Trump Is Already Guilty of Aiding Putin’s Attack on America

The Trump-Russia scandal is the subject of multiple investigations that may or may not unearth new revelations, but this much is already certain: Donald Trump is guilty.

We don’t need additional information about the Russian covert scheme to undermine the 2016 campaign, or about the curious interactions between Team Trump and Russia, or about Trump pressuring and then firing FBI Director James Comey, to reach the judgment that the president of the United States engaged in wrongdoing.

From the start, Trump and his crew have claimed they had nothing to do with the hack-and-leak operation mounted by Russian intelligence to help Trump nab the presidency. They have dismissed the matter as fake news, and they have insisted there is no issue because there has been no proof that the Trump campaign conspired with Russia. In May, for instance, Trump proclaimed, “Believe me, there’s no collusion.” Nothing to see; move along.

Explicit collusion may yet be proved by the FBI investigation overseen by special counsel Robert Mueller or by other ongoing probes. But even if it is not, a harsh verdict can be pronounced: Trump actively and enthusiastically aided and abetted Russian President Vladimir Putin’s plot against America. This is the scandal. It already exists—in plain sight.

As soon as the news broke a year ago that the Russians had penetrated the Democratic National Committee’s computer systems, Trump launched a campaign of denial and distraction. For months, he refused to acknowledge the Kremlin’s role. He questioned expert and government findings that pinned the blame on Moscow. He refused to condemn Putin. Far from treating these acts of information warfare seriously, he attempted to politicize and delegitimize the evidence. Meanwhile, he and his supporters encouraged more Russian hacking. All told, Trump provided cover for a foreign government’s attempt to undermine American democracy. Through a propaganda campaign of his own, he helped Russia get away with it. As James Clapper, the former director of national intelligence, testified to Congress this spring, Trump “helps the Russians by obfuscating who was actually responsible.”

On June 15, 2016, the day after the Washington Post reported that the DNC had been hacked and that cybersecurity experts had identified two groups linked to the Russian government as the perps, Trump’s campaign issued a statement blaming the victim: “We believe it was the DNC that did the ‘hacking’ as a way to distract from the many issues facing their deeply flawed candidate and failed party leader.” The intent was obvious: to impede somber consideration of the Russian intervention, to have voters and reporters see it as just another silly political hullabaloo.

In the following weeks, Trump continued to claim the Russia story was fiction. After WikiLeaks dumped nearly 20,000 DNC emails—a move that nearly blew up the Democratic convention—Trump tweeted, “The new joke in town is that Russia leaked the disastrous DNC e-mails, which should never have been written (stupid), because Putin likes me.” Two days later, he proclaimed at a news conference, “Russia, if you’re listening, I hope you’re able to find the 30,000 emails that are missing. I think you will probably be rewarded mightily by our press.” Trump supporters including Rep. Mike Pompeo, who would become Trump’s CIA director, and Roger Stone, the longtime political dirty trickster, cheered on WikiLeaks.

By midsummer, numerous cyber experts had bolstered the conclusion that Russia was behind the hacks. And President Barack Obama echoed those findings. So anyone paying attention to the facts—say, a presidential candidate and his advisers—would have been aware of this fundamental point. Indeed, in August, during his first intelligence briefing as the Republican presidential nominee, Trump was reportedly told that there were direct links between the hacks and the Russian government.

Still, he didn’t change his tune. During a September 8 interview with RT, the Kremlin-controlled broadcaster that has been accused of disseminating fake news and propaganda, Trump discounted the Russian connection: “I think maybe the Democrats are putting that out. Who knows, but I think it’s pretty unlikely.” (Yes, he did this on RT.) He repeated a similar line at the first presidential debate at the end of that month, with his famous reference to how the DNC hacker “could be somebody sitting on their bed that weighs 400 pounds, okay?”

The Spy Who Wrote the Trump-Russia Memos: It Was “Hair-Raising” Stuff

Private experts and US intelligence had already determined that Russia had pulled off this caper. Trump had been told this. Yet he continued to deny Russia’s culpability, actively protecting Moscow.

Many Republicans followed his lead. Trump’s stance—treating a widely shared conclusion as controversial speculation—essentially foreclosed a vigorous and bipartisan response to the Moscow intervention. It is hard to imagine how this did not embolden Russian intelligence and reinforce Putin’s belief that he had backed the right horse.

On October 7, the Department of Homeland Security and the Office of the Director of National Intelligence blew the whistle on Moscow, issuing a statement that the DNC hack and related cyberattacks had been authorized by “Russia’s senior-most officials.” Yet Trump remained on the side of the enemy. That same day, the now notorious grab-them-by-the-pussy video surfaced—and less than an hour after that story broke, WikiLeaks began releasing thousands of stolen emails from John Podesta, the Clinton campaign’s chairman. Trump’s response, at the second presidential debate: “I notice, anytime anything wrong happens, they like to say ‘the Russians.’ Well, Hillary Clinton doesn’t know if it’s the Russians doing the hacking. Maybe there is no hacking.” The next day at a campaign rally, Trump, citing some of the Podesta emails, exclaimed, “I love WikiLeaks!”

What could be better for Putin? The US government had called him out, yet the GOP presidential candidate was discrediting this conclusion. Trump made it tougher for Obama and the White House to denounce Putin publicly—to do so, they feared, would give Trump cause to argue they were trying to rig the election against him.

At the final debate, Clinton accurately summed up Trump’s position: “It’s pretty clear you won’t admit that the Russians have engaged in cyberattacks against the United States of America, that you encouraged espionage against our people.” Trump replied, “Our country has no idea” who pulled off the hacks.

After the election, he maintained this stance. “It’s time for the country to move on,” he said in December. Two weeks later, after the US intelligence establishment released a report concluding Putin had implemented this covert op to install Trump in the White House, the president-elect compared the intelligence community to Nazi Germany. Though he did at one point concede Russia was the culprit, Trump continued calling the Russia story a hoax whipped up by Democrats and eventually reverted to form, asserting that the hacks might have been waged by China or others. And he still showed no signs of confronting Putin. At the Russian leader’s request, he jovially hosted the Russian foreign minister and ambassador in the Oval Office—and then disclosed top-secret information to them. Moreover, he did this the day after brazenly ousting Comey, who was overseeing the bureau’s probe of Moscow’s meddling and links between Trump associates and Russia.

It’s been common for political observers to say the Trump-Russia controversy has generated a great deal of smoke, but the amount of fire is yet to be determined. It’s true that the various links tying Trump and his associates to Russia have yet to be fully explained. Many questions remain: Was there any specific coordination? If not, did the Trump camp privately signal to Moscow that Russia would get a better deal if Trump were elected? That alone would have provided encouragement for Putin to attack.

This country needs a thorough and public investigation to sort out how the Russian operation worked, how US intelligence and the Obama administration responded, and how Trump and his associates interacted with Russia and WikiLeaks. But whatever happened out of public view, the existing record is already conclusively shameful. Trump and his crew were active enablers of Putin’s operation to subvert an American election. That is fire, not smoke. That is scandal enough.

Why Would a President Schmooze With Vicious Autocrats and Repressive Monarchs?

Much outrage has been expressed in recent weeks over President Donald Trump’s White House invitation to Rodrigo Duterte, president of the Philippines, whose “war on drugs” has led to thousands of extrajudicial killings. Criticism of Trump was especially intense given his warm public support for other authoritarian rulers, including Egypt’s Abdel Fatah al-Sisi (who visited the Oval Office amid presidential praise weeks earlier), Turkey’s Recep Tayyip Erdogan (who got a congratulatory phone call from Trump on the recent referendum victory that cemented his powers), and Thailand’s Prayuth Chan-ocha (who also received a White House invitation).

But here’s the strange thing: The critics generally ignored the far more substantial and long-standing support US presidents, Democrat and Republican, have offered to dozens of repressive regimes over the decades. These regimes have one striking thing in common: They are all on an autocratic honor role of at least 45 nations and territories hosting scores of US military bases—from tiny outposts to installations the size of a small city. All told, these bases are home to tens of thousands of US troops.

To ensure basing access, American officials regularly collaborate with regimes and militaries that have been implicated in torture, murder, suppression of democratic rights, systematic oppression of women and minorities, and countless other human rights abuses. Never mind Trump. These collaborations have been the status quo for nearly three-quarters of a century. In fact, since World War II, US administrations have often shown a preference for maintaining bases in undemocratic and/or despotic states—Spain under Generalissimo Francisco Franco, South Korea under Park Chung-hee, Bahrain under King Hamad bin Isa al-Khalifa, and Djibouti under four-term President Ismail Omar Guelleh, to name just a few.

Many of our 45 undemocratic base hosts qualify as fully “authoritarian regimes,” according to a democracy index compiled by the Economist. Which means American installations and the troops stationed there are effectively helping block the spread of democracy in countries like Cameroon, Chad, Ethiopia, Jordan, Kuwait, Niger, Oman, Qatar, Saudi Arabia, and the United Arab Emirates.

This support for dictatorship and repression should trouble any American who believes in the principles of our Constitution and Declaration of Independence. After all, one of the long-articulated justifications for maintaining US military bases abroad has been that our military presence protects and spreads democracy. Far from it, such bases tend to help legitimize and prop up repressive regimes, while often interfering with genuine efforts toward political and democratic reform. The silencing of the critics of human rights abuses in base nations such as Bahrain, which has violently cracked down on pro-democracy demonstrators since 2011, has left the United States complicit.

During the Cold War, such bases were often justified as the unfortunate but necessary consequence of confronting the “communist menace.” Yet in the quarter-century since the Cold War ended, few of those bases have closed. So today, while White House visits from autocrats generates indignation, the presence of American military installations in the same countries receives little notice.

The 45 nations and territories with little or no democratic rule represent more than half the roughly 80 countries now hosting US bases—countries that often lack the power to ask their “guests” to leave. They are part of a historically unprecedented global network of military installations the United States has built or occupied since World War II.

While there are no foreign bases in the United States, we have around 800 bases in foreign countries—almost certainly a record for any nation or empire in history. More than 70 years after World War II and 64 years after the Korean War, there remain, according to the Pentagon, 181 US “base sites” in Germany, 122 in Japan, and 83 in South Korea. Hundreds more dot the planet from Aruba to Australia, Belgium to Bulgaria, Colombia to Qatar. Hundreds of thousands of troops, civilians, and family members occupy these installations. By my conservative estimate, manning and maintaining these installations costs US taxpayers at least $150 billion annually—which is more than the budget of any government agency other than the Pentagon.

For decades, our leaders in Washington have insisted these foreign bases spread American values and democracy—and that may have been true to some extent in occupied Germany, Japan, and Italy after World War II. But as base expert Catherine Lutz suggests, the subsequent historical record shows that “gaining and maintaining access” for our outposts “has often involved close collaboration with despotic governments.”

Consider the Philippines: The United States has maintained military facilities in the archipelago almost continuously since seizing it from Spain in 1898. America only granted the colony independence in 1946, conditioned on the local government’s agreement that the United States would retain access to more than a dozen military installations there.

After independence, a succession of US administrations supported two decades of Ferdinand Marcos’ autocratic rule in the Philippines, ensuring the continued use of Clark Air Base and Subic Bay Naval Base, two of our largest overseas bases. The Filipinos finally ousted Marcos in 1986 and ordered the US military to leave in 1991, but five years later, the Pentagon quietly returned. With the help of a “visiting forces agreement” and a growing stream of military exercises and training programs, it began to set up surreptitious, small-scale bases once more. A desire to solidify this renewed base presence, while also checking Chinese influence in the region, may have driven Trump’s White House invitation to Duterte. It came despite the Filipino president’s record of joking about rape, swearing he would be “happy to slaughter” millions of drug addicts just as “Hitler massacred six million Jews,” and bragging, “I don’t care about human rights.”

In Turkey, President Erdogan’s increasingly autocratic rule is only the latest episode in a pattern of military coups and undemocratic regimes interrupting periods of democracy in Turkey. Since 1943, however, US bases have been a constant presence in the country, where they have repeatedly sparked protest—throughout the 1960s and 1970s, prior to the Bush administration’s 2003 invasion of Iraq, and more recently, when US forces began using them to launch attacks in Syria.

Although Egypt has a relatively small US base presence, its military has enjoyed deep and lucrative Pentagon ties since the signing of the Camp David Accords with Israel in 1979. After a 2013 military coup ousted a democratically elected Muslim Brotherhood government, the Obama administration waited months to withhold some forms of military and economic aid, despite more than 1,300 killings by security forces and the arrest of more than 3,500 members of the Brotherhood. According to Human Rights Watch, “Little was said about ongoing abuses,” which have continued to this day.

The United States also has maintained deep connections with the Thai military, which has carried out 12 coups since 1932. Both countries have been able to deny they have a basing relationship of any sort, thanks to a rental agreement between a private contractor and US forces at Thailand’s Utapao Naval Air Base. “Because of contractor Delta Golf Global,” writes journalist Robert Kaplan, “the US military was here, but it was not here. After all, the Thais did no business with the US Air Force. They dealt only with a private contractor.”

In monarchical Bahrain, which has had a US military presence since 1949 and now hosts the Navy’s 5th Fleet, the Obama administration offered only the most tepid criticism of the Bahraini government despite an ongoing, often violent crackdown on pro-democracy protesters. According to Human Rights Watch and others (including an independent commission of inquiry appointed by the Bahraini king, Hamad bin Isa al-Khalifa), the government has been responsible for widespread abuses, including the arbitrary arrest of protesters, ill treatment during detention, torture-related deaths, and growing restrictions on freedoms of speech, association, and assembly. The Trump administration has already signaled its desire to protect the military ties of the two countries by approving a sale of F-16 fighters to Bahrain without demanding any improvements in its human rights record.

This is typical of what the late base expert Chalmers Johnson once called the American “baseworld.” Research by political scientist Kent Calder confirms what’s come to be known as the “dictatorship hypothesis”: that “the United States tends to support dictators in nations where it enjoys basing facilities.” Another large study concluded that autocratic states have been “consistently attractive” as base sites. “Due to the unpredictability of elections,” it added bluntly, democratic states prove “less attractive in terms of sustainability and duration.”

Even within what are technically US borders, democratic rule has regularly proved “less attractive” than preserving colonialism into the 21st century. The presence of scores of bases in Puerto Rico and the Pacific island of Guam has been a major motivation for keeping these and other territories—American Samoa, the Northern Mariana Islands, and the US Virgin Islands—in varying degrees of colonial subordination. Conveniently for military leaders, they have neither full independence nor the full democratic rights—voting, representation in Congress—that come with US statehood. Installations in at least five of Europe’s remaining colonies have proved equally attractive, as has the base US troops have forcibly occupied in Guantánamo Bay, Cuba, since shortly after the Spanish-American War of 1898.

Authoritarian rulers are well aware of the desire of US officials to maintain the status quo when it comes to bases. As a result, they often capitalize on a base presence to extract benefits or help ensure their own political survival.

The Philippines’ Marcos, former South Korean dictator Syngman Rhee, and more recently Djibouti’s Ismail Omar Guelleh have been typical in the way they used bases to extract economic assistance from Washington, which they then lavished on political allies to shore up their power. Other autocrats have relied on US bases to bolster their international prestige and legitimacy, or to justify violence against political opponents.

After the 1980 Kwangju massacre—in which the South Korean government killed hundreds, if not thousands, of pro-democracy demonstrators, strongman General Chun Doo-hwan explicitly cited the presence of US bases and troops to suggest that he enjoyed Washington’s support. Whether that was true remains a matter of historical debate. What’s clear, though, is that American leaders have regularly muted their criticism of repressive regimes lest they imperil US basing rights. And the US presence tends to strengthen military, rather than civilian, institutions because of military-to-military ties, arms sales, and training missions that generally accompany the basing agreements.

Opponents of repressive regimes often use the bases to rally nationalist sentiment, anger, and protest against their ruling elites and the United States. In some such cases, fears in Washington that a transition to democracy might lead to base eviction leads to a doubling down on support for the undemocratic ruler. The result can be an escalating cycle of opposition and US-backed repression.

While some analysts defend the presence of US bases in undemocratic countries as necessary to deter bad actors and support American interests (primarily corporate ones), backing dictators and autocrats frequently leads to harm—not just for the citizens of the host nations, but for US citizens as well. The base buildup in the Middle East is the most prominent example. In the wake of the 1979 Soviet invasion of Afghanistan and the Iranian Revolution the same year, the Pentagon has built up scores of bases across the Middle East at a cost of tens of billions of dollars. These bases and the troops stationed in them have been a “major catalyst for anti-Americanism and radicalization,” according to former West Point professor Bradley Bowman, who cites research noting a correlation between the bases and Al Qaeda recruitment.

Outposts in Saudi Arabia, Iraq, and Afghanistan have helped generate and fuel the radical militancy that has spread throughout the Greater Middle East and led to terrorist attacks in Europe and the United States. The presence of US bases and troops in Muslim holy lands was a major recruiting tool for Al Qaeda, and part of Osama bin Laden’s professed motivation for the 9/11 attacks.

With the Trump administration seeking to entrench the renewed base presence in the Philippines, and the president commending Duterte and similarly authoritarian leaders in Bahrain and Egypt, Turkey and Thailand, human rights violations worldwide are likely to escalate, fueling unknown brutality and baseworld blowback for years to come.

Why Trump’s Firing of Comey Should Be Investigated

There are multiple investigations of the Trump-Russia scandal underway, including two conducted by the House and Senate intelligence committees, one by a Senate judiciary subcommittee, and one (or more) by the FBI. They cover a range of issues: Vladimir Putin’s secret operation to subvert the 2016 campaign to help Donald Trump win, interactions between Trump associates and Russia, ex-national security adviser Michael Flynn’s contacts with the Russian ambassador (and how the White House handled that controversy, as well as Flynn’s acceptance of foreign payments from Russia and other nations and his other business dealings), and, possibly, the business- and lobbying-related actions of Paul Manafort, who managed Trump’s campaign, and other people close to Trump. Now there is a need for a new investigation that focuses on Trump’s firing of FBI chief James Comey.

This could well be the most serious inquiry of all because it would raise the sensitive issue of impeachment.

When Trump pink-slipped Comey on Tuesday, his Justice Department released a three-page letter with reasons why Comey should be booted. The justifications were all related to how he managed the investigation of Hillary Clinton’s emails at the State Department. The criticisms were familiar and old: Comey had gone too far when he first held a press conference in July to declare the investigation was over but harshly criticized Clinton and then informed Congress days before the election that his agents had revived the investigation to review a newly found cache of Clinton emails (which turned out to hold essentially no new information). Of course, Trump enthusiastically praised Comey for his October surprise, because it dealt Clinton a blow in the final days and conceivably helped Trump win. But now, suddenly, Comey’s conduct in that episode is supposedly the grounds for Trump showing Comey the door.

The initial news reports tell another story. Various insider accounts—yes, based on anonymous sources—indicate that Trump’s firing of Comey was motivated, at least in part, by Trump’s anger over the ongoing Russia investigation. Politico reports:

Trump had grown enraged by the Russia investigation, two advisers said, frustrated by his inability to control the mushrooming narrative around Russia. He repeatedly asked aides why the Russia investigation wouldn’t disappear and demanded they speak out for him. He would sometimes scream at television clips about the probe, one adviser said.

And who was the best target for his anger? Comey.

Last month, Comey appeared before the House intelligence committee, and his testimony put Trump in a bad spot. Comey noted that the FBI had no information to support Trump’s baseless charge that President Barack Obama had wiretapped Trump before the election. He was practically calling Trump a nut or a liar. Then Comey, in an unprecedented move, revealed that the FBI had been investigating interactions between Trump associates and Russia since last July. It was a stunning moment: the FBI chief disclosing his bureau was running an investigation that could lead to his boss, the president. All of this showed the Trump-Russia scandal was still on fire.

Naturally, Trump was enraged. He has dismissed the Russia story as fake news and a hoax. Comey said it was nothing but.

If Trump fired Comey to impede the Russia investigation, he possibly engaged in obstruction of justice. That is a crime. That is a case for impeachment. In fact, the first of the three articles of impeachment filed by the House judiciary committee against Richard Nixon in 1974 was for obstruction of justice. That article listed as one reason for impeachment: “interfering or endeavouring to interfere with the conduct of investigations by the Department of Justice of the United States, the Federal Bureau of Investigation, the office of Watergate Special Prosecution Force, and Congressional Committees.”

Trump certainly appears to have tried to interfere with the Russia investigation by dismissing Comey.

A congressional investigation of Trump’s action is warranted. There are White House and Justice Department officials who can be questioned on this subject. They can be asked how the firing was discussed and handled by administration officials. (Congress might also want to ask Comey about the President’s claim, in his termination letter to the FBI director, that Comey had assured Trump on three occasions that he was not a target of the bureau’s investigation.) There may be documents to subpoena. (One side issue: how could Attorney General Jeff Sessions participate in this decision, as he did, if he recused himself from anything to do with the Russia investigations because he had lied about his own meetings with the Russian ambassador?)

This is not simply a personnel matter. Trump does have the right to fire Comey. But if this was done to smother an investigation, Trump may have violated the law, defending himself and not the Constitution. He knows why he did this—and presumably so do Sessions and assorted White House and Justice Department officials. Congress needs to step in and guarantee for the American public that the president has not abused his power and obstructed justice to protect himself. And there are several committees in the House and Senate that could assume this critical mission. With Trump’s firing of Comey, the Trump-Russia scandal has moved from a tale of a foreign power undermining American democracy to the story of a president possibly doing the same.

Why the Sally Yates Hearing Was Very Bad News for the Trump White House

The much-anticipated Senate hearing on Monday afternoon with former acting attorney general Sally Yates and former director of national intelligence James Clapper confirmed an important point: the Russia story still poses tremendous trouble for President Donald Trump and his crew.

Yates recounted a disturbing tale. She recalled that on January 26, she requested and received a meeting with Don McGahn, Trump’s White House counsel. At the time, Vice President Mike Pence and other White House officials were saying that ret. Lt. Gen. Michael Flynn, Trump’s national security adviser, had not spoken the month before with the Russian ambassador to the United States, Sergey Kislyak, about the sanctions then-President Barack Obama had imposed on the Russians as punishment for Moscow’s meddling in the 2016 presidential campaign. Yates’ Justice Department had evidence—presumably intercepts of Flynn’s communications with Kislyak—that showed this assertion was flat-out false.

At that meeting, Yates shared two pressing concerns with McGahn: that Flynn had lied to the vice president and that Flynn could now be blackmailed by the Russians because they knew he had lied about his conversations with Kislyak. As Yates told the members of the Senate subcommittee on crime and terrorism, “To state the obvious: you don’t want your national security adviser compromised by the Russians.” She and McGahn also discussed whether Flynn had violated any laws.

The next day, McGahn asked Yates to return to the White House, and they had another discussion. According to Yates, McGahn asked whether it would interfere with the FBI’s ongoing investigation of Flynn if the White House took action regarding this matter. No, Yates said she told him. The FBI had already interviewed Flynn. And Yates explained to the senators that she had assumed that the White House would not sit on the information she presented McGahn and do nothing.

But that’s what the White House did. McGahn in that second meeting did ask if the White House could review the evidence the Justice Department had. She agreed to make it available. (Yates testified that she did not know whether this material was ever reviewed by the White House. She was fired at that point because she would not support Trump’s Muslim travel ban.) Whether McGahn examined that evidence about Flynn, the White House did not take action against him. It stood by Flynn. He remained in the job, hiring staff for the National Security Council and participating in key policy decision-making.

On February 9, the Washington Post revealed that Flynn had indeed spoken with Kislyak about the sanctions. And still the Trump White House backed him up. Four days later, Kellyanne Conway, a top Trump White House official, declared that Trump still had “full confidence” in Flynn. The next day—as a media firestorm continued—Trump fired him. Still, the day after he canned Flynn, Trump declared, “Gen. Flynn is a wonderful man. I think he has been treated very, very unfairly by the media, as I call it, the fake media in many cases. And I think it is really a sad thing that he was treated so badly.” Trump displayed no concern about Flynn’s misconduct.

The conclusion from Yates’ testimony was clear: Trump didn’t dump Flynn until the Kislyak matter became a public scandal and embarrassment. The Justice Department warning—hey, your national security adviser could be compromised by the foreign government that just intervened in the American presidential campaign—appeared to have had no impact on Trump’s actions regarding Flynn. Imagine what Republicans would say if a President Hillary Clinton retained as national security adviser a person who could be blackmailed by Moscow.

The subcommittee’s hearing was also inconvenient for Trump and his supporters on another key topic: it destroyed one of their favorite talking points.

On March 5, Clapper was interviewed by NBC News’ Chuck Todd on Meet the Press and asked if there was any evidence of collusion between members of the Trump campaign and the Russians. “Not to my knowledge,” Clapper replied. Since then, Trump and his champions have cited Clapper to say there is no there there with the Russia story. Trump on March 20 tweeted, “James Clapper and others stated that there is no evidence Potus colluded with Russia. The story is FAKE NEWS and everyone knows it!” White House press secretary Sean Spicer has repeatedly deployed this Clapper statement to insist there was no collusion.

At Monday’s hearing, Clapper pulled this rug out from under the White House and its comrades. He noted that it was standard policy for the FBI not to share with him details about ongoing counterintelligence investigations. And he said he had not been aware of the FBI’s investigation of contacts between Trump associates and Russia that FBI director James Comey revealed weeks ago at a House intelligence committee hearing. Consequently, when Clapper told Todd that he was not familiar with any evidence of Trump-Russia collusion, he was speaking accurately. But he essentially told the Senate subcommittee that he was not in a position to know for certain. This piece of spin should now be buried. Trump can no longer hide behind this one Clapper statement.

Clapper also dropped another piece of information disquieting for the Trump camp. Last month, the Guardian reported that British intelligence in late 2015 collected intelligence on suspicious interactions between Trump associates and known or suspected Russian agents and passed this information to to the United States “as part of a routine exchange of information.” Asked about this report, Clapper said it was “accurate.” He added, “The specifics are quite sensitive.” This may well have been the first public confirmation from an intelligence community leader that US intelligence agencies have possessed secret information about ties between Trump’s circle and Moscow. (Comey testified that the FBI’s counterintelligence investigation of links between Trump associates and Russian began in late July 2016.)

So this hearing indicated that the Trump White House protected a national security adviser who lied and who could be compromised by Moscow, that Trump can no longer cite Clapper to claim there was no collusion, and that US intelligence had sensitive information on interactions between Trump associates and possible Russian agents as early as late 2015. Still, most of the Republicans on the panel focused on leaks and “unmasking”—not the main issues at hand. They collectively pounded more on Yates for her action regarding the Muslim travel ban than on Moscow for its covert operation to subvert the 2016 election to help Trump.

This Senate subcommittee, which is chaired by Sen. Lindsey Graham (R-S.C.), is not mounting a full investigation comparable to the inquiry being conducted by the Senate intelligence committee (and presumably the hobbled House intelligence committee). It has far less staff, and its jurisdiction is limited. But this hearing demonstrated that serious inquiry can expand the public knowledge of the Trump-Russia scandal—and that there remains much more to examine and unearth.

The Department of Defense Is Investigating Michael Flynn

The Defense Department’s inspector general has opened an investigation to determine whether Michael Flynn, Donald Trump’s former national security advisor, accepted payments from a foreign government without permission, according to documents released Thursday by Rep. Elijah Cummings (D-Md.).

“These documents raise grave questions about why General Flynn concealed the payments he received from foreign sources after he was warned explicitly by the Pentagon,” Cummings, the top Democrat on the House oversight committee, said in a statement. “Our next step is to get the documents we are seeking from the White House so we can complete our investigation. I thank the Department of Defense for providing us with unclassified versions of these documents.” Earlier this week, Cummings blasted the White House for refusing to provide his committee with documents related to whether Flynn disclosed his foreign payments when he reapplied for a security clearance last year.

Prior to working for Trump, Flynn had led the Defense Intelligence Agency under former President Barack Obama. Flynn was pushed out of that job in 2014 and the DIA explicitly told Flynn that he could not to accept any compensation from a foreign state without prior permission from the federal government. Flynn, however, took $45,000 in speaking fees from television network RT (formerly know as Russia today), which U.S. intelligence officials describe as a Russian propaganda outlet.

Flynn claims the DIA was briefed on the payment, but the information released by Cummings shows that the agency cannot find any documentation “referring or relating” to his “receipt of money from a foreign source.” There’s also another relationship that Cumming says is alarming and may not have been properly disclosed: Flynn’s company received $530,000 from a firm owned by a Turkish businessman with close ties to the government. Flynn’s lawyer wrote that the business relationship “could be construed to have principally benefited the republic of Turkey,” and Flynn filed belated paperwork identifying his work as a foreign agent after losing his post in the Trump administration.

During Thursday’s White House briefing, Press Secretary Sean Spicer blamed the Obama administration when he was asked about the thoroughness of Flynn’s vetting by Trump’s transition team. “There’s an issue…that the Department of Defense Inspector General is looking into,” Spicer said. “We welcome that, but all of that clearance was made by the Obama administration and apparently with knowledge of the trip that he took.”

Earlier this week, Cummings and House oversight committee chairman Rep. Jason Chaffetz (R-Utah) held a joint press conference, during which they revealed that Flynn may have broken the law by not disclosing the payment from RT when he reapplied for a security clearance last year.

But Republicans on the oversight committee are furious about Cummings’ decision to make the documents public. “Though we’ve walked hand-in-hand with the Democrats during this investigation, this morning they broke with long-standing protocol and decided to release these documents without consulting us,” a spokeswoman for Chaffetz said on CNN.

Democrats say they’ve been working with the Pentagon to release unclassified versions of the documents to the public. A spokeswoman for Cummings said Republicans on the committee were informed the documents would be released this morning. “I honestly don’t understand why the White House is covering up for Michael Flynn,” Cummings said at a press conference today following the release of the documents. “There is a paper trail that the White House does not want our committee to follow it.”

With Nunes Out, the New Guys Running the Trump-Russia Probe Ain’t Much Better

On Thursday morning, the inevitable happened: Rep. Devin Nunes (R-Calif.), the chairman of the House intelligence committee, announced he was yielding the reins on his panel’s derailed investigation into Russia’s meddling in the 2016 presidential election. Nunes claims the reason for his retreat is that the House ethics committee is investigating whether he publicly revealed classified information—a charge he insists is “baseless.” Whatever happens with this ethics inquiry, his departure does not guarantee the investigation will fare any better than it has.

In his statement, Nunes curiously said nothing about Vladimir Putin’s secret political attack on the United States. Nor did he mention the question of contacts between Trump associates and Moscow. He only discussed one aspect of the committee’s probe: the leaking of classified information (mainly about Michael Flynn, who was fired from the national security adviser post after news reports showed he had lied about his conversations with the Russian ambassador to the United States during the transition). “The charges…are being leveled just as the American people are beginning to learn the truth about the improper unmasking of the identities of US citizens and other abuses of power,” Nunes declared. So even as he said bye-bye to the probe, the congressman—who served on the Trump transition team and who delegitimized himself while trying to provide cover to President Donald Trump for his fact-free charge that Barack Obama had wiretapped him—was still promoting Trump’s distraction of choice: The big story is what happened when Trump and his team were possibly picked up by “incidental” intelligence collection, not Putin’s attempt to subvert an American election or the FBI’s investigation of Trump associates for possibly coordinating with Russia.

And the committee members Nunes designated as his heirs have been champions of the same diversionary tactic.

Nunes, who is retaining his post of committee chairman, assigned the task of running the Russia investigation to Rep. Mike Conaway (R-Texas). He also noted that Rep. Trey Gowdy (R-S.C.) and Rep. Tom Rooney (R-Fla.) will assist Conaway. At the committee’s first hearing for its Russia probe—before Nunes ran the investigation into a ditch—his three designees, as they questioned FBI chief James Comey and National Security Agency head Mike Rogers, focused on the narrow issue of leaks and unmasking. (“Unmasking” is the term of art for when a senior US official cleared to handle top-secret reports based on intelligence intercepts of foreign targets requests an intelligence agency to disclose to him or her the identity of a US citizen referenced in a report.) Or they asked questions designed to raise doubts about the intelligence community’s assessment that Putin meddled in the election to assist Trump. That is, they stuck to the GOP’s political script.

Moreover, in early January, Conaway dismissed the issue of Russian involvement in the campaign with a wacky comparison. Speaking to a Dallas newspaper, he compared the Russian hacking-and-leaking assault to standard campaign moves: “Harry Reid and the Democrats brought in Mexican soap opera stars, singers and entertainers who had immense influence in those communities into Las Vegas, to entertain, get out the vote and so forth. Those are foreign actors, foreign people, influencing the vote in Nevada. You don’t hear the Democrats screaming and saying one word about that.” As the Dallas Morning News reported, “Asked whether he considers that on par with Russian cyber-intrusions that aimed to damage Hillary Clinton’s campaign, Conaway said: ‘Sure it is, it’s foreign influence. If we’re worried about foreign influence, let’s have the whole story.'”

This attitude was on full display during the hearing with Comey and Rogers—at which Comey declared the FBI had no evidence to support Trump’s Obama-wiretapped-me claim and revealed the FBI had been investigating Trump-Russia contacts since July. When Conaway was granted time for questioning, he dwelled on when and why the FBI and the NSA had reached the conclusion that the Russian operation was designed to help Trump. Conaway tried to make an issue out of the fact that the FBI hit this conclusion with more certainty a few weeks before the NSA did late last year. Comey had to point out, “To be clear, Mr. Conaway, we all agreed with that judgment.” And Rogers echoed him.

Conaway’s intent was clear: to attempt to show this damaging-to-Trump assessment was still iffy. This led him into a bizarre exchange with Comey over rooting for college football teams and whether a person can cheer for one team to lose and not really desire the other team to win. (Conaway referenced his wife’s favorite team, the Red Raiders of Texas Tech.) Comey noted that “logically, when Putin wanted Hillary Clinton to lose,” he wanted Trump to win. Conaway then tried to discredit a Washington Post story by noting that the anonymous sources who provided the newspaper information about the US intelligence community’s assessment of the Russian operation (before that evaluation was made public) had probably broken the law. It was not obvious what he was driving at. But Conaway had not bothered to express any outrage over the Russian intervention or to encourage the FBI’s ongoing investigations. He was in Trump-damage-control mode.

Rooney used his grilling time to pose to Rogers a long and detailed series of questions about incidental collection and unmasking. These are not unimportant subjects. But they have nothing to do with how Putin and Russian intelligence intervened in the election. (Rogers noted that only 20 senior-ranked officials at the NSA, including himself, are authorized to approve unmasking requests.) Then came the money shot. Rooney asked, “If the NSA obtained the communication of General Flynn while he was communicating with the surveillance target legally, would you please explain how General Flynn’s identity could be unmasked based on the exceptions that we discussed?” So this was all about targeting those current or past US officials who had leaked information on Flynn’s conversation with the Russian ambassador. Rooney was more concerned about the leaking than Flynn’s deceptions and back-channel communications (for which Flynn was fired). Rogers replied, “I’m not going to discuss even hypotheticals about individuals, I’m sorry.”

Nevertheless, Rooney decried the “serious crime” that had apparently been committed via a presumed act of unmasking. He noted he was worried that the intelligence community had broken a “sacred trust” with the American people. (There was not a word about Flynn violating any trust.) He did not once address the Russian intervention.

When Rooney was done, Gowdy picked up this line of questioning. Gowdy is best known for running the House special committee on Benghazi that went on endlessly—after other House committees had scrutinized the matter and blown apart the various anti-Clinton conspiracy theories of the right—and was marred by partisan moves and, yes, leaks from the GOP side of the committee. (Gowdy also declared during the campaign that he believed Clinton should be prosecuted for how she handled her official email when she was secretary of state.) Citing several newspaper stories about Flynn’s calls with the Russian ambassador—which referred to classified intercepts that had captured these communications—Gowdy said to Comey, “I thought it was against the law to disseminate classified information. Is it?” Comey replied, “Yes, sir. It’s a serious crime. I’m not going to comment on those particular articles because I don’t want to, in any circumstance, compound a criminal act by confirming that it was classified information, but in general, yes, it’s a serious crime.”

Gowdy subsequently followed up with this question: “Is there an exception in the law for reporters who want to break a story?” Comey answered, “Well that’s a harder question as to whether a reporter incurs criminal liability by publishing classified information and one probably beyond my ken.” But Gowdy suggested that a reporter could be prosecuted for publishing a story containing classified information. “You’re not aware of an exception in the current dissemination of the classified information statute that carves out an exception for reporters?” he asked the FBI chief. No, Comey said: “I’m not aware of anything carved out in the statute. I don’t think a reporter’s been prosecuted certainly in my lifetime, though.”

Gowdy did not ask anything related to how the Kremlin had targeted a political party and presidential campaign to subvert an election. Instead, he fixated on leaks and locking up journalists who receive and report classified secrets. He pressed Comey to investigate the Flynn leak, and he ticked off a list of Obama officials who might have had access to unmasked names—James Clapper, John Brennan, Susan Rice, Loretta Lynch, Sally Yates—as if to suggest one or more of them deserved to be investigated for the Flynn leak.

Toward the end of the hearing, Gowdy did speak one sentence about the FBI’s Russia investigation. He told Comey, “I want you to go find every single witness who may have information about interference, influence, motive, our response, collusion, coordination, whatever your jurisdiction is, wherever the facts may take you. Though the heavens may fall, go do your jobs because nature abhors a vacuum.” But Gowdy then cautioned people not to confuse “evidence” with “facts” and to be wary of hearsay. This seemed to be an indirect way of questioning media reporting regarding the Russian intervention in the election and the contacts between Trump associates and Russia. In any event, Gowdy had tried to turn the hearing into an inquiry about the Flynn leak and the once-obscure subject of unmasking—which matched the agenda of Trump defenders.

Acting in a partisan and puzzling manner, Nunes made a hash of the House intelligence committee’s investigation of the Trump-Russia scandal. After his botched stunt, his credibility was shot. Stepping aside was the correct action. Yet he has placed this important exercise in the hands of men who have indicated they are not fully concerned with the main issues, which, of course, are rather inconvenient for their party and its president. Conaway, Rooney, and Gowdy have not yet demonstrated they can mount an independent and vigorous investigation on this politically sensitive terrain. Nunes may be gone, but the challenges facing the committee remain.

Paul Manafort Tried to Help Russian Oligarch Suspected of Mob Ties Get a US Visa

On Wednesday morning, the Associated Press released a bombshell report revealing that Paul Manafort, who ran Donald Trump’s campaign for several months, had secretly worked for a Russian billionaire a decade ago to promote Russian leader Vladimir Putin. The news service noted that Manafort “proposed in a confidential strategy plan…that he would influence politics, business dealings and news coverage inside the United States, Europe and the former Soviet republics to benefit the Putin government.” Manafort pitched this idea to Russian oligarch Oleg Deripaska, a close Putin ally, and in 2006 signed a $10 million annual contract for the project. The AP’s report shows Trump’s campaign was managed by an operative who had received millions from a Putin crony to bolster the Russian leader’s image in the United States at a time when US-Russia relations were tense.

Manafort’s relationship with Deripaska began at least several years before they inked this contract when the Russian oligarch was banned from entering the United States due to his suspected connections to Russian organized crime. In the early 2000s, the aluminum magnate enlisted Manafort, a veteran lobbyist and fixer with a reputation for representing foreign despots and thugs, to help him secure a visa so he could travel to the United States, according to a source with knowledge of the arrangement,

In the late 1990s, the US State Department had refused to allow Deripaska (reportedly one of the richest men in Russia) visit the United States. As the Guardian reported in 2008:

A senior former State Department official said US officials who considered Deripaska’s case in 1998 believed he was associated with several Russians involved in organised crime, including Anton Malevsky, head of the notorious Ismailovskaya Brotherhood. Others believed by the US authorities to be his associates were involved in the so-called Aluminium Wars during the mid-1990s which resulted in dozens of killings. Deripaska has always strenuously denied any links to organised crime.

The State Department official said: “There are four grounds that are relevant in Deripaska’s case. Number three is, does this person have criminal associations and relationships? That’s the one that applied to Deripaska.”

In 2000, Deripaska, who was looking to list his company on the London Stock Exchange, hired former US Senator Bob Dole and the law and lobbying firm of Alston & Bird, where Dole worked, to bolster his image and lobby the State Department. Dole won permission for Deripaska to make a short trip to the United States in December 2000, and the oligarch delivered lectures at Harvard University and a Washington, DC think tank. But, according to the Guardian, Deripaska, during this visit, was “interviewed by the FBI, which led to a second ban on his entering the US.”

This is about the time when Manafort began assisting Deripaska on the visa issue, according to the source with knowledge of this deal. Manafort also retained a publicity expert to generate positive stories about Deripaska, this source said.

The Deripaska visa matter continued on for years, and Deripaska kept Dole and his firm on the payroll. In 2005, Alston & Bird was paid about $260,000 for its work on behalf of Deripaska. That year, the oligarch received a multi-entry visa, in part so he could talk to FBI investigators. But in July 2006, the visa was revoked. The Wall Street Journal reported this happened after “concerns were raised about the accuracy of statements he made in a meeting with the Federal Bureau of Investigation.”

In 2006, Manafort’s business partner at the time, Rick Davis, set up meetings overseas between Sen. John McCain, a harsh Putin critic, and Deripaska. A McCain aide later said these were just “social and incidental” contacts that occurred while McCain was traveling abroad on official business.

Deripaska did get into the United States in 2009—under unusual circumstances. The Journal reported that Deripaska, who was “barred entry to the US for years due to US government concerns about possible ties to organized crime” had “visited the country twice this year under secret arrangements made by the Federal Bureau of Investigation.” The newspaper noted:

Aluminum magnate Oleg Deripaska met with FBI agents in August and earlier this month as part of a continuing criminal probe, according to two administration officials. The focus of that probe couldn’t be learned.

Mr. Deripaska used the opportunity of his recent US visits to meet with top executives of U.S. investment banks Morgan Stanley and Goldman Sachs Group Inc. The aluminum giant he controls, UC Rusal, is preparing for an initial public offering, a vital part of Mr. Deripaska’s efforts to save his debt-burdened business…

Mr. Deripaska’s recent visits were arranged outside of regular State Department visa procedures because the US. continues to have concerns about Mr. Deripaska’s business associations, according to administration officials. Instead, FBI officials arranged for a limited-entry permit from the U.S. Department of Homeland Security, as allowed in special cases related to sensitive matters, officials said.

Another person familiar with the case said there was some opposition from other US agencies to Mr. Deripaska’s visits, but that the FBI prevailed. The FBI had previously been at loggerheads with the State Department over Mr. Deripaska; FBI officials have said they were getting interesting information from him, this person said.

This did not ultimately resolve the issue. In 2010, Deripaska remained banned from regular travel to the United States, and the Russian foreign ministry retained another DC lobbying firm to work on this.

The AP reported that Manafort maintained a business relationship with Deripaska until at least 2009, though “they had a falling out laid bare in 2014 in a Cayman Islands bankruptcy court. The billionaire gave Manafort nearly $19 million to invest in a Ukrainian TV company called Black Sea Cable, according to legal filings by Deripaska’s representatives. It said that after taking the money, Manafort and his associates stopped responding to Deripaska’s queries about how the funds had been used.” The news service also noted that “Manafort did not disclose details about the lobbying work to the Justice Department during the period the contract was in place,” and it pointed out under “the Foreign Agents Registration Act, people who lobby in the US on behalf of foreign political leaders or political parties must provide detailed reports about their actions to the department. Willfully failing to register is a felony and can result in up to five years in prison and a fine of up to $250,000, though the government rarely files criminal charges.”

Manafort told AP, “I worked with Oleg Deripaska almost a decade ago representing him on business and personal matters in countries where he had investments. My work for Mr. Deripaska did not involve representing Russia’s political interests.” Manafort did not respond to a Mother Jones request for comment regarding his work for Deripaska on the visa issue.

A spokesman for Manafort did forward a general statement Manafort had sent to reporters: “I have always publicly acknowledged that I worked for Mr. Deripaska and his company, Rusal, to advance its interests. For example, one of the projects involved supporting a referendum in Montenegro that allowed that country to choose membership in the EU, a measure that Russia opposed. I did not work for the Russian government. Once again, smear and innuendo are being used to paint a false picture. I look forward to meeting with those conducting serious investigations of these issues to discuss the actual facts.”

Asked if Manafort would address his work for Deripaska on the travel visa, the spokesman replied, “I do not expect I will get an answer about something that happened 15 years ago. I apologize.”

Can Republicans Be Trusted to Investigate Trump’s Russia Scandal?

Last week, news broke that the Senate intelligence committee—as part of its recently launched investigation of both the Russian hacking of the 2016 campaign and contacts between Donald Trump associates and Russia—had sent letters to at least a dozen agencies, individuals, and organizations instructing them to preserve records and information related to the probe. This was one of the first public signs that the Senate committee or the House intelligence committee, which has initiated its own inquiry, had begun any real digging.

But both investigations are proceeding behind a thick veil of secrecy, and there is no way to tell if the Republicans leading these efforts are mounting serious endeavors committed to unearthing facts that might be inconvenient, embarrassing, delegitimizing, or worse for Trump and his White House. So the question remains: Can these committees be trusted to get the job done?

Congressional investigations are not easy tasks. Committees usually are burdened with a wide variety of responsibilities. In the case of the intelligence committees, they are already responsible for monitoring the full intelligence community, which includes 17 different agencies. Veteran members and staffers from these committees routinely say that it’s tough for them to manage the normal oversight. (Watching over just the gigantic National Security Agency could keep a committee busy around the clock.)

Now, these committees have to maintain their current overwhelming duties and also conduct a highly sensitive inquiry. One congressional source says that the House intelligence committee has slightly expanded its staff for the hacking/Trump-Russia investigation. But Jack Langer, the spokesman for Rep. Devin Nunes (R-Calif.), the chairman of the committee, won’t confirm that. And spokespeople for Sen. Richard Burr (R-N.C.), the chairman of the Senate intelligence committee, did not even respond to a request for comment on the staffing issue.

Langer and the Burr spokespeople also wouldn’t say if the House and Senate intelligence committees are coordinating their efforts. Or if either committee has yet issued any subpoenas. Or if the committees will release public updates on the progress of each investigation. This is a red flag. Questions such as these do not involve classified or secret information. The committees could demonstrate their commitment to full accountability by informing the public about these organizational issues. The desire to shield such details does not bode well.

Jeremy Bash, who was chief counsel for the House intelligence committee in 2007 and 2008 (when Democrats controlled Congress), notes that there are three key elements necessary to ensure the intelligence committees conduct an effective investigation: full-time staff with legal or investigative training devoted to the inquiry; access for members and staff to all relevant documents held by government agencies; and a vigorous effort to conduct a broad range of witness interviews. He points out that past intelligence committee investigations have been hindered when intelligence agencies have not allowed staffers easy access to materials. Indeed, the intelligence committees often get into tussles with the spy services they oversee. Three years ago, the Senate intelligence committee had an explosive fight with the CIA over documents when it was examining the agency’s use of torture. This bitter clash threatened to blow up into a full-scale constitutional crisis.

News reports about the Trump-Russia scandal indicate that US intelligence agencies have material—perhaps surveillance intercepts or reports from human assets—relating to contacts between Trump associates and Russians. The FBI reportedly has been investigating these contacts and presumably has collected information relevant to the committees’ inquiries. Yet often intelligence agencies, looking to protect sources and methods or an ongoing investigation, are reluctant to share such information—even with the committees. (Democratic senators and representatives have repeatedly called on the FBI to release to the public information it has on Trump-Russia interactions.)

Much depends on the chairmen of the two committees. How hard will they push if they encounter a roadblock at the FBI or elsewhere? And how far will they go? Will they devote sufficient resources? Will they issue subpoenas for witnesses not eager to accept a committee invitation? A chairman has much discretion in determining the course of an investigation. Imagine that a staffer has located a witness who might possess significant information but that this witness is now living in South Korea. Will the chairman send staff there to locate the witness and obtain a statement? Or might he say, We have to let this one go?

The most crucial element is how committed the chairman is to uncovering the truth. “The real enemy to an investigation is the time that goes by,” says Bash, who helped oversee an investigation of the NSA’s warrantless wiretapping during his time with the house committee. “People lose interest. Other events intervene. The key thing is to get going fast. There are a hundred ways to slow down an investigation by people or agencies who don’t want it.”

Neither Burr nor Nunes has demonstrated much public enthusiasm for investigating the Trump-Russia scandal. At first, Burr wanted his committee to focus solely on the Russia hacking, not ties between Trump associates and Russia. This was no surprise. Most congressional Republicans have either shied away from or downplayed this subject. And Burr did serve on the Trump campaign’s national security advisory council. But after Sens. John McCain (R-Ariz.) and Lindsey Graham (R-S.C.) pushed for a select committee investigation—which would be a more independent inquiry involving a greater number of senators—Burr agreed to widen the intelligence committee probe to cover the Trump-Russia angle. It was obvious that he did so in order not to lose control of the investigation.

Nunes, who was an adviser to Trump’s transition team, initially showed little eagerness for this assignment, as well His announcement in late January that he would proceed with the investigation came only after Burr’s change of heart—and followed weeks of public pressure from Rep. Adam Schiff, (D-Calif.), the ranking Democrat on the House intelligence committee. Skepticism regarding the willingness of Burr or Nunes to lead robust, wherever-it-goes investigations is hardly unfounded.

On Friday, the Washington Post reported—and the White House confirmed—that Burr and Nunes had been enlisted by the Trump administration to be part of its effort to counter news stories about Trump associates’ ties to Russia. Their participation in this spin campaign has undermined their claims of independence. And on Saturday—in response to Rep. Darrell Issa’s (R-Calif.) surprising call for a special prosecutor to investigate the Trump-Russia connections—Nunes dismissed Issa’s demand, saying, “This is almost like McCarthyism revisited. W’’re going to go on a witch hunt against, against innocent Americans?” He added, “At this point, there’s nothing there.” That’s not the manner in which the head of an independent investigation should be talking about the inquiry. How does Nunes know who’s innocent or not—or whether there’s nothing there—at this point?

In recent weeks, Democratic members of both committees told me that, at least for the time being, they were hoping for the best and taking Burr and Nunes at their word when they claim they are committed to conducting thorough investigations, holding public hearings, and releasing public findings. These recent actions of Burr and Nunes may change that perspective. Schiff has said he will release public updates on the progress of the House committee’s inquiry, though he has not issued one yet.

On the Senate side, Democrats say that the effectiveness of the investigation may depend on McCain. He is not a full member of the Senate intelligence committee, but as chair of the Senate armed services committee, he is an ex officio member of the intelligence committee. In that regard, he has the same access as a full member to the investigation’s materials, and he can monitor the inquiry. Should he conclude the investigation is not proceeding vigorously, he will be in a position to publicly shame Burr and revive his demand for a select committee probe. Of course, Democrats on the Senate and House intelligence committees could do the same, but they won’t have the same political standing to pull that sort of move.

For weeks, Democrats on both sides of Capitol Hill have called for an independent bipartisan commission—similar to the well-regarded 9/11 commission—to investigate this affair. This inquiry would operate outside of the congressional committee system—meaning outside of GOP control. Naturally, the Republican congressional leadership has opposed the move and has declared that it’s just fine to let the intelligence committees do their work. And McCain and Graham have yet to endorse the Democrats’ proposal. But that is a card McCain could play if the Senate investigation does not meet his standards. Still, every time there is a development in the Trump-Russia story—such as last week when it was reported that the Trump White House asked the FBI to knock down the news stories saying that Trump associates had interacted with Russian intelligence—Democrats renew their call for an independent commission that would be distant from congressional politics.

Even with the FBI investigating, the congressional investigations are crucial. The FBI inquiry is either a counterintelligence probe or a criminal investigation (or maybe both). Neither of those are designed or intended to provide a full accounting to the public. An FBI criminal inquiry (usually) only yields public information if someone ends up being charged with a crime and the case goes to trial. And in such instances, the only information that emerges is material necessary for the prosecution of the case. That could be a small slice of whatever the bureau obtained.

A counterintelligence investigation aims to discover and possibly counter a foreign actor’s effort to target the United States with espionage, covert action, or terrorism. These sort of probes tend to stay secret unless they result in a criminal case. (Perhaps a spy is discovered and arrested, or a would-be terrorist indicted.) In an unusual move, the intelligence community, at President Barack Obama’s direction, did release some of its assessments regarding the Russia hacking. But whatever the FBI and other intelligence agencies may be investigating, their efforts are not likely to produces a comprehensive public accounting of this double scandal: Vladimir Putin’s attack on the US election and the interactions between the president’s crew and the foreign power that waged this political warfare.

As of now, that’s the job of the two congressional intelligence committees. Both are under the direction of Republicans who have supported Trump and participated in White House spin efforts. Both are moving forward cloaked by their customary secrecy. And both have yielded no indications yet that they will produce the investigations and public findings necessary to resolve these grave matters.

Why Trump Can’t Come Clean on Russia

There is an old chestnut that gets tossed out whenever a scandal hits: It’s not the crime, it’s the cover-up. The saying traces back to Watergate. Sen. Howard Baker, the top Republican on the Senate Watergate committee, once noted, “It is almost always the cover-up rather than the event that causes trouble.” This week, following the resignation of national security adviser Michael Flynn, NBC News’ Chuck Todd was one of many who quipped, “It’s not the crime, it’s the cover-up.” And that was certainly a significant element of the Flynn imbroglio: Flynn had lied about his December conversation with the Russian ambassador, concealing the fact that they had discussed the sanctions President Barack Obama had just levied on Russia as punishment for its covert efforts to swing the 2016 election to Trump. But in this case the bigger scandal at hand is not a cover-up. It is the thing itself: the connections between the Trump camp and Moscow during the campaign, when Vladimir Putin was trying to subvert American democracy.

Certainly, the Trump campaign has strived mightily to smother this potentially explosive scandal. Here’s a partial account.

* Days after the election, Russian deputy foreign minister Sergei Ryabkov said in an interview that “there were contacts” between the Trump team and the Kremlin. He noted, “Obviously, we know most of the people from his entourage.” Trump spokeswoman Hope Hicks immediately said the campaign had “no contact with Russian officials” before the election.

* At Trump’s January 11 press conference, a reporter asked him, “Can you stand here today, once and for all, and say that no one connected to you or your campaign had any contact with Russia leading up to or during the presidential campaign?” Trump did not reply. But after the press conference ended and Trump was leaving, he did answer that query with a firm “no.”

* On January 15, on Face the Nation, John Dickerson asked incoming Vice President Mike Pence, “Did any adviser or anybody in the Trump campaign have any contact with the Russians who were trying to meddle in the election?” Pence declared, “Of course not. And I think to suggest that is to give credence to some of these bizarre rumors that have swirled around the candidacy.”

* On February 14, at the daily White House briefing, ABC News’ Jonathan Karl asked press secretary Sean Spicer whether any Trump associates were in touch with the Russian government prior to the election. Spicer replied, “There’s nothing that would conclude me that anything different has changed with respect to that time period.” That contorted statement was clearly meant as a no.

The drift is clear. Whenever queried about this highly sensitive matter, Trump and his minions have said there were no contacts between anyone in his crew and the Putin regime during the 2016 campaign. This is a cover-up.

There is evidence that Trump associates did interact with Russian officials during the campaign. The Washington Post story that broke open the Flynn affair a few days ago also reported that the Russian ambassador had told the newspaper he had been communicating with Flynn during the campaign. At that point, Flynn was Trump’s senior national security adviser. (As such, Flynn attended in mid-August the first briefing Trump received as the GOP nominee from the US intelligence community, during which Trump and Flynn were told that US intelligence agencies had concluded Russia was behind the hacking and leaking that targeted Democrats.) And on Tuesday night, the New York Times reported that intelligence intercepts indicated that several Trump associates had “repeated contacts with senior Russian intelligence officials in the year before the election.”

In late October, I reported that a former foreign counterintelligence officer had sent memos to the FBI indicating that the “Russian regime has been cultivating, supporting and assisting TRUMP for at least 5 years” and that Trump “and his inner circle have accepted a regular flow of intelligence from the Kremlin, including on his Democratic and other political rivals.” The memos also claimed that Russian intelligence had “compromised” Trump during his visits to Moscow and could “blackmail him,” and that Russian intelligence had compiled a dossier on Hillary Clinton based on “bugged conversations she had on various visits to Russia and intercepted phone calls.”

On Tuesday, I bumped into a prominent Republican consultant, and he said that Trump had to “get out in front of” the burgeoning scandal and disclose all the facts because “the cover-up is always worse.” The Washington Post‘s Chris Cillizza offered similar advice to the president on Wednesday morning: “What is really needed at this point is a full and complete debrief for the American people from Trump himself. Why was his campaign in ‘constant’ contact with Russian officials? Who in the campaign—or the broader Trump organization—was involved? Are they still with the campaign or the business? What was discussed on these calls?…Why is Trump so reluctant to condemn Russia and Vladimir Putin in particular?”

But the cover-up here may not be worse than the actions being covered up.

At a minimum, it seems that Trump associates—at least Flynn—were secretly interacting with the Putin regime as it was plotting to subvert American democracy to help Trump win the White House. A key question is obvious: What did they discuss? The darkest possibility is that they talked about the Kremlin assault on the US election. Short of that, might Flynn or others have encouraged Putin’s clandestine operation by signaling that Moscow would have an easier time with a Trump administration than with a Clinton administration? Were there any winks or nods? After all, in late July, Trump called on Russia to hack Clinton. Whatever was discussed, any Trump associate who spoke with Russian officials during the summer or fall of the campaign had reason to know that he or she was interacting with a member of a regime that was actively attempting to undermine the election in a manner beneficial to Trump.

How can Trump and his crew concede that they were hobnobbing with a foreign government that was waging political warfare against the United States? The “full and complete debrief” that Cillizza advocates would require Trump to acknowledge that he and his team have covered up these contacts and explain why. This “full and complete debrief” could well show that Trump’s camp cozied up to a repressive government that was seeking to destabilize US politics to help Trump. It could reveal that Trump associates directly or indirectly encouraged Putin’s attack on the 2016 election.

Trump would lose all legitimacy as president were he to admit that anything of this sort transpired. There are some deeds that cannot be acknowledged. Expecting Trump and his lieutenants to confess that his campaign or business associates were networking with the Kremlin or Russian intelligence is not realistic—especially after their months of denial. (Trump also for months refused to accept the US intelligence assessment that Russia was behind the hacking and leaking aimed at Democratic targets, and when he finally bent on this point, he downplayed Moscow’s meddling in the election.) Trump cannot continue to present himself as the triumphant winner of a fair election if it turns out his own people were palling around with Moscow.

Another famous line is this: You can’t handle the truth. Further revelations about contacts between the Trump camp and Russia could pose an existential threat to the Trump White House. The clear choice for him and his gang is to deny, to stonewall, to distract, to lie. Trump doesn’t explain the pre-election contacts; he complains about leaks. He casts all interest in this controversy as merely the revenge of the Clinton losers. He calls reporting on the Russia connection “fake news” and slams journalists pursuing the Flynn story as “fake media.” This is not shocking. He might not be able to survive a full accounting. The poison of the cover-up may be less deadly than the poison of the event itself. Only Trump and the people involved can know for sure. But investigations of the Russian contacts now being conducted by the FBI and the congressional intelligence committees—if they are mounted effectively and yield public results—may eventually allow us to see the full calculation. In the meantime, the public can justifiably conclude that when it comes to Trump-Russia connections during the campaign, the Trump team has been covering up for very good reasons.

Students With Valid Visas Are Trapped in Limbo Abroad

On Saturday morning, Niki Mossafer Rahmati got off her flight from Tehran in Doha, Qatar to board a connecting flight to Boston, when she got caught up in the chaos set off by President Trump’s immigration order.

Rahmati, an MIT junior studying mechanical engineering, had been home with her family for winter break when she received word Wednesday morning of the pending executive order. She changed her flight to return to Boston right away, only to find that order had gone into effect in the middle of her connecting flight to Doha. She and some 30 other Iranians with legal visas were blocked from boarding the plane and sent back to Tehran. Among them, Rahmati says, were two women traveling to their pregnant daughters to help them through their last trimester.

“Do any of the people sound like illegal immigrants?” Rahmati asked in a public Facebook post after arriving back home in Tehran. “This will not secure the borders from terrorism and illegal immigrants. It will only increase racism in the American society. The president is trying to make Islamophobia a norm and policy by which he wants to lead the country.”

“My inbox is flooded with messages and emails of love and support,” she also wrote. “But I cannot believe all this love is coming from the same country that banned me from entering its borders just a couple of hours ago.”

Rahmati is just one among many students from Iran, Iraq, Libya, Somalia, Sudan, Syria and Yemen who have been barred from returning to school. MIT alone has 38 students from Iran, 1 from Iraq, 5 from Syria, 2 from Sudan, and 1 from Somalia; two, including Rahmati, were reportedly unable to board flights back to Boston. According to the New York Times, students from Stanford, Harvard, and Yale, among other universities, have also been affected.

Yesterday, after thousands of protesters stormed US airports to fight for the release of people detained upon arrival, a federal judge in Brooklyn blocked part of President Trump’s order by temporarily allowing valid visa holders who had landed in the US to stay. Federal judges in Massachusetts, Virginia, and Washington quickly followed suit, with the Massachusetts order additionally restraining enforcement of the order for visa holders traveling back to the US in the next seven days.

In response, MIT issued an statement urging students and staff to “fly back to Boston—directly to Logan Airport—as soon as possible, and before February 4.” Whether or not the court order will be respected by Custom and Border Protection officials abroad is unknown.

Rahmati is a member of the sorority Sigma Kappa and counselor for the MIT chapter of Camp Kesem, a national nonprofit that operates free summer camps for children whose parents have had cancer. For weeks before heading home for break, Rahmati had been fundraising for this summer’s camp. After the election, Rahmati encouraged her friends to keep an open mind to Trump supporters, according to her roommate.

As news of her situation has spread, the MIT community sprang into action, calling elected officials and circulating a White House petition. At this writing, her ability to return to MIT to finish her undergraduate remains uncertain.
