Inside the bill that set the ‘strongest clean energy requirement in the nation’

Washington, D.C., is positioning itself on the climate policy fast track. The District of Columbia city council voted unanimously last week to approve an expansive climate bill requiring utility providers to generate 100 percent of their energy supply from renewable sources by 2032. If D.C. Mayor Muriel Bowser signs the legislation as expected, the provisions will put the nation’s capital on a faster, formally pledged timeline toward cutting utility emissions than any U.S. state. (Hawaii and California have both pledged state-wide goals of 100 percent renewable energy for electricity by 2045.)

While several smaller cities have already reached similar 100-percent renewable energy targets, Washington, D.C., is by far the largest city to make such a commitment. And that’s not all that’s in the bill. Together, the provisions were dubbed the “strongest clean energy requirement in the nation,” by Mark Rodeffer, D.C. Sierra Club chapter chair.

So what’s in D.C.’s bill? And what can the rest of us learn from it, at a time when cities and states are racing to fill the gap left by federal regulators to slow climate change?

What the bill regulates: Electricity and some transportation

D.C.’s new bill is intended to dramatically decrease emissions from one of the most common sources, electricity, by ratcheting up the requirements on utility providers. D.C.’s current law already mandates that utility providers derive 50 percent of their energy supply from renewable sources by 2032, with 5 percent carved out for solar. The new bill doubles these figures to 100 percent renewables by 2032 with 10 percent solar by 2041.

Buildings account for 74 percent of D.C.’s carbon emissions. And the bill also establishes a separate program to set benchmarks for energy efficiency for the largest buildings in the city, those with more than 10,000 square feet of gross floor area. The specific standards, however, have not yet been set. According to Cliff Majersik, the Institute for Market Transformation executive director who worked on the bill, D.C. will become the first U.S. jurisdiction “to require a broad swath of existing buildings to improve their whole-building energy performance.”

The bill also tackles another major contributor of emissions: transportation. While the bill won’t do anything to regulate residents’ private transportation choices, it will regulate the city’s own contributions: By 2045, all public transportation and privately owned vehicle fleets in D.C. will have to produce zero emissions.

How would the bill be implemented?

The burden falls on utility companies to meet benchmarks for renewable electricity — or pay a price. Every year, the city sets renewable energy standards for companies to hit that increase incrementally until they reach 100 percent in 2032. What happens if companies don’t meet those standards? The city requires electricity suppliers to to make compliance payments into D.C.’s Renewable Energy Development Fund.

There are other guaranteed revenue sources to fund other parts of the bill. Utility companies serving D.C. are already required to collect fees from customers who use natural gas and electricity. These fees are put toward a fund for D.C.’s energy efficiency efforts. But this bill temporarily raises those per-unit rates and creates a new fee on home heating and fuel oil to raise even more money for energy efficiency. (D.C. residents who make under a certain income, with the amount dependent on household size, will still be eligible for utilities discounts.)

Helping low-income residents transition to clean energy

Some of the revenue from increased fees will be used to help low-income communities adapt.

“Communities that have done the least to cause climate change [are] disproportionately bearing the burden of climate change,” Judith Howell, a member of the labor union 32BJ SEIU, said in a statement. “Working people in the U.S. and around the world will be extremely vulnerable to those changes.”

Thirty percent of the additional revenue will be put aside for programs like weatherization and bill assistance for low-income households, as well as job training in energy efficiency fields. At least $3 million annually will also be allocated toward energy efficiency upgrades in affordable housing buildings.

The criticism that watered down one requirement for utilities

In November, local energy company Pepco ran some misleading ads on Facebook urging D.C. residents to “act now” and “act boldly” to achieve a “sustainable vision.” When users clicked through to a petition, what it was asking was that its customers oppose a provision of the bill requiring Pepco to use long-term contracts for renewable energy.

WAMU’s Jacob Fenston wrote in November:

“Pepco wants residents to sound off on one small piece of the legislation: a requirement that Pepco purchase renewable energy under long-term contracts. According to the DOEE analysis, this provision would reduce greenhouse gas emissions by 8 percent by 2032.”

Majersik told CityLab that the long-term contract provision Pepco opposed was stripped from the bill, but may be proposed as part of a new bill in 2019. Ultimately, Pepco supported the revised bill and released a statement calling the legislation an “important step toward advancing the cause of clean energy.”

Among the primary supporters of the bill was the D.C. Climate Coalition, which included over 110 advocacy organizations, faith groups, unions, consumer advocate organizations, and D.C. businesses.

Camila Thorndike, D.C. campaign director at the CCAN Action Fund said in a press release: “With the passage of this bill, we’re taking the power back from President Trump and taking control of our energy future.”

Ever wonder what happens to people when they get booted from President Trump’s graces? (They don’t all wind up with a Saturday Night Live trip down memory lane.)

It’s been almost six months since Scott Pruitt was cut loose as head of the EPA, and for the most part he’s been keeping out of the spotlight. According to sources, Pruitt is using his industry connections to launch a private consulting business — you know, promoting coal exports and consorting with coal barons, the way a former administrator of the Environmental Protection Agency would.

However, Pruitt’s lawyer, Cleta Mitchell, says these new career pursuits will stop short of violating an official five-year ban on lobbying the EPA. After a mess of ethics violations and legal scandals, Pruitt is proceeding with caution. Mitchell says: “He has discussed multiple opportunities with me and has been quite careful not to do anything that is even close to the line.”

Although Pruitt’s fall from grace hasn’t been memorialized on SNL, he did become the butt of a few jokes by someone else — his former bestie, Donald Trump.

Evidently, Trump has congratulated Andrew Wheeler, Pruitt’s replacement, several times for not trying to buy used mattress from Trump Hotel. Yep. Pruitt did that. But hey, there’s nothing wrong with a little reuse, reduce, recycle — it may turn out to be one of Pruitt’s better moves for the environment.

Clyde Tombaugh spent much of his life peering at telescope data. He discovered Pluto in 1930, and he spent years poking around the outer solar system. But as the scientific community began to dream about launching a vehicle into the great beyond, he focused his gaze much closer to home.

At the time, the smaller stuff in our immediate space environment remained largely a mystery. People like Tombaugh worried whether orbiting gunk would make spaceflight that much harder. If they ever built a spaceship, would space litter pummel it irreparably?

As part of a 1950s Army project, Tombaugh tried to find out. But before he finished, the Soviets sent the world’s first object to orbit. When Sputnik first spun around Earth, in 1957, Tombaugh’s equipment caught it: a shiny sphere, just about two feet across. The fact that he could spot it meant that if dangerous debris had been orbiting, he likely would have found it, too. And he hadn’t. When he published his final report in 1959, Tombaugh concluded that rockets faced little risk of colliding with natural objects.

Humans have since sent thousands of rockets to space. In their cargo holds, they have stored satellites that help humans communicate, wage war, watch TV, and grok planetary processes. Sometimes, as Sputnik did not long after launch, these objects finish their useful lives, slip back into the surly bonds of Earth, and burn up in the atmosphere. There’s the glove that a Gemini astronaut let slip from the first spacewalk, and a spatula from a shuttle mission. Once, a tool bag escaped an ISS astronaut and floated around for eight months. Other times, however, junk remains in orbit long after it’s useful. A Chinese missile, for instance, smashed a Chinese satellite into thousands of pieces, some of which continue to circle and circle.

These pieces of trash could pose a version of the threat that Tombaugh had worried about: that they’ll get in the way of humans’ desire to send stuff to (and keep it in) space. Earth’s front porch is now littered with around 24,000 pieces of debris bigger than a large orange, and millions and millions of bits smaller than that. Meanwhile, the number of new satellites humans want to launch is on the rise. According to consulting company Euroconsult, around 7,000 smallsats may hop to orbit in the next decade. Elon Musk, though famous for missed deadlines, plans to launch the initial satellites in his space-internet megaconstellation in 2019, as does internet provider OneWeb.

Satellites in low Earth orbit are supposed to spiral back down, burning up in Earth’s atmosphere 25 years after they complete their missions. The process can happen naturally as their orbits decay over time. Alternately, these craft can point thrusters into space and willfully plunge into the atmosphere. But sometimes more aggressive measures are needed to clean up the junk circling overhead. Making sure satellites obey the 25-year guideline, and watching them closely in the meantime, has spawned a whole sector of creative solutions. Here are some of the latest experiments in de-junking space:

Grim Reapers

The satellite industry calls it “active debris removal,” but think of it as a space robot that’s out to kill. In June, scientists at Surrey Space Center and their partners dispatched a mission called RemoveDEBRIS from the International Space Station. Soon after, it deployed a net and captured a small CubeSat that the team had previously released. The net wrapped around the satellite, cocooning it and ending its life. RemoveDEBRIS will also test a harpoon on a dead satellite, and use a sail to then drag itself back down.

A company called Astroscale is pursuing a similar approach. “The best way to avoid a bunch of small pieces of debris that could harm large satellites is to remove large satellites that become small pieces of debris,” says Chris Blackerby, the company’s COO. Astroscale’s first mission, called ELSA-d, a cheery acronym that hides the ominous “End-of-Life Service” hidden within it, aims to show that a reaper-style space robot can find lost debris, match a dead satellite’s tumble, and dock.

Pushers

Traditionally, satellites have thrusters that push them to the orbits they need, keep them there, and then (assuming the gas gauge doesn’t read “empty”) send them shooting down to Earth when the time comes. But conventional chemical engines are way too heavy for small satellites, so lots of the little guys don’t really have propulsion systems — which can pose a space-junk problem if their orbits don’t wind down quickly. They need thrusters that are appropriately sized for smallsats.

“The use of propulsion is the beginning, middle, and end of a mission,” says Beau Jarvis, an exec at a propulsion company called PhaseFour. The PhaseFour system, which you will be able to plunk on your satellite, uses radio waves to turn gas into plasma, which shoots from the spacecraft, pushing it in the opposite direction.

Many similar gas pedals require expensive cathodes and anodes, but ones that don’t are easier to make en masse. Another engine-maker, Accion, also dispenses with the expensive parts: Its engines use a liquid salt that shoots from the craft. Zoom zoom.

Draggers

Not long ago, a distressed customer approached Roccor, a space manufacturer. “They had a satellite that was basically built and ready for launch,” says CEO Douglas Campbell. They had just one problem: Their de-orbit plan needed some work. So Roccor made them a new one, involving … space feathers.

At the end of a satellite’s life, two thin composite sheets — coiled tight like a tape measure during the rest of the mission — will pop from it, making the satellite resistant enough that it slips down and crosses the Kármán line that delineates Earth and space. The system weighs between around 1 and 4 kilograms (2.2 to 8.8 pounds), and is basically another way of doing a dragsail. “Low Earth orbit is beachfront property,” says Campbell, who plans to sell the “Rocfall” feathers so more satellites don’t become space junk. “Everyone wants to be there. We don’t want to ruin the environment.”

Stalkers

Two government groups in the U.S. keep abreast of what’s what in space, and help orbiters avoid collisions. NASA’s Orbital Debris Office deals with the minute, while the US Strategic Command tracks everything bigger than 10 centimeters (about 4 inches) and issues the “duck!” alerts to satellite operators. Last year, though, the Trump administration said it would turn some responsibility for space traffic management over to the Department of Commerce (although the details of how aren’t yet fully fleshed out). Why? Because satellites are increasingly commercial operations.

“In the past, the U.S. government got into ‘space situational awareness’ because it was primarily a military issue,” says Dan Ceperley, CEO of the private satellite-tracking company LeoLabs. It’s still a military issue — secret communications, spying, navigation — but it’s also morphed into an everyone-else issue. So the Department of Commerce and companies like LeoLabs will help shoulder some of the defense sector’s past burdens. LeoLabs has two radar systems, with plans for more, and they hope to give customers information about satellites’ whereabouts with more regularity than the government.

Beepers

Federal trackers traditionally find satellites using either radar or optical telescopes. But those devices don’t necessarily tell you whose object you’re pinging, or give you its position every hour of every day. You have to extrapolate an object’s orbit using physics, so there’s some fuzziness in the calculation of its position, and uncertainty in collision red-flags. But a scientist at the Aerospace Corporation, a federally funded research and development center, has a reasonable question. Why not put GPS transponders on new craft? Just like if you put one on your enemy’s car, you could know where it was, and what it was, all the time, no home radar required. Similarly, a Los Alamos project called ELROI proposes slapping laser-beaming “license plates” on orbiters so that they’re easier to detect and identify.

The metal bits and spent rocket stages already dirtying Earth orbit are unlikely to get license plates or GPS devices. They’ll continue to circle our planet like overhead reminders that our environmental contamination has expanded, like a growing gray cloud, beyond terra firma. But because there are so many clean-up artists, maybe it won’t be too late.

If we end up with too much trash, we won’t only make our desire to launch lots of little satellites untenably complicated. We could also, someday, make it impossible to send a rocket safely beyond Earth, just like Tombaugh and his cohort feared before anyone had even tried.

China is both the best and worst hope for clean energy

In Katowice, Poland, delegates from around the world have gathered to discuss how to curb emissions of greenhouse gases. The intent is to meet the goals that emerged from the 2015 Paris United Nations Climate Summit. But this year there’s a new top dog at the table.

The United States, led by a president who doesn’t believe in climate change or the scientists who study it, will take a back seat at this month’s climate summit, known as COP24. Meanwhile China, with its massive economy and growing green energy sector, has become the world’s climate leader.

That might seem like a good thing if it weren’t for a couple of problems. China is the world’s biggest carbon polluter, and its emissions won’t start easing for many years. Chinese leaders are also exporting dirty energy around the world through their “belt and road” development program, which is spurring economic growth throughout Africa and Southeast Asia. A construction boom in coal-fired power plants has accompanied that growth in places like Vietnam, Pakistan, and Kenya, for example.

So having China as the big power at a climate summit doesn’t bode well for any new get-tough-on-carbon deals between now and the end of the meeting on December 14, experts say. “The negotiations abhor a vacuum,” says Andrew Light, senior fellow at the World Resources Institute and a former climate negotiator in the Obama administration. “The U.S. is not showing leadership, so China steps in.”

The latest round of climate negotiations (held in the capital of Poland’s coal-producing region of Silesia) are focused on the technical issues of how best to measure and verify each country’s stated emissions reductions. Even though the negotiations are held under the flag of the United Nations, there’s no real carbon police out there. So it’s up to each country to self-report their carbon dioxide emissions from factories, automobile tailpipe emissions, and other sources that end up forming a warming blanket in the Earth’s atmosphere. Those numbers are then fact-checked by other nations and NGOs.

A major report released in October by a panel of the world’s leading scientists says that the planet will experience severe environmental damage — wildfires, hurricanes, droughts, and floods — that could top $54 trillion by 2040 unless there’s a big downward shift in carbon dioxide emissions. That’s going to require every nation to make changes, as well as individual cities, states, and businesses.

“It will require things that are more aggressive, like shutting down existing power plants, and by 2030, we probably need to reduce global coal power production by 70 or 80 percent,” says Nathan Hultman, director of the Center for Global Sustainability at the University of Maryland.

Hultman, who worked on climate issues in the Obama White House, says the solutions may be politically impossible for now. “Are we doing enough quickly enough?” he said. “The answer is probably no. At the same time, we have to ask, how do we ramp up contributions toward limiting emissions.”

Still, Hultman and others see progress, and they see China as both a cause of the problem and a potential solution. China burns half the world’s coal and has added 40 percent of the world’s coal capacity since 2002. More than 4.3 million Chinese people work in coal mines, compared to 76,000 in the U.S. (that’s fewer employees than work at Arby’s or in radio).

While China is gaga for coal, it also is more green than anyone else. China owns half the world’s electric vehicles and 99 percent of the world’s electric buses. One quarter of its electricity comes from renewable power like solar or wind. Its cheap silicon panels have driven down the price of solar energy worldwide, and Chinese manufacturers are now starting to export EV batteries to automakers in Europe, Asia, and the U.S.

For Chinese leaders, boosting global green energy isn’t a moral issue, it’s an economic one, according to Jonas Nahm, assistant professor of energy, resources, and environment at the Johns Hopkins University School of Advanced International Studies. “It doesn’t come from an altruistic place,” Nahm said. “They are doing this as an economic development strategy.”

Nahm has been studying the disconnect between green energy targets announced by party leaders in Beijing, and the actions of local leaders in China’s far-flung provinces. He found that up to 40 percent of renewable energy is wasted because there’s no national power market in China. That means that wind and solar power generated in one province can’t be sent to an adjacent province, so more coal plants are fired up even if there’s cheaper green energy next door.

But China’s reliance on dirty coal has come back to haunt its own citizens, according to Nahm. “The air pollution crisis is a reason to get away from coal,” he said. “That’s the first environmental crisis that’s pushed the government to act, and then the impact of climate change. There’s desertification, water shortages, giant dust storms, and some of these problems are getting more severe.”

Nahm and the other experts believe that China is headed in the right direction on climate change, but its economy is so big and so dependent on coal that it takes a while to get there. As for the climate summit in Poland, it’s possible that China might try to wiggle out of meeting even tougher new climate commitments, even as it becomes the biggest nation supporting the U.N. Paris agreement goals. President Trump said he plans to walk away from the Paris agreement; the earliest he can do that is in 2020.

There’s also the issue of checking up on each country’s measurements. Before the Paris agreement, China was considered a “developing” nation subject to less stringent reporting requirements. That changed after 2015. But without a strong U.S. influence to check it today, China might try to loosen the bookkeeping, says Samantha Gross, a senior fellow at the Brookings Institute, a Washington-based think tank.

“What will the reporting requirements be and how will they be verified,” said Gross. “That’s what the negotiators will be duking out in Poland. I’m curious to see how far they get.”

As for China, Gross says they hold the cards for the world’s climate future. “We’re all gonna fry if they don’t do something.”
