We asked a range of authors, artists, and poets to name books that bring solace or understanding in this age of rancor. Two dozen or so responded. Here are picks from the climate change expert, editor, and blogger extraordinaire Joe Romm.

Reading recommendations: As a blogger, I am drawn toward collections of short essays. The last time this country was so divided, the greatest orator and writer ever elected president repeatedly shared his thoughts on what the country needed to do to preserve liberty. Abraham Lincoln: His Speeches and Writings, edited by Roy Basler and Carl Sandburg, is one of the best collections. It includes classics like the Gettysburg Address alongside lesser-known gems like “The Perpetuation of Our Political Institutions,” in which a 28-year-old Lincoln explains the danger to the Republic of a demagogue just like Trump.

A Collection of Essays, by George Orwell: Orwell is so relevant today, 67 years after his death, that he was, as of late, ranked as Amazon’s No. 1 author in both “classics” and “contemporary” literature and fiction! He is also the greatest essayist of the last century, and few essays speak better to our alternative-facts president than 1946’s “Politics and the English Language,” in which Orwell explains why “in our time, political speech and writing are largely the defence of the indefensible.”

Brave New World Revisited, by Aldous Huxley: Brave New World, published in 1932, envisioned a dystopian future for humanity. In 1956, Huxley published a series of essays on the topic that are as relevant today as Orwell’s, with titles like “Propaganda in a democratic society” and “Subconscious persuasion.” A particular must-read is Huxley’s 1949 letter to Orwell about which of their dystopias would turn out to be more prescient.

This Tech Company’s Anti-Censorship Stance Is Helping Hate Speech

Since its launch in 2013, the neo-Nazi website The Daily Stormer has quickly become the go-to spot for racists on the internet. Women are whores, blacks are inferior and a shadowy Jewish cabal is organizing a genocide against white people. The site can count among its readers Dylann Roof, the white teenager who slaughtered nine African Americans in Charleston in 2015, and James Jackson, who fatally stabbed an elderly black man with a sword in the streets of New York earlier this year.

Traffic is up lately, too, at white supremacist sites like The Right Stuff, Iron March, American Renaissance and Stormfront, one of the oldest white nationalist sites on the internet.

The operations of such extreme sites are made possible, in part, by an otherwise very mainstream internet company—Cloudflare. Based in San Francisco, Cloudflare operates more than 100 data centers spread across the world, serving as a sort of middleman for websites—speeding up delivery of a site’s content and protecting it from several kinds of attacks. Cloudflare says that some 10 percent of web requests flow through its network, and the company’s mainstream clients range from the FBI to the dating site OKCupid.

The widespread use of Cloudflare’s services by racist groups is not an accident. Cloudflare has said it is not in the business of censoring websites and will not deny its services to even the most offensive purveyors of hate.

“A website is speech. It is not a bomb,” Cloudflare’s CEO Matthew Prince wrote in a 2013 blog post defending his company’s stance. “There is no imminent danger it creates and no provider has an affirmative obligation to monitor and make determinations about the theoretically harmful nature of speech a site may contain.”

Cloudflare also has an added appeal to sites such as The Daily Stormer. It turns over to the hate sites the personal information of people who criticize their content. For instance, when a reader figures out that Cloudflare is the internet company serving sites like The Daily Stormer, they sometimes write to the company to protest. Cloudflare, per its policy, then relays the name and email address of the person complaining to the hate site, often to the surprise and regret of those complaining.

This has led to campaigns of harassment against those writing in to protest the offensive material. People have been threatened and harassed.

ProPublica reached out to a handful of people targeted by The Daily Stormer after they or someone close to them complained to Cloudflare about the site’s content. All but three declined to talk on the record, citing fear of further harassment or a desire to not relive it. Most said they had no idea their report would be passed on, though Cloudflare does state on the reporting form that they “will notify the site owner.”

“I wasn’t aware that my information would be sent on. I suppose I, naively, had an expectation of privacy,” said Jennifer Dalton, who had complained that The Daily Stormer was asking its readers to harass Twitter users after the election.

Andrew Anglin, the owner of The Daily Stormer, has been candid about how he feels about people reporting his site for its content.

“We need to make it clear to all of these people that there are consequences for messing with us,” Anglin wrote in one online post. “We are not a bunch of babies to be kicked around. We will take revenge. And we will do it now.”

ProPublica asked Cloudflare’s top lawyer about its policy of sharing information on those who complain about racist sites. The lawyer, Doug Kramer, Cloudflare’s general counsel, defended the company’s policies by saying it is “base constitutional law that people can face their accusers.” Kramer suggested that some of the people attacking Cloudflare’s customers had their own questionable motives.

Hate sites such as The Daily Stormer have become a focus of intense interest since the racially divisive 2016 election—how popular they are, who supports them, how they are financed. Most of their operators supported Donald Trump and helped spread a variety of conspiracy theories aimed at damaging Hillary Clinton. But they clearly have also become a renewed source of concern for law enforcement.

In testimony Tuesday before the Senate Judiciary Committee, Chief Will D. Johnson, chair of the International Association of Chiefs of Police Human and Civil Rights Committee, highlighted the reach and threat of hate on the Internet.

“The internet provides extremists with an unprecedented ability to spread hate and recruit followers,” he said. “Individual racists and organized hate groups now have the power to reach a global audience of millions and to communicate among like-minded individuals easily, inexpensively, and anonymously.

“Although hate speech is offensive and hurtful, the First Amendment usually protects such expression,” Johnson said. “However, there is a growing trend to use the Internet to intimidate and harass individuals on the basis of their race, religion, sexual orientation, gender, gender identity, disability, or national origin.”

A look at Cloudflare’s policies and operations sheds some light on how sites promoting incendiary speech and even violent behavior can exist and even thrive.

Jacob Sommer, a lawyer with extensive experience in internet privacy and security issues, said there is no legal requirement for a company like Cloudflare to regulate the sites on their service, though many internet service providers choose to. It comes down to a company’s sense of corporate responsibility, he said.

For the most part, Sommers said, a lot of companies don’t want “this stuff” on their networks. He said those companies resist having their networks become “a hive of hate speech.”

Jonathan Vick, associate director for investigative technology and cyberhate response at the Anti-Defamation League, agrees. He said that many of the hosts they talk to want to get hate sites off their networks.

“Even the most intransigent of them, when they’re given evidence of something really problematic, they do respond,” he said.

Cloudflare has raised at least $180 million in venture capital since its inception in 2009, much of it from some of the most prominent venture capital firms and tech companies in the country. The service is what’s known as a content delivery network, and offers protection from several cyber threats including “denial of service” attacks, where hundreds of computers make requests to a website at once, overwhelming it and bringing it down.

Company officials have said Cloudflare’s core belief is in the free and open nature of the internet. But given its outsize role in protecting a range of websites, Cloudflare has found itself the target of critics.

In 2015, the company came under fire from the hacker collective Anonymous for reportedly allowing ISIS propaganda sites on its network. At the time, Prince, the company’s CEO, dismissed the claim as “armchair analysis by kids,” and told Fox Business that the company would not knowingly accept money from a terrorist organization.

Kramer, in an interview with ProPublica, reiterated that the company would not accept money from ISIS. But he said that was not for moral or ethical reasons. Rather, he said, Cloudflare did not have dealings with terrorists groups such as ISIS because there are significant and specific laws restricting them from doing so.

In the end, Kramer said, seedy and objectionable sites made up a tiny fraction of the company’s clients.

“We’ve got 6 million customers,” he told ProPublica. “It’s easy to find these edge cases.”

One of the people ProPublica spoke with whose information had been shared with The Daily Stormer‘s operators said his complaint had been posted on the site, but that he was “not interested in talking about my experience as it’s not something I want to revisit.” Someone else whose information was posted on the site said that while she did get a few odd emails, she wasn’t aware her information had been made public. She followed up to say she was going to abandon her email account now that she knew.

“The entire situation makes me feel uneasy,” she said.

Scott Ernest had complained about The Daily Stormer‘s conduct after Anglin, its owner, had used the site to allegedly harass a woman in the town of Whitefish, Montana. After his complaint, Ernest wound up on the receiving end of about two dozen harassing emails or phone calls.

“Fuck off and die,” read one email. “Go away and die,” read another. Those commenting on the site speculated on everything from Ernest’s hygiene to asking, suggestively, why it appeared in a Facebook post that Ernest had a child at his house.

Ernest said the emails and phone calls he received were not traumatizing, but they were worrying.

“His threats of harassment can turn into violence,” he said of Anglin.

Anglin appears quite comfortable with his arrangement with Cloudflare. It doesn’t cost him much either—just $200 a month, according to public posts on the site.

“Any complaints filed against the site go to Cloudflare, and Cloudflare then sends me an email telling me someone said I was doing something bad and that it is my responsibility to figure out if I am doing that,” he wrote in a 2015 post on his site. “Cloudflare does not regulate content, so it is meaningless.”

Representatives from Rackspace and GoDaddy, two popular web hosts, said they try to regulate the kinds of sites on their services. For Rackspace, that means drawing the line at hosting white supremacist content or hate speech. For GoDaddy, that means not hosting the sort of abusive publication of personal information that Anglin frequently engages in.

“There is certainly content that, while we respect freedom of speech, we don’t want to be associated with it,” said Arleen Hess, senior manager of GoDaddy’s digital crimes unit.

Both companies also said they would not pass along contact information for people who complain about offensive content to the groups generating it.

Amazon Web Services, one of the most popular web hosts and content delivery networks, would not say how they handle abuse complaints beyond pointing to an “acceptable use” policy that restricts objectionable, abusive and harmful content. They also pointed to their abuse form, which says the company will keep your contact information private.

According to Vick at the ADL, the fact that Cloudflare takes money from Anglin is different from if he’d just used their free service.

“That’s a direct relationship,” he said. “That raises questions in my mind.”

Some companies offering other services vital to success on the web have chosen not to do business with Anglin’s The Daily Stormer. Google, PayPal and Coinbase, for instance, have chosen to cut off his accounts rather than support his activities. Getting booted around from service to service can make it hard to run a hate site, but Cloudflare gives the sites a solid footing.

And, by The Daily Stormer‘s account, advice and assurances. In a post, the site’s architect, Andrew Auernheimer, said he had personal relationships with people at Cloudflare, and they had assured him the company would work to protect the site in a variety of ways—including by not turning over data to European courts. Cloudflare has data centers in European countries such as Germany, which have strict hate speech and privacy laws.

Company officials offered differing responses when asked about Auernheimer’s post. Kramer, Cloudflare’s general counsel, said he had no knowledge of employee conversations with Auernheimer. Later, in an email, the company said Auernheimer was a well-known hacker, and that as a result at least one senior company official “has chatted with him on occasion and has spoken to him about Cloudflare’s position on not censoring the internet.”

A former Cloudflare employee, Ryan Lackey, said in an interview that while he doesn’t condone a lot of what Auernheimer does, he did on occasion give technical advice as a friend and helped some of the Stormer‘s issues get resolved.

“I am hardcore libertarian/classical liberal about free speech—something like Daily Stormer has every right to publish, and it is better for everyone if all ideas are out on the internet to do battle in that sphere,” he said.

Vick at the ADL agrees that Anglin has a right to publish, but said people have the right to hold to task the Internet companies that enable him.

“Andrew Anglin has the right to be out there and say what he wants to say. But the people who object to what he has to say have a right to object as well,” he said. “You should be able to respond to everybody in the chain.”

How to Pass a Thousand-Year Tax Cut

Republicans would like to pass a permanent tax cut. Sadly for them, Senate procedures prevent that. The only way to avoid a Democratic filibuster is to pass their tax plan via reconciliation, which requires only 51 votes in the Senate and can’t be filibustered. But thanks to the Byrd Rule, any reconciliation bill that increases the deficit beyond a 10-year window is once again subject to a filibuster, and that would doom any tax measure. This limits Republicans to tax plans that sunset in 2028.

But wait. Maybe there’s an alternative. The Wall Street Journal explains:

President Donald Trump has said he wants to cut taxes, big-league, and Republicans are having trouble squeezing his ambitions into congressional rules forbidding bigger deficits after a 10-year budget scoring window.

Some lawmakers are exploring a way around that problem: Make the window bigger. Sen. Pat Toomey (R., Pa.) suggested last week a “longer horizon” to overcome obstacles posed by the process known as reconciliation….A 15-year, 20-year or 30-year budget window could let Republicans pass a temporary tax cut that is long enough to give companies confidence to invest but short enough so its fiscal effects peter out by the 2030s or 2040s.

Surprised? That’s because everyone always talks about the Byrd Rule forbidding deficit increases beyond a 10-year “budget window.” But that’s not what it says. Here’s the actual relevant language:

A provision shall be considered to be extraneous if it decreases revenues during a fiscal year after the fiscal years covered by such reconciliation bill or reconciliation resolution.

In this context, “extraneous” means it can be filibustered, and there’s nothing in there about ten years. That’s just custom. If Republicans felt like it, they could pass a bill that “covers” the next millennium and sunsets in 3018. Here is Daniel Hemel, an assistant professor of law at the University of Chicago:

“I don’t think there’s anything magical about the number 10, other than 10 has been the maximum number for long enough that 11 would seem like a break from Senate norms.”

But who cares about Senate norms? Not Republicans. So there must be something more to this or they’d just go ahead and do it. One possibility is that there are still a handful of old-school deficit hawks left in the party, and they won’t vote for a longer budget window. Or there might be some arcane technical issue involved. I would be fascinated to hear from a real budget expert on this.

Trump’s War on "Fake News" Is Chillingly Real

By now America mostly yawns when Donald Trump declares reporting from the New York Times, CNN, and other top media outlets to be phony. The president of the United States scornfully calling out “fake news” has essentially become normal. And that is exactly the point.

As a legion of pundits takes measure of how little Trump has accomplished during his first 100 days, the facts don’t lie about his quantifiable efforts to undermine the press. The Oval Office may require a bunch more work than Trump anticipated, but when it comes to weakening the immune system of our democracy he has given it the college try. To date Trump has used one of his biggest presidential megaphones—his Twitter accounts—to attack the media no fewer than 45 times. His railing against “fake news” to his more than 45 million followers caught the most attention in mid-February, when he declared, “The FAKE NEWS media (failing @nytimes, @NBCNews, @ABC, @CBS, @CNN) is not my enemy, it is the enemy of the American People!”

That’s just the social-media sum of his authoritarian invective on this front. Trump has also used press conferences and campaign-style rallies to go on the offensive against journalists whose critical coverage he didn’t like, as he often did on the road to the White House. He has made ominous threats about cracking down on press freedom, in particular singling out the New York Times when he suggested changing libel laws. His burn-it-all-down chief strategist Steve Bannon famously labeled the media “the opposition party” and demanded it “keep its mouth shut.” And, as the White House has worked vigorously to distract from a widening Russia investigation that could hobble or perhaps even bring down Trump’s presidency, Trump and his allies have focused on going after leakers to the press.

Recently, Politico‘s Ben Schreckinger and Hadas Gold made the case that Trump’s war on “fake news” is itself fake. The current occupants of the White House know they can’t in reality control the media, and moreover they’ve engaged in prodigious infighting through their own rash of leaks. (The Politico piece also informed us that White House officials have been lying to reporters for sport.)

But over the long term, Trump’s war on the media could have real consequences. Public confidence in the press flatlined last year. Add to that a White House repeating week after week that the most accomplished media institutions in our country are phony—while at the same time embracing actual purveyors of fake news—and the danger requires no fact-checking to be evident.

The good news is that many in the Fourth Estate have been rising to the challenge. Not too long ago, it was about as interesting and informative to tune into CNN as it was to watch a home shopping channel. But even though the cable network has shamelessly used duplicitous Trump surrogates to juice conflict and thereby ratings for its commentary shows, CNN reporters and anchors have come alive in the face of Trump, especially Jim Sciutto, Dana Bash, Jim Acosta, Jake Tapper, and Brian Stelter. The New York Times‘ tough-minded Maggie Haberman has provided a stellar window into how the neophyte president operates. The Washington Post‘s David Farenholdt won a much deserved Pulitzer Prize for his investigations of Trump’s bogus philanthropic claims (notwithstanding Donald Trump Jr.’s own risible pick for the prize). And I’d be remiss if I didn’t mention Mother Jones‘ own leading investigative work on the Russia scandal and Trump’s unprecedented financial conflicts of interest.

As Trump’s attacks against the press go on, and they will, the American news media should take nothing for granted. But journalists can also keep the faith given what history has shown about this battle. “Four hostile newspapers,” as Napoleon once said, “are more to be feared than a thousand bayonets.”

The Times is now publishing climate denial. Scientists are not having it.

Two weeks ago, the New York Times took on Bret Stephens — who once called climate change an “imaginary” problem — as an op-ed columnist in an effort to reflect more political perspectives.

His first column came out on Friday, and — surprise — it casts doubt on the certainty of the scientific consensus on climate.

Previously, while some readers had threatened to cancel their subscriptions as a result of his controversial stances on science, Muslims, and campus rape, “relatively few” had done so, wrote Liz Spayd, the Times’ public editor.

The backlash to Spayd’s piece was real. Climatologist Michael Mann canceled his subscription and started the Twitter hashtag #ShowYourCancellation.

“There is no left-leaning or right-leaning climate science, just as there is no Democrat or Republican theory of gravity,” wrote Stefan Rahmstorf, head of Earth System Analysis at the Potsdam Institute for Climate Impact Research, in his cancellation letter.

Other scientists joined in:

James Bennet, the paper’s editorial page editor, defended the decision to hire Stephens. We shouldn’t ignore the perspective of the “millions of people who agree with him,” he told HuffPost.

Well, yes — but millions of people have been wrong before. That doesn’t mean alternative facts should be given a platform.

Now that Stephens’ first piece is up, we’ll see if more cancellations follow.

The Most Important Free Speech Question Is: Who Decides?

Like everyone, I’ve been watching as the free speech debate on college campuses has morphed from its usual steady background hum into a Big Issue Of The Day. First there was Milo Yiannopoulos at Berkeley. Then Charles Murray at Middlebury. Heather Mac Donald at Claremont McKenna. Ann Coulter at Berkeley. The right is naturally outraged that these speakers were harassed or banned, and the left is—well, what is the left’s reaction to all this? At first, it was mostly a matter of not really sticking up for free speech rights on campus. That was bad enough, but then the conversation changed. Instead of a collective mumble, I began reading affirmative arguments that there was absolutely nothing wrong with “no-platforming” these folks. For example, a few days ago a New Republic article showed up in my Facebook feed and got high fives from several people I follow. Here is Aaron Hanlon:

When departments or groups arrange for a speaker, invitations are usually authorized by small committees or localized administrative offices without a campus-wide discussion or debate….Instead of community-wide discussion and debate over the merits of bringing a given speaker to campus, the debate happens after the invitation, giving the misleading impression that no-platforming is about shutting down speech.

….But no-platforming is better understood as the kind of value judgment that lies at heart of a liberal arts education….This has always meant deciding what people needed to know, but also what they don’t need to know—or at least which knowledge and skills deserved priority in one’s formal education.

….No-platforming may look like censorship from certain angles, but from others it’s a consequence of a challenging, never-ending process occurring at virtually all levels of the university: deciding what educational material to present to our students and what to leave out. In this sense, de-platforming isn’t censorship; it’s a product of free expression and the foundational aims of a classically liberal education.

The sophistry here is breathtaking. If it’s just some small group that invites someone, then it’s OK if the rest of the university blackballs their choice. After all, universities are supposed to decide what students don’t need to know. It may “look like censorship from certain angles,” but it’s actually the very zenith of free expression. Juliet Kleber followed up today:

As Aaron Hanlon argued in the New Republic earlier this week, choosing not to host Ann Coulter or Milo Yiannopoulos on campus is not a suppression of their free speech. Academia certainly has an important place in selecting and elevating certain voices to relevance in a broader culture, but let’s not forget that a college isn’t a town hall: it’s a particular community of people engaged in intersecting missions of education. Coulter is not a member of that community and she has no claims upon it. Campus life is curated, and none of us outside of it are guaranteed access to that platform.

Enough. I don’t usually pay a lot of attention to the latest outrages on college campuses because college campuses are teeming with smart, verbal, overconfident 19-year-olds. Of course they do stupid things. We all did stupid things at that age. I’m generally happy for all these micro-outrages to remain local controversies handled by local administrators.

But now everyone is weighing in, and here on the left we’re caving in way too often to this Hanlon-esque lunacy. Is some of the speech he’s concerned about ugly and dangerous and deliberately provocative? Of course it is. But that’s not a reason to shut it down. That’s the whole reason we defend free speech in the first place. If political speech was all a harmless game of patty-cake, nobody would even care.

Speech is often harmful. And vicious. And hurtful. And racist. And just plain disgusting. But whenever you start thinking these are good reasons to overturn—by violence or otherwise—someone’s invitation to speak, ask yourself this: Who decides? Because once you concede the right to keep people from speaking, you concede the right of somebody to make that decision. And that somebody may eventually decide to shut down communists. Or anti-war protesters. Or gays. Or sociobiologists. Or Jews who defend Israel. Or Muslims.

I don’t want anyone to have that power. No one else on the left should want it either.

Here’s Why Trump Is Having a Cow Over Canadian Milk

Donald Trump hasn’t done much in his young presidency to delight high-powered Democratic lawmakers like Senate Majority Leader Chuck Schumer (D-N.Y.). But last week, Trump did just that when he picked a fight with Canada’s dairy farmers, after receiving a letter urging him to do so from Schumer, Sen. Kirsten Gillibrand (D-N.Y.), and Sen. Tammy Baldwin (D-Wis.).

Trump’s beef with Canadian dairy played well with Republicans, too. At a speech in dairy-heavy Wisconsin last week (video here), Trump fulminated against our northern neighbor’s milk policy and vowed to organize what sounds like a dramatically awkward group phone call involving the state’s most prominent politicians: Wisconsin Gov. Scott Walker, Sen. Ron Johnson (R-Wis.), and House Speaker Paul Ryan (R-Wis.). “We’re going to get together and we’re going to call Canada, and we’re going to say, ‘What happened?'” he thundered. “And they might give us an answer, but we’re going to get the solution, not just the answer, okay?”

Okay!

If you’re wondering what the hell Trump is babbling about—and why Canadian milk generates such strange, and angry, bedfellows south of its border—here’s a primer.

• US dairy producers are churning out way too much milk, and they have been for a while. “Farmers in the U.S. are pouring out tens of millions of gallons of excess milk, amid a massive glut that has slashed prices and has filled warehouses with cheese,” the Wall Street Journal reported last October. In the first eight months of 2016, the paper added, US dairy farmers dumped out 66 Olympic swimming pools worth of milk, the “most wasted in at least 16 years.” In 2015, too, there was “so much milk flowing out of US cows…that some is ending up in dirt pits because dairies can’t find buyers,” Bloomberg reported at the time.

The backstory: Goaded by rising demand for dairy products from Asia and low prices for feed, US farmers scaled up in 2014, increasing their herds and squeezing out more milk per cow. Trouble is, farmers in other big milk-producing regions like New Zealand made the same bet, and now there’s a global milk glut. The practice of dumping surplus milk has continued into this spring, the US Department of Agriculture recently reported.

US agriculture programs give dairy farmers incentive to produce as much as possible, embroiling them in boom-and-bust cycles like the current one, driving small farms out of business and forcing survivors to scale up. As recently as 1950, around 3.5 million US farms kept dairy cows; by 2012, that number had dwindled to 58,000, even as overall production surged. The shakeout continues. “In 2010, Vermont had more than 1,000 dairy farms, but by the end of last year there were just over than 800,” NPR recently reported.

Meanwhile, the massive overproduction persists amid heroic, government-led efforts to prod Americans to consume more dairy. As Josh Harkinson reported in 2015, USDA dietary guidelines urge everyone nine years old or older to drink three cups of milk per day, a recommendation that owes much more to industry lobbying than it does to sound nutrition science. Then there’s Dairy Management, a group overseen by the USDA that works with “influential and globally recognized companies such as McDonald’s, Domino’s, Quaker, Taco Bell and Pizza Hut” to work more dairy into fast food. Oy.

• Canada’s dairy farmers are largely insulated from these cycles. That’s because, in sharp contrast to the US government, Canada’s dairy policy is based on production quotas that prevent farmers from either under- or overproducing. The program guarantees farmers get a price that covers their production costs, and slaps a high tariff on dairy imports, protecting them from foreign competition. Canadian consumers tend to pay more for milk than their peers, but not prohibitively so. Overall, Canadians devote just 9.7 percent of their overall expenditures to groceries, one of the lowest rates in the world. (US consumers have the lowest rate of all: 6.4 percent.)

Canada’s dairy program, known as “supply management,” might sound crazy to US ears, but it has advantages. In an excellent 2010 Gastronomica article, Barry Estabrook noted that, while decades of booms and busts had hollowed out dairy farming in New England and upstate New York, small and mid-sized dairy farms just over the border in Ontario—farming the “same gently rolling tapestry of field and forest”—are thriving.

• But there’s a hole in Canada’s dairy-tariff wall. So-called ultra-filtered milk—made with a process that concentrates milk proteins, separating out the fat—is a relatively new invention, designed to make dairy products that are highly concentrated and shelf-stable, and thus easy to export. Because of a loophole in trade law, Canada’s dairy tariffs don’t apply to it, and so the US dairy industry has been exporting ultra-filtered milk into Canada for years, where it competes with less processed domestic skim milk in cheese making. Major production plants have “been built in recent years along the Canada-US border in states like New York and Wisconsin to service Canadian demand,” reports the Canadian news site iPolitics.com; and it has grown into a $150 million market for US producers.

• Canada just slammed shut that loophole—enraging the US industry and capturing Trump’s attention. In a policy change announced in February and put into effect recently, Canada dropped the price for processed dairy products, essentially pricing US ultra-filtered milk out of its market. Two US dairy companies geared to the Canadian market—one in Wisconsin, one in New York—immediately complained of lost sales; the Wisconsin one, Grassland Dairy products, delivered bad news to 75 farms: It would no longer buy their milk. The development inflamed politicians in Democratic Party-dominated New York and and GOP-heavy Wisconsin, and eventually in the White House.

• But the US dairy industry has been itching for years to break down Canada’s tariff wall and undercut its dairy program—as have Democratic politicians. Under Barack Obama, US negotiators pushed hard to fully pry open the Canadian market to US dairy under the Trans-Pacific Partnership, the trade deal championed by Obama and ultimately killed by Trump. And Tom Vilsack, who served as Obama’s secretary of agriculture for the entire eight-year term, now leads the US Dairy Export Council, a Big Dairy group that for years has pushed against Canada’s program. Vilsack recently signed a letter to Trump demanding “immediate action” against Canada for icing out US ultra-filtered milk.

• Canada aside, though, US dairy farmers clearly can’t export their way out of the dairy glut. As Chris Holman, a Wisconsin farmer who is active in the Wisconsin Farmers Union, noted in a recent blog post, the underlying problem is a “vicious cycle” that leads to oversupply: “When markets are up, farms often expand and production increases to take advantage of better prices. When the milk supply goes up and markets are down, farms often expand and production increases as they try to keep their heads above water.” Holman recently told me that “if every dairy farm in Wisconsin culled one cow out of production, it would more than make up for the milk lost to Canada, and everyone can keep farming.”

But organizing such a move would essentially require supply management—something anathema to big US dairy processors, which enjoy all the cheap milk encouraged by a lack of production controls. Ferd Hoefner, former policy director and current senior strategic adviser for the National Sustainable Agriculture Coalition, told me that the 2014 farm bill included a supply management program for dairy, but it was struck down at the last minute.

• Wisconsin is a dairy-heavy state—and one that Trump barely won. And also the home of Ryan, with whom Trump needs to be friendly if he is going to get anything done in Congress. Moreover, his anti-trade tirades have not been popular with US Big Ag interests, which rely heavily on exports. Applying his fierce trade rhetoric to pry open Canada’s domestic dairy market may be a way for him to appease those interests.

Meanwhile, this week, Trump added more fuel to his trade war with Canada, imposing hefty duties on lumber imports from there. As the Los Angeles Times noted, “Dairy and lumber are sensitive industries in the heartland and rural parts of America, and any moves to strengthen those domestic constituents could help the administration garner congressional support for its broader trade policy objectives.” And picking on Canada is less risky than picking on his usual targets, China and Mexico. “It’s not like Canada is going to open up the border and let a whole bunch of Central Americans into the United States. So Canada is a pretty safe target,” Laura Dawson, director of the Canada Institute at the Woodrow Wilson Center, told Politico.

James Comey Wasn’t a Partisan Hack. He Was Worse.

By coincidence, right after my Comey post yesterday morning the New York Times published a long tick-tock about how and why Comey did what he did. It doesn’t address the question of whether Comey tipped the election, it just provides an insider account of what was going through Comey’s head as he made decisions during campaign season.

It makes for depressing reading. The reporters conclude pretty strongly that Comey wasn’t motivated by any conscious partisan motives. But even if that’s true, there were pretty clearly partisan and personal influences at work. Apologies in advance for the length of this post, but putting all six of the following excerpts together in a single narrative is the only way to show what really happened. The story begins two years ago when the FBI opened its probe into Hillary Clinton’s emails:

On July 10, 2015, the F.B.I. opened a criminal investigation, code-named “Midyear,” into Mrs. Clinton’s handling of classified information….Everyone agreed that Mr. Comey should not reveal details about the Clinton investigation. But attorney general Loretta Lynch told him to be even more circumspect: Do not even call it an investigation, she said, according to three people who attended the meeting. Call it a “matter.”

….It was a by-the-book decision. But Mr. Comey and other F.B.I. officials regarded it as disingenuous in an investigation that was so widely known. And Mr. Comey was concerned that a Democratic attorney general was asking him to be misleading and line up his talking points with Mrs. Clinton’s campaign, according to people who spoke with him afterward.

This seems to have been the starting point. Even when Justice Department officials were making straightforward, “by-the-book” decisions, Comey was paranoid that they were acting to protect a Democrat—something that obviously might invite Republican attack if he went along. This belief continued to grow, and led to much of what happened later, when the investigation was wrapping up:

Early last year, F.B.I. agents received a batch of hacked documents, and one caught their attention. The document, which has been described as both a memo and an email, was written by a Democratic operative who expressed confidence that Ms. Lynch would keep the Clinton investigation from going too far, according to several former officials familiar with the document.

Read one way, it was standard Washington political chatter. Read another way, it suggested that a political operative might have insight into Ms. Lynch’s thinking.

Normally, when the F.B.I. recommends closing a case, the Justice Department agrees and nobody says anything….The document complicated that calculation, according to officials. If Ms. Lynch announced that the case was closed, and Russia leaked the document, Mr. Comey believed it would raise doubts about the independence of the investigation.

This email wasn’t related to Lynch or her office in any way. It was just gossip from a third party. But instead of ignoring it, Comey worried that it might leak and hurt his own reputation. This also motivated his decision, when the investigation was over, to hold an unusual press conference which damaged Clinton seriously even though he cleared her of wrongdoing:

Standing in front of two American flags and two royal-blue F.B.I. flags, he read from a script….“Any reasonable person in Secretary Clinton’s position” should have known better, Mr. Comey said. He called her “extremely careless.” The criticism was so blistering that it sounded as if he were recommending criminal charges. Only in the final two minutes did Mr. Comey say that “no charges are appropriate in this case.”

….By scolding Mrs. Clinton, Mr. Comey was speaking not only to voters but to his own agents. While they agreed that Mrs. Clinton should not face charges, many viewed her conduct as inexcusable. Mr. Comey’s remarks made clear that the F.B.I. did not approve.

Former agents and others close to Mr. Comey acknowledge that his reproach was also intended to insulate the F.B.I. from Republican criticism that it was too lenient toward a Democrat.

Again, Comey had failed to play it straight. Even though the decision to exonerate Clinton “was not even a close call,” as he later said, he tore into Clinton in order to protect himself from criticism—both from Republicans and from his own agents. This is especially damning given the subsequent evidence that Comey’s criticism of Clinton was wildly overstated. The same dynamic played out in reverse a couple of months later over the FBI investigation into Donald Trump and Russian interference in the election:

Mr. Comey and other senior administration officials met twice in the White House Situation Room in early October to again discuss a public statement about Russian meddling….At their second meeting, Mr. Comey argued that it would look too political for the F.B.I. to comment so close to the election, according to several people in attendance. Officials in the room felt whiplashed. Two months earlier, Mr. Comey had been willing to put his name on a newspaper article; now he was refusing to sign on to an official assessment of the intelligence community.

And it played out yet again in September, when agents discovered some Clinton emails on Anthony Weiner’s laptop. Michael Steinbach, a former FBI agent who worked closely with Comey, explained what went through Comey’s mind:

Agents felt they had two options: Tell Congress about the search, which everyone acknowledged would create a political furor, or keep it quiet, which followed policy and tradition but carried its own risk, especially if the F.B.I. found new evidence in the emails.

….Conservative news outlets had already branded Mr. Comey a Clinton toady. That same week, the cover of National Review featured a story on “James Comey’s Dereliction,” and a cartoon of a hapless Mr. Comey shrugging as Mrs. Clinton smashed her laptop with a sledgehammer.

Congressional Republicans were preparing for years of hearings during a Clinton presidency. If Mr. Comey became the subject of those hearings, F.B.I. officials feared, it would hobble the agency and harm its reputation. “I don’t think the organization would have survived that,” Mr. Steinbach said.

Once again, the primary concern was protecting Comey and the FBI. Republicans had made it clear that their retribution against anyone who helped Clinton would be relentless, and that clearly had an impact on Comey. Steinbach’s suggestion that Republican vengeance would have destroyed the FBI is clearly nuts, but Comey was taking no chances. He didn’t want the grief.

Even after it was all over, Comey’s partisan influences continued to work on him:

Officials and others close to him also acknowledge that Mr. Comey has been changed by the tumultuous year.

Early on Saturday, March 4, the president accused Mr. Obama on Twitter of illegally wiretapping Trump Tower in Manhattan. Mr. Comey believed the government should forcefully denounce that claim. But this time he took a different approach. He asked the Justice Department to correct the record. When officials there refused, Mr. Comey followed orders and said nothing publicly.

Daniel Richman, a longtime friend of Comey’s, said this represented “a consistent pattern of someone trying to act with independence and integrity, but within established channels.”

The evidence does indeed show consistent behavior, but of a different kind. At every step of the way, Comey demonstrated either his fear of crossing Republicans or his concern over protecting his own reputation from Republican attack. It was the perfect intersection of a Republican Party that had developed a reputation for conducting relentlessly vicious smear campaigns and a Republican FBI director who didn’t have the fortitude to stand up to it. Comey may genuinely believe that his decisions along the way were nonpartisan, but the evidence pretty strongly suggests otherwise.
