At vast expense, I have spent the past few weeks completely renovating my work area. Needless to say, I didn’t do this for me. I did it for you, because you all deserve blog posts written in the most stimulating and technologically advanced surroundings possible.

It all started when I suddenly realized that I had never liked my desk lamp—so I bought a new one. Then it kind of snowballed. You know how it goes. As you can see, the cats are pretty happy with the whole setup. Sometimes they share the birdwatching pod, other times they stretch out in their own private pods. What more can a cat ask for?

I’m a Transgender Man in North Carolina. Here’s What the Bathroom Law Means For Me.

Charlie Comero, a 35-year-old transgender man in Charlotte, North Carolina, was nervous about having to use women’s bathrooms after his state enacted HB2, a sweeping anti-LGBT law that says you can only use public facilities that match the sex on your birth certificate. So he decided to prepare: He printed cards (see photo below) to hand out to the women he met inside. We asked him to share his story below, in his own words, edited for length and clarity.

I grew up in Michigan, on a farm in a small town, and I moved to Charlotte almost four years ago to teach for a local high school. I was very nervous about moving to North Carolina—it’s technically the “Bible Belt”—but the truth is that Charlotte is amazing, liberal. I fell in love with the city and have stayed ever since.

Now, one person’s story is obviously not an example for the entire community. But I identify as a transgender man and as a nonbinary individual, which means I’ve never identified only as a girl or only as a boy—I’ve always identified as both. I wear men’s clothing, though I do have a closet full of five-inch high heels that I absolutely love and will never get rid of.

Growing up I always felt different from other girls and I couldn’t put my finger on why. Maybe it was a lack of representation of trans people in the media. And I didn’t see it growing up in a small town, so being transgender wasn’t an option, as far as I knew.

Not all transgender people decide to transition physically, but I decided to when I was 34 years old. It took me that long, and you know what got me there? The book The Alchemist: This talk of personal legend and embodying that, that’s what woke me up. I got a ton of support from the yoga community—I do yoga every day—and from the LGB and trans communities. Unfortunately my best friend stopped talking to me, and another dear friend changed how she acted toward me.

I probably started going into the men’s room when I was about six months into my physical transition, which is taking testosterone. I made my decision based on how I was being perceived in society. As soon as my voice got low and I was starting to be seen as male, that’s when I started going to the men’s bathroom. I was scared shitless. It was gross in there. It was liberating and scary. I had this fear that they were going to know I have a vagina. It took me a couple of weeks to realize no one in the men’s bathroom cares; there’s no way to know I wasn’t born with a biological penis.

The day HB2 became law, I was there to testify in front of the Senate, and I had my speech prepared. I was sitting there listening to the senators talk about how important this bill is and how it would protect women and children. If they really cared about women and children, Republicans would actually do things to help women and children, rather than making up some story about an imagined bogeyman walking into a women’s bathroom dressed in women’s clothes to rape women and children. It was absurd. I felt like I didn’t exist, like I wasn’t an equal human.

Afterward I was sitting down with my girlfriend at brunch and I asked her: Where do I go to the bathroom now? It’s literally against the law for me to use the men’s room, and it’s also risky. Even though I’m more than a year on testosterone—I’m getting facial hair, my hair has receded a little—I still don’t always pass as male. Or do I use the women’s room, follow the law, and clearly make people uncomfortable? We started going through the different examples of what would happen, what could happen, and she started crying because it became clear to her that I was at risk for getting hurt.

The first time I went back into a women’s bathroom, I was so nervous. I’m still nervous. I’ve created these cards—I keep them in my wallet. One time I was in a bathroom at a government center in Charlotte, and a woman asked what I was doing there. I tried handing her the card but she didn’t want to take it, she walked away. I saw her later in the hallway, and I said, “I didn’t mean to startle you.” She looked at me and said, “I hope I never make that mistake again.” I have no idea what she meant—I don’t think she knew what it meant to be a transgender man. And then the other day someone gave me a hug after I gave her my card. I don’t know if she recognized it because it’s been viral.

But here’s what I’m most afraid of: When they don’t say anything and just ignore me and leave, I’m afraid to leave the bathroom and to be met by that woman’s boyfriend or husband or an authority figure. Because I could easily be socked.

The senators who wrote this bill made it a lot more difficult for transgender people, because a lot of them have the gender on their driver’s license changed, but not their birth certificate. If I wanted to do that, I’d have to fly back to Michigan. Some of my friends would have to fly out of the country. Some people, depending on the state, have to go in front of judge, and some judges are not going to be cool with allowing a transgender person to make the change.

Last night I reached out to two really close transgender women friends who are people of color, because I’m worried about them, and they are both scared—they feel unsafe. I’m scared, yeah, I’m at risk, yeah, but not as much as them. They were already at risk before this bill, they were already a target, and now it’s multiplied. And that’s the thing that really upsets me—that this bill gives people permission to be bigots.

HB2 isn’t just about bathrooms. It’s stripping away all city ordinances that are in place to protect marginalized folks. Women, including those who aren’t transgender, are starting to realize this affects them, too. It puts all of us at risk unless you’re a white man. And who wrote the bill? White men. Isn’t that interesting?

Donald Trump Is Now Way Out Ahead of Ted Cruz

Two days ago—two!—I posted a Pollster chart showing that Ted Cruz had nearly caught up to Donald Trump on a national level. This was based on polling through April 6, and today we have polling results through April 11. Look what’s happened:

Yikes! The head-to-head between Trump and Cruz has gone from 39-38 to 53-25. Trump now has a 28-point lead over Cruz, about as big as any he’s had since the beginning of the year.

Maybe this is just a temporary spike—or, then again, maybe April 6 was the temporary spike. Either way, this is an extraordinary amount of movement for an aggregate measure in just five days. Did something happen on April 6 that I missed?

UPDATE: Sam Wang says this spike is just the effect of one high-end-of-the-range poll (NBC/SurveyMonkey) and one super-high poll (YouGov). I don’t expect aggregates to move so strongly based on just one or two polls, but it looks like he’s right. Those two polls by themselves added 27 points to Trump’s lead. So I guess there’s no need to panic just yet.

The Time Ted Cruz Defended a Ban on Dildos

In one chapter of his campaign book, A Time for Truth, Sen. Ted Cruz proudly chronicles his days as a Texas solicitor general, a post he held from 2003 to 2008. Bolstering his conservative cred, the Republican presidential candidate notes that during his stint as the state’s chief lawyer before the Supreme Court and federal and state appellate courts, he defended the inclusion of “under God” in the Pledge of Allegiance, the display of the Ten Commandments on the grounds of the state capitol, a congressional redistricting plan that assisted Republicans, a restrictive voter identification law, and a ban on late-term abortions. He also described cases in which he championed gun rights and defended the conviction of a Mexican citizen who raped and murdered two teenage girls in a case challenged by the World Court. Yet one case he does not mention is the time he helped defend a law criminalizing the sale of dildos.

The case was actually an important battle concerning privacy and free speech rights. In 2004, companies that owned Austin stores selling sex toys and a retail distributor of such products challenged a Texas law outlawing the sale and promotion of supposedly obscene devices. Under the law, a person who violated the statute could go to jail for up to two years. At the time, only three states—Mississippi, Alabama, and Virginia—had similar laws. (The previous year, a Texas mother who was a sales rep for Passion Parties was arrested by two undercover cops for selling vibrators and other sex-related goods at a gathering akin to a Tupperware party for sex toys. No doubt, this had worried businesses peddling such wares.) The plaintiffs in the sex-device case contended the state law violated the right to privacy under the 14th Amendment. They argued that many people in Texas used sexual devices as an aspect of their sexual experiences. They claimed that in some instances one partner in a couple might be physically unable to engage in intercourse or have a contagious disease (such as HIV) and that in these cases such devices could allow a couple to engage in safe sex.

The Gender Pay Gap Is Still About 21 Cents Per Dollar

Today is Equal Pay Day, so let’s break down the numbers for the gender pay gap. According to an up-to-date study by Francine Blau and Lawrence Kahn, the current wage gap for annual earnings is 21 cents: On average, women earn 79 cents for every dollar a man earns.

So that’s the headline number. But what are the causes of the gap in men’s and women’s earnings? Blau and Kahn break it down into seven buckets:

You can look at this two ways. The first is to say that the pay gap due to discrimination (the most likely cause of the “unexplained” part of the chart above) is about 10 cents per dollar, since roughly 11 cents is explained by other factors, such as experience in the job, occupation, industry, etc.

The second way—which is my take—is that it’s true that some of the gap goes away when you account for the fact that women tend to work in different jobs than men and take more time off to have children. But that’s all part of the story. When you look at the whole picture, women are punished financially in three different ways: because “women’s jobs” have historically paid less than jobs dominated by men; because women are expected to take time off when they have children, which reduces their seniority; and because even when they’re in the same job with the same amount of experience, they get paid less than men. All of these things are part of the pay gap. Whether you call all three of them “discrimination” is more a matter of taste than anything else.

But however you choose to approach it, the gender pay gap still exists. It’s at least 10 cents per dollar, and more like 21 cents if you accept that most of the mitigating factors are gender-based as well.

Weekly Flint Water Report: April 2-7

I got tired of waiting for Michigan’s DEQ to post Friday’s water testing result, so here is this week’s Flint water report through Thursday. As usual, I’ve eliminated outlier readings above 2,000 parts per billion, since there are very few of them and they can affect the averages in misleading ways. During the week, DEQ took 368 samples. The average for the past week was 10.07.

Samantha Bee Demonstrates How Frighteningly Easy it Is to Purchase a Gun

On the latest Full Frontal, Samantha Bee took us on her quest to rent the costume of the National Rifle Association’s esteemed gun safety mascot, Eddie Eagle. But doing so proved to be a surprisingly onerous process—one that required filling out an 18-page application and dealing with the group’s mandatory 20-day waiting period before anyone can get their hands on Eddie’s gear.

Compare that to the relatively simple task of acquiring a gun, whether it be online, at your run-of-the-mill gun shop, or at a gun show in New Mexico:

“Are you a felon?” one gun own seller in New Mexico asked a Full Frontal producer.

“No,” she replied.

“Ok.”

Another gun secured! As the episode goes on, Bee and her team are able to add to their arsenal with frightening ease, all while being repeatedly denied an elusive Eddie Eagle costume.

Dangerous Work for “Crap Money”—The Dark Side of Recycling

Darkness had enveloped the Newell Recycling yard by the time Erik Hilario climbed into a front-end loader on a cold evening in January 2011. Hilario, a 19-year-old undocumented immigrant from Mexico, earned $8 an hour at the industrial park in East Point, Georgia, working amid jagged piles of scrap metal eventually bound for the smelter.

On this day, Hilario was driving a loader in a paved section of the nine-acre yard known as the defueler or car-processing area. Here, according to witness testimony, gasoline was drained from junked cars through a crude process employing a 30-foot crane and an 11-foot-tall structure topped with a spike known as The Puncher. A claw attached to the crane would pick up cars and smash them, gas tank first, onto the spike, spilling gasoline into a trough. The crane then would swing the cars onto a pile, dripping gas along the way.

As Hilario used the loader to slowly push metal scraps, a spark ignited the gasoline on the ground. An intense fire suddenly engulfed him. “Help me!” he screamed, his coworkers later testified.

When the fire was finally extinguished, Hilario’s severely burned body was found 10 feet from the charred loader. A doctor reviewing Hilario’s autopsy later determined that he was probably conscious for as long as five minutes before he died.

Recycling may be good for the environment, but working conditions in the industry can be woeful. The recycling economy encompasses a wide range of businesses, from tiny drop-off centers in strip malls to sprawling scrap yards and cavernous sorting plants. The industry also includes collection services, composting plants, and e-waste and oil recovery centers. Some of the jobs at these facilities are among the most dangerous in America. Others offer meager pay, and wage violations are widespread. Experts say much of the work is carried out by immigrants or temporary workers who are poorly trained and unaware of their rights.

“These are not good jobs,” says Jackie Cornejo, former director of Don’t Waste LA, a campaign to improve working conditions for waste and recycling workers Los Angeles. “People only hear about the feel-good aspects of recycling and zero waste, and rarely do they hear about the other side.”

The last comprehensive analysis of the American recycling industry, commissioned in 2001 by the National Recycling Coalition, estimated that it employed more than 1 million people. Private scrap yards alone generated more than an estimated $80 billion in revenue in 2015. The nation’s largest trash haulers, Waste Management and Republic Services, are also the largest recycling firms. In 2014, recycling generated a combined $1.7 billion in revenue for the two corporations, or about 7.5 percent of total sales.

But many of the companies that do this work are small and may lack the knowledge and resources to establish effective safety procedures. Recycling workers, by virtue of their immigration status or status as temps, often hesitate to speak up when they see hazards on the job or are victimized by the outright illegal behavior of their supervisors.

One of the largest sectors in recycling, scrap yards, has long had high fatality and injury rates. In 2014 its fatality rate was 20.8 deaths per 100,000 full-time workers, more than 9 times higher than manufacturing workers overall. The same year, garbage and recycling collectors had the fifth-highest fatality rate among the dozens of occupations analyzed by the Bureau of Labor Statistics. No one tracks how many workers die across all recycling sectors. But at scrap yards and sorting facilities, at least 313 recycling workers were killed on the job from 2003 to 2014, according to the BLS.

A FairWarning analysis of Occupational Safety and Health Administration (OSHA) records found that inspections conducted from 2005 to 2014 resulted in scrap yards and sorting facilities receiving about 80 percent more citations per inspection than the average inspected worksite did.

Recycling is dirty, labor-intensive work. It involves heavy machinery, including conveyor belts, shredders, and grinders that can pose a serious risk of injury or death, especially if they’re not properly serviced or lack basic safety features. Unlike many industrial processes, recycling cannot be completely systematized because it deals with an ever-changing flow of materials in all manner of shapes and sizes. Workers may have to personally handle most of the scrap passing through recycling facilities, potentially exposing them to sharp objects, toxics, carcinogens, or explosives.

“I did not realize the danger,” recalls Alice Pulliam of Reidsville, North Carolina, whose 32-year-old son, Christopher Webb, was killed at the Southern Investments plastic recycling plant in July 2012. It purchased loads of milk jugs, detergent bottles, and other recyclable plastics and ground them into bits for re-sale to businesses that would further process the material.

One day, just a couple of months after joining the 13-employee company, Webb was feeding giant bales of compacted bottles and jugs into an auger with 14 spinning blades. More than a foot long and sharpened to a point, these blades broke up the bales before they were ground into finer pieces. Following the plant’s standard procedure, Webb used a forklift to place the roughly three-foot high bales on an elevated platform next to the mouth of the auger, according to a report by the North Carolina Department of Labor’s Division of Occupational Safety and Health. While the blades spun below him, Webb climbed onto the bales to cut the wires holding them together. Then he used the forklift to push the bales into the auger.

Webb was on top of a bale when he fell into the spinning blades below, crushing his head. A subsequent investigation by the state department of labor found that plant employees weren’t instructed to shut down the auger while climbing on the bales, and that the machine did not have the proper guarding to prevent the blades from hitting workers.

The state cited Southern Investments with 35 safety violations, including 16 “willful violations,” and fined the company the unusually high sum of $441,000. The plant’s owner, Donald Southern, said he could not pay and agreed to close Southern Investments and not manage another plastic recycling business in North Carolina. He declined to comment for this story.

Generally, the hazards at scrap yards and sorting facilities are typical of any major industrial operation Safety measures to make these workplaces less dangerous are well known and widely implemented in other industries. “This is not rocket science,” says Susan Eppes, a Houston-based safety consultant to the recycling industry.

Although OSHA says that 5 of its 10 regions have special enforcement programs covering sectors of the recycling industry, safety advocates say that isn’t enough. “Systematically, across the country, they haven’t given the industry the attention it’s due,” says Eric Frumin, the health and safety director for Change to Win, a partnership of four national unions. Advocates are lobbying the agency to create a national program aimed at sorting plants, where metal, paper, and plastic are separated. The Institute of Scrap Recycling Industries, a trade association, recently announced that it is partnering with OSHA to try to reduce injury and fatality rates.

Yet basic safety procedures are often ignored in recycling plants, experts say. Consider the case of Robert Santos, a 46-year-old line supervisor at a Republic Services plant in North Las Vegas, where he helped dump mounds of recyclables onto a conveyor belt. Using radios, workers would direct front-end loaders to push paper from a holding bay onto the belt, which rolled towards a baler. State safety inspectors later learned that it was common for employees to stand on the moving belt to pull material from the holding bay, or to sweep up material along its sides.

The recycling industry tends to attract the desperate and the downtrodden. “It’s a low end of the economy,” says Eric Frumin of Change to Win. “We’ve shipped all the factory jobs to China, so what is the modern-day equivalent of dirty, dangerous factory jobs? Warehouses and recycling plants.”

Take the case of 51-year-old David Lightfritz, who was killed in a 2011 accident at Marietta Industrial Enterprises in Ohio when he tried unjamming a large machine used to separate glass from paper and plastics. Lightfritz got into the recycling business after his previous employer learned he was a registered sex offender. “He didn’t have anything else,” says his older brother, Willard Lightfritz. “He wasn’t out of prison long and he was dead working for crap money”—around $7 an hour.

Recycling drop-off centers have become a priority target of wage theft investigations in California by the Department of Labor’s Wage and Hour Division. Ruben Rosalez, the division’s western regional administrator, says these small businesses are among the “worst that we have to deal with,” and are as exploitative as sweatshops or the agricultural industry.

Wage and Hour investigators in Los Angeles have found that these businesses were often paying their employees as little as $55 or $65 a day, regardless of the hours they worked. Some employers were found to not even keep payroll records, and some failed to provide bathrooms for workers.

On the morning of June 8, 2012, work at the sorting facility was delayed two hours because a mass of paper had clogged the holding bay. Once the jam was cleared, Santos stood on the conveyor belt, yanking paper from the bay, when two to three tons of paper suddenly collapsed on top of him. A coworker would later remember him shouting “Stop the belt! Stop the belt!” before he was enveloped in a pile of paper eight feet high.

After the paper was lifted off of him, Santos was found to have minimal brain activity. He was taken off life support six days later and died. The Nevada Occupational Safety and Health Administration fined Republic Services $5,390 for the incident. Asked to justify such a small fine for a fatal accident, Nevada OSHA’s chief administrative officer said it was in line with agency policy, and that investigators did not find “clear indifference to employee safety and health.” Republic Services did not respond to requests for comment.

After his fatal accident, Erik Hilario’s family moved quickly to file a wrongful death lawsuit. Newell Recycling of Atlanta and the Hilario family declined to comment for this story.

Last September, a jury in Fulton County, Georgia, awarded $29.2 million to the Hilario family. Newell and the family subsequently settled out of court. But the pain of a life cut short lingers Hilario’s family, who were described by their lawyer as still reeling from Erik’s death five years later. “He wanted to be somebody,” Erik’s older brother, Efrain, recalled in his tearful testimony during the trial. “He had many dreams.”

John Oliver Takes on the Error-Plagued World of Credit Reporting

John Oliver took on the dicey world of credit reporting, or as the Last Week Tonight host described it on Sunday, the “basis for the single most important three-digit number in your whole life other than 311—the Beatles of rap rock.”

Businesses use credit reports to determine whether to lend credit to someone. But as Oliver explained, nearly a quarter of every credit report contains inaccurate information, including critical errors that can block a person from getting hired at a job and even renting an apartment.

It’s an error-ridden process by which many important life events are effectively destroyed. Watch above to see how Oliver tries to get credit reporting companies to understand the gravity of these routine mistakes.

Benghazi Committee Passes 700-Day Milestone

House Democrats pointed out today that the Select Committee on Benghazi has now been cranking along for 700 days. Steve Benen comments:

To put this in context, the 9/11 Commission, investigating every possible angle to the worst terrorist attack in the history of the country, worked for 604 days and created a bipartisan report endorsed by each of the commission’s members….Rep. Trey Gowdy’s (R-S.C.) Benghazi panel has also lasted longer than the investigations into the federal response to Hurricane Katrina, the attack on Pearl Harbor, the assassination of President Kennedy, the Iran-Contra scandal, Church Committee, and the Watergate probe.

What Steve fails to acknowledge, of course, is that Benghazi is far more important than any of these other events. So naturally it’s going to take longer. I’m guessing that 914 days should just about do the trick.
