Here’s Why Donald Trump Can’t Defund “Out-of-Control” California

One of President Donald Trump’s favorite threats is cutting federal government funding to states, cities, and other entities that refuse to cooperate with his policies. On January 25, he issued an executive order titled “Enhancing Public Safety in the Interior of the United States,” which warns “sanctuary cities” that they could lose federal funds if they continue to protect undocumented residents from deportation. After an appearance by Breitbart‘s Milo Yiannopoulos at the University of California-Berkeley was canceled amid violent protests, Trump tapped out the following tweet:

And during a pre-Super Bowl interview with Fox News’ Bill O’Reilly, Trump doubled down on California: “If we have to, we’ll defund…We give tremendous amounts of money to California. California in many ways is out of control, as you know.”

Here’s the thing: Trump can’t just yank funding from states or cities or universities that upset him. Yet the matter is far from resolved: Several cities and one state have already filed lawsuits against the Trump administration over its threats, all but ensuring a battle that could end up before the Supreme Court. Here’s what you need to know about the legal issues behind this fight.

Why can’t the president withhold federal money from states or cities?

The short answer is that Congress, not the White House, has ultimate power over the federal purse. The president’s budget requests may direct Congress how to allocate federal spending, but the matter is not entirely in his hands. And he has no authority to withhold or rescind spending that’s already been authorized.

So couldn’t Congress defund a state or city if the president asked it to?

Hypothetically, Congress could pass a law or budget bill that puts conditions on the federal funding provided to, say, out-of-control California. But numerous Supreme Court decisions protect state and local governments against this type of vindictive policymaking. When the federal government raised the national minimum drinking age to 21 in 1984, it prodded states into enforcing the new law by stipulating that any state that didn’t comply would lose 5 percent of its federal highway construction funds. South Dakota wasn’t happy about this and filed a lawsuit against the federal government. South Dakota v. Dole worked its way up to the Supreme Court, which found that the federal government can apply conditions to funding—with a few limits. One of those limits is the stipulation that any conditional spending must not be “coercive.” As Justice William Rehnquist wrote, there is a point when “pressure turns into compulsion,” and a state might unconstitutionally be forced to comply because it needs the federal money to operate. Additionally, conditional funding can only apply to new money, not funding that’s already been committed.

As a practical matter, states and cities receive federal money through hundreds of different appropriations bills and programs. If Trump and congressional Republicans wanted to effectively defund California, they would have to modify each federal spending provision that affects the state. Conceivably, they could pass a bill that instructs the Department of the Treasury to stop sending money to Sacramento, but that would spark an enormous constitutional crisis.

But aren’t states and cities required to follow federal laws whether they like it or not?

Yes—but again there are limits. When the Supreme Court ruled on the constitutionality of Obamacare in 2012, it also considered the law’s expansion of state Medicaid programs. The Affordable Care Act had threatened to cut off all Medicaid funding to states should they fail to expand the program in accordance with its standards. Citing South Dakota v. Dole, Chief Justice John Roberts wrote in his opinion that this ultimatum was “a gun to the head” of the states. For many states, federal Medicaid money comprises more than 10 percent of total revenue, and losing that money would effectively cripple them. Six other justices agreed with Roberts on this point, and Medicaid expansion was left to the states.

What about the 10th Amendment?

The 10th Amendment of the Constitution says that any power not delegated to the federal government becomes the responsibility of the states. This is the basis of America’s federal system, whereby states have the freedom to pass laws that are distinct from those passed by Congress.

The Supreme Court has long interpreted the 10th Amendment as the foundation for a check on federal power. Take the case of Printz v. United States. After Congress passed the Brady Handgun Violence Prevention Act in 1993, a Montana sheriff named Jay Printz challenged its requirement that local law enforcement agencies conduct background checks on gun buyers. He argued that Congress was acting outside of its authority to compel state-level officials to enforce federal law. In 1997, five Supreme Court justices, led by Antonin Scalia, agreed.

The Printz decision underscores what Duke University law professor Matthew Adler calls “an external constraint upon congressional power—analogous to the constraints set forth in the Bill of Rights—but one that lacks an explicit textual basis.” In other words, decades of Supreme Court rulings on the 10th Amendment have formed an effective check on federal power by the states. And that could mean that just as Printz was allowed to resist conducting federally mandated background checks, a court could find that officials in sanctuary states and cities are allowed to avoid enforcing federal immigration law.

Don’t conservatives like the 10th Amendment more than progressives?

In the past, the 10th Amendment has provided cover for advocates of states’ rights and efforts to resist federal civil rights efforts such as integrating schools. More recently, the 10th Amendment became a rallying cry for the Obama administration’s opponents. Sen. Ted Cruz (R-Texas) is a big fan of the 10th, and tea partiers and “Tenthers” invoked the amendment to push back against Obamacare and even call for secession.

Now it’s liberals who are warming to the promise of the 10th Amendment. San Francisco’s recently filed federal lawsuit against the Trump administration argues that, defunding aside, the anti-sanctuary-city executive order violates the 10th Amendment. The city claims that it is within its rights to not cooperate with federal authorities under the “anti-commandeering” precedent set in Printz, which says higher jurisdictions may not “commandeer” local resources to enforce federal rules. Likewise, Massachusetts has also invoked the 10th amendment against Trump’s “Muslim ban” executive order. Several Boston suburbs have also cited the 10th in their lawsuits against the administration’s sanctuary city order, as has Santa Clara County, California, the home of Silicon Valley. Last week, Portland’s mayor issued a statement that the 10th Amendment protects its sanctuary city policies too.

How could this battle play out?

The feds depend on state and local officials to enforce their policies. The federal system is set up to encourage cooperation between state and federal officials. If that falls apart, Trump will have difficulty enacting his agenda. As Yale law professor Heather Gerken recently argued on Vox, “Even if President Trump spends enough political capital to win this or that battle against blue cities and states, he cannot win the war. The federal government doesn’t have the resources to carry out Trump’s policies.”

The funding question remains up in the air since Trump hasn’t given any indication to how, exactly, he would defund cities and states. However, given that California is in the process of passing legislation that effectively makes the entire state a sanctuary for undocumented immigrants, and given that its elected officials have been vocal about their opposition to Trump, we could see a California v. U.S. case in the near future if Trump tries to follow through. On Monday, state Attorney General Xavier Becerra reiterated his commitment to pushing back against Trump’s defunding threat. “We will fight anyone who wants to take away dollars that we have earned and are qualified for simply because we are unwilling to violate the Constitution under these defective executive orders,” he said.

A Tip for Parents as the School Year Begins: You’re Not Totally in Control, and That’s Okay

For more than a quarter century, psychologist and author Ross Greene specialized in the most challenging children. Last year, I wrote about how his collaborative approach to discipline is diverting the school-to-prison pipeline. Schools trained in his method reported suspensions falling by as much as 80 percent. And after implementing his model, youth prisons and an adolescent psychiatric ward saw recidivism, injuries, and the need for restraints drop by more than half.

Greene’s new book, Raising Human Beings: Creating a Collaborative Partnership With Your Child, addresses a broader audience and articulates a discipline and parenting framework for all children. One day, after he dropped his oldest child off at college, he spoke to me about the biggest parenting challenges, raising kids in a scary world, what parents should know as they face the back-to-school season, and what truly builds grit in children.

Mother Jones: This is your first book for a general parenting audience, as opposed to focusing on behaviorally challenging kids. What is different here?

Ross Greene: For a very long time, people have been saying to me, “What if you want to do this approach with every kid?” For a behaviorally challenging kid, you’re parenting this way just to help bring the kid’s behavior under control and to greatly reduce conflict. But you want to teach all kids the skills that are on the better side of human nature: empathy, appreciating how one’s behavior is affecting other people, resolving disagreements in ways that do not involve conflict, taking another’s perspective, honesty.

MJ: What are the most common mistakes you see parents make?

RG: The biggest mistake is overdoing it on the unilateral approach. Thinking you have more control than you really do. Losing sight of the fact that you’re your kid’s partner, not the person who’s pulling all the strings. Not letting them struggle. Swooping in and fixing everything and being way too punitive when punitive really doesn’t accomplish very much.

MJ: You write that modern parents are rejecting both authoritarian and permissive parenting—you call the approaches the “Dictatorial Kingdom” and the “Pushover Provinces.” But parents report feeling lost. Why is it so hard for parents to find a new path?

RG: Reason No. 1 is because of how they themselves were raised. Reason No. 2 is we’ve been lacking the technology. A lot of parents aren’t exactly sure how to go about solving a problem with a kid in a way that’s mutually satisfactory—doing that with their child feels very foreign to a lot of people. It probably explains why so many parents tell me their kids don’t listen to them and why so many kids tell me that they don’t feel heard.

MJ: Your discipline model has three specific steps. First, reflective listening to gather information from a child about the problem; second, sharing your concerns with the kid; third, working toward mutually satisfactory solutions. This can appear complicated and time-consuming, but when we wrote about it, some readers said it seemed intuitive and plain common sense. Which is it?

RG: I like to call it uncommon common sense. There is still quite the vibe out there that as a parent you have to be completely in control and in charge. This model acknowledges that being completely in control is a fantasy. This kid was someone the minute he or she popped out, and the idea that we can take this lump of clay and mold it into a form of our choosing is absolutely ludicrous. People still look askance at a kid in the supermarket who’s pitching a fit and think the parent is not sufficiently in control or not being sufficiently punitive. That’s an issue for a lot of parents as well.

MJ: Your chapter on “Parental Angst” resonated with me. It’s one thing to read a book and decide to change your parenting—it’s another thing to stick with it. What gets in the way of parents implementing your model?

RG: It does take practice. It’s not something you do well the first time. Another huge challenge is that most parents are accustomed to dealing with problems in the heat of the moment. When people are rushed, they’re stressed and you greatly increase the likelihood of being punitive and unilateral just because you’re trying to grasp control. The vast majority of things parents and kids get in conflict over are highly predictable. We’re disagreeing about the same expectations the kid is having difficulty meeting every hour, every day, every week. Because it’s predictable, we can have these conversations proactively. That is very hard for people.

MJ: Why is it useful to shift one’s view from “this child is misbehaving” to “the child is having difficulty meeting expectations”?

RG: Parents are much more likely to be attuned to what they don’t like than they are to the expectations that the kid is having difficulty meeting. Challenging behavior is just a signal, the fever, the means by which the kid is communicating that he or she is having difficulty meeting an expectation. Everybody is talking about the behavior. Behaviors float downstream to us. We need to paddle upstream. The problems that are causing the behaviors, that’s what’s waiting for us. It’s a crucial paradigm shift. We’re moving away from carrots and sticks, and time-outs and privileges gained and lost, and suspensions and detentions in schools, none of which will actually solve the problems that are actually causing the behaviors. It’s a whole lot more productive to be in problem-solving mode than it is to be in behavior modification mode. We’re focused on what’s causing the fever.

MJ: Can you explain how compatibility informs parents’ actions?

RG: When there’s a good fit between skills and expectations, there’s what we call compatibility, and we would expect a good outcome. When there’s a poor fit between expectations and the capacity of the kid, there is incompatibility, and that’s when we see people exhibit challenging behavior. People don’t scream or swear or pout or sulk when there’s compatibility. But most growth occurs when there’s incompatibility. When it comes to resilience, when it comes to pulling yourself up when you’ve fallen down, you don’t learn those things when things are going well. You learn those things when you’re struggling. So that’s when parents have to decide: “Am I going to swoop in and take control here to make sure that things go really well for my kid? Or am I going to do this in a collaborative fashion so that the problem ultimately does get solved but I’m involving my kid in the process so he learns how to do it for himself?” How I conduct myself when I get involved goes a long way to determining whether my kid is going to have the skills to solve the problem themselves in the long run.

MJ: What are the most common conflict areas between parents and kids?

RG: Homework. It’s so crucial to really get a good handle on what’s getting in the way of the kid completing a homework assignment. It can be so many things. Kids are overprogrammed these days. School is very demanding these days. No kid should be getting three or four hours of homework a night. There’s no breathing time, there’s no family time, there are just extracurriculars and homework and then go to bed. That’s a solution that has to involve the school as well.

Screen time is another very common one. It’s become a really important way for people to communicate with each other these days. But if we’re sitting at dinner and there’s no conversation going on because everybody’s got their head someplace else in their iPhone, that’s a family problem that needs to be solved. Solutions can’t be imposed. That just fosters resentment. If a solution isn’t mutually satisfactory, it’s not going to stick.

MJ: You write about kids who become suicidal, cut themselves, struggle to succeed in life. Parental fear is behind a lot of the controlling behavior. What can parents do to let go a bit and follow your advice to raise human beings?

RG: I just dropped my 18-year-old daughter off at college. I have fears about how she’s going to do academically. I have fears about how she’s going to do socially. I’m worried. I also have faith. Over 18 years of us solving problems together, my daughter has shown me that she’s got a good head on her shoulders, that she is pretty good at solving the problems that affect her life. If she wants my input, she gets it. If we’re being unilateral, then communication does not happen, the relationship does not happen. We never get to see that our kid is capable of solving problems on her own. We never start to build up the faith that they can actually do it.

We have forgotten that those skills on the more positive side of human nature have to be taught, have to be modeled, have to be practiced. The method of parenting described in Raising Human Beings is a perfect mechanism for teaching those skills. This is not me in sales mode, I fervently believe there’s never been a more important time for this book. It’s a scary world out there.

MJ: As we go into a new school year, what’s the one takeaway you want parents to have from your book?

RG: Be your kid’s collaborative partner, but also be a collaborative partner with the folks at school. Schools can be pretty unilateral too. Show them you know how to collaborate. Show them this is not about power. Let them know detentions and suspensions and paddling don’t solve the problems that are affecting kids’ lives. Those problems can be identified and solved but not by being punitive. My advice to educators is collaborate with parents; they know a lot about their kids.

How You Can Be Green in the Office

I have a nine-to-five job, spending most of my day in front of the computer and far removed from any Nature Conservancy of Canada (NCC) property. I will likely not be doing hands-on conservation on any given work day. Sometimes, cubicle dwellers like me need to think hard about how we can contribute in environmentally positive ways in our workplace.

Recently, the NCC national office in Toronto opened a can of worms in hopes of closing the loop with our organic wastes. Up until November 2015, there had been no organic waste collection in our building. That all changed when a vermiculture start-up contacted NCC about composting our food waste through Green Bins Growing.

Owner and operator of WasteNot Worm Farms, Jocelyn Molyneux, is just about the most enthusiastic person Ive seen about red, wriggly worms. Over a lunch and learn, Jocelyn introduced our group to the important roles worms play in agriculture, the differences between traditional (hot) composting and worm composting and their fertilizer by-products. Of about a dozen attendees, only one had experience with worm composting and that was from the college she attended that had adopted this practice.

So whats the point of all this, and is it worth it?

Worms are the soils natural nutrient recycling squad and they are quite apt at this job. They eat decaying matter and produce nutrient-rich biofertilizer. By signing on for an office worm composting system, were looking to divert our organic waste away from landfill to a process that feeds back into our food system.

Jocelyn told us one pound of worms can eat up to one pound of food waste each day. The resulting manure material is called worm castings a dense, nutrient-rich humus that sequesters carbons, feeds soil with beneficial microbes that kick-start the soil food web and provides natural plant growth stimulators.

Compare this to conventional fertilizers, which are generally made from petroleum products: conventional fertilizers damage the natural soil ecosystem, reducing soil fertility by killing soil microbes and creating a dependency on further chemical fertilizer applications. Even when compared to traditional composting, worms come out on top. Traditional composting produces a low-grade soil mulch where the high heat treatment has killed most beneficial microbes and much of the carbon and other nutrients have broken down, Jocelyn says.

The price difference is telling, too. Worm castings weigh in at $400 U.S./cubic yard versus $30 U.S./cubic yard for compost.

A big incentive with WasteNot Worm Farm is that we receive 25 percent of our years castings to give out to employees or donate to a community garden. A good deal, compared to buying it at $5/lb, if you ask me!

After receiving the 101 on worm composting, we had the chance to introduce ourselves to the red wigglers we had just employed. To our surprise, these are thin, spindly worms about two to four inches long; nothing like the big plump earthworms (night crawlers) some of us encounter while working in our gardens.

A brave few held their hand out to meet the worms, but were told not to handle them for too long as worms are photosensitive and can go into spasms under prolonged exposure to light.

We will not however actually have a worm bin in our kitchen, and for good reason! WasteNot Worm Farms collects our food wastes weekly, reducing the risk of fruit flies and limiting the waft of bad odors. Composting at a central farm facility (about 80 kilometres outside of Toronto) is more efficient for a small operation like WasteNot Worm Farms. Like the worms themselves, WasteNot Worm Farms is small but has a big appetite.

Ontario sends three million tonnes of organics to landfill each year, mostly because it’s cheaper to landfill in Michigan than it is to compost in Ontario.

Canadians are hungry for sustainable solutions, and worm farming is a simple, inexpensive biotechnology that recycles waste nutrients back to our soil. With early adopters like the Nature Conservancy of Canada leading the way, I’m confident that vermicomposting is on the verge of becoming a popular Zero Waste industrial recycling solution, says Jocelyn.

It has now been four months since we started using the green bins and I can already see a drastic diversion of wastes. In the past without organic waste collection services, we had no choice but to dump our food scraps into the same bin as our non-recyclables. Since we signed on with WasteNot Worm Farms, our staff have been diligent in correctly sorting their organic, compostable items, recyclables and trash.

Our hope is that by paying a small premium for Green Bins Growing, we are supporting a waste management practice that promotes environmental sustainability. We are looking forward to seeing the volume of worm castings our wastes can generate over the year, ensuring were doing our part to cycle those nutrients back into our soil.
