You can’t get more serious about protecting the people from their government than the Fifth Amendment to the Constitution, specifically in its most critical clause: “No person shall be… deprived of life, liberty, or property, without due process of law.” In 2011, the White House ordered the drone-killing of American citizen Anwar al-Awlaki without trial. It claimed this was a legal act it is prepared to repeat as necessary. Given the Fifth Amendment, how exactly was this justified? Thanks to a much contested, recently released but significantly redacted—about one-third of the text is missing—Justice Department white paper providing the basis for that extrajudicial killing, we finally know: the president in Post-Constitutional America is now officially judge, jury, and executioner.

Due Process in Constitutional America

Looking back on the violations of justice that characterized British rule in pre-Constitutional America, it is easy to see the Founders’ intent in creating the Fifth Amendment. A government’s ability to inflict harm on its people, whether by taking their lives, imprisoning them, or confiscating their property, was to be checked by due process.

Due process is the only requirement of government that is stated twice in the Constitution, signaling its importance. The Fifth Amendment imposed the due process requirement on the federal government, while the Fourteenth Amendment did the same for the states. Both offer a crucial promise to the people that fair procedures will remain available to challenge government actions. The broader concept of due process goes all the way back to the thirteenth-century Magna Carta.

Due process, as refined over the years by the Supreme Court, came to take two forms in Constitutional America. The first was procedural due process: people threatened by government actions that might potentially take away life, liberty, or possessions would have the right to defend themselves from a power that sought, whether for good reasons or bad, to deprive them of something important. American citizens were guaranteed their proverbial “day in court.”

The second type, substantive due process, was codified in 1938 to protect those rights so fundamental that they are implicit in liberty itself, even when not spelled out explicitly in the Constitution. Had the concept been in place at the time, a ready example would have been slavery. Though not specifically prohibited by the Constitution, it was on its face an affront to democracy. No court process could possibly have made slavery fair. The same held, for instance, for the “right” to an education, to have children, and so forth. Substantive due process is often invoked by supporters of same-sex unions, who assert that there is a fundamental right to marry. The meaning is crystal clear: there is an inherent, moral sense of “due process” applicable to government actions against any citizen and it cannot be done away with legally. Any law that attempts to interfere with such rights is inherently unconstitutional.

* Seventy-three years ago, on February 17, 1941, as a second devastating global war approached, Henry Luce, the publisher of Time and Life magazines, called on his countrymen to “create the first great American Century.” Luce died in 1967 at age 69. Life, the pictorial magazine no home would have been without in my 1950s childhood, ceased to exist as a weekly in 1972 and as a monthly in 2000; Time, which launched his career as a media mogul, is still wobbling on, a shadow of its former self. No one today could claim that this is Time‘s century, or the American Century, or perhaps anyone else’s. Even the greatest empires now seem to have shortened lifespans. The Soviet Century, after all, barely lasted seven decades. Of course, only the rarest among us live to be 100, which means that at 70, like Time, I’m undoubtedly beginning to wobble, too.

* The other day I sat down with an old friend, a law professor who started telling me about his students. What he said aged me instantly. They’re so young, he pointed out, that their parents didn’t even come of age during the Vietnam War. For them, he added, that war is what World War I was to us. He might as well have mentioned the Mongol conquests or the War of the Roses. We’re talking about the white-haired guys riding in the open cars in Veteran’s Day parades when I was a boy. And now, it seems, I’m them.

* In March 1976, accompanied by two friends, my wife and I got married at City Hall in San Francisco, and then adjourned to a Chinese restaurant for a dim sum lunch. If, while I was settling our bill of perhaps $30, you had told me that, almost half a century in the future, marriage would be an annual $40 billion dollar business, that official couplings would be preceded by elaborate bachelor and bachelorette parties, and that there would be such a thing as destination weddings, I would have assumed you were clueless about the future. On that score at least, the nature of the world to come was self-evident and elaborate weddings of any sort weren’t going to be part of it.

For Americans, it was like the news from nowhere. Years had passed since reporters bothered to head for the country we invaded and blew a hole through back in 2003, the country once known as Iraq that our occupation drove into a never-ending sectarian nightmare. In 2011, the last US combat troops slipped out of the country, their heads “held high,” as President Obama proclaimed at the time, and Iraq ceased to be news for Americans.

So the headlines of recent weeks—Iraq Army collapses! Iraq’s second largest city falls to insurgents! Terrorist Caliphate established in Middle East!—couldn’t have seemed more shockingly out of the blue. Suddenly, reporters flooded back in, the Bush-era neocons who had planned and supported the invasion and occupation were writing op-eds as if it were yesterday, and Iraq was again the story of the moment as the post-post-mortems began to appear and commentators began asking: How in the world could this be happening?

America has entered its third great era: the post-constitutional one. In the first, in the colonial years, a unitary executive, the King of England, ruled without checks and balances, allowing no freedom of speech, due process, or privacy when it came to protecting his power.

In the second, the principles of the Enlightenment and an armed rebellion were used to push back the king’s abuses. The result was a new country and a new constitution with a Bill of Rights expressly meant to check the government’s power. Now, we are wading into the shallow waters of a third era, a time when that government is abandoning the basic ideas that saw our nation through centuries of challenges far more daunting than terrorism. Those ideas—enshrined in the Bill of Rights—are disarmingly concise. Think of them as the haiku of a genuine people’s government.

Deeper, darker waters lie ahead and we seem drawn down into them. For here there be monsters.

The Powers of a Police State Denied

America in its pre-constitutional days may seem eerily familiar even to casual readers of current events. We lived then under the control of a king. (Think now: the imperial presidency.) That king was a powerful, unitary executive who ruled at a distance. His goal was simple: to use his power over his American colonies to draw the maximum financial gain while suppressing any dissent that might endanger his control.

In those years, protest was dangerous. Speech could indeed make you the enemy of the government. Journalism could be a crime if you didn’t write in support of those in power. A citizen needed to watch what he said, for there were spies everywhere, including fellow colonists hoping for a few crumbs from the king’s table. Laws could be brutal and punishments swift as well as extra-judicial. In extreme cases, troops shot down those simply assembling to speak out.

How Egypt’s Generals Sidelined Washington

Since September 11, 2001, Washington’s policies in the Middle East have proven a grim imperial comedy of errors and increasingly a spectacle of how a superpower is sidelined. In this drama, barely noticed by the American media, Uncle Sam’s keystone ally in the Arab world, Egypt, like Saudi Arabia, has largely turned its back on the Obama administration. As with so many of America’s former client states across the aptly named “arc of instability,” Egypt has undergone a tumultuous journey—from autocracy to democracy to a regurgitated form of military rule and repression, making its ally of four decades appear clueless.

Egypt remains one of the top recipients of US foreign aid, with the Pentagon continuing to pamper the Egyptian military with advanced jet fighters, helicopters, missiles, and tanks. Between January 2011 and May 2014, Egypt underwent a democratic revolution, powered by a popular movement, which toppled President Hosni Mubarak’s regime. It enjoyed a brief tryst with democracy before suffering an anti-democratic counter-revolution by its generals. In all of this, what has been the input of the planet’s last superpower in shaping the history of the most populous country in the strategic Middle East? Zilch. Its “generosity” toward Cairo notwithstanding, Washington has been reduced to the role of a helpless bystander.

Given how long the United States has been Egypt’s critical supporter, the State Department and Pentagon bureaucracies should have built up a storehouse of understanding as to what makes the Land of the Pharaohs tick. Their failure to do so, coupled with a striking lack of familiarity by two administrations with the country’s recent history, has led to America’s humiliating sidelining in Egypt. It’s a story that has yet to be pieced together, although it’s indicative of how from Kabul to Bonn, Baghdad to Rio de Janeiro so many ruling elites no longer feel that listening to Washington is a must.

An Army as Immovable as the Pyramids

Ever since 1952, when a group of nationalist military officers ended the pro-British monarchy, Egypt’s army has been in the driver’s seat. From Gamal Abdul Nasser to Hosni Mubarak, its rulers were military commanders. And if, in February 2011, a majority of the members of the Supreme Council of the Armed Forces (SCAF) abandoned Mubarak, it was only to stop him from passing the presidency on to his son Gamal on his 83rd birthday. The neoliberal policies pursued by the Mubarak government at the behest of that businessman son from 2004 onward made SCAF fear that the military’s stake in the public sector of the economy and its extensive public-private partnerships would be doomed.

Fattened on the patronage of successive military presidents, Egypt’s military-industrial complex had grown enormously. Its contribution to the gross domestic product (GDP), though a state secret, could be as high as 40 percent, unparalleled in the region. The chief executives of 55 of Egypt’s largest companies, contributing a third of that GDP, are former generals.

Working with the interior ministry, which controls the national police force, paramilitary units, and the civilian intelligence agencies, SCAF (headed by General Abdel Fattah el-Sisi, doubling as the defense minister) would later orchestrate the protest movement against popularly elected President Muhammad Morsi of the Muslim Brotherhood. That campaign reached its crescendo on June 30, 2013. Three days later, SCAF toppled Morsi and has held him in prison ever since.

The generals carried out their coup at a moment when, according to the Washington-based Pew Research Center, 63 percent of Egyptians had a favorable view of the Muslim Brotherhood, 52 percent approved of the Brotherhood-affiliated Freedom and Justice Party, and 53 percent backed Morsi, who had won the presidency a year earlier with 52 percent of the vote.

Washington Misses the Plot

Remarkably, Obama administration officials failed to grasp that the generals, in conjunction with Interior Minister Muhammad Ibrahim, were the prime movers behind the Tamarod (Arabic for “rebellion”) campaign launched on April 22, 2013. Egyptians were urged to sign a petition addressed to Morsi that was both simplistic and populist. “Because security has not returned, because the poor have no place, because I have no dignity in my own country…,” read the text in part, “we don’t want you anymore,” and it called for an early presidential election. In little over two months, the organizers claimed that they had amassed 22.1 million signatures, amounting to 85 percent of those who had participated in the presidential election of 2012. Where those millions of individually signed petitions were being stored was never made public, nor did any independent organization verify their existence or numbers.

As the Tamarod campaign gained momentum, the interior ministry’s secret police infiltrated it, as did former Mubarak supporters, while elements of the police state of the Mubarak era were revived. Reports that cronies of the toppled president were providing the funding for the campaign began to circulate. The nationwide offices of the Free Egyptians—a party founded by Naguib Sawiria, a businessman close to Mubarak and worth $2.5 billion—were opened to Tamarod organizers. Sawiria also paid for a promotional music video that was played repeatedly on OnTV, a television channel he had founded. In addition, he let his newspaper, Al Masry al Youm, be used as a vehicle for the campaign.

In the run-up to the mass demonstration in Cairo’s iconic Tahrir Square on June 30th, the first anniversary of Morsi’s rule, power cuts became more frequent and fuel shortages acute. As policemen mysteriously disappeared from the streets, the crime rate soared. All of this stoked anti-Morsi feelings and was apparently orchestrated with military precision by those who plotted the coup.

Ben Hubbard and David D. Kirkpatrick of the New York Times provided evidence of meticulous planning, especially by the Interior Ministry, in a report headlined “Sudden Improvements in Egypt Suggest a Campaign to Undermine Morsi.” They quoted Ahmad Nabawi, a Cairo gas station manager, saying that he had heard several explanations for the gas crisis: technical glitches at the storage facilities, the arrival of low quality gas from abroad, and excessive stockpiling by the public. But he put what happened in context this way: “We went to sleep one night, woke up the next day, and the crisis was gone”—and so was Morsi. Unsurprisingly, of all the ministers in the Morsi government, Interior Minister Ibrahim was the only one retained in the interim cabinet appointed by the generals.

“See No Evil”

Initially, President Obama refused to call what had occurred in Egypt a military “coup.” Instead, he spoke vaguely of “military actions” in order to stay on the right side of the Foreign Assistance Act in which Congress forbade foreign aid to “any country whose duly elected head of government is deposed by military coup or decree.”

Within a week of the coup, with Morsi and the first of thousands of Muslim Brotherhood followers thrown behind bars, SCAF sidelined the Tamarod campaigners. They were left complaining that the generals, violating their promise, had not consulted them on the road map to normalization. Having ridden the Tamarod horse to total power, SCAF had no more use for it.

When Morsi supporters staged peaceful sit-ins at two squares in Cairo, the military junta could not bear the sight of tens of thousands of Egyptians quietly defying its arbitrary will. Waiting until the holy fasting month of Ramadan and the three-day festival of Eid ul Fitr had passed, they made their move. On August 14th, Interior Ministry troops massacred nearly 1,000 protesters as they cleared the two sites.

“Our traditional cooperation cannot continue as usual when civilians are being killed in the streets and rights are being rolled back,” said Obama. However, in the end all he did was cancel annual joint military exercises with Egypt scheduled for September and suspend the shipment of four F-16 fighter jets to the Egyptian air force. This mattered little, if at all, to the generals.

The helplessness of Washington before a client state with an economy in freefall was little short of stunning. Pentagon officials, for instance, revealed that since the “ouster of Mr. Morsi,” Defense Secretary Chuck Hagel had had 15 telephone conversations with coup leader General Sisi, pleading with him to “change course”—all in vain.

Five weeks later, the disjuncture between Washington and Cairo became embarrassingly overt. On September 23rd, the Cairo Court for Urgent Matters ordered the 85-year-old Muslim Brotherhood disbanded. In a speech at the U.N. General Assembly the next day, President Obama stated that, in deposing Morsi, the Egyptian military had “responded to the desires of millions of Egyptians who believed the revolution had taken a wrong turn.” He then offered only token criticism, claiming that the new military government had “made decisions inconsistent with inclusive democracy” and that future American support would “depend upon Egypt’s progress in pursuing a more democratic path.”

General Sisi was having none of this. In a newspaper interview on October 9th, he warned that he would not tolerate pressure from Washington “whether through actions or hints.” Already, there had been a sign that Uncle Sam’s mild criticism was being diluted. A day earlier, National Security Council spokeswoman Caitlin Hayden stated that reports that all military assistance to Egypt would be halted were “false.”

In early November, unmistakably pliant words came from Secretary of State John Kerry. “The roadmap to democracy is being carried out to the best of our perception,” he said at a press conference, while standing alongside his Egyptian counterpart Nabil Fahmy during a surprise stopover in Cairo. “There are questions we have here and there about one thing or another, but Foreign Minister Fahmy has reemphasized to me again and again that they have every intent and they are determined to fulfill that particular decision and that democratic track.”

The Generals Axe the Secular, Pro-Democracy Movement

Fahmy and Kerry were looking at that democratic “track” from opposite perspectives. Three weeks later, the military-appointed president, Adly Mansour, approved a new law that virtually outlawed the right to protest. This law gave the interior minister or senior police officials a power that only the judiciary had previously possessed. The minister or his minions could now cancel, postpone, or change the location of protests for which organizers had earlier received the permission of local police. Human Rights groups and secular organizations argued that the 2013 Protest Law was reminiscent of Mubarak’s repressive policies. Washington kept quiet.

Two days later, critics of the law held a demonstration in Cairo that was violently dispersed by the police. Dozens of activists, including the co-founders of the April 6 Youth Movement, Ahmed Maher and Muhammad Adel, seminal actors in the Tahrir Square protests against Mubarak, were arrested. Maher and Adel were each sentenced to three years imprisonment.

Following the coup, the number of prisoners rose exponentially, reaching at least 16,000 within eight months, including nearly 3,000 top or mid-level members of the Brotherhood. (Unofficial estimates put the total figure at 22,000.) When 40 inmates herded into a typical cell in custom-built jails proved insufficient, many Brotherhood members were detained without charges for months in police station lockups or impromptu prisons set up in police training camps where beatings were routine.

The 846 Egyptians who lost their lives in the pro-democracy revolution that ended Mubarak’s authoritarian regime were dwarfed by the nearly 3,000 people killed in a brutal series of crackdowns that followed the coup, according to human rights groups.

The sentencing of the founders of the April 6 Youth Movement—which through its social media campaign had played such a crucial role in sparking anti-Mubarak demonstrations—foreshadowed something far worse. On April 28, 2014, the Cairo Court for Urgent Matters outlawed that secular, pro-democracy movement based on a complaint by a lawyer that it had “tarnished the image” of Egypt and colluded with foreign parties.

With this set of acts, the post-coup regime turned the clock back to Mubarakism—without Mubarak.

Setting the World’s Mass Death-Penalty Record

On that same April day in the southern Egyptian town of Minya, Judge Saeed Elgazar broke his own month-old world death-penalty record of 529 (in a trial that lasting less than an hour) by recommending the death penalty for 683 Egyptians, including Muslim Brotherhood leader Mohammed Badie. The defendants were charged in an August 2013 attack on a police station in Minya, which led to the death of a policeman. Of the accused, 60 percent had not been in Minya on the day of the assault. Defense lawyers were prevented from presenting their case during the two-day trial.

Elgazar was a grotesquely exaggerated example of a judiciary from the Mubarak era that remained unreconciled to the onset of democracy. It proved only too willing to back the military junta in terrorizing those even thinking of protesting the generals’ rule. A US State Department spokesperson called the judge’s first trial “unconscionable.” But as before, the military-backed government in Cairo remained unmoved. The Egyptian Justice Department warned that “comments on judicial verdicts are unacceptable, be they from external or internal parties as they represent a serious transgression against the independence of the judiciary.”

When the second mass sentence came down, Kerry murmured that “there have been disturbing decisions within the judicial process, the court system, that have raised serious challenges for all of us. It’s actions, not words that will make the difference.” A defiant Nabil Fahmy responded by defending the verdicts as having been rendered by an independent judiciary “completely independent from the government.”

One predictable response to the military junta’s brutal squashing of the Brotherhood, which over the previous few decades had committed itself to participating in a multi-party democracy, was the swelling of the ranks of militant jihadist groups. Of these Ansar Bait al Muqdus (“Helpers of Jerusalem”), based in the Sinai Peninsula and linked to al-Qaeda, was the largest. After the coup, it gained new members and its terror attacks spread to the bulk of Egypt west of the Suez Canal.

In late December, a car bomb detonated by its operatives outside police headquarters in the Nile Delta town of Mansoura killed 16 police officers. Blaming the bombing on the Muslim Brotherhood instead, the interim government classified it as a “terrorist organization,” even though Ansar had claimed responsibility for the attack. By pinning the terrorist label on the Brotherhood, the generals gave themselves carte blanche to further intensify their ruthless suppression of it.

While SCAF pursued its relentless anti-Brotherhood crusade and reestablished itself as the ruling power in Egypt, it threw a sop to the Obama administration. It introduced a new constitution, having suspended the previous one drafted by a popularly elected constituent assembly. The generals appointed a handpicked committee of 50 to amend the suspended document. They included only two members of the Islamist groups that had jointly gained two-thirds of the popular vote in Egypt’s first free elections.

Predictably, the resulting document was military-friendly. It stipulated that the defense minister must be a serving military officer and that civilians would be subject to trial in military courts for certain offenses. Banned was the formation of political parties based on religion, race, gender, or geography, and none was allowed to have a paramilitary wing. The document was signed by the interim president in early December. A national referendum on it was held in mid-January under tight security, with 160,000 soldiers and more than 200,000 policemen deployed nationwide. The result: a vote of 98.1 percent in favor. (A referendum on the 2012 constitution during Morsi’s presidency had gained the backing of 64 percent of voters.)

The charade of this exercise seemed to escape policymakers in Washington. Kerry blithely spoke of the SCAF-appointed government committing itself to “a transition process that expands democratic rights and leads to a civilian-led, inclusive government through free and fair elections.”

By this time, the diplomatic and financial support of the oil rich Gulf States ruled by autocratic monarchs was proving crucial to the military regime in Cairo. Immediately after the coup, Saudi Arabia, Kuwait, and the United Arab Emirates (UAE) poured $12 billion into Cairo’s nearly empty coffers. In late January 2014, Saudi Arabia and the UAE came up with an additional $5.8 billion. This helped Sisi brush off any pressure from Washington and monopolize power his way.

The Strongman as Savior

By then, huge photographs and portraits of General Sisi had become a common fixture on the streets in Cairo and other major cities. On January 27th, interim president Mansour promoted Sisi to field marshal. Later that day, SCAF nominated him for the presidency. A slew of stories started appearing in the state-run media as well as most of its privately owned counterparts backing Sisi and touting the benefits of strong military leadership.

Sisi’s original plan to announce his candidacy on February 11th, the third anniversary of Mubarak’s forced resignation, hit an unexpected speed bump. On February 7th, Al Watan, a newspaper supportive of the military regime with longstanding ties to the security establishment, printed an embarrassing front-page story placing Sisi’s worth at 30 million Egyptian pounds ($4.2 million). Within minutes of its being printed, state officials contacted the paper’s owner, Magdy El Galad, demanding its immediate removal. He instantly complied.

Sisi continued to place his henchmen in key positions in the armed forces, including military intelligence. On March 26th, he resigned from the army, declaring himself an independent candidate. Nonetheless, as Alaa Al Aswany, a prominent writer and commentator, revealed, senior military commanders continued to perform important tasks for him. There was nothing faintly fair about such an election, Aswany pointed out. Most other potential candidates for the presidency had reached a similar conclusion—that entering the race was futile. Hamdeen Sabahi, a secular left-of-center politician, was the only exception.

Despite relentless propaganda by state and private media portraying Sisi as the future savior of Egypt, things went badly for him. That he would be crowned as a latter-day Pharaoh was a given. The only unknown was: How many Egyptians would bother to participate in the stage-managed exercise?

The turnout proved so poor on May 26th, the first day of the two-day election, that panic struck the government, which declared the following day a holiday. In addition, the Justice ministry warned that those who failed to vote would be fined. The authorities suspended train fares to encourage voters to head for polling stations. TV anchors and media celebrities scolded and lambasted their fellow citizens for their apathy, while urging them to rush to their local polling booths. Huge speakers mounted on vans patrolling city neighborhoods alternated raucous exhortations to vote with songs of praise for the military. Al Azhar, the highest Islamic authority in the land, declared that to fail to vote was “to disobey the nation.” Pope Tawadros, head of Egypt’s Coptic Christian Church whose members form 10 percent of the population, appeared on state television to urge voters to cast their ballots.

The former field marshal had demanded an 80 percent turnout from the country’s 56 million voters. Yet even with voting extended to a third day and a multifaceted campaign to shore up the numbers, polling stations were reportedly empty across the country. The announced official turnout of 47.5 percent was widely disbelieved. Sabahi described the figure as “an insult to the intelligence of Egyptians.” Sisi was again officially given 96.1 percent of the vote, Sabahi 3 percent. The spokesman for the National Alliance for the Defense of Legitimacy put voter participation at 10 percent-12 percent. The turnout for the first free and fair two-day presidential election, held in June 2012 without endless exhortations by TV anchors and religious leaders, had been 52 percent.

Among the regional and world leaders who telephoned Sisi to congratulate him on his landslide electoral triumph was Russian President Vladimir Putin. No such call has yet come in from President Obama.

For Washington, still so generous in its handouts to the Arab Republic of Egypt and its military, trailing behind the Russian Bear in embracing the latest strongman on the Nile should be considered an unqualified humiliation. With its former sphere of influence in tatters, the last superpower has been decisively sidelined by its key Arab ally in the region.

Who could forget? At the time, in the fall of 2002, there was such a drumbeat of “information” from top figures in the Bush administration about the secret Iraqi program to develop weapons of mass destruction (WMD) and so endanger the United States. And who—other than a few suckers—could have doubted that Saddam Hussein was eventually going to get a nuclear weapon? The only question, as our vice president suggested on “Meet the Press,” was: Would it take one year or five? And he wasn’t alone in his fears, since there was plenty of proof of what was going on. For starters, there were those “specially designed aluminum tubes” that the Iraqi autocrat had ordered as components for centrifuges to enrich uranium in his thriving nuclear weapons program. Reporters Judith Miller and Michael Gordon hit the front page of the New York Times with that story on September 8, 2002.

Then there were those “mushroom clouds” that Condoleezza Rice, our national security advisor, was so publicly worried about—the ones destined to rise over American cities if we didn’t do something to stop Saddam. As she fretted in a CNN interview with Wolf Blitzer on that same September 8th, “We don’t want the smoking gun to be a mushroom cloud.” No, indeed, and nor, it turned out, did Congress!

And just in case you weren’t anxious enough about the looming Iraqi threat, there were those unmanned aerial vehicles—Saddam’s drones!—that could be armed with chemical or biological WMD from his arsenal and flown over America’s East Coast cities with unimaginable results. President George W. Bush went on TV to talk about them and congressional votes were changed in favor of war thanks to hair-raising secret administration briefings about them on Capitol Hill.

In the end, it turned out that Saddam had no weapons program, no nuclear bomb in the offing, no centrifuges for those aluminum pipes, no biological or chemical weapons caches, and no drone aircraft to deliver his nonexistent weapons of mass destruction (nor any ships capable of putting those nonexistent robotic planes in the vicinity of the US coast). But what if he had? Who wanted to take that chance? Not Vice President Dick Cheney, certainly. Inside the Bush administration he propounded something that journalist Ron Suskind later dubbed the “one percent doctrine.” Its essence was this: if there was even a 1 percent chance of an attack on the United States, especially involving weapons of mass destruction, it must be dealt with as if it were a 95 percent-100 percent certainty.

Here’s the curious thing: if you look back on America’s apocalyptic fears of destruction during the first 14 years of this century, they largely involved three city-busting weapons that were fantasies of Washington’s fertile imperial imagination. There was that “bomb” of Saddam’s, which provided part of the pretext for a much-desired invasion of Iraq. There was the “bomb” of the mullahs, the Iranian fundamentalist regime that we’ve just loved to hate ever since they repaid us, in 1979, for the CIA’s overthrow of an elected government in 1953 and the installation of the Shah by taking the staff of the US embassy in Tehran hostage. If you believed the news from Washington and Tel Aviv, the Iranians, too, were perilously close to producing a nuclear weapon or at least repeatedly on the verge of the verge of doing so. The production of that “Iranian bomb” has, for years, been a focus of American policy in the Middle East, the “brink” beyond which war has endlessly loomed. And yet there was and is no Iranian bomb, nor evidence that the Iranians were or are on the verge of producing one.

The Fulbright Program Is the Flagship of American Cultural Diplomacy. So Why Are We Cutting It?

Often it’s the little things coming out of Washington, obscured by the big, scary headlines, that matter most in the long run. Items that scarcely make the news, or fail to attract your attention, or once noticed seem trivial, may carry consequences that endure long after the latest front-page crisis has passed. They may, in fact, signal fundamental changes in Washington’s priorities and policies that could even face opposition, if only we paid attention.

Take the current case of an unprecedented, unkind, under-the-radar cut in the State Department’s budget for the Fulbright Program, the venerable 68-year-old operation that annually arranges for thousands of educators, students, and researchers to be exchanged between the United States and at least 155 other countries. As Washington increasingly comes to rely on the “forward projection” of military force to maintain its global position, the Fulbright Program may be the last vestige of an earlier, more democratic, equitable, and generous America that enjoyed a certain moral and intellectual standing in the world. Yet, long advertised by the US government as “the flagship international educational exchange program” of American cultural diplomacy, it is now in the path of the State Department’s torpedoes.

Right now, all over the world, former Fulbright scholars like me (Norway, 2012) are raising the alarm, trying to persuade Congress to stand by one of its best creations, passed by unanimous bipartisan consent of the Senate and signed into law by President Truman in 1946. Alumni of the Fulbright Program number more than 325,000, including more than 123,000 Americans. Among Fulbright alums are 53 from 13 different countries who have won a Nobel Prize, 28 MacArthur Foundation fellows, 80 winners of the Pulitzer Prize, 29 who have served as the head of state or government, and at least one, lunar geologist Harrison Schmitt (Norway, 1957), who walked on the moon—not to mention the hundreds of thousands who returned to their countries with greater understanding and respect for others and a desire to get along. Check the roster of any institution working for peace around the world and you’re almost certain to find Fulbright alums whose career choices were shaped by international exchange. What’s not to admire about such a program?

Yet the Fulbright budget, which falls under the State Department’s Bureau of Educational and Cultural Affairs (ECA), seems to be on the chopping block. The proposed cut amounts to chump change in Washington, only $30.5 million. But the unexpected reduction from a $234.7 million budget this year to $204.2 million in 2015 represents 13 percent of what Fulbright gets. For such a relatively small-budget program, that’s a big chunk. No one in the know will say just where the cuts are going to fall, but the most likely target could be “old Europe,” and the worldwide result is likely to be a dramatic drop from 8,000 to fewer than 6,000 in the number of applicants who receive the already exceedingly modest grants.

How We’ve Created a Booming Market for Border Security Technology

With the agility of a seasoned Border Patrol veteran, the woman rushed after the students. She caught up with them just before they entered the exhibition hall of the eighth annual Border Security Expo, reaching out and grabbing the nearest of them by the shoulder. Slightly out of breath, she said, “You can’t go in there, give me back your badges.”

The astonished students had barely caught a glimpse of the dazzling pavilion of science-fiction-style products in that exhibition hall at the Phoenix Convention Center. There, just beyond their view, more than 100 companies, including Raytheon, General Dynamics, and Verizon, were trying to sell the latest in futuristic border policing technology to anyone with the money to buy it.

The students from Northeastern Illinois University didn’t happen to fall into that category. An earnest manager at a nearby registration table insisted that, as they were not studying “border security,” they weren’t to be admitted. I asked him how he knew just what they were studying. His only answer was to assure me that next year no students would be allowed in at all.

Among the wonders those students would miss was a fake barrel cactus with a hollow interior (for the southern border) and similarly hollow tree stumps (for the northern border), all capable of being outfitted with surveillance cameras. “Anything that grows or exists in nature,” Kurt Lugwisen of TimberSpy told a local Phoenix television station, “we build it.”

Nor would those students get to see the miniature drone—”eyes in the sky” for Border Patrol agents—that fits conveniently into a backpack and can be deployed at will; nor would they be able to check out the “technology that might,” as one local Phoenix reporter warned, “freak you out.” She was talking about facial recognition systems, which in a border scenario would work this way: a person enters a border-crossing gate, where an image of his or her face is instantly checked against a massive facial image database (or the biometric data contained on a passport).”If we need to target on any specific gender or race because we’re trying to find a subject, we can set the parameters and the threshold to find that person,” Kevin Haskins of Cognitec (“the face recognition company”) proudly claimed.

Nor would they be able to observe the strange, two day-long convention hall dance between homeland security, its pockets bursting with their parents’ tax dollars, and private industry intent on creating the most massive apparatus of exclusion and surveillance that has ever existed along US borders.

Women Still Aren’t Equal in the Online World

The Web is regularly hailed for its “openness” and that’s where the confusion begins, since “open” in no way means “equal.” While the Internet may create space for many voices, it also reflects and often amplifies real-world inequities in striking ways.

An elaborate system organized around hubs and links, the Web has a surprising degree of inequality built into its very architecture. Its traffic, for instance, tends to be distributed according to “power laws,” which follow what’s known as the 80/20 rule–80% of a desirable resource goes to 20% of the population.

In fact, as anyone knows who has followed the histories of Google, Apple, Amazon, and Facebook, now among the biggest companies in the world, the Web is increasingly a winner-take-all, rich-get-richer sort of place, which means the disparate percentages in those power laws are only likely to look uglier over time.

Powerful and exceedingly familiar hierarchies have come to define the digital realm, whether you’re considering its economics or the social world it reflects and represents. Not surprisingly, then, well-off white men are wildly overrepresented both in the tech industry and online.

Just take a look at gender and the Web comes quickly into focus, leaving you with a vivid sense of which direction the Internet is heading in and–small hint–it’s not toward equality or democracy.

Experts, Trolls, and What Your Mom Doesn’t Know

As a start, in the perfectly real world women shoulder a disproportionate share of household and child-rearing responsibilities, leaving them substantially less leisure time to spend online. Though a handful of high-powered celebrity “mommy bloggers” have managed to attract massive audiences and ad revenue by documenting their daily travails, they are the exceptions not the rule. In professional fields like philosophy, law, and science, where blogging has become popular, women are notoriously underrepresented; by one count, for instance, only around 20% of science bloggers are women.

An otherwise optimistic white paper by the British think tank Demos touching on the rise of amateur creativity online reported that white males are far more likely to be “hobbyists with professional standards” than other social groups, while you won’t be shocked to learn that low-income women with dependent children lag far behind. Even among the highly connected college-age set, research reveals a stark divergence in rates of online participation.

Socioeconomic status, race, and gender all play significant roles in a who’s who of the online world, with men considerably more likely to participate than women. “These findings suggest that Internet access may not, in and of itself, level the playing field when it comes to potential pay-offs of being online,” warns Eszter Hargittai, a sociologist at Northwestern University. Put simply, closing the so-called digital divide still leaves a noticeable gap; the more privileged your background, the more likely that you’ll reap the additional benefits of new technologies.

Some of the obstacles to online engagement are psychological, unconscious, and invidious. In a revealing study conducted twice over a span of five years–and yielding the same results both times–Hargittai tested and interviewed 100 Internet users and found that there was no significant variation in their online competency. In terms of sheer ability, the sexes were equal. The difference was in their self-assessments.

It came down to this: The men were certain they did well, while the women were wracked by self-doubt. “Not a single woman among all our female study subjects called herself an ‘expert’ user,” Hargittai noted, “while not a single male ranked himself as a complete novice or ‘not at all skilled.'” As you might imagine, how you think of yourself as an online contributor deeply influences how much you’re likely to contribute online.

The results of Hargittai’s study hardly surprised me. I’ve seen endless female friends be passed over by less talented, more assertive men. I’ve had countless people–older and male, always–assume that someone else must have conducted the interviews for my documentary films, as though a young woman couldn’t have managed such a thing without assistance. Research shows that people routinely underestimate women’s abilities, not least women themselves.

When it comes to specialized technical know-how, women are assumed to be less competent unless they prove otherwise. In tech circles, for example, new gadgets and programs are often introduced as being “so easy your mother or grandmother could use them.” A typical piece in the New York Times was titled “How to Explain Bitcoin to Your Mom.” (Assumedly, dad already gets it.) This kind of sexism leapt directly from the offline world onto the Web and may only have intensified there.

And it gets worse. Racist, sexist, and homophobic harassment or “trolling” has become a depressingly routine aspect of online life.

Many prominent women have spoken up about their experiences being bullied and intimidated online–scenarios that sometimes escalate into the release of private information, including home addresses, e-mail passwords, and social security numbers, or simply devolve into an Internet version of stalking. Esteemed classicist Mary Beard, for example, “received online death threats and menaces of sexual assault” after a television appearance last year, as did British activist Caroline Criado-Perez after she successfully campaigned to get more images of women onto British banknotes.

Young women musicians and writers often find themselves targeted online by men who want to silence them. “The people who were posting comments about me were speculating as to how many abortions I’ve had, and they talked about ‘hate-fucking’ me,” blogger Jill Filipovic told the Guardian after photos of her were uploaded to a vitriolic online forum. Laurie Penny, a young political columnist who has faced similar persecution and recently published an ebook called Cybersexism, touched a nerve by calling a woman’s opinion the “short skirt” of the Internet: “Having one and flaunting it is somehow asking an amorphous mass of almost-entirely male keyboard-bashers to tell you how they’d like to rape, kill, and urinate on you.”

Alas, the trouble doesn’t end there. Women who are increasingly speaking out against harassers are frequently accused of wanting to stifle free speech. Or they are told to “lighten up” and that the harassment, however stressful and upsetting, isn’t real because it’s only happening online, that it’s just “harmless locker-room talk.”

As things currently stand, each woman is left alone to devise a coping mechanism as if her situation were unique. Yet these are never isolated incidents, however venomously personal the insults may be. (One harasser called Beard–and by online standards of hate speech this was mild–”a vile, spiteful excuse for a woman, who eats too much cabbage and has cheese straws for teeth.”)

Indeed, a University of Maryland study strongly suggests just how programmatic such abuse is. Those posting with female usernames, researchers were shocked to discover, received 25 times as many malicious messages as those whose designations were masculine or ambiguous. The findings were so alarming that the authors advised parents to instruct their daughters to use sex-neutral monikers online. “Kids can still exercise plenty of creativity and self-expression without divulging their gender,” a well-meaning professor said, effectively accepting that young girls must hide who they are to participate in digital life.

Over the last few months, a number of black women with substantial social media presences conducted an informal experiment of their own. Fed up with the fire hose of animosity aimed at them, Jamie Nesbitt Golden and others adopted masculine Twitter avatars. Golden replaced her photo with that of a hip, bearded, young white man, though she kept her bio and continued to communicate in her own voice. “The number of snarky, condescending tweets dropped off considerably, and discussions on race and gender were less volatile,” Golden wrote, marveling at how simply changing a photo transformed reactions to her. “Once I went back to Black, it was back to business as usual.”

Old Problems in New Media

Not all discrimination is so overt. A study summarized on the Harvard Business Review website analyzed social patterns on Twitter, where female users actually outnumbered males by 10%. The researchers reported “that an average man is almost twice as likely to follow another man as a woman” while “an average woman is 25% more likely to follow a man than a woman.” The results could not be explained by varying usage since both genders tweeted at the same rate.

Online as off, men are assumed to be more authoritative and credible, and thus deserving of recognition and support. In this way, long-standing disparities are reflected or even magnified on the Internet.

In his 2008 book The Myth of Digital Democracy, Matthew Hindman, a professor of media and public affairs at George Washington University, reports that of the top 10 blogs, only one belonged to a female writer. A wider census of every political blog with an average of over 2,000 visitors a week, or a total of 87 sites, found that only five were run by women, nor were there “identifiable African Americans among the top 30 bloggers,” though there was “one Asian blogger, and one of mixed Latino heritage.” In 2008, Hindman surveyed the blogosphere and found it less diverse than the notoriously whitewashed op-ed pages of print newspapers. Nothing suggests that, in the intervening six years, things have changed for the better.

Welcome to the age of what Julia Carrie Wong has called “old problems in new media,” as the latest well-funded online journalism start-ups continue to be helmed by brand-name bloggers like Ezra Klein and Nate Silver. It is “impossible not to notice that in the Bitcoin rush to revolutionize journalism, the protagonists are almost exclusively–and increasingly–male and white,” Emily Bell lamented in a widely circulated op-ed. It’s not that women and people of color aren’t doing innovative work in reporting and cultural criticism; it’s just that they get passed over by investors and financiers in favor of the familiar.

As Deanna Zandt and others have pointed out, such real-world lack of diversity is also regularly seen on the rosters of technology conferences, even as speakers take the stage to hail a democratic revolution on the Web, while audiences that look just like them cheer. In early 2013, in reaction to the announcement of yet another all-male lineup at a prominent Web gathering, a pledge was posted on the website of the Atlantic asking men to refrain from speaking at events where women are not represented. The list of signatories was almost immediately removed “due to a flood of spam/trolls.” The conference organizer, a successful developer, dismissed the uproar over Twitter. “I don’t feel the need to defend this, but am happy with our process,” he stated. Instituting quotas, he insisted, would be a “discriminatory” way of creating diversity.

This sort of rationalization means technology companies look remarkably like the old ones they aspire to replace: male, pale, and privileged. Consider Instagram, the massively popular photo-sharing and social networking service, which was founded in 2010 but only hired its first female engineer last year. While the percentage of computer and information sciences degrees women earned rose from 14% to 37% between 1970 and 1985, that share had depressingly declined to 18% by 2008.

Those women who do fight their way into the industry often end up leaving–their attrition rate is 56%, or double that of men–and sexism is a big part of what pushes them out. “I no longer touch code because I couldn’t deal with the constant dismissing and undermining of even my most basic work by the ‘brogramming’ gulag I worked for,” wrote one woman in a roundup of answers to the question: Why there are so few female engineers?

In Silicon Valley, Facebook’s Sheryl Sandberg and Yahoo’s Marissa Mayer excepted, the notion of the boy genius prevails. More than 85% of venture capitalists are men generally looking to invest in other men, and women make 49 cents for every dollar their male counterparts rake in–enough to make a woman long for the wage inequities of the non-digital world, where on average they take home a whopping 77 cents on the male dollar. Though 40% of private businesses are women-owned nationwide, only 8% of the venture-backed tech start-ups are.

Established companies are equally segregated. The National Center for Women and Information Technology reports that in the top 100 tech companies, only 6% of chief executives are women. The numbers of Asians who get to the top are comparable, despite the fact that they make up one-third of all Silicon Valley software engineers. In 2010, not even 1% of the founders of Silicon Valley companies were black.

Making Your Way in a Misogynist Culture

What about the online communities that are routinely held up as exemplars of a new, networked, open culture? One might assume from all the “revolutionary” and “disruptive” rhetoric that they, at least, are better than the tech goliaths. Sadly, the data doesn’t reflect the hype. Consider Wikipedia. A survey revealed that women make up less than 15% of the contributors to the site, despite the fact that they use the resource in equal numbers to men.

In a similar vein, collaborative filtering sites like Reddit and Slashdot, heralded by the digerati as the cultural curating mechanisms of the future, cater to users who are up to 87% male and overwhelmingly young, wealthy, and white. Reddit, in particular, has achieved notoriety for its misogynist culture, with threads where rapists have recounted their exploits and photos of underage girls got posted under headings like “Chokeabitch,” “Niggerjailbait,” and “Creepshots.”

Despite being held up as a paragon of political virtue, evidence suggests that as few as 1.5% of open source programmers are women, a number far lower than the computing profession as a whole. In response, analysts have blamed everything from chauvinism, assumptions of inferiority, and outrageous examples of impropriety (including sexual harassment at conferences where programmers gather) to a lack of women mentors and role models. Yet the advocates of open-source production continue to insist that their culture exemplifies a new and ethical social order ruled by principles of equality, inclusivity, freedom, and democracy.

Unfortunately, it turns out that openness, when taken as an absolute, actually aggravates the gender gap. The peculiar brand of libertarianism in vogue within technology circles means a minority of members–a couple of outspoken misogynists, for example–can disproportionately affect the behavior and mood of the group under the cover of free speech. As Joseph Reagle, author of Good Faith Collaboration: The Culture of Wikipedia, points out, women are not supposed to complain about their treatment, but if they leave–that is, essentially are driven from–the community, that’s a decision they alone are responsible for.

“Urban” Planning in a Digital Age

The digital is not some realm distinct from “real” life, which means that the marginalization of women and minorities online cannot be separated from the obstacles they confront offline. Comparatively low rates of digital participation and the discrimination faced by women and minorities within the tech industry matter–and not just because they give the lie to the egalitarian claims of techno-utopians. Such facts and figures underscore the relatively limited experiences and assumptions of the people who design the systems we depend on to use the Internet–a medium that has, after all, become central to nearly every facet of our lives.

In a powerful sense, programmers and the corporate officers who employ them are the new urban planners, shaping the virtual frontier into the spaces we occupy, building the boxes into which we fit our lives, and carving out the routes we travel. The choices they make can segregate us further or create new connections; the algorithms they devise can exclude voices or bring more people into the fold; the interfaces they invent can expand our sense of human possibility or limit it to the already familiar.

What vision of a vibrant, thriving city informs their view? Is it a place that fosters chance encounters or does it favor the predictable? Are the communities they create mixed or gated? Are they full of privately owned shopping malls and sponsored billboards or are there truly public squares? Is privacy respected? Is civic engagement encouraged? What kinds of people live in these places and how are they invited to express themselves? (For example, is trolling encouraged, tolerated, or actively discouraged or blocked?)

No doubt, some will find the idea of engineering online platforms to promote diversity unsettling and–a word with some irony embedded in it–paternalistic, but such criticism ignores the ways online spaces are already contrived with specific outcomes in mind. They are, as a start, designed to serve Silicon Valley venture capitalists, who want a return on investment, as well as advertisers, who want to sell us things. The term “platform,” which implies a smooth surface, misleads us, obscuring the ways technology companies shape our online lives, prioritizing certain purposes over others, certain creators over others, and certain audiences over others.

If equity is something we value, we have to build it into the system, developing structures that encourage fairness, serendipity, deliberation, and diversity through a process of trial and error. The question of how we encourage, or even enforce, diversity in so-called open networks is not easy to answer, and there is no obvious and uncomplicated solution to the problem of online harassment. As a philosophy, openness can easily rationalize its own failure, chalking people’s inability to participate up to choice, and keeping with the myth of the meritocracy, blaming any disparities in audience on a lack of talent or will.

That’s what the techno-optimists would have us believe, dismissing potential solutions as threats to Internet freedom and as forceful interference in a “natural” distribution pattern. The word “natural” is, of course, a mystification, given that technological and social systems are not found growing in a field, nurtured by dirt and sun. They are made by human beings and so can always be changed and improved.

“Up to a few months ago, Ben Suc was a prosperous village of some thirty-five hundred people.” That is the initial line of The Village of Ben Suc, his first book, a copy of which I recently reread on a plane trip, knowing that he was soon to die. That book, that specific copy, had a history of its own. It was a Knopf first edition, published in 1967 in the midst of the Vietnam War, after the then-shocking text had appeared in the New Yorker magazine. An on-the-spot account of an American operation, the largest of the Vietnam War to that moment, it followed American troops as they helicoptered into a village controlled by the enemy about 30 miles from the capital, Saigon. All its inhabitants, other than those killed in the process, were removed from their homes and sent to a makeshift refugee camp elsewhere. The US military then set Ben Suc afire, brought in bulldozers to reduce it to rubble, and finally called in the US Air Force to bomb that rubble to smithereens—as though, as the final line of his book put it, “having once decided to destroy it, we were now bent on annihilating every possible indication that the village of Ben Suc had ever existed.”

I had read the piece in the New Yorker when that magazine devoted a single issue to it, something it had not done since it published John Hersey’s Hiroshima in a similar fashion in 1946. I never forgot it. I was then 23 years old and just launched on a life as an anti-Vietnam War activist. I would not meet the author, 24-year-old neophyte reporter Jonathan Schell, for years.

To look at that first edition some 47 years later is to be reminded of just how young he was then, so young that Knopf thought it appropriate in his nearly nonexistent bio to mention where he went to high school (“the Putney School in Vermont”). The book was tiny. Only 132 pages with an all-print orange cover that, in addition to the author and title, said: “The story of the American destruction of a Vietnamese village—this is the complete text of the brilliant report to which the New Yorker devoted almost an entire issue.” That was bold advertising in those publishing days. I know. As an editor at a publishing house as the 1980s began, I can still remember having a fierce argument about whether or not it was “tasteless” to put a blurb from a prominent person on a book’s cover.
