Last week, Congress did Wall Street a solid. When lawmakers passed a giant spending bill that funds the government through September, they included a provision written by Citigroup lobbyists that allows banks to make more risky trades with taxpayer-insured money. Then, on Thursday, bankers got another giveaway: The Federal Reserve announced it would delay for up to two years implementation of a crucial section of the Volcker rule—one of the most important regulations to come out of the 2010 Dodd-Frank financial reform bill. The rule generally forbids the high-risk trading by commercial banks that helped cause the financial crisis. The move by the Fed pushes the deadline for banks to comply past the next presidential election and gives Wall Street lobbyists more time to weaken it.

“Less than a week after Wall Street slipped a bailout provision written by Citigroup into the government spending bill, the Fed has given the big banks another victory,” Sen. Elizabeth Warren (D-Mass.) said in a statement Friday.

“It’s really hard to see an excuse for this,” says Marcus Stanley, the financial policy director at Americans for Financial Reform, an advocacy group.

The Volcker rule ensures that financial institutions don’t engage in something called proprietary trading, which is when a bank trades for its own benefit as opposed to for the benefit of its customers. Banks were supposed to comply with the Volcker rule by July 21, 2014. Last year, when banking watchdogs finalized the rule, the Fed granted banks a year-long extension. The Fed’s Thursday announcement gives banks another year to get rid of certain investments—including those in private equity firms and hedge funds. The central bank also noted Thursday that it plans to push out the deadline again next year, by another 12 months. That brings the new compliance deadline to July 2017, far past the 2016 election. If the new president is a Republican, he could fill his administration with Wall Street insiders opposed to the rule, making it even easier for lobbyists to gut it.

Before the Volcker rule was finalized last year, the financial industry fought like mad to weaken it. The regulation could slash the total annual profits of the eight largest US banks by up to $10 billion, according to an estimate by Standard & Poor’s. Banking reform advocates were fairly happy with way the final reg turned out. But now the financial industry has extra time to take a few more whacks at rule before banks actually have to obey it. “Wall Street’s loophole lawyers and other hired guns will… continue to hit at the rule as if it were a piñata,” Dennis Kelleher, the president of the financial reform advocacy group Better Markets, said when regulators completed the rule in 2013.

The Dodd-Frank law already contains a provision allowing banks that will have difficulty getting rid of particular investments before the initial compliance deadline to request an extension from banking regulators. The Fed’s announcement yesterday amounts to an unnecessary “blanket” extension, Stanley says. “It’s hogwash.”

Meet the Fortune 500 Companies Funding the Political Resegregation of America

Over the past four to five years, the United States has been resegregated—politically. In states where registered Democrats outnumber Republicans and presidential races can be nail-biters, skillful Republican operatives have mounted racially-minded gerrymandering efforts—the redrawing of congressional and state legislative districts—that have led to congressional delegations stacked with GOP members and yielded Republican majorities in the state legislatures.

In North Carolina, Pennsylvania, and Ohio, to name just three, GOPers have recast state and congressional districts to consolidate black voters into what the political pros call “majority-minority districts” to diminish the influence of these voters. North Carolina is an especially glaring example: GOP-redistricting after the 2010 elections led to half the state’s black population—1.1 million people—being corralled into one-fifth of the state legislative and congressional districts. “The districts here take us back to a day of segregation that most of us thought we’d moved away from,” State Sen. Dan Blue Jr., who was previously North Carolina’s first black House speaker, told the Nation in 2012.

A major driving force behind this political resegregation is the Republican State Leadership Committee, a deep-pocketed yet under-the-radar group that calls itself the “lead Republican redistricting organization.” The RSLC is funded largely by Fortune 500 corporations, including Reynolds American, Las Vegas Sands, Walmart, Devon Energy, Citigroup, AT&T, Pfizer, Altria Group, Honeywell International, Hewlett-Packard. Other heavyweight donors not on the Fortune 500 list include Koch Industries, Blue Cross Blue Shield, and the US Chamber of Commerce. At the same time these big-name firms underwrite the RSLC’s efforts to dilute the power of black voters, many of them preach the values of diversity and inclusion on their websites and in corporate reports.

As part of its Redistricting Majority Project—which, tellingly, is nicknamed REDMAP—the RSLC, starting in 2010, poured tens of millions of dollars into legislative races around the country to elect new GOP majorities. Next it provided money and expertise to state officials redrawing political boundary lines to favor the Republican Party—and to shrink the clout of blacks, Hispanics, and other traditionally Democratic voters. Unlike its Democratic equivalent, the RSLC has vast sums at its disposal, spending $30 million during the 2010 elections, $40 million in 2012, and $22 million in 2014.

Here’s Why Bank of America’s $17 Billion Settlement Probably Won’t Cost It That Much

On Thursday, the Justice Department announced a record $17 billion settlement with Bank of America over accusations that the bank—as well as companies it later bought—intentionally misled investors who purchased financial products backed by toxic subprime mortgages. It’s the largest settlement the US government has reached with any company in history, and it is roughly equal to the bank’s total profits over the past three years. But as is the case with similar settlements involving Citigroup and JPMorgan Chase, Bank of America probably won’t end up paying that much.

Potential tax deductions and tricky accounting techniques in deals like this often hide the real cost to banks. The Associated Press explains:

Bank of America will pay $9.65 billion in cash and provide consumer relief valued at $7 billion…Whether cash payments are structured as penalties or legal settlements can determine whether targeted companies can declare them as tax-deductible business expenses. Also, consumer relief is an amorphous cost category: If Bank of America’s deal resembles the department’s previous settlements with JPMorgan and Citigroup, that part could be less costly to the company than the huge figures suggest.

…Much of the relief will come from modifying loans that the banks have already concluded could not be recovered in full. Reducing the principal on troubled loans often just brings the amount that borrowers owe in line with what the banks already know the loan to be worth.

Settlement math also affects the actual cost of the deals, allowing banks to earn a multiple for each dollar spent on certain forms of relief. Under Citi’s deal, for example, each dollar spent on legal aid counselors is worth $2 in credits, and paper losses on some affordable housing project loans can be credited at as much as four times their actual value.

Banks generally regard the consumer relief portion of settlements as “stuff they’re doing anyway,” banking analyst Moshe Orenbuch told the AP.

The Bank of America settlement resolves more than two dozen investigations by prosecutors around the country.
