In November, TMZ reported that a former Florida State University student had accused the school’s quarterback, Jameis Winston, of rape nearly a year ago. The accuser’s lawyer says that after she came forward the Tallahassee police tried to dissuade her from pressing charges, warning her that the city is “a big football town” that might not treat her warmly if she leveled these allegations. Indeed, since her charges became public, some Seminoles fans have floated conspiracy theories that a rival school or Heisman Trophy contender may have put the accuser up to it. Prosecutors, for their part, will hold a press conference on Thursday afternoon to announce whether they’ll go forward with the case.

Ultimately, Winston—whose DNA was found at the scene and who claims the sex was consensual—may not be charged. But the case has highlighted a disturbing and long-standing pattern in college football. At top football schools the sport is a major moneymaker, and many big-name universities (and law enforcement authorities in those jurisdictions) have too often shielded players accused of rape—even going so far as to smear and punish victims who speak out. Dan Drezner points out today that in the latest poll from the Council on Foreign Relations, the opinions of foreign policy elites have converged quite a bit with the opinions of the general public. But among the top five items in the poll, there’s still one big difference that sticks out like a fire alarm: ordinary people care about American jobs and elites don’t. Funny how that works, isn’t it?

Tax-Free Internet Sales May Finally Be a Thing of the Past

Amazon CEO Jeff Bezos announced on 60 Minutes last night that Amazon would someday make home deliveries via propeller-driven drones. Will this actually ever happen? I don’t know, but I suspect that Bezos doesn’t really care. Today, everyone is talking about Amazon drones, which means they’re talking about Amazon. Mission accomplished.

However, it turns out that today brings much more important news for online retailers. Tacocopters may make for amusing conversation, but sales taxes mean a lot more for the bottom line:

The Supreme Court on Monday declined to get involved in state efforts to force online retailers such as Amazon.com to collect sales tax from customers even in places where the companies do not have a physical presence….All but five states impose sales taxes, and an increasing number have passed legislation to force online retailers such as Overstock and eBay to begin collecting those taxes from customers.

….As is its custom, the court gave no explanation for turning down petitions from Amazon and Overstock.com to review a decision by New York’s highest court to uphold that state’s 2008 law requiring sales tax collections.

Seattle-based Amazon has no offices, distribution centers or workforce in New York. But the New York Court of Appeals said Amazon’s relationship with third-party affiliates in the state that receive commissions for sending Web traffic its way satisfied the “substantial nexus” necessary to force the company to collect taxes.

Happy Cyber Monday! As it happens, Amazon pretty much caved in on this issue a year ago, but this is still an important non-ruling. It almost certainly means that every other state will fairly quickly follow the lead of California and New York, and it means that every other online retailer will have to start collecting state sales taxes too.

At a guess, this might also spur Congress to pass national legislation governing online sales taxes. Republicans have resisted this since it would effectively raise taxes on consumers, but if that’s going to happen anyway then it might be worthwhile to at least harmonize the treatment of companies across all 50 states. It could even be a chance to put some modest limits on internet sales taxes, which might actually count as a tax reduction in Republican eyes. Who knows? But certainly national legislation has a slightly brighter outlook today than it did yesterday.

Racism Is Over, According to the RNC’s Twitter Account

Sunday is the 58th anniversary of Rosa Parks’ arrest. The Republican National Committee took to Twitter to celebrate the civil rights icon:

It’s a weirdly phrased tweet, given that racism is still a huge problem in America, and elsewhere. For the record, the RNC’s actual statement on Rosa Parks is much better and less awkward. The statement acknowledges that earlier this year, a bronze statue of Parks was unveiled in the US Capitol’s National Statuary Hall (which is full of white supremacists).

But if you’re looking for something that is actually terrifying and appalling, just remember that this Supreme Court seems to think that racism in America is over.

This year’s meme of the day—literally—is that Black Friday is just a bunch of meaningless hooey. To sample just a few: Neil Irwin tells us that Black Friday sales have no broad significance; David Lazarus says Black Friday crowds are losing out to the internet; Suzanne Kapner says Black Friday doorbusters are just an illusion; Lydia DePillis says Black Friday is a terrible and dangerous tradition; and the staff of the Christian Science Monitor this year debunks no fewer than 16 Black Friday myths.

Is it like this every year? Maybe. But I don’t remember quite such relentless dyspepsia over Black Friday in years past. Plenty of horror, shock, and disgust, to be sure, but not mere shoulder-shrugging dismissal. Because of this, I’m officially declaring that the Black Friday bubble has peaked. If you own stock in Black Friday Inc., it’s time to sell.

Judge Agrees to Resentence Rapist Who Got No Prison Time

Following a national outcry, the Alabama judge who sentenced Austin Smith Clem to probation and no prison time for three rape convictions has agreed to reconsider the sentence. The judge, James Woodroof, filed an order Tuesday indicating his intention to resentence Clem. Brian Jones, the district attorney for Limestone County, in north central Alabama, had previously appealed the sentence as too lenient.

In September, a Limestone County jury found Clem, 25, guilty of raping Courtney Andrews, a teenage acquaintance and his then-neighbor, three times—twice when she was 14, and again when was she was 18. Clem’s defense attorney did not call any witnesses at trial. After less than two hours of deliberation, the jury returned guilty verdicts against Clem on one count of first-degree rape and two counts of second-degree rape.

On November 13, Woodroof ruled that Clem would be punished by serving two years in a program aimed at nonviolent criminals and three years of probation.

Clem’s victim, now 20, said she was “livid” when she first heard the verdict. Her case has since received national attention. On Sunday, she appeared on MSNBC, where she told Melissa Harris-Perry, “I need for him to be in prison. I’m not going to feel safe other than that.”

Only Republicans Believe Obamacare Is Doomed

Greg Sargent points us this morning to the latest CNN poll on Obamacare, and it shows that despite all the rollout problems, attitudes toward the law haven’t changed an awful lot:

There are some additional crosstabs at the link, and Sargent points out that they paint a cautiously positive picture:

The poll also finds 54 percent believe current problems facing the law will eventually be solved, versus 45 percent who don’t. Again, that latter sentiment is driven by Republicans: Independents think they will be solved by 50-48; moderates by 55-43. By contrast, Republicans overwhelmingly believe they won’t be solved by 72-27.

Crucially, young Americans — who are important to the law’s success – overwhelmingly believe the problems will be solved (71 percent). Part of the campaign by Republicans to persuade Americans that the law’s doom is inevitable is about dissuading people from enrolling, to turn that into a self fulfilling prophesy.

Republicans are convinced the law is already a failure. And why wouldn’t they? The Fox News bubble has been telling them that for months. But the rest of the country is willing to give it a chance and thinks its problems will probably be solved. When they are, support will go up even higher.
