Lamar Smith’s climate denial turns off some Texas voters.

The New York State Supreme Court is requiring the oil giant and its accounting firm PricewaterhouseCoopers to turn over documents subpoenaed by state Attorney General Eric Schneiderman. He’s conducting a fraud investigation into the company, spurred by a report from InsideClimate News last year that revealed Exxon knew fossil fuel burning was heating up the atmosphere back in the 1970s and deliberately misled the public about it.

Earlier this month, Exxon attempted to halt the investigation by suing Schneiderman, as well as Massachusetts Attorney General Maura Healey, and arguing that their investigations are politically motivated.

Exxon has also been arguing, under a Texas statute, that documents held by PricewaterhouseCoopers are privileged. But yesterday, the New York court ruled against the company on that point. The court, as the Washington Post reports, determined that New York law, not Texas law, governs the dispute, and ordered the company to comply with Schneiderman’s subpoena.

Schneiderman was pleased with the ruling, of course. He said he looks forward to “moving full-steam ahead with our fraud investigation” and called on Exxon to “cooperate with, rather than resist,” the probe.

ExxonMobil has no such intention. The company said it will appeal the ruling.

Ohio Attorney General Accuses Planned Parenthood of Illegally Dumping Fetal Remains

Ohio officials on Friday accused Planned Parenthood affiliates in the state of disposing of fetal tissue in violation of state law, saying that the health care organization sent the remains to companies that dumped the tissue in landfills.

The accusation was the result of the Ohio attorney general’s investigation into Planned Parenthood over the organization’s donation of fetal tissue from abortions. Attorney General Mike DeWine said in a statement on Friday that his office concluded its investigation of Planned Parenthood and found that the organization had not illegally sold fetal tissue.

But DeWine said his office did find that Planned Parenthood had violated an Ohio regulation requiring that a “fetus shall be disposed of in a humane manner.” According to the attorney general’s investigation, the health care organization sends fetal remains to disposal companies, which then dump the tissue in landfills.

Stephanie Kight, president and CEO of Planned Parenthood of Greater Ohio, has denied all wrongdoing and says her organization handles fetal tissue legally and in the same manner as other health care providers. Planned Parenthood of Greater Ohio is one of the state affiliates mentioned by DeWine.

“We take our responsibility as a health care provider seriously, and if we ever thought that one of our vendors wasn’t handling fetal tissue properly, we would take swift action,” Kight told reporters on Friday.

DeWine’s new accusations are the result of his failed investigation into the sale of fetal tissue, she added. “He has dug up another set of accusations that are equally false.”

Ohio is one of a handful of states that launched investigations into Planned Parenthood following the series of widely debunked sting videos purporting to show the organization’s staff discussing fetal tissue donation. None of the investigations have found evidence that Planned Parenthood illegally sold fetal tissue.

Obama says a climate plan is coming next month, so climate hawks delay lawsuit

“Sit tight, guys. Climate rules are coming soon, I swear.”

A cavalry of lawyers representing states and environmental groups was expected to launch a legal assault against the Obama administration this week over its slow movement on climate rules, but the charge was postponed at the 11th hour.

What changed? Obama has been telling donors that he plans to unveil new climate change regulations as part of a larger climate strategy next month.

Those regulations are expected to include a long-awaited rule on carbon dioxide emissions from new power plants, which would likely make it impossible to build new coal plants unless they have carbon-capture technology. The administration has been delaying release of that rule, reportedly working to improve it so it can better withstand the inevitable industry lawsuits. That delay in turn prompted states and environmental groups to threaten their own lawsuit.

The attorney generals of New York and nine other states, along with three major green groups, had planned to sue the EPA this week because it missed a deadline in April to finalize emissions standards for new electric power plants.

Two months after notifying the agency they intended to sue, the consortium had expected to file as early as Monday, but backed off temporarily to allow the White House to disclose its climate plans.

“Due to public reports that the president will be announcing major action on climate change very soon, the Attorney General has decided to postpone a lawsuit on this matter for a short period,” said Melissa Grace, a spokeswoman for New York Attorney General Eric Schneiderman.

So the prospect of a new climate initiative is enough to mollify the would-be litigants — for now.

But climate activists are still restless and unhappy, particularly over Obama’s indecision on the Keystone XL pipeline. Just yesterday, 22 activists were arrested during a Keystone protest outside a State Department office in Chicago.
