Trump’s EPA just introduced a historic CO2 rule for planes. Wait, what?

Cars, power plants, and some buildings are subject to fuel and energy efficiency standards in the United States. Believe it or not, up until now, the nation’s aviation industry has been free to do whatever it wants when it comes to emissions. Left to their own devices, U.S. airlines have let their carbon emissions steadily rise and their fuel efficiency gains stagnate. Between 2016 and 2018, emissions rose 7 percent while fuel efficiency improved by a measly 3 percent.

On Monday, the Environmental Protection Agency (EPA) introduced the U.S.’s first-ever CO2 standard for airplanes. The rule would impose regulations restricting emissions from the aviation industry — something many other developed countries have already done. The EPA hasn’t released the full proposal yet, which means details about what the rule will actually do are still TBA.

But isn’t Trump’s EPA certifiably averse to regulating polluters in any way, shape, or form? To say that the current administration hasn’t made emissions standards a priority would be an understatement. In fact, the Trump administration is facing threats of lawsuits from environmental groups over its recently finalized rule weakening fuel efficiency standards for vehicles.

While the EPA’s new CO2 standard for airplanes is historic, it doesn’t necessarily signal that the agency is changing its industry-friendly ways. The EPA has basically had its hand forced by both domestic green groups and an international regulator.

The rule’s long and tortuous journey began in 2010, when a group of environmental organizations sued President Obama’s EPA for neglecting to regulate emissions from ships and airplanes. A year later, the U.S. District Court for Washington, D.C., ruled that the EPA had to make a determination on whether emissions from planes posed a threat to public health. If the answer to that question was yes, the agency would have to create new regulations limiting those emissions. In 2016, green groups filed another lawsuit against the agency for neglecting to finalize the court-mandated evaluation of whether emissions from planes are harmful to public health. The EPA finally did so later that year, finding that plane emissions are indeed harmful. But the agency has dragged its feet on proposing the actual emissions regulation until now.

Daniel Rutherford, shipping and aviation director at the nonprofit International Council on Clean Transportation, says airplane manufacturers are eager for the rule to take effect. “Without a CO2 standard, Boeing and Gulfstream, for example, can’t sell their aircraft internationally in the future,” he said. That’s because of standards set by the U.N.’s International Civil Aviation Organization (ICAO), which was formed at the behest of the U.S. toward the end of World War II to help the booming aviation industry achieve uniformity. American manufacturers have been meeting ICAO’s emissions standards voluntarily, but in the future, the lack of EPA pollution standards for planes will hinder their ability to be competitive in the international market. Starting in 2023, Boeing and other manufacturers will need to recertify their existing aircrafts under the EPA’s forthcoming standard, otherwise they won’t qualify for sale under ICAO’s guidelines. In other words, it’s a matter of paperwork.

Rutherford emphasized that ICAO’s guidelines aren’t exactly the gold standard — they compel airlines to do the bare minimum, and the strictest ICAO requirements won’t even take effect until 2028. Green groups hoped the U.S.’s standards would be more stringent. “The trick with ICAO is that it tends to introduce what we call ‘technology-following standards,’ so instead of looking ahead and setting new poles for technology, it tends to say, ‘OK, let’s see what’s already developed and see that it’s deployed in all aircrafts,’” Rutherford said. ICAO’s recommendations might’ve been groundbreaking a decade ago, but most new aircrafts already meet the recommendations easily. “It’s very clear that the standard as ICAO proposed and probably as the EPA will propose itself is too weak to reduce emissions” by much, he said.

But the EPA’s rule could still change to become more planet-friendly. Once the rule is released, the public will have an opportunity to comment, a process that could take a month or more. After that, the EPA will have to finalize the rule, which typically takes about a year, which means the process will stretch into the next administration. If that administration is Democratic, it could scrap the original version of the rule and go back to the drawing board.“There might be an about-face on the requirements for the final rule,” Rutherford said, “but it’s really dependent upon the presidential election.”

Oil and gas leasing rejected in Wyoming because, well, climate change

A federal judge has blocked drilling on roughly 300,000 acres of public land in Wyoming because the Department of Interior failed to take climate change into account when auctioning off the land for oil and gas leasing.

U.S. District Judge Rudolph Contreras ruled that officials from the Interior’s Bureau of Land and Management (BLM) should have considered climate change risks such as greenhouse gas emissions linked to the drilling before making the decision.

“By asserting that these crucial environmental analyses are overly speculative at the leasing stage and more appropriate for later, site-specific assessments, BLM risks relegating the analyses to the ‘tyranny of small decisions,’” Contreras wrote in his memorandum opinion.

In other words: Putting off decisions about climate impacts is no longer an option.

Under the National Environmental Policy Act of 1969, federal agencies must identify and understand the environmental effects of proposed actions, and inform the public of those effects so that its opinion could be involved in the decision-making process.

Failing to consider both environmental degradation and climate change in government policy has been a trend since the first day of the Trump administration. In just the past two years, we’ve seen shortsighted plans to boost the coal industry, withdrawal from the Paris Agreement, and attempts to roll back a slew of federal regulations on extraction of coal, oil and gas, and most recently mercury.

Just Wednesday morning, Environmental Protection Agency Administrator Andrew Wheeler told CBS This Morning that climate change’s effects were decades away, despite the fact that numerous scientific reports — including from his own government — contradict that assertion.

“Climate change is an important issue that we have to be addressing, and we are — but most of the threats from climate change are 50 to 75 years out,” Wheeler said. In fact, the impacts of climate change have been much more immediately evident in air quality in Texas, record-breaking flooding in Nebraska, and out-of-season wildfires in Oregon.

The judge’s decision is overdue pushback on the Trump administration’s policy of ignoring the climate impacts of its agenda. Now, BLM has to redo the environmental assessment with a more realistic view of our climate situation. Until then, Contreras will continue to block any leases.

This map shows the 5 hottest midterm races for climate

Earlier this fall, the world’s top climate scientists gave humanity about 10 years to avoid a future that really sucks. With the midterm elections right around the corner, that warning means voters are effectively deciding which candidates to trust with the keys to the climate. If voters are sufficiently worried about warming, that anxiety might help determine who is put in office.

According to Anthony Leiserowitz, director of the Yale Program on Climate Change Communication, worry is a stronger predictor of policy support than other emotions. “We found that it’s not fear, it’s not anger, and it’s not disgust or guilt,” he explained. “Worry doesn’t hijack, doesn’t overwhelm, rationality. It can really spur it.”

So just how worried about the planet’s future are voters in the nation’s tightest congressional races? Grist created a map overlaying competitive elections, as identified by The Cook Political Report, with climate concern data from Yale’s 2018 Climate Opinion Maps.

These toss-up elections are spread throughout the country. Some are sprawling rural districts, others are comprised primarily of dense cities or metro areas. (Keep in mind that congressional districts vary in size, but each holds roughly the same number of people.) Each district varies in what percentage of its constituents report being worried about climate change — represented from yellow (not that worried) to red (pretty worried).

Interestingly, even in those districts where folks seem less concerned about climate change, a majority of people worry about it. Most of the seats in play are currently held by Republicans. And while several Democrats have doubled down on environmental policies, like renewable energy, climate change is a bipartisan issue in many of these communities.

Look closely at the map, and you’ll see a handful of neck-and-neck races in places chock full of climate-worriers. These communities range from the beaches of Miami and Southern California to the suburbs of Houston. Grist examined five of these highly climate-concerned toss-up districts to see what local factors may shift the balance of power in Congress.

California 48th district (67 percent of residents are worried)

California’s 48th congressional district includes much of coastal Orange County, and the local midterms are about as melodramatic as an episode of The O.C.

Republican Dana Rohrabacher has represented this affluent, conservative bastion in a deep-blue state since 1989, but his seat is in play due in part to a few recent scandals: He had more than one clandestine meeting with Marina Butina, the former NRA darling arrested on suspicion of Russian espionage and election interference. That’s landed him on the radar of the Mueller investigation — and in hot water with voters. “They call me Putin’s best friend,” he told ABC last year. “I’m not Putin’s best friend.”

But even Republicans who deny Russian entanglements can’t get away with denying climate change in this sea-level community. The district’s stunning coastlines — from Huntington Beach to Laguna Beach — could see chronic flooding by 2030. That science isn’t lost on homeowners in the area, says Ray Hiemstra, co-chair of the Sierra Club’s Angeles Chapter Political Committee. “They’re actually starting to think, ‘Maybe I should start thinking of selling my place.’”

Rohrabacher says he supports solar and nuclear energy, as well as expanding oil and gas production. The staunch Trump supporter has stated in the past that offshore drilling is safer than importing oil on tankers, pointing to incidents such as the 1984 American Trader spill. In contrast, his opponent, Democratic candidate Harley Rouda, says he’ll promote clean energy while pushing back on offshore drilling efforts.

Florida 26th district (67 percent are worried)

The tides are already lapping at the door in the low-lying Florida Keys. Within the century, scientists predict that much of South Florida could be underwater.

It’s no wonder that residents in Florida’s 26th congressional district — the state’s southernmost region which includes all three of its national parks, as well as part of Miami-Dade County — are some of the Americans who are most concerned about climate change in the nation. Almost 70 percent of its constituents are Latino, most of them Cuban-American. Polls show that Latinos consistently want climate action more than the population at large.

So what are people most concerned about? In addition to king tides, Elizabeth Bonnell, chair of the Sierra Club’s Miami Group, points to “climate gentrification” — when developers buy up future beachfront properties in low-income neighborhoods, pushing out current residents. Then, there’s the stifling heat, toxic algae, and dangerous hurricanes that have been brewing in the Atlantic recently.

The seat is one of the top 10 House races to watch in 2018, according to Politico. But District 26 is a special place where both candidates running for the House seat — yes, including the Republican — have explicitly backed climate action.

Incumbent Carlos Curbelo is one of only a handful of Republicans to openly address climate change. In February 2016 he co-founded the bipartisan Climate Solutions Caucus, which earned him a spot on the 2017 Grist 50 list. But this year, in the wake of Hurricane Michael, Curbelo called people who linked the historic storm, which intensified rapidly thanks to the Gulf of Mexico’s warmer-than-normal waters, climate change “alarmists.” The stance earned him some criticism.

“Those of us who truly care about #climatechange must be sober when discussing its connection to #HurricaneMichael or any other storm,” Curbelo tweeted. “Florida has had hurricanes for centuries. There’s no time to waste, but alarmists hurt the cause & move our fight for #climatesolutions backward.”

One week out from the election, the race is narrowing. And Democratic challenger Debbie Mucarsel-Powell, a former associate dean at Florida International University, has made the environment a key component of her political ads.

Texas 7th district (65 percent are worried)

The Texas 7th is affluent, well-educated, largely residential — and as a result of Hurricane Harvey, still recovering from being underwater for a chunk of 2017.

While the east side of Houston has long been infamous for its oil and gas infrastructure, the more affluent west side is becoming increasingly vulnerable to climate change in the form of freak storms. It has suffered extensive flooding from Harvey and at least two other storms in the past five years.

Republican John Culberson has represented Texas 7th since 2001. As he faces a tough reelection this year against Democratic challenger Lizzie Pannill Fletcher, he’s largely avoided talking about climate change, including declining an invitation in January to a community climate forum held in his district. While he has eschewed those exact words during his re-election bid, Rep. Culberson has used last year’s hurricane as a major talking point, name-dropping the storm in more than half of his emails to voters this year.

“He hasn’t been one of the snowball throwers calling climate change a hoax,” said Daniel Cohan, an environmental engineering professor at Rice University. “But he takes a wait-and-see attitude, falsely indicating that the science isn’t clear.”

For a district that’s borne the brunt of so many environmental disasters, it’s unclear how much sway climate change will have over the results of this race. According to Mark Jones, a political scientist at Rice University’s Baker Institute for Public Policy, there may not be enough swing voters in the Texas 7th who care about the issue. Those that do care already know how they’re voting. But Jones adds, there are “not an insignificant number” of voters who are still grappling with Harvey and could be potentially influenced by talk of climate policy.

Texas 32nd district (65 percent are worried)

Texas has a lot of skin the game when it comes to climate change. A National Oceanic and Atmospheric Administration (NOAA) scientist once dubbed the state “the disaster capital of the United States” for its unique meteorological conditions.

Texas’ 32nd congressional district, which includes the suburbs northeast of Dallas, saw unprecedented rains and flooding in September and October. The storms led to multiple deaths in the Dallas area. An extreme drought and heat wave this past summer resulted in a remarkable uptick in heat-related hospital visits.

Like Texas overall, the 32nd is a “majority-minority” district: 49 percent white, 25 percent Latino, 15 percent black, and eight percent Asian. Environmental polls have shown that people of color are more likely to care about climate change compared to white people. And the district’s demographics are now colliding with extreme weather to drive climate concern.

At least for now, climate politics in the 32nd — which is more affluent than much of the state — are traditionally partisan. Pete Sessions, the incumbent Republican who’s represented the district (and its previous incarnation, District 5) since 1997, has a lifetime score of two percent from the League of Conservation Voters, indicating a strong anti-environment record. Sessions’ campaign platform includes “reining in the EPA” and opening public lands for drilling. When Sessions was questioned early last year about his support for controversial EPA head Scott Pruitt, he hanged the subject, putting the blame on New York and the Northeast for polluting America.

Sessions’ main opponent, Democrat Colin Allred, is an ex-football player and current civil rights attorney whose main focus is on reducing voter disenfranchisement. His environmental platform states he believes in promoting investment in renewable energy, “rejoining” the Paris climate accord, and defending the independence of the EPA and NOAA.

New Jersey 7th district (64 percent are worried)

New Jersey’s 7th congressional district stretches from New York City’s western suburbs all the way to the banks of the Delaware River. Not only does the river serve as the water supply for more than 15 million Americans, but it’s also a source of considerable climate worry for constituents.

Polluted runoff finds its way into waterways which add to the district’s rising rivers, damaging families, homes, and businesses. Climate change-related flooding threatens the quality of life across the district according to Ed Potosnak, executive director of the New Jersey League of Conservation Voters. “That’s where lack of action by Congress has left families vulnerable,” he told Grist.

New Jersey is the most densely populated state in the U.S., and the district runs the socioeconomic gamut, with a mix of suburban, exurban, and rural communities.

Republican Congressman Leonard Lance has represented the district since 2009. He’s also a member of the Climate Solutions Caucus. Though Lance has been a rare voice espousing the reality of climate change within the GOP, he also has a track record of siding with big business and the fossil fuel industry on legislation. Lance has a lifetime score of 23 percent on the League of Conservation Voters’ scorecard, hardly the marks of an environmentalist.

Lance’s opponent, Democrat Tom Malinowski, is new to New Jersey, but not to politics. He served as Assistant Secretary of State for Democracy, Human Rights, and Labor under President Obama. According to the League of Conservation Voters, he has dedicated his career to people’s rights to breathe clean air and drink clean water. Like his opponent, Malinowski has stated he believes that humans are exacerbating climate change. He has promised to oppose pipelines that will run across the state and has spoken out against offshore drilling,

Like Texas overall, the 32nd is a “majority-minority” district: 49 percent white, 25 percent Latino, 15 percent black, and eight percent Asian. Environmental polls have shown that people of color are more likely to care about climate change compared to white people. And the district’s demographics are now colliding with extreme weather to drive climate concern.

At least for now, climate politics in the 32nd — which is more affluent than much of the state — are traditionally partisan. Pete Sessions, the incumbent Republican who’s represented the district (and its previous incarnation, District 5) since 1997, has a lifetime score of two percent from the League of Conservation Voters, indicating a strong anti-environment record. Sessions’ campaign platform includes “reining in the EPA” and opening public lands for drilling. When Sessions was questioned early last year about his support for controversial EPA head Scott Pruitt, he hanged the subject, putting the blame on New York and the Northeast for polluting America.

Sessions’ main opponent, Democrat Colin Allred, is an ex-football player and current civil rights attorney whose main focus is on reducing voter disenfranchisement. His environmental platform states he believes in promoting investment in renewable energy, “rejoining” the Paris climate accord, and defending the independence of the EPA and NOAA.

New Jersey 7th district (64 percent are worried)

New Jersey’s 7th congressional district stretches from New York City’s western suburbs all the way to the banks of the Delaware River. Not only does the river serve as the water supply for more than 15 million Americans, but it’s also a source of considerable climate worry for constituents.

Polluted runoff finds its way into waterways which add to the district’s rising rivers, damaging families, homes, and businesses. Climate change-related flooding threatens the quality of life across the district according to Ed Potosnak, executive director of the New Jersey League of Conservation Voters. “That’s where lack of action by Congress has left families vulnerable,” he told Grist.

New Jersey is the most densely populated state in the U.S., and the district runs the socioeconomic gamut, with a mix of suburban, exurban, and rural communities.

Republican Congressman Leonard Lance has represented the district since 2009. He’s also a member of the Climate Solutions Caucus. Though Lance has been a rare voice espousing the reality of climate change within the GOP, he also has a track record of siding with big business and the fossil fuel industry on legislation. Lance has a lifetime score of 23 percent on the League of Conservation Voters’ scorecard, hardly the marks of an environmentalist.

Lance’s opponent, Democrat Tom Malinowski, is new to New Jersey, but not to politics. He served as Assistant Secretary of State for Democracy, Human Rights, and Labor under President Obama. According to the League of Conservation Voters, he has dedicated his career to people’s rights to breathe clean air and drink clean water. Like his opponent, Malinowski has stated he believes that humans are exacerbating climate change. He has promised to oppose pipelines that will run across the state and has spoken out against offshore drilling,

Politicians usually like to play it safe with their campaign ads: American flags, factories, Labrador retrievers, and kids in suspenders. The environment doesn’t typically (if ever) make an appearance minus a pretty backdrop for an American flag.

But this year is different. A burst of political advertisements about the changing climate has hit television screens across the country. Could it be a sign that some politicians might soon stop avoiding climate change like the plague (and starting talking about it like… well, an actual plague)?

The New York Times tracked down those ads — there are more than a dozen out there. And I spent the day watching them all so you don’t have to. The following takeaways are NOT endorsements. Nothin’ like tearing apart some political ads on a Friday afternoon.

Say “jobs,” not “climate change”

Renewables. Are. Big. Clean energy seems like the safest way for politicians to talk about climate change without coming on too strong or like too much of an environmentalist, heaven forbid. Take Rhode Island Governor Gina Raimondo’s ad, titled “The Ocean State.” In the 30ish-second ad, the Democrat touts her state’s clean energy credentials. “We’re now the only state with an offshore wind farm,” she says, standing on a boat (with — you guessed it — an American flag flying in the background). She never mentions the words “climate change,” instead taking the tried-and-true approach of linking the project to potential economic growth.

Green is the new extreme sport

Democratic Congressperson Michelle Lujan Grisham of New Mexico’s 1st District took a less traditional approach in her ad for governor. She climbed 265 feet to the top of a wind turbine to prove she’ll go the extra mile (or foot) for renewable energy. Did she impress viewers, or just give them vertigo? We’ll find out on November 6.

The environment = anti-Trump ammo

Other politicians used climate change as fodder to slam President Trump in their ads, doubling down on partisan politics. Sean Casten, a scientist running in Illinois’ 6th Congressional District, tore into the president’s history of climate skepticism. “This facility is on the leading edge of clean energy,” Casten says, standing in front of some expensive-looking monitors. “Donald Trump doesn’t think we need it because he thinks climate change is a hoax.”

It makes for pretty, pretty policy

Steve Sisolak, Nevada’s Democratic candidate for governor, has a “bold environmental vision” for his state. His ad starts in front of a sad-looking lagoon, but quickly transitions to Instagram-worthy drone footage of solar farms. He says he wants to protect Nevada’s national monuments, like Golden Butte, and ends with a pledge to uphold the Paris agreement and the Clean Power Plan.

Climate is at least bipartisan-curious

OK, so there weren’t a horde of Republicans releasing ads in favor of reducing emissions. But at least one Republican representative, Carlos Curbelo of Florida’s 26th District, was down to bring climate change up in his ads — maybe not too surprising for a guy whose district is at sea-level. Curbelo is one of the founding members of the Climate Solutions Caucus, a bipartisan effort to get politicians in Congress to act on climate change. He also appears on our Grist 50 list, though he somehow neglected to mention that in his campaign video.

“I just call ‘em like I see him,” Curbelo says in his T.V. spot, which seems to take place entirely on a basketball court for some reason. “The right didn’t do enough for our environment.” The ad also features a 2018 quote from the National Wildlife Federation, which calls him a leader on climate change. Are politicians ready to stop swerving climate change in their campaigns? A dozen or so ads isn’t a seismic shift in the way politicians approach this issue. But it’s a start!

Think the climate change lawsuit is dead? It’s just beginning.

Another climate change accountability lawsuit appears to have died. RIP. But take heart, you fine-feathered climate hawks. No man is an island, but every court is.

As you may recall, in January, New York City sued ExxonMobil, Chevron, BP, Shell, and ConocoPhillips, alleging that the companies had purposefully misled the public about the effects of climate change in order to keep raking in money.

United States District Judge John F. Keenan tossed the lawsuit straight in the proverbial trash can on Thursday. “Global warming and solutions thereto must be addressed by the two other branches of government,” Judge Keenan said.

Fat chance of that happening anytime soon.

Just last month, a U.S. district judge dismissed similar complaints against major oil companies brought by Oakland and San Francisco. “Using lawsuits to vilify the men and women who provide the energy we all need is neither honest nor constructive,” said R. Hewitt Pate, Chevron’s vice president and general counsel.

Both the California and New York suits were part of a wave of climate accountability lawsuits taking place across the country, from Rhode Island to Colorado to King County, Washington.

So are all these climate suits going to evaporate? Not quite.

“It’s easy to see this decision as momentum,” said Michael Burger, executive director of Columbia University’s Sabin Center for Climate Change Law. But “no other court is bound by this decision. It’s as simple as that.”

Just because one judge rules a certain way doesn’t mean other judges looking at similar cases will make the same decision. “Each judge and each panel of appellate judges is going to look at these issues independently until it gets resolved by some higher court,” Burger said.

What’s more, the New York lawsuit is likely to get appealed. That means it could get pulled out of that same proverbial trash can, dusted off, and sent along to the federal court of appeals. So Big Oil isn’t out of the woods quite yet. If a higher court does ultimately side with polluters, however, lower courts would likely follow that precedent.

Burger doesn’t know, ultimately, whether the dismissal of the New York case will change the outcome of the other climate suits. But he isn’t the only law expert who thinks this isn’t necessarily the end of the line.

“We remain optimistic that the majority of these cases will end up in state court where they belong, and that taxpayers will ultimately prevail in their efforts to recover costs,” Richard Wiles, executive director of the Center for Climate Integrity said in a statement.

America’s fastest-growing urban area is stuck between a rock and a dry place

When Latter-day Saint migrants arrived in Utah in 1847, a verse in Isaiah served as consolation to them in the desiccated landscape: “The wilderness and the solitary place shall be glad for them; and the desert shall rejoice, and blossom as the rose.”

Lately, the desert has blossomed nowhere more than the St. George area, in the state’s southern reaches. The city is a picturesque outpost, with red-rock desert framing bright green lawns and golf courses, all built around the stark white Mormon temple in the center of town.

Brigham Young’s adherents came here to grow crops, primarily cotton — hence its reputation as Utah’s Dixie. Today, that ceaseless sunshine is luring so many tourists, retirees, and students that St. George has become the fastest-growing metropolitan area in the country. According to Census Bureau data released in March, the metro, home to 165,000 people, grew 4 percent between 2016 and 2017.

“Six million people visit the area every year. As people visit here, some of them decide to stay,” St. George Mayor Jon Pike said. The area remains a retirement community, “but we also have 33,000 students K through 12, and we have a fast-growing university [Dixie State University].” Healthcare is a booming industry, and, like many growing cities, St. George has a section of town earmarked for tech companies. Mixed-use developments are popping up downtown. The growth likely won’t slow any time soon: State demographers believe the area will surpass 500,000 residents by 2065.

As is the case with other growing desert burgs, St. George grapples with water-supply issues. But the challenge here is unique. Remarkably cheap rates mean that residents of an area with only eight inches of annual rainfall are using tremendous amounts of water. An average St. George resident uses more than twice as much water as the average citizen of Los Angeles.

Political leaders at the state and local level view this primarily as a supply issue. Their preferred solution is a gargantuan $1.4 billion pipeline that would connect the region with Lake Powell, a reservoir along the Colorado River. With the aid of pumping stations, the pipeline would shuttle water over 140 miles and 2,000 feet of elevation gain. The goal is to store 86,000 acre-feet a year in nearby reservoirs and aquifers — more than enough, officials say, to meet the demand of the growing population and decrease reliance on the dwindling Virgin River, currently Washington County’s primary water source.

“We certainly are committed to conservation, but we don’t think that gets you there alone, especially with the organic growth and the tremendous in-migration that’s occurring in the Southwest,” said Ronald Thompson, general manager of the Washington County Water Conservancy District, the wholesaler that supplies water to St. George and other cities in the county.

In 2006, the state legislature passed a bill to fund the Lake Powell project, but construction has been delayed since then by stop-and-go planning (at this point, pipeline approval is on hold due to uncertainty about which federal agency has jurisdiction over the project).

Multiple state and regional environmental groups say the pipeline is far too aggressive, and that basic conservation measures can meet the region’s water demand. Amelia Nuding, senior water analyst for Western Resource Advocates, believes regional leaders should focus on three strategies to achieve quick conservation success: better data collection, higher water rates, and building codes that require water-smart construction and landscaping. Not only would that meet St. George’s water needs, according to Nuding’s group, but it would avoid further depleting an already burdened Colorado River.

Utah typically uses less than its allotted share of Colorado River water, which is divvied up among Western states, but climate change and growing populations are taxing relations among the river’s interstate constituents. “Yes, [Utah residents] are legally entitled to that water from the Colorado River,” Nuding said. “But … I think that we should meet certain metrics of water stewardship before further depleting the Colorado River.”

Leaders have, for the most part, ignored environmentalists’ suggestions. Water-use data in Utah is scant; until recently, statewide water surveys took place only every five years. In 2010 — the latest state data available — the St. George region’s per-capita consumption was 325 gallons per day. More current numbers from the city suggest conservation; St. George proper uses 250 gallons per person per day. Nonetheless, it’s still consuming more water than other Southwest cities. Las Vegas takes about 220 gallons per person each day; Tucson, considered a regional leader, uses 120.

Water rates here don’t punish heavy use. A St. George household that goes through 16,000 gallons a month would see a $47 water bill; equivalent usage would cost a Tucson household $184. Washington County Water Conservancy District is in the process of raising rates 5 to 10 percent each year until baseline rates are tripled, but even then, they would be a bargain compared to some cities.

Utah’s water-delivery systems are largely gravity-fed, thus keeping costs down, and most homeowners have access to unmetered non-potable water for landscaping and irrigation. This, plus state oversight of water rates, keeps the rates low — and consumption high.

Any major reduction in consumption here will require a cultural shift. St. George is marketed as a desert oasis. Nine golf courses are located in the region, and it remains an agricultural stronghold. Local municipalities offer basic water-conservation rebates — St. George, for instance, helps cover the cost of replacing high-flow toilets — but nothing at the level of cities that, for instance, pay residents to replace sod with desert-appropriate landscaping.

Mayor Pike heralded developers who are voluntarily choosing water-smart appliances and landscaping, and cited the planned Desert Color community as an example. But that project’s water-wise cred has been questioned: Its centerpiece is an 18-acre artificial pond.

That said, St. George’s growth could inherently promote efficiencies. Apartment and townhouse construction is finally catching up with demand, which will keep some new residents from the sprawling single-family homes and yards that guzzle so much water. A good deal of new construction will take place on agricultural land where water is already allocated.

But per-person efficiency doesn’t mean less water use overall. Every St. George resident could cut her water use in half, but if the population more than doubles, the city is still using more water. Such is the conundrum of desert growth. “We’d be wise to diversify our sources,” Pike said. “If the Powell pipeline isn’t built, that would change things. … It would slow growth.”

Constructing the pipeline, oddly enough, might trigger cost increases that could curtail water use. While the state would cover the pipeline’s initial costs, locals are on the hook in the long run. In a letter to Utah’s governor, economists at state universities said that water rates would have to jump sixfold for the region to meet its repayment obligations. “Of course, increasing water rates this much would significantly decrease Washington County residents’ demand for water,” the economists wrote. “In our analysis, demand decreased so much that the [Lake Powell pipeline] water would go unused.”

If rates are going up anyway, conservation advocates think the pipeline talk is occurring too soon. “Why don’t they just try [raising rates] now, and see how much demand changes?” Nuding said. “From a water-management perspective, that makes all the sense in the world.”

In this blossoming desert city, leaders have a choice: Do they let the roses go brown, or pay exorbitantly to keep them?

Trump administration to replace Clean Power Plan with ‘dirty power plan’

President Donald Trump claimed in September that he did away with the Clean Power Plan, one of the Obama administration’s most ambitious efforts for tackling climate change. The plan was the first to set a limit on carbon pollution from existing power plants. Dispensing with the regulation, Trump told a rally in Alabama, was simple as, “boom, gone.”

Of course the reality is more complicated. Because the Clean Power Plan is a finalized regulation from the EPA, the agency also has to put forward its justification for repealing it. During an appearance on Monday at the coal-mining town of Hazard, Kentucky, administrator Scott Pruitt announced his plans to sign the draft proposal to repeal the 2015 climate rule.

“The war on coal is over,” Pruitt said. “Tomorrow in Washington, D.C., I will be signing a proposed rule to roll back the Clean Power Plan. No better place to make that announcement than Hazard, Kentucky.”

The Clean Power Plan was crafted to cut carbon pollution from existing power plants 32 percent by 2030, by having states devise their own proposals for creating a pollution-cutting mix of renewables, gas, nuclear, and energy efficiency. But the Supreme Court stayed the rule in 2015, so its implementation stalled while the U.S. Court of Appeals for the District of Columbia Circuit heard the case brought by 26 states and coal companies like Murray Energy, which is owned by Trump donor Bob Murray. So far, the court hasn’t ruled, waiting to see what the Trump administration does next.

Another wrinkle is that the Trump administration eventually has to do something because it technically can’t ignore the EPA’s determination that greenhouse gases endanger public health, a finding compelled by a landmark Supreme Court decision in 2007. If they do nothing, they still risk lawsuits for not enforcing the Clean Air Act.

As I reported in August:

Whatever the administration decides, it will need to publish a written justification, which will be scrutinized by environmental groups in a likely lawsuit on the decision. The administration faces a similar quandary that plagued the GOP during the health care fight: Repeal the Clean Power Plan outright, or replace it with a shell of a rule?

According to a leaked draft of the EPA’s proposal, the Trump administration is choosing the first option — but with a twist. The 43-page document lays out the reasoning for repealing the rule by stressing the costs of implementation without factoring in the benefits from air pollution reduction and its contribution to combating climate change. The public is also invited to comment on alternatives for replacing it, without the EPA proposing any replacement of its own.

Janet McCabe, former head of the EPA office of air and radiation, explained that seeking input before even proposing a replacement “is not a legally necessary step.” Agencies use this step “sometimes to seek broad input before they put their own thoughts down into a proposal, which necessarily signals a particular policy and legal direction.”

A former EPA attorney that helped craft the Clean Power Plan told Mother Jones that the agency’s invitation to the public to comment is actually its own stalling tactic. The extra step pushes back the EPA’s regulatory timeline for nine months, at least. The reason the status quo appeals to the administration’s coal allies is that the implementation of the Clean Power Plan was delayed by the Supreme Court while current legal challenges played out. The coal industry only gains by the EPA delaying a replacement climate regulation, because the longer it’s put off, the longer it can pollute without limit. By stalling, Pruitt kicks the can down the road, by betting that the status quo of no rule in place is better than a replacement.

“Pruitt doesn’t believe in this stuff, so he’s actually in a paradoxical position,” says Joe Goffman, the former EPA attorney who is now at Harvard Law School’s environmental program. “If they do propose a replacement for the Clean Power Plan, what he’ll be doing is putting his signature on the proposal which will require to some extent power plants to address their carbon emissions.”

Nothing Pruitt is proposing now changes the underlying legal and scientific reasoning for why the EPA needs to do something on carbon emissions from the coal sector. Natural Resource Defense Council’s Climate and Clean Air Director David Doniger says the administration’s strategy is basically “replacing the Clean Power Plan with a dirty power plan.”

Democrats Are Setting Their Sights on "Putin’s Favorite Congressman"

Rep. Dana Rohrabacher (R-Calif.) won his first election to the House of Representatives in 1988 with 64 percent of the vote. He’s been reelected 13 times since then. And even though he walloped his most recent challenger by nearly 17 percentage points, some Democrats now think that this could be the final term for the Southern California conservative Politico has dubbed “Putin’s favorite congressman.

Protesters, sometimes numbering in the hundreds, assemble outside Rohrabacher’s office every Tuesday at 1 p.m. “He has been our congressman for a long time,” laments Diana Carey, vice chair of the Democratic Party of Orange County. “But because the district was predominantly Republican, my view is he’s been on cruise control.” Thanks to changing demographics in Orange County and newly fired-up liberal voters, Carey doesn’t think Rohrabacher’s seat is safe anymore.

Recently, Rohrabacher has been swept up in the scandal over the possible collusion between President Donald Trump’s campaign and Russia. Like Trump, Rohrabacher, who claims to once have lost a drunken arm-wrestling match with Vladimir Putin in the 1990s, believes the Russian government is being unfairly demonized. (During the 1980s, Rohrabacher was a staunch anti-communist who hung out with the anti-Soviet mujahedeen in Afghanistan.) He has shrugged off allegations of Moscow’s meddling in the 2016 presidential election by pointing out that the United States is guilty of similar actions. In May, the New York Times reported that in 2012 the FBI warned Rohrabacher that Russian spies were trying to recruit him. Two days earlier, the Washington Post reported on a recording from June 2016 in which House Majority Leader Kevin McCarthy said, “There’s two people I think Putin pays: Rohrabacher and Trump.” (McCarthy assured Rohrabacher the remarks were meant as a joke.)

But of all the issues where Rohrabacher and Trump align, Russia may be the least pressing concern for the constituents who are rallying against him. So far, Rohrabacher has voted in line with Trump’s positions more than 93 percent of the time, according to FiveThirtyEight, including voting in favor of the GOP health care bill that would effectively end Obamacare. Rohrabacher pushed hard for the bill, warning his GOP colleagues that letting Trump’s first major legislative effort die would stunt the president’s momentum. “If this goes down,” he said in March, “we’re going to be neutering our President Trump. You don’t cut the balls off your bull and expect that’s he’s going to go out and get the job done.” Health care is a hot-button issue in the 48th District, Carey says. “I’ve had conversations with people who are absolutely beside themselves, scared that they’re going to lose coverage.”

While Rohrabacher won his last race in a near-landslide, his district went for Hillary Clinton in the presidential election. She won by a slim margin, but it was enough for the Democratic Congressional Campaign Committee (DCCC) to flag the district as a top target to flip in 2018. If the Democrats hope to best Rohrabacher in the midterms, they have a lot of work to do, says Justin Wallin, an Orange County-based pollster who runs an opinion research firm. “I don’t think Dana has carved out a position as a fire-breathing supporter for any political personality except for Ronald Reagan,” says Wallin, referring to Rohrabacher’s early days working in the Reagan White House. “He tends to align quite naturally with that district in his perspectives, his persona, and his political views. His district views him as being independent, and when Dana takes a position on something that seems to be outside the mainstream, that can actually buttress his favorable regard.”

Two Democrats have announced bids to run against Rohrabacher. One is first-time candidate Harley Rouda, a businessman and attorney who gave $9,200 to Republican congressional candidates and nothing to Democrats between 1993 and 2007. The other is Boyd Roberts, a Laguna Beach real estate broker who has vowed to work to impeach Trump and who finished last among five candidates running for a school board seat in Hemet, California, in 2012. Both are attacking Rohrabacher over his sympathetic stance toward Russia. “The district will vote Rohrabacher out because i think there is something with the Russia thing. I think I can raise money off it,” Roberts told the Los Angeles Times. In an online ad, Rouda calls Rohrabacher “one of the most entrenched members of Washington’s establishment” and vows to get “tough on Russia” if he is elected.

“They’re both kind of waving the flag of the Russia thing, and I just don’t think that’s gonna get them over the line,” says Wallin. Carey declined to comment on either candidate, though she says a third challenger will be announcing a bid this summer. Meanwhile, the DCCC hasn’t thrown its backing behind anyone yet. “Barring something dramatic happening, I’d say he is far more safe than a number of other districts in the area,” says Wallin.

Yet Carey thinks that so long as the Democrats continue organizing with the same intensity they’ve shown so far, they can turn the district blue. “We have a lot of folks who said they never paid attention before, a lot of no-party-preference people who are really concerned about democracy,” she says. When asked whether people in the district continue to be engaged, she responds, “So far I think the energy is staying. I tell people, ‘This is not a sprint, it’s a marathon.’ But I think as long as Trump keeps tweeting, we’ll keep having interest!”
