President Obama just made Arctic drilling more annoying

Environmental activists have been on a winning streak when it comes to keeping fossil fuels in the ground, from knocking down approval for the Keystone XL pipeline to stopping the Obama administration from opening Atlantic waters to drilling. They’ve been holding out for one more big win over Arctic drilling.

Activists were disappointed, then, on Thursday when the Department of Interior teased a “major” announcement only to leave the future of the Arctic open. Instead, Interior finalized regulations that will supposedly make it safer to drill in the difficult polar waters, while costing the industry around $2 billion over the next 10 years. The most prohibitive of the measures requires backup rigs in the case of a spill, and as well as planning for Arctic-specific conditions like limiting drilling during bad weather.

At the moment, Obama’s not really making environment or industry allies happy. “It may be the case that the rules require safer drilling practices, but the simple fact is that there’s no safe way to drill for oil in the Arctic with the climate crisis deepening all around us,” David Turnbull of Oil Change International told Grist.

Meanwhile, Sen. Lisa Murkowski (R-AK) thought it sent mixed messages on the offshore industry’s future and was “dismayed by the regulatory onslaught” on energy production.

In any case, this is just the prelude to Obama’s big climate finale of his administration. The draft for the administration’s five-year offshore-drilling plan offered new leases for sale in the Arctic; the final plan is due out later this year, and will determine development all the way through 2022.

Obama has already protected more ocean than any other president before him, but his decision on Arctic leasing might be the legacy that sticks.

You’ve got to hand it to him for creativity.

Rep. Richard Hudson (R-N.C.) has proposed an amendment that would ban employees of the Environmental Protection Agency (EPA) from using taxpayer money to fly … because environmental regulators in coach is really the battle we need to be fighting right now. You can think of it as a sort of no-fly list for greens, as Politico reports.

Not content merely to force EPA employees to ride Greyhound, Rep. Hudson also proposed an amendment that would prohibit EPA funds from being used to buy firearms. While it’s hardly common for water quality inspectors to pack heat, a small number of EPA officers do carry weapons for enforcement purposes. In 2009, for instance, armed EPA agents helped apprehend fugitive Larkin Baggett, the owner of a Utah chemical company who had been sentenced to 20 years in prison for illegal dumping and other environmental crimes.

As for pretty much anyone else carrying AR-15s, well, Hudson sees no problem there.

Rising seas are lapping at the doors of Trump’s real estate empire

On a hot and lazy afternoon in Palm Beach, the only sign of movement is the water gently lapping at the grounds of Mar-a-Lago, the private club that is the prize of Donald Trump’s real estate acquisitions in Florida.

Trump currently dismisses climate change as a hoax invented by China, though he has quietly sought to shield real estate investments in Ireland from its effects.

But at the Republican presidential contender’s Palm Beach estate and the other properties that bear his name in South Florida, the water is already creeping up bridges and advancing on access roads, lawns, and beaches because of sea-level rise, according to a risk analysis prepared for the Guardian.

In 30 years, the grounds of Mar-a-Lago could be under at least a foot of water for 210 days a year because of tidal flooding along the intracoastal water way, with the water rising past some of the cottages and bungalows, the analysis by Coastal Risk Consulting found.

Trump’s insouciance in the face of overwhelming scientific evidence of climate change — even lapping up on his own doorstep — makes him something of an outlier in South Florida, where mayors are actively preparing for a future under climate change.

Trump, who backed climate action in 2009 but now describes climate change as “bullshit,” is also out of step with the U.S. and other governments’ efforts to turn emissions-cutting pledges into concrete actions in the wake of the Paris climate agreement. Trump has threatened to pull the United States out of the agreement.

And the presidential contender’s posturing about climate denial may further alienate the Republican candidate from younger voters and minority voters in this election who see climate change as a gathering danger.

When Guardian U.S. asked its readers about their most urgent concern in these elections as part of our Voices of America series, the single issue looming on their minds was climate change.

Real estate professionals, with perhaps an extra dash of self-interest, hold similar views. In a survey published in the Miami Herald last month, two-thirds of high-end Miami realtors were concerned sea-level rise and climate change could hurt local property values, up from 56 percent of them last year.

So too for mayors in South Florida. About a third of the civic leaders in South Florida’s compact of mayors are working on strategies to protect their towns from rising seas — and lobbying Florida’s governor and fellow Republicans in Congress to acknowledge the gathering threat.

Elected officials in those same Florida towns say they are already spending heavily to rebuild disappearing beaches and pump out water-logged streets.

Republicans in coastal districts can’t afford to play politics with climate change, said Steve Abrams, a Republican and mayor of Palm Beach County.

“We don’t have the luxury at the local level to engage in these lofty policy debates,” said Abrams. “I have been in knee-deep water in many parts of my district during King Tide.”

King Tides, the extreme high tides of the autumn, are a growing nuisance in Miami and other areas of South Florida — and are creeping up the manicured lawns of Trump’s Mar-a-Lago from the intracoastal waterway, according to the CRC analysis.

Parts of the estate are already at high risk of flooding under heavy rains and storms, the analysis found. By 2045, the storm surge from even a category two storm would bring waters crashing over the main swimming pool and up to the main building, the analysis found.

The historic mansion at the heart of Mar-a-Lago is not going to be underwater, “but they are going to have more and more issues with health and safety, access, and infrastructure,” said Keren Bolter, chief scientist for the firm.

Despite Trump’s pronouncements, there is strong evidence that he — personally — could pay the price for climate change in his property interests along the South Florida oceanfront and intracoastal waterway.

In South Florida, sea level is projected to rise up to 34 inches by the middle of the century and as high as 81 inches by 2100, according to the National Oceanic and Atmospheric Administration.

South of Mar-a-Lago, where the elevation is lower, water already pools in the road in front of the Trump Hollywood condos after the briefest of cloud bursts. The luxury development, where three-bedroom units are on sale for up to $3 million apiece, offers “pristine beaches.”

“Right outside your door you’ll find the Hollywood Beach broadwalk, ranked as one of the five best boardwalks in the country,” the company website says.

But Peter Bober, a Hollywood native who is now the city’s mayor, said flooding was becoming a regular occurrence, when storms coincided with high tide.

“We have had neighborhoods where the water has been up to people’s front doors. That is not something that I remember as a kid growing up in the city of Hollywood,” he said.

Meanwhile, the city is spending heavily on pumping systems and to truck in sand to replenish beaches disappearing due to erosion.

Bober said he had seen storms with water pouring over the sea walls of the intracoastal. “Water just floods the entire neighborhood, and there is nothing we can do about it,” Bober said. “We have occasional storms where we are totally overwhelmed.”

Such instances are only growing more frequent. Bolter’s modeling suggests Trump’s Hollywood condos could be turned into islands for up to 140 days a year by 2045, cut off from the low-lying A1A coastal road because of tidal flooding and storm surges. Under a category two storm, a storm surge could wash right up to the front gate.

Further south, the Trump Grande in Sunny Isles also faces a soggy future, according to the projections. In 30 years, the boundaries of the property could face tidal flooding and storm surges for 97 days a year, cutting off access to the A1A road. The beaches could also be scoured away by erosion.

“The big issue here is that if a big storm hits, you have five-foot, six-foot waves, and that is going to eat away even at the grass here. It could push the waves even to where we are standing. And if that is going to eat away this whole area, that could do some serious damage,” Bolter said.

Other Trump-branded properties, such as the golf clubs in Doral and Jupiter, are at higher elevations, above the water line amid projected sea-level rise this century. But Bolter said the courses faced different risks from heavy rainfall and poor drainage because of Florida’s high water table.

Scientists have long expected sea-level rise on the southeast Florida coast to occur faster than the global average, advancing rapidly on barrier islands and beaches.

The low-lying coastal areas are exposed to an additional threat of inland flooding from the intercoastal waterways, and contamination of fresh water supply by high tides and storm surges.

But the pace of sea-level rise has accelerated over the last decade because of the collapse of ice cover in Greenland and Antarctica, and because of the weakening of ocean currents such as the Gulf Stream. Nowhere is this as evident as in South Florida.

Since 2006, the average rate of sea-level rise in South Florida has increased to nine millimeters a year from three millimeters a year, for a total rise over the decade of about 90 millimeters, or about 3.5 inches, according to Shimon Wdowinski, a research scientist at the University of Miami.

As a result, flooding in Miami Beach and other low-lying areas has doubled over the last decade, Wdowinski found, using tide gauges, rain records, insurance claims, and other data to construct the flood record. “People should be aware of where they want to invest for their properties,” he said. “I think for the next 20 years it will be OK, but I don’t know if it will be in 50 or 80 years. That’s a different story.”

Other sections of the low-lying South Florida coast are just as vulnerable. In 2012, Hurricane Sandy barely grazed Florida, reserving its fury for New York and New Jersey.

But a subsequent storm unleashed huge waves that uprooted traffic lights and street signs, and caused the collapse of a 1.5-mile stretch of the A1A coastal artery in the center of Fort Lauderdale.

“When the road collapsed, that was basically a huge wake-up call,” said Jason Liechty, environmental projects coordinator for Broward County. “Sometimes when you talk about climate change and sea-level rise it seems very abstract, but if you see big chunks of concrete just sticking up out of the road, it becomes very real.

“It took $20 million and 40,000 truckloads of imported sand so far to raise the mile-long section of road by two feet, sink in metal sheets 40 feet down, and rebuild sand dunes to provide buffers from future storms — and the repairs are still under way four years later.

“So let’s do the math here: You are talking about several hundred million dollars if the whole coast line is affected, and that’s a lot of money,” Liechty said.

A number of towns in South Florida are already beginning to make the investment, calculating that it would be cheaper to put in defenses against rising seas now than wait for a catastrophe.

Miami Beach is spending $400 million to raise roads and install pumps to drain streets that experience regularly flooding at high tide — and to prevent salt water from contaminating fresh water storage inland.

In other sea-level hotspots, such as Hollywood, newer construction — including Trump-branded buildings — are being built on top of steeply graded driveways, above the flood zone.

But for some of South Florida’s cities, there may be no alternative to retreat — even if it means abandoning some of the wealthiest real estate in the country.

In his offices in the historic city hall of Coral Gables, James Cason keeps a poster-size map showing a wide swath of land, sliced up by canals, yacht moorings, and multimillion dollar homes in gated communities with elevations below four feet.

About 34 miles of Coral Gables are exposed to the ocean. The entire area — representing about $3 billion in property and about 10 percent of homes — will be underwater in the second half of the century, according to NOAA’s projections.

Two schools, 20 bridges, 21 pumping stations will all be swamped, according to the projections. Some 302 yachts will almost certainly be trapped behind low-lying bridges. Water treatment plants and pumping stations will no longer work.

Cason has no patience for those, like Trump, who deny climate change is occurring. “It’s an existential threat to a city like us,” he said. So much so that Cason has hired consultants to contemplate a future when it may no longer be able to engineer a way out of sea-level rise.

“What do you do if and when the water is up so high you can’t provide services — when do you stop charging taxes?” he asked. “If your house is underwater, can you stop paying taxes on it?”

He would like to believe that by the end of the century, scientists will have figured out a solution to the rising seas that threaten his city. But there is one thing of which he is certain: Coral Gables will not survive by retreating behind a sea wall.

“There is no Dutch solution,” he said. “You can’t really build a wall around it. It will just come up from below.”

Ocean acidification is bad for mussels. You may think you’ve heard this story before (cf. clams, oysters, scallops) but wait! This time it’s a little different.

It turns out that acidifying seawater prevents the tasty mollusks from attaching to rocks and other surfaces, scientists from the University of Washington found in a new study. And while mussels are famously good at sticking to things, it turns out they’re pretty useless at everything else. If they can’t cling to rocky surfaces near the surf line, they sink, and become easy targets for predators.

“A strong attachment is literally a mussel’s lifeline,” said lead author Emily Carrington.

This is especially concerning for mussels farms, where weak attachments are already responsible for loss of as much as 20 percent of mussels.

Ocean acidification already threatens coral, crabs, and other shelled organisms that may not survive as their environment grows more acidic. The oceans are already over 30 percent more acidic than they were 200 years ago; by the end of the century, they could be 150 percent more acidic. Beyond lost biodiversity, the effect on aquaculture could threaten both global food security and the seafood economy as a whole, which employees an estimated 10 to 12 percent of the world’s population.

Weeds That Are Good for Your Garden

While some weeds are invasive and steal nutrients from intentionally planted flowers or edibles, there are other “weeds” that may actually helpyour garden or lawn. Before declaring war on those dandelions, read on to learn aboutsome of the beneficial volunteer plants.You might find some new helpers and save yourself some work.

1. Nitrogen Fixers

Plants require nitrogen to survive. The problem is most nitrogen naturally occurs as a gas in our atmosphere and is unavailable to plants.

Nitrogen fixing plants solve this issue with specialized root nodules that can take nitrogen from the air and store it in their roots. The nitrogen becomes available to other plants once the nitrogen fixers die and the roots start to decompose.

The legume family of plants are excellent nitrogen fixers, including clover, vetch, peas, beans, lupines, false indigo, and alfalfa. Leave these plants to die at the end of the season or till in perennial varieties to allow the nitrogen to be released.

Even some potentially weedy trees and shrubs are great for fixing nitrogen, such as sea buckthorn, broom, alder, locust trees, and Russian olives. The older roots that die off naturally will release nitrogen into the surrounding soil.

2. Deeply-Rooted Weeds

Plants with deep root systems, like docks, dandelion, pigweed, or thistles, will draw hidden nutrients to the soil surface. This often includes trace minerals that many of your shallow-rooted ornamental plants would have a hard time accessing. The deep roots also break up compacted soil to improve water permeability and texture.

These weeds are excellent to add to your compost. Try leaving some in place throughout the growing season to harvest and compost the leaves regularly before they start to flower or seed.

You can also dig up the roots at the end of the season. But make sure they dont survive in your finished compost. Try putting the harvested roots in the sun for at least a week to thoroughly dry out. Soaking the roots in a bucket of water until they ferment will also finish them off before adding to your compost.

3. Ground Covers

Ground cover plants in any form, including weeds, can help your garden in many ways.

Their roots will stabilize soil, preventing erosion and the loss of nutrient-rich top soil. The stems and leaves will provide shade to keep your ground moist and reduce irrigation needs.

Although it may sound contradictory, a good ground cover of weeds will also help with weed control. Weeds that make a tight mat of vegetation over the ground, such as purslane or dead-nettle, will prevent more invasive weeds from taking hold.

4. Edible Weeds

Many of our modern-day weeds were once sought-after food crops. The flavor of wild greens is often stronger than our cultivated varieties, but this is no reason to disregard them.

In fact, weeds such as lambs quarters, yellow dock, dandelion leaves, purslane, chickweed, and sorrel have two or three times the nutritional value of spinach or Swiss chard.

If you steam or saut the greens, it will remove any bitter aftertaste they may have when raw. Then you can use them as you would any other green vegetable in soups, stews, sauces, or as a simple side dish.

These are some tasty edible weeds you can try:

Dandelion (Taraxacum officinale) eat the fresh leaves or dry the roots in small pieces and use in tea.
Clover (Trifolium pretense) leaves and blossoms are good fresh, blossoms can be steeped in tea.
Plantain (Plantago major) leaves are excellent steamed.
Sorrel (Rumex acetosella) lemon-flavored leaves are tasty raw when young, or steamed when older.
Watercress (Nasturtium officinale) tangy leaves are good fresh or steamed.
Chickweed (Stellaria media) fresh leaves are great in salad.
Lambs quarters (Chenopodium album) young leaves are good raw or steamed, and the seeds are also very nutritious.

5. Cover Crops

The main purpose of a cover crop is to provide more nutrients and organic matter for your soil. Many farmers and gardeners will purposely sow certain plants as cover crops, but you can also use your existing weed species.

Its recommended to regularly cut off the greens of a cover crop and leave them as a mulch to decompose on the soil, or take them to your compost. The plants can be tilled into the ground at the end of the season.

You can leave lush weeds you already have in place, such as clover, burdock, thistles, chickweed, or pigweed. Just make sure to keep cutting them down before they flower and make seeds.

6. Insect Attractants and Repellants

You can help support pollinating insects by keeping some wild, flowering weeds around to provide food. Some of their favorites include dandelions, clover, thistles, evening primrose, borage, and Queen Annes lace. Allowing weedy shrubs, such as wild cherries or roses, to grow in unused corners of your yard is also useful.

These weeds can attract beneficial predatory insects to your garden as well, such as ladybugs, parasitic wasps and lacewings, which control your bad bugs.

On the other hand, some weeds can keep unwanted bugs away. A study in Florida found there was less armyworm damage in cornfields with weeds like dandelion, cockleburs and goldenrod. Plants like pennyroyal, feverfew and peppermint are known to repel mosquitos.

Weeds can also lure harmful insects away from your desired plants. For example, lambs quarters often attracts leafminers, which could attack your spinach or other greens instead.

7. Soil Indicators

Certain weeds grow best under specific soil and climate conditions. If you see them growing in an area, youll have a good idea of whats going on in that soil.

For instance, knotweed, sow thistle and plantain are all indicators of an acidic soil. Whereas sheep sorrel and yellow toadflax will often grow in poor soils low in organic matter.

If you see a lot of one or two types of weeds in a location, look into what theyre telling you before you make any further plans for the area.

Advertising works even when we know someone is trying to manipulate us into buying commemorative coins, banana slicers, and anything ever sold in an inflight magazine. And it works even better on kids, who may not understand they’re being pitched.

In perhaps the best proof yet that advertising has frightening power over children, researchers have shown that a little marketing can convince kids to eat their vegetables. A new study, out of Cornell, found that 239 percent more students chose salad in a lunchroom when the salad bar was covered with pictures of vegetable cartoon-characters and nearby TVs played videos with those same characters — you know Brian Broccoli, Suzy Sweetpea, and the rest of the Super Sprowtz — extolling the virtues of veggies.

“The results of this study highlight how the persuasiveness of marketing media can be leveraged in a positive way by encouraging children to make more nutritious choices,” said Drew Hanks, the study’s lead author and a professor at Ohio State University, in a statement.

Yes, it’s a bit creepy that advertisements — even good ones — can hack the minds of children, but the sooner we get over the idea that we always act rationally the better. Once we accept that our environments influence our actions we can use that knowledge to encourage the good influences and shut down the bad, like marketing junk food to toddlers.

Listen up, beach-goers who delight in swimming amongst plastic bags, deflated balloons, and lonely flip flops! We found the perfect place for you: the shores of Hong Kong, where unsightly piles of debris have recently washed up and taken up residence.

Plastic pollution is not a new problem for Hong Kong’s waterfront. But during the past two weeks, Quartz reports, the garbage influx has reached unprecedented levels.

No one knows precisely where the trash is coming from, but we’re guessing it has something to do with humans — you know, those creatures that like to buy food in individually wrapped plastic packages and, incidentally, have thrown 10 to 30 billion pounds of plastic debris into the ocean. Right now, it looks like Hong Kong’s shores are bearing the brunt of it.

Just a few years ago, Hong Kong set up a fake, blue-sky backdrop in front of its smoggy city skyline for tourist-photo purposes. If only we had a beautiful backdrop to remember the island’s clean beaches by …

President Barack Obama joined Hillary Clinton on the campaign trail for the first time on Tuesday, addressing a rally in Charlotte, North Carolina, with an impassioned speech to boost support for the presumptive Democratic nominee.

“There has never been any man or woman more qualified for this office than Hillary Clinton—ever,” Obama said. “And that’s the truth. The bottom line is, I know Hillary can do the job, and that’s why I am so proud, North Carolina, to endorse Hillary Clinton as the next president of the United States.”

He continued lavishing praise on Clinton, focusing on her vigorous performance as his Democratic primary opponent in 2008 and her later tenure as his administration’s secretary of state to highlight her willingness to put the country’s direction above politics. Obama also took shots at Donald Trump, the presumptive Republican nominee, and painted him as an unskilled candidate focused on self-promotion.

“Everybody’s got an opinion, but nobody actually knows the job until you’re sitting behind the desk,” he said. “Everybody can tweet, but nobody actually knows what it takes to do the job until you’ve sat behind the desk. I mean, Sasha tweets but she doesn’t think she should thereby be sitting behind the desk.”

The president’s appearance in the swing state came just hours after FBI Director James Comey announced the agency would recommend no charges against Clinton in the criminal investigation into her use of a private email server while secretary of state. While he did not directly address the federal probe, Obama sought to use her tenure as secretary of state to emphasize her strong leadership and dedication to public service.

An unfortunate milestone was reached last weekend in Chicago when a woman was hit by a truck and killed while riding a bicycle from a bike-share service. This is the first time a bike share has been implicated in a cyclist’s death, despite an estimated 71 million trips taken since the programs were first introduced in the U.S. in 2007.

The victim, 25-year-old Virginia Murray, was wearing a helmet, but truck encounters are especially deadly for cyclists no matter their equipment. In New York City, for example, trucks were involved in 32 percent of deadly bicycle crashes between 1996 to 2003 — and 12 percent of pedestrian fatalities from 2002 through 2006, according to city statistics.

There are a couple of fairly simple ways to address this problem, however. First: by installing side guards on trucks. Already mandatory on trucks in the E.U., Brazil, Japan, and China, side guards prevent cyclists from falling underneath the vehicle’s wheels. While they don’t prevent accidents, they do prevent fatalities.

Second, a designated bike lane could also have saved Murray’s life — and saved the city of Chicago some money at the same time. A 2014 study found that for every dollar spent on bike lanes and other biking infrastructure, cities reaped between $6 and $24 in savings from decreased pollution, congestion, and health care costs from fewer traffic fatalities.

There’s also the tack of educating drivers to accept the revolutionary idea that streets are made for more than motor vehicles — and, if all else fails, making sure bikers know what to do if they do get hit.

The crazy true story of how George W. Bush secretly tried to raise the gas tax

Remember that time the George W. Bush administration tried to sneak a new gas tax onto the books and sort of succeeded?

You probably don’t, because not even those fighting over this measure in Congress understood what was going on. As far as I can tell, the only person who knows the full story is Hanna Breetz, a political scientist at Arizona State University who wrote a dissertation on U.S. alternative fuel policy back in 2012. It’s a dissertation that — mirabile dictu — broke news. But, because it’s a dissertation, no one noticed.

Breetz’s research provides a rare glimpse inside the political sausage factory that churns policy proposals into laws for the good old US of A. In this episode, nobody saw the full picture, and nobody was pushing for the thing that emerged in the end. It’s a story that shows how sometimes there is no guiding plan behind this country’s policy. The politicians weren’t rational planners — they were more like ants tugging a leaf in haphazard directions until they reached a destination.

Back in January 2006, Bush held a one-man intervention with the United States, telling the country that it was “addicted to oil.” To help wean us off our addiction, he called for us to increase our alternative fuel consumption to 35 billion gallons by 2017. Where did this number come from? Conventional wisdom held that Bush pulled it from thin air.

“Tellingly, not one of the industry lobbyists, environmental advocates, Department of Energy analysts, or Congressional staff that I interviewed seemed to know where the 35 billion gallon goal came from,” Breetz writes. “Many of them derided it as a number made up for political purposes.” The people she interviewed described the target as “arbitrary,” “mythical,” and “mind-boggling.”

It’s tempting to believe that some young speechwriter suggested this number after Bush initially wrote “62 squigilliam gallons!”

In fact, the number had a purpose, and it wasn’t plucked from a hat. But the Bush administration seems to have kept silent about its rationale so that no one would figure out what it was actually proposing: doubling the federal gas tax.

Before the speech, Bush had asked his advisors for a proposal that could make dramatic change without dramatic government intrusion. Bush wanted to work with the market, not pick winners and losers. His advisors suggested a gas tax. Make gas a lot more expensive and people will start choosing other fuels. Of course, this would never fly because most members of Bush’s political party had sworn not to raise taxes of any kind. I imagine someone in the Council of Economic Advisors standing up to say, “Clearly, the best solution would be to tax oil but … we’re Republicans.”

Then, one of these advisors, Benjamin Ho, “reached into the economics literature for an almost subversively clever alternative,” Breetz writes. That alternative: Tell oil companies that they must use an unrealistically high quantity of alternative fuels or pay a penalty — in this case $1 per gallon. It’s functionally equivalent to a gas tax, but it doesn’t look like one. If that doesn’t make sense, you can read how it works here, but remember this is incomprehensible by design. The Bush administration didn’t expect the alternative fuels to emerge out of thin air — it chose a number so big that it would force companies to pay a penalty and push gas prices up. Setting a mandate for 35 billion gallons of alternative fuels would add about 20 cents to the price of gas, on top of the existing 18.6 cent federal gas tax.

When the Senate took up this proposal, however, it morphed into something different. Instead of allowing the market to choose the alternative fuels, senators picked the winner: biofuel — ethanol and biodiesel grown in the Midwest. Instead of creating a mandate for a wide variety of alternative fuels, senators expanded a mandate exclusively for biofuels — gas from plant juice — they had passed two years before. Environmentalists, concerned about the amount of land that we’d need to grow all these biofuels, successfully lobbied to get a mandate for cellulosic ethanol — which can, in theory, be produced without any additional land — into the law.

Along the way, lawmakers eliminated the $1-per-gallon penalty, the key feature required to make this policy an incognito gas tax. They replaced it with fines for companies that failed to meet the impossibly high oil displacement goals. These fines have driven up the price of gas, Breetz told me, but the entire process is inefficient and punitive. In the past, the companies have paid fines for failing to buy cellulosic ethanol that didn’t exist. The courts struck down that practice in 2013, but the EPA still requires oil companies to buy biofuels or pay a fee. Now the fees and volumes are much lower than Bush advisors envisioned, and probably too low to significantly budge the price of gas.

The bill President Bush signed into law on Dec. 19, 2007, Breetz writes, bore little resemblance to what most analysts thought was achievable, or what anyone had wanted to begin with (including the industry it purportedly helped).

The Bush administration deserves more credit than greens generally give it for passing an incognito gas tax. Of course, it didn’t exactly work, but it’s still interesting to see how factions with shared interests pulled this proposal in opposite directions. This case study challenges the notion that democratic governments make deliberate, rational choices. Perhaps we should think of public policy as emergent phenomena, like the formation of geometric patterns in snowflakes and the movement of schools of fish. Maybe democracies plan their political fate only to the same degree that termites plan the architecture of their mounds. For this termite, spending his days scribbling away about what ought to be done, that idea is at once terrifying and liberating.
