Editor’s note, April 18: An explosion Wednesday at a fertilizer plant north of Waco, Texas, killed between five and 15 people, authorities say, and injured more than 160. The US Chemical Safety Board, an independent agency that investigates chemical accidents and issues safety recommendations, says it expects a “large investigative team” to arrive at the scene this afternoon. As the Center for Public Integrity reported Wednesday, the board has been criticized for failing to complete investigations in a timely manner.

On April 2, 2010, an explosion at the Tesoro Corp. oil refinery in Anacortes, Washington, killed five workers instantly and severely burned two others, who succumbed to their wounds.

Eighteen days later, the Deepwater Horizon drilling rig blew up in the Gulf of Mexico, killing 11 workers and unleashing a massive oil spill.

In both cases, the US Chemical Safety Board—an independent agency modeled after the National Transportation Safety Board—launched investigations. Like the NTSB, the Chemical Safety Board is supposed to follow such probes with recommendations aimed at preventing similar tragedies.

Yet three years after Tesoro and Deepwater Horizon, both inquiries remain open—exemplars of a chemical board under attack for what critics call its sluggish investigative pace and short attention span. A former board member calls the agency “grossly mismanaged.”

The number of board accident reports, case studies, and safety bulletins has fallen precipitously since 2006, an analysis by the Center for Public Integrity found. Thirteen board investigations—one more than five years old—are incomplete.

Last month, we detailed how Intuit, the maker of TurboTax, has fought a proposal that could make filing taxes easier and cheaper for millions of Americans.

As we noted, tax activist Grover Norquist and other conservatives have also opposed the proposal, called “return-free filing,” which would give many taxpayers the option to receive a pre-filled return that they could simply review, sign and send back, all for free. Return-free filing has been endorsed by many experts and adopted by several European countries.

As it turns out, Norquist has also recently weighed in on the side of the tax prep industry on another issue.

A House bill introduced earlier this year would bar the IRS from offering taxpayers software that would compete with programs like TurboTax. In March, Norquist and others wrote a letter to members of Congress that urged them to support the bill—what they called a “pro-taxpayer, anti-IRS power grab legislation.”

At issue is how Americans file their taxes and whether electronic filing can be offered directly through the IRS.

Missouri Lawmaker: No Welfare If Your Kid Gets Mono or Depression

Missouri Rep. Steve Cookson, a Republican, caused a stir last year when he offered a bill to ban any discussion of sexual orientation in public schools outside of traditional sex ed and science instruction. That meant teachers couldn’t talk about gay and lesbian issues during class, and gay-straight alliances couldn’t meet during the school day. Critics called it the “don’t say gay” bill. It died in committee.

Now, Cookson is back in the news for introducing another controversial bill. Children of welfare recipients can’t miss more than 10 percent of their classes—roughly three weeks of school—or their family loses welfare benefits. The bill, which would amend the state’s welfare statute, is a single sentence long:

School age children of welfare recipients must attend public school, unless physically disabled, at least ninety percent of the time in order to receive benefits.

You’d be hard-pressed to find anyone who thinks it’s OK to skip three weeks’ worth class during the school year. But what about an unexpected illness like mono or clinical depression? Cookson has yet to clarify what exactly qualifies for the “physically disabled” exemption in his bill. And so unless mono qualifies as a physical disability, the critics who deride Cookson’s bill the “don’t get sick” bill make a fair point. A entire family could lose its state assistance if their kid got mono from a classmate.

As the Kansas City Star notes, state Republicans, which control the Missouri General Assembly, recently named Cookson the chair of the House education committee. That means his “don’t get sick” bill could get a full airing on the House floor.

Frackers Are Losing $1.5 Billion Yearly to Leaks

Of all the many and varied consequences of fracking (water contamination, injured workers, earthquakes, the list goes on) one of the least understood is so-called “fugitive” methane emissions. Methane is the primary ingredient of natural gas, and it escapes into the atmosphere at every stage of production: at wells, in processing plants, and in pipes on its way to your house. According to a new study, it could become one of the worst climate impacts of the fracking boom—and yet, it’s one of the easiest to tackle right away. Best of all, fixing the leaks is good for the bottom line.

According to the World Resources Institute, natural gas producers allow $1.5 billion worth of methane to escape from their operations every year. That might sound like small change to an industry that drilled up some $66.5 billion worth of natural gas in 2012 alone, but it’s a big deal for the climate: While methane only makes up 10 percent of greenhouse gas emissions (20 percent of which comes from cow farts), it packs a global warming punch 20 times stronger than carbon dioxide.

“Those leaks are everywhere,” said WRI analyst James Bradbury, so fixing them would be “super low-hanging fruit.”

The problem, he says, is that right now those emissions aren’t directly regulated by the EPA. In President Obama’s first term, the EPA set new requirements for capturing other types of pollutants that escape from fracked wells, using technology that also, incidentally, limits methane. But without a cap on methane itself, WRI finds, the potent gas is free to escape at incredible rates, principally from leaky pipelines. The scale of the problem is hard to overstate: The Energy Department found that leaking methane could ultimately make natural gas—which purports to be a “clean” fossil fuel—even more damaging than coal, and an earlier WRI study found that fixing methane leaks would be the single biggest step the US could take toward meeting its long-term greenhouse gas reduction goals.

Charts: Look At How Badly Obama Lags on Judicial Appointments

Last week, President Obama withdrew his judicial nominee for the powerful DC Circuit Court of Appeals—which hasn’t had a nominee confirmed since 2006—because Republicans threatened to filibuster her. This high-profile battle is just the tip of the iceberg. Because of Republican obstructionism, the Obama administration’s lackadaisical pace of nominations, and problems with the Senate confirmation process, more federal judgeships are staying vacant nationwide under this president than under President Bush, and Obama’s nominees are taking longer to get confirmed.

During Obama’s first term, the number of appeals court vacancies rose from 14 to 17. During Bush’s first term, by contrast, appeals court vacancies dropped from 27 to 18. Because Obama has been slower to nominate than Bush or Clinton, the average number of days from the opening of a seat to a nomination increased by 44 percent between Bush’s and Obama’s first terms.

When the president finally does nominate someone, the Senate is generally reluctant to confirm her. Obama has 15 judicial nominees waiting for Senate floor votes right now. Overall, his judicial nominees wait an average of 116 days on the Senate floor for a vote—three times longer than Bush’s average judicial nominee wait time. When the 112th Congress ended in December, the Senate had approved 175 of Obama’s judges. By contrast, Bush had 206 judges approved in his first term, and President Clinton had 204.

The figure below, also by Remapping Debate, compares Bush and Obama’s first terms, showing the average number of days between vacancy and nomination, and the number of days nominees were pending before the Senate.

Why is the GOP so obstinate on confirmations? Senate Republicans may be giving Democrats a little payback. “Republicans don’t think Bush’s nominees were treated fairly,” Russell Wheeler, a fellow at the Brookings Institution, which has tracked the phenomenon, told Bloomberg News on Wednesday.

Confirmation of a nominee to the DC circuit court, which is one step below the Supreme Court, is particularly important for Obama’s second term because the court handles all disputes related to regulations and executive actions. “With legislative priorities gridlocked in Congress, the president’s best hope for advancing his agenda is through executive action, and that runs through the D.C. Circuit,” Doug Kendall, president of the Constitutional Accountability Center, told the Washington Post Tuesday.

Right now that court is conservative-dominated, with four Republican and three Democratic appointees, and four vacancies (twice as many as any other court of appeals). This configuration didn’t work out so well in the Obama’s first term. The DC circuit court blocked EPA air pollution rules and put a hold on cases related to workers’ rights.

Of the DC circuit confirmation, Kendall says “There are few things more vital on the president’s second-term agenda.”

EPA to Study Flame Retardant Chemicals. Finally.

The EPA announced this week that it will study the health and environmental risks of 23 chemicals, with an emphasis on chemical flame retardants that are found in many common products.

Even though they were phased out of baby clothes back in the 1970s due to health concerns, flame retardants are still used in baby cribs and car seats, couches, and electronics. Many have been linked to cancer and neurological and developmental problems, particularly in children. And we use so much of them that they’re turning up in our food, too.

The EPA’s announcement came just as a new study found extremely high levels of flame retardant chemicals on airplanes—”some of the highest measurements I’ve ever seen,” according to the paper’s co-author. This is less of a concern for airline passengers than it is for the pilots and flight attendants, but it does raise questions about yet another way we’re being exposed to potentially dangerous chemicals.

The EPA plans to evaluate four common flame retardants—TBPH, TCEP, and HBCD—under the Toxic Substances Control Act (TSCA), the 37-year-old law governing chemical regulation. As we’ve reported here before, that law is both weak and outdated, an issue that the EPA noted in its announcement on Wednesday:

“EPA is committed to more fully understanding the potential risks of flame retardant chemicals, taking action if warranted, and identifying safer substitutes when possible,” said James J. Jones, Acting assistant administrator for the Office of Chemical Safety and Pollution Prevention. “Though today’s announcement represents a significant step forward on chemical safety, it’s important to remember that TSCA, this country’s chemicals management legislation, remains in dire need of reform in order to ensure that all Americans are protected from toxic chemicals in their environment.”

TSCA reform advocates point to flame retardants as an example of why current chemical regulations are a total failure. EPA is just now evaluating their safety, after decades of human exposure to these chemicals. “Flame retardants have become exhibit A for our nation’s failed chemical policy,” said Andy Igrejas, executive director of Safer Chemicals, Healthy Families. “Many have have turned out to be very toxic, and yet they have found their way into our homes and our bodies through their use in consumer products.”

Obama’s New FCC Pick Could Help Determine the Future of the Internet

One of the hot jobs in the US government—chairman of the Federal Communications Commission—is about to become vacant, and President Barack Obama’s pick for this position will say much about his priorities and what it takes to win a job within his administration.

The current chairman, Julius Genachowski, was a Harvard Law classmate of Obama and longtime Washington denizen with several stints in the private sector, and last week he announced he’s splitting after four years in the post. Genachowski has had a rollicking tenure at the more-important-than-ever agency. His FCC approved the controversial NBC/Comcast merger, but it killed AT&T’s $39 billion bid for T-Mobile. He developed a national broadband plan, while pushing for universal broadband access and contending with spectrum crunch. He’s had to navigate the knotty issue of net neutrality (at one point angering both Verizon and public interest advocates). His tenure has vividly demonstrated that the FCC chairman’s office is a node for cutting-edge policy issues related to economic development, technology, education, and media.

New York City Mayor Mike Bloomberg wants new gun control legislation so bad that he’s set to spend a staggering $12 million of his own money on ads targeting US senators in a dozen states.

As the New York Times reports, Bloomberg’s new wave of ads, which begin on Monday, support universal background checks for nearly all gun purchases, but do not mention a ban on assault weapons. The ads, run under the auspices of Mayors Against Illegal Guns, a group funded and co-chaired by Bloomberg, will target Sens. Kay Hagan (D-N.C.), Mary Landrieu (D-La.), Mark Pryor (D-Ark.), Dean Heller (R-Nev.), Rob Portman (R-Ohio), Patrick Toomey (R-Penn.), Saxby Chambliss (R-Ga.), Johnny Isakson (R-Ga.), Dan Coats (R-Ind.), and Jeff Flake (R-Ariz.).

Bloomberg’s $12 million ad buy further cements his position as the main political force challenging the clout of the National Rifle Association. For decades, the NRA has used its money and manpower to oust politicians who support any new regulation of guns in America. The threat of NRA attacks helped stifle any effort at new gun laws, including requiring background checks for most gun purchases and reinstating the ban on assault rifles, which expired in 2004. Now, by pumping money into Mayors Against Illegal Guns and Independence USA, his super-PAC, Bloomberg hopes to counter the might of the NRA, while giving cover to pro-gun-control legislators.

Here’s more from the Times on Bloomberg’s new ad blitz:

In each state, the commercials urge support for the measure to require background checks for nearly all firearms purchases, not just those in gun stores, the most debated element of the legislation and a coveted goal of gun control advocates.

Mr. Bloomberg has singled out Mr. Flake, who already voted against the expansion of background checks in the Senate Judiciary Committee, by producing a special, scolding commercial aimed at Arizona. “Flake’s vote,” the ad declares, equals “no background checks for dangerous criminals.”

The mayor, who over the years has spent tens of millions of dollars to support his favored candidates, holds the power to use his “super-PAC” to wield influence in the midterm Congressional elections next year and beyond. He said he would heavily favor “candidates who will stop people from getting killed.”

“There is an easy measure of how you decide who those are,” he said, noting that gun rights groups rate lawmakers. “The NRA keeps score of it for you. They are public information.”

To those who might fear his financial might, he added: “If they pass sensible gun legislation, there is not an issue.”

Bloomberg has scored a handful of recent gun-related victories. He pumped nearly $10 million into Independence USA in the 2012 elections; the super-PAC went on to spend $3 million to defeat Rep. Joe Baca (D-Calif.), a pro-gun rights congressman. Independence USA also spent millions last month in the Democratic primary for Illinois’ 2nd congressional district to defeat Debbie Halvorson, who had an “A” rating from the NRA. Democrat Robin Kelly, whom Bloomberg supported, ultimately cruised to victory.

The NRA has said it plans to fire back at Bloomberg with an advertising campaign of its own. And an NRA lobbyist told the Times that it’s confident that many Americans won’t buy into Bloomberg’s message. “What he is going to find out is that Americans don’t want to be told by some elitist billionaire what they can eat, drink and they damn well don’t want to be told how, when and where they can protect their families,” Chris Cox, the NRA’s top lobbyist, said.

Trader Joe’s and Whole Foods Won’t Sell GM Salmon

A number of US supermarket chains pledged on Wednesday not to sell genetically modified salmon, in a sign of growing public concern about engineered foods on the dinner table.

The US Food and Drug Administration (FDA) is in the final stages of deciding whether to allow GM salmon on to the market. If approved, AquaBounty Technology’s salmon would be the first genetically engineered animal to enter the food supply.

The company combined genes from two species of salmon with a pouter eel to produce a fish it says it can bring to market twice as fast as conventional salmon.

The GM salmon is the first in some 30 other species of genetically engineered fish under development, including tilapia. Researchers are also working to bring GM cows, chickens, and pigs to market.

Sneaky House Bill Would Gut Financial Reform

A bipartisan group of four representatives introduced a sneaky little bill Wednesday that would dismantle an huge chunk of the historic financial reform laws enacted after the financial crisis.

The Swap Jurisdiction Certainty Act, introduced by Reps. Scott Garrett (R-N.J.), Mike Conaway (R-Tex.), John Carney (D-Del.), and David Scott (D-Ga.), all of whom sit on the House Financial Services Committee, would allow big banks to shift risky activities to foreign subsidiaries in order to avoid US regulations. Part of the landmark 2010 Dodd-Frank financial reform act requires that derivatives—financial products whose value is based on things like currency exchange rates and crop prices—be traded in public marketplaces, instead of in private. The new bill would exempt foreign companies from these US derivatives rules, which sounds reasonable; the law purportedly just affects other countries. But what it would mean is that huge US-based banks that operate internationally could just do their paperwork through their international arms to avoid regs, effectively gutting the section of Dodd-Frank that gave federal regulators the authority for the first time to regulate derivatives such as the credit default swaps that helped cause the 2007 bank failures.

The Commodities Futures Trading Commission and Securities and Exchange Commission were supposed to have finalized the Dodd-Frank derivatives laws into regulations a long time ago, but those governing international trading are still pending. The agencies are supposedly close to final rules now—SEC chair Elise Walter said earlier this year that finalizing these rules was a top priority at the agency. But until they’re finalized, the rules are still vulnerable to tweaking, or gutting, by crafty lawmakers (or crafty industry folk).

Carney has defended his bill as consumer-friendly and bank-friendly all at once: “Congress and regulators must ensure that we’re protecting American consumers, ending future bailouts and maintaining American competitiveness in an increasingly global economy,” he said in a press release. Garrett was more straightforward about what the bill would do. “Our job creators—millions being crushed by overly burdensome Washington rules and regulations—deserve to be on a fair, level playing field with the international community,” he said.

But last year, when Congress introduced a similar bill, financial reform advocates slammed it. Americans for Financial Reform, a group of national and state organizations that push for common sense financial reforms, wrote an open letter to representatives in May 2012:

The legislation “would create an overwhelming temptation to move swaps business overseas, indeed to the foreign jurisdictions where regulation was most lax compared to the U.S. In addition to seriously undermining the basic transparency and accountability requirements in the US, such a ‘race to the bottom’ would be a serious blow to the entire international effort to make derivatives markets safer.

Walter has said the derivative rules were the “critical linchpin” of Dodd-Frank because of the “global nature of the market.”

Indeed, says Dennis Kelleher, president and CEO of the Wall St. watchdog group Better Markets. “The CFTC proposed very strong cross border guidance,” he told Mother Jones. “Even if the CFTC gets all of the other rules correct—if they don’t get the cross border rules right, then all their other work doesn’t matter.”
