In a ruling this week, Judge William Alsup said that plaintiffs can sue greenhouse-gas emitters in federal court. That’s a big reversal. So far, the courts have held that it’s up to the EPA and lawmakers — not judges — to bring polluters into line.

In this case, the cities of Oakland and San Francisco sued a bunch of oil companies for contributing to climate change, raising sea levels and damaging their waterfronts. Because federal courts had previously said they wouldn’t regulate polluters, the cities were trying to move their lawsuit into the California court. If federal court wouldn’t punish polluters, the lawyers figured, maybe state court would.

Alsup denied the cities’ motion to move to state court. But instead of bowing to precedent and punting responsibility over to the EPA, he’s letting the lawsuit go to trial — in federal court.

“[The oil companies] got what they wanted; but they may be sorry they did,” said Ken Adams, lawyer for the Center for Climate Integrity, in a statement.

Of course, after opening this door, the courts could very well slam it shut again. The Supreme Court unanimously ruled in 2011 that it’s the job of Congress and regulators, not the court, to police emissions. But that decision concerned an American electric utility. Alsup said this case was different because the cities are suing international corporations.

Nor’easters are now just as dangerous as hurricanes

On Friday and Saturday, the winter storm now moving up the East Coast will unleash hurricane-force winds on Washington, blizzard conditions across parts of New York and New England, and inflict the worst coastal flood in Boston’s history.

By all accounts, this storm is a monster. It’s also the latest sign that New England’s long-feared coastal flooding problem is already here — and it’s time to admit climate change is its primary cause.

The storm’s strongest winds will point squarely toward the shore, smashing huge waves the size of three-story apartment buildings into coastal defenses, and roiling the sea as far away as South America. To make matters worse, it’s arriving in conjunction with a full moon, when tides are normally highest. The system is predicted to stall out for more than 24 hours just off the New England coastline — for an astonishing three straight tide cycles.

Although the storm is getting little attention in the national news, the National Weather Service and meteorologists across the Northeast are screaming at a fever pitch. Boston-area municipalities have taken heed, issuing evacuations, preparing dive-team equipment for water rescues, and deploying a temporary flood barrier designed as a climate change-resilience measure. Massachusetts Governor Charlie Baker has activated the National Guard to help with preparations.

Call it a nor’easter, a “bomb cyclone,” a superstorm — in an era of worsening extreme weather, fierce winter systems like this are arriving with startling frequency. And flooding is by far the most dangerous and destructive consequence. This week’s storm, like every weather event, is inseparable from the context of the warming climate. Nor’easters like this one are now a threat to public safety on par with hurricanes, and it’s time we start treating them that way.

This week’s storm is larger in size than Hurricane Sandy, with winds just as strong. National Weather Service in Boston called the storm’s gusts “about as extreme as it gets” and labeled the flooding it will spur a “life and death situation.” In a harrowing statement, the agency warns of massive power outages, the destruction of coastal homes, and some neighborhoods being “cut off for an extended time” from the rest of the metro area. It’s possible that sea walls and other semi-permanent coastal defenses could be breached, or beaches and dunes erased from the map — exposing vulnerable coastal communities and permanently altering the geography of New England.

Nor’easters draw their energy from clashing regions of warm and cold air, often producing massive circulations double the size of hurricanes. Hurricanes usually have much stronger winds at ground level, though, which is why they’re typically more destructive. But as seas have risen across the northeastern U.S. over the past century due to climate change, the flooding impact of what were once relatively routine winter storms has quickly grown.

While hurricanes are also expected to eventually grow stronger, there’s no convincing evidence they clearly have yet — although last year’s hurricane season is a worrying harbinger. Nor’easters are also expected to get worse due to climate change, as warmer air provides them with additional water vapor, fueling their ability to strengthen. Add to that, sea levels in Massachusetts have increased by about a foot over the past 100 years, and should rise by a further 3 to 9 feet by the end of this century.

Winter superstorms that bring high-level coastal flooding to northern locales like Boston are already occurring with alarming regularity. Only 34 hurricanes have passed within 200 miles of the city since 1851 — an average of one every five years. And only nine of these created a significant rise in the tides. Meanwhile more than 90 of the top 100 floods in Boston were spawned by nor’easters, and 13 of the top 20 have happened since 2000.

Though it’s one of the most severe examples in history, today’s storm is not the first one to hit the most densely populated part of the country with the power of a hurricane. It’s not even the first one this year — in January, another “bomb cyclone” floated rafts of ice into flooded Boston streets.

There are around three strong nor’easters every winter, 15 times as frequent as hurricanes — plenty of opportunity for repeat flooding disasters. A study earlier this year showed that record flooding could happen in New York City every five years starting just a few decades from now, largely because sea level rise has transformed nor’easters into coastline-devouring monsters.

Storms like these — technically called “extratropical cyclones,” because they form outside the tropics — don’t come with scary cone-shaped tracking maps like hurricanes or official names that can be blasted across social media. Still, they have quickly become the single biggest threat to coastal development across most of the northeast.

Coastal floods are one of the leading indicators that the world is warming. Given the path we’re on, the worst is yet to come.

Let’s hold off on praising China’s new carbon-pricing market

This week, China announced it has launched a nationwide carbon-trading market, with the intent of slowing down its growing climate footprint and capping its emissions as soon as possible.

Most news coverage has labeled the move as a major development in the global fight against climate change. Former U.S. Vice President Al Gore, who has devoted his post-political career to fighting warming, hailed the announcement as “a tipping point in the climate crisis.”

However, some close observers in China and elsewhere suggest we pump the brakes on celebrating this week’s news. Several critical details of the Chinese plan are still outstanding, they say. Most importantly: We still don’t know what the “cap” on its cap-and-trade plan will be, how emissions permits will be distributed, or what they will set the target carbon price to.

The Guardian reports that the Chinese government has been toying with the idea of nationwide carbon trading for more than a decade, so the revelation doesn’t come out of nowhere. And as the world’s largest emitter of greenhouse gases, any effort to limit the country’s pollution is hugely important.

But Emil Dimantchev, a climate policy researcher at the Massachusetts Institute of Technology, wrote earlier this year that it’s premature to call China’s new policy ambitious without the details of the trading scheme being in place. In a series of tweets this week following the announcement, Dimantchev doubled-down on that assessment.

“The policy is still missing the crucial features that will determine whether it will be a success,” he tweeted.

Separate reporting by Beijing-based carbon-market analyst Stian Reklev revealed that for its first two years the new Chinese system will only involve simulated trades. That, obviously, will have no impact on emissions in China or elsewhere.

“It’s clear the market is nowhere near ready to be launched, and they’re only doing this because [Chinese President] Xi Jinping promised the market would start in 2017,” Reklev tweeted this week.

The World Bank currently tracks 47 carbon-pricing initiatives worldwide that are either already in existence or set to open soon. The only one even remotely the size of China’s proposed market is the European Union’s Emissions Trading Scheme — a hugely complex system with mixed success, which covers about 4 percent of global emissions. Other carbon trading platforms in Washington, California, and in the northeastern U.S. police an additional 1 percent or so of global emissions — but none of them caps pollution across the entire economy of the states involved.

If China’s market eventually covers its whole economy, it would be responsible for about 30 percent of global emissions, more than double all currently existing carbon markets combined. So the higher China sets its carbon price, the more of an impact it will have on emissions elsewhere. A high price on Chinese carbon could motivate other pricing schemes around the world to raise their targets.

The world needs ambitious climate policy from China in order to meet the agreed-upon Paris goals of limiting global warming — especially with the United States’ government in the process of plopping itself on the sidelines.

This step from China is without question in the right direction. But the fact that the scheme is still apparently in the design phase should be a sign that the Asian behemoth may not yet be the planetary savior many are hoping for.

It’s OK that Democrats don’t have a national climate policy

More than a year after the election of Donald Trump, the opposition Democratic Party still hasn’t found its voice on climate change.

That’s according to an essential overview of the situation from the Atlantic’s Robinson Meyer. Taken at face value, it’s not good news: Despite consistent rhetoric that climate change is among the most important challenges of the century, the Democratic Party has no large-scale cohesive plan to tackle it.

OK, that fact is worrying.

However, while Meyer is correct in his assessment of national politics, he makes one glaring omission: Climate action at the local and state level around the United States is, if anything, healthier and more ambitious than ever before. And it’s more often than not driven by Democrats. After a two decade-long quixotic quest for a unified federal climate policy, party members are finally willing to admit that their climate strategy can’t rest on economy-wide national legislation alone.

“We need to do everything we can to fight climate change,” says Keith Ellison, a congressman from Minnesota and deputy chair of the Democratic National Committee. “That means having a bill ready for passage when we take power, and it also means pushing for more immediate wins to lower carbon emissions at the state and local levels by building upon the work of aggressive climate policy in states like Minnesota, California, and New York.”

In city halls, boardrooms, and statehouses across America, what’s (not) happening on climate in today’s Washington is mostly a sideshow. The science is clear, climate-related disasters are happening now, and in most cases, it makes economic sense to take action immediately. So on the front lines of climate change, from San Juan to San Francisco, Minneapolis to Miami, the message is clear: This problem is too important to wait for Congress and the president to get their act together.

Since President Trump announced his intent to withdraw from the Paris Agreement back in June, more than 2,500 local leaders from all 50 states have signed a pledge saying, “We are still in.” In aggregate, those leaders — mayors, governors, CEOs, university presidents, etc. — represent more than half of all Americans. As an independent nation, they’d rank third in the world in terms of share of total emissions — nearly 10 percent of the global total. But this collective is pushing some of the most ambitious climate policy anywhere on Earth.

And contrary to what you might hear in Washington, pro-climate efforts don’t come at the expense of the economy. In New York City, emissions are down 15 percent since 2005. In the same timeframe, the economy has grown by 19 percent. In Minneapolis, emissions are down 18 percent while the economy is up 30 percent.

Even in red states like Kansas and Texas, bipartisan coalitions are emerging to take advantage of tremendous renewable energy resources in wind and solar. In 2005, Kansas sourced less than 1 percent of its electricity from wind. Now, it’s at 25 percent and, like California, is on pace to get 50 percent of its energy from renewable sources in the next few years. There is now a nationwide job boom in construction and installation of renewable energy.

If you ask Democrats and advocates directly, this kind of progress has changed the prevailing wisdom of what effective U.S. climate policy looks like.

“We know it’s possible because we’re doing it,” Washington Governor Jay Inslee said in a statement from Bonn, Germany. “The West Coast offers a blueprint: This is how you build a thriving, innovative economy that combats climate change and embraces a zero-emission future.”

Inslee is helping lead a sizeable, but unofficial, U.S. delegation at the ongoing United Nations Climate Change Conference in Bonn. Dan Firger of Bloomberg Philanthropies, whose boss, Michael Bloomberg serves as an outspoken U. N. special envoy for cities and climate action, calls it a “shadow climate government.”

“We’re less concerned about a silver bullet bill in Congress than we are about how best to get near-term carbon reductions done,” Firger told Grist, adding that the former New York City mayor believes in “bottom-up climate action.”

Lou Leonard, a senior vice president at the World Wildlife Fund, points to the Regional Greenhouse Gas Initiative, a market-based approach to reducing carbon emissions among several northeastern U.S. states. Already, one of the largest carbon schemes in the world, it stands to expand after this month’s elections resulted in Democratic victories in the Virginia and New Jersey governor races. Those states are now set to join the initiative.

“We cannot put all our chips in a federal solution,” says Leonard from Bonn, where his organization is helping support the We Are Still In delegation. “That’s not the way the U.S. economy works, that’s not the way politics works, and it’s certainly not the most obvious path to success.”

Still, The Atlantic’s Meyer has a point: Democrats need to be able to combine all these local policy victories into a national and global win. After all, worldwide carbon emissions are on pace for a new record high in 2017. But this inside-out approach has precedents for yielding real results.

Climate change inherently is a problem that requires local action. And increasingly, those working for climate policy have shifted their efforts to support local early adopters. It’s a strategy specifically designed to build an eventual national consensus.

“There’s more happening than many people are aware of,” says Steve Valk, the communications director for Citizens Climate Lobby. “City and state initiatives — as happened with gay marriage — can drive a national policy.”

In parts of the United Kingdom Monday morning, people woke up to a blood-red sun — a phenomenon seen around the globe this year.

The color was caused by smoke that blew in from wildfires across Portugal and Spain. Hurricane Ophelia deepened the reddish hue by dragging up dust from the Sahara.

Red skies have haunted the western U.S. recently as wildfires burned in Montana and ash rained down in Seattle. This month in Northern California, 20,000 people evacuated from massive wildfires under a red-orange sky.

On the other side of the world, wildfires burned in Siberia all summer long, covering the sun with enormous clouds of smoke and ash.

To understand why this happens, you need to know a bit of optics. Sun rays contain light from the whole visible spectrum. As the sun’s white light beams into the atmosphere, it collides with molecules that diffuse some of the wavelengths. On a normal day, short wavelength colors, like purple and blue, are filtered out, making the sun look yellow.

But high concentrations of light-scattering molecules in the air (like smoke particles from a wildfire) crowd out more of those short-wavelength colors, leaving behind that hellish red color.

Since climate change makes wildfires worse, we’ll be seeing a lot more of it.
