Steve Benen reports on the swan song of conservative plans to prove that Planned Parenthood broke the law:

There was just one nagging detail: Planned Parenthood never actually did anything illegal. It didn’t sell fetal tissue for a profit; it didn’t misuse public resources, and it didn’t violate any laws. The Republican plan was based on a foundation of quicksand.

But The Hill reported over the weekend that GOP House members are now shifting to their back-up plan: they no longer care whether Planned Parenthood did anything wrong.

In reality, there’s no shift here. Republicans have wanted to defund Planned Parenthood for a long time. The sting videos were just an excuse to mount another effort. Democrats do the same thing on gun control whenever there’s a high-profile shooting.

And there’s nothing really wrong with this. Politics is all about persuading the public to come around to your way of thinking, and one way to do that is to take advantage of events in the real world. Even if you fail, maybe you’ve moved public opinion a few points and you’ll do better next time. So far, both Planned Parenthood and gun rights have survived, and there’s not really much evidence that public opinion has shifted a lot on either one. But that doesn’t mean anyone is likely to stop trying.

It Turns Out That Those "Full and Unedited" Planned Parenthood Videos…. Aren’t

I gave up on the Planned Parenthood sting videos a long time ago. It’s pretty obvious there was no criminal behavior unmasked, or even any unethical behavior.1 The claims of the producers never matched the reality of the videos, so I stopped watching when new ones came out.

But Sarah Kliff soldiered on! She not only watched them all, she watched the full, unedited versions. And she discovered something after reading a forensic analysis of the videos from Planned Parenthood: they aren’t actually full and unedited. The folks who ran the sting claim that they did nothing more than edit out bathroom breaks, but Kliff isn’t buying it:

Take the first example I wrote about here, the meeting with the Texas Planned Parenthood clinic where the tape appears to jump forward a half-hour. In that case, nobody suggests a bathroom break. There’s no change in meeting; when the video jumps forward, they’re still sitting in the exact same seats.

Meanwhile, the longer videos show lots of small-talk footage that isn’t especially relevant to the argument over fetal body parts. I know because I watched all of it. There are moments in a car, where directions are being given and all the camera footage is totally blurry, where people stand around in hallways, where they talk about the relationship between caffeine and headaches. Those moments weren’t cut from the tape — and it’s hard to know what would make those different from the bathroom breaks and other moments deemed irrelevant to the audience.

I guess we need a chant for this. Release the video! We demand to see the bathroom breaks! Explain the timestamps! Or something. As far as I’m concerned, Planned Parenthood has long since been exonerated in this episode, so I don’t really need to see anything. But I am curious about just what they decided to leave out.

Investigations Prove the Planned Parenthood "Sting" Videos Were a Bust

Since undercover videos that captured Planned Parenthood staff discussing fetal tissue donations were released last month, GOP officials in more than 10 states have clamored to launch investigations into the organization. On Tuesday, South Carolina Gov. Nikki Haley joined that group, ordering her state’s health department to review the policies and practices of all abortion clinics in the state, including the three operated by Planned Parenthood.

“These practices are not consistent with the laws or character of our state,” Haley wrote in her letter to the state agency tasked with regulating abortion clinics, adding that it “cannot allow an organization with broken internal oversight and a flawed corporate culture to behave the way Planned Parenthood has in other states.”

In the videos, recorded surreptitiously and released by the anti-abortion group Center for Medical Progress, Planned Parenthood officials talk frankly about the organization’s tissue donation program and the costs associated with donating fetal tissue from an abortion. Though fetal tissue donation is a long-standing and legal practice in the United States, and has contributed to medical advancements like the polio vaccine, conservatives have used the videos to attack the health care organization, saying they provide evidence that Planned Parenthood illegally profits from the sale of aborted fetuses. And they’ve pushed for investigations to unmask this purported criminal wrongdoing.

But so far, those investigations are falling flat. Completed probes in Georgia, Indiana, Massachusetts, and South Dakota have spent thousands in taxpayer money but turned up no evidence that Planned Parenthood is trafficking in the sale of fetal tissue. And in most of the other states that have launched investigations—including Ohio, Arizona, Texas, and Kansas—Planned Parenthood affiliates don’t even have fetal tissue donation programs, making it hard to believe the states will find any illegal activity related to the practice. In Louisiana, where Gov. Bobby Jindal ordered an investigation in mid-July, Planned Parenthood does not even operate a single clinic.

“In every state where these investigations have concluded, officials have cleared Planned Parenthood of any wrongdoing,” Dawn Laguens, executive vice president of Planned Parenthood Federation, told the Huffington Post. “We’ve said all along that Planned Parenthood follows all laws and has very high medical standards, and that’s what every one of these investigations has found.”

Not every governor has taken the bait. Democratic governors in Minnesota and Virginia have rejected state legislators’ pleas to look into the group, saying they won’t waste time investigating programs that don’t exist in their states.

“As far as I’m concerned, there’s no basis for an investigation at taxpayer expense into a private nonprofit organization that has stated they don’t engage in those practices,” Minnesota Gov. Mark Dayton told local reporters after he received a letter from GOP lawmakers asking him to take action.

Other states have taken another approach since the release of the videos: Governors in Alabama and Arkansas, along with Louisiana’s Jindal, have moved to block Medicaid funding for Planned Parenthood, which they may not be able to do under federal law. Meanwhile, public opinion of the organization remains high. A recent NBC News/Wall Street Journal poll found that despite weeks of bad news, Planned Parenthood is still more popular than every major 2016 presidential contender, the NRA, and the Supreme Court.

In a radio interview yesterday with conservative host Hugh Hewitt, Donald Trump took the unusual step of agreeing with other Republican presidential candidates. He said that it would be better for the federal government to shut down than to continue funding Planned Parenthood.

“The only way to get rid of Planned Parenthood money for selling off baby parts is to shut the government down in September. Would you support that?” Hewitt asked. Trump replied, “Well I can tell you this. I would.” In the late ’90s, Trump said he supported keeping late-term abortions legal, but since first considering a run for the GOP nomination in 2011, he has been pro-life.

Trump joins a long list of conservatives who have expressed outrage over undercover videos released by a network of anti-abortion activists last month. Jeb Bush also offered his two cents. “The next president should defund Planned Parenthood,” he said in an interview. Louisiana Gov. Bobby Jindal severed the state’s Medicaid contract with Planned Parenthood yesterday. Meanwhile, the Senate debated a bill that aimed to strip all federal funding of Planned Parenthood. The bill ultimately failed after the threat of a Democratic filibuster led by Massachusetts Sen. Elizabeth Warren and Missouri Sen. Claire McCaskill.

Republican senators and 2016 hopefuls Ted Cruz and Rand Paul have promised to do everything in their power to deny funding to Planned Parenthood, even if it comes down to a government shutdown. Arizona Sen. John McCain, who chastised his colleagues for the 2013 shutdown, told NPR that he believes a shutdown would be justified in this case. “If Democrats want to stand before the American people and say they support this practice of dismembering unborn children, then that’s their privilege,” McCain said.

It’s possible that when Congress returns from its five-week August recess, Senate Majority Leader Mitch McConnell and House Speaker John Boehner will attach a new bill to defund Planned Parenthood to a must-pass budget bill, employing the same tactics that were used in the 2013 shutdown.

Now that Trump has signed on to a potential shutdown, he thinks it could succeed. He acknowledged to Hewitt that the government shutdown over the Affordable Care Act in 2013 was a political disaster for the Republicans—but that was their own fault. “If they had stuck together, they would have won that battle,” he asserted. “I think you have to in this case, also.”

It’s been a bad couple of weeks for reproductive rights. Planned Parenthood is under vicious attack: In addition to its site being hacked — hampering access to crucial reproductive healthcare services for women around the country — the absurdly named Center for Medical Progress has released, as of today, four separate videos attempting to villainize the organization. The cherry on top of this nightmare sundae is that on Monday, the Senate will vote on a bill that would strip Planned Parenthood of its funding.

Planned Parenthood is not, contrary to deluded conservative belief, the abortion factory that it’s painted as. It actually gives women all over the country access to birth control that, you know, prevents them from having to get abortions. And, as it turns out, much of the credit for the access that we do have is due to none other than Warren “Richer Than Your Entire City” Buffett.

Bloomberg Business reports:

In the past decade, the Buffett Foundation has become, by far, the most influential supporter of research on IUDs and expanding access to the contraceptive. “This is common-sense, positive work to help families meet their dreams and their needs in planning their pregnancies,” says Brandy Mitchell, a nurse practitioner who coordinates family planning at Denver Health, a state-run provider. “Why we have to rely on a donor to make this happen is beyond belief.”

Quietly, steadily, the Buffett family is funding the biggest shift in birth control in a generation. “For Warren, it’s economic. He thinks that unless women can control their fertility—and that it’s basically their right to control their fertility—that you are sort of wasting more than half of the brainpower in the United States,” DeSarno said about Buffett’s funding of reproductive health in the 2008 interview. “Well, not just the United States. Worldwide.”

Buffett’s great mountains of money have funded not only crucial medical research of IUDs, but also the landmark CHOICE project that started in St. Louis, Mo., in 2007 and the wildly successful Colorado initiative that provided free IUDs to adolescent girls, reducing teen pregnancy by 40 percent in four years as well as — surprise, surprise! — the teen abortion rate by 42 percent in the same time period. (Colorado Republicans, by the way, voted to defund that program in spite of its success.)

See, everyone? Money doesn’t always have to be evil! Incredibly rich people can do incredible things!

But then, of course, we can always count on the GOP to step in and fuck it all up.

The tweet, aside from demonstrating a clear lack of grammar skills, mirrors similar statements from the likes of Rush Limbaugh asserting the same blend of crazy. Rubio should probably lay off of Twitter and get back to actually doing his job.

Planned Parenthood "Sting" Video Is Yet Another Right-Wing Nothingburger

Yesterday I watched the (now infamous) hidden video from the Center for Medical Progress, which allegedly shows a couple of undercover “buyers” for a fetal tissue procurement company having lunch with Deborah Nucatola, director of medical services for Planned Parenthood. And it was obviously pretty fishy. Nucatola was talking very openly about how they dispose of fetal tissue from abortions, and doing it in a way that exhibited no stress and no sense at all of being involved in a shady operation. The price per specimen was $30-100,which obviously covered no more than shipping and normal handling. It plainly wasn’t enough for this to be an illegal for-profit business.

So I shrugged and went on with my day. Then the video landed on the front page of the Washington Post and it went mainstream. I assume Fox has been running it on a 24/7 loop as well. But as near as I can tell, it’s completely bogus. The video tries to imply that Planned Parenthood is performing illegal abortions and that it’s selling fetal tissue for profit, also a felony. But there’s not the slightest evidence of either. In fact, as Media Matters points out, if you watch the unedited video it’s crystal clear that the charges for the fetal tissue they sell are designed only to cover the actual costs of the process. Nucatola says repeatedly that affiliates want to “break even,” not make a profit.

So there’s basically nothing here. Bioethicists have been debating for years whether it’s a good idea to sell fetal tissue, and as you can imagine, they’ve been disagreeing for years and show no signs of ever coming to a consensus. Some think it’s wrong and some think it’s OK. That’s not surprising since some people think abortion is wrong and some think it’s OK. And if you think abortion is wrong, you’re certainly not going to be happy about the sale of tissue from aborted fetuses.

Nonetheless, it’s a common practice, and one that’s critical for a lot of medical research. What’s more, it’s only done if the mother wants the tissue donated.

So: scandal? Not hardly. Is it wrong? If you think abortion is murder, then of course you think it’s wrong. If you think abortion is morally benign, as I do, then you’re glad to see donated tissue being used in important medical research. And that’s pretty much that. In the end, this is just another sad attempt at a sting video that goes nowhere once you get beyond the deceptive editing. It’s time for conservatives to find a different toy to manufacture fundraising opportunities for their base.

Tennessee Voters Just Made It Easier to Restrict Abortion—And the GOP Isn’t Wasting Any Time.

For years, as lawmakers in other conservative states passed onerous restrictions designed to limit abortion access, deep-red Tennessee stood out as an exception—because the state’s constitution forbade many of the harshest anti-abortion measures.

But that changed on Election Day. Last week, 53 percent of Tennessee voters approved Amendment 1—a change to the state’s constitution that will allow lawmakers to pass a slew of new abortion restrictions. And Republicans, led by Beth Harwell, the speaker of the state house of representatives, are already working on three abortion restrictions to debate in 2015: One measure would set up a mandatory waiting period between a woman’s first visit to an abortion clinic and the time of the procedure. A second would force women to undergo mandatory counseling, known as informed consent, before an abortion. And a third would add new, unspecified inspection requirements for abortion facilities.

As I reported in September, Amendment 1 was aimed at overturning a 2000 court decision that struck down a 48-hour waiting period, an “informed consent” law, and a requirement that all second-trimester abortions be performed in a hospital. Amendment 1 reads: “Nothing in this Constitution secures or protects a right to abortion or requires the funding of an abortion,” including for pregnancies “resulting from rape or incest or when necessary to save the life of the mother.”

Supporters of Amendment 1 argued that the new language was necessary because Tennessee was barred from inspecting abortion clinics. (In fact, the Tennessee Department of Health inspected several of the state’s clinics within the past year before renewing their licenses.)

Amendment 1 detractors, on the other hand, warned that the measure was actually aimed at using strict new regulations to close some of Tennessee’s seven abortion clinics. This tactic is popular with Tennessee’s neighbors. It’s part of why nearly 1 in 4 women who receive an abortion in Tennessee live in another state, such as Alabama and Mississippi, where highly restrictive abortion laws have closed all but a handful of abortion providers.

Abortion rights advocates also worried that the amendment would allow abortion opponents to spread misinformation about abortion through an informed consent law; South Dakota, for example, compels doctors to tell women that abortion can lead to an increased risk of suicide—an assertion that mainstream medical organizations say is false. All told, both camps poured $5.5 million into the fight over Amendment 1.

It’s not as though Tennessee was abortion-friendly to begin with. Before Amendment 1 came along, Tennessee passed anti-abortion laws that limited insurance coverage for abortion, outlawed the abortion pill, and caused two abortion clinics to close because they could not gain admitting privileges with local hospitals.

The real danger of Amendment 1 is that the measure “will basically just open the floodgates for the General Assembly to pass any kind of restriction if the amendment passes,” Jeff Teague, the president of Planned Parenthood of Middle and East Tennessee, said in the run-up to the election. “We think they probably have a long list of things they’re going to pass.”

Turns out he was spot-on.

WATCH: Front-Runner in GOP Senate Primary Says Planned Parenthood Wants to Kill Newborns

According to North Carolina GOP Senate candidate Greg Brannon, Planned Parenthood has a secret plan to legalize the killing of newborn babies as old as three months. Brannon, a Rand Paul-backed obstetrician who is a front-runner for the GOP nomination, made the allegations at a November fundraiser for Hand of Hope, a chain of crisis pregnancy centers he operates in North Carolina.

Well how far will it go? Last year, February 29, 2012, the Journal of Ethics in Australia, they debated that. They said we already know abortion is fine, why stop in the womb? Why not three months after. Why should we end the responsibility at that point? It could happen in America. Florida’s trying to do it right now and so is Georgia. Planned Parenthood. Because we allowed that slippery slope. Every human being deserves life, liberty, and property.

Brannon’s statement appears to be based on testimony given last year by a lobbyist for the Florida Alliance of Planned Parenthood Affiliates. Asked how the organization’s physicians would respond if a baby were born alive during an abortion, the lobbyist appeared confused and said she’d have to check. But in a follow-up statement, Barbara Zdravecky, CEO of Planned Parenthood of Southwest and Central Florida, unambiguously rejected the notion: “In the extremely unlikely event that the scenario presented by the legislators ever happened, of course Planned Parenthood would provide appropriate care to both the woman and the infant.”

“These absurd and patently false claims by Greg Brannon demonstrate just how extreme and out of touch he is when it comes to women’s health issues—and the rest of the Republican Senate candidates in North Carolina are just as dangerous,” Planned Parenthood Action Fund Executive Vice President Dawn Laguens said in a statement. Brannon’s campaign did not respond to request for clarification.

In the same speech, Brannon said women get abortions because of the same nihilistic worldview that causes them to believe in evolution. “We have people who believe they evolve from nothing, they came from nothing, they’ll go to nothing, and today doesn’t matter, so when they have a mistake, why not move on?,” he said.

The most recent survey of the race, from Public Policy Polling, showed Brannon tied with Thom Tillis, the speaker of the state house of representatives, for the Republican nomination—and running even with Sen. Kay Hagan (R-N.C.) in a hypothetical November matchup.

12 Horror Stories Show Why Wednesday’s Big Supreme Court Abortion Case Matters

Liam Lowney does not talk about his sister, Shannon Elizabeth Lowney, without first gushing about her personality. She was bright and intelligent, a talented student and passionate musician with an “infectious smile,” he says. Only then will he discuss how she died: On December 30, 1994, as she worked the front desk at a Planned Parenthood clinic in Brookline, Massachusetts, a man named John C. Salvi entered and riddled her face with bullets.

On Wednesday, the Supreme Court will hear arguments in McCullen v. Coakley, a case in which anti-abortion-rights activists are challenging a Massachusetts law—passed partially in response to Lowney’s murder—that bans protests within 35 feet of an entrance to an abortion clinic. The petitioners claim the law violates their First Amendment rights. Eleanor McCullen, the lead challenger, is a septuagenarian grandmother whose refrigerator is barely visible beneath all the baby photos that she says were sent to her by women she encountered outside clinics and persuaded not to proceed with an abortion.

But Massachusetts’s buffer zone was not created in response to peaceful protesters like those waged by McCullen and others. It was written in response to people like Salvi and those protesters who have used physical force to block women from obtaining abortions. Even after Republican Gov. Paul Cellucci signed a modest buffer zone into law in 2000, Massachusetts’s abortion clinics were swamped by protesters who physically barred women from entering. Yet lawyers for McCullen aren’t merely asking the court to strike down the extended 35-foot buffer zone, which Massachusetts established in 2007; they are asking the justices to ban all buffer zones outside abortion clinics.

Attorneys for the ACLU, which filed a friend-of-the-court brief in the case, concede that buffer zones do impinge on free speech, but they contend this is necessary to protect the competing constitutional right to obtain an abortion. To prove that point, the ACLU compiled police reports, oral testimonies, and written statements that describe how difficult it had become in Massachusetts to obtain or provide an abortion before the 35-foot buffer zone was implemented in 2007. The following excerpts offer a glimpse of the pandemonium that often reigned outside Massachusetts’s clinics before this law was enacted.

Gail Kaplan, a patient escort at the Boston Planned Parenthood clinic, speaking to the Massachusetts Legislature in 2007:

The protestors are moving closer and closer to the main door. They scream and block the way for the patients to get into the clinic. We fill out police reports almost every week regarding the way they encroach upon the door, but nothing has changed…They’re getting so close that patients are terrified to even walk into the clinic.

I have often been spit upon while escorting a patient into the clinic since they got so close to me while shouting their protests…When it rains, they bring these huge umbrellas and try to knock the escorts out of the way.

Michael T. Baniukiewicz, head of security for Planned Parenthood facilities in Massachusetts, in a sworn 2007 affidavit:

I have observed two regular protesters standing by the PPLM-Boston garage entrance in Boston Police hats and jerseys…I saw them wearing Brookline Police hats and jerseys while standing near the entrance to the parking lot in front of Women’s Health Services.

They carried clipboards and had patients write on clipboards. These patients appeared to be frightened and upset when they learned that they were not police. Patients informed me that they had provided their names, addresses, and telephone numbers.

Baniukiewicz, in a 2007 deposition:

They place four of their protesters, especially on Saturdays, right on the curbstone of the buffer zone, so when people try to park there to let a patient out, they can’t get out.

The safety issue is scary…The protesters will look to start a fight, and obviously that’s keeping people from entering the building.
