Democrats say Trump’s “culture of corruption” is making people sick

Peggy Price, a mother and retired Marine Corps sergeant, was livid when she recently learned that the Environmental Protection Agency had delayed the release of a study exposing large-scale contamination of water sources with perfluoroalkyls. The chemical compounds, also called PFAS, have tainted 126 water systems at or near U.S. military bases across the country and are linked to cancer and a host of other health problems, affecting the reproductive system and major organs like the liver.

Price was stationed at Camp Lejeune in North Carolina in the early ‘80s. The base was the site of one of the most notorious contaminated water cases in American history. It wasn’t until an exposé in 2000, that she learned her family’s many health battles stemmed from her time at Lejeune — and she’s infuriated that officials are still trying to keep the public in the dark about water crises.

“The rest of my life has become a battlefield of cancer, disease, and mental health disorders for me, my two sons, and my two daughters,” said Price, fighting back tears as she spoke at a Congressional forum Wednesday.

On the heels of Scott Pruitt’s ouster as EPA administrator, Democrats held the forum where party members pointed to a “culture of corruption” that they say is not only harming the environment, but making people sick. Their rhetoric falls in line with a larger Democratic strategy of calling out the Trump administration on its pervasive double-dealing, which it hopes will spur a blue wave during this year’s midterm elections.

“From the start, this president’s toxic team has chosen to help special interests at the expense of everyday Americans,” said first-term Virginia Congressman Donald McEachin as he opened Wednesday’s event, convened by the Democratic Environmental Message Team.

In May, Democrats announced a series of proposals that they say aim to “get rid of the corruption that’s led to such a dysfunctional political system in Washington.” At the top of the their agenda is a commitment to reign in the influence of special interest groups and lobbyists. Pruitt and his successor Andrew Wheeler have been top targets of the left’s finger pointing due to their links to oil and coal companies, respectively.

“While the news of Scott Pruitt’s resignation last week was great to hear — especially after his role in suppressing the study — I’m still worried.” said Sergeant Price, referring to the PFAS report. “The government has never taken contaminated water seriously, and under Trump and Pruitt it’s been worse.”

Along with House Minority Leader Nancy Pelosi, several members of Congress, and other invited guests highlighted the Trump administration’s attempts to roll back protections established through the Clean Air Act and the Clean Power Plan. This administration and the Republican Congress “have unleashed an unprecedented attack on public health,” said Earl Blumenauer from Oregon. “And I’m not just talking about their unrelenting assault on the Affordable Care Act, but public health, in terms of air and water.”

Though it was Democratic leaders who had invited Sergeant Price to Washington to speak at their forum, her message for greater transparency wasn’t just aimed at Republicans but at all legislators.

“We need the members of Congress to carry out strong oversight of agencies and to demand greater transparency so the public can know what’s happening,” she said, referring again to the PFAS study. “If this affects us, we have the right to know.”

Losing Justice Kennedy puts fundamental environmental protections in peril

In a letter hand-delivered to President Trump on Wednesday, Justice Anthony Kennedy announced his retirement after 30 years on the Supreme Court.

Trump has already hinted at a list of potential replacements — all of whom are likely to side with the court’s now clear conservative majority. Kennedy has been the swing vote for decades. And without his moderating influence, advocates of the environment will face a steep challenge in winning over a majority of the justices.

With time quickly running out before the world locks in dangerous levels of climate change, that’s a frightening proposition. A more conservative-leaning court could make broad modifications to U.S. law that could last for decades. With environmental protections weakened, future presidents who want to take action on climate will have a much tougher time making lasting policy decisions.

It’s not an exaggeration to say that, when it comes to climate change and environmental protection, the next Supreme Court justice’s opinions will have consequences that are planetary in scope.

Since the implications of a solidly conservative Supreme Court are so far-reaching, Grist reached out to several environmental law experts to learn which specific rulings and regulations could be most at risk. Responses were lightly edited for clarity.

Massachusetts vs. EPA: Gives the government authority to regulate greenhouse gases as pollutants.

Justice Kennedy was in the majority on Massachusetts v. EPA. It would be quite something if a new court, by a 5-4 decision, opted to reverse such recent precedent. But given what we have seen in the last few days [from the Supreme Court], it’s not impossible to see it happening.

The Clean Air Act and climate protections are most at risk. Kennedy was the deciding vote on Massachusetts v. EPA, which reaffirmed the Clean Air Act as the most important mechanism for regulating greenhouse pollution economy-wide. We’re one vote away from losing fundamental protections for our climate.

“Waters of the United States” Rule: Provides protection to some wetlands.

The Trump Administration’s proposal to rescind the Obama-era Waters of the United States Rule — which would curtail the federal government’s authority to limit pollution in wetlands and other smaller bodies of water under the Clean Water Act — may well ultimately end up before the Supreme Court. Justice Kennedy’s replacement will influence how we protect our air and water, as well as how we respond to climate change, for generations to come.

Clean Power Plan: Limits greenhouse gas emissions from power plants.

I’m particularly concerned about the regulations that the Trump administration will introduce to replace Obama-era climate protections — for example the replacement to the Clean Power Plan. The administration will no doubt be gutting some of these rules and potentially violating statutory mandates in the process. It’s much more likely that the Supreme Court will uphold the replacement rules with another Trump nominee replacing Kennedy.

​There is a good chance that the new justice will go along with the other conservative justices in narrowly reading the regulatory authority that statutes like the Clean Air Act and the Clean Water Act give to EPA and other federal agencies. This could be bad news if the next President tries to revive something like the Clean Power Plan, which was widely portrayed as pushing the envelope of EPA’s authority — an issue the courts still haven’t decided.

Standing: Allows plaintiffs to bring environmental grievances to court more often.

My main concern is how the newly configured court will interpret environmental groups’ standing to sue to enforce federal laws. Justice Kennedy had a nuanced take on standing, and it is likely that Trump’s nominees will have a more blunt approach, one that seeks to significantly curtail the ability of these groups to get into court.

The future for environmental laws or standards:

Litigation is often the only option for those seeking to protect air and water and ensure public input on the value of sensitive ecosystems, endangered species, other wildlife species, and for those wanting to preserve important national landscapes. My general thought is that Kennedy was the last bulwark of reasonableness against the Trump Administration’s environmental onslaught. Every environmental lawyer I know is incredibly fearful of what this retirement will mean for the future of environmental protection in the United States.

I think just about any environmental rule that makes its way to the Supreme Court after Kennedy’s successor is appointed will be in jeopardy. We already have four hyper-conservative justices who tend to vote along ideological/party lines — and antipathy towards regulation, particularly environmental regulation, is a core part of that ideology. I have no doubt that Trump will nominate another conservative justice who shares his anti-regulation agenda. Through this justice, Trump will be able to continue advancing his deregulatory agenda for years after he his presidency ends.

Here’s What President Obama Just Promised the World in the Fight Against Climate Change

Charlie Riedel/AP This morning, hours ahead of a looming deadline, the United Stats released its formal submission to the UN in preparation for global climate talks that will take place in Paris later this year. Known as an “intended nationally determined contribution,” the document gives a basic outline for what US negotiators will pony up for an accord that is meant to replace the aging Kyoto Protocol and establish a new framework for international collaboration in the fight against climate change. The US submission offered few surprises and essentially reiterated the carbon emission reduction targets that President Barack Obama first announced in a bilateral deal with China in November: 26 to 28 percent below 2005 levels by 2025. The document then gives a rundown of Obama’s climate initiatives in order to demonstrate that the US goal is attainable with policies that are already in place or are in the works. Chief among those policies is the Clean Power Plan, which sets tough new limits for carbon emissions from the electricity sector, with the aim to reduce them 30 percent by 2030. // <![CDATA[ DV.load(“//www.documentcloud.org/documents/1698605-un-indc.js”, width: 630, height: 800, sidebar: false, container: “#DV-viewer-1698605-un-indc” ); // ]]></script> UN INDC (PDF) UN INDC (Text) With today’s announcement, the US joins a handful of other major polluters, including Mexico and the European Union, in formally articulating its Paris position well in advance. In a series of earlier UN meetings over the fall and winter, negotiators stressed that setting early delivery dates for these pledges was important so that countries will have time to critique each others’ contributions in advance of the final summit in December. But although the deadline is today, many other key players—including China, Brazil, Russia, Japan, and India—have yet to make an announcement. Environmental groups’ immediate reactions to the US submission were mostly positive. “The United States’ proposal shows that it is ready to lead by example on the climate crisis,” World Resources Institute analyst Jennifer Morgan said in a statement. “This is a serious and achievable commitment.” At least one leading Republican offered an equally predictable rebuttal, according to the AP: “Considering that two-thirds of the US federal government hasn’t even signed off on the Clean Power Plan and 13 states have already pledged to fight it, our international partners should proceed with caution before entering into a binding, unattainable deal,” said Senate Majority Leader Mitch McConnell, R-Ky. 50 Years After Its Discovery, Acid Rain Has Lessons for Climate Change

Mary Terriberry/Shutterstock In the 1980s, the dying red spruce trees of New England—many of them taller than eight-story buildings and more than three centuries old—furnished frightening proof of the power of acid rain. The trees were seen as a canary in the coal mine, and it was easy to imagine the ensuing consequences for the forest at large. “Half the red spruce… are dead,” Dudley Clendinen wrote for The New York Times from New Hampshire in 1983. “Some of the balsam fir are beginning to look sick. Sugar maples have fallen, as have beech trees, and Dr. Richard M. Klein, one of the two directors of the university’s research project, worries that with spring, they may find that ash trees are down on the mountain, too.” The prospect of dead forests galvanized Americans and their representatives. In 1990, Congress amended the Clean Air Act to include the Acid Rain Program. The impact on the targeted pollutants, sulfur dioxide and nitrogen oxides from power generation, was remarkable.
