How Zero-Tolerance Policing Pits Poor Against Poor

As a graduate student in sociology at the University of California-Los Angeles, Forrest Stuart embarked on a stint of what one might call immersive urban ethnography. Now an assistant professor at the University of Chicago, he was interested in how America’s most desperate people—homeless, addicts, parolees—went about trying to start over. “I had worked with prisoner advocacy groups and in minimum-security prisons,” he told Mother Jones. “I’d meet guys who would be released at five am with no food, no nothing. If I were one of those guys, maybe just a guy who needed food, or an addict who hadn’t had any treatment in prison, I would do whatever I had to do to survive—and maybe that would mean something illegal.”

Forrest had heard that the 50-block section of Los Angeles known as Skid Row was among the most impoverished and heavily policed locations in America—the “ground zero,” as he puts it, of the bootstrap story—so he went there. “I started by sitting in the courtyards, standing on the corners, hoping that people would strike up conversations. I started selling loose cigarettes, and people finally began talking to me.”

Five years of field research resulted in Stuart’s new book, Down, Out and Under Arrest: Policing and Everyday Life in Skid Row. The excerpt below was adapted from the book, which is out this week from University of Chicago Press. Also, don’t miss this eye-opening chat with the author.

Jackson moved with his typical nervous energy as he set up his “sidewalk shop” on the corner of Fifth and San Pedro Streets. The late afternoon light gave a sense of urgency to his motions as he unloaded his wares from his battered shopping cart onto the worn blue tarp he spread across the sidewalk. Six dented cans of chili, a bundle of women’s cosmetics, a stack of college textbooks. The scavenged inventory looked remarkably similar to those of the three other street vendors who had set up only feet away. He grabbed a splintered broom that hung from the chain-link fence behind him and began to sweep cigarette butts, soiled paper napkins, and other small debris into tight piles. He squatted low to better grip the broom’s broken stub of a handle, muttering in annoyance as passing pedestrians disrupted his tidying.

Jackson’s complaints grew audible as he glanced up from his task and noticed that a group of four visibly drunk men had assembled on the corner, pulling tall cans of Old English malt liquor out of brown paper bags. Jackson jogged in their direction, veering slightly from his path to tug on the shirt of another vendor, a clean-shaven, bald man named Larry, who followed without question.

“Hey y’all,” Jackson said forcefully as he pushed his way through the perimeter of the group. “You go a get your drink on somewhere else, you hear? Y’all can’t be partying over here.”

While startled, the men appeared undeterred. Jackson was hardly an intimidating guy; his high-pitched voice matched his five-foot-five-inch frame. One of the men swallowed a mouthful of malt liquor, teetered slightly, and leaned in to offer a slurred response. Just as the words formed on his lips, however, Larry’s deep voice suddenly boomed from above. Standing almost a foot taller than Jackson and outweighing him by at least a hundred pounds, Larry stared down at the group through his dark sunglasses.

“Time to leave, fellas, and I’m only gonna tell you once. I’m really not playing, so don’t test your luck.”

Silence.

The four men exchanged defeated looks with bloodshot eyes. Putting up no further fight, they rewrapped their cans in brown paper bags and vacated the corner. Hands on his hips, Jackson watched with satisfaction as the four staggered their way up San Pedro Street.

I spent roughly two and a half years alongside Jackson, Larry, and 14 other street vendors as they conducted business along Fifth Street, one of Skid Row’s main thoroughfares. These men devoted their time on the block to far more than simply hawking their wares. Tidying the sidewalk, quelling arguments, and, most notably, intercepting alcohol and drug consumption, the men maintained a vigilant system of informal social control.

Since the 1990s, American cities have embraced aggressive zero-tolerance policing policies. Police officers fan out across the country’s poorest minority neighborhoods to detain and search pedestrians, and to issue citations and make arrests for things as trivial as jaywalking, blocking the sidewalk, and loitering. An overlooked effect of these policies: Residents often feel pressured to step outside of their routine activities to regulate the actions of their fellow citizens before the police arrive on the scene and make matters worse. In Skid Row this “third-party policing” now extends all the way down, so to speak, forcing even onlookers and pedestrians to become accountable for the behaviors of others.

Before moving into Skid Row, Jackson spent much of his adult life employed as a machinist in LA’s once-booming aerospace sector. But for decades, Southern California was losing aerospace jobs, and plenty of the region’s semiskilled black workers bore the brunt. Facing a string of downsizings, layoffs, and evictions, Jackson and his wife Leticia reluctantly moved into a dilapidated SRO hotel room on Skid Row’s western border.

“That’s when we got into crack,” Jackson recounted matter-of-factly one afternoon as we shared a basket of fries in a noisy downtown diner. While the couple had frequented bars after work and occasionally smoked marijuana on the weekends, they didn’t try harder drugs until they moved into Skid Row. “At that place, you got people knocking at your door at all times of the day. It’s easy to fall into it.” To pay for their mounting habit, Jackson began peddling “knickknacks” he scavenged from downtown alleyways.

Jackson was at the height of his addiction, smoking crack at least once a day, when he and I first met. I sold cigarettes nearby, but eventually Jackson invited me to set up shop next to his tarp and volunteered to “show me the ropes.” He insisted that it would be mutually beneficial: When pedestrians stopped to buy my cigarettes they might be enticed to buy one of his products, and vice versa. And so our partnership began.

Throughout my time on the corner, I marveled at the rigorous order the vendors maintained along the sidewalk. Of all the nearby activities they stepped in to regulate, none received a more concerted reproach than drug-related behavior. The vendors had become a powerful example of what urbanist Jane Jacobs famously called “eyes on the street.” One afternoon, Jackson was sifting through a mound of wrinkled clothes in his baby stroller. I noticed that a small glass crack pipe had slid out of the pocket of a jacket that had been resting atop the other items. Keith, a round black vendor whom I had only met minutes earlier, saw me staring at the pipe and called Jackson over in a quiet voice: “You know you can’t have that out here,” he reprimanded in a hushed tone, gesturing behind Jackson toward the pipe. “Ain’t no room for that out here.” For the past year, Keith had tried to help Jackson get clean. He occasionally held onto Jackson’s cash while they worked and constantly forbade him from “mixing business with pleasure.”

As Keith lectured on, Jackson finally noticed the pipe. “Aw, shit,” he said, clearly ashamed. He tried to reassure Keith. “I know, I know, I know. It’s just, yeah, okay…I’ll take care of it right now. Don’t you worry. I got this.”

Jackson quickly walked back to the stroller, where he put on the jacket, shoved the pipe back in the pocket, and turned to me. “I go a run home real quick,” he said. “Watch my stuff.” Before I had a chance to respond, Jackson started walking in the direction of his SRO. He returned a half hour later without his jacket and, I assumed, without the pipe. Thus began a regular pattern in which Jackson would “run home” to “talk to Leticia” or “check on something” most days. In the lead-up to excusing himself, Jackson tended to grow irritable toward me and his fellow vendors and customers. He always returned noticeably energized, talkative.

But in a few months Jackson began to curb his addiction, and I realized that returning to the corner meant that he had to leave his stash and pipe back home. It meant that he was able to separate himself, if only for the duration of the day, from the dealers and addicts he complained were fixtures at his SRO building. It meant surrounding himself with vendors who not only demanded abstinence on the job, but who stepped in at the first glimpse of drug paraphernalia.

As conflicted as I felt about possibly enabling his addiction, I also realized that holding Jackson’s place on the corner also helped maintain his exposure to what Princeton sociologist Mitchell Duneier, in his ethnography of street vendors in New York’s City’s Greenwich Village, calls the “rehabilitative forces of the sidewalk.” According to Duneier, vending allows even the most impoverished, addicted, and otherwise defeatist individuals the opportunity to “become innovators—earning a living, striving for self-respect, establishing good relations with fellow citizens, providing support for each other.”

On the other hand, what people are really trying to do is avoid the police. And that means that support and community and providing for each other can only go so far. Fearing harmful and potentially deadly police encounters, the vendors acted like surrogate cops. Although they sometimes protected certain of their peers from detrimental police encounters, they mercilessly punished others for attracting too much law enforcement attention. Knowing that the cops tend to target homeless people, addicts, and idle groups of “suspicious looking” pedestrians, the vendors took it upon themselves to forcibly purge these people from the vicinity. Their attempts to cool off the block ended up exposing fellow Skid Row denizens to even more miseries. As if zero-tolerance policing hadn’t done enough harm, the vendors had introduced their own brand of anxiety, fear, violence, and marginalization.

Leticia spent very little time on the corner. When she did stop by to bring Jackson lunch or money or to pass along a message, she seldom stayed longer than a brief conversation. But that changed. Jackson had been arrested a few months back while trying to steal textbooks from the bookstore at a nearby community college. For this crime, he served just over 90 days in county jail, where he suffered debilitating withdrawal symptoms. But by the end of his sentence he had sobered up.

When he got out, Jackson was determined to get his and Leticia’s lives back on track. Without the income provided by his hustles, Leticia was unable to pay the rent on their SRO room and building management had forcibly removed her from the unit and marked their rental history with the note “abandonment”—a stain that would make it even harder for them to secure housing in the future. With nowhere to turn, Leticia followed her addiction out into Skid Row’s streets. At first, Jackson couldn’t find her. He spent a month scouring the neighborhood, spending a few hours a day scraping together cash on the corner. Finally, he heard from friends that Leticia had been spotted at the Union Rescue Mission. He was overjoyed to reunite with his partner of 17 years, and the two became inseparable.

His fellow vendors, however, were less than enthusiastic about the reunion. Their discontent came to a head one afternoon. Larry, Craig, and Terrance had all set up their shops a noticeable distance from Jackson’s. “What are you looking at?” Craig called out as Jackson glanced their way.

“Not much, apparently,” Jackson shot back, avoiding eye contact.

“What’s that, little man?” Terrance yelled. “Did you say something?”

Jackson turned his back on the two. “These assholes,” he said under his breath.

“What’s going on?” I whispered.

“They’re just being assholes,” Jackson replied, trying to appear unconcerned. “They’re pissed off that I got Leticia out here helping me out, trying to say she’s the reason we all got tickets a couple days back.”

Over Jackson’s shoulder, I saw Craig walking toward us, with Terrance in tow. “You talking more shit? You got something to say to my face?” Craig peered down at Jackson, fists clenched.

I tried my best to intervene. “It’s all good, man. Nobody’s talking shit. It’s all good.”

“No, man,” he scolded me. “It ain’t all good. This little nigga’s fucking it up for every one of us. He knows he can’t have her hanging around all damn day.” Craig turned back to address Jackson. “We told you that last time. Or don’t you remember?”

Jackson stood tall. “I can have anybody I…”

Craig’s fist caught Jackson mid-sentence, thudding into his stomach. Jackson buckled over. Leticia ran to his side. Craig took a step back and turned toward me, as though expecting me to attack. Instead, I froze, at a loss.

Craig continued to lecture, almost reluctantly, as if surprised at his own punch. “I done warned you. I’m done playing with y’all. You need to take this bitch and dip.”

“Who you calling bitch?” Leticia screamed, taking a step toward Craig, raising her fist.

Jackson grabbed her other arm, pulling her back. “Naw, baby.”

Craig stood staring at us for a moment, then turned away. He and Terrance walked back to their shops. I reached down and began gathering Jackson’s inventory and loading it back into his duffel bag. Leticia helped me as Jackson propped himself against the fence, catching his breath. The three of us headed toward their friend’s SRO room, where the couple had been spending their nights, sleeping on the floor. This was a violation of the building’s rules, but Leticia had been barred from the mission for showing up high.

I pieced together the motive for Craig’s attack as Leticia ranted for two blocks. She flailed one arm in explanation, keeping the other arm tight around Jackson’s waist as she huddled close to his body. This was, apparently, precisely the kind of behavior that had been catching the officers’ attention. Over the course of the previous week, Leticia and Jackson had been detained twice while they stood on Fifth Street.

“We was just standing here minding our own business,” Leticia complained, “when two of them came up and asked me if I was ‘working.’ At first I didn’t know what they meant. I thought they was asking if I needed a job or something. But then I realized these assholes was asking if I was trickin’! I said, ‘This is my husband right here.’ But they didn’t even believe me. They made us take out our IDs and show them we had the same last name. Then they asked us if we were on probation or parole, if we had any warrants on us. Just for standing here talking. After all that, they still told me to take off.”

“Not before they wrote us all up,” Jackson added. “Craig too.” Jackson’s sobriety made him seem reserved next to Leticia’s constant fidgeting.

We arrived at the SRO building, where Leticia ran inside to use the bathroom and Jackson and I leaned against the wall. “Those guys really fucked me,” he said after a short lapse in the conversation. He gazed out at the street, deep in thought. “I mean, I know she makes it harder for me, and for them. I understand. But I don’t have a choice, man. That’s my wife.” His voice quieted. “Next week, I’m fucked.”

“Why? What’s up?” I asked. “It’s Mother’s Day,” he replied.

“Mother’s Day already happened.”â&#128;¨

“No. The other Mother’s Day. That’s what they call it when the checks come in. The GR General Relief checks. Her pick-up date’s on the fourth, but I can’t leave her alone at all that week. Last time she damn near smoked up her whole check before I could get her to give me her money. And she fought me on it. When I got out, she was using even worse. I can’t make her stop completely. She ain’t strong enough to go cold turkey like me. It kills me, man. That’s my wife. That’s the mother of my child.”

He sighed, and continued. “I go a make sure she don’t kill herself, or up and disappear or something. We’re broke, Forrest. How am I supposed to keep my wife alive and keep saving enough money to get a place? We can’t be in the mission no more!”

I offered what I assumed to be the most obvious solution. “Dude, why don’t you just move? Set up somewhere else and then you don’t have to worry about Craig or anybody.”

“Yeah, I’m gonna have to. That’s the only way I can have her out there with me. But that was the first place all my regular customers go when they get paid. Nobody wants to go nowhere else for movies ’cause they don’t wanna spend their money on a disc that don’t work. Ain’t no refunds and returns in this business.” Jackson sometimes proved to his customers that a DVD was good by previewing it on one of the other men’s portable DVD players—one of the resources they readily shared. “Customers don’t wanna take a risk on a movie that don’t work. That means I go a sell them for less. Probably half price! That three-dollar movie I got is gonna end up going for a buck, if I’m lucky.”

The two of us stood in silence. We both understood Jackson’s predicament. Returning to Fifth Street would require leaving Leticia unsupervised. Abandoning Fifth Street to support his wife through her recovery would immediately reduce the couple’s already meager income. This would mean they wouldn’t be able to move off the streets and into their own room for the foreseeable future. As research on homelessness consistently demonstrates, Jackson’s chances of keeping Leticia (and himself) away from crack and crack-addicted peers would be extremely low if the two couldn’t find housing.

Down on Skid Row, the intensification of policing does more than just crack down on minor neighborhood problems and disturbances. It alters the equation that determines how residents view each other—and whom they consider a problem or disturbance in the first place. When they act on these views, they sometimes end up hurting the most marginalized among them—people desperate for help. With hyper-policing, neighbors may help keep a watch on crime and bad behavior, do so to the detriment of the larger community. We get eyes on the street, but they’re not the kind of eyes we want.

A week after the altercation with Craig, I stood with Jackson and his wife on Seventh Street, on the opposite side of Skid Row. I watched as he sold one of his DVDs at half price, just as he had predicted. He turned to me, defeat in his eyes. “You wanna know what living in Skid Row’s really like?” he asked, referring back to our very first conversation more than a year earlier. “Trying to make a living down here, getting done the way Craig and those guys did me, you know what it’s like? It’s like hustling backward.”

Here’s what the new Never Trump contender has to say about climate change

After searching for a miracle to save the Republican Party from a nominee straight out of the bowels of reality television, Republicans have one more desperate scheme in mind.

Prominent conservatives, including Mitt Romney and “Never Trump” Weekly Standard editor Bill Kristol, have reportedly floated a relatively unknown figure for a third-party run — the National Review writer and constitutional lawyer David French. An Iraq war veteran, French has only teased us on whether he will enter the race. He’s yet to announce anything formally.

We may not have much information about French’s intentions, but we do know where he stands on climate change, based on his writing and Twitter feed:

He’s not convinced climate change is caused by humans. 

“Could humans be causing global warming? Maybe. Is the globe actually warming?  Maybe.  Can we do anything about it? I have no idea. Should we enact sweeping economic and cultural reforms to address a crisis that may or may not exist and that we may or may not be able to influence when those same reforms won’t also be enacted by China, India, or virtually any other emerging economy?”

He thinks America should stop leading by example, and race to the bottom on environmental regulations.

“The Left doesn’t seriously dispute the notion that American regulations aren’t going to save the planet, but they justify the demand for American sacrifice by essentially ascribing a mystical power to our national policies — as if our decision to fall on our own sword will so move India and China and the rest of the developing world (which has a lot of fossil fuels left to burn to lift its people out of poverty) that they’ll essentially have their own “come to Jesus” movement in defiance of national interest and centuries of national political culture. “America leads,” they proclaim.”

He has sharp commentary on SUVs.

For him, climate science advocacy is like screaming about “demon rum.”

“In reality, I respect the wild-eyed rapture-pastors far more than the climate hysterics. They merely ask me to believe, they don’t use the power of government to dictate how I live…. They’re like a drunk preacher screaming about the evils of demon rum.”

He’s a big fan of Titanic.

But hey, let’s look on the bright side — at least he’s not saying China hatched climate change as a hoax.

Universal Health Care Is Probably No More Popular Now Than It’s Ever Been

Harold Pollack says that Bernie Sanders has started a political revolution:

Not enough of one to win the Democratic presidential nomination, but enough to put the dream of single-payer health care back on the national political agenda in a way few would have expected five years ago….Just this week, Gallup released a poll indicating that “58% of U.S. adults favor the idea of replacing the Affordable Care Act with a federally funded healthcare system that provides insurance for all Americans.” Politico Magazine reports that Sanders’s health plan “is the most popular of the three remaining candidates.”

I’d be thrilled about this if it were true, but I have my doubts. The problem is that Americans have a long history of supporting things in the abstract but not so much when they become concrete partisan proposals. Take Obamacare. In 2013, a CNBC poll showed 37 percent unfavorability toward the “Affordable Care Act,” but 46 percent toward “Obamacare.” In 2014, a Morning Consult poll showed 71 percent support for offering Medicaid to all adults under the poverty line, but only 62 percent support for expanding Medicaid “as encouraged under the Affordable Care Act.” A Marist poll in Kentucky showed 57 percent disapproval of Obamacare but only 22 percent disapproval of kynect—Kentucky’s version of Obamacare. And of course, we have years of polling showing that lots of people like nearly all the individual elements of Obamacare, but then turn around and insist that they hate Obamacare itself.

As for universal health care, a Harris poll last September found 63 percent approval. A Kaiser poll in December found 58 percent support for Medicare-for-all. Gallup polls going back 15 years show higher support for government guarantees of health care during the Bush years than they do now.

So color me skeptical that Bernie Sanders has really had much effect on the health care debate. Gallup’s poll last week didn’t so much as breathe the word “taxes,” and if it did, support for the universal health care option would sink like a stone. Americans have long had mixed feeling about universal health care, and those feelings are deeply tied up in partisan attitudes and willingness to pay. Unfortunately, Sanders doesn’t seem to have moved the needle on this at all.

White Nationalist Party Claims More of Its Members Are Now Trump Delegates

On May 10, Los Angeles attorney William Johnson resigned as a delegate for Donald Trump to the Republican National Convention after Mother Jones reported that Johnson is the leader of the white nationalist American Freedom Party. The Trump campaign, which selected Johnson as one of its California delegates, blamed his inclusion on a “database error.” But white nationalist leaders, including one who has contributed to an online hate forum, are now claiming that other members of their movement have become delegates for Trump.

“Here is what they don’t know: we have more delegates!” the American Freedom Party wrote on its Facebook page last week, in response to the Mother Jones report.

Johnson said in an interview that he is not directly involved with the AFP’s Facebook page, but he confirmed that the page is run by Robert H. DePasquale, whose covert activism as a white supremacist is well documented. According to the Southern Poverty Law Center, DePasquale is a web designer in New York City who has built sites for white supremacist groups and has pseudonymously posted more than 20,000 racist and anti-Semitic messages on Stormfront, a leading online hate forum. (The forum’s motto is “White Pride World Wide.”) DePasquale did not respond to requests for comment. The AFP’s Facebook post, captured by Mother Jones in this screen shot, was soon deleted:

The AFP has come to see the Trump campaign as its path to taking white nationalism into the mainstream. In recent months the group and a related super PAC have produced and funded pro-Trump robocalls, set up a “political harassment hotline” for Trump supporters, and promoted Trump on a talk radio show.

But movement leaders appear torn about how much to shout from atop the Trump bandwagon versus staying in the shadows. Johnson told Mother Jones that he knows of at least one other AFP member who has been selected by a state party to attend the GOP convention this July. Johnson declined to identify the person for fear of compromising the person’s involvement with the GOP, but he disclosed that he is an “honorary” delegate for Trump from an eastern state. So-called honorary delegates do not have voting power, but typically are selected by state parties to attend the convention, often as a perk in exchange for political donations.

At Johnson’s request, the AFP delegate for Trump agreed to be interviewed by Mother Jones, but later backed out. Johnson said there are additional white nationalist Trump delegates who have been in touch with movement leaders, though “I don’t actually know who they are. There are people who are surreptitious,” he said.

“Right now people are still a little bit afraid because they will have the same reaction that happened to me,” Johnson explained. “We just have to give it a few more months before people feel comfortable.”

The Trump campaign did not respond to a request for comment.

Led by Johnson since 2009, the American Freedom Party “exists to represent the political interests of White Americans” and aims to preserve “the customs and heritage of the European American people.” The AFP has never elected a candidate of its own to public office and is estimated to have only a few thousand members, but it is “arguably the most important white nationalist group in the country,” according to the Southern Poverty Law Center’s Mark Potok.

Johnson believes that Trump’s rise will motivate other white nationalists to express their views publicly. “You’ve got to realize that I’m out in the open and upfront, but a lot of people aren’t there yet,” he said. “Talk to me in eight months and more people will be out. Particularly if Donald Trump gets elected.”

Oxfam: Poultry Industry Routinely Denies Workers Bathroom Breaks

The United States isn’t exactly a hotbed of trade unionism and worker power. But presumably, most people can take for granted access to the bathroom while on the job. Not so for people who staff the nation’s chicken slaughterhouses, according to a scathing new report from Oxfam America.

After a three-year project interviewing dozens of current and former workers across the country, Oxfam came to this stark conclusion:

Routinely, poultry workers say, they are denied breaks to use the bathroom. Supervisors mock their needs and ignore their requests; they threaten punishment or firing. Workers wait inordinately long times (an hour or more), then race to accomplish the task within a certain timeframe (e.g., ten minutes) or risk discipline.

How do they deal with this brutal state of affairs? “They urinate and defecate while standing on the line; they wear diapers to work; they restrict intake of liquids and fluids to dangerous degrees; they endure pain and discomfort while they worry about their health and job security,” the report adds.

Given that the industry produces what’s by far America’s favorite meat and employs more than 375,000 people, this might sound like a startling state of affairs that will inspire swift federal action. As the Oxfam report notes, “Denial of regular access to the bathroom is a clear violation of US workplace safety law.”

But Big Poultry’s bathroom trouble has been known for a while. For a 2013 report, the Southern Poverty Law Center surveyed Alabama poultry workers on the conditions they face. Findings included heightened levels of repetitive-motion injuries, routine cuts and gashes—and the lack of bathroom breaks. “Of the 266 workers answering questions about bathroom breaks, nearly eight in 10 (79 percent) said they are not allowed to take breaks when needed,” SPLC found. The group noted many of the same conditions flagged by Oxfam, including workers “stripping off their gear while running to the restroom,” on floors that are often “slippery with fat, blood, water, and other liquids.”

Also in 2013, SPLC attorney Tom Fritzsche delivered those findings in testimony before the Inter-American Commission on Human Rights (part of the Organization of American States), noting (video here).

The Oxfam report, too, puts the speed of the modern industrial kill line—the maximum under US law IS 140 birds per minute—at the heart of the problem. “Supervisors deny requests to use the bathroom because they are under pressure to maintain the speed of the processing line, and to keep up production,” the report states. “Once a poultry plant roars to a start at the beginning of the day, it doesn’t stop until all the chickens are processed.”

To keep the line rolling and give workers breaks when they need them is possible, Oxfam found, but that requires resources: maintaining a “set of replacement workers (line assistants or floaters) who step in as needed.” Yet “in the course of hundreds of interviews, only a handful of workers reported that their bathroom needs are respected,” the report found. Interestingly, “These exceptions are primarily in plants that have unions, which offer important protections, inform workers of their rights, and ensure they have a voice on the job.”

For its part, the chicken industry says the claims made by Oxfam are exaggerated. “The health, safety and respect of our employees is very important, and we value their contributions in helping to produce our food,” the National Chicken Council claimed in an online statement. “We’re troubled by these claims but also question this group’s efforts to paint the whole industry with a broad brush based on a handful of anonymous claims. We believe such instances are extremely rare and that U.S. poultry companies work hard to prevent them.”

A number of companies are named in the report, including Perdue, the nation’s fourth-largest poultry company and the subject of my recent feature on the industry’s move away from reliance on antibiotics. “The anecdotes reported are not consistent with Perdue’s policies and practices,” the company states in a response to the Oxfam report. The company went on to describe its policy:

Regarding bathroom breaks, our associates receive two 30-minutes breaks during each eight-hour shift. They typically work 2 to 2½ hours, have a 30-minute break, work another 2 to 2½ hours and have another 30-minute break, then work the remainder of the shift. If an associate is unable to wait for the scheduled break and needs to use the restroom, they are to be given permission to leave the line as soon as someone can cover for them. If a department is short-staffed that day, there may be times it is difficult to provide immediate coverage.

Thus are the challenges of operating a kill line that requires workers to break down as many as 140 birds per minute. For years, the industry promoted a US Department of Agriculture proposal that would have allowed line speeds to go as high as 175 birds per minute. After a firestorm of criticism from worker-rights and food-safety groups, the USDA shelved that plan in 2014. But, Oxfam America’s Oliver Gottfried tells me, the USDA left the door open to allow it in the future—and Congressional Republicans have been itching ever since to make it so.

Paul Ryan Says He Regrets Calling the Poor “Takers.” That Isn’t Enough.

Here is Speaker Paul Ryan today in an address to a group of House interns:

Instead of playing to your anxieties, we can appeal to your aspirations….We don’t resort to scaring you, we dare to inspire you….We question each other’s ideas—vigorously—but we don’t question each other’s motives….People with different ideas are not traitors. They are not our enemies. They are our neighbors, our coworkers, our fellow citizens.

….I’m certainly not going to stand here and tell you I have always met this standard. There was a time when I would talk about a difference between “makers” and “takers” in our country, referring to people who accepted government benefits. But as I spent more time listening, and really learning the root causes of poverty, I realized I was wrong….So I stopped thinking about it that way—and talking about it that way.

The obvious pushback is that while Ryan may have stopped talking about “makers and takers,” his policies are exactly the same as they’ve always been. After all that time spent listening, he changed his rhetoric but apparently none of his substantive views.

Which is true enough. If all Ryan is doing is telling a bunch of interns that they can get more done if they watch their language and hide their true intentions, then there’s nothing much to applaud here. At the same time, it’s still good to say this stuff out loud, regardless of how sincere it is. Not many people do anymore. Now, how about doing it again in front of a more important audience and with a few explicit references to Donald Trump thrown in?

When presidential candidate Bernie Sanders talks about income inequality, and when other candidates speak about the minimum wage and food stamps, what are they really talking about?

Whether they know it or not, it’s something like this.

My Working Life Then

A few years ago, I wrote about my experience enmeshed in the minimum-wage economy, chronicling the collapse of good people who could not earn enough money, often working 60-plus hours a week at multiple jobs, to feed their families. I saw that, in this country, people trying to make ends meet in such a fashion still had to resort to food benefit programs and charity. I saw an employee fired for stealing lunches from the break room refrigerator to feed himself. I watched as a co-worker secretly brought her two kids into the store and left them to wander alone for hours because she couldn’t afford childcare. (As it happens, 29 percent of low-wage employees are single parents.)

At that point, having worked at the State Department for 24 years, I had been booted out for being a whistleblower. I wasn’t sure what would happen to me next and so took a series of minimum wage jobs. Finding myself plunged into the low-wage economy was a sobering, even frightening, experience that made me realize just how ignorant I had been about the lives of the people who rang me up at stores or served me food in restaurants. Though millions of adults work for minimum wage, until I did it myself I knew nothing about what that involved, which meant I knew next to nothing about twenty-first-century America.

I was lucky. I didn’t become one of those millions of people trapped as the “working poor.” I made it out. But with all the election talk about the economy, I decided it was time to go back and take another look at where I had been, and where too many others still are.

My Working Life Now

I found things were pretty much the same in 2016 as they were in 2012, which meant—because there was no real improvement—that things were actually worse.

This time around, I worked for a month and a half at a national retail chain in New York City. While mine was hardly a scientific experiment, I’d be willing to bet an hour of my minimum-wage salary ($9 before taxes) that what follows is pretty typical of the New Economy.

Just getting hired wasn’t easy for this 56-year-old guy. To become a sales clerk, peddling items that were generally well under $50 a pop, I needed two previous employment references and I had to pass a credit check. Unlike some low-wage jobs, a mandatory drug test wasn’t part of the process, but there was a criminal background check and I was told drug offenses would disqualify me. I was given an exam twice, by two different managers, designed to see how I’d respond to various customer situations. In other words, anyone without some education, good English, a decent work history, and a clean record wouldn’t even qualify for minimum-wage money at this chain.

And believe me, I earned that money. Any shift under six hours involved only a 15-minute break (which cost the company just $2.25). Trust me, at my age, after hours standing, I needed that break and I wasn’t even the oldest or least fit employee. After six hours, you did get a 45-minute break, but were only paid for 15 minutes of it.

The hardest part of the job remained dealing with… well, some of you. Customers felt entitled to raise their voices, use profanity, and commit Trumpian acts of rudeness toward my fellow employees and me. Most of our “valued guests” would never act that way in other public situations or with their own coworkers, no less friends. But inside that store, shoppers seemed to interpret “the customer is always right” to mean that they could do any damn thing they wished. It often felt as if we were penned animals who could be poked with a stick for sport, and without penalty. No matter what was said or done, store management tolerated no response from us other than a smile and a “Yes, sir” (or ma’am).

The store showed no more mercy in its treatment of workers than did the customers. My schedule, for instance, changed constantly. There was simply no way to plan things more than a week in advance. (Forget accepting a party invitation. I’m talking about childcare and medical appointments.) If you were on the closing shift, you stayed until the manager agreed that the store was clean enough for you to go home. You never quite knew when work was going to be over and no cell phone calls were allowed to alert babysitters of any delay.

And keep in mind that I was lucky. I was holding down only one job in one store. Most of my fellow workers were trying to juggle two or three jobs, each with constantly changing schedules, in order to stitch together something like a half-decent paycheck.

In New York City, that store was required to give us sick leave only after we’d worked there for a full year—and that was generous compared to practices in many other locales. Until then, you either went to work sick or stayed home unpaid. Unlike New York, most states do not require such a store to offer any sick leave, ever, to employees who work less than 40 hours a week. Think about that the next time your waitress coughs.

Minimum Wages and Minimum Hours

Much is said these days about raising the minimum wage (and it should be raised), and indeed, on January 1, 2016, 13 states did raise theirs. But what sounds like good news is unlikely to have much effect on the working poor.

In New York, for instance, the minimum went from $8.75 an hour to the $9.00 I was making. New York is relatively generous. The current federal minimum wage is $7.25 and 21 states require only that federal standard. Presumably to prove some grim point or other, Georgia and Wyoming officially mandate an even lower minimum wage and then unofficially require the payment of $7.25 to avoid Department of Labor penalties. Some Southern states set no basement figure, presumably for similar reasons.

Don’t forget: any minimum wage figure mentioned is before taxes. Brackets vary, but let’s knock an even 10 percent off that hourly wage just as a reasonable guess about what is taken out of a minimum-wage worker’s salary. And there are expenses to consider, too. My round-trip bus fare every day, for instance, was $5.50. That meant I worked most of my first hour for bus fare and taxes. Keep in mind that some workers have to pay for childcare as well, which means that it’s not impossible to imagine a scenario in which someone could actually come close to losing money by going to work for short shifts at minimum wage.

In addition to the fundamental problem of simply not paying people enough, there’s the additional problem of not giving them enough hours to work. The two unfortunately go together, which means that raising the minimum rate is only part of any solution to improving life in the low-wage world.

At the store where I worked for minimum wage a few years ago, for instance, hours were capped at 39 a week. The company did that as a way to avoid providing the benefits that would kick in once one became a “full time” employee. Things have changed since 2012—and not for the better.

Four years later, the hours of most minimum-wage workers are capped at 29. That’s the threshold after which most companies with 50 or more employees are required to pay into the Affordable Care Act (Obamacare) fund on behalf of their workers. Of course, some minimum wage workers get fewer than 29 hours for reasons specific to the businesses they work for.

It’s Math Time

While a lot of numbers follow, remember that they all add up to a picture of how people around us are living every day.

In New York, under the old minimum wage system, $8.75 multiplied by 39 hours equaled $341.25 a week before taxes. Under the new minimum wage, $9.00 times 29 hours equals $261 a week. At a cap of 29 hours, the minimum wage would have to be raised to $11.77 just to get many workers back to the same level of take-home pay that I got in 2012, given the drop in hours due to the Affordable Care Act. Health insurance is important, but so is food.

In other words, a rise in the minimum wage is only half the battle; employees need enough hours of work to make a living.

About food: if a minimum wage worker in New York manages to work two jobs (to reach 40 hours a week) without missing any days due to illness, his or her yearly salary would be $18,720. In other words, it would fall well below the Federal Poverty Line of $21,775. That’s food stamp territory. To get above the poverty line with a 40-hour week, the minimum wage would need to go above $10. At 29 hours a week, it would need to make it to $15 an hour. Right now, the highest minimum wage at a state level is in the District of Columbia at $11.50. As of now, no state is slated to go higher than that before 2018. (Some cities do set their own higher minimum wages.)

So add it up: The idea of raising the minimum wage (“the fight for $15“) is great, but even with that $15 in such hours-restrictive circumstances, you can’t make a loaf of bread out of a small handful of crumbs. In short, no matter how you do the math, it’s nearly impossible to feed yourself, never mind a family, on the minimum wage. It’s like being trapped on an M.C. Escher staircase.

The federal minimum wage hit its high point in 1968 at $8.54 in today’s dollars and while this country has been a paradise in the ensuing decades for what we now call the “One Percent,” it’s been downhill for low-wage workers ever since. In fact, since it was last raised in 2009 at the federal level to $7.25 per hour, the minimum has lost about 8.1 percent of its purchasing power to inflation. In other words, minimum-wage workers actually make less now than they did in 1968, when most of them were probably kids earning pocket money and not adults feeding their own children.

In adjusted dollars, the minimum wage peaked when the Beatles were still together and the Vietnam War raged.

Who Pays?

Many of the arguments against raising the minimum wage focus on the possibility that doing so would put small businesses in the red. This is disingenuous indeed, since 20 mega-companies dominate the minimum-wage world. Walmart alone employs 1.4 million minimum-wage workers; Yum Brands (Taco Bell, Pizza Hut, KFC) is in second place; and McDonald’s takes third. Overall, 60 percent of minimum-wage workers are employed by businesses not officially considered “small” by government standards, and of course carve-outs for really small businesses are possible, as was done with Obamacare.

Keep in mind that not raising wages costs you money.

Those minimum wage workers who can’t make enough and need to go on food assistance? Well, Walmart isn’t paying for those food stamps (now called SNAP), you are. The annual bill that states and the federal government foot for working families making poverty-level wages is $153 billion. A single Walmart Supercenter costs taxpayers between $904,542 and $1.75 million per year in public assistance money. According to Florida Congressman Alan Grayson, in many states Walmart employees are the largest group of Medicaid recipients. They are also the single biggest group of food stamp recipients. In other words, those everyday low prices at the chain are, in part, subsidized by your tax money. Meanwhile, an estimated 18 percent of food stamps (SNAP) are spent at Walmart.

If the minimum wage goes up, will spending on food benefits programs go down? Almost certainly. But won’t stores raise prices to compensate for the extra money they will be shelling out for wages? Possibly. But don’t worry—raising the minimum wage to $15 an hour would mean a Big Mac would cost all of 17 cents more.

Time Theft

My retail job ended a little earlier than I had planned, because I committed time theft.

You probably don’t even know what time theft is. It may sound like something from a sci-fi novel, but minimum-wage employers take time theft seriously. The basic idea is simple enough: if they’re paying you, you’d better be working. While the concept is not invalid per se, the way it’s used by the mega-companies reveals much about how the lowest wage workers are seen by their employers in 2016.

The problem at my chain store was that its in-store cafe was a lot closer to my work area than the time clock where I had to punch out whenever I was going on a scheduled break. One day, when break time on my shift came around, I only had 15 minutes. So I decided to walk over to that cafe, order a cup of coffee, and then head for the place where I could punch out and sit down (on a different floor at the other end of the store).

We’re talking an extra minute or two, no more, but in such operations every minute is tabulated and accounted for. As it happened, a manager saw me and stepped in to tell the cafe clerk to cancel my order. Then, in front of whoever happened to be around, she accused me of committing time theft —that is, of ordering on the clock. We’re talking about the time it takes to say, “Grande, milk, no sugar, please.” But no matter, and getting chastised on company time was considered part of the job, so the five minutes we stood there counted as paid work.

At $9 an hour, my per-minute pay rate was 15 cents, which meant that I had time-stolen perhaps 30 cents. I was, that is, being nickel and dimed to death.

Economics Is About People

It seems wrong in a society as wealthy as ours that a person working full-time can’t get above the poverty line. It seems no less wrong that someone who is willing to work for the lowest wage legally payable must also give up so much of his or her self-respect and dignity as a kind of tariff. Holding a job should not be a test of how to manage life as one of the working poor.

I didn’t actually get fired for my time theft. Instead, I quit on the spot. Whatever the price is for my sense of self-worth, it isn’t 30 cents. Unlike most of this country’s working poor, I could afford to make such a decision. My life didn’t depend on it. When the manager told a handful of my coworkers watching the scene to get back to work, they did. They couldn’t afford not to.

The current rate of poverty among the elderly is 9.8 percent, compared to 15.7 percent for those under age 65. But what about the future? The Social Security Administration projects that poverty rates will continue to decline for the elderly. About 7 percent of depression babies, who started retiring in 1990, currently live in poverty, compared to a forecast of 5.7 percent for Gen Xers, who will begin retiring in 2030. However, these averages hide some stark differences:

Not all groups are expected to do so well. Among high school dropouts, poverty rates are projected to increase from 13.5 percent to 24.9 percent…before declining to 18 percent for GenXers….Given the projected increase in minorities and immigrants, as well as the historic increase in women’s labor force participation, retirees with low labor force attachment are increasingly low-educated, low-skilled, and disabled. Not surprisingly, those retirees are projected to have very high poverty rates.

By 2030, SSA forecasts that poverty will be all but eradicated for every income group except one: the very poorest. This is unsurprising but nonetheless far-reaching in its policy implications: If you are poor during your working career you will continue to be poor when you retire. If not, then not. Our retirement programs should be set accordingly.

Weekend Follow-Up #1: Welfare Reform and Deep Poverty

I’d forgotten about this even though I wrote about it two years ago, but here’s yet another chart about “deep poverty”:

In this case, deep poverty is defined as households with income under 50 percent of the poverty line (about $10,000 for a family of three). The calculation is based on more accurate measures of poverty that have since been endorsed by the Census Bureau.

Now, this is a different measure of poverty than the one used by Kathryn Edin and Luke Shaefer that I noted yesterday. Their measure is both tighter (looking at even lower poverty rates) and looser (it counts households that are in extreme poverty even for short times). So it’s not entirely an apples-to-apples comparison. Still, once you look at the historical numbers, it doesn’t look like the 1996 welfare reform act slowed down the growth of welfare spending, nor did it have more than a very small effect on deep poverty.

None of this is especially meant to defend welfare reform. But 20 years later, it doesn’t look like it really had quite the catastrophic impact that a lot of people were afraid of at the time.
