Boulder, Colorado, is the latest city to sue Big Oil over climate change.

Rick Scott, who has served as Florida’s governor since 2011, hasn’t done much to protect his state against the effects of climate change — even though it’s being threatened by sea-level rise.

On Monday, eight youth filed a lawsuit against Scott, a slew of state agencies, and the state of Florida itself. The kids, ages 10 to 19, are trying to get their elected officials to recognize the threat climate change poses to their constitutional rights to life, liberty, and the pursuit of happiness.

18-year-old Delaney Reynolds, a member of this year’s Grist 50 list, helped launch the lawsuit. She’s been a climate activist since the age of 14, when she started a youth-oriented activism nonprofit called The Sink or Swim Project. “No matter how young you are, even if you don’t have a vote, you have a voice in your government,” she says.

Reynolds and the other seven plaintiffs are asking for a “court-ordered, science-based Climate Recovery Plan” — one that transitions Florida away from a fossil fuel energy system.

This lawsuit is the latest in a wave of youth-led legal actions across the United States. Juliana v. United States, which was filed by 21 young plaintiffs in Oregon in 2015, just got confirmed for a trial date in October this year.

Minnesota Cop Who Killed Philando Castile Is Charged With Second-Degree Manslaughter

The suburban police officer who shot and killed Philando Castile during a Minnesota traffic stop is being charged with second-degree manslaughter, John Choi, Ramsey County’s top prosecutor, announced on Wednesday.

Castile, 32, was shot by officer Jeronimo Yanez last July. According to Castile’s girlfriend, Diamond Reynolds, who was also in the car along with the couple’s young daughter, the officer fired his weapon as Castile reached to get his ID, after Castile informed Yanez he had a (legally permitted) gun. Reynolds live streamed the aftermath on Facebook, and her video sparked weeks of protests in Minneapolis and nationwide.

Officer Yanez’s use of deadly force “was not necessary, was objectively unreasonable, and was inconsistent with generally accepted police practices,” Choi said. “No reasonable officer—knowing, seeing, and hearing what Officer Yanez did at the time—would have used deadly force under these circumstances.” Yanez’s discharge of his firearm also put Reynolds and her daughter at risk, Choi added. The officer will be charged with two counts of reckless discharge of a firearm as well.

The charging documents revealed new details about the incident: Through the driver’s side window, Yanez asked Castile for his driver’s license and insurance information. Castile provided Yanez with an insurance card and then informed Yanez that he was carrying a weapon. Yanez said “okay” and told Castile not to reach for it. Castile—apparently still reaching for something—responded, “I’m not reaching for it.” Yanez yelled, “Don’t pull it out!” Castile’s girlfriend assured Yanez that Castile wasn’t reaching for the gun. Yanez again ordered Castile not to pull his gun out, and seconds later, he fired seven shots. Castile died on the scene soon after.

Another document, made public by the Hennepin County Sheriff’s Department, showed that Castile had a legal permit to carry a firearm.

Georgia Is Illegally Segregating Students With Behavioral Problems. There’s a Better Way.

A US Department of Justice investigation has found that the state of Georgia is illegally segregating students with behavioral and emotional disabilities. The probe found not only that this sorting has resulted in an estimated 5,000 kids getting an inferior education—often in the same deteriorating buildings that were used during the Jim Crow days for black students—but that the segregated system limits the special education and behavioral resources available for students in integrated settings.

According to ProPublica, the DOJ sent Georgia Gov. Nathan Deal and Attorney General Sam Olens a letter this month detailing its findings:

In Georgia, schools were quick to move children out of mainstream classrooms, the Justice Department noted. In some cases, students were recommended for placement after a single incident or a string of minor incidents, such as using inappropriate language with a teacher. Parents reported feeling pressured into agreeing to the placements.

In fact, many students who were placed in what’s called the Georgia Network for Educational and Therapeutic Support, for GNETS, didn’t actually need to be there, the Justice Department said. Most could have stayed in their neighborhood schools if they’d been given more behavioral or mental-health support. “Nearly all students in the GNETS Program could receive services in more integrated settings, but do not have the opportunity to do,” the letter said.

The letter also explained how students began to feel like stigmatized “outcasts” after being placed in one of GNETS’ 24 facilities:

The negative effects of inappropriate segregation faced by students in the GNETS Program are readily apparent. One student in the GNETS Program stated, “school is like prison where I am in the weird class.” He attributes this in large part to isolation and distance from other students in the general education community, as he does not have the opportunity to interact with these students during the school day. According to a number of other students we spoke with, the GNETS Program denies them some of the most basic elements of a typical childhood school experience.

The arrangement set up by the state of Georgia, which is quick to label “problem” students, runs in direct contrast to the findings highlighted in Mother Jones’ recent feature What If Everything You Knew About Disciplining Kids Was Wrong? Reporter Katherine Reynolds Lewis focused on psychologist Ross Greene’s Collaborative Proactive Solutions method, which has teachers, parents, and administrators problem solve with students instead of jumping into punishment mode.

The CPS method hinges on training school (or prison or psych clinic) staff to nurture strong relationships—especially with the most disruptive kids—and to give kids a central role in solving their own problems. For instance, a teacher might see a challenging child dawdling on a worksheet and assume he’s being defiant, when in fact the kid is just hungry. A snack solves the problem. Before CPS, “we spent a lot of time trying to diagnose children by talking to each other,” Principal Nina D’Aran says. “Now we’re talking to the child and really believing the child when they say what the problems are.”

The next step is to identify each student’s challenges—transitioning from recess to class, keeping his hands to himself, sitting with the group—and tackle them one at a time. For example, a child might act out because he felt that too many people were “looking at him in the circle.” The solution? “He might come up with the idea of sitting in the back of the room and listening,” D’Aran says. The teachers and the student would come up with a plan to slowly get him more involved.

D’Aran’s school in Maine began implementing CPS in 2011. Prior, kids were referred to the principal’s office for discipline 146 times, and two were suspended. After CPS was introduced, the number of referrals dropped to 45, and there were zero suspensions.

It is important to note that the school that D’Aran’s works at is predominantly white. A study released this month in the journal Sociology of Education found that black students who misbehave are more likely to be punished with expulsion, suspension, or referral to law enforcement, while their white peers who engage in the same actions are more likely to receive special education services or psychological treatment. This trend is apparent in the demographic breakdown within the GNETS program. Take, for example, the public school district in Madison County, Ga.: In 2011, the last time the Department of Education collected data, black students made up less than 10 percent of the district’s student body, but they comprised 48 percent of the student body at Rutland Psychoeducational Program, the GNETS facility within that district. Programs like CPS indicate shifts in school discipline are happening—it’s now about getting those practices into high-minority, disadvantaged districts, environments where the school-to-prison pipeline is a real threat.

“We know if we keep doing what isn’t working for those kids, we lose them,” Greene explained to Reynolds Lewis. “Eventually there’s this whole population of kids we refer to as overcorrected, overdirected, and overpunished. Anyone who works with kids who are behaviorally challenging knows these kids: They’ve habituated to punishment.”

In November 2013, June lived in a makeshift encampment of tarps and cardboard, squeezed between a road and a chain link fence in West Oakland, California. “It can happen to anybody, man,” he says of life on the street. “Up today, down tomorrow. That’s the way it goes.”

Come last winter, June upgraded from his ramshackle encampment to a pink wooden house with a tan door and shiny roof. The new house, which is just long enough for him to lie down inside, cost only $30 to build.

It’s one of about 25 colorful homes artist Greg Kloehn has fashioned from the massive amounts of garbage dumped illegally in Oakland—a city where a minimum wage worker would have to put in 150-hour weeks to afford a fair market, two-bedroom apartment. He uses whatever materials he happens upon—pallets, bed boards, sheets of plastic, dryer doors. One home has an umbrella and grill propped on its miniature front porch. Wheels accommodate the “nomadic life” of people living on the street, who relocate frequently to avoid cops and city cleanup crews. As Kloehn jokes, he builds “illegal homes out of illegal garbage.”

Over the past four to five years, the United States has been resegregated—politically. In states where registered Democrats outnumber Republicans and presidential races can be nail-biters, skillful Republican operatives have mounted racially-minded gerrymandering efforts—the redrawing of congressional and state legislative districts—that have led to congressional delegations stacked with GOP members and yielded Republican majorities in the state legislatures.

In North Carolina, Pennsylvania, and Ohio, to name just three, GOPers have recast state and congressional districts to consolidate black voters into what the political pros call “majority-minority districts” to diminish the influence of these voters. North Carolina is an especially glaring example: GOP-redistricting after the 2010 elections led to half the state’s black population—1.1 million people—being corralled into one-fifth of the state legislative and congressional districts. “The districts here take us back to a day of segregation that most of us thought we’d moved away from,” State Sen. Dan Blue Jr., who was previously North Carolina’s first black House speaker, told the Nation in 2012.

A major driving force behind this political resegregation is the Republican State Leadership Committee, a deep-pocketed yet under-the-radar group that calls itself the “lead Republican redistricting organization.” The RSLC is funded largely by Fortune 500 corporations, including Reynolds American, Las Vegas Sands, Walmart, Devon Energy, Citigroup, AT&T, Pfizer, Altria Group, Honeywell International, Hewlett-Packard. Other heavyweight donors not on the Fortune 500 list include Koch Industries, Blue Cross Blue Shield, and the US Chamber of Commerce. At the same time these big-name firms underwrite the RSLC’s efforts to dilute the power of black voters, many of them preach the values of diversity and inclusion on their websites and in corporate reports.

As part of its Redistricting Majority Project—which, tellingly, is nicknamed REDMAP—the RSLC, starting in 2010, poured tens of millions of dollars into legislative races around the country to elect new GOP majorities. Next it provided money and expertise to state officials redrawing political boundary lines to favor the Republican Party—and to shrink the clout of blacks, Hispanics, and other traditionally Democratic voters. Unlike its Democratic equivalent, the RSLC has vast sums at its disposal, spending $30 million during the 2010 elections, $40 million in 2012, and $22 million in 2014.
