Trump Administration Leaves 50,000 Haitians in Legal Limbo

About 50,000 Haitians living in the United States will remain in limbo for another six months. The Trump administration has reportedly granted a temporary extension of these Haitians’ legal status, leaving them at risk of being forced to leave the country—or remain illegally—at the start of next year.

Multiple reports on Monday indicate that the Department of Homeland Security will extend Temporary Protected Status for Haitian nationals for six months. Haitians were granted the special status in 2010, after an earthquake leveled buildings, displaced millions, and killed an estimated 300,000 people. As Mother Jones previously reported, TPS is granted to people from countries experiencing humanitarian crises:

First introduced in 1990, the TPS program provides humanitarian relief to nationals of countries coping with a severe conflict or natural disaster. By providing recipients with legal status and work authorization, TPS designations—typically granted in six- to 18-month cycles that can be renewed indefinitely—have become a crucial means of aiding people who face unsafe conditions should they be sent back to their home country.

The extension was first reported on Monday by the Washington Post and confirmed by the Miami Herald, which wrote that Rep. Frederica Wilson (D-Fla.) received a call from DHS with news of the decision. DHS not not respond to Mother Jones‘ request for comment.

With the extension, Haiti’s TPS designation will continue past its current July expiration date, to January 22, 2018. The six-month extension aligns with the recommendation of James McCament, acting director of US Citizenship and Immigration Services, who wrote a memo to Homeland Security Secretary John Kelly in April suggesting that Haiti’s TPS designation be extended to the beginning of 2018 and then allowed to expire. Immigration advocates had strongly encouraged DHS to extend the designation for a full 18 months, arguing that Haiti needed more time to recover before thousands of people could return to the country safely.

Prior to the decision, some 50,000 Haitians living and working in the United States were at risk of being deported back to Haiti, which is dealing with a multitude of conflicts—or staying in the United States and becoming undocumented. The latest extension means that Haitians with TPS can breathe for now but will face the same suspense in November, when DHS must again decide whether to extend their TPS or allow it to expire.

Immigration advocates had mixed reactions to the news. “The fear was that we may not even get six months,” says Nana Brantuo, policy manager for the Black Alliance for Just Immigration, one of the groups that has called for an extension of Haiti’s TPS designation. But she adds, “The 18-month extension is what we need. Otherwise we’re going to have thousands of people who are unauthorized in fear of being deported.”

If There’s Going to Be a Wall, Let It Be This Collaboration Between American and Mexican Designers

When President Trump appealed to the public to submit proposals for his “big, beautiful” border wall, you can be pretty sure that the plan presented by the Mexican American Design and Engineering Collective (MADE) was not what he had in mind.

In response to the president’s mad quest to build a wall along the US-Mexico border, the group of 14 designers, engineers, builders, and architects from the US and Mexico proposed something entirely different—a high-tech “ecotopia” called Otra Nation.

“Otra Nation will be the world’s first shared co-nation open to citizens of both countries and co-maintained by Mexico and the United States of America,” the group says in their proposal. “Besides sharing the same geographical conditions, the continuous exchange of information, knowledge, artistic expression and migration between sides will produce fertile ground to bring forth a hybrid sense of identity.”

Reflecting their ideology, the group is an even mix of US and Mexican professionals, and while they prefer to keep their identities anonymous, MADE spokesman, Memo Cruz, says that members of the group have worked with the last four US presidents and the last two Mexican ones. “We came together as people who wanted to come up with a solution to a broken system,” Memo said. “And sometimes to break a broken system is to make a new one.”

Far from the wall Trump envisions, the MADE collective wants to build a high-speed, electric hyperloop connecting different parts of Otra Nation. According to the group’s proposal, the new co-nation would be six miles wide and span the 1,200 miles from San Diego/Tijuana to the Gulf Coast. The land would be “drill free,” and used for a “regenerative agricultural system that will become a bread basket for the two countries.” To top it off, the whole thing would be powered completely by solar and other renewable energy sources, creating thousands of jobs and billions of dollars in trade.

Among the 200-plus proposals submitted to the Department of Homeland Security (DHS) by the April 4th deadline, Otra Nation was definitely one of the more idealistic.

At the other end spectrum were walls made of wire mesh impossible to climb or cut, or constructed with one-way plexiglass panels so that US citizens could look into Mexico, but not the other way around.

Other designs were so whimsical that they could only be interpreted as a mockery of Trump’s ambitions—a wall made of organ pipes or a line of trees with hammocks strung between them.

From comical to xenophobic, the range of ideas submitted to DHS highlighted just how divided the US is when it comes to issues of immigration and border security. But while many of these proposals included green technology like solar panels or windmills, none acknowledged the true environmental consequences of building a wall along the border.

The border wall’s environmental footprint

That may be in part because we don’t really know. The last and only environmental review of US border security policy was conducted by the Immigration and Naturalization Service—the precursor to the DHS—in 2001. Effective for five years, the review has never been updated, and since then the size of the US Border patrol has more than doubled and hundreds of miles of fences and walls have been built.

This is the basis of a legal challenge by Arizona Congressmen Raul M. Grijalva and the Center for Biological Diversity put forth in early April. Citing the the Environmental Policy Act, the lawsuit calls upon federal agencies to conduct an environmental analysis of the proposed wall before any construction takes place.

“American environmental laws are some of the oldest and strongest in the world, and they should apply to the borderlands just as they do everywhere else,” said Rep. Grijalva in a statement. “These laws exist to protect the health and well-being of our people, our wildlife, and the places they live. Trump’s wall—and his fanatical approach to our southern border—will do little more than perpetuate human suffering while irrevocably damaging our public lands and the wildlife that depend on them.”

Even without a review, it’s clear to environmentalists that Trump’s wall would be a disaster. “It would be the end of jaguars and ocelots in North America,” Randy Serraglio, a conservation advocate for the Center of Biological Diversity, said, naming only two out of the hundreds of animals whose migratory patterns and natural habitats would be jarringly broken by a 30-foot tall wall.

And, while information on the environmental impact of the US Border wall is scarce, a recent European study on the security fencing dividing countries in Eastern Europe and Asia confirms Serraglio’s fears. The study conducted by Norwegian scientists showed that the 15,000 to 19,000 miles of fence, much of which was erected in response to Europe’s growing refugee crisis, poses a “major threat” to wildlife.

Much more than just a security fence, Trumps wall will cross at least four wildlife refuges, potentially impacting 111 endangered species like jaguars, ocelots, black bears and Mexican grey wolves. Beyond imperiling sensitive animal populations, conservationists also argue that of the wall would cause flooding, erosion, and irreparable damage to countless acres of public lands like Big Bend National Park and Organ Pipe Cactus National Monument.

“We’ve invested millions of dollars in establishing and protecting these areas over the years,” Serraglio said. “It makes absolutely no sense to throw that all away because Donald Trump wants to wall off the border.”

We only need to look at 654 miles of barriers that have already been erected along the border under the Clinton and Bush administrations to see just how bad things can get, said Serraglio. He points to instances like the destruction of the Tijuana Estuary system by erosion, and the 2008 flash flood in Arizona’s Organ Pipe Cactus National Monument that occurred because the border barrier inhibited the natural flow of rain water. The same storm led to two deaths and $8 million dollars of damage on the other side of the barrier in Nogales, Mexico.

There’s got to be a better way

Of all the designs submitted for Trumps wall, Otra Nation may be the only one advocating for a dismantling of the existing fence line. “We actually think that we can remove the physical borders that have already been put up,” said Cruz.

According to the MADE spokesman, Otra Nation would provide better border security than any physical wall could by using a high-tech system of biometric surveillance and universal smart ID cards. “The ID system that we are proposing is the toughest ID system in the world,” Cruz said. “It is far more stringent than anything the US government has right now.”

The idea may have some Orwellian undertones, but for environmentalists Otra Nation’s wall-less border is a welcome alternative to Trump’s vision. Still, many conservationists stress that it’s not just the wall, but the roads, the vehicles, the buildings, the noise, the high-powered lights, and other security installations, all of which will take its toll on the land and its inhabitants.

For now though, Trump’s wall seems about as far from reality as Otra Nation’s vision of a new age “ecotopia.” The administration has yet to figure out who will pay for the project that the DHS now estimates will cost nearly $22 billion dollars, nor has Trump answered how he intends to build the wall when 1,255 miles, or 64% of the border, runs right down the middle of the Rio Grande. Barring the unlikely scenario that Mexico will elect to host the wall on their side of the river, the US will have to effectively cede a large section of the Rio Grande to Mexico, a move which would undoubtedly affect ranchers, landowners, energy companies, and the local communities that rely on the Rio Grande for water.

Despite these inconsistencies, the president seems hellbent on fulfilling his campaign promise to build a “great” wall to keep immigrants out of the United States. His budget already sets aside $1.4 billion for the initial development of the project, and the bid process is moving forward with the DHS expected to announce a shortlist of 20 proposals by the summer. Those chosen will then build 30 ft. prototypes of their design in the Otay Mesa Community outside of San Diego.

“I know we’ve got a million to one chance of getting selected,” said Cruz. Still, he hopes that MADE’s Otra Nation proposal will at least generate conversation between members of the US and Mexican governments about alternative ways of looking at the border that don’t involve a wall. “Even if we’re not selected, to get the two governments to sit down and look at what we’ve done with these solutions, that will be a huge win for us.

Leaked DHS Doc Says Trump’s Seven Countries Aren’t Very Dangerous

Remember those seven countries that President Trump singled out for a travel ban? He asked the Department of Homeland Security to check them out and explain why they deserved to be on a no-entry list. Here’s what he got:

Oops. “Rarely implicated” means a grand total of six people out of 82. That’s one per year since 2011. And not one terrorist plot per year, either. One “terrorism related offense” per year. In many of these cases, it’s probably a material support charge for sending a hundred bucks to some warlord back home.

This comes via the AP, which got this comment:

Homeland Security spokeswoman Gillian Christensen on Friday did not dispute the report’s authenticity, but said it was not a final comprehensive review of the government’s intelligence.

“While DHS was asked to draft a comprehensive report on this issue, the document you’re referencing was commentary from a single intelligence source versus an official, robust document with thorough interagency sourcing,” Christensen said. “The … report does not include data from other intelligence community sources. It is incomplete.”

I have a feeling that once the “interagency sourcing” is finished, there might be a different spin on these numbers. This is very definitely not what the boss wants to hear.

Who the Hell Is Running Things at the White House?

On Friday, the Department of Homeland Security determined that President Trump’s immigration order didn’t apply to green card holders.
Later on Friday, Steve Bannon overruled them and said it did.
Saturday night, DHS confirmed that the order applied to green card holders.
Today, chief of staff Reince Priebus apparently overruled Bannon and said it didn’t apply to green card holders after all.

Who are Bannon and Priebus speaking for? Neither one of them has the authority on their own to issue these directives. DHS Secretary John Kelly has the authority. Whoever’s running the Department of Justice has the authority. Donald Trump has the authority. When are we going to hear from one of them?

Trump’s Immigration Fiasco Might Be More Premeditated Than We Think

The President’s team had months to prepare this signature immigration initiative. And they produced…an amateurish, politically self-immolating effort that humiliated the country, provoked international retaliation, and failed to withstand the obvious federal court challenge on its very first day.

Given the despicable nature of this effort, I’m happy it has become a political fiasco. It also makes me wonder how the Trump administration will execute the basic functions of government. This astonishing failure reflects our new President’s contempt for the basic craft of government.

This sure seems to be the case. For the barely believable story of just how incompetent the whole exercise was, check out this CNN story. It will leave your jaw on the floor. And yet, there’s also one tidbit that makes me wonder if the chaos attending the rollout was quite as unintended as we think:

Friday night, DHS arrived at the legal interpretation that the executive order restrictions applying to seven countries — Iran, Iraq, Libya, Somalia, Syria, Sudan and Yemen — did not apply to people who with lawful permanent residence, generally referred to as green card holders.

The White House overruled that guidance overnight, according to officials familiar with the rollout. That order came from the President’s inner circle, led by Stephen Miller and Steve Bannon. Their decision held that, on a case by case basis, DHS could allow green card holders to enter the US.

The decision to apply the executive order to green card holders, including those in transit, is almost insane. Whatever else he is, Steve Bannon is a smart guy, and he had to know that this would produce turmoil at airports around the country and widespread condemnation from the press. Why would he do this?

In cases like this, the smart money is usually on incompetence, not malice. But this looks more like deliberate malice to me. Bannon wanted turmoil and condemnation. He wanted this executive order to get as much publicity as possible. He wanted the ACLU involved. He thinks this will be a PR win.

Liberals think the same thing. All the protests, the court judgments, the press coverage: this is something that will make middle America understand just what Trump is really all about. And once they figure it out, they’ll turn on him.

In other words, both sides think that maximum exposure is good for them. Liberals think middle America will be appalled at Trump’s callousness. Bannon thinks middle America will be appalled that lefties and the elite media are taking the side of terrorists. After a week of skirmishes, this is finally a hill that both sides are willing to die for. Who’s going to win?

EINSTEIN is Probably the Wrong Name for the Government’s Very Flawed Cybersecurity System

The government relies on a system called EINSTEIN, or the National Cybersecurity Protection System, to detect and stop the rising numbers of cyberattacks on its computers. But a new report from the Government Accountability Office says EINSTEIN is falling far short of expectations.

The latest version of the $6-billion-dollar system, which rolled out in 2013, was designed to both detect suspicious cyber activity and prevent anything harmful from entering or leaving government computer networks. But the GAO says the system gives its users only “a limited ability to detect potentially malicious activity entering and exiting computer networks at federal agencies.” And when the GAO tested EINSTEIN, the system could only identify six percent of the common vulnerabilities in programs typically used on federal computers, including Microsoft Office and Internet Explorer.

The system is also falling short on helping agencies share information about cyber threats. The GAO found that only 5 of 23 federal agencies are actually using the “intrusion prevention” parts of the EINSTEIN system, which actively try to block malicious content. The information gained from those agencies helps recognize patterns that the system can use to improve and identify other similar attacks. The smaller the pool of data, the less effective the system can be. The information-sharing process itself also appears to be a mess. “DHS has yet to develop most of the planned functionality for NCPS’s information-sharing capability,” the report said. “Moreover, agencies and DHS did not always agree about whether notifications of potentially malicious activity had been sent or received, and agencies had mixed views about the usefulness of these notifications.”

A classified version of the report was released in November, but a declassified version was released on Thursday by the GAO. It came just days after the government announced the formation of a new agency to handle background checks after two massive hacks struck the Office of Personnel Management. The hacks, believed to be the work of the Chinese government, stole the highly sensitive background investigation forms of more than 20 million federal employees. After the attacks became public knowledge last year, the government’s cybersecurity defenses came under withering scrutiny from congressional overnight committees. This week’s report isn’t likely to help.
