The town that extended ‘smart growth’ to its water

As with so many towns in the West, the history of Westminster, Colorado, can be told through its water supply.

The turning point in that history was the hot, dry summer of 1962. Westminster was already embroiled in a debate over where to source its water when a drought choked the small city, forcing officials to impose a sprinkler ban. Soon enough, residents noticed that the water trickling from their taps was slightly discolored and didn’t smell right. The desperate city had started drawing water from the Kershaw Ditch, a pool it had recently abandoned over treatment issues.

Although the city said the water was “safe, but stinky,” fed-up local mothers were convinced it would make their children sick and raised hell. In what became known as the “Mothers’ March,” more than 100 women gathered at city hall to protest the city’s water management. City-council meetings were disrupted by protesters who would shout questions through open windows, and the mothers flogged petitions on street corners. They attracted enough attention that Dan Rather did a segment on the protests for CBS News.

The events of that summer ensured that water would become Westminster’s defining issue for years to come, until the city struck a deal with local farmers to share water from the artificial Standley Lake. But even with its supply settled, Westminster continued to focus on taming demand, most recently with a conservation and planning approach that’s become a regional model for managing growth without straining resources.

“Starting from such an uncomfortable place, we’ve kept our eyes on the prize,” said Stu Feinglas, who retired last year as Westminster’s senior water-resources analyst. “Sustainable development and sustainable water.”

Feinglas, who started with the city in 2001 (as another drought gripped northeast Colorado), approached the problem holistically, with a data-driven approach that has become influential for other cities in the West. By merging the city’s land-use plans with water data, Feinglas and colleagues ensured that Westminster wouldn’t run dry, even as its population boomed from less than 10,000 at the time of the water protests to 113,000 today. The surrounding county was even water-healthy enough to support Colorado’s first two water slides as part of the Water World theme park.

The state’s population is expected to keep growing — as much as 70 percent by 2040. At the same time, climate change is fueling persistent droughts. In 2018, parts of nine Western states, including Colorado, were in severe or extreme drought, according to the National Oceanic and Atmospheric Administration.

Conservation measures have helped many Western cities decouple population growth from water use, but that approach often puts the burden on businesses and residents to be more efficient. Taking a demand-focused approach to water from the earliest stages of planning is still rare, said Erin Rugland, a junior fellow at the Babbitt Center for Land and Water Policy in Phoenix.

“There’s always been a way to engineer around it,” Rugland said. “It’s been feasible to find a new supply. But I think we’re starting to reach a turning point.”

The recent sustained drought — which has left the critical storage facilities Lake Powell and Lake Mead at their lowest levels since they were being filled — has cemented the idea that Western states are going to have to try to do more with less water. On April 8, Congress approved a seven-state Drought Contingency Plan, which lays out shared cuts if supplies continue to stay low.

The plan builds on 2007 guidelines that helped manage the early years of the drought; now states, tribes, agriculture groups, and cities are negotiating a new set of guidelines set to take effect in 2026. Previous agreements have hit agriculture hard, since the industry is by far the biggest water user in the West, but most everyone agrees that the 2026 guidelines will require some sacrifices from cities, even as they grow as economic engines.

That’s where Feinglas thinks his approach — which current Westminster officials are sticking with — needs to become the norm.

Using Westminster’s comprehensive plan, which zones parcels for general use like multifamily housing or retail, Feinglas made a rough estimate of how much water each type of building would use. Then the city built GIS software that overlays water resources and infrastructure over the comprehensive plan — making it easy to see, for example, how much water a proposed strip mall might use.

It’s a step up from the typical water-per-capita measure that most cities rely on, which doesn’t reflect the fact that denser developments are typically more water-efficient than a single-family house with a green lawn. It also, Feinglas said, helps planners guide developers to smarter construction, even previewing what their water rates and tap fees might be.

“We didn’t want public works to determine how the city developed. We wouldn’t be the ones to say no,” Feinglas said. “What we could do is show how much water we have and ask them to be creative and make their development work with that.”

That meant city planners could identify where it might make more sense to zone for multifamily housing, or see where new pipes might be necessary. Developers could amend their permits to include more low-flow toilets or water recycling. On rare occasions, proposals have been scrapped because they’d need more water than the city could supply. Essentially, Westminster is planning for the worst, making sure that another drought won’t force anyone to turn off the taps.

It seems straightforward, and more or less mirrors what cities have been doing for years to align transportation and transit demand with new construction. But only a handful of other cities — notably Flagstaff, Arizona — have made it work.

“It requires operating between the silos of water management and planning, two disciplines that don’t have a lot of common language,” Rugland said. “Efforts for collaboration would have to be on top of day-to-day duties.”

Also, water data isn’t always easy to come by, especially on a lot-by-lot basis that breaks it down by business type. It’s even tougher for cities that draw their water from multiple sources, who may keep data in different forms (California, for instance, had to pass a law in 2016 requiring that the various state and local agencies be able to share their water data).

More states and cities are trying to make the water-land link. Colorado’s Water Plan calls for 75 percent of citizens to live in communities that have integrated water conservation into land use by 2025, and the state’s water conservation board has guidance to help local governments (the Keystone Policy Center has also held a dialogue with state and local partners). Arizona has a law that requires local jurisdictions to include available water supply and demand as part of a comprehensive plan, but not necessarily to make the link to planning (government cuts reduced state oversight for those comprehensive plans, as well). New software tools, like Razix Solutions, offer off-the-shelf guidance for local officials.

Ultimately, Feinglas said, the model requires city departments to talk to each other and plan for the worst, even if it means some short-term pain. “We know water is valuable, especially now,” Feinglas said. “The last thing you want is to lose your economy because you can’t supply your citizens.”

9 Surprising Health Benefits of Gardening

Gardening can play a significant role in a healthy lifestyle ? and not just because of any fruits and vegetables you grow. Even if you don?t have the greenest thumbs, you still can enjoy the benefits. Here are nine surprising ways gardening can boost your health.

1. It uplifts your mood

A growing body of research has linked being around nature to stress relief and an overall improved mood. And it seems gardening falls under that category. A study on gardening and stress had participants complete a stressful task before assigning them either to 30 minutes of gardening or 30 minutes of indoor reading. Both groups experienced drops in their cortisol levels (the stress hormone), but the gardening group had much more significant decreases. Plus, gardening managed to restore the participants? positive moods after the stress task had brought them down, but reading did not. ?These findings provide the first experimental evidence that gardening can promote relief from acute stress,? the study says.

2. It can strengthen your immune system

More research is demonstrating how playing in the dirt can be good for your health. A study on immunity found evidence to support the notion that exposure to microbes, especially at a young age, helps to strengthen the immune system and prevent diseases. And another study from Johns Hopkins Medicine corroborates those findings. It found that early exposure to dirt, dander and germs can lower a person?s risk of allergies and asthma. Just remember that dirt also might contain bacteria and parasites that can make you sick. So avoid touching your face with dirty hands, and wash them as soon as you?re done gardening.

3. It promotes brain health

Gardening also has the potential to improve your brain health. A study on dementia recruited 2,805 people age 60 and older who had no known cognitive impairments and followed them for 16 years. Ultimately, there were 115 men (out of 1,233) and 170 women (out of 1,572) who developed dementia during that time. But the researchers noted that those who engaged in daily gardening lowered their risk of developing dementia by 36 percent. In comparison, daily walks dropped the dementia risk by 38 percent for men, but interestingly there wasn?t a ?significant prediction? for women.

4. It?s good exercise

Gardening may help you relax, but it?s also a pretty good workout. Cleveland Clinic qualifies gardening as ?moderate? exercise ? akin to walking or riding your bike, depending on the intensity. And research has catalogued several health benefits of gardening, especially for older adults. A study on seniors found daily physical activity, including gardening, cut their risk of a heart attack or stroke by up to 30 percent, as well as prolonged their lives. And another study on gardening and older adults concluded that gardening was an ideal way for seniors to stay in shape. It specifically helped them maintain their hand strength and dexterity. Plus, at any age, caring for something that?s living can be a helpful motivator to get up and move.

5. It helps you eat healthier

According to Harvard Medical School, gardening can play a helpful role in maintaining a healthy diet. Just by the nature of what you grow, it can lead you to eat more fruits and vegetables. You also can prevent unhealthy fertilizers and pesticides from getting in your food. And you get to enjoy the benefits of freshly picked produce. ?Vegetables that ripen in the garden have more nutrients than some store-bought vegetables that must be picked early,? Harvard Medical School says. Plus, a study on gardening and diets found people who gardened when they were children were likely to eat more fruits and vegetables later in life. So put those little green thumbs to work.

6. It can be a positive social activity

Social interaction is important for your health and well-being in many ways. ?Adults with strong social support have a reduced risk of many significant health problems, including depression, high blood pressure and an unhealthy body mass index,? Mayo Clinic says. Plus, a social group can give you a sense of belonging, help you cope with trauma and encourage you to make positive choices. And if you?re an avid gardener, working in a community garden might be the perfect fit. One study found people participating in community gardens had significantly lower BMIs ? as well as a lower risk of becoming overweight or obese ? than others in their neighborhoods who didn?t garden. The researchers also found some of the benefits extended to the gardeners? families, as well.

7. It exposes you to vitamin D

We all need vitamin D ? from the sun and our diets ? to keep our bodies healthy. And though it?s important to be careful about exposing your skin to the sun, gardening still is a prime way to keep your vitamin D at an optimal level. A study on vitamin D deficiency found regular gardening (as well as outdoor cycling) lowered the likelihood that older adults ? whose skin often has more trouble synthesizing vitamin D ? would become deficient. Interestingly, people who engaged in brisk outdoor walks did not experience the same benefit.

8. It?s eco-friendly

Tending to a home garden can be an eco-friendly activity and help to combat climate change. And a healthier planet means better health for all of us. A guide from the National Wildlife Federation offers several tips on environmentally friendly gardening. For instance, it recommends trading your gas-powered lawn tools for electric- or human-powered ones.?Stay away from fertilizers and lawn chemicals?to help prevent water pollution. Plus, be conscientious about what you plant. ?Gardeners can play an important role in minimizing the threat of invasive species expansion by removing invasive plants from the garden and choosing an array of native alternatives,? the National Wildlife Federation says.

9. It gives you a sense of purpose

Regardless of whether you have a single plant or an entire field, gardening is an ongoing responsibility. And that can give you a sense of purpose and nourish your spirit. Just ask NASA. To combat feelings of isolation, lower stress and break up monotony, NASA’s Human Research Program has experimented with astronauts growing plants in space. ?The countermeasure to sensory monotony is sensory stimulation,? according to NASA. ?Working with plants provides astronauts visual, tactile and olfactory stimulation, and eventually even salivary stimulation with fresh foods and variety.? And even astronauts ? whose job already is out-of-this-world ? found significant meaning in the work. ?Several astronauts agree that the ability to watch plants grow, and to play a part in their growth, provides a strong connection to something bigger than their immediate surroundings,? NASA says.

U.S. banks pledged to fund renewable energy, but they still spend way more on fossil fuels

Each year since the Paris climate agreement, major world banks have increased their financing of fossil fuels, pouring $1.9 trillion into the industry from 2016 through 2018. And, it turns out, U.S. banks are the worst offenders, according to a recent report published by a group of environmental organizations.

“The sad reality is that the fossil fuel sector has only grown since Paris,” says Patrick McCully, climate and energy director for the Rainforest Action Network and one of the report’s authors. “The banks are following what the industry is doing, and the industry’s able to expand because it’s able to keep getting capital from the banks … It’s just this really alarming, really terrifying dynamic going on worldwide.”

The top four financial institutions supporting the fossil fuel industry are all American: JP Morgan Chase, Wells Fargo, Citi, and Bank of America. Two more, Morgan Stanley and Goldman Sachs, aren’t far behind. This is despite all six of these major U.S. banks publishing a joint statement, in the months leading up to the adoption of the Paris deal, acknowledging the threat of climate change, pledging financial support for solutions, and calling for a “more sustainable, low-carbon economy.”

By far, JP Morgan Chase is the biggest funder among the 33 banks assessed, putting $196 billion into fossil fuels from 2016 through 2018. Its money represents 10 percent of the industry’s total financing. Notably, the highest spending year for Chase — and many other top banks — was 2017, the same year President Trump announced the U.S. would pull out of the Paris agreement.

In recent years, public pressure has mounted against banks financing oil, gas, and coal companies. These campaigns have been particularly coordinated and successful in Europe, and the World Bank announced in 2017 that it would no longer finance oil and gas extraction. The same year, France-based PNB Paribas committed to end support of shale and tar sands businesses, and last year, British multinational HSBC stopped financing offshore oil and gas projects in the Arctic.

“There’s new legislation and national legislation in European countries that are forcing banks to move in the right direction much, much quicker than the U.S. banks,” McCully says. “[U.S. banks] don’t feel the same sort of public pressure, and they definitely don’t feel the same sort of political pressure.”

Efforts and success in the U.S. have been more limited. The most pressure so far has come from activists, led by indigenous groups, that have targeted banks supporting the Dakota Access pipeline. Protesters have also rallied outside Chase and Wells Fargo over their fossil fuel funding in recent years. But the United States is home to several of the world’s biggest oil and gas companies, including Exxon Mobil, Chevron, and ConocoPhillips, and the industry holds huge political influence, particularly since U.S. production of fossil fuels has surged over the past decade. In 2018, lobbying for oil and gas topped $124 million — more than double what it was 15 years ago — putting significant pressure on politicians to resist climate action despite dire warnings from the Intergovernmental Panel on Climate Change that the world has just over a decade to act to avert catastrophe.

“Our financial system is basically not responding to that threat at this point,” says Yossi Cadan, the senior global campaigner on divestment for 350.org. “The notion that politicians are not going to act is the current financial assumption. And if you think like that, and you say, OK, politicians are not going to regulate the extraction of fossil fuels … then we may be able to burn everything that we have and make a profit out of it.”

Still, banks have made very public commitments in recent years to finance sustainable companies and projects or to go carbon-neutral. Last year, Wells Fargo, the second biggest fossil fuel funder, committed $200 billion in financing through 2030 to projects and businesses focused on transitioning to a low-carbon economy. In 2017, the institution invested $12 billion in sustainable businesses — but it put more than four times that toward financing fossil fuels the same year.

Citi, Bank of America, and Chase have made similar pledges, all of which pale in comparison to their fossil fuel financing. In 2017, Chase announced it would be 100 percent renewable energy–reliant by 2020 and committed $200 billion in clean energy financing by 2025. But it has spent almost the same amount financing fossil fuels in just the past three years. And while Chase CEO Jamie Dimon publicly criticized President Trump’s decision to pull out of the Paris agreement, the bank’s longest sitting board member is Lee Raymond, the former board chair and CEO of Exxon. Well known for his public skepticism of climate change, Raymond led Exxon during a time when it was pouring tens of millions of dollars into funding climate change denial.

The report also reveals that Chase is the top financier of three major categories of fossil fuel projects — Arctic oil and gas, ultra-deepwater drilling, and liquefied natural gas — and that it is also the top U.S. banker for two others: tar sands oil and coal mining. It is second only to Wells Fargo in financing fracking. Chase did not respond to requests for comment from Mother Jones.

The broad increase in fossil fuel funding comes as many people consider fossil fuels to be economically unsustainable. Oil and gas companies face the prospect of stranded assets if governments tighten environmental regulations, if energy demand shifts toward renewables, or if companies face litigation and increased scrutiny from concerned shareholders — all of which are currently underway. The coal industry in the U.S. is on its last legs, despite the Trump administration’s efforts to prop it up. About 75 percent of U.S. coal production is more expensive than solar or wind energy, according to a report released this week. And it’s getting harder for the industry in general to make money. Yet oil companies have continued to aggressively pursue fossil fuel development, and the world’s major banks are supporting them. Alarmingly, the new data shows that banks (again, led by Chase) put $600 billion behind the 100 companies most focused on expanding fossil fuel production, accounting for almost one-third of all fossil fuel financing.

“Even if the bank thinks in seven years it might be a problem, they say, ‘Well, we’ll be out of here in three years,’” McCully says. “You say economically why would they do it, but even morally why would they do it? If they think they’re leaving this completely decimated world to their kids and grandkids, wouldn’t they want to do something about it? But it just seems like they’re unable to look beyond the next quarter, maybe the next year. They just don’t have long-term economic or moral vision.”

As banks become increasingly crucial to the future of fossil fuels, they could also play a particularly critical role in the fight to reduce greenhouse gas emissions and slow global warming. Without the support of banks, U.S. coal companies would be decimated since a lack of liquid assets makes them reliant on loans, Cadan points out. And while oil companies have enough assets to finance themselves for a while, it’s largely unsustainable long-term, especially because without financing, new investments are increasingly risky and costly. Banks “can determine the pace of how we combat climate change,” Cadan says. “It’s black and white. With the help of financial institutions we can easily be in a different space. If they take real action.”

“Ultimately, it doesn’t matter how many solar panels we have,” McCully adds. “If we’re still building lots more coal plants and oil fields, clean energy is not going to help.”

Why Toledo just gave legal rights to Lake Erie

Lake Erie provides drinking water for 11 million people, and an unusual tactic to protect it was just adopted in Toledo, Ohio: On Tuesday, Toledoans passed the “Lake Erie Bill of Rights” in a special election, with 61 percent voting yes on a ballot measure that could allow citizens to sue polluters on behalf of the lake.

“This is the first in the nation in terms of rights-of-nature law being adopted by a municipality over a certain ecosystem, and I think it’s the beginning of more things to come in that area,” said Thomas Linzey, executive director and chief legal counsel for the Community Environmental Legal Defense Fund, which helped local activists draft the bill.

The ballot measure will amend the city’s charter to establish that Lake Erie has the right to “exist, flourish, and naturally evolve.” The goal of giving the lake legal rights, Linzey said, is for activists to be able to do “a survey of who’s the biggest polluters into the lake” and then bring lawsuits “to stop that pollution,” he said.

Runoff pollution is a major cause of Lake Erie’s algae blooms, which can make water toxic to fish, wildlife, and people. This kind of pollution occurs “when rainfall washes fertilizer and manure spread on large farm fields into streams that flow into Lake Erie,” according to the Alliance for the Great Lakes.

Past problems with Lake Erie’s water quality prompted organizers to think about new ways to safeguard it. Back in 2014, the City of Toledo issued an advisory for residents not to drink municipal water after chemical tests found unsafe levels of an algal toxin. The toxic algae bloom left 110 people sick and nearly half a million without tap water. Ohio even declared a state of emergency.

“For three days in 2014, we lost access to our drinking water, and we didn’t see any action come out of that,” Markie Miller, an organizer for Toledoans for Safe Water, told CityLab. “We wanted to do something for ourselves.”

The concept of giving rights to nature originates, at least within the U.S., from an article by Christopher Stone published in 1972 in the Southern California Law Review: “Should Trees Have Standing? — Toward Legal Rights for Natural Objects.” Since then, the idea has gained traction internationally. In 2008, Ecuador became the first country to recognize rights of nature in its national constitution. And in 2010, Bolivia’s legislative assembly passed the “Law of the Rights of Mother Earth.”

The basic principle is that of legal standing: Under the U.S. Constitution, to have standing, one needs to show direct injury to oneself caused by some entity, and there must be some redress, or remedy, that can be found in court. Activists hope that with these new rights, Lake Erie will have standing in court without needing to demonstrate injury to a human.

The U.S. Clean Water Act addresses point-source pollution, from a confined and discrete source. But a significant percentage of what plagues Lake Erie is diffuse, non-point-source pollution, such as excess fertilizers from agriculture and urban stormwater runoff.

The fact that Toledoans endorsed such an unusual means to combat pollution reflects an understanding that current regulations aren’t sufficient, said Madeline Fleisher, senior attorney in the Environmental Law & Policy Center’s Columbus office. “The citizens of Toledo are clearly and rightfully frustrated. I understand why they’re trying novel approaches to try to get those issues addressed.” (As is common in local special elections, turnout in Toledo’s was low; just shy of 9 percent of registered voters cast ballots.)

The proposal has been contentious. The board of elections in Lucas County (whose seat is Toledo) voted to block it from the ballot in the November 2018 election. After several months of debate, the board ultimately voted in December to add it to the February special election because of an Ohio Supreme Court decision, as the Toledo Blade reported. One board member said he still believed the measure was “on its face unconstitutional and unenforceable.”

Opponents of the Lake Erie Bill of Rights are concerned about the costs of litigation for farms and businesses. The Ohio Farm Bureau Federation already pledged its support for a lawsuit farmer Mark Drewes filed in the Federal District Court for Northern Ohio Wednesday, challenging the constitutionality of the bill.

“Farmers want and are working toward improving water quality, but this new Toledo law hurts those efforts. Mark Drewes understands this, and it’s Farm Bureau’s job to back his important actions on behalf of Ohio farmers,” the executive vice president of the Ohio Farm Bureau, Adam Sharp, said in a statement.

The suit contends that the measure violates federal constitutional rights, including equal protection and freedom of speech. Additionally, it argues that the bill of rights violates Ohio state law in several ways. For example, it contends that Toledo as a local government cannot override the Ohio state governing structure of Lake Erie, since the Ohio Department of Natural Resources governs the lake under state law.

“One of the biggest challenges that the [Lake Erie] Bill of Rights will have is moving from vision to enactment,” said Cinnamon Carlarne, an Ohio State University law professor. “That is part of a larger conversation trying to advance the role that law plays in protecting ecosystems for a variety of reasons — not the least of which is that we are, as humans, fundamentally dependent on them.”

The Earth’s surface is 70 percent water, but even that underestimates how vital ocean health is to our planet’s ability to maintain life. Recent results from scientists around the world only further confirm that our waterworld is in serious danger.

Last week, a bombshell study confirmed that the oceans are warming 40 percent faster than many scientists had previously estimated. The finding partially resolved a long-running debate between climate modelers and oceanographers. By measuring the oceans more directly, scientists again came to a now-familiar conclusion: Yes, things really are as bad as we feared.

The ocean stores more than 90 percent of all excess heat energy due to the buildup of greenhouse gases in the atmosphere. From the standpoint of heat, global warming is almost entirely a story of how rapidly the oceans are changing.

Warming oceans work to melt polar ice, of course, thereby raising sea levels. But hotter oceans change how the atmosphere works, too. More heat energy in the oceans means more heat energy is available for extreme weather: Downpours of rainfall are happening more often, hurricanes are shifting in frequency and growing in intensity, freak ocean heat waves are spilling over into temperature records on land. Melting Arctic and Antarctic sea ice is also increasing wave height, which is accelerating coastal erosion — worsening the effects of sea-level rise.

The now-inevitable loss of nearly all coral reefs — home to a quarter of the ocean’s biodiversity — is the most charismatic of the impacts. The changes to the world’s oceans are shifting marine ecosystems on a grand scale, all the way down to phytoplankton, the base of the planet’s food web.

Last month, a study found that the “Great Dying,” the worst mass extinction in Earth history, was triggered by a period of global warming comparable to what’s predicted for us under business-as-usual conditions. The study asked: Could we be on a similar path as 252 million years ago, when most marine life was snuffed out after the warming seas lost most of their oxygen?

The answer, almost entirely, comes down to what we collectively decide to do in the next decade or so.

CO2 sticks around in the atmosphere for about 100 years. The lag time of ocean heating — the amount of time it takes for the energy of a particularly warm day at the sea’s surface to reach all the way to its deepest depths — is about 2,000 years. Oceans act as a massive storage system to retain that heat over very long timescales.

It’s why, if we’re going to limit warming to less than 1.5 degrees C (2.7 degrees F), the IPCC says that not only do we need to cut emissions immediately — with a 50 percent reduction globally by 2030 — but we also need to work to draw down the greenhouse gases that are already in the atmosphere, through massive reforestation and other means. We simply don’t have time to wait for them to dwindle on their own.

By changing the atmosphere to capture more of the sun’s energy, we’re adding the equivalent of four Hiroshima bombs of heat energy every second to the oceans. In 2018, the oceans gained about 9 zettajoules of heat energy. (For reference, annual energy use for all of human civilization is about 0.5 zettajoules.) There’s just no way to remove that heat once it’s there. It will inevitably end up leaking into the atmosphere, intensifying our experience of a warming planet even further.

Even if a future human civilization decided to embark on a geoengineering project to offset the atmospheric effects of climate change, there is no practical physical mechanism to cool down the 325 million cubic miles of ocean water on the planet.

Combined with other stressors like overfishing, acidification, plastic pollution, and nutrient runoff, the oceans are already experiencing geological-scale changes. This is the grandest of possible wake-up calls: We are in the emergency phase of climate change. In order for things to get back on track and avoid further radical changes to our planetary life-support system, we have to make radical changes to our culture and society.
