How vulnerable is your community to coronavirus? These new maps reveal a familiar pattern.

The predominantly black and low-income communities living near the back-to-back petrochemical refineries of Louisiana’s “cancer alley” have long suffered compromised immune systems and high rates of disease. Now, the state’s fast-growing COVID-19 outbreak is poised to hit them especially hard.

Yet behind the veil of the pandemic, last week the Environmental Protection Agency (EPA) issued a temporary policy — with no end date specified — to suspend its enforcement of key environmental regulations, allowing industries like Louisiana’s petrochemical giants to make their own determinations as to whether or not they are complying with requirements to monitor pollution levels. Ironically, as the EPA relaxes its rules for polluters, the link between long-term exposure to environmental hazards and the most severe outcomes of coronavirus infections is starting to come into focus.

Jvion, a healthcare data firm, has collaborated with Microsoft to launch a new COVID-19 community vulnerability map to identify the populations most vulnerable to severe complications following a coronavirus outbreak. The interactive map aggregates socioeconomic and environmental factors, such as lack of access to transportation, exposure to toxins, unemployment, and mortality rate. According to the map, these factors make certain “cancer alley” communities particularly vulnerable.

“Our most heavily weighted and frequent determining risk factor was air quality, though that doesn’t mean that it’s the most predictive factor,” said John Showalter, chief product officer for Jvion. “There’s definitely a biologic rationale that environmental health hazards that lead to pulmonary and cardiovascular conditions would then lead people with those conditions to do poorly during a COVID-19 outbreak.”

Jvion used machine learning to analyze block-level data from the U.S. Census to help identify “environmental health hazard” as one key socioeconomic factor that makes a population more vulnerable to severe COVID-19 outcomes, based on the health effects of polluted air, contaminated water, and extreme heat. They also factored in how chronic exposure to outdoor air pollutants, such as fine particulate matter, can increase the risk of cancer, respiratory illnesses, and cardiovascular disease — preexisting conditions that physicians say can make the novel coronavirus more severe and fatal.

A side-by-side comparison of Jvion’s vulnerability map with the EPA’s Environmental Justice Screen (EJScreen) suggests a stark correlation between a community’s proximity to industrial facilities and its projected risk of severe COVID-19 outcomes.

Jvion labels Harris County, Texas, as having a high vulnerability for COVID-19 — and a key socioeconomic influencer for that determination is its “above average environmental health hazard.” A new analysis from the University of Texas Health Science Center echoes Jvion’s map: The report shows where risk factors for severe COVID-19 outcomes (mostly preexisting health conditions) are distributed across Harris County to determine which neighborhoods are most at-risk of hospitalization and intensive care for COVID-19. Cross-referencing the EJScreen, it becomes clear that the Harris County map highlights communities in close proximity to industrial facilities and those at a higher risk of cancer from breathing airborne toxins.

“There’s a familiar pattern in these maps, and it’s a pattern that you see in mobility rates and mortality rates, race and ethnicity demographics, as well as the distribution of industry in our country,” said Corey Williams, the research and policy director for Air Alliance Houston. “All those things overlap to a great extent, so there is a correlation, but it’s difficult to prove causation.”

Philadelphia has seen a rapid uptick in coronavirus cases, and its pockets of vulnerability have similar characteristics to Houston’s. Jvion’s map shows that the predominantly black and low-income neighborhoods of Point Breeze and Grays Ferry are considered to have an “extremely high” vulnerability risk for COVID-19 due to environmental hazards, elevated unemployment rates, and low incomes. The EJScreen shows that the areas are close to major highways with heavy traffic, wastewater plants, and industrial facilities.

It’s clear that the novel coronavirus is already compounding underlying systemic inequities in communities with more people of color, poverty, migrants, and those without access to resources like medical care. These maps can help ensure that government response and medical capacity in these at-risk populations can meet the needs of those likely to be severely ill from the virus, including those living near heavy industry and fossil fuel infrastructure.

In a letter submitted to the EPA last week, environmental groups demanded to know why polluting facilities are now excused from complying with environmental regulations, even as their operations continue relatively unfettered. “What is the basis for presuming that the pandemic means companies can no longer comply with environmental rules while they continue to operate and process all other forms of corporate ‘paperwork’?” the memo asked.

Coronavirus postpones crucial U.N. climate conference

COP26, the landmark United Nations climate conference of 2020 — originally planned to be held in Glasgow, Scotland, in November — will be delayed due to the coronavirus pandemic.

“The world is facing an unprecedented global challenge & countries are rightly focusing on fighting #COVID19,” wrote Alok Sharma, the president of COP26 and a member of the U.K. parliament, on Twitter. “Due to this, #COP26 has been postponed.”

Policymakers and scientists have speculated for weeks about whether the conference, which would bring together delegations from almost 200 countries around the world, would be rescheduled due to the pandemic spreading across the globe.

Some had urged decision-makers not to delay the talks, saying that COP26 was a crucial step to advancing the goals of the 2016 Paris Agreement. “If it is going to be canceled, that should only be done at the last possible minute — in October,” Yvo do Boer, a former chief of the United Nations Framework Convention on Climate Change (UNFCCC), told the Guardian in mid-March. (The UNFCCC, the UN treaty responsible for preventing dangerous climate change, is the framework for the annual COP, or “Conference of the Parties,” meetings.)

But with national governments reeling from almost 900,000 cases of coronavirus worldwide, the possibility of a successful and productive COP26 looked increasingly slim.

The conference will be held instead in 2021, but the United Nations and the U.K. have not agreed upon a new date. This is not the first COP to experience logistical problems — last year, COP25 had to be moved abruptly from Chile to Spain due to social unrest — but the disruption in this case will be much more significant.

Countries were expected to present updated national emissions targets at COP26, and there was hope that many countries would pledge to reduce their emissions to net-zero by 2050. The world is currently far off-track to meet the goals set by the almost 200 countries that signed onto the Paris Agreement four years ago.

While the coronavirus may have slowed global emissions for the moment, experts worry that the pandemic will hinder the transition from fossil fuels to renewable energy in the long run. And the COP26 delay could drive attention away from the need to reduce fossil fuel use as quickly as possible.

“COVID-19 is the most urgent threat facing humanity today,” Patricia Espinosa, U.N. executive secretary for climate change, said in a statement. “But we cannot forget that climate change is the biggest threat facing humanity over the long term.”

The Philippines volcanic eruption is harming public health, but not the climate — yet

When Mount Pinatubo erupted in the Philippines in 1991, it plunged the surrounding area into darkness as an avalanche of hot ash and lava poured down. Ash buried homes, smoke blocked the sunlight, and deadly mudslides swallowed nearby cities. So when the Taal volcano, located 90 miles south of Mount Pinatubo, exploded on Sunday, many Filipinos feared the worst. It felt like déjà vu.

The Taal volcano, surrounded by the waters of the Taal Lake in the province of Batangas, just 40 miles from Manila, is a famous tourist destination. Visitors and residents alike were caught off guard this week when Taal spat enormous clouds of ash into the air. Tens of thousands of people living within a 9-mile radius of the volcano were ordered to evacuate, some finding shelter in classrooms and gymnasiums. No casualties have yet been reported, but houses and farms were destroyed, and thousands of animals were left behind by their owners.

Nearby regions are still experiencing small earthquakes, while seismologists warn of a possible volcanic tsunami, where water surging from the lake could deluge nearby villages. As of Friday, areas around the volcano still remain on Alert Level 4, which means another eruption could be imminent.

Amid all the bright lava and towering ash plumes, it’s easy to overlook that volcanic eruptions can dramatically affect air quality. Shortly after Taal erupted, air quality in the province of Batangas and nearby areas spiked to unhealthy levels, and face masks disappeared off the shelves. (Local business owners saw an opportunity in the tragedy, with some pricing face masks at five times their normal cost.) When aerosols like sulfur dioxide are inhaled, they can lead to asthma or respiratory diseases.

You can even see Taal’s volcanic emissions from space. Satellite imagery shows that strong winds pushed emissions from the eruption northward, leaving a trail of red, yellow, and blue.

Volcanoes can also affect global temperatures — though Taal isn’t expected to have much of an effect unless there’s a bigger explosion. During Mount Pinatubo’s 1991 eruption, for instance, 20 million tons of sulfur dioxide and ash particles were released into the air, blowing all the way into the stratosphere. The catastrophic event also emitted tens of millions of tons of greenhouse gases, like carbon dioxide and water vapor. But thanks to sulfur dioxide, which reacts with water to form aerosols that reflect the sunlight back to space, the eruption ended up temporarily cooling global temperatures, which fell as much as 1 degrees F for about three years following the eruption.

Taal — which is currently releasing an average of 6,500 tons of sulfur dioxide per day — probably won’t have a noticeable effect on the climate, unless there’s a much bigger explosion. For comparison, Pinatubo spewed 20 million tons of sulfur dioxide into the air.

The Philippine Institute of Volcanology and Seismology warned residents that Taal’s immense tremors could last from three days to seven months. But Mariton Bornas, chief of volcano monitoring and eruption prediction division in the Philippines, told CNN that the alert level would be lowered if there’s no activity within two weeks.

“We’re still measuring high levels of sulphur dioxide,” she said. “We’re still having earthquakes, new fissures are developing, and the volcano is swollen. So, the potential for an explosive eruption is still there.” Let’s hope the volcano settles down before it becomes another Mount Pinatubo.

Cory Booker shines at first-ever presidential environmental justice forum

Several Democratic 2020 candidates appeared on Friday in Orangeburg, South Carolina, to attend a historic event: the first-ever Presidential Forum on Environmental Justice. Moderated by former Environmental Protection Agency official and current National Wildlife Federation Vice President Mustafa Santiago Ali, as well as Democracy Now! host Amy Goodman, the forum addressed an issue that’s new to the presidential primary circuit but has for decades been a chief concern for people of color and frontline and low-income communities across the United States.

What is environmental justice? Ali defined the term for the audience gathered at an auditorium on the campus of the historically black college South Carolina State University by flipping it on its head. Environmental injustice and environmental racism, he said, are caused by regulations and policies that negatively affect the nation’s minorities and poor — in this case putting them more at risk from pollution or the impacts of climate change. To achieve environmental justice would be to craft policy with the explicit intent of protecting those communities.

Many of the Democratic candidates have said they intend to do just that, if they take over for Donald Trump as president. But only six of them showed up on Friday to tell voters how they aim to make good on that promise: Tom Steyer, Elizabeth Warren, Cory Booker, John Delaney, Joe Sestak, and Marianne Williamson. Of those six, Booker and Steyer were the most nimble on their feet when discussing the topic of the day — a testament to the fact that they both have long histories of working with either climate groups or grassroots environmental activists (or both).

Notably absent from the stage was Vermont Senator Bernie Sanders, who was preparing for a climate change-themed summit with Representative Alexandria Ocasio-Cortez in Iowa on Saturday. In the wake of Washington Governor Jay Inslee’s departure from the primary race, Sanders, wielding a multi-trillion dollar climate plan he’s calling the “Green New Deal,” has positioned himself as the field’s climate hawk. And according to Vox, the Sanders campaign is making climate action a central component of its strategy in Iowa in the lead up to the state’s caucuses early next year. It’s a big bet on recent polls that show primary state Democrats consider climate change a top issue.

The environmental justice forum in South Carolina was hosted by the National Black Caucus of State  Legislators. (Editor’s note: Grist was one of the forum’s media sponsors.) And it was notable, not only for the being the first-of-its-kind event. In addition, it also showed that if Bernie Sanders may be the race’s new climate candidate, Cory Booker is its environmental justice candidate.

Booker took the stage following the evening’s undisputed headliner, Elizabeth Warren — the only frontrunner to make the trip to Orangeburg. The New Jersey senator, who has discussed these issues going back to his time as mayor of Newark, New Jersey, had no trouble distinguishing himself from his Massachusetts colleague. While Warren pledged a trillion dollars, as part of a $3-trillion climate plan, toward picking up the communities who find themselves facing the brunt of environmental injustice, the candidate with a plan for seemingly everything offered few specifics.

Booker, in contrast, spoke at length about pollution from pig farms in Duplin County, North Carolina, toxic coal ash in Uniontown, Alabama, and cancer clusters between Baton Rouge and New Orleans in Louisiana. Environmental racism, he said, is a “shameful reality in America.” He discussed his proposal to replace all lead service lines in the country, in order to help avoid the water crises that have gripped Flint, Michigan, and his hometown, Newark. When Goodman asked the Jersey senator to defend his support of nuclear energy,  he did so  along environmental justice lines, saying, “The damage done to poor and vulnerable communities is significantly worse from climate change than from nuclear waste.”

Does Booker think environmental justice could be a winning issue in Iowa? “Yes,” he told Grist after the forum. “Every state has Superfund sites, every state is struggling with environmental justice issues, so absolutely.”

Unfortunately, the 2020 contenders may not get another opportunity to discuss the topic this election cycle. After all, environmental justice has only been discussed, briefly, at one presidential debate, thanks to prodding from, Marianne Williamson, who has failed to qualify for the past two debates. And despite multiple requests from candidates, the Democratic National Committee said it will not host a debate on climate change.

Williamson told Grist she was impressed by what her fellow presidential hopefuls said at the forum. “When it comes to actual policies,” she said, “none of us are all that different from each other. We all get it.” At the very least, she added, the policies discussed at Friday’s forum would be a “complete reversal of the level of entrenched environmental injustice that is endemic to the agenda of the current administration.”

Amazon accused of abandoning 100 percent renewable energy goal

Amazon has been accused of abandoning a much-publicized goal of running its data centers on 100 percent renewable energy — instead focusing its attention on winning business from the oil and gas industry.

According to a Greenpeace report released earlier this year, some of Amazon’s most important data centers in Virginia, where the company has committed to building its second HQ, are powered by only 12 percent renewable energy. Across the company as a whole, Amazon reached 50 percent renewable usage in 2018, and has not issued any updates since.

This week, a report from the tech news site Gizmodo suggested one reason for the slowdown was Amazon’s increasing focus on bringing on board large oil and gas companies as Amazon Web Service customers.

The figures represent slow progress towards the goal, first announced in 2014, to power the entire company using renewables, and have led some to accuse Amazon of abandoning the goal entirely.

Alongside the organization’s report, Greenpeace’s Elizabeth Jardim said: “Despite Amazon’s public commitment to renewable energy, the world’s largest cloud computing company is hoping no one will notice that it’s still powering its corner of the internet with dirty energy.

“Unless Amazon and other cloud giants in Virginia change course, our growing use of the internet could lead to more pipelines, more pollution and more problems for our climate.”

Gizmodo’s report cited Andrew Jassy, the AWS chief executive, who told an oil and gas conference in Houston last month: “A lot of the things that we have built and released recently have been very much informed by conversations with our oil and gas customers and partners.”

Gizmodo contrasted his statement with another, reported in December, from the AWS executive Peter DeSantis, who “told colleagues inside the company that renewable energy projects are too costly and don’t help it win business.”

Amazon’s renewables record is in stark contrast to some of its competitors, most notably Google, which reported success in reaching 100 percent renewables use in 2017. “Our engineers have spent years perfecting Google’s data centers, making them 50 percent more energy-efficient than the industry average,” the company’s head of technical infrastructure, Urs Hölzle, said at the time.

“But we still need a lot of energy to process trillions of Google searches every year, play more than 400 hours of YouTube videos uploaded every minute and power the products and services that our users depend on. That’s why we began purchasing renewable energy – to reduce our carbon footprint and address climate change. But it also makes business sense.”

A year later, Apple declared its “retail stores, offices, data centers and co-located facilities in 43 countries” were powered by 100 percent clean energy. Facebook has committed to do the same by 2020.

Amazon did not immediately respond to a request for comment.

Trump is about to make the pork industry responsible for inspecting itself

Next time you tuck into a pork chop or a carnitas-filled burrito, spare a thought for the people who work the kill line at hog slaughterhouses. Meatpacking workers incur injury and illness at 2.5 times the national average; and repetitive-motion conditions at a rate nearly seven times as high as that of other private industries. Much has to do with the speed at which they work: Hog carcasses weighing as much as 270 pounds come at workers at an average rate of 977 per hour, or about 16 per minute.

President Donald Trump’s U.S. Department of Agriculture is close to finalizing a plan that would allow those lines to move even faster, reports the Washington Posts Kimberly Kindy. The USDA’s Food Safety and Inspection Service is currently responsible for overseeing the kill line, making sure that tainted meat doesn’t enter the food supply. The plan would partially privatize federal oversight of pork facilities, cutting the number of federal inspectors by about 40 percent and replacing them with plant employees, Kindy adds. In other words, the task of ensuring the safety of the meat supply will largely shift from people paid by the public to people being paid by the meat industry.

Deregulation is on brand for the Trump team, but the idea of semi-privatizing the USDA’s meat inspection dates to former President Bill Clinton, who launched pilot programs for both chicken and pork plants. President Barack Obama was an enthusiast — his USDA approved a similar plan for chicken slaughterhouses in 2014, but declined in the end to let all poultry companies speed up the kill line after fierce pushback by workplace and food safety advocates. In its waning days in 2016, the Obama USDA was close enough to finalizing hog slaughterhouse deregulation that a bipartisan group of 60 Congress members sent a letter to then-USDA Secretary Tom Vilsack urging the the department not to make the move.

The Trump administration appears to be bringing new zeal to the task of reshaping meat inspection. Once it finalizes the new pork inspection, the USDA plans to roll out a similar scheme for the beef industry, Kindy reports. And last fall, the agency announced it would would let some chicken slaughterhouses speed up their kill lines from 140 birds per minute to 175 birds per minute.

The USDA has long insisted pulling inspectors off the kill line—while also speeding it up—is about “modernization.” “Advances in animal science, market hog production systems, biosecurity, and veterinary medicine have eliminated the vast majority of diseases inspected for under traditional inspection,” the agency claimed in a 2018 explainer.

What does this deregulation mean for the safety of our meat? We already have a sneak preview. For years, a USDA pilot program has allowed five large hog slaughterhouses to operate at higher line speeds with fewer inspectors. A 2013 audit by the USDA’s Office of Inspector General found that the USDA “did not provide adequate oversight” of the pilot facilities over its first 15 years, and as a result, the plants “may have a higher potential for food safety risks.”

According to the OIG report, there are 616 USDA inspected hog plants in the United States, meaning that just 0.8 percent of them are in the pilot program. Yet of the top 10 US hog plants earning the most food safety and animal welfare citations in the period of fiscal years 2008 to 2011, three were enrolled in the pilot program. By far the most-cited slaughterhouse in the United States over that period was a pilot plant — it drew “nearly 50 percent more [citations] than the plant with the next highest number.”

And in 2015, the Government Accountability Project released affidavits from four USDA federal inspectors working in the pilot hog plants. Their reports from the sped-up line, which I wrote about here, don’t make for appetizing reading. Here’s an excerpt.

“Not only are plant supervisors not trained, the employees taking over USDA’s inspection duties have no idea what they are doing. Most of them come into the plant with no knowledge of pathology or the industry in general.”

“Food safety has gone down the drain under HIMP [the acronym for the pilot program]. Even though fecal contamination has increased under the program (though the company does a good job of hiding it), USDA inspectors are encouraged not to stop the line for fecal contamination.”

In Kindy’s recent Washington Post report, Pat Basu, chief veterinarian for the USDA inspection service from 2016 to 2018, makes similar observations. He “refused to sign off on the new pork system because of concerns about safety for both consumers and livestock,” Kindy reports. “The USDA sent the proposed regulations to the Federal Register about a week after Basu left, and they were published less than a month later, according to records and interviews.”

The Trump USDA first announced plans to finalize the new system in February of 2018, but has made no public comments on it since. Kindy reports the changes are imminent, and could be rolled out “as early as May.” The agency did not respond to my request for comment.

How American recycling is changing now that China won’t take it

“This facility is our version of Willy Wonka & the Chocolate Factory.”

That’s how Eileen Kao described Montgomery County, Maryland’s recycling center on a tour. Kao, who is chief of waste reduction and recycling in the county’s Department of Environmental Protection, pointed out how machines in the facility help sort recyclables. As she described how the machines worked, a magnet separated steel and tin cans into a storage silo while a shaker table collected pieces of glass that were too small to be sorted. Dozens of workers hand-sorted at certain steps along the process.

The county’s recycling center in Derwood, Maryland, processed more than 31,000 tons of commingled material and more than 45,000 tons of mixed paper last year. At this building, commingled material (bottles, cans, and containers) is sorted. Mixed paper, including cardboard, is sorted in another facility nearby.

Over recent months, news coverage has depicted China’s National Sword policy as a crisis for recycling in municipalities all over the United States. Since early 2018, China has banned many scrap materials and has not accepted others unless they meet an extremely strict contamination rate of 0.5 percent. (Contamination rates of U.S. recyclables before sorting vary from place to place, but can reach 25 percent or higher.) The decision reflects China’s desire to recycle more of its domestic waste. Previously, China had been the destination for about 40 percent of the United States’ paper, plastics, and other recyclables.

National Sword sent waves through the global recyclables market. The changes in China diverted many materials to Southeast Asian countries, whose ports were not prepared to receive them in such high volume. Thailand, Vietnam, and Malaysia have begun to enact their own restrictions.

Meanwhile, many municipal recycling programs in the United States have suffered. As of January, Philadelphia was sending half of the recyclables it collects straight to the incinerator. Minneapolis stopped accepting black plastics. Marysville, Michigan, will no longer accept eight of 11 categories of items (including glass, newspaper, and mixed paper) for curbside recycling, in order to cut costs. Deltona, Florida, stopped curbside pickup altogether.

Many recycling and solid-waste organizations, as well as the U.S. EPA, have dedicated resources and staff to “identify solutions to be able to help support recycling here in the U.S.,” according to Dylan de Thomas, vice president of industry collaboration at the Recycling Partnership, a nonprofit that gives grants to and works with communities to improve their recycling programs. The EPA, which has typically left leadership on recycling to local governments, held its first-ever recycling summit in November 2018.

While recycling centers have been closing down in some places, like in greater Birmingham, Alabama, and around California, programs elsewhere are stepping up their efforts to decrease contamination levels in the recycling bin by educating residents about their role in the recycling process. This emphasis on outreach suggests a heavier onus on citizens to stop tossing items absentmindedly into the bin, and start disposing of them in a more informed, deliberate way.

Take plastic bags, for example. Whereas most grocery chains accept plastic bags for recycling, most municipal recycling programs do not. Still, plastic bags are frequently found in recycling bins. The mistake is so pervasive that Washington, D.C., mailed postcards to residents instructing them not to put plastic bags in the recycling bin. (D.C. only prints two types of mailers each year for recycling, one an overview and another focused on a particular issue.)

D.C. also did a pilot program with the Recycling Partnership to provide curbside feedback for residents. Between 2005 and 2014, the single-stream model went from being used by 29 percent of American communities to 80 percent, according to one survey. It may lead to people putting fuller bins out to be collected, but the uptake of single-stream recycling has also meant higher contamination rates.

Some communities are switching back to dual-stream in an attempt to bring down contamination. Otherwise, they’re hoping citizens can make better recycling decisions. Ecomaine, a nonprofit that processes recycling for more than 70 communities in Maine on a single-stream model, recently hired a new educator to inform residents about what’s recyclable, what’s not, and why.

“It has certainly been a tough year-and-a-half to two years,” said Ecomaine’s communications manager, Matt Grondin. “But in the end, that landfill storage is forever storage, and to abandon recycling programs for a year or two of a down market really is a short-sighted solution to a long-term problem.”

Back in Maryland, China’s policy hasn’t led Montgomery County to stop recycling anything. It continues to generate revenues from all the materials it recycles, Kao said, except mixed-color, broken glass, which it pays to recycle because it has little value. The county sells the majority of its bales domestically. In fact, one silver lining to China’s crackdown is a growing domestic market in the United States. More than a dozen North American paper mills have announced new capacity to process recycled paper, although it will be a few years before all of it comes online.

In any case, there are strategies that local programs can use, either separately or in combination, to find their way back to health and continue recycling waste. China’s policy change may not represent the much-feared “end of recycling” in the United States so much as an inflection point.

That’s how Eileen Kao described Montgomery County, Maryland’s recycling center on a tour. Kao, who is chief of waste reduction and recycling in the county’s Department of Environmental Protection, pointed out how machines in the facility help sort recyclables. As she described how the machines worked, a magnet separated steel and tin cans into a storage silo while a shaker table collected pieces of glass that were too small to be sorted. Dozens of workers hand-sorted at certain steps along the process.

The county’s recycling center in Derwood, Maryland, processed more than 31,000 tons of commingled material and more than 45,000 tons of mixed paper last year. At this building, commingled material (bottles, cans, and containers) is sorted. Mixed paper, including cardboard, is sorted in another facility nearby.

Over recent months, news coverage has depicted China’s National Sword policy as a crisis for recycling in municipalities all over the United States. Since early 2018, China has banned many scrap materials and has not accepted others unless they meet an extremely strict contamination rate of 0.5 percent. (Contamination rates of U.S. recyclables before sorting vary from place to place, but can reach 25 percent or higher.) The decision reflects China’s desire to recycle more of its domestic waste. Previously, China had been the destination for about 40 percent of the United States’ paper, plastics, and other recyclables.

National Sword sent waves through the global recyclables market. The changes in China diverted many materials to Southeast Asian countries, whose ports were not prepared to receive them in such high volume. Thailand, Vietnam, and Malaysia have begun to enact their own restrictions.

Meanwhile, many municipal recycling programs in the United States have suffered. As of January, Philadelphia was sending half of the recyclables it collects straight to the incinerator. Minneapolis stopped accepting black plastics. Marysville, Michigan, will no longer accept eight of 11 categories of items (including glass, newspaper, and mixed paper) for curbside recycling, in order to cut costs. Deltona, Florida, stopped curbside pickup altogether.

Many recycling and solid-waste organizations, as well as the U.S. EPA, have dedicated resources and staff to “identify solutions to be able to help support recycling here in the U.S.,” according to Dylan de Thomas, vice president of industry collaboration at the Recycling Partnership, a nonprofit that gives grants to and works with communities to improve their recycling programs. The EPA, which has typically left leadership on recycling to local governments, held its first-ever recycling summit in November 2018.

While recycling centers have been closing down in some places, like in greater Birmingham, Alabama, and around California, programs elsewhere are stepping up their efforts to decrease contamination levels in the recycling bin by educating residents about their role in the recycling process. This emphasis on outreach suggests a heavier onus on citizens to stop tossing items absentmindedly into the bin, and start disposing of them in a more informed, deliberate way.

Take plastic bags, for example. Whereas most grocery chains accept plastic bags for recycling, most municipal recycling programs do not. Still, plastic bags are frequently found in recycling bins. The mistake is so pervasive that Washington, D.C., mailed postcards to residents instructing them not to put plastic bags in the recycling bin. (D.C. only prints two types of mailers each year for recycling, one an overview and another focused on a particular issue.)

D.C. also did a pilot program with the Recycling Partnership to provide curbside feedback for residents. Why Toledo just gave legal rights to Lake Erie

Lake Erie provides drinking water for 11 million people, and an unusual tactic to protect it was just adopted in Toledo, Ohio: On Tuesday, Toledoans passed the “Lake Erie Bill of Rights” in a special election, with 61 percent voting yes on a ballot measure that could allow citizens to sue polluters on behalf of the lake.

“This is the first in the nation in terms of rights-of-nature law being adopted by a municipality over a certain ecosystem, and I think it’s the beginning of more things to come in that area,” said Thomas Linzey, executive director and chief legal counsel for the Community Environmental Legal Defense Fund, which helped local activists draft the bill.

The ballot measure will amend the city’s charter to establish that Lake Erie has the right to “exist, flourish, and naturally evolve.” The goal of giving the lake legal rights, Linzey said, is for activists to be able to do “a survey of who’s the biggest polluters into the lake” and then bring lawsuits “to stop that pollution,” he said.

Runoff pollution is a major cause of Lake Erie’s algae blooms, which can make water toxic to fish, wildlife, and people. This kind of pollution occurs “when rainfall washes fertilizer and manure spread on large farm fields into streams that flow into Lake Erie,” according to the Alliance for the Great Lakes.

Past problems with Lake Erie’s water quality prompted organizers to think about new ways to safeguard it. Back in 2014, the City of Toledo issued an advisory for residents not to drink municipal water after chemical tests found unsafe levels of an algal toxin. The toxic algae bloom left 110 people sick and nearly half a million without tap water. Ohio even declared a state of emergency.

“For three days in 2014, we lost access to our drinking water, and we didn’t see any action come out of that,” Markie Miller, an organizer for Toledoans for Safe Water, told CityLab. “We wanted to do something for ourselves.”

The concept of giving rights to nature originates, at least within the U.S., from an article by Christopher Stone published in 1972 in the Southern California Law Review: “Should Trees Have Standing? — Toward Legal Rights for Natural Objects.” Since then, the idea has gained traction internationally. In 2008, Ecuador became the first country to recognize rights of nature in its national constitution. And in 2010, Bolivia’s legislative assembly passed the “Law of the Rights of Mother Earth.”

The basic principle is that of legal standing: Under the U.S. Constitution, to have standing, one needs to show direct injury to oneself caused by some entity, and there must be some redress, or remedy, that can be found in court. Activists hope that with these new rights, Lake Erie will have standing in court without needing to demonstrate injury to a human.

The U.S. Clean Water Act addresses point-source pollution, from a confined and discrete source. But a significant percentage of what plagues Lake Erie is diffuse, non-point-source pollution, such as excess fertilizers from agriculture and urban stormwater runoff.

The fact that Toledoans endorsed such an unusual means to combat pollution reflects an understanding that current regulations aren’t sufficient, said Madeline Fleisher, senior attorney in the Environmental Law & Policy Center’s Columbus office. “The citizens of Toledo are clearly and rightfully frustrated. I understand why they’re trying novel approaches to try to get those issues addressed.” (As is common in local special elections, turnout in Toledo’s was low; just shy of 9 percent of registered voters cast ballots.)

The proposal has been contentious. The board of elections in Lucas County (whose seat is Toledo) voted to block it from the ballot in the November 2018 election. After several months of debate, the board ultimately voted in December to add it to the February special election because of an Ohio Supreme Court decision, as the Toledo Blade reported. One board member said he still believed the measure was “on its face unconstitutional and unenforceable.”

Opponents of the Lake Erie Bill of Rights are concerned about the costs of litigation for farms and businesses. The Ohio Farm Bureau Federation already pledged its support for a lawsuit farmer Mark Drewes filed in the Federal District Court for Northern Ohio Wednesday, challenging the constitutionality of the bill.

“Farmers want and are working toward improving water quality, but this new Toledo law hurts those efforts. Mark Drewes understands this, and it’s Farm Bureau’s job to back his important actions on behalf of Ohio farmers,” the executive vice president of the Ohio Farm Bureau, Adam Sharp, said in a statement.

The suit contends that the measure violates federal constitutional rights, including equal protection and freedom of speech. Additionally, it argues that the bill of rights violates Ohio state law in several ways. For example, it contends that Toledo as a local government cannot override the Ohio state governing structure of Lake Erie, since the Ohio Department of Natural Resources governs the lake under state law.

“One of the biggest challenges that the [Lake Erie] Bill of Rights will have is moving from vision to enactment,” said Cinnamon Carlarne, an Ohio State University law professor. “That is part of a larger conversation trying to advance the role that law plays in protecting ecosystems for a variety of reasons — not the least of which is that we are, as humans, fundamentally dependent on them.”

Andrew Wheeler confirmed as the nation’s 15th EPA administrator

Andrew Wheeler has been confirmed as the nation’s 15th administrator of the Environmental Protection Agency.

The Senate voted 52-47 to confirm the former coal lobbyist, who has served as acting EPA chief since former Administrator Scott Pruitt resigned amid ethics scandals last July.

In a statement posted to Twitter, Wheeler said he was “deeply honored” and looking forward to carrying out President Donald Trump’s agenda.

Senator Joe Manchin, a Democrat from West Virginia, voted against Wheeler after having supported his nomination as deputy administrator last year. Senator Susan Collins of Maine was the lone Republican to vote against the nomination. She opposed Pruitt’s nomination but, like Manchin, previously voted to confirm Wheeler as the agency’s No. 2 official.

In a statement Wednesday announcing her decision, Collins said Wheeler is “certainly qualified” but that she has “too many concerns with the actions during his tenure as acting administrator to be able to support his promotion.”

“The policies he has supported as acting administrator are not in the best interest of our environment and public health, particularly given the threat of climate change to our nation,” she said.

His confirmation adds yet another member to President Donald Trump’s Cabinet who as recently as 2017 was on the payroll of the industries he now regulates.

In 2017, the Senate confirmed Alex Azar, a former executive at the pharmaceutical giant Eli Lilly & Co., to lead the Department of Health and Human Services. In January, former Boeing executive Patrick Shanahan took over as acting secretary of defense after James Mattis’ abrupt departure. The next day, David Bernhardt, a former oil lobbyist and No. 2 at the Department of the Interior, became acting secretary when Ryan Zinke resigned amid mounting ethics investigations.

A week later, Trump nominated Wheeler, who in December became the longest-serving acting administrator in the EPA’s history, to take on the role permanently.

Thursday’s confirmation comes a day after the Senate voted 52-46 to end debate on the nomination. In a speech on the Senate floor following that vote, Senator Tom Carper, a Democrat from Delaware, said that in some cases Wheeler has “accelerated the environmental damage and regulatory zeal” that Pruitt began.

“Time and time again Mr. Wheeler has proven that his environmental policies are almost as destructive and extreme has his predecessors’,” he said.

Senator John Barrasso, a Republican from Wyoming, chair of the Senate Committee on Environment and Public Works, said Wednesday that Trump picked the right man for the job. Regulatory proposals to replace the Clean Power Plan, an Obama-era rule to cut carbon pollution from power plants, and to revise the 2015 Waters of the U.S. rule, which sought to safeguard drinking water for millions of Americans, shows that Wheeler “is serious about clear air and clear water while also understanding there’s an important role for states and local communities to play,” Barrasso said.

Wheeler’s record-breaking reign as acting administrator was marked by an unprecedented assault on greenhouse gas regulations amid historic wildfires and hurricanes that scientists say offer a preview of the rapidly warming world to come.

In August, Wheeler unveiled a proposal weakening fuel economy standards for new vehicles in a move seen as a “giant giveaway” to oil companies even as electric automobile technology made huge leaps forward. Weeks later, he proposed gutting a landmark Obama-era power plant regulation, allowing, by the EPA’s own calculus, enough pollution to cause an additional 1,400 premature deaths per year.

The planet has already warmed more than 1 degree C (1.8 degrees F) above pre-industrial levels. As a result, many Americans born after the mid-1970s have never experienced average temperatures unaffected by human-caused emissions. But in October, the United Nations released a landmark report predicting catastrophic effects of warming beyond 1.5 degrees Celsius (2.7 degrees F) — a fate that’s all but certain unless world governments halve emissions by 2030. A month later, federal scientists from 13 agencies, including the EPA, confirmed the findings in a National Climate Assessment that forecast U.S. average temperatures surging “9 degrees F (5 degrees C) or more by the end of this century.”

In response, Wheeler, despite admitting he hadn’t read the multiagency report, dismissed its findings and threatened to intervene in the drafting of the next National Climate Assessment.

In December, Wheeler delivered another two victories to the coal industry that, until mid-2017, had paid him to lobby the government. He proposed loosening requirements that coal-fired power plants reduce carbon dioxide emissions. He capped off the month by announcing plans to relax a rule restricting how much mercury and other dangerous pollutants coal-fired plants can release into the air.

In February, Wheeler announced that the EPA would consider regulating toxic, cancer-causing “forever chemicals” contaminating drinking water across the country — a move critics said amounted to a delay that could sicken millions. Last week, he broke off negotiations with California over a national vehicle fuel economy standard, setting the administration up for a lengthy legal fight with the Golden State, which is allowed under the Clean Air Act to set its own pollution limits.

Environmental groups reacted to Thursday’s confirmation much as they did when Wheeler took the reins as deputy administrator.

“Wheeler wants to turn the EPA into a wish-granting service for polluters, no matter the cost to public health or wildlife,” Emily Knobbe, EPA policy specialist at the Center for Biological Diversity, said in a statement. “But it’s only a matter of time before his dirty dealings land him in the same trash heap as his predecessor.”
