There’s a Good Reason Democrats Aren’t Opposing Every Trump Nominee Unanimously

Why aren’t Democrats voting against President Trump’s cabinet nominees en masse? Is it because they’re just a bunch soft-headed Beltway lifers who don’t understand that the base is pissed and wants them to fight fight fight?

Nope. I’m sure they all get that. But there are two reasons not to do this. The first is simple: the tradition that presidents should be able to choose their own cabinet officers really is important. It’s important on its own merits, and it’s also important politically. We simply can’t get to the point where opposition parties routinely vote against every appointee for everything. That would be disastrous anytime different parties control the Senate and the White House.

But maybe this is still too wishy-washy for you. So here’s another reason: if Democrats vote against everyone sight unseen, then Republicans will vote for everyone sight unseen. However, if Democrats demonstrate that they’re considering each candidate on the merits, they have at least a fighting chance of defeating one or two of Trump’s nominees. Betsy DeVos, for example, has shown that she’s flatly ignorant of an astounding amount of basic education policy. It might be possible to persuade two or three Republicans to oppose her on these grounds—but only if the entire confirmation process isn’t a pure partisan battle.

So that’s that. There’s a principled reason for not opposing everyone unanimously, but there’s also a pragmatic reason. It won’t make a huge difference, but it might keep one or two of Trump’s worst qualified nominees out of the cabinet.

What Does It Take for the Press to Call a Lie a Lie?

Watching the inauguration yesterday, I saw the smallish crowds just like everyone else. My immediate thought was: Oh God, this means tomorrow will be a 24/7 offensive from the White House about how this was the biggest inaugural crowd ever in history. The boy king will demand no less.

Sure enough, that’s what we got. Trump went out to visit the CIA today and informed everyone that the inauguration crowd was at least a million, maybe a million and a half. Then he sent out his press secretary, Sean Spicer, to deliver an unprecedented screed, yelling at the assembled reporters about how dishonest they were and then spewing out a whole array of fabricated numbers to back up his boss’s lies. When he was done, he turned on his heels and left without taking any questions.

I’m not interested in pointless discussions of whether Trump does this stuff to distract us (in this case, from the massive number of people at the women’s marches around the country). I suppose that’s part of it. But it’s obvious from decades of watching Trump that he simply can’t abide any criticism, either express or implied. Everything he does has to be the biggest and best. He’s incapable of not lashing out when anyone suggests otherwise.

That’s obvious enough to be banal at this point. What I’m more interested in is when the media is going to get over its faintheartedness and start calling this stuff what it is: lies. On MSNBC, Jim Sciutto reminded us that Trump frequently says things that “defy the facts.” CNN wrote about Spicer’s “misstatements of fact.” The New York Times said Trump’s crowd numbers were “false.” Other newspapers said the same thing in different ways.

But even by the strictest definition, Trump and Spicer were lying. Trump made up his numbers out of thin air, knowing perfectly well they were based on nothing. Spicer delivered a whole bunch of numbers that were obviously either invented or just plain fake—and did it in an angry tone that was clearly meant to intimidate everyone in the room.

All of this stuff was not just “false,” it was knowingly false. Everyone knows this. So let’s cut out the delicate language and the earnest panel discussions about whether Spicer might have a point about one thing or another. He was lying. Trump was lying. Can’t we be adults and just say so?

Donald Trump Just Replaced the White House Climate Website With…This

As Donald Trump was sworn in Friday, the White House website got a major makeover. One of the casualties in the reset: any mention of the need to fight climate change.

The original White House page dedicated to the problem of climate change and former President Barack Obama’s policies to address it is now a broken link: “The requested page ‘/energy/climate-change’ could not be found.”

Instead, the White House website features Trump’s energy talking points from the campaign. The page—titled, “An America First Energy Plan”—makes no mention of climate change, other than to say, “President Trump is committed to eliminating harmful and unnecessary policies such as the Climate Action Plan and the Waters of the US rule. Lifting these restrictions will greatly help American workers, increasing wages by more than $30 billion over the next 7 years.”

The page contains only the briefest of mentions of the environment: “Protecting clean air and clean water, conserving our natural habitats, and preserving our natural reserves and resources will remain a high priority. President Trump will refocus the EPA on its essential mission of protecting our air and water.”

Thanks For Everything, President Obama. We’re Going to Miss You.

It’s less than 24 hours until Barack Obama leaves the White House. In eight years, here’s my top ten list of what he accomplished:

  1. Affordable Care Act
  2. Stimulus package
  3. Climate actions: Paris agreement, EPA power plant standards, auto mileage standards, etc.
  4. Dodd-Frank financial reform
  5. Iran nuclear treaty
  6. Killed Osama bin Laden
  7. Allowed gays to serve openly in the military
  8. New START treaty
  9. Delivered 74 consecutive months of job growth
  10. Declined to get seriously involved in Syria

I’m keenly aware of all the criticisms you can make of this list: the stimulus wasn’t big enough; Dodd-Frank didn’t go far enough; Obamacare doesn’t have a public option; cap-and-trade failed; the surveillance state became permanent; there was no help for underwater homeowners; there are still troops in Iraq and Afghanistan; and so forth. These are all legit. Nonetheless, if you compare this list to other presidents of the past century, there aren’t more than three or four who can match it. Here in the real world, that’s pretty good.

On foreign affairs, Obama got better as he spent more time in office. In 2009 he approved a huge surge of troops into a hopeless fight in Afghanistan. In 2011, he resisted intervening in Libya but eventually agreed to a middling-size offensive. Finally, by 2013, he had learned his lesson and simply refused to allow more than a modest bit of engagement in Syria. And thank God for that. If we had committed seriously to Syria, we’d be fighting a massive two-front war there to this day. Anybody who thinks otherwise is just not paying attention.

In the end, Obama wasn’t a transformative president. But that’s a high bar: in my book, FDR and Reagan are the only presidents of the past century who qualify. Still, Obama turned the battleship a few degrees more than most presidents, and we’re all better off for it. He also brought a certain amount of grace and civility to the White House, as well as a genuine willingness to work across the aisle. In the event, that turned out to be futile, because Republicans had already decided to oppose everything he did sight unseen. But he did try.

I don’t know how much of his legacy will survive. A fair amount, I think, since repealing things like Obamacare, Dodd-Frank, and the Iran treaty are harder than they look. But some of it will fade or evaporate in the Trump era. And Obama was never able to make any headway against the anger that festers in the hearts of so many Americans toward the poor, the non-white, the non-male, the non-straight, and the non-Christian. Now this anger will guide our next four years. I miss him already, the best president of my lifetime.

Jeff Sessions Has a History of Blocking Black Judges

Alabama is nearly 30 percent black, but only three African American judges have ever sat on a federal bench there. Advocates for judicial diversity in the state say that in recent decades, that’s thanks largely to Jeff Sessions, the Republican senator from Alabama whom Donald Trump has nominated to be his attorney general. During his 20 years in the Senate, they say, Sessions has used his perch on the judiciary committee to block nearly every black candidate for a judgeship in his state.

“The senator has a problem putting African Americans on the federal bench in Alabama,” says John Saxon, a Birmingham-based attorney who served on a committee in the 1990s that recommended nominees for judgeships in the state. “And the people need to know that.”

The Senate will hold confirmation hearings over Sessions’ nomination for attorney general on Tuesday and Wednesday. If it votes to confirm him, Sessions will wield significant influence over issues of particular importance to African Americans and other minorities, such as the application of the nation’s civil rights laws. Sessions has a troubled history on race relations that, along with his far-right views on immigration and other issues, has aroused strong opposition from civil rights leaders to his nomination. In 1986, the Senate failed to confirm Sessions, then a federal prosecutor, for a federal judgeship after witnesses at his confirmation hearing claimed Sessions had called a black colleague “boy,” labeled civil rights groups including the NAACP “un-American,” and joked that he used to like the Ku Klux Klan before he learned that its members smoked marijuana. Sessions has denied the first charge and said the other comments were taken out of context.

Those allegations have haunted his career, although he was elected Alabama attorney general in 1994 and to the US Senate two years later. But his track record on African American judges has received far less scrutiny.

For years, Democrats have tried to remedy the inequality in Alabama’s court system by appointing more black judges. Nearly every time, Sessions has succeeded in stopping them.

In 1996, Judge Alex Howard in the Southern District of Alabama retired, creating a vacancy on the same court where Sessions couldn’t get confirmed 10 years prior. At the time, Saxon served on a federal appointments committee overseen by the state Democratic Party, and the committee quickly began vetting potential replacements. The Southern District—whose largest city, Sessions’ hometown of Mobile, is majority African American—has never had a black judge, so the appointments committee unanimously decided that the position should go to an African American, several former members of the committee recall. The committee sent a list of several respected black lawyers and jurists in southern Alabama to the White House, but none of them was ever nominated for the position. According to Saxon, this is because Sessions had informed Bill Clinton’s administration that he opposed every name on the list. Though Sessions had no constitutional power to block their nominations, senators are given significant sway over nominees in their states. And as a member of the judiciary committee, Sessions could have used procedural maneuvers to hold up their nominations indefinitely.

“For four years, the entire second term of Bill Clinton’s administration, that federal district judgeship sat empty, and the only reason it sat empty is Jeff Sessions blocked it,” says Saxon. “And in my opinion, the only reason he blocked it is because we made it clear from day one it’s time to put an African American on the federal district bench in the only district in Alabama that hadn’t had one.”

Other members of the appointments committee, some of whom declined to speak on the record, agree that Sessions played a role in preventing the black judicial candidates from being nominated. The White House, they say, was not the problem: Several of them spoke to White House officials who were willing to nominate those black judges, as did other prominent Democrats in the state.

“It was definitely Jeff Sessions that was preventing the appointment of an African American,” recalls Democratic state Sen. Hank Sanders of Mobile, who remembers a White House official pointing to Sessions to explain why none of the black candidates were being put forward for confirmation.

“Senator Sessions voted to confirm Eric Holder for Attorney General as well as judges like Abdul Kallon, Charles Wilson, Janice Rogers Brown, and Miguel Estrada and has put forward a number of women from his state as well,” Sessions spokeswoman Sarah Isgur Flores says in an email response to questions about Sessions’ record on black judges. “As Senator, Jeff Sessions consistently voted for judges who would say what the law is and not what the law should be by substituting their own ideological preferences.”

In the late 1990s, Saxon had the opportunity to appeal personally to Sessions about the vacant Southern District seat when he encountered the senator at a University of Alabama football game. As Saxon recalls, the two men huddled together in the university president’s private box to discuss the open judicial seat, and Sessions repeatedly told Saxon that he couldn’t live with any of the candidates the committee had suggested. So Saxon invited Sessions to propose a different black candidate for the position from anywhere in the state. There were several potential candidates who could have appealed to Sessions, Saxon says. One was Ken Simon, a black lawyer and former state judge who had served in the Ronald Reagan administration and worked at the state’s largest corporate defense firm. “He’s not some flaming liberal,” Saxon says. But Sessions didn’t put forward Simon’s name, or anyone else’s.

“I can’t get in the man’s heart or his soul,” says Saxon. “But I will tell you it’s awfully curious that he blocked any of those names going forward and refused to come up with an alternative name with us saying, ‘Jeff, it’s time to desegregate the Southern District.'”

Saxon’s committee eventually decided that filling the Southern District vacancy with an African American was hopeless and put forward Donald Briskman, a respected Jewish lawyer in Mobile. Sessions blocked him, too, according to Saxon. In 2001, at Sessions’ behest, President George W. Bush nominated Callie Granade, an assistant US attorney whom Sessions had mentored when he was the chief prosecutor in the district. She was confirmed with Sessions’ support.

Sessions’ opposition to black judges in Alabama doesn’t seem to have dissipated over the years. President Barack Obama is leaving office with five district court seats in Alabama unfilled, and a vacancy reserved for an Alabama judge on the 11th Circuit Court of Appeals sits empty. Democrats tried to fill some of those open seats with African Americans, but years of conversations between the White House and Alabama’s two Republican senators, Sessions and Richard Shelby, broke down, with the senators refusing to give approval to any of Obama’s picks. “I think the holdup is basically the White House is ready to nominate some individuals but would like to have some assurance from our senators…that they’re going to at least give some positive thought toward the individuals the president nominates,” Nancy Worley, the head of the Alabama Democratic Party, told the Montgomery Advertiser in 2015.

The only exception to this pattern was the confirmation of Abdul Kallon, a black lawyer, to a federal district judgeship in 2009. But because Kallon replaced retiring Judge U.W. Clemon, a Jimmy Carter appointee and the first African American federal judge in Alabama, the diversity of the state’s bench didn’t change. Clemon tells Mother Jones he believes Sessions’ close ties to the corporate law firm where Kallon was a partner, Bradley Arant Boult Cummings, played a role in Sessions’ decision to support his nomination. Bradley Arant has a lobbying presence in Washington, and two former Sessions aides have gone on to work at the firm. According to the Center for Responsive Politics, Bradley Arant and its attorneys are the seventh-biggest donor to Sessions’ political campaigns over the course of his Senate career.

Still, Sessions’ support of Kallon only went so far. When Obama nominated Kallon to the vacant 11th Circuit seat in February 2016, Sessions opposed his confirmation. One-quarter of the residents of the 11th Circuit, which represents Alabama, Georgia, and Florida, are black—the highest percentage of any federal appeals court in the country—but only one of the court’s 11 judges is African American. The seat on the court reserved for an Alabaman has never been held by a black judge.

The five open seats on Alabama’s federal district courts will now be Trump’s to fill. Liberals have criticized the Obama administration for failing to nominate more people of color in Alabama and other Southern states and for not fighting vigorously enough for the confirmation of the candidates he has nominated. But with Sessions on the judiciary committee, confirming black judges, particularly in Alabama, might have been an uphill battle.

“I have always found that it is very easy to get white lawyers to be judges, and it is very hard to get black lawyers to be judges,” says Joe Reed, a longtime Democratic activist in Alabama who served with Saxon on the appointments committee.

During Obama’s second term, Reed and Sanders, the state senator, traveled to Washington to meet with Sessions, Shelby, and Rep. Terri Sewell, the only Democrat in Alabama’s congressional delegation, with the goal of confirming multiple judges—including African American ones—in Alabama and on the 11th Circuit. Reed appealed to the senators by invoking their place in history. “You’ve got a legacy,” he recalls telling them. “I don’t know anybody who’s ever come out great, or been considered great or good, unless they came down on the side of justice, on the side of civil rights, on the side of racial harmony and progress. I don’t know anybody who’s ever been on the other side and looked good.” The senators responded, he says, by telling him they wanted fair judges.

After the meeting, Reed and Sanders hung back and spoke with Sessions alone. “The meeting was over, and Dr. Reed said, ‘Hank, let’s try to talk to Sessions,'” Sanders says, in an account confirmed by Reed. “‘Cause we considered Sessions a problem. We didn’t consider Shelby the same problem.” But this second attempt also fell apart when Sessions brought up the fact that Sanders had testified against his confirmation to a federal judgeship in 1986.

“Thirty years later, that was still something he was holding in his craw,” Sanders says. “My interpretation of the message was, ‘You’re not going to get anything out of me. You all stopped me from being a federal judge, and you’re not going to get anything out of me.'”

Business Community Shocked That Trump Might Impose Import Tariffs

CNN reports that the business community is shocked at the idea that Donald Trump might impose import tariffs when he takes office:

Two sources who represent business interests in Washington tell CNN that the man in line to be White House chief of staff, Reince Preibus, has told key Washington players that one idea being debated internally is a 5% tariff on imports….Priebus, the sources said, was warned such a move could start trade wars, anger allies, and also hurt the new administration’s effort to boost the rate of economic growth right out of the gate.

One of the sources said he viewed the idea as a trial balloon when first raised, and considered it dead on arrival given the strong reaction in the business community — and the known opposition to such protectionist ideas among the GOP congressional leadership. But this source voiced new alarm Tuesday after being told by allies within the Trump transition that defending new tariffs was part of the confirmation “murder board” practice of Wilbur Ross, the President-elect’s choice for commerce secretary.

You know, I mostly feel kind of sorry for all the working-class folks who voted for Trump because they fell for his con. But you know who I don’t feel sorry for? The business community, which largely supported Trump because they thought they were too smart to be conned. He won’t really impose tariffs. He won’t really take revenge on companies that move jobs overseas. He won’t really crack down on all those illegal immigrants we give our dirtiest jobs to.

They just wanted their tax cuts and their pet regulatory changes. They didn’t care about all that racist, nativist, protectionist blather. It was just for show, anyway, wasn’t it? Ha ha ha. Right?

Well, Paul Ryan may save them in the end. We won’t know for a while. But these are rich, educated folks. They knew who Trump was. They knew he was spectacularly unqualified. They knew he was thin-skinned. They knew he was unstable. They knew he was egotistical. They knew he was vengeful. They knew he was dangerous. But they supported him anyway because they wanted their tax cuts. If they eventually find themselves on the business end of Trumponomics, I’m just going to lie back and snicker at them.

Corey Lewandowski Opens Lobbying Shop to Cash in on Trump. Here’s What He Once Said About Lobbyists.

In February, Corey Lewandowksi, who was then Donald Trump’s campaign manager, was interviewed by Trump’s future campaign chairman (and now senior White House adviser) Stephen Bannon about the role lobbyists play in Washington. Lewandowski’s response was unambiguous and venomous. Trump’s election, he declared, would mark the end of influence-peddling by political insiders. Here’s how he put it:

This is the fundamental problem with the ruling class in Washington, DC—the party bosses, the K Street crowd, the lobbyists who control all these politicians. They will do anything to maintain their power. They will do anything. They will say anything. They will spend whatever it takes because they know that if Donald Trump becomes the nominee and ultimately the president of the United States, the days of backroom deals are over. He will only be responsible to the American people. And so what you have is a series of people who’ve made a very, very good living by controlling politicians through their donations and making sure they get the legislation done—or not done—in Washington, DC to best benefit their clients. And those days are coming to an end.

But maybe not just yet.

On Wednesday morning, Lewandowski announced that he and another former Trump campaign veteran, Barry Bennett, are opening up a lobbying and political consulting firm in the swamp their ex-boss vowed to drain.

Without a hint of irony, the first sentence of Lewandowski’s press release points out that his offices will be just one block from the White House. He didn’t note that this is also one block from K Street, the ground zero of Washington influence-peddling, or Swamp Central. The next sentence touts Lewandowski’s close relationship with Trump. As in, we’re going to cash in on my insider connection to the guy in the White House.

For Lewandowski, this is actually a return to lobbying. As Mother Jones reported in March, Lewandowski was a registered lobbyist in the mid-2000s. In fact, Lewandowski lobbied for green energy subsidies. (One of his former clients told Mother Jones that Lewandowski was helpful to the funding of a publicly owned solar project in Massachusetts.) And he did this, as he headed up the New Hampshire chapter of government-bashing Americans for Prosperity.

It’s not clear if Lewandowski will once again register as a lobbyist. The firm’s announcement describes it as a full-service government relations and political consulting firm. But even if he sticks to the “consulting” side of things, his new gig might still make Trump campaign reunions awkward. On Tuesday, Kellyanne Conway, who led the Trump campaign in its final months, lashed out at Washington culture and “political consultants” in particular.

“Draining the swamp is not just about lobbying and politicians, it’s also about consultants,” Conway told conservative radio host Laura Ingraham, adding that she viewed political consultants as a “staff infection.” By the way, Conway has long been a political consultant.

President Obama just made his final campaign pitch for Hillary Clinton at an energetic election eve rally in Philadelphia. In a roughly 18-minute speech, Obama emphasized that, even after a turbulent and sometimes divisive eight years in the White House, he still believed in voters’ capacity for hope, and urged them to turn out to vote for Clinton: “She will work, she will deliver, she won’t just tweet.”

“I’m betting that America will reject a politics of resentment and a politics of blame,” he said. “I’m betting that tomorrow, you will reject fear, and you will choose hope. Your local farmers market stand might be reselling produce.

The Republican candidate on Monday promoted his plan to purportedly save the government $100 billion over eight years. It involves cutting all federal spending on climate change programs, both domestic and international.

“We’re going to put America first,” Trump said at a Michigan rally. “That includes canceling billions in climate change spending for the United Nations, a number Hillary wants to increase, and instead use that money to provide for American infrastructure including clean water, clean air, and safety.”

As Bloomberg BNA reports, Trump didn’t give a precise tally for how he got to $100 billion:

[The] campaign press office said that the figure combined an estimate of what the Obama administration had spent on climate-related programs, the amount of U.S. contributions to an international climate fund that Trump would cancel, and a calculation of what Trump believes would be savings to the economy if Obama’s and Clinton’s climate policies were reversed.

That math, however, doesn’t work out: According to a 2014 report from the White House’s Council of Economic Advisers, a global temperature increase of just 3 degrees C would cost the United States 1 percent of GDP, or $150 billion a yearby damaging public health and infrastructure and battling sea-level rise, stronger storms, declining crop yields, and increased drought and wildfires.
