Another Day, Another Sickening New Video of Police Brutality

A disturbing video taken in New York City shows police punching and beating a man who greeted the officers with his hands up.

The July 7 video, obtained and published by the New York Daily News, shows Thomas Jennings standing at the counter of a convenience store, raising his hands in surrender. A police officer approaches with a baton in his right hand and starts pushing him in the chest with his left. Jennings begins to back up with his hands in the air, when a second officer rushes in and starts punching Jennings in the head. The two officers then begin to handcuff Jennings’ hands behind his back. After cuffing Jennings, one officer hits him in the back with the baton and uses his elbow to drive Jennings’ face into the counter.

Jennings was arrested and accused of robbery, menacing, larceny, possession of stolen property, possession of a weapon, and resisting arrest, according to the criminal complaint obtained by Mother Jones. He was held without bail until July 13, and was then released.

According to the Daily News, the Brooklyn District Attorney’s Office and the NYPD are both reviewing the incident.

The incident apparently began at another store, where Jennings and another man tried to buy two slices of pizza. Jennings told the paper that he was a dollar short, so he stepped outside to ask someone for a quick loan. After he left, the other man allegedly pulled out a switchblade and told the employee that they weren’t going to pay for the pizza. Then both men fled. Police tracked Jennings to another store, where the confrontation took place.

“It’s horrendous what they did to him,” Amy Rameau, Jennings’ lawyer, told the Daily News. “He had his hands up. He didn’t pose a threat to anyone in that store. It was an absolute use of excessive force.”

Ex-Congressman Michael Grimm Gets Eight Months in Prison for Tax Crimes

Former Rep. Michael Grimm (R-N.Y.), the Staten Islander best known for threatening on-camera to “break” a reporter “in half—like a boy,” has been sentenced by a federal judge to eight months in prison for tax evasion.

The sentencing, by US District Judge Pamela Chen, comes seven months after Grimm pleaded guilty to his role in filing a false tax return. Grimm had been indicted in April 2014 on 20 counts related to accounting practices at Healthalicious, a Manhattan restaurant he owned before his time in Congress. The restaurant’s co-owner, Bennett Orfaly, has previously been accused of having ties to a convicted Gambino family mobster.

Despite his indictment, last year, Grimm ran for reelection to his third term in Congress—and won. It was not until December 30—seven days after entering his guilty plea—that he announced his intentions to resign his seat.

Before Grimm was the target of an investigation by the FBI, he served for two decades as one of its agents. It was during this time that Grimm reportedly pulled a gun in a Queens nightclub, and, after a bouncer ejected him, stormed the nightclub with another FBI agent and members of the NYPD. “I’m a fucking F.B.I. agent,” Grimm reportedly said. “Ain’t nobody gonna threaten me.”

Philadelphia, a city with a vastly smaller population than that of New York City, has seen a much higher rate of police shootings in recent years. According to a new report published on Monday by the US Department of Justice, police violence disproportionately affects Philadelphia’s black community, and officers don’t receive consistent training on the department’s deadly force policy.

The 174-page report results from an investigation the DOJ launched in 2013 at the request of Philadelphia Police Commissioner Charles Ramsey, during a time when officer-involved shootings, including fatal incidents, were on the rise, even as violent crimes and assaults against the police was on the decline. “Police carry baggage and lack legitimacy in some communities,” Ramsey, who has been appointed to chair the Presidential Task Force on 21st Century Policing, recently told the New York Times. “And for us to change the paradigm, we have to understand why we are viewed in this way.”

The DOJ’s Philadelphia investigation, which examined nearly 400 deadly force incidents between 2007 and 2013, provides a rare close-up of the patterns of officer-involved shootings. The report follows on the heels of another damning report the DOJ published on the city of Ferguson, where federal investigators found systematic racial discrimination among public officials and police.

While it’s nearly impossible to know how much the findings in Philadelphia represent police practices across the country—there is no comprehensive national data on police officers’ use of force, as we reported last year—the DOJ probe does reveal an alarming rate of shootings when compared to other large departments. Philadelphia’s police force, which is one-fifth the size of the NYPD, saw dozens more officer shootings resulting in deaths and injuries than those by the NYPD over the same period.

Here are a few key findings from Monday’s report:

In a city where blacks and whites each make up about 45 percent of the population, almost 60 percent of the officers involved in shootings between 2007 and 2013 were white, while 81 percent of suspects involved were black.

In nearly half of officer-involved shootings of an unarmed victim, the officer mistook a nonthreatening object for a gun.

Black suspects were the most likely to get shot because of a misidentified object. White suspects were the most likely to be involved in a physical altercation that resulted in the officer shooting.

Among officer-involved shootings in which the victim was black, black and Hispanic officers were more likely than their white counterparts to have shot at a suspect after mistaking a plain object for a gun.

While the overall number of officer-involved shootings declined between 2007 and 2013, the share of victims who were unarmed during those incidents more than tripled, from 6 percent in 2007 to 20 percent in 2013.

Officers initiated the encounter in 43 percent of officer-involved shootings in 2013, down from nearly 60 percent in 2007 and nearly 70 percent in 2008.

Out of 382 suspects involved in the shootings between 2007 and 2013, about 88 were killed, 180 injured, and 115 unharmed. The majority of suspects brandished a weapon but did not shoot, held a weapon other than a firearm, or were unarmed. Forty-nine suspects (13 percent) shot at the officer, injuring six and killing one.

The average time spent on investigating an officer involved shooting has declined from 417 days in 2007 to 264 days in 2013.

Out of 88 officers who were found to have violated department policy during a shooting incident, 73 percent were not suspended or terminated. Some interviewees told the Justice Department they believed that the department’s board of inquiry undermined findings from internal reviews of officer shootings, resulting in “too little discipline.”

New Yorkers Disapprove of Cops Turning Their Backs on Mayor Bill de Blasio

A new public opinion poll shows that an overwhelming majority of New Yorkers—nearly 80 percent—believe police union leader Patrick Lynch was “too extreme” in saying that the mayor’s office had blood on its hands for supporting the Mike Brown and Eric Garner protests. The poll comes amid persisting tensions between New York City Mayor Bill de Blasio, NYPD officers, and union leaders, which came to a head after two cops were shot and killed in Brooklyn on December 20. The Quinnipiac University poll, published Thursday, showed that 69 percent of New Yorkers disapproved of police officers turning their backs on Mayor Bill de Blasio as an act of protest during the funerals of recently slain officers Wenjian Liu and Rafael Ramos.

The poll also revealed stark racial divides in New Yorkers’ opinions on the mayor’s handling of relations between the police and the community: 62 percent of black respondents approved, while 63 percent of white respondents disapproved. They were similarly divided on who they believed was at fault for the ongoing tensions between de Blasio and the NYPD: 69 percent of black voters blamed police; 61 percent of white voters blamed the mayor.

A Majority of Cop Killers Have Been White

As officials continue to investigate Saturday’s tragic killing of two NYPD officers, Wenjian Liu and Rafael Ramos, details have surfaced about the suspect, 28 year old Ismaaiyl Brinsley, who allegedly shot a woman in Baltimore before traveling to New York. Anti-police posts he appears to have published on social media sites prior to the killings have lead many to connect his crime to protests that occurred in previous weeks, and some commenters have cast blame on officials including New York Mayor Bill de Blasio, Attorney General Eric Holder, and President Obama, all of whom have condemned the violence. (Read my colleague Kevin Drum’s response to that.)

But, while every killing of an officer is a tragedy, it is worth noting, as my colleague Shane Bauer reported in the context of another story, assaults and felony killings of police officers in the US are down sharply over the past two decades. Attention has also been focused on Brinsley’s race, but FBI data shows that, though African Americans are arrested and incarcerated at a higher rate than whites, the majority of assailants who feloniously killed police officers in the past year were white.

Grand Jury Doesn’t Indict Staten Island Cop in Death of Eric Garner

A Staten Island grand jury has declined to indict NYPD officer Daniel Pantaleo in the death of Eric Garner.

The “no-bill” decision comes despite the fact that Pantaleo was caught on camera putting Garner in a chokehold during his July 17 arrest.

Cell-phone video of Garner’s July 17 arrest shows Pantaleo wrestling him to the sidewalk on Bay Street, with the white cop’s arms wrapped around the neck of the black suspect.

On the ground, Garner was heard repeatedly yelling “I can’t breathe!” as Pantaleo and other cops held him down and handcuffed him.

The Medical Examiner’s Office ruled Garner’s death a homicide caused by “compression of neck (chokehold), compression of chest and prone positioning during physical restraint by police.”

Police union leaders denied that Pantaleo used a chokehold — which is banned by the NYPD — and blasted the autopsy as part of a “political” witch hunt.

The fact that this video exists, that the cop saw it being recorded, that the grand jury watched it and then still declined to indict, should chasten anyone who thinks body cams will be a cure-all for police abuse.

NYPD Officer Allegedly Caught On Video Throwing Pregnant Woman To the Ground

Yet another video has surfaced capturing what appears to be a violent arrest conducted by an officer of the New York Police Department.

In the video caught by a bystander over the weekend, a visibly pregnant Sandra Amezquita and her husband Ronel Lemos say they were attempting to intervene while officers arrested Amezquita’s son, seen sitting on the ground.

The arresting officer suddenly slams Amezquita to the ground, right before he forcefully shoves another woman out of the way.

“What we saw in that gruesome video is a woman who’s trying to protect her son, who is being stopped and frisked by police, and she herself became a victim, slammed onto the floor,” said Dennis Flores, from local blog El Grito de Sunset Park, the site that first posted the video.

“The first thing I thought was they killed by baby and they’re going to kill my wife,” Lemos said.

Amezquita says she suffered vaginal bleeding and bruises to her stomach. She was given a summons for disorderly conduct; Lemos was arrested for hitting an officer.

The disturbing incident comes just less than a week after another officer, from the same Brooklyn precinct, was suspended after being caught on video kicking a street vendor in the head.
