You can expect Neil Gorsuch to be bad news for the environment.

Catherine Flowers has been an environmental justice fighter for as long as she can remember. “I grew up an Alabama country girl,” she says, “so I was part of the environmental movement before I even knew what it was. The natural world was my world.”

In 2001, raw sewage leaked into the yards of poor residents in Lowndes County, Alabama, because they had no access to municipal sewer systems. Local government added insult to injury by threatening 37 families with eviction or arrest because they couldn’t afford septic systems. Flowers, who is from Lowndes County, fought back: She negotiated with state government, including then-Alabama Senator Jeff Sessions, to end unfair enforcement policies, and she enlisted the Environmental Protection Agency’s help to fund septic systems. The effort earned her the nickname “The Erin Brockovich of Sewage.”

Flowers was continuing the long tradition of residents fighting for justice in Lowndes County, an epicenter for the civil rights movement. “My own parents had a rich legacy of fighting for civil rights, which to this day informs my work,” she says. “Even today, people share stories about my parents’ acts of kindness or help, and I feel it’s my duty to carry on their work.”

Years later, untreated and leaking sewage remains a persistent problem in much of Alabama. Flowers advocates for sanitation and environmental rights through the organization she founded, the Alabama Center for Rural Enterprise Community Development Corporation (ACRE, for short). She’s working with the EPA and other federal agencies to design affordable septic systems that will one day eliminate the developing-world conditions that Flowers calls Alabama’s “dirty secret.”

Former Vice President Al Gore counts himself as a big fan of Flowers’ work, calling her “a firm advocate for the poor, who recognizes that the climate crisis disproportionately affects the least wealthy and powerful among us.” Flowers says a soon-to-be-published study, based on evidence she helped collect, suggests that tropical parasites are emerging in Alabama due to poverty, poor sanitation, and climate change. “Our residents can have a bigger voice,” she said, “if the media began reporting how climate change is affecting people living in poor rural communities in 2017.” Assignment editors, pay attention.

Donald Trump’s Modeling Agency Is on the Verge of Collapse, Say Industry Insiders

Donald Trump’s presidency hasn’t been good for one of his favorite businesses. The president’s modeling agency has been losing models and senior staff in recent months amid a growing backlash over his toxic politics. And the problems at Trump Model Management appear to be escalating. In interviews with Mother Jones, three industry insiders said they believe the agency could be forced to close.

The sources—two model bookers who have worked with Trump Models and another person with deep ties to the agency—attributed the firm’s sudden tailspin to the controversial president himself. The once glamorous Trump brand, they said, now appears to be tainted.

“Yeah, it’s closing,” said Virginie Deren, a model booker at the top Paris firm Premium, which co-represents a handful of models with Trump Model Management. Deren said she was given this information by a Trump booker. “It’s surprising that it’s come to that point,” she added. “It’s rough.”

Trump executives didn’t respond to multiple requests for comment for this story, but employees of the agency said this week that business is continuing as normal.

Deren said she didn’t know the precise timing of the potential closure or what might happen next for models at the agency. “For now, they haven’t really told us anything,” she said. “Of course, it’s going to take time.”

“That’s definitely happening,” said a second modeling agent who has also worked with Trump models, when asked about the potential closure. This source added that Trump staffers have approached the source’s own company looking for work. “They’re all pretty much sort of scrambling to get out,” said the source, who spoke anonymously to protect the firm where the source works. “We’ve met quite a few who’ve expressed the dismay this is happening, and their only goal is to find a new place.”

A third source—who has close ties to Trump Models—agreed that the situation at the agency is dire and that closing is a real possibility. This source requested anonymity to protect against the possibility of future legal action by the agency.

Corinne Nicolas, president of Trump Model Management, did not respond to questions from Mother Jones. Ronald Lieberman, a vice president at the Trump Organization who has previously responded to press queries about Trump Models, also did not respond to questions about the state of the modeling business. No one answered several calls to the company’s main phone line Wednesday.

Asked about the claims that the agency could soon close its doors, Michael Wildes—a New York attorney who has worked extensively with the agency, as well as with Melania Trump—told Mother Jones, “I’ve been privy to conversations, but I’m not permitted to share anything.”

Still, employees at Trump Models say their work is continuing as normal. Reached on her cellphone Tuesday, Helene Marengo, who works in the agency’s accounts department, said she was unaware of any plans to close her company. “I’m still working. I’m in my office right now, working like normal,” she said. “I have no knowledge of anything happening. As of right now, it’s business as usual.”

A woman who answered the door at the company’s Manhattan office Wednesday said that “of course” the agency remained open for new business.

Last summer, Mother Jones interviewed several foreign-born models who alleged they had worked illegally in the United States with Trump’s agency—a report that was particularly striking in light of Trump’s hawkish stance on illegal immigration. Four former Trump models told Mother Jones they worked for the agency without work visas; one said she worked for the agency for four years without a visa. Records in a lawsuit filed against Trump Model Management by a fifth former model, Alexia Palmer, indicated that she, too, worked for the company without work authorization. (The lawsuit was ultimately dismissed.)

Deren, the Paris booker, said agencies have recently suffered from a general downturn in the modeling business in both Paris and New York. But, she added, the problems at Trump Model Management have more to do with “the political situation”—that is, with Trump.

Since Trump’s campaign, models and their bookers have become increasingly uneasy about working with the president’s agency, said Brandon Hall, the creative director of Sutherland Models, a Toronto agency. He has co-represented roughly 10 models with Trump’s agency over the years and said he currently has about four or five models in common with the company. (Successful fashion models typically have several agents representing them in different markets around the world to book local gigs.) “I would probably be a little reluctant” to work with Trump’s agency, Hall said—adding that models themselves might be even more reluctant to sign with Trump.

One model Hall represented recently didn’t want to meet with Trump’s agents in New York, he said. “It’s just sort of what has transpired because of the election and what has arisen from that,” he said, attempting to explain the apparent aversion to Trump’s agency in the modeling world. “I’m sure he’s gained in some ways and is suffering in others. And I think in the entertainment industry and the fashion industry, among actresses, models, he’s not well liked.”

According to his most recent financial disclosures, Trump owns an 85 percent stake in the agency. He earned nearly $2 million in commissions from it in 2015. But since the election, the modeling firm he founded in 1999 has suffered from a series of staff defections, including longtime Trump agent Duane Gazi-White, who traveled the globe scouting new modeling talent at pageants and Miss Teen USA contests. He recently went to work for a Trump competitor, New York Models, as director of new faces and development. (Gazi-White did not respond to requests for comment.)

Another Trump agent, Gabriel Ruas Santos-Rocha, recently left Trump Models to set up a new modeling firm called Anti Management, which launched last month. “I did not start an agency with the intent of taking someone out of business,” Santos-Rocha told the Washington Post this week. “Outside of that I have no comments.” (Rocha wouldn’t comment for this story.)

Rocha told Refinery29, the fashion news site, that Trump models were finding it tough to stay with the company because of Trump’s brand. “The people who got the worst of it were the models; they’d arrive on set and people would say, ‘Oooh, you’re from Trump Models? How dare you,’ or ‘Why are you still with them?'” Rocha said, according to the article. “They were constantly harassed by employees on shoots, especially by other models.” Refinery29 first reported that a possible boycott among industry stylists and photographers was being discussed in early February.

Then there are the models. Katie Moore, a breakout star from New York’s Fashion Week in February 2016, and a rising talent in the modeling world, is preparing to leave Trump’s firm in search of new representation, according to Tabitha Garcia, her Texas-based agent. Garcia told Mother Jones that too many Trump agents were leaving the agency for Moore to continue her career there—the situation had become untenable. “Most of Katie’s agents have moved on to other agencies and we are exploring those options for her right now,” Garcia wrote in an email. “An agent really makes the model…That is why it is sad to have this happen.”

“I will be flying to NYC next week to meet with agencies with Katie to continue her career at another agency,” Garcia added. “The staff at Trump have been nothing but kind and amazing along our journey and I am sad that we had to make this hard decision.”

Katie Moore’s Texas-based agent confirmed the star Trump model is seeking new representation.

Other top Trump models have also fled the agency. Shirley Mallmann signed on with Anti. Veteran supermodel Maggie Rizer blamed Trump’s politics when she exited the company on the eve of the November election. “As a woman, a mother, an American and a human being, I cannot wake up Wednesday morning being the least bit related to the Trump brand,” Rizer wrote on Instagram.

Trump Model Management might be a small part of the president’s business empire, but it did seem to be particularly close to his heart. It augmented his brand as a playboy, and he enjoyed cross-pollinating his other businesses with Trump models. He personally signed talent directly from his Miss Universe and Miss USA competitions. And Trump Models appeared on his reality show, The Apprentice. Melania Trump was once represented by the agency.

At the agency’s launch party in 1998, Trump issued a promise about the company, as described by New York Magazine. Flanked by his business partner and the supermodel Daniela Pestova, Trump rose for a toast. “To the richest agency,” he declared. Now that agency could become the first piece of his business empire to fall victim to his polarizing presidency.

Cacti, Foxes, Solar Panels, and Other Bids to Unmake Trump’s Wall

Of all President Donald Trump’s promises, his signature wall along the 2,000-mile U.S.-Mexico border has drawn especially creative opposition.

Mexicans formed a human barrier in protest. Architects drafted a design for a powerful 1,000-mile energy-generating barrier outfitted with solar panels and wind turbines.

And then there’s Sarah Zapolsky and her friend April Linton, two Washington, D.C.-area social scientists. Their quaint concepts include a wall of cacti and a barrier of affordable homes.

But they had more in mind than quirky commentary.

Their ideas are part of a quiet, slightly subversive strategy. A bureaucratic pothole for the border speed bump. Call it guerrilla bidding.

The two women are federal employees who know something about government contracting—and how to potentially gum it up. Zapolsky, who gives her age as “old enough to know better,” works at the Department of Housing and Urban Development. Linton, 56, is at the State Department.

Armed with an insider’s understanding of how procurement works, Zapolsky knows that the government must review and respond to legitimate bids and related questions. That can cause drag on the process—exactly their plan.

Approaching the deadline set by the Trump administration to submit “white papers” for 30-foot-tall concrete and “other” border wall prototypes, the two women prepared their pitches. On Tuesday, the agency pushed back its deadline for submissions a third time—to April 4.

Getting past the stringent requirements for competitive bidders—who must have completed within the past five years similar projects of at least $25 million—poses a challenge to their plot. In a nod to these unusual political times, the agency also made the uncommon request for details about prospective contractors’ experience with “politically contentious design-build projects.”

But that hasn’t discouraged Zapolsky and Linton from dropping rumble-strip questions on the agency, to which it is supposed to respond:

“Our design includes stovepipe cacti. Would it be okay to use fake ones for the prototype?”
“Could we build a wall of solar panels, which meets the proposed border wall requirement, sell the energy generated back to Mexico, and have that count as that country paying for the wall?”
“Prototype demolition: Does this refer to taking down the wall after it is built should the administration change and decide the Wall is a ridiculous idea?”

On Tuesday, Customs and Border Protection posted its responses to questions. The agency reposted a truncated version of one of Zapolsky’s questions: “Does this refer to taking down the wall?” Its response: “Yes, if the line item is exercised.”

Trump’s champions have complained of so-called Deep State defiance from within the federal bureaucracy to undermine his efforts. Zapolsky and Linton, who met while working at the Department of Homeland Security, swear to no such membership. Their resistance stems from their concerns about the impact a wall may have and how their taxpayer money is spent. The two are acting as private citizens, not public employees, they say.

“This isn’t ‘deep’ government,” Zapolsky said. “Never confuse dissent with disloyalty. I’m all about making this country remaining great. This (wall) isn’t the way to do it.”

Solicitation saboteurs

By law, these would-be solicitation saboteurs can’t work for the government and win a federal contract. But they’re not interested in getting a dollar out of the border wall design bids, which could total $600 million.

The goal is to draw a formal complaint on the agency request that could slam the brakes on the bidding process. The daughter of a “government girl” who opposed McCarthyism, Zapolsky took umbrage that Customs and Border Protection initially planned to give the public just four days to create and submit designs for a border wall.

“I was so annoyed that it had to be a big ugly concrete wall,” she said. “I had to do something, but it had to be something creative—and legal.”

Then it came to her: clog the system. She gave it a name—#ArtThatWall—and registered as an “interested vendor” on the federal contracting website, fbo.gov. She turned next to Facebook to share her strategy.

A wave of creativity streamed back: Bead curtains. Baseball diamonds every quarter-mile with Fenway-like Green Monster walls (which match the Border Patrol’s green uniforms). A giant line of theater stages; one version includes, at random intervals, actors performing the Act V “Wall” scenes from Shakespeare’s “A Midsummer Night’s Dream.” Zapolsky’s 12-year-old son proposed building a wall out of Legos.

With a nod to her current job at HUD aiming to end childhood homelessness, Zapolsky chose a wall of houses along the border. And, because, you know, barging through someone’s living room is rude.

Linton, who has studied immigration, saw the Facebook post and got busy, too. Her expansive “Beautiful Borders” vision is a wall of stovepipe cactus—which can grow to 30 feet. Landscaped with hiking trails and nearby interpretive centers jointly staffed by bilingual park rangers from Mexico and the United States, the wall would be patrolled by security forces aided by fennec foxes. The vulpine desert dwellers would have training “to identify the scent and body language of smugglers, terrorists and haters.”

“It’s big. It’s beautiful. Everybody will love it. Mexicans will build it,” a draft proposal ends.

As required, it offers a “concrete” solution.

If Zapolsky knows how many potential guerrilla bidders she’s encouraged with her Facebook call to submit designs, she isn’t saying. The two think they’ve already played a part, however minor, to stall Trump’s wall.

Caught off-guard by the level of what Customs and Border Protection deemed “industry” interest after its late February notice, the agency delayed its original March 6 target date to release its requests for proposal. About 725 construction companies, engineers, consultants and would-be vendors registered their interest in the project, Zapolsky and Linton included. The agency has outlined a two-month time frame to review and select winning bids with contracts to be awarded in early June, about two months later than first announced.

The women claimed the delays as a “joyful and respectful” but small victory, Zapolsky said, though what effect they had on the decision to push back the release of requests is unclear.

Customs and Border Protection declined to comment. Rowdy Adams, a retired Border Patrol agent involved in earlier fence projects, said Customs and Border Protection had no choice but to slow down with all the public interest.

“That’s why the brakes were pumped,” he said.

Linton waxed optimistic that, once submitted, their proposals might get some attention.

“Maybe somebody from DHS actually wants to hear from me,” Linton said before the agency posted the requests. “It feels like we’re winning and we haven’t even submitted our concept yet.”

Trump’s New Executive Order Will Worsen Hunger in Africa

On Tuesday, President Donald Trump took his most concrete step thus far to unravel his predecessor’s legacy on climate change, with a wide-ranging executive order that dismantles several Obama-era policies to restrict greenhouse gas pollution. The order outraged environmentalists—Sen. Ed Markey (D-Mass.) called it “a declaration of war on American leadership on climate change”—but it wasn’t very surprising: It simply followed through on a threat contained in the budget Trump proposed two weeks ago.

“We’re not spending money on that anymore,” Mick Mulvaney, director of the White House’s Office of Management and Budget said then, in response to a question about climate change during a press conference. “We consider that to be a waste of your money to go out and do that.”

That stance could be a big problem for the dozens of farmers I’ve met across sub-Saharan Africa as a journalist reporting on climate change impacts to food security.

Christine Wasike is a maize farmer in Bungoma, an agricultural haven in western Kenya. She works half an acre by hand to produce food for her husband and several young children; if she’s lucky, there is enough left over to sell for cash to pay for school fees, clothes, healthcare, farm equipment, and other necessities.

Like all but a handful of wealthy farmers in Kenya who can afford irrigation systems, she relies exclusively on rainfall to water her crops, and last year, which scientists recently confirmed was the hottest ever recorded, the rains came late and light. As a result, Wasike’s harvest was disappointing, and her income for the season was less than $50, a net loss after covering the cost of seeds and other farm expenses.

“When there is drought farmers suffer a lot,” she says. “There is a lot of hunger, especially with children at home.”

Stories like Wasike’s are increasingly commonplace in sub-Saharan Africa. A majority of people on the continent depend directly on subsistence agriculture for their livelihoods, and because they rely almost exclusively on rainfall for water and often can’t afford adaptive technologies, they are among the world’s most vulnerable people to climate change. As a result, they are among those with the most to lose from if Trump reverses Obama’s climate change policies.

As America walks away from its commitment to help slow the global warming that it holds the primary responsibility for creating in the first place, Wasike, her children, and millions of her peers will be much more likely to face a future defined by hunger and poverty.

The main target of Trump’s executive order is the Clean Power Plan, a regulation hammered out during Obama’s second term that imposes limits on greenhouse gas emissions from power plants. The regulation, which was Obama’s signature achievement on climate change, aims to slash the carbon footprint of the nation’s power sector by 32 percent below 2005 levels by 2030. But to Scott Pruitt, the new administrator of the Environmental Protection Agency, it was never more than a plot to “kill jobs throughout the country,” as he told ABC News on Sunday. As directed by Tuesday’s order, the EPA will now review all policies that “serve as obstacles or impediments to energy production”—including the Clean Power Plan. At the same time, the Justice Department will back down from defending the Plan against legal attacks.

These policy changes will reverberate far beyond the coal-fired power plants they are meant to protect. That’s because the Clean Power Plan is the domestic regulation underpinning the US commitment to the Paris Agreement, the groundbreaking global climate accord reached in December 2015. Although the agreement, signed by Obama shortly before he left office, contains language that would make it difficult for Trump to formally withdraw within the next few years, his order effectively accomplishes the same thing. Without the Clean Power Plan, America’s participation in the agreement becomes meaningless. And without America, the world’s second-biggest climate polluter after China, the whole agreement goes up in smoke.

As a result, the chance that global temperature rise will stay “well below” 2 degrees Celsius above pre-industrial levels, the limit agreed to in Paris, will vanish. That kind of warming will produce a variety of life-threatening effects in the US which, contrary to Mulvaney’s assertion, would cost taxpayers far more—in the form of damage to coastal property, lost agricultural production, increased electrical bills, public health threats, and other costs, according to a recent economic analysis lead by former New York mayor Michael Bloomberg—than what they will save by slashing climate programs.

Still, the impact to developing countries—where livelihoods are more often linked directly to the land and where the money is scarce to, for example, build a storm surge barrier or develop a drought-resistant seed—will likely be even more severe. Millions of the world’s most vulnerable people will suffer the consequences of industrial pollution they did not produce. In other words, they will be left to clean up America’s mess.

In Africa, the most severe impacts will be to agriculture and food security. Sub-Saharan Africa already has the world’s least-productive farms: Average yields of staple grains per hectare are only one-quarter of those in the US and Europe, according to the World Bank, due mainly to poor soil quality and lack of access to financing and the latest farming techniques and equipment. Low productivity not only leads to hunger—23 percent of Africans, 220 million people, are chronically undernourished, the world’s highest rate—but also impedes economic growth, since agriculture is the main income source for a majority of people.

Rising temperatures (Africa has warmed by about 1 degree Fahrenheit in the last 50 years, and is expected to continue warming faster than the global average rate) and increasingly erratic rainfall are making the situation worse. An analysis for the 2014 Intergovernmental Panel on Climate Change report found that prolonged dry spells and high temperatures could reduce yield of staple grains across the continent up to 35 percent by 2050, even as the continent sees its population double.

The consequences will be wide-reaching. Market prices will climb, calorie availability will drop, and national economies will suffer: A recent analysis by the OECD found that reduced agricultural productivity because of climate change could sap up to 4 percent of sub-Saharan Africa’s GDP by 2060, the world’s highest rate of loss. Some areas may become unusable for farming or grazing, forcing people to look for new land, which in turn can lead to territorial ethnic conflicts and deforestation. Food and water scarcity can prompt mass migrations, like the one currently underway in the Sahel, and humanitarian crises, like the 20 million people currently in need of emergency food assistance in southern Africa. It can contribute to radicalization and the empowerment of terrorist groups like Boko Haram, which has benefited from destitution caused by the desiccation of Lake Chad.

These impacts will be borne in particular by the rural poor, who often have no “plan B” when the harvest fails, and in particular by women, who typically are responsible for growing crops for food and cash (in addition to other household duties).

Fortunately, in most cases, the solutions needed to make Africa’s farmers and pastoralists more resilient to climate change are nothing very fancy, expensive, or high-tech. People need training on basic techniques to conserve water and improve soil quality; they need access to microloans to afford better seeds, tools, fertilizer, and irrigation; they need secure land rights; they need better roads to take their produce to markets. The fate of programs to promote these solutions now in place at the the US Agency for International Development, now under the purview of Secretary of State Rex Tillerson, remains unclear.

What farmers don’t need are unchecked greenhouse gas emissions from the US The specific numbers on projections of crop yields, hunger, poverty, and other factors differ slightly depending on which analysis you read, but one trend is consistent: The hotter the world gets, the worse off Africa’s rural poor will be. And if that doesn’t bother this administration, it should, since economic depression and political instability are ultimately harmful to US business, military, and diplomatic interests in Africa.

Deleting climate change from the EPA’s rulebook and the federal budget won’t make it go away—and it won’t settle our environmental debt to the rest of the world.

There’s a lot more oil to keep in the ground all of a sudden.

Mustafa Ali helped to start the EPA’s environmental justice office and its environmental equity office in the 1990s. For nearly 25 years, he advocated for poor and minority neighborhoods stricken by pollution. As a senior adviser and assistant associate administrator, Ali served under both Democratic and Republican presidents — but not under President Donald Trump.

His departure comes amid news that the Trump administration plans to scrap the agency’s environmental justice work. The administration’s proposed federal budget would slash the EPA’s $8 billion budget by a quarter and eliminate numerous programs, including Ali’s office.

The Office of Environmental Justice gives small grants to disadvantaged communities, a life-saving program that Trump’s budget proposal could soon make disappear.

Ali played a role in President Obama’s last major EPA initiative, the EJ 2020 action agenda, a four-year plan to tackle lead poisoning, air pollution, and other problems. He now joins Hip Hop Caucus, a civil rights nonprofit that nurtures grassroots activism through hip-hop music, as a senior vice president.

In his letter of resignation, Ali asked the agency’s new administrator, Scott Pruitt, to listen to poor and non-white people and “value their lives.” Let’s see if Pruitt listens.

Trump just picked an ambassador to Russia who (gasp!) cares about climate change.

Mustafa Ali helped to start the EPA’s environmental justice office and its environmental equity office in the 1990s. For nearly 25 years, he advocated for poor and minority neighborhoods stricken by pollution. As a senior adviser and assistant associate administrator, Ali served under both Democratic and Republican presidents — but not under President Donald Trump.

His departure comes amid news that the Trump administration plans to scrap the agency’s environmental justice work. The administration’s proposed federal budget would slash the EPA’s $8 billion budget by a quarter and eliminate numerous programs, including Ali’s office.

The Office of Environmental Justice gives small grants to disadvantaged communities, a life-saving program that Trump’s budget proposal could soon make disappear.

Ali played a role in President Obama’s last major EPA initiative, the EJ 2020 action agenda, a four-year plan to tackle lead poisoning, air pollution, and other problems. He now joins Hip Hop Caucus, a civil rights nonprofit that nurtures grassroots activism through hip-hop music, as a senior vice president.

In his letter of resignation, Ali asked the agency’s new administrator, Scott Pruitt, to listen to poor and non-white people and “value their lives.” Let’s see if Pruitt listens.

Can Republicans Be Trusted to Investigate Trump’s Russia Scandal?

Last week, news broke that the Senate intelligence committee—as part of its recently launched investigation of both the Russian hacking of the 2016 campaign and contacts between Donald Trump associates and Russia—had sent letters to at least a dozen agencies, individuals, and organizations instructing them to preserve records and information related to the probe. This was one of the first public signs that the Senate committee or the House intelligence committee, which has initiated its own inquiry, had begun any real digging.

But both investigations are proceeding behind a thick veil of secrecy, and there is no way to tell if the Republicans leading these efforts are mounting serious endeavors committed to unearthing facts that might be inconvenient, embarrassing, delegitimizing, or worse for Trump and his White House. So the question remains: Can these committees be trusted to get the job done?

Congressional investigations are not easy tasks. Committees usually are burdened with a wide variety of responsibilities. In the case of the intelligence committees, they are already responsible for monitoring the full intelligence community, which includes 17 different agencies. Veteran members and staffers from these committees routinely say that it’s tough for them to manage the normal oversight. (Watching over just the gigantic National Security Agency could keep a committee busy around the clock.)

Now, these committees have to maintain their current overwhelming duties and also conduct a highly sensitive inquiry. One congressional source says that the House intelligence committee has slightly expanded its staff for the hacking/Trump-Russia investigation. But Jack Langer, the spokesman for Rep. Devin Nunes (R-Calif.), the chairman of the committee, won’t confirm that. And spokespeople for Sen. Richard Burr (R-N.C.), the chairman of the Senate intelligence committee, did not even respond to a request for comment on the staffing issue.

Langer and the Burr spokespeople also wouldn’t say if the House and Senate intelligence committees are coordinating their efforts. Or if either committee has yet issued any subpoenas. Or if the committees will release public updates on the progress of each investigation. This is a red flag. Questions such as these do not involve classified or secret information. The committees could demonstrate their commitment to full accountability by informing the public about these organizational issues. The desire to shield such details does not bode well.

Jeremy Bash, who was chief counsel for the House intelligence committee in 2007 and 2008 (when Democrats controlled Congress), notes that there are three key elements necessary to ensure the intelligence committees conduct an effective investigation: full-time staff with legal or investigative training devoted to the inquiry; access for members and staff to all relevant documents held by government agencies; and a vigorous effort to conduct a broad range of witness interviews. He points out that past intelligence committee investigations have been hindered when intelligence agencies have not allowed staffers easy access to materials. Indeed, the intelligence committees often get into tussles with the spy services they oversee. Three years ago, the Senate intelligence committee had an explosive fight with the CIA over documents when it was examining the agency’s use of torture. This bitter clash threatened to blow up into a full-scale constitutional crisis.

News reports about the Trump-Russia scandal indicate that US intelligence agencies have material—perhaps surveillance intercepts or reports from human assets—relating to contacts between Trump associates and Russians. The FBI reportedly has been investigating these contacts and presumably has collected information relevant to the committees’ inquiries. Yet often intelligence agencies, looking to protect sources and methods or an ongoing investigation, are reluctant to share such information—even with the committees. (Democratic senators and representatives have repeatedly called on the FBI to release to the public information it has on Trump-Russia interactions.)

Much depends on the chairmen of the two committees. How hard will they push if they encounter a roadblock at the FBI or elsewhere? And how far will they go? Will they devote sufficient resources? Will they issue subpoenas for witnesses not eager to accept a committee invitation? A chairman has much discretion in determining the course of an investigation. Imagine that a staffer has located a witness who might possess significant information but that this witness is now living in South Korea. Will the chairman send staff there to locate the witness and obtain a statement? Or might he say, We have to let this one go?

The most crucial element is how committed the chairman is to uncovering the truth. “The real enemy to an investigation is the time that goes by,” says Bash, who helped oversee an investigation of the NSA’s warrantless wiretapping during his time with the house committee. “People lose interest. Other events intervene. The key thing is to get going fast. There are a hundred ways to slow down an investigation by people or agencies who don’t want it.”

Neither Burr nor Nunes has demonstrated much public enthusiasm for investigating the Trump-Russia scandal. At first, Burr wanted his committee to focus solely on the Russia hacking, not ties between Trump associates and Russia. This was no surprise. Most congressional Republicans have either shied away from or downplayed this subject. And Burr did serve on the Trump campaign’s national security advisory council. But after Sens. John McCain (R-Ariz.) and Lindsey Graham (R-S.C.) pushed for a select committee investigation—which would be a more independent inquiry involving a greater number of senators—Burr agreed to widen the intelligence committee probe to cover the Trump-Russia angle. It was obvious that he did so in order not to lose control of the investigation.

Nunes, who was an adviser to Trump’s transition team, initially showed little eagerness for this assignment, as well His announcement in late January that he would proceed with the investigation came only after Burr’s change of heart—and followed weeks of public pressure from Rep. Adam Schiff, (D-Calif.), the ranking Democrat on the House intelligence committee. Skepticism regarding the willingness of Burr or Nunes to lead robust, wherever-it-goes investigations is hardly unfounded.

On Friday, the Washington Post reported—and the White House confirmed—that Burr and Nunes had been enlisted by the Trump administration to be part of its effort to counter news stories about Trump associates’ ties to Russia. Their participation in this spin campaign has undermined their claims of independence. And on Saturday—in response to Rep. Darrell Issa’s (R-Calif.) surprising call for a special prosecutor to investigate the Trump-Russia connections—Nunes dismissed Issa’s demand, saying, “This is almost like McCarthyism revisited. W’’re going to go on a witch hunt against, against innocent Americans?” He added, “At this point, there’s nothing there.” That’s not the manner in which the head of an independent investigation should be talking about the inquiry. How does Nunes know who’s innocent or not—or whether there’s nothing there—at this point?

In recent weeks, Democratic members of both committees told me that, at least for the time being, they were hoping for the best and taking Burr and Nunes at their word when they claim they are committed to conducting thorough investigations, holding public hearings, and releasing public findings. These recent actions of Burr and Nunes may change that perspective. Schiff has said he will release public updates on the progress of the House committee’s inquiry, though he has not issued one yet.

On the Senate side, Democrats say that the effectiveness of the investigation may depend on McCain. He is not a full member of the Senate intelligence committee, but as chair of the Senate armed services committee, he is an ex officio member of the intelligence committee. In that regard, he has the same access as a full member to the investigation’s materials, and he can monitor the inquiry. Should he conclude the investigation is not proceeding vigorously, he will be in a position to publicly shame Burr and revive his demand for a select committee probe. Of course, Democrats on the Senate and House intelligence committees could do the same, but they won’t have the same political standing to pull that sort of move.

For weeks, Democrats on both sides of Capitol Hill have called for an independent bipartisan commission—similar to the well-regarded 9/11 commission—to investigate this affair. This inquiry would operate outside of the congressional committee system—meaning outside of GOP control. Naturally, the Republican congressional leadership has opposed the move and has declared that it’s just fine to let the intelligence committees do their work. And McCain and Graham have yet to endorse the Democrats’ proposal. But that is a card McCain could play if the Senate investigation does not meet his standards. Still, every time there is a development in the Trump-Russia story—such as last week when it was reported that the Trump White House asked the FBI to knock down the news stories saying that Trump associates had interacted with Russian intelligence—Democrats renew their call for an independent commission that would be distant from congressional politics.

Even with the FBI investigating, the congressional investigations are crucial. The FBI inquiry is either a counterintelligence probe or a criminal investigation (or maybe both). Neither of those are designed or intended to provide a full accounting to the public. An FBI criminal inquiry (usually) only yields public information if someone ends up being charged with a crime and the case goes to trial. And in such instances, the only information that emerges is material necessary for the prosecution of the case. That could be a small slice of whatever the bureau obtained.

A counterintelligence investigation aims to discover and possibly counter a foreign actor’s effort to target the United States with espionage, covert action, or terrorism. These sort of probes tend to stay secret unless they result in a criminal case. (Perhaps a spy is discovered and arrested, or a would-be terrorist indicted.) In an unusual move, the intelligence community, at President Barack Obama’s direction, did release some of its assessments regarding the Russia hacking. But whatever the FBI and other intelligence agencies may be investigating, their efforts are not likely to produces a comprehensive public accounting of this double scandal: Vladimir Putin’s attack on the US election and the interactions between the president’s crew and the foreign power that waged this political warfare.

As of now, that’s the job of the two congressional intelligence committees. Both are under the direction of Republicans who have supported Trump and participated in White House spin efforts. Both are moving forward cloaked by their customary secrecy. And both have yielded no indications yet that they will produce the investigations and public findings necessary to resolve these grave matters.

CNN: US Intelligence Has Confirmed Parts of the Trump-Russia Memos

US investigators have confirmed parts of the 35-page batch of memos compiled by a former British spy, CNN reported Friday afternoon. The memos, first written about by Mother Jones in October 2016, contained allegations of collusion between officials working for Donald Trump during the presidential campaign and Russian government operatives, and allegations that the Russian government was working to harm the candidacy of Hillary Clinton and boost Trump.

Friday’s CNN report says investigators have confirmed that some of the conversations between senior Russian officials and other Russian officials occurred on the same days and from the same locations alleged in the memos.

“The corroboration, based on intercepted communications, has given US intelligence and law enforcement ‘greater confidence’ in the credibility of some aspects of the dossier as they continue to actively investigate its contents,” CNN reported.

None of the newly learned information relates to the salacious allegations in the dossier. Rather it relates to conversations between foreign nationals. The dossier details about a dozen conversations between senior Russian officials and other Russian individuals. Sources would not confirm which specific conversations were intercepted or the content of those discussions due to the classified nature of US intelligence collection programs.

But the intercepts do confirm that some of the conversations described in the dossier took place between the same individuals on the same days and from the same locations as detailed in the dossier, according to the officials. CNN has not confirmed whether any content relates to then-candidate Trump.

US intelligence officials emphasize the conversations were solely between foreign nationals, including those in or tied to the Russian government, intercepted during routine intelligence gathering.

Some of the individuals involved in the intercepted communications were known to the US intelligence community as “heavily involved” in collecting information damaging to Hillary Clinton and helpful to Donald Trump, two of the officials tell CNN.

White House Press Secretary Sean Spicer told CNN, “We continue to be disgusted by CNN’s fake news reporting.” In a subsequent call, Spicer told the CNN reporters that their story was “more fake news,” and said it was “about time CNN focused on the success the President has had bringing back jobs, protecting the nation, and strengthening relationships with Japan and other nations.”

CNN’s report on Friday is the first public corroboration by the US intelligence community that any reports contained in memos were accurate, but CNN’s sources did not comment on or confirm the specific allegations relating to alleged contact between Russian officials and any US citizens, including people close to Trump.

CNN had previously reported that the heads of the FBI, the CIA, and the National Security Agency, along with the Office of the Director of National Intelligence, briefed Trump and former President Barack Obama on the contents of the memos in early January.

House Dems Demand Investigation of Michael Flynn’s Putin Dinner

A key Trump White House official may have violated the Constitution in 2015 when he delivered a paid speech in Moscow and dined with Vladimir Putin, congressional Democrats alleged Wednesday. According to the lawmakers, Michael Flynn, the controversial national security adviser, may have run afoul of the Constitution’s Emoluments Clause.

Since Donald Trump’s election in November, ethics experts have raised concerns that the president’s many overseas business interests might violate the Emoluments Clause—a provision that prohibits federal office holders from accepting financial benefits from a foreign government. But the possibility that Flynn, a retired Army general, may have also violated the clause is new.

The concern was raised in a letter signed by top Democrats on the House Oversight, Armed Services, Judiciary, Homeland Security, Intelligence, and Foreign Affairs committees and focuses on a trip to Russia that Flynn took in December 2015. On the trip, Flynn attended a 10th anniversary gala celebration for RT, the pro-Russia news outlet owned by the Russian government. At the gala, Flynn appeared on a panel and then sat next to Putin during dinner. Flynn retired from the military prior to the trip, but the Democratic letter notes that he may still have been covered by the Emoluments Clause.

In an interview with the Washington Post last year, Flynn downplayed the importance of the meeting by making it clear that he was only there as a paid speaker.

“I was asked by my speaker’s bureau, LAI. I do public speaking. It was in Russia. It was a paid speaking opportunity,” Flynn told the Post. “The gig was to do an interview with RT correspondent Sophie Shevardnadze. It was an interview in front of the forum, probably 200 people in the audience.”

Flynn would not tell the Post how much he was paid for the event. The White House did not immediately respond to Mother Jones’ request for comment on the letter.

Flynn had a long career in the US Army, rising to the rank of lieutenant general, and spent two years as the head of the Defense Intelligence Agency under Barack Obama. After clashing with Obama, Flynn retired from the Army in August 2014, roughly 16 months before his trip to Moscow. But the House Democrats’ letter points out that the Department of Defense has issued multiple warnings to retired military officers about accepting payments from foreign governments.

“Significantly, retired regular military officers are also subject to the Emoluments Clause because they are subject to recall, and, therefore, hold an ‘Office of Profit or Trust’ under the Emoluments Clause,” a 2013 Department of Defense white paper reads.

The Democrats point to other Department of Defense memos making clear that the restriction covers commercial entities owned by foreign governments, which could include RT because it is part of the state-owned RIA Novosti press agency.

The letter was sent to newly confirmed Secretary of Defense James Mattis. It asks for an investigation, including an examination of communications between Flynn and RT, as well as the details of how much he was paid.

A leaked list of Trump’s infrastructure priorities looks pretty surprising.

That’s how new news site Axios described it Monday morning, and the news has just gotten worse since then.

A leaked copy of the Trump team’s plan for the EPA calls for slashing its budget, “terminating climate programs,” ending auto fuel-economy standards, and executing “major reforms of the agency’s use of science and economics.”

The Trump administration has frozen EPA grants and contracts, cutting off funding for everything from cleanup of toxic sites to testing of air quality.

EPA employees have been ordered not to share information via social media, press releases, or new website content, Huffington Post reports.

It’s unclear which of these changes are temporary — just in place until Trump’s nominee to head the EPA, Scott Pruitt, gets confirmed — and which might be put in place more permanently.

More bad news for the EPA will be coming: A new team that Trump has put in place to shift the agency’s direction includes three former researchers from Koch-funded think tanks, one former mining lobbyist, and a number of people who have argued against climate action, according to Reuters. And Trump is poised to issue executive orders to weaken pollution rules and cut agency budgets, Vox reports.
