Corporations Want to Follow Your Every Move, Whether You Like It Or Not

Last year the Commerce Department put together a group to make recommendations for regulating facial recognition technology. The group included nine privacy advocates, but Dan Froomkin reports that it didn’t go well:

At a base minimum, people should be able to walk down a public street without fear that companies they’ve never heard of are tracking their every movement — and identifying them by name — using facial recognition technology,” the privacy advocates wrote in a joint statement. “Unfortunately, we have been unable to obtain agreement even with that basic, specific premise.”

….After a dozen meetings, the most recent of which was last week, all nine privacy advocates who have participated in the entire process concluded that they were totally outgunned. “This should be a wake-up call to Americans: Industry lobbyists are choking off Washington’s ability to protect consumer privacy,” Alvaro Bedoya, executive director of the Center on Privacy & Technology at Georgetown Law, said in a statement.

People simply do not expect companies they’ve never heard of to secretly track them using this powerful technology. Despite all of this, industry associations have pushed for a world where companies can use facial recognition on you whenever they want — no matter what you say. This position is well outside the mainstream.”

I had no idea that anyone was even considering the regulation of facial recognition software, so this is news to me. It’s yet another indication that in the future we will have virtually no privacy left at all. Either that or we’ll all start walking around in tinfoil-shielded space suits whenever we leave our tinfoil-wallpapered houses.

Are Fitbit, Nike, and Garmin Planning to Sell Your Personal Fitness Data?

Lately, fitness-minded Americans have started wearing sporty wrist-band devices that track tons of data: Weight, mile splits, steps taken per day, sleep quality, sexual activity, calories burned—sometimes, even GPS location. People use this data to keep track of their health, and are able send the information to various websites and apps. But this sensitive, personal data could end up in the hands of corporations looking to target these users with advertising, get credit ratings, or determine insurance rates. In other words, that device could start spying on you—and the Federal Trade Commission is worried.

“Health data from a woman’s connected device, may be collected and then sold to data brokers and other companies she does not know exist,” Jessica Rich, director of the Bureau for Consumer Protection at the Federal Trade Commission, said in a speech on Tuesday for Data Privacy Day. “These companies could use her information to market other products and services to her; make decisions about her eligibility for credit, employment, or insurance; and share with yet other companies. And many of these companies may not maintain reasonable safeguards to protect the data they maintain about her.”

Several major US-based fitness device companies contacted by Mother Jones—Fitbit, Garmin, and Nike—say they don’t sell personally identifiable information collected from fitness devices. But privacy advocates warn that the policies of these firms could allow them to sell data, if they ever choose to do so.

NSA’s Harshest Critics Meeting With White House Officials Tomorrow

On Thursday, a number of civil liberties groups that have harshly criticized the NSA surveillance practices disclosed by Edward Snowden, are meeting with President Obama’s top lawyer, Kathy Ruemmler. This White House session is one of several this week with lawmakers, tech groups, and members of the intelligence community that will help the President soon decide whether to keep the controversial surveillance programs intact.

Among groups that are reportedly attending the meeting are the Center for Democracy and Technology, the Electronic Privacy Information Center (EPIC), and the Federation of American Scientists. According to Caitlin Hayden, a spokesperson for the White House, the purpose of the meeting with Ruemmler “is to have a broad discussion regarding privacy and civil liberties protections and transparency initiatives.” According to a source with knowledge of the meeting, the meeting is likely the “next phase” of the Obama Administration’s attempt to decide “exactly how much of the Surveillance Review Group’s fairly radical recommendations they’re going to get behind.”

In December, this independent panel took a hard look at NSA snooping and issued 46 recommendations for reform, such as having phone carriers store domestic telephone records, rather than the NSA. Marc Rotenberg, the executive director of EPIC, tells Mother Jones that, “We support many of the recommendations contained in the report of the Review Group, particularly the proposal to end the NSA’s bulk collection of telephone records….But we think the President needs to do more.” He adds, “Privacy protection is not simply about NSA reform. We also need strong consumer safeguards.”

On Wednesday, President Obama is meeting with “leaders of the Intelligence community” and members of the Privacy and Civil Liberties Oversight Board, an independent agency that advises the President, according to Hayden. He will also meet with members of the House and Senate on Thursday to discuss surveillance issues. The Associated Press reports that he is expected to issue a final decision on NSA surveillance programs as early as next week.
