Government doesn’t know exact route of Keystone XL

You might think that one would need to know the precise route of a huge planned pipeline in order to assess its environmental impacts. But the State Department apparently disagrees.

Thomas Bachand has been trying to find out the precise route of Keystone XL for his Keystone Mapping Project. When he submitted a Freedom of Information Act request to the State Department, which is responsible for assessing Keystone, it responded with a big shrug of the shoulders. From the department’s June 24 letter to Bachand:

[T]he Department does not have copies of records responsive to your request because the Environmental Impact Statement for the Keystone pipeline project was created by Cardno ENTRIX under a contract financed by TransCanada Keystone Pipeline LP, and not the U.S. government.

Neither Cardno ENTRIX nor TransCanada ever submitted GIS information to the Department of State, nor was either corporation required to do so. The information that you request, if it exists, is therefore neither physically nor constructively under the control of the Department of State and we are therefore unable to comply with your FOIA request.

DeSmogBlog lists some of the important questions left unanswered because we lack the specific route info:

Where will KXL intersect rivers or cross ponds that provide drinking water? What prized hunting grounds and fishing holes might be ruined by a spill? How can communities prepare for possible incidents?

This isn’t the first time Bachand has been blocked in his efforts to map the proposed pipeline. From his blog:

Last year when I requested the data from TransCanada, I was told that releasing it would be a “national security risk.” Despite this, TransCanada only carries $200 million in third party liability insurance. By contrast, cleanup costs for the 2010 pipeline spill in Kalamazoo, Michigan are $1 billion and climbing.

How very thoughtful of TransCanada to be concerned about risks.

The good news: Heavy rainfall across the Midwest has helped ease a widespread drought.

The bad news: Rainfall has been so heavy that drought has been replaced by flooding

The scary news: The cycle of flood-drought-flood that has ravaged the Midwest over the past two years is the type of cycle that climate change is expected to bring to the region, and it could become the new normal.

From NBC News:

Heavy river flooding in six Midwestern states that forced evacuations, shut down bridges, swamped homes and caused at least three deaths was at or near crest in some areas Sunday evening.

Rivers surged from the Quad Cities to St. Louis Sunday, with water levels reaching record heights. Hours earlier, National Guardsmen, volunteers, homeowners and jail inmates pitched in with sandbagging to hold back floodwaters that closed roads in Missouri, Illinois, Iowa, Indiana, Wisconsin and Michigan.

From the AP:

Rain last week started the whole mess, causing the Mississippi and many other rivers to surge in Missouri, Illinois, Iowa, Wisconsin, Michigan and Indiana. Flooding has now been blamed in three deaths — two at the same spot in Indiana and one in Missouri. In all three cases, vehicles were swept off the road in flash floods.

Spots south of St. Louis aren’t expected to crest until late this week, and significant flooding is possible in places like Ste. Genevieve, Mo., Cape Girardeau, Mo., and Cairo, Ill.

Adding to concern is the forecast. National Weather Service meteorologist Julie Phillipson said an inch of rain is likely in many places Monday night into Tuesday, some places could receive more than that.

“That’s not what we want to see when we have this kind of flooding, that’s for sure,” Phillipson said.

The flooding of the Mississippi River is quite the contrast to the situation just a few months back, when low water levels were threatening the barge industry. But it resembles the flood of spring in 2011. From Weather Underground:

Residents along the Mississippi River have experienced a severe case of flood-drought-flood weather whiplash over the past two years. The Mississippi reached its highest level on record at New Madrid, Missouri on May 6, 2011, when the river crested at 48.35′. Flooding on the Mississippi and Missouri rivers that year cost an estimated $5 billion. The next year, after the great drought of 2012, the river had fallen by over 53′ to an all time record low of -5.32′ on August 30, 2012. Damage from the great drought is conservatively estimated at $35 billion. Next Tuesday, the river is expected to be at flood stage again in New Madrid, 40′ higher than the August 2012 record low. Now, that is some serious weather whiplash. …

The new normal in the coming decades is going to be more and more extreme flood-drought-flood cycles like we are seeing now in the Midwest, and this sort of weather whiplash is going to be an increasingly severe pain in the neck for society. We’d better prepare for it, by building a more flood-resistant infrastructure and developing more drought-resistant grains, for example. And if we continue to allow heat-trapping gases like carbon dioxide continue to build up in the atmosphere at the current near-record pace, no amount of adaptation can prevent increasingly more violent cases of weather whiplash from being a serious threat to the global economy and the well-being of billions of people.

Wisconsin left way, way behind in wind energy boom

The state of Wisconsin is seriously lagging in the wind power boom that’s sweeping much of the rest of the nation — and it’s not because it lacks for wind.

From Midwest Energy News:

In 2012, a year that saw a nationwide surge in wind farm installations as developers rushed to beat expiring tax credits, Wisconsin added only 18 megawatts of capacity.

By comparison, Michigan and Ohio, with much lower wind potential, had already installed 138 MW and 308 MW in just the first three quarters.

Compared to other Midwestern states, Wisconsin ranks at the bottom in both wind projects under construction and in queue, according to the American Wind Energy Association.

Challenges to wind energy have come from nearly every level of government.

Gov. Scott Walker (R) has pushed legislation that would hamper wind developments, and some state lawmakers and local officials have also tried to throw roadblocks in front of the wind industry.

The town of Sherman, Wis., for example, is kicking up a fuss over a wind developer’s application to build four wind turbines, enough to power 4,000 homes. Town officials have asked the state to impose a moratorium on pending wind farm applications.

From the Sheboygan Press:

[U]nder state law, town leaders were given 45 days … to review the developer’s application to ensure it’s complete. Once the application is deemed complete, they’ll have another 90 days to hold a public hearing and then vote to approve or reject it.

But Sherman Town Chairman William Goehring said town officials feel that the state-imposed time line should be put on hold given unresolved questions about potential health risks with wind farms and a lack of clarity under state law on how wind farms can meet noise standards.

Never mind that there’s no scientific evidence that wind turbines make people sick (though they do make some people annoyed).

When will the Badger State pull its head out of the snow and join the rest of the nation in the wind- and solar-powered energy and jobs boom?

Last coal-fired car ferry to keep dumping waste in Lake Michigan

It’s bad enough that the S.S. Badger is still powered by coal — the only car ferry left in the country that runs on the dirtiest of fossil fuels. But what’s really going to blow your mind is how the ferry disposes of its coal ash after burning: It is mixed with water into a slurry and dumped overboard. More than 500 tons of it every year. Straight into Lake Michigan. Just like its operators have been doing since the 1950s.

In 2008, the U.S. EPA told Lake Michigan Carferry, the company that operates the Badger, to cut that crap out. The company must switch to another fuel or start dumping the waste somewhere on land, the EPA said. The ferry company responded by asking for more time to study how it would switch over to natural gas, and the EPA was all, OK, but just four more years, and that’s it.

That four-year grace period expired over the winter, and guess what Lake Michigan Carferry plans to do once the ferrying season begins next month? That’s right, it plans to continue dumping its coal ash into Lake Michigan. And the federal government is pretty much OK with that.

From the AP:

The company had applied for a permit to continue dumping the ash while researching how to retrofit the ship to operate on liquefied natural gas. Under a proposed consent decree [between the EPA and Lake Michigan Carferry] filed in U.S. District Court in Grand Rapids, the company would scrap that option in favor of onboard storage.

Disposal into the lake would be reduced over the next two years and stop altogether by the end of the 2014 sailing season.

After a 30-day public comment period, a judge will decide whether to approve the deal, which also would require the company to pay a $25,000 civil penalty for exceeding mercury pollution standards last year. Coal ash contains low concentrations of arsenic, mercury and other heavy metals, although it’s not classified as hazardous. The company denied violating federal or state mercury regulations.

“This consent decree offers the fastest and most certain path available to EPA to stop the discharge of coal ash from the Badger into Lake Michigan,” said Susan Hedman, EPA regional administrator.

The feds would like to know how you feel about this deal. From the Ludington [Mich.] Daily News:

“Now it’s important that our community step forward and start submitting its comments on this agreement between the EPA and carferry owners,” Ludington Mayor John Henderson told the Ludington Daily News recently. “I hope everybody sees there is true progress being made that totally eliminates that discharge into Lake Michigan and make it a more environmentally friendly operation.”

Here’s a comment for Lake Michigan Carferry: Join us in the 21st century! It isn’t so bad here. We’ve got cleaner air and cleaner water now, because other people started cleaning up their acts last century.

A refinery in Superior, Wis., wants to cut in on the rail industry’s sweet deal: shipments of oil from North Dakota. The company doesn’t own trains. But it does sit at the tip of Lake Superior.

Petroleum refiner Calumet Specialty Products Partners is exploring whether to build a crude oil loading dock on Lake Superior, near its Superior, Wis., refinery, to ship crude oil on the Great Lakes and through connecting waterways, the company said Friday. …

Pipelines are the cheapest way to move petroleum products, [analyst Ethan] Bellamy said, but their delivery points are fixed. Railcars, barges and ships can move to different delivery points. That allows crude to go to the highest bidder.

And what could go wrong?

Josh Mogerman of the Natural Resources Defense Council noted that a pipeline spill two summers ago of Canadian tar sands oil fouled Michigan’s Kalamazoo River, a Lake Michigan tributary.

“That should give anyone who cares about the Great Lakes pause,” he said.

Well, yeah. But that was a pipeline. When is the last time a boat carrying oil leaked into a waterway? I mean, besides yesterday.

From Reuters:

Two oil barges pushed by a tugboat slammed into a railroad bridge in Vicksburg, Mississippi, on Sunday, causing one to leak crude oil into the Mississippi River, the U.S. Coast Guard said.

Officials used an “absorbent boom” to contain the undetermined amount of oil that leaked into the river after the collision, which occurred shortly after midnight and damaged both barges, Lieutenant Ryan Gomez said. The barge that is leaking was holding 80,000 gallons of light crude oil, he said.

The Associated Press has more details:

Tugs were holding the barge near shore on the Louisiana side of the river, south of the bridge it hit and directly across from Vicksburg’s Riverwalk Casino.

Orange containment boom was stretched across part of the river downstream from the barge, and a small boat appeared to patrol the area. …

The oily sheen was reported up to three miles downriver from the bridge at Vicksburg on Sunday. Gomez said crews have laid down a boom and also a secondary boom. They also were using a rotating skimmer device to sweep up oily water in the river.

This is a minor spill on a relatively narrow body of water. A big spill on Lake Superior — which could, in its worst case, then flow through each of the other Great Lakes and over Niagara Falls — is a daunting prospect. (We looked at the prospect of such a spill last year.)

Spills are written into business plans like Calumet’s, maybe the second or third paragraph on the 19th page. They’re worst-case scenarios for which theoretical accommodations are made. Until, as happened yesterday, the spills cease to be theoretical.

Big 50-year plan could make Detroit greener and healthier

Detroit’s city leaders, backed by deep-pocketed foundations, have laid out a new plan for remaking Motor City into a thriving and sustainable metropolis. From Detroit Free Press columnist Brian Dickerson:

[P]rops to Mayor Dave Bing and the Detroit Works project he has championed for telling Detroiters the truth about their limited options for redeeming Michigan’s largest city — and reminding them how quickly those options will narrow if Detroit’s elected leaders fail to seize the moment.

The Detroit Future City report unveiled Wednesday is best understood as a municipal triage plan. Squarely confronting the chasm between residents’ expectations and the city’s capacity to meet them, the report’s authors have done their best to apportion the city’s dwindling resources across a sprawling landscape of deprivation. …

Nobody will be forced to move … But if implemented, the Future City plan would codify the tale-of-two-cities scenario that already exists, formalizing the boundary between neighborhoods that retain critical mass and the more sparsely populated hinterlands where the amenities associated with urban living are generally unavailable.

The new Detroit Works Project 50-year plan for the city is sprawling and ambitious, but unlike a lot of huge strategic plans, it actually doesn’t seem completely insane. Put together after hundreds of meetings, thousands of surveys, and tens of thousands of snippets of community input, the 350-page “Detroit Future City” report is full of big, green ideas.

The plan’s recommendations for a future Detroit include building “blue and green infrastructure” to help address water and air-quality issues, creating new open space networks, including local wildlife habitat, and diversifying the city’s public transportation modes. The W.K. Kellogg, Kresge, and Ford Foundations have pledged millions to help the plan become reality.

“This is the most comprehensive framework ever established for an American city,” said Toni Griffin, director of the Technical Planning Team at the Detroit Works Project.

The report calls for adding new, large areas of greenspace, but it’s also emphatic about the need to reuse old buildings (whereas other shrinking cities have taken the approach of knocking them down en masse). From the report:

Vacant land and buildings are among Detroit’s most valuable assets for its future … Turning vacant land from burdens to assets will take more than changes in specific policies and practices. ALL PUBLIC AGENCIES—WHETHER CITY, COUNTY, OR STATE—WILL NEED TO CHANGE HOW THEY THINK ABOUT LAND, AND MAKE EQUALLY FUNDAMENTAL CHANGES TO THE WAY THEY ACQUIRE, MANAGE, AND DISPOSE OF LAND AND BUILDINGS, AND THE WAY OTHER PUBLIC AGENCIES REGULATE THEM. Without such a change in thinking and practice, the inventory of vacant land and buildings in its current condition will not only fail to become an asset, it will continue to act as a roadblock to the implementation of creative strategies for land use, environmental restoration, economic growth and neighborhood revitalization.

Yeah, I’ll get behind any strategic plan for reuse and sustainability that yells at backward-thinking public agencies in bold, all-caps.

Bringing back chestnut trees could fight climate change and give us tasty treats

When Nat King Cole first recorded “The Christmas Song (Chestnuts Roasting on an Open Fire)” in 1946, American giant chestnut trees had been nearly wiped out by a foreign fungus. Billions of native trees were felled by the disease. If you want to roast those sweet babies over an open fire this holiday season, they’ll likely be of the imported-from-China variety.

A hundred years ago, it was a very different scene, NPR reports:

The American chestnut was king of the forest. One of every four hardwoods in the eastern woodlands was a chestnut. They grew so tall — up to 100 feet — they were called the redwoods of the east.

By the mid-20th century they were “pretty much obliterated,” and now the only seasonal street-food treats are those crusty sugared peanuts. An American tragedy.

Efforts to revitalize the country’s chestnut stock have been ongoing for decades, but they’re not just aimed at holiday treats (because researchers have other crazy priorities).

Why is it so important to bring back the chestnut tree? Advocates say the trees were critical to the economy of rural communities and the ecology of the forests. Some even say chestnuts can help with global warming.

“Some” being scientists, like the ones who penned a 2009 Purdue University study on new hybrid chestnut trees and their carbon-fighting superpowers.

“Maintaining or increasing forest cover has been identified as an important way to slow climate change,” said [associate professor of forestry Douglass] Jacobs, whose paper was published in the June issue of the journal Forest Ecology and Management. “The American chestnut is an incredibly fast-growing tree. Generally the faster a tree grows, the more carbon it is able to sequester. And when these trees are harvested and processed, the carbon can be stored in the hardwood products for decades, maybe longer.”

Over the last several years, we’ve been importing more foreign chestnuts, but we’re also growing more of them at home. American growers have been planting and cultivating a variety of chestnut trees, from European-Japanese hybrids to blight-resistant Chinese varieties. They’re creating new stock and marketing it with new products aimed at the health-conscious. From NPR’s The Salt blog:

Many growers hand harvest to serve a niche, regional market, but they hope to modernize with grabbing tools called nut wizards and vacuum and all-in-one self-propelling harvesting systems. On the processing side, anti-microbial treatments help improve chestnut’s short shelf life. “It’s like an apple, if you leave them on a table they’ll go crummy,” says Dan Guyer, an engineer at [Michigan State University] who’s experimenting with X-ray chestnut sorting technology.

And then there are new marketing strategies. Chestnut flour is aimed at the gluten free crowd, but there’s also chestnut honey and beer. MSU helped develop peeled-frozen chestnut packs, hoping to appeal to the shopper on the go.

In Missouri, [University of Missouri forestry professor Michael] Gold likens it to selling a novel exotic fruit in U.S. markets for the first time: “We see our role as the catalyst in developing what we call the ‘new’ chestnut, as a new crop for American palates.”

Who needs an open fire when you can warm up with chestnut brew?

As of last year, Texas has a law that requires fracking companies to reveal the chemicals used in their fracking fluids. Unless that fracking fluid is considered a “trade secret” by the fracking company, which, surprise surprise, companies have claimed 19,000 times in the first eight months of this year.

From Bloomberg:

A subsidiary of Nabors Industries Ltd. (NBR) pumped a mixture of chemicals identified only as “EXP- F0173-11” into a half-dozen oil wells in rural Karnes County, Texas, in July.

Few people outside Nabors, the largest onshore drilling contractor by revenue, know exactly what’s in that blend. This much is clear: One ingredient, an unidentified solvent, can cause damage to the kidney and liver, according to safety information about the product that Michigan state regulators have on file.

A year-old Texas law that requires drillers to disclose chemicals they pump underground during hydraulic fracturing, or “fracking,” was powerless to compel transparency for EXP- F0173-11. The solvent and several other ingredients in the product are considered a trade secret by Superior Well Services, the Nabors subsidiary.

While the ability of fracking companies to hide their ingredients is not a new problem, the Texas law demonstrates its extent. The specific makeup of fracking fluid is one of the innovations that led to the current shale gas boom; it’s justifiable — in the respect that fracking can be justified — to claim that the combination of chemicals is proprietary information. The question that arises is how to balance that secrecy with public health. (A possible solution: Ban all fracking everywhere! This solution is unlikely to be adopted.)

For neighbors of fracked wells, the omissions mean they can’t use the disclosures to watch for frack fluids migrating into creeks, rivers and aquifers, because they don’t know what to look for, says Adam Briggle, who is chairman of a citizen’s group in Denton, Texas, called the Denton Stakeholder Drilling Advisory Group. …

The 19,000 trade-secret claims made in Texas this year through August hid information that included descriptions of ingredients as well as identification numbers and concentrations of the chemicals used. Overall, oil and gas companies withheld information on about one out of every seven ingredients they pumped into 3,639 wells.

And you will not be surprised to learn who thinks the legislation is just perfect as is.

Recently, more states are following the Texas model — with an assist from industry. In December 2011, the American Legislative Exchange Council (ALEC), a Washington-based public policy organization that brings together corporations and legislators to craft bills for states, adopted model legislation that is almost identical to the Texas rule.

The model bill was sponsored inside ALEC by Exxon Mobil Corp. (XOM), which also advises the council from a seat on its “private enterprise board,” according to ALEC documents obtained by Common Cause, a nonprofit group in Washington.

ALEC has long-standing ties to the fossil fuel industry, so this shouldn’t be a surprise. Nor should Exxon’s interest in protecting fracking; the company has made a big bet on natural gas.

Internationally, The Wall Street Journal reports, fracking isn’t catching on, due to a combination of shale locations and availability of technology. Exxon itself killed a project in Poland after deciding that drilling wasn’t worth it. That is good news for the rest of the world — but bad news for the United States, which becomes both a laboratory experiment and a deeply profitable business venture.

After all, there’s a massive windfall trapped in that shale. And it’s far cheaper to seek forgiveness via an eventual class-action suit than it is to seek permission by providing full information.
