The 2015 Retirement Confidence Survey from the Employee Benefit Research Institute is out, and it shows the usual: hardly anyone thinks that Social Security benefits will remain stable in the future. They expect cuts, cuts, and more cuts.

This may be part of the explanation for the two charts on the right. If you ask current workers, only a third think that Social Security will be a major source of retirement income. But if you ask current retirees for a reality check, two-thirds report that Social Security is a major source of their retirement income.

Why the big difference? If workers think Social Security benefits are likely to be cut, that’s probably a part of the explanation. But a bigger part is almost certainly just invincible optimism. Current workers are sure they’re going to save enough, or get a big enough return on their 401(k), or get a big enough inheritance, or something—and this will see them through their retirement. Social Security? It’ll just be a little bit of extra pin money for fun and games.

But in reality, that’s not how it works. For most people, it turns out they don’t save nearly as much as they think, which in turn means that their little Social Security check is what keeps them solvent. If more people understood this, public acceptance of conservative plans to cut Social Security benefits would probably be a lot lower.

Facebook Is Being Sued for Gender and Racial Discrimination. Here’s Why.

In a lawsuit filed against Facebook on Monday, former employee Chia Hong accused the company of gender discrimination, racial discrimination, and sex harassment.* She is represented by Lawless & Lawless, the same law firm representing Ellen Pao in the high-profile gender discrimination case against venture capital firm Kleiner Perkins. (And yes, Lawless really is the last name of the two sisters who head the firm.)

Hong, who worked as a product manager at Facebook until October 2013, alleges that she suffered from discrimination by her boss, Anil Wilson, and dozens of other coworkers during her three years at the company. She also claims that she was wrongfully terminated after complaining about the harassment and discrimination.

The complaint states that Facebook employment policies were “neutral on their face” but “resulted in a disparate impact” on Hong, due to her gender:

The harassment included, but was not limited to, ANIL WILSON regularly ignoring or belittling plaintiff’s professional opinions and input at group meetings in which she was the only woman or one of very few; asking plaintiff why she did not just stay home and take care of her child instead of having a career; admonishing plaintiff for taking one personal day per month to volunteer at her child’ s school, which was permitted under company policy; ordering plaintiff to organize parties and serve drinks to male colleagues, which was not a part of plaintiff’s job description and not something that was requested of males with whom she worked; and telling plaintiff he had heard she was an “order taker,” by which he meant that she did not exercise independent discretion in the execution of her job duties.

It also alleges racial discrimination against her:

The discrimination included, but was not limited to, plaintiff having her professional opinions belittled or ignored at group meetings in which she was one of the only employees of Chinese descent; plaintiff being told that she was not integrated into the team because she looks different and talks differently than other team members, and plaintiff being replaced by a less qualified, less experienced Indian male.

This latest case comes as various Silicon Valley companies are struggling to diversify their conspicuously white, male workforces. According to a report issued by Facebook last June, 69 percent of its employees are male—including 77 percent among senior staff and 85 percent among its tech workers. The report also found that Facebook’s overall workforce was 57 percent white and 34 percent Asian.

In a statement to TechCrunch on Wednesday about the lawsuit, a Facebook spokesperson refuted Hong’s allegations: “We work extremely hard on issues related to diversity, gender and equality, and we believe we’ve made progress. In this case we have substantive disagreements on the facts, and we believe the record shows the employee was treated fairly.”

Correction: The initial version of this post misstated the allegation as “sexual harassment.”

Top State Republican Sued For “Bigoted, Racist, and Sexist” Comments

The Georgia Republican Party, and its chair, John Padgett, have already been sued once in the past year over allegations of racial discrimination and racial slurs. Now, Padgett, his wife, and the company he owns are being sued again, on the grounds that they frequently engaged in “bigoted, racist and sexist commentary” about the employees who work there, a possible violation of the federal Civil Rights Act and the Fair Labor Standards Act.

The latest suit was filed by Vanessa Dewberry, a former manager at Southeast Ambulance Inc., a company owned and operated by Padgett. Dewberry, who is black, was usually the only person of color in higher-level meetings, the suit notes. That meant she was privy to the allegedly questionable comments of the predominately white management. In February 2014, Dewberry decided to record a meeting. What she heard became the basis of her lawsuit:

Padgett, talking about a black employee: “He’s not a goddamn doctor…he’s a black tech that’s supposed to know better.”
Padgett and others (including his wife, Mary) engaged in a conversation making fun of a female employee. “She’s the one that looks like a boy,” Padgett said. A male speaker interjected, “Nobody around the office knows what to refer to it.” Mary Padgett responded: “What is she? Is she a—is she—it’s a—if she’s a she.” According to Dewberry, John Padgett found the exchange humorous, and laughed during at mentions of the employee as “it.”

“As shocking as this type of unlawful ridicule of SEA employees was,” the suit states, “Ms. Dewberry recognized that it was typical of SEA meetings and was not likely to stop without some intervention.” Dewberry complained to Padgett and company HR director Michelle Hayes directly after the meeting, but her lawyers say no action was taken to address the complaint. Less than a week later, Padgett fired her. Dewberry is suing not only for racial discrimination and wrongful termination, but also for wages—her suit also alleges she was not fully paid for her work.

Padgett’s alleged bad behavior extended to his work as chairman of the state GOP, too. The earlier suit, filed in July 2014 by Padgett’s ex-assistant, Qiana Keith, is still pending. Keith alleges that she endured consistent racial discrimination and racial slurs while working at the Georgia Republican Party, including being ordered not to park in front of the party offices. State party lawyers deny Keith’s claims; attempts to reach Padgett for comment were unsuccessful, and SEA declined to comment. Padgett is a longtime conservative activist in Georgia, and was elected as chair in 2013 on a platform of “fighting the liberal media” and “building a new majority” by promoting diversity, according to a campaign ad.

Could This Be the Senate Race Where the Koch Brothers Meet Their Match?

Republicans’ most likely path to retaking the Senate in November requires GOPers to pick up seats in six key states: Alaska, Arkansas, Louisiana, Montana, South Dakota, and West Virginia. Of the six, Alaska—where Democratic Sen. Mark Begich is facing off against former Republican Attorney General Dan Sullivan—may be the closest race. That’s why right-wing groups backed by the likes of the Koch brothers and Karl Rove are dumping millions into the state—and why Alaska unions are pulling out all the stops this year to make sure Begich, a fierce supporter of labor, carries the day.

“This is literally the most active we’ve ever been in an election cycle,” says Vince Beltrami, the president of the Alaska AFL-CIO, which represents nearly all unions in the state.

Union members have been working the phones, pushing out mailings, and canvassing on behalf of Begich. Volunteers have even taken the unusual step of door-knocking in areas far outside of Alaska’s urban centers, says Jerry McBeath, a professor of political science at the University of Alaska-Fairbanks. Because of the unprecedented level of campaign action this year, Beltrami says, the AFL-CIO had to rent out an extra 7,000-square-foot warehouse.

In addition to boots-on-the-ground support for Begich, unions are also throwing down for TV ads to help ensure the freshman senator gets a second term in office. The political action committee affiliated with the International Association of Fire Fighters, for example, recently spent $165,000 on TV ads against Sullivan. The National Education Association’s super-PAC unveiled an ad in early September slamming Sullivan for a misleading claim he made about going after a Wall Street firm that gave the state bad financial advice and cost the public pension fund billions of dollars. Around the same time, four statewide unions—Alaska Professional Fire Fighters, Alaska Public Employees Association, Alaska State Employees Association, and National Education Association-Alaska—held a press conference in midtown Anchorage to respond to the same disingenuous ad.

Labor unions are some of the top contributors to Senate Majority PAC, the organization that provides most of the funding for Put Alaska First, the political action committee that backs Begich and has run a majority of commercials supporting him.

Begich has a solid pro-labor track record. Since his election to the Senate in 2009, he has backed legislation that would give collective bargaining rights to public safety officers, cosponsored the Employee Free Choice Act, which would make it easier for workers to organize for better wages and benefits, and voted against a bill that would have banned Transportation Security Administration employees from collective bargaining. After Begich won his Senate race in November 2008, he delayed his resignation as mayor of Anchorage to oversee the signing of generous five-year contracts with unions representing municipal workers, firefighters, electrical workers, and cops. One out of every four Alaskans is either in a union or has a family member in a union. The state has the second-highest union membership rate in the country.

The giant push by labor this year comes not only because the race is one of the most competitive in the country and could decide which party controls the Senate. The wave of union action is also a backlash against the onslaught of money pouring into the state in support of Sullivan from the billionaire Koch brothers’ dark-money group Americans for Prosperity and GOP operative Karl Rove’s super-PAC, American Crossroads. The groups—which support the rollback of collective bargaining rights and back right-to-work laws, which prevent unions from compelling employees to join or pay dues to a union—are dumping money into the Alaska Senate race for the first time ever.

“They’re up here on the airwaves 24 hours a day, seven days a week, trying to tie Mark to Obama,” Beltrami says. “They say things 50 times a day on the airwaves that aren’t true. You gotta push back.”

Unions have a unique edge when it comes to pushing back, McBeath explains. He says unions could swing this election in Begich’s favor because the amount of outside money flowing in means “the airwaves are almost bought out, and other means of campaigning—like door-to-door—are more important than they would be in a typical Senate race.”

Begich has raised a total of $8.4 million so far and has spent $6.4 million. Sullivan has raised $4 million, of which he has spent about $3 million.

It makes sense that the unions are going no-holds-barred to make sure Begich wins in November. It’ll be rough going all the way though—in part because not all rank-and-file members will fall in line with union leadership at the polls, says Carl Shepro, a former political science professor at the University of Alaska-Anchorage. “There are so many conservative voters in Alaska,” he says. Even if they’re part of a union, “that doesn’t mean that they’ll vote liberal.”

When Keith Seilhan was called in to coordinate BP’s oil spill cleanup after the Deepwater Horizon rig exploded, the senior company official and experienced crisis manager looked at the situation and thought, “Fuck this.” He dumped his family’s $1 million worth of BP stock, earning a profit and saving $100,000 in potential losses after the share price tanked even further.

But Seilhan knew something that other investors did not know when he made that trade. The company was lying to the government and the public about the amount of oil that was leaking from the ruptured well — by a factor of more than ten. And the feds say that doesn’t just make Seilhan an awful person — it means he was engaging in insider trading. Charges and a settlement were announced Thursday.

“The complaint alleges that within days, Seilhan received nonpublic information on the extent of the evolving disaster, including oil flow estimates and data on the volume of oil floating on the surface of the Gulf,” the U.S. Securities and Exchange Commission said in its announcement.

Without admitting or denying guilt, the Texan, who has since left BP, agreed to pay the government a penalty equivalent to double the $105,409 that he allegedly gained through the trade.

Fancy-pants restaurant made its fancy-pants customers sick.

A tasting menu at Danish restaurant Noma, consistently named among the world’s best, costs $250 a head — not including wine.

For at least 63 people who dined there last month, a generous helping of vomiting and diarrhea was on the house.

Danish food authorities faulted the famous restaurant for failing to protect its diners after one of its workers fell ill last month, apparently spreading gastroenteritis to dozens of its big-spending customers. The initial emailed report of the illness was ignored for four days by restaurant staff.

Noma is accustomed to basking in food industry glory. It has been crowned the world’s top restaurant on the San Pellegrino World’s 50 Best Restaurants list three times, for example. Now it is wallowing in a new kind of spotlight. From The Guardian:

In a statement Peter Kreiner, Noma’s managing director, told Danish newspapers: “It is a matter that affects us all deeply, and which we are really sorry about.”

The restaurant recognised that internal procedures had not been good enough and said an email from the employee reporting the sickness had not been seen.

He also said the faulty [hot water] tap [identified by investigators] had been fixed by a plumber straight after the inspection and that the restaurant had changed its procedure around staff emails to avoid any future delays.

Kreiner said the restaurant was co-operating with health authorities and organising customer compensation.

The restaurant’s chefs are known for experimenting with such unusual ingredients as ants and fermented grasshoppers, Reuters tells us. Perhaps now its managers will experiment with promptly reading their emails.
