Fresh off his victory in Iowa, Ted Cruz is intensifying his anti-Washington rhetoric, even as his campaign barrels forward fueled by large amounts of cash from the people he claims to stand against. In an email to grassroots supporters sent Tuesday afternoon, Cruz begged recipients to hurry up and send cash to help him fight “the Washington cartel,” and he claimed falsely that “I will never get—nor do I want—money from the D.C. lobbyists or the special interest billionaires.”

Not only is this not true; it’s easy to prove, since Cruz has a well-documented history of bagging money from lobbyists and special-interest billionaires.

For example, during his 2012 run for the Senate, Cruz accepted $125,450 in donations from 92 registered lobbyists (and $21,500 from their family members). We know this because the lobbyists are required to report their donations to political candidates. (A full list of lobbyists donating to Cruz’s Senate campaign can be found at OpenSecrets.org, where I used to work.)

Some of the lobbyists Cruz took money from include Eric Ueland and Daniel Meyer of Goldman Sachs (a combined $3,000); C. Boyden Gray ($2,500), whose past clients include Exelon and FirstEnergy; five reps from Warren Buffett’s Berkshire Hathaway ($13,750); and Jennifer Gray-Bonnar of Koch Industries ($1,250).

Judicial Races Now Look Like Regular Old Political Campaigns. Thanks, Citizens United!

Justice is blind, except when it’s backed by millions in political spending. In the wake of Citizens United, the Supreme Court case allowing unlimited spending on elections by outside groups, judicial races in the thirty-eight states that conduct elections for their high courts have become indistinguishable from ordinary political campaigns, according to a new report released Thursday by the Brennan Center for Justice, which analyzed the 2011-2012 judicial election cycle. The last election cycle saw record spending: Special interest groups and political parties spent an unprecedented $24.1 million on state court races in the last election period, a jump of more than $11 million since 2007-08. The most expensive high court elections were in the four states where courts most closely divided by either judicial philosophy or political party: Michigan, Wisconsin, Florida, and North Carolina.

Top funders were mostly conservative: Business and conservative groups accounted for 7 of the top 10 spenders in 2011–2012.

Special interest group donations escalated: The independent groups empowered by Citizens United spent a record $15.4 million to persuade voters in high court races in the last election period, accounting for more than 27 percent of total spending on high court races. The previous record was $11.8 million in 2003–2004.

Koch-type national groups invaded judicial races: Big spenders in judicial races in the last election cycle included the Koch brothers group Americans for Prosperity in Florida and North Carolina, the NRA-affiliated group Law Enforcement Alliance of America in Mississippi, the Republican State Leadership Committee in North Carolina, and the progressive advocacy group America Votes in Florida.

Super spenders dominated: Thirty-five percent of all funds spent on state high court races, or $19.6 million, came from only 10 special-interest groups and political parties. That’s compared with 21 percent in 2007-2008.

TV ad spending jumped: During the 2011-2012 cycle, a record $33.7 million was spent on television ads for state high court races, far more than the previous record of $28.5 million in 2007-2008. Negative advertisements aired in at least ten states. The Ohio Republican party said that Ohio supreme court justice candidate Bill O’Neill “expressed sympathy for rapists.” in Wisconsin, an incumbent justice was accused of protecting a priest accused of molestation. And in Michigan, one candidate was described as having “volunteered to help free a terrorist.”

20-Week Abortion Bans Are Mostly a Charade

Most of you probably know this already, but it’s worth a reminder. All those red states that are passing anti-abortion laws usually emphasize the provision that bans abortions after 20 weeks. That tends to poll pretty well. But it’s mostly a charade:

While all the attention is going to the 20-week bans, they’re not the point, not by a long shot….The 20-week bans are just the most high-profile component of larger pieces of legislation whose goal is to make it impossible for women to get abortions at all, no matter what the stage of their pregnancies. The bills are inevitably crafted with provisions that will shut down as many abortion clinics as possible. Abortion clinics often require doctors from out of state to travel to the clinic, because of the harassment, threats, and even assassinations that local doctors have been subject to? Then we’ll require that every doctor have admitting privileges at a hospital within a certain number of miles, which out-of-state doctors won’t have. And we’ll throw in some rules on how wide your hallways need to be (not kidding), meaning in order to stay open you’d have to do hundreds of thousands of dollars of remodeling. Failing that, we’ll make sure that women who need abortions will have to suffer as much inconvenience, expense, and humiliation as possible.

It’s these provisions, much more than the 20-week bans, that will make the largest difference for women in these states. Depending on what state they’re in, they’ll have to travel far—in some cases hundreds of miles—pay for hotels because of waiting periods, get lectures from doctors required to lie to their patients about things like a fictional link between abortion and breast cancer, and submit to forced and medically unnecessary procedures. These kinds of provisions aren’t new, but this latest wave is occurring under the rubric of 20-week bans that are much more likely to be met with public approval, or at least the indifference most state legislation receives. Opponents of abortion rights are hoping they can get a case to the Supreme Court that will result in Roe v. Wade being overturned, but even if that doesn’t happen, they can still succeed in making abortion virtually illegal in states where they have control. And they’ve made lots of progress already.
