New Yorkers might soon have a constitutional right to clean air and water

Lawmakers in Albany saw green on Tuesday as the Dem-controlled New York State Legislature passed a broad package of environmentally friendly bills, including nods to toxic toys, solar power, and even the humble dragonfly. But one of the biggest proposed changes is an amendment to the state constitution that would guarantee New Yorkers the right to clean air and water, and a healthful environment.

“For far too long, common sense environmental measures that would protect our air, water, and our health had little chance of becoming law in New York,” Peter Iwanowicz, the executive director of Environmental Advocates of New York, told the New York Daily News. “Now, in just one afternoon, the Legislature is making up for lost time by passing a suite of bills that will protect New Yorkers’ health and the precious natural resources we all love and enjoy.”

Here’s a roundup of a few of the measures, which will now go to Governor Andrew Cuomo to be signed or vetoed:

Show me the hazards

Bill S.181 requires the Department of Environmental Conservation to publish a list of areas in New York that are most adversely affected by existing environmental hazards. Senator José Serrano, who sponsored the bill, said he hoped the list would call more attention to environmentally overburdened and disadvantaged communities when the state considered future projects.

“As we move toward a greener, cleaner New York, we must make balanced and informed decisions on environmental matters as we protect the health and well-being of all New Yorkers,” he said.

It’ll get safer to chew on toys and jewelry

A handful of state bills took aim at harmful chemicals in toys, agriculture, and jewelry — happy news for crunchy parents and not-so-good news for several New York manufacturers.

Bill S.501B establishes strict regulations on certain chemicals in children’s products. Another bill, S.5343, prohibits the use of the widely used brain-damaging pesticide chlorpyrifos (except, for some reason, on apple tree trunks). Studies have linked prenatal exposure of chlorpyrifos to a variety of developmental issues in children, including lowered IQ.

If you’re a compulsive necklace gnawer, you’ll be happy to know that bill S.4046 requires jewelry containing 40 parts per million of lead to carry a warning to notify parents and consumers about jewelry that “may be harmful if eaten or chewed.”

And a light bit of legislation: Bill S.2139 ensures mercury-added lamps (which include fluorescent lamps, neon signs, and car headlights) sold in the state do not contain excessive levels of mercury.

A neighborly approach to solar power

Bill S.4742A prohibits homeowners’ associations from restricting the installation or use of solar power systems and bill S.752 increases the tax credit provided for solar energy system equipment.

A day for dragonflies

What are you doing on Saturday, June 8? Well if you’re in New York, you could celebrate the state’s new dragonfly day, courtesy of a new proclamation from Governor Andrew Cuomo. Organizers say it’s an opportunity to recognize the environmental value of the state wetlands and learn more about ways to reduce CO2 emissions.

Life, liberty, and clean air and water

That’s not all, folks. Perhaps the biggest piece of legislation is the Green Amendment, a.k.a. bill S.2072. The bill proposes a 15-word amendment to Bill of Rights in the New York State Constitution: “Each person shall have a right to clean air and water, and a healthful environment.”

Proponents say the new wording would allow the justice system to prosecute violations of the amendment, while critics point out that the vague wording could create confusion. “What is clean?” asked Republican Assemblyman Andy Goodell during Tuesday’s floor debate.

If Governor Cuomo signs off on the bill, New York would only become the third state — after Montana and Pennsylvania, which passed similar measures in the 1970s — to recognize environmental rights as on par with other political and civil liberties.

“The Senate Majority is working to protect our environment for future generations even if our federal government continues to counter important efforts to mitigate climate change,” Senator David Carlucci and Green Amendment sponsor said. “This package of bills […] will help ensure New Yorkers have healthier communities, safer drinking water, more sources of clean energy, and less exposure to harmful chemicals.”

An alternative timeline of what the Clinton-Trump debates could have been.

Lower-income communities are getting shut out from bike-sharing programs, and New York City is an especially bad culprit.

The problem with Citibike, New York City’s program, is that it’s largely inaccessible in low-income neighborhoods, writes Noah Zuss on City & State New York, a local politics and policy website.

You can’t find Citibike stations in vast swaths of the city. The Bronx, the country’s poorest urban county, has none. Most of blue-collar Queens is also ignored, as is Manhattan’s least-affluent portion north of 110th Street.

The other problem is cost. Citbike runs $12 per day. It’s $14.95 a month for an annual membership, but you need to have a credit or debit card to sign up, which excludes many low-income New Yorkers. Even Citibike’s discount program for public-housing residents requires a credit or debit card.

It’s a similar story in Boston, Washington, D.C., and Denver: Bike-sharing programs are disproportionately used by affluent white people. Cities have responded with subsidized discount memberships for lower-income residents without much success yet.

What’s the solution? Last month, a report from the National Association of City Transportation Officials suggested month-to-month memberships and cash payments to make bike-sharing more accessible.

Annual heat-related deaths in New York City could soar by more than 500 percent by the 2080s, according to a new study.

Published in the journal Environmental Health Perspectives, it finds a wide range of potential outcomes depending on how much warming we endure, how New York’s demographics shift (elderly people are more likely to die from heat), and whether the city proactively adapts to the more severe heat waves that are certain to come. Deaths could be reduced by more cooling centers, more widespread air-conditioning, and construction of buildings better suited to climate shifts.

An average of 638 people died annually from heat-related causes in New York City between 2000 and 2006. If the city gets serious about adaptation and temperatures rise as little as possible, annual deaths could be reduced to an estimated 167 by later this century. If the city fails to adapt, a worst-case scenario could see deaths increase to 3,331 per year.

In coastal cities, most climate change concerns have focused on rising sea levels and more severe storms, but New York also suffers from hot, humid summers. (This is one reason New Yorkers so often decamp for California, where they can substitute complaining about weather extremes with complaining about the lack of seasons). Heat waves particularly endanger the homeless and low-income people. The time to start adapting is now.

Up to 2000 New Yorkers rallied to show support for Paris Saturday in the wake of Friday’s attacks. Mayor Bill deBlasio spoke, people added their names to an impromptu memorial, and the crowd sang the Marseillaise. “I think it’s important for us to stay together and remain calm,” 22-year-old Andrew Congee told me. “To show how strong the French country is and how important it is for us to enjoy life.”

Here’s a great argument for public transit, in a single image: Check out how gnarly it’d be — and how many dang bridges New York would have to build — if the estimated 2 million-plus people commuting in and out of Manhattan during rush hour each day drove their own cars:

According to an analysis by Vancouver-based highway design engineer Matt Taylor, the city would need a whopping 48 additional eight-lane bridges to accommodate such a travesty.

The next step to his analysis — parking — suggests that if as many people also needed off-street parking, there’d be 62 square kilometers (or almost 24 square miles) of parking space, “equivalent to a layer of underground parking underneath the entire island.” If local residents also drove, he estimates, they’d need TWO layers.

Luckily for New York, though, just 16 percent of commuters actually drive their own vehicles to work these days, and few local residents drive: New Yorkers average about 23 cars per 100 residents, compared to about 78 for the rest of the country. (Though maybe it’d get even better if Manhattan went the way of Paris and started banning cars entirely?)

Anyway, thank goodness this is just a rendering; research repeatedly shows that when we build more roads, all we get is more traffic. We shudder to imagine the gridlock.

Yankees caps, tattooed children, cartoonish women, men riding lions, Nazis in gas masks, dragons in hats: All of these figures decorate the buildings of New York City, and photographer Yoav Litvin’s new book, Outdoor Gallery, is the fulfillment of his mission to bring their vibrant shapes, colors, and lines to a larger public audience. “I learned a visual language spoken by a thriving community of artists that interact with each other, their environment, and a diverse public,” Litvin writes on what inspired his glossy tome on Big Apple street art.

Yoav Litvin, a New York-based writer and science researcher at Rockefeller University, started taking photographs of street art two years ago when he was recovering from a rugby injury. After the ill-fated match, Litvin was left to walking for exercise. The daily walks turned into a project to document what he saw–art work that most New Yorkers typically breeze by without much notice. Before that, he spent years studying the brain and later giving talks on “progressive, creative, and nonviolent causes.” His talents, creativity and attention to detail elevate his photographs and give him a platform to explore the racial, social, and political conversations going on between artists and their communities.

Many of the New York City’s graffiti artists, according to Litvin’s book, started around the age of 10, and thrive on the city’s culture of free expression. Litvin’s book captures the lives and work of 46 artists, whose reasons for painting and backgrounds often diverge, despite their commitment to working with a freedom and openness that’s seldom possible in stuffy indoor galleries. “It seemed like the natural place for art to be,” says Chris Stain, whose portrait of a woman with her young children appears on Brooklyn’s Lafayette Avenue—some of the “common people” he so often paints. Stain tells Litvin he’s been arrested, threatened, and nearly provoked into fistfights during his work sessions. But that’s all part of the process, and the thrill: “There is more drama on TV than what I have to offer.” Now he’s working on a degree in arts education, so he can teach as he continues to paint.

Many of the artistic messages are familiar: give peace a chance, women are treated like objects, death is inevitable. The subjects of race, social struggle, and politics often go hand in hand with the rebellious nature of painting illegally. It’s the variety and personality, the crazy and the unique, in Litvin’s portraits that make his book special: Each artist has a distinctive voice and style. They help shift the graffiti dynamic away from mere vandalism, and become like characters in a street novel—each portrait a new chapter.

My favorites are the strange, absurd, and mystical portraits that are sufficient to make New Yorkers pause from their bustling to ponder for a few seconds. And while some of the art is in that classic bombing style consisting of colorful, jumbled letters—channeling the defiance of leaving your mark on a place—far more compelling are the odd, yet oddly cohesive, works.

Consider QRST’s portrait on Brooklyn’s Troutman Street of a a man with a ram’s head. Naked and cross-legged, he holds a lantern and a bird cage with cardinals inside, all while floating on a broad pink flower. It’s weird and thought-provoking. Why a ram? Why cardinals? Is that peace I see in the ram’s eyes, or a foreboding fortune? And why does ASTRODUB, who graced a wall in Brooklyn’s Williamsburg with a sexy, terminator-esque woman, orange skulls, pink birds, and the words “Love hurts so good” say that she “can’t really identify as a street artist?” How does NDA manage to combine cartoonish elements of children’s books—big yellow faces with pickle-sized noses, purple flowers, dogs—with macabre skulls, dragon snouts, and rap lyrics, and still inspire joy and melodic rhapsody? The book is full of mysteries. And that’s the best part.

“I love this picture a lot,” Litvin says. “Here, I am serving as the photographer whereas Dain’s artwork is my model.”

Hellbent uses abstract colorful patterns and texture for a striking effect.

Kram, a transplant from Barcelona, combines humor and technical skill in his popular work.

“Mimi” appears in many pieces by Shiro, which embody hip-hop and street culture.

5 New York Epidemics That Were Way Worse Than Ebola Will Be

Ebola has arrived in New York City. So should residents here be worried about a widespread outbreak? Almost certainly not: The disease is not airborne, and infected patients are only contagious once they show symptoms. Craig Spencer, the infected doctor in New York, has said he didn’t have symptoms Wednesday night when he rode the subway between Manhattan and Brooklyn and went bowling. Three people he came into contact with, who have not shown symptoms, have been placed in precautionary quarantine. And unlike West Africa, where health care is sparse and low-quality, the US is well equipped to handle cases of the virus; the hospital where Spencer is being treated has been preparing to treat Ebola patients. (Public heath officials in the city expected cases of Ebola to turn up sooner or later.)

But the prospect of a deadly disease outbreak in the Big Apple is still pretty scary, and the city hasn’t always dodged the pathogen bullet. Here are a few epidemics in New York that were far worse than Ebola is likely to be.

Yellow fever (1795-1803):

The city’s first health department was created in 1793 to block boats from Philadelphia, which at the time was in the grips of a yellow fever epidemic that left 5,000 dead. The tactic didn’t work: By 1795 cases began to appear in Manhattan, and by 1798 the disease had reached epidemic proportions there, with 800 deaths that year. Several thousand more died over the next few years. (The disease causes victims’ to vomit black bile and their skin to turn yellowish, and the fatality rate without treatment is as high as 50 percent.) This was no small blow for a city that at the time had only about 60,000 residents. As is the case today with Ebola in West Africa, misinformation was a big part of the problem: Doctors at the time had only just begun to speculate that the virus was carried by mosquitoes (other theorized sources included unsanitary conditions in slums and rotting coffee). Little effort was made to publicize the epidemic for fear of a mass exodus from the city, according to Baruch College. Today yellow fever is extremely rare in the United States but still kills 30,000 people every year, 90 percent of whom are in Africa.

Cholera (mid-1800s):

By the 1830s New York was a booming metropolis of 200,000, with swarms of newcomers arriving daily on boats from Europe. When word of a raging cholera epidemic in Europe reached the city’s Board of Health, it instituted quarantines on incoming ships and tried to clean up the filthy streets. But again the board was reluctant to make public announcements, this time to avoid disrupting trade, according to city records. One resident claimed the board was “more afraid of merchants than of lying.” By June 1832, the disease, which causes severe diarrhea and can kill within hours if untreated, arrived in New York via boats traveling down the Hudson River from Quebec. Within two months, 3,500 people were dead—mostly poor Irish immigrants and blacks living in the city’s slums. Outbreaks occurred again in 1849, with some 5,000 deaths, and in 1866, with 1,100 deaths.

Polio (1916):

New York City was the epicenter of an outbreak of polio in 1916 that began with a handful of cases reported to a clinic in Brooklyn. The disease, which advances from feverlike symptoms to paralysis and sometimes death, ultimately spread to 9,000 New Yorkers and caused 2,400 deaths. Across the Northeast, the infection toll climbed to 23,000 by the fall. The disease remained prevalent in the United States until the 1954 introduction of Jonas Salk’s polio vaccine. Polio is now extremely rare here. But worldwide, it still infects 200,000 people every year, particularly in Afghanistan, Nigeria, and Pakistan.

Influenza (1918):

In August 1918, a Norwegian ship called the Bergensfjord pulled into New York Harbor carrying 21 people infected with a new and virulent strain of the flu. Over the next several weeks, dozens more arrived, mostly on ships from Europe, and sick passengers were quarantined in a hospital just blocks from the modern-day Bellevue, where Spencer is currently being treated. Those unfortunate sailors were just the first in what would become the deadliest disease outbreak in the city’s history to that date. Over 30,000 deaths were recorded by November—the actual number was likely much higher—including 12,300 during the first week of November alone. One health worker visited a family in lower Manhattan and found an infant dead in its crib and all seven other family members severely ill.

Other nearby cities fared even worse: The death rate in New York was 4.7 per 1,000 cases, compared to 6.5 in Boston and 7.3 in Philadelphia, according to the National Institutes of Health. That may not sound like a lot, given that the Ebola death rate is closer to 50 percent, but because influenza is so easily spread it can infect a much greater number of people. Globally, the 1918 flu killed between 50100 million people, the worst public health crisis in modern times. Today, the flu is still considered the greatest infectious disease risk for Americans, killing between 3,000 and 50,000 every year, according to the Centers for Disease Control and Prevention. In other words, it’s possible that more people could die from the flu this year in America than have died worldwide from Ebola during this outbreak. And yet only 1 in 3 Americans get a flu shot. Get a flu shot, people!

HIV/AIDS (1981-present):

The scourge of HIV/AIDS is the most familiar epidemic for modern New Yorkers, beginning with the June 1981 discovery of 41 cases of a rare cancer among gay men across the country. Throughout the 1980s, campaigns by the city encouraged New Yorkers to use protection during sex and not to share needles or use intravenous drugs. By 1987, according to city records, $400 million had been spent on AIDS services. But activists for AIDS rights groups like ACT UP accused city officials, led by Mayor Ed Koch, of dragging their feet and ignoring the true scale of the crisis. It took until the mid-’90s for anti-retroviral drugs to become widely available. Today, for people who have access to adequate health care, HIV is often manageable. But to date, more than 100,000 New Yorkers have been killed by AIDS-related maladies, according to state health statistics. Despite recent advances in medical treatment, infection rates are still high in New York, disproportionately affecting racial minorities and gay men.

No justice, no ride to work! The vast majority of transit systems in the U.S. have cut service, raised fares, or both over the last two years, affecting those who rely on public transportation especially hard.

An article in the current issue of the Boston Review outlines the struggle for more justice and more buses:

For millions of American families, the commute to work is more than stressful: it can also be cripplingly costly. While the average family spends around 19 percent of its budget getting around, very low-income families (defined as families who make less than half of an area’s median income) can see as much as 55 percent of their earnings eaten up by transportation costs, according to a report by the Center for Transit-Oriented Development. …

Nationwide about 80 cents out of every federal transportation dollar goes toward highways—used disproportionately by more affluent drivers — and only 20 cents goes toward mass transit systems, which are heavily used by people of color and by lower-income workers. When it’s time to distribute that 20 percent, regional authorities often favor light-rail systems for suburban commuters over bus lines for city riders.

Some hope, though: A few cities have managed to wrest money away from the ‘burbs and back to the urbs by filing lawsuits claiming civil rights violations.

That tactic may not work for New Yorkers, though, who are about to see yet another fare hike, their fourth in five years — and it’s not because transit workers are getting a raise. Here, New Yorkers campaigning against fare hikes explain how debt service has increased train costs.

If there’s one thing the status quo has no answer for, it’s digging out of debt. Sorry, New York.

Modern-day Robin Hoods: Stealing construction supplies from the rich to give to the Sandy-hit poor

Superstorm Sandy not only revealed the massive class divisions in New York City, but also made them worse. As wealthier areas in Manhattan recover, poor and working-class communities in Brooklyn, Queens, and Staten Island are still struggling.

Some New Yorkers have taken a decidedly illegal tack to solving this problem. From their press release:

Over the past two weeks, a group of concerned New Yorkers has been expropriating thousands of dollars worth of tools and materials from luxury residential developments across Manhattan and delivering them to neighborhoods devastated by Superstorm Sandy.

The confiscated materials, some of them never even used, include: shovels, wheelbarrows, hand trucks, pry bars, tarps, buckets, hard bristle brooms, industrial rope, contractor trash bags, particulate masks, work lights, work gloves, flashlights, heat lamps, and gasoline.

Liberated from their role in building multimillion-dollar pieds-à-terre for wealthy CEOs and Hollywood celebrities, these tools are now in the collective hands of some of the hardest-hit communities in the city where they are now being allocated and shared among the people who need them most. These expropriations will continue as long as the demand for them exists.

The project — can I call it a project? — has far bigger ambitions than just wheelbarrows.

Here is New York: a city in which people write rent checks by candlelight, huddle around gas ovens for warmth, and are housed in shelters that are literally prisons — this is a city in which the darkness and misery are indeed all too literal. Luxury up front, desolation behind: this New York is but a cruel Dickensian reboot of a city.

A cold winter is nearly upon us. In the coming days, Bloomberg will doubtless be seen doling out turkeys and vague promises at any variety of overflowing city shelters while the shutters snap away. As the rich and powerful ladle out their meager scraps and twist their faces into caring regard, those of us who envision a better world will be out in the streets, maneuvering in the dark, trying.

Another world is possible, but capital’s scraps won’t get us through this holiday season, let alone the long, hot future ahead.
