By law, New York has to protect communities from climate change. Cuomo’s budget ignores that.

Nearly 300 climate activists from across New York State gathered in the halls of the capitol building in Albany late last month during an environmental conservation hearing. They formally submitted testimonies to the committee, spoke with Assembly members, and rallied inside the building, occupying the lobby and one of the grand staircases. They were there to tell New York Governor Andrew Cuomo that they’d noticed he had some unfinished business with regard to the state’s climate policy.

The rally came after Cuomo released his 2021 budget proposal. Although it included a $33 billion, five-year plan to fight climate change, environmental groups were surprised to see that the budget didn’t mention anything about protecting vulnerable communities from the climate crisis — even though the state is required to do just that under the Empire State’s ambitious new climate law, Climate Leadership and Community Protection Act (CLCPA).

The CLCPA, which commits the state to net-zero emissions by 2050, was signed last July and officially went into effect on January 1, 2020. The final version of the bill was not exactly what advocates had hoped it would be. They envisioned it as the state’s version of the national Green New Deal: sweeping legislation that would curtail the state’s greenhouse gas emissions and transition to a greener economy while also addressing racial and economic issues. But last-minute changes made by Cuomo slashed the original bill’s social justice and labor provisions — making it look a lot less like the federal Green New Deal.

What the CLCPA does contain, however, are provisions to address climate impacts on disadvantaged communities. The law says that state agencies, authorities, and entities shall direct resources “in a manner designed to achieve a goal for disadvantaged communities to receive forty percent of the overall benefits of spending on clean energy and energy efficiency programs, projects, or investments” and “no less than thirty-five percent.” But Cuomo’s spending plan for fiscal year 2021 does not mention anything with regard to that provision.

In a letter to state representatives, New York Renews — a statewide coalition of nearly 200 advocacy groups — expressed their disappointment in Cuomo’s spending plan. “You passed a law designed to protect communities, but the governor’s budget does not include the funding necessary to do so,” the group wrote. “The governor’s status quo climate budget ignores disadvantaged communities as if the CLCPA was never signed into law.”

The $33 billion climate portion of Cuomo’s budget proposal includes plans to invest in resilient infrastructure, planting more trees, preserve fish and wildlife habitats, expand renewable energy, install electric-vehicle charge stations, ban single-use plastics, and permanently ban fracking in the state. But for New York Renews, these proposals don’t go far enough because they don’t address the unequal impacts of climate change and environmental contamination.

“Low-income communities and communities of color across New York State have consistently faced the worst impacts of pollution and climate change, yet the Governor’s budget does not meet the standard set by the CLCPA that at least 35 percent of climate and energy spending target frontline communities,” NY Renews coalition coordinator Stephan Edel told Grist in an email. “This is a grave oversight, but there’s still time to fix it.”

As part of the solution, NY Renews is pushing for the Climate and Community Investment Act, which would fine corporate polluters. The money generated by that fine would go to large-scale renewable energy projects, updates to the electric grid, environmental justice community projects, energy-efficient transit systems, helping low-income New Yorkers with their energy bills, and providing financial assistance to workers and nearby communities when fossil fuel infrastructure closes. Since it will take time for the Climate and Community Investment Act to go into effect and begin collecting money from polluters, New York Renews is demanding a $1 billion Climate and Community Investment Fund to be added to this year’s budget to jumpstart spending to benefit low-income communities.

In response to a request for comment from Grist, a representative for Cuomo said in an email that state agencies, in coordination with a new Climate Justice Working Group, will figure out how to devote at least 35 percent of clean energy funding to disadvantaged communities as required by the CLCPA.

State budget negotiations between Cuomo and the legislature will continue through March and will be finalized by March 31. New York Renews is committed to pushing its demands: On February 28, the group is set to gather around 300 activists to visit state legislators within their districts to talk about the budget and the Climate and Community Investment Act. It also plans to start working with the Climate Action Council, a policymaking body that was created under the CLCPA and is set to convene for the first time this month to begin setting specific emissions reductions targets for the state.

“We’re hopeful that the Assembly and Senate budgets will include new spending for climate justice and frontline communities, and that those provisions will be included in the final New York state budget,” Edel said. “Make no mistake, we’ll continue to fight for climate, jobs, and justice at every step of the process.”

Judge writes blistering dissent as kids’ climate lawsuit gets tossed

Nowadays, it’s not unusual to see young folks publicly protesting climate change. But back in 2015, long before Greta Thunberg set up shop on the steps of the Swedish Parliament and inspired millions to take to the streets, 21 kids sued the United States to try to force the government to do something about climate change. They argued that the government’s inaction was putting their constitutional rights to life, liberty, and the pursuit of happiness at risk. That case, Juliana v. United States, paved the way for more climate-themed lawsuits to be filed against governments and oil companies around the world.

On Friday, after five long years of wins, setbacks, and procedural delay, the kids finally got their answer: No.

The 9th Circuit dismissed the case on the grounds that the courts don’t have the power to order the kind of emissions reduction plan sought by the plaintiffs, who were demanding that the government limit atmospheric warming to 1 degree C — a whole half-degree cooler than the target called for by the U.N.’s Intergovernmental Panel on Climate Change.

Any plan to reduce emissions, the panel of three judges wrote in a 32-page opinion, would require the executive and legislative branches to come up with a range of complicated policies and vote on them. As such, the decision reads, “the panel reluctantly concluded that the plaintiff’s case must be made to the political branches or to the electorate at large.” The issue here, of course, is that the leadership of one of the United States’ two major political parties denies the existence of climate change, and Congress’ most recent climate bill — the first one in a decade — just hit the dust in the Senate. Regardless, the case will not go to trial.

One judge wasn’t happy about that. In a searing dissent, District Judge Josephine Staton lacerated the U.S. government and said that the young people do have standing.

In these proceedings, the government accepts as fact that the United States has reached a tipping point crying out for a concerted response — yet presses ahead toward calamity. It is as if an asteroid were barreling toward the Earth and the government decided to shut down our only defenses. Seeking to quash this suit, the government bluntly insists that it has the absolute and unreviewable power to destroy the Nation.

The decision is a blow to the youth plaintiffs, many of whom have put their lives on hold for years in order to be available for depositions and testimonies. But winning the case wasn’t their only priority. When Grist interviewed one plaintiff, Aji Piper, in 2018, he said his reasons for suing the government are chiefly moral.

“It’s not about the winning,” he said. “It’s doing it because it’s the right thing to do.” At least the kids know they tried their best to protect Earth from the asteroid. And their legal counsel isn’t giving up yet. “We will be asking the full Ninth Circuit to review the determination that federal courts can do nothing to address an admitted constitutional violation,” Andrea Rodgers, the plaintiffs’ co-counsel, said in a statement.

New York’s ambitious climate and environmental justice laws are in effect. Here’s what’s next.

New York state’s landmark climate legislation has finally reached the finish line after a four-year marathon through Albany. And that means it’s reached the starting line for the state’s race to net-zero emissions.

The climate law, originally called the Climate and Community Protection Act but ultimately dubbed the Climate Leadership and Community Protection Act, struggled to make it past the Republican-controlled state senate for three years until Democrats finally won it back in 2018. Although New York Governor Andrew Cuomo altered the bill by slashing some labor and social justice provisions last summer, the CLCPA was still considered a major win for climate activists when Cuomo signed it into law in July with former Vice President Al Gore at his side.

But there was a catch: In order for the CLCPA to go into effect in 2020, Cuomo needed to sign a separate environmental justice bill by the end of 2019. As of mid-December, he hadn’t signed it, making several environmental advocates anxious as the January 1 deadline drew near. But finally, on December 23, Cuomo signed the environmental justice bill, putting the landmark climate law into effect as New Yorkers rang in the new year.

So what happens now that the environmental justice bill and the CLCPA are in effect? The CLCPA made headlines for being the most ambitious emissions-reduction legislation in the country thanks to its promises to reach net-zero emissions by 2050 and 100 percent renewable electricity by 2040. But in the short term, the main outcomes of the two new laws will be … new policymaking bodies!

The CLCPA sets broad targets for emissions reductions, but the hard work of figuring out how to decarbonize New York’s economy will fall into a new group called the Climate Action Council. The Climate Action Council consists of 22 members including the heads of state agencies, the majority and minority leaders of the state senate and assembly, and various appointed experts — including at least one fuel gas executive. The Climate Action Council is required to come up with its first “scoping plan” for reducing emissions within two years, and then to revisit the plan every five years subsequently.

Meanwhile, the environmental justice bill will create a permanent environmental justice advisory group within the existing Department of Environmental Conservation, plus an interagency coordinating council that will make sure New York state agencies are treating New Yorkers fairly when it comes to the enforcement of environmental policies. Since low-income communities of color tend to bear the brunt of the fossil fuel industry’s social costs, the goal is to ensure that vulnerable or disadvantaged communities aren’t suffering negative environmental consequences from state policies.

The advisory group will consist of representatives from local environmental organizations that advocate for low-income communities of color, some business representatives, local government environmental officials, and members of either state or federal environmental organizations. The group will be tasked with developing a model environmental justice policy for state agencies by the end of 2020. Once the state adopts the group’s model policy, each agency will have six months to come up with its own environmental justice policy, but if an agency fails to come up with one, it will have to comply with the advisory group’s version.

The advisory group will also advise agencies on decisions like land-use permits for fossil fuel projects and monitor their compliance with the environmental justice policies.

New York Renews, a statewide coalition of nearly 200 advocacy groups, pushed for the environmental justice bill to be passed alongside the CLCPA, and for the CLCPA itself to include environmental justice provisions. “Protecting vulnerable populations, communities of color, and low-income communities should be a priority for all climate solutions,” said Adrien Salazar, a campaign strategist at progressive think tank Demos and a 2019 Grist 50 Fixer. “Science has shown consistently that communities of color and low-income neighborhoods are most vulnerable to climate impacts and pollution. This is why equity and justice was written into the CLCPA.”

This isn’t the first time New York has attempted to address environmental injustice. In 1999, the state’s Department of Environmental Conservation received a federal grant from the EPA to develop a comprehensive environmental justice program, and eventually created an advisory group. Though the Department of Environmental Conservation officially adopted an environmental justice policy in 2003, it failed to follow through on most of the advisory group’s recommendations.

But the CLCPA and environmental justice bill are binding — they require the state to meet its emissions reduction targets and make good on its commitments to address environmental injustice and invest in vulnerable communities. But Salazar, whose organization is part of New York Renews, warned that if agencies fail to mobilize adequate resources and put significant plans into motion, New York could very well fail to reach the goals it sets for itself.

“This will take every agency setting up programs and policies to meet the state’s goals, directing resources accordingly, and beginning to enact those plans starting now,” he said. “The state has to demonstrate how important it is to not just pass bold climate policy but to get the implementation right.”

How To Grow a Clover Lawn To Improve Biodiversity

The American obsession with a pristine, green lawn presents a few problems. That green lawn requires a lot of work to maintain and is a huge drain on resources. Lawns in the U.S. are the country’s largest irrigated crop, consuming more land than any food crop. Besides hogging resources, the solid carpet of turfgrass we’ve created also hurts wildlife by discouraging biodiversity and creating runoff that pollutes waterways.

There are benefits to having a yard full of grass. And it’s possible to have a gorgeous, biodiverse lawn that benefits the environment. It just takes a little rethinking about what makes a lawn, including reconsidering clover — a plant that we redefined as a weed after WWII.

Embracing clover as a mainstay of your lawn can tip the balance back in an eco-friendly direction. You’ll also benefit from a lower-maintenance, self-fertilizing green lawn.

Choosing the Right Clover Strategy

The benefits of clover are vast. It’s drought tolerant and self-fertilizing. The plant absorbs nitrogen from the atmosphere and returns it to the soil. In other words, it creates its own fertilizer and fertilizes nearby plants. When you mix it with common grass types such as Kentucky bluegrass or fescues, it creates enough nitrogen to eliminate the need for chemical fertilizers.

Clover provides forage for pollinators such as bees. It also looks magical and you may find your neighbors admiring it. Just make sure you choose the variety best suited to your needs. Dutch white clover (Trifolium repens) or micro clover (Trifolium repens var. Pipolina) are the best species to incorporate into your turf. Dutch white clover stays green year-round, while micro clover turns brown during the winter. Micro clover is more tolerant of foot traffic and blooms 90 percent less than Dutch white clover. That means fewer bees and less support for pollinators .

Most people are happiest with a combination of turfgrass and clover. While some perform aggressive lawn makeovers to completely convert to clover, that isn’t necessary. If you already have a lawn, you can overseed it with clover and gradually let the clover take over.

Planting Clover

To establish a mixed grass/clover lawn, you can sow clover seed into the lawn, encourage existing clover patches, or both. Encouraging existing patches is as easy as mowing over clover with the mower blade set low, between 1½ and 2 inches. This will allow the clover to take over by weakening the grass.

Sow seed in spring as soon as the last frost has passed. Dutch white clover should be seeded at 1 pound of seed to 1,000 square feet, and micro clover needs double that. After you seed, water the lawn daily until seedlings are visible, and then only once in a while, as needed.

Maintaining a Clover Lawn

There’s no need to fertilize a clover lawn. It takes care of that for you! It is also imperative that you do not apply broadleaf herbicides to a clover lawn unless you want to kill it. Your irrigation bill should drop, as this classic “weed” is drought tolerant. Try irrigating every other week in summer and see how it performs. A bonus? You only have to mow a clover lawn once a month to keep it looking tidy. Other than the frequency, just mow clover the same way you would mow a regular grass lawn.

The very same weeds that homeowners have been struggling to eradicate might be the answer to the low-maintenance, green lawn you dream of. Unlike typical turfgrasses, a clover lawn reduces water use, eliminates the need for fertilizer, cuts time spent on lawn care in half, and increases biodiversity. Plant it right and enjoy a future where your lawn is part of the solution rather than contributing to the lawn problem.

No longer is climate change a fringe issue. These days, it’s a business one. Worldwide, eight in 10 consumers say it’s “extremely” or “very” important that companies implement programs to help the environment. Like it or not, today’s consumers expect businesses to lead the charge on environmental causes.

Fortunately, your company doesn’t have to choose between saving money and saving the Earth. In addition to the marketing boost that environmental action might net you, many of the best ways to protect the planet also benefit your user experience, your recruiting game, and your operations budget.

Simple Business-Savvy Sustainability

1. Digitize to make consumer data more accessible.

With respect to sustainability and your user experience, digital account access is the table stakes. Whether you’re a hospital, bank, or retail brand, there’s no reason you should prefer paper billing. Not only does online management minimize printing and disposal costs, it reduces waste and the CO2 impact of mail delivery.

What’s the step-up strategy? Strengthen your user experience by turning write-in information into online tools.

Until recently, for example, consumers who wanted to know their auto insurance score had to request mailed copies from researchers like Lexis Nexis. By letting consumers look up their score for free online auto insurance, companies are differentiating themselves while doing good for the environment.

2. Incentivize working from home.

If you’re looking for another way to differentiate yourself, this time with workers, turn to remote work. Not only is the benefit free to offer, but it’s in high demand: Eighty-five percent of millennials say they’d prefer to telecommute all the time. Given that reducing the number of miles driven is one of the best things an individual can do to reduce their carbon footprint, why not take the win-win?

What if your company requires physical work? Consider investing in a small fleet of loaner bikes that employees can use to commute, go out to lunch, or run a quick errand. If several employees have electric cars, it could also be worthwhile to invest in an electric vehicle charging station. Alternatively, some companies give workers a monetary incentive for leaving their cars at home. For example, Clif Bar offers a reward program that pays employees when they commute by walking, biking, taking public transit, and other eco-friendly alternatives to driving their car alone.

3. Think twice about business trips.

Commuting isn’t the only type of travel associated with work, and it certainly isn’t the one that company leaders have the most control over. Although some types of business travel, such as site surveys and investor meetings, are non-negotiable, most are optional. Not only is online conferencing more environmentally friendly, but it also saves companies hundreds to thousands of dollars per eliminated trip.

Always ask before you book travel: would a video conference work just as well?

If travel isn’t necessary, take a mitigation approach. Swap short flights for car trips. Greenhouse gas emissions from flying have increased more than 80 percent just since 1990. Better yet, take a bus or train.

4. Minimize disposable office products.

Whatever your workplace’s carbon footprint, it could almost certainly be less. Swap paper towels for washable fabric ones. Encourage employees to use reusable mugs and water bottles by eliminating disposable cups. Buy a set of cheap silverware in place of plastic cutlery. None of these changes will make or break your budget, but the environmental benefits increase as more employees participate.

Remember that your office can be the place employees, partners, and customers learn to think of the planet first. That’s a reputation win, too.

On average, Americans produce 4.4 pounds of trash every day. Much of that waste happens at home, but the office environment matters as well. Full-time team members spend half their waking hours at work, there’s no reason they shouldn’t have sustainable options to choose from when eating lunch, deciding to print or not, or using the restroom. Small changes add up to big differences in CO2 emissions.

5. Make utility money go further.

Every time someone turns up your office’s air conditioning or flips on a light, it costs money. You don’t have to sweat in the heat (or work in the dark), but you also don’t have to settle for steep utility bills.

If you’re not ready to put solar panels on the roof, start small. As they burn out, switch your incandescent light bulbs to energy-efficient LEDs. Use expanding foam sealant to fill cracks. Invest in a smart, programmable thermostat. Even asking employees to unplug their devices before they leave can put a dent in your utility expenses: Keeping electronics plugged in when they’re asleep costs consumers upwards of $19 billion per year.

Consumers have made it clear: Creating a healthier, cleaner world should be every company’s charge. Encourage your employees to reduce their emissions, but don’t use that as an excuse to avoid making company-level changes. We all live on the same planet; it’s up to all of us to protect it.

Green America Rolls Out Handy Chocolate Scorecard

You have plenty of luscious options when selecting chocolate treats. With that wide selection is a rich opportunity to wield your spending power and reward firms that support environmental responsibility and fair labor practices for farmers.

Maybe you’re browsing for Halloween. Or you’re on the prowl for a scrumptious personal indulgence.

Green America, a nonprofit organization that focuses on economic action for social justice and environmental sustainability, encourages choosing wisely when buying chocolate. Especially if it involves links with child labor. And deforestation.

“It is an ideal product for voting with our dollars,” says Todd Larsen, executive co-director of Consumer and Corporate Engagement for Green America. “We can choose to purchase from brands that are working to build farmer income, address child labor, and promote ecological farming practices.”

Green America’s Chocolate Scorecard

Green America’s fresh ranking of chocolate companies features report-card grades, with emphasis on labor and environmental factors.

The scorecard is designed as a valuable resource for discriminating shoppers who appreciate information about ethical sourcing practices in products they purchase.

Labor certifications, including Fairtrade, IMO Fair for Life, and UTZ, were factored into each brand’s ranking. (See more certifications and what they mean on Green America’s website.) Other factors, including efforts to support farmers — especially in West Africa — rounded out the scores.

“… we are not only looking at how much certified cocoa a major chocolate company has, we are also looking to see if the company has innovative programs and projects in place to address some of the other underlying issues of child labor in cocoa and if the company is working to address deforestation,” Green America’s website states.

Focusing on eliminating farmer poverty interconnects with and assists in resolving other social and environmental issues, according to Charlotte Tate, labor justice manager at Green America.

Examples of chocolate companies’ noteworthy programs and practices include:

Divine: 44 percent ownership by a farmers cooperative in Ghana
Alter Eco: investing in agroforestry, which integrates cacao with other crops for a healthy and diverse ecosystem, and offers additional produce and revenue for farmers
Endangered Species: donates 10 percent of profits to animals, habitat, and humanity

Green America points out it did not include every chocolate company in its rankings, and notes that many of the A-rated firms are members of Green America’s Green Business Network of “socially and environmentally responsible businesses.”

Mars, Nestle, Hershey, and Lindt earned middle rankings.

Godiva received an F.

Green America’s website features a separate page offering extra information about the scores, including Godiva’s.

“Godiva has stated on its website that it has a goal of sourcing 100 percent sustainable cocoa by 2020. It has not indicated which certifications it is sourcing from, what progress it is making with this goal, or what additional steps it is taking to address child labor and farmer income. While its competitors publish annual reports on their progress, Godiva only reports minimal information on its website.”

Earth911 emailed a Godiva spokeswoman about its Green America grade, and she issued a quick reply.

“GODIVA condemns forced labor or any practice that exploits, endangers, or harms people, especially children. We do not own farms and purchase our cocoa through third parties, which puts us at a distinct disadvantage on scorecards such as these that don’t allow for an accurate representation of our longstanding commitment to people and planet. We ensure ethical sourcing through agreements with our suppliers to comply with our GODIVA Code of Conduct, which explicitly prohibits the use of forced and child labor.”

Speaking Out

While thoughtfully directing your dollars is a powerful tool to support preferred products, perhaps you’ll want to add fuel to your position.

Write a note directly to the firms you’re supporting or avoiding, explaining why you decided to purchase — or not purchase — their products.

Another route is signing a petition, such as Green America’s request to Godiva: “… share your progress with the public through a corporate responsibility report on your website that makes your progress on farmer income, child labor, and environmental protection fully transparent.”
