The Standing Rock Sioux will be ready to take a Trump challenge to courts

In the wake of the Obama administration’s surprise decision to block the Dakota Access Pipeline, company reps seem confident they need only wait for President-elect Trump to keep building. But the lawyer who represents the Standing Rock Sioux says it won’t be so easy to overcome the legal hurdles.

“If an agency decides that a full environmental review is necessary, it can’t just change its mind with a stroke of a pen a few weeks later,” EarthJustice attorney Jan Hasselman told Grist. “That would be violation of the law, and it’s the kind of thing that a court would be called upon to review. It doesn’t mean they’re not going to try.”

Trump could force the pipeline through along the dispute route at Lake Oahe. He technically could ignore the Corps’ decision to fulfill a public Environmental Impact Statement with his newfound executive powers, but that might not be wise.

“He could in the sense that you can rob a bank, but you’d get in trouble,” Hasselman said.

If that were the case, Standing Rock would be prepared to take the matter to courts again, their lawyer told Grist.

“Circumventing the environmental assessment now that the agency has determined it’s the right course of action shouldn’t pass muster under legal standards,” he added.

For example, the Ninth Circuit has ruled that federal agencies can’t just flip on a dime on settled rulemaking that is based on facts because a new administration has taken over. The Supreme Court this year declined to take up the case, leaving the Circuit’s decision standing that the Bush administration couldn’t exempt the Tongass rainforest in Alaska from a conservation rule, when the agency’s fact-finding found otherwise.

Unless a conservative Supreme Court reverses course, then Standing Rock still has that advantage in a Trump era.

Going further to weaken environmental regulations overall would require a more robust change to the law with congressional action. With the law on their side for now, environmental justice advocates could challenge administration decisions just as they did in the Bush administration. (Talk about government interference: Trump is reportedly also considering privatizing oil-rich Native American land to boost oil companies.)

Energy Transfer Partners has its share of options, too — even if Trump didn’t reverse the decision, it could still sue to maintain the current route.

One of the surer bets on what’s next is that the company is going to have to wait longer to build its pipeline than it originally intended. Energy Transfer Partners wanted it to be operational by the end of the year. If the Corps decision holds, it could potentially be tied up as long as a year or two. It would have to undergo a full environmental assessment of route alternatives, which is the traditional way government agencies solicit input from the public and weigh the pros and cons of environmentally risky projects.

The pipeline is far from dead. But it’s also far from a sure thing.

16 Ways to Make Your Bathroom More Eco-Friendly

Making your bathroom more water- and energy-efficient might not seem sexy, but it can make a big difference in your home’s utilitybills and environmental impact. These are somebig and small ways to make your bathroom more eco-friendly.

When we’re talking about making any room more eco-friendly, there are really two things going on:

  1. The things in the room.
  2. Your habits in the room.

The list below looks atboth ways to improve efficiency in the bathroom and good habits you can adopt to conserve water and energy when you’re bathing or using thetoilet. 16 Ways to Make Your Bathroom More Eco-Friendly

1.Stop theleaks. Running toilets and leaky faucets are more than just an annoyance. In fact, when you add up all of the little water wasters like these across the U.S., it adds up to over 1 trillion gallons of water per year. If you have a leak or suspect one, get a plumber in as soon as you can to repair it or take a stab at repairing it yourself.

2. Go low flow. This is an affordable way to make your bathroom more eco-friendly that almost anyone can do. Installing a low flow faucet on the bathroom sink or your showerhead is incredibly easy. Really, it is. I’ve done it, and if I can do it,I’m betting that you can, too.

3. Go dual flush.If you’ve got the budget,this is a big water saver. Dual flush toilets use around half the water to flush liquid waste compared to standard toilets. If getting a new toilet is not in your price range, you can buy kits like this one to convert a regular toilet to dual flush.

4. Go old school. If you want a really low-tech solution to reduce the water your toilet uses, put a small plastic bottlefull of water into the tank, so it won’t fill withas much water. Back in the 90s, some people put bricks into their tanks to displace some of the water. Do not do this! A brick erodes over time and will mess up your toilet.

5.Skip abath.Unless you take very long showers (16 minutes or more), a bath uses far more water to get you clean than a shower.Take showers instead of baths to rack up the water savings! This will also save energy, since you bathe in hot water. Reducing hot water usage is a double whammy, saving you water and energy.

6. Skip a shower.Showers use less water than baths, but afive minute shower still uses about 12.5 gallons of water. Sure, if youwent for a run or worked in the garden, you probably need a shower. But if you just hung out watching TV or even worked in an office all day, do you really need a daily shower? Even skipping one shower a week makes a difference!

7. Get an efficient water heater. Whether you’re taking showers or baths,you’re taxing your home’s hot water heater. Heating water accounts forabout 20 percent of your home’s energy costs, so getting a better heateris a great way to make your bathroom (and kitchen and laundry room) more eco-friendly. Consumer Reports has a great guide to the best water heaters. If you can swing it, it looks like a tankless is the best bet from an energy-conservation perspective. Tank water heaters store hot water, meaning they’re constantly running to keep the water hot. A tankless heater only turns on when you turn on the hot water tap.

8. Turn down the water heater. It only takes a couple of hours to reduce the temperature on your water heater, and this fix is free! You don’t need it at 140 degrees Fahrenheit. Turn it down to 120 to save money and energy in the bathroom. The video above shows you how to adjust the temperature on your home’s water heater.

9. Try the shower bucket. Whether you have a tank or tankless water heater, it takes a few minutes for your shower to get hot. Rather than let this water go down the drain, you can collect it in a bucket and use it to water house plants. You can also use the shower bucket when you’re dripping faucets during a winter freeze. Drip the tub faucet instead of a sink, and stick that bucket underneath.

10. Ditch the PVC shower curtain liner. Vinyl shower curtain liners are no good for the planet or for your home’sair quality. PVC liners offgas harmful volatile organic compounds (VOCs) that are bad news for indoor air quality and your health. Unfortunately, PVC shower curtains are not recyclable. The best thing that you can do is toss the old one and replace it with a non-PVC alternative. Companies like Ty even make non-toxic shower curtain liners that you can recycle.

12. Turn off the tap. When you’re brushing your teeth or washing your hands, you don’t need water running while you scrub. A sink faucet uses 2.5 gallons of water per minute. Turn it off until you really need that water to rinse.

13. Stop with the anti-bacterial soap. Anti-bacterial soap is not necessary, and when it rinses down the drain it is an environmental nightmare. It’s no more effective than regular ol’ soap, and there’s even evidence that it weakens heart and muscle function. No, thank you!

14. Choose LEDs. Just like anywhere else in the house, efficient light bulbs add up to big energy savings over time. LED bulbs are a bit of an investment up front, but they last up to50 times longer than incandescents. And unlike CFL bulbs, they don’t contain mercury.

15. Get recycled toilet paper. Do we really need to cut down new trees to wipe our bottoms? No, we don’t. While you’re at it, try to use less toilet paper in general.It still takes energy and water to create a roll of recycled TP.

16. Chooseorganic towels. Next time you have to replace your bath towels, choose organic cotton. Conventional cotton is one of the most water-intensive and polluting crops on the planet. Don’t go out and replace your perfectly good old towels with organic ones, though. The lowest-impact choice you can make is to buy nothing.But when your old towels are starting to fall apart, go organic.

How to Make Your Poop More Eco-Friendly

The amount of fecal waste we excrete each day can rival the size of a small chihuahua. Have you ever considered how all of that poop affects the environment?

Poop isnt a big topic in the battle for reducing our environmental impact, but the way you handle your number twos can make small, but important changes if you put in some effort. Here are a few ways your poop can become more eco-friendly.

Compost human poo. Perhaps the most eco-friendly thing to do with your poo is to compost it and allow it to fertilize new life. If you’ve ever been camping, you may have pooped in aClevis Multrum composting toilet. It’s not pretty, per se. But all our nasty excrementgets to serve a higher purpose. If you invest in a composting toilet in your own home, you have the power to turn human waste into plant fuel.

By nourishing your soil with the nutrients and microbes fromyour composted poop (rather than letting it flow in freshwater to the treatment plant) you are doing your part to perpetuate nature’s natural and intricate circle of life support. All life comes from good soil, after all, and soil health across the country is suffering.The downside:composting your wastedoes require that you become a little more up close and personal with your poop.

Clean up your diet. Theoretically, if you keep your diet clean, your gut bacteria will be healthier, which means your poo will have a healthier spectrum of microbiota. It also will be full of good nutrients. If youre composting your waste, healthier poop can mean healthier, richer soil.

Just like us, plants need bacteria and minerals to survive and thrive. If we treat our digestive systems right, human compost can help other plants to flourish.Eat lots of organic, local produce, limit red meat consumption (and always eat grass-fed when you do), drink plenty of water and eat complex carbs like root veggies, seeds, nuts and grains (if tolerated). Eating resistant starch, found in tigernuts and cooked-then-chilled potatoes or rice, promotes the growth of beneficial bacteria the compost of your digestive system. And, above all, take probiotics before, after and during any bout of prescription antibiotics you must take, which can decimate your system. If ourwaste is more diverse and balanced, it makes for a healthier earthin the long run.

Use green toilet paper. Always opt for 100 percent recycled and unbleached. Need I say more?

Keep your pups poop green, too. Have you considered how eco-friendly it is to clean up your dogs poop? Biodegradable bags can actually take anywhere between 10 to 1,000 years to decompose. They really aren’t the best option, although buying high quality ones is the best way to go.

Other options for your pup’s pooinclude using flushable bags made of PVA that will dissolve in water (make sure your water treatment center can handle dog pathogens, as some cannot) or composting. There are plenty of options out there for dog compost that don’t involve burying your dog’s poop daily or keeping smelly, unsightly piles all over your yard. Try dog composting tanks if you have plenty of yard space, and toss all your pal’s plops in there. Mainly, just don’t leave black, non-biodegradable baggies strewn about in nature, and you will bewell on your way to becoming the owner of a dog with green poop.

Sure, maybe poop isn’t at the forefront of the sustainability movement, but it’s something to be aware of. After all, our poop is an indicator of our internal health and can help to fuel the cycle of life on our planet. This rule, which will be gradually phased in, requires drilling operators to halve the natural gas that is flared off from new and existing wells, limit venting from storage tanks, inspect for leaks, and so on. DOI projects that the rule should cut methane emissions up to 35 percent.

Methane is an extremely powerful heat-trapping gas. With the the increase in natural gas and oil drilling that is the fracking boom, methane leakage from wells and pipelines has also skyrocketed. A crackdown on these leaks was part of President Obama’s Climate Action Plan.

The new rule doesn’t govern private land, where most drilling takes place. The Environmental Protection Agency developed rules limiting methane leakage from new wells on private land. Hillary Clinton proposed to follow up on that with a rule for existing wells on private land.

Trump will not do that. But, now that the public lands rule is finalized, undoing it would require a new rule-making process, subject to legal challenge.

DIY: Turn a Produce Net into a Dish Scrubber

Few things delight me more than a good upcycle. Why? Upcycled crafts not only feed my creative soul, but they also help us care for the planet by preventing waste. This simple kitchen upcyle is a two-for-one way to be green. You’ll save a produce net from a landfill and also reduce your consumption of abrasive dish scrubber pads in the kitchen!

It’s always nice when doing something you love also benefits our environment. Ready to craft?

Upcycled Produce Net Dish Scrubber

Supplies needed:

2 produce nets (think sweet potatoes, citrus fruits, etc.)
String or twine
Scissors

Directions:
1. Begin by laying the produce nets as flat as possible, one on top of the other.

2. Roll them up nice and tight, like you are rolling up a tortilla. (Now I’m hungry. Is it Taco Tuesday yet?)

3. Fold the roll over in half, bending it directly in the center.

4. Tie the twine or string at the center of the rolled and folded produce bags. Tie a knot tightly. Double knot.

5. Take your scissors and snip apart the ends of the produce bags. This will fan the bags open and create the “fluff” you want.

6. Continue to trim to even out the dish scrubber and get rid of any loose ends. Shape the scrubber with your scissors and pull apart the layers to fill it all out.

7. Tie an additional piece of string around the scrubber to create a hang tag. This way it can easily hang on your faucet to dry when not in use.
