This is hardly the most important topic in the world, but this story from ABC News sure left me scratching my head:

American tire companies have helped to defeat proposed laws in eight states that would require inspection of tires for age….”We oppose legislation that have some sort of age limit on tires,” said Dan Zielinski, executive director of the Rubber Manufacturers of America.

In the most recent case, the trade group spent $36,000 on lobbyists to defeat proposed legislation in the state of Massachusetts that would have included the age of tires on regular vehicle inspections, according to ABC News’ Boston affiliate WCVB, which joined other top ABC News affiliate investigative teams around the country in a national hidden camera investigation into tire safety.

….For consumers, determining the age of a tire can be a daunting task. The date of production can be found in a unique code at the end of 11- or 12-digit identification number on the tire’s sidewall. But instead of the standard month/year display, the tire industry uses a week/year display. For example, a tire produced in early June of 2010 (in the 21st week of the year) would be displayed as 2110, instead of the more common 06/10 that most consumers are accustomed to seeing.

“They did not want to put a date code on tires, specifically because they did not want to give the impression that tires might actually have a service life,” said Kane, the safety consultant.

OK, but why do tire manufacturers oppose the idea that tires have a service life? Wouldn’t a recognized service life lead to more tire sales? I can think of dozens of industries that have successfully run ad campaigns urging consumers to replace items more often than they’re accustomed to, with the goal of selling more stuff. So what’s the difference here?

The coal industry has a decades-old friendship with Johns Hopkins University, but now that cozy relationship is being torn apart by the scrutiny of investigative journalists.

When employees filed for black-lung-related benefits, coal companies paid the Baltimore-based university handsome sums to screen the claimants for the disease. After reviewing chest X-rays, the university’s scientists almost always concluded that the scans did not show black lung — a conclusion which often overwhelmed any other medical opinion in the case.

(Black lung disease, or coal workers’ pneumoconiosis, kills an estimated 1,500 former coal miners every year. It is a painful and preventable ailment contracted by inhaling coal dust.)

The racket was exposed by the ABC, working in partnership with the Center for Public Integrity:

For 40 years, these doctors have been perhaps the most sought-after and prolific readers of chest films on behalf of coal companies seeking to defeat miners’ claims. Their fees flow directly to the university, which supports their work, an investigation by the Center for Public Integrity and ABC News has found. According to the university, none of the money goes directly to the doctors.

Their reports — seemingly ubiquitous and almost unwaveringly negative for black lung — have appeared in the cases of thousands of miners, and the doctors’ credentials, combined with the prestigious Johns Hopkins imprimatur, carry great weight. Their opinions often negate or outweigh whatever positive interpretations a miner can produce.

For the credibility that comes with these readings, which the doctors perform as part of their official duties at Johns Hopkins, coal companies are willing to pay a premium. For an X-ray reading, the university charges up to 10 times the rate miners typically pay their physicians. …

In the more than 1,500 cases decided since 2000 in which [senior university scientist Paul] Wheeler read at least one X-ray, he never once found the severe form of the disease, complicated coal workers’ pneumoconiosis. Other doctors looking at the same X-rays found this advanced stage of the disease in 390 of these cases.

After the results of the investigation were broadcast late last week, the university announced on its website that it was suspending the screening program:

Following the news report we are initiating a review of the pneumoconiosis B-reader service. Until the review is completed, we are suspending the program.

United Mine Workers called on the federal government to take action following the revelations.

“Whatever penalties or punitive actions that can be taken with respect to Dr. Wheeler should be,” union spokesman Phil Smith said. “But whatever they are, they will pale in comparison to the pain and suffering he has caused thousands of afflicted miners. There is no penalty which will make up for that.”

I would probably be bitter, too, if I were Beef Products, Inc. Those are the folks behind uber-gross “lean finely textured beef,” aka “pink slime,” the ammonia-soaked cow trimmings added as filler to ground beef. During pink slime’s heyday, it ended up in more than two-thirds of American hamburgers, at a ratio of up to 15 percent slime to 85 percent burger. That slime was cheap, and so chemical-packed that it sterilized the rest of the meat. Mmm, food!

Fast-forward to today: The origins and grossness of “pink slime” are well-known, fast food restaurants have given up the stuff, and BPI is as pissed as a parent whose kid was unknowingly served pink slime in her USDA-approved school lunches.

According to Time, only about 5 percent of ground beef contains the “lean finely textured” stuff now. Following an 11-part ABC News series that ran last March and April, BPI says its revenues have dropped from more than $650 million a year to $130 million. The company filed a lawsuit last September against ABC, anchor Diane Sawyer, and other named defendants seeking $1.2 billion in damages. ABC didn’t coin “pink slime” — a USDA scientist named Gerald Zirnstein did, in 2002 — but ABC and its parent company Disney sure do have deep pockets.

BPI has hired “a high-powered Chicago trial lawyer,” according to Reuters, which reports the case “is shaping up to be one of the most high-stakes defamation court battles in U.S. history.” The company’s founders say they plan to fight ’til the bitter, slimy end, regardless of the cost. “We have to do this,” one told Reuters. “We have no other choice.”

The case hinges on state “product-disparagement” statutes that protect farmers and their products in 13 states, including South Dakota, where BPI is based. From Reuters:

Under the South Dakota version of the law, plaintiffs must show that defendants publicly spread information they knew to be false and stated or implied “that an agricultural food product is not safe for consumption by the public.” …

For BPI to prove the defamation piece of its case, it would need to show that the network negligently reported a false statement of fact that injured its reputation. If BPI is deemed by the court to be a public rather than a private figure in the legal sense, it would have a higher bar to cross: The company would need to prove ABC knew the facts it was reporting were false or it recklessly disregarded the truth.

While the case is in the early stages, the network appears to have a legal leg-up on both counts: ABC never said BPI’s product is dangerous, and courts have repeatedly offered broad protections for journalists in the course of their work.

But by calling a food product “slime” 137 times over the span of nearly four weeks on its newscasts, its website and on Twitter, according to BPI’s tally, did ABC make the public think [lean finely textured beef] was unsafe? If, as BPI alleges, ABC shrugged off information that refuted parts of its reporting, did it act recklessly and could it therefore be held liable for defamation?

The case will be one of the first challenging First Amendment protections for news outlets in the social media era. One notable piece of evidence cited in BPI’s lawsuit is a single Tweet by reporter Jim Avila, who wrote: “It’s just not what it purports to be. Meat.” One of BPI’s arguments is that ABC News intentionally portrayed its product as something other than beef. (The USDA considers [lean finely textured beef] to be beef.)

If BPI wins, the precedent would be chilling for reporting on industrial food. If ABC wins, we probably still won’t see a lot of investigative reporting on industrial food, honestly. And either way, we’ll still have the slime: After a steep dropoff last year, manufacturers are slowly reintroducing the stuff.
