Now there’s one less way for Big Coal to screw over Americans

The Obama administration took a small step on Thursday to prevent coal companies from fleecing taxpayers.

Until now, the biggest coal conglomerates were getting away with scamming the government by selling coal mined on federal land to their own subsidiaries for a discounted, below-market price. Since the government’s royalties from that coal are a percentage of the sale price, that meant the companies were paying lower royalties than they should have been. Forty-two percent of the coal produced in Wyoming’s Powder River Basin — the biggest coal-producing area in the U.S. right now — was being sold through these “captive transactions,” according to Public Citizen, a good government advocacy group.

On Thursday, the Interior Department issued a new rule that puts a stop to that practice.

“One of the things Cloud Peak [Energy] and other coal companies were doing is selling to an affiliate at the mine mouth and then selling it in the export market at a significantly higher price,” says Tyson Slocum, director of Public Citizen’s energy program. This new rule will allow the department to more accurately calculate the “market value” of coal, oil, and gas extracted on public land and make sure it’s getting paid fair royalties. Slocum estimates that this could bring in an additional $300 million per year in royalties.

This is important for two reasons: Corporations should not be stealing from the public, and every penny we undercharge fossil-fuel companies is an implicit subsidy for the dirty fuels that cause climate change. Coal companies are struggling, and instead of throwing them a lifeline that will help them stay in the business of worsening global warming, we should be letting them sink.

Crucially, unlike many other rules issued by federal agencies, this new rule will apply not just to future leases but also to ones that already exist. So even under a coal lease bought five years ago, a company will now have to pay fairer royalty rates going forward.

This is just the beginning of reforms needed to the federal fossil-fuel leasing system. A bigger issue is that coal, oil, and gas lease rates have failed to keep pace with the market, and on top of that they do not factor in the social costs of pollution and climate change. If they did those two things, the cost of fossil-fuel leases would be prohibitive. As it is, the leasing program is a big money-loser for the federal government. Greenpeace estimates that coal leasing alone costs taxpayers some $50 billion per year.

Ultimately, of course, we should be keeping fossil fuels in the ground — especially on land owned by the public. Hillary Clinton has pledged to move toward that goal, but she hasn’t specified a timeline. President Obama and Interior Secretary Sally Jewell have only promised to ensure that the public gets a fair price for fossil fuels extracted from public land, and to align the leasing programs with the administration’s goal of combatting climate change. It’s not clear what exactly either of those things mean. But in January, the Interior Department put a moratorium on new coal leases pending the results of a multi-year environmental review of the leasing program.

Climate activists have made fixing the broken fossil-fuel leasing system their top priority, and clearly more changes will occur, but no one knows how far they will go.

Oregon explosion reminds us that oil trains are “weapons of mass destruction”

An oil train that went off the tracks and burst into flames in the Columbia River Gorge in Oregon last week hasn’t been cleaned up yet, but the railroad is already back to business as usual. And many North Americans are feeling renewed anxieties about the danger of what activists call “bomb trains.”

On Friday, 16 Union Pacific train cars filled with highly combustible fracked oil from the Bakken shale formation in North Dakota derailed outside Mosier, Ore. Multiple cars caught fire, and about 100 people were evacuated from nearby homes. Elizabeth Sanchey, one of the first responders, told Oregon Public Broadcasting that the scene “looked like the apocalypse.” This weekend, a sheen of oil was spotted on the Columbia River nearby.

Mosier city officials quickly passed an emergency motion calling on Union Pacific to remove all oil from the damaged cars before the line was reopened, but Union Pacific just pushed the disabled cars to the side of the track and restarted operations. As of this writing, the cars are still filled with oil.

“Restarting trains before the high-risk carnage of their last accident is even cleared from the tracks is telling Mosier they are going to play a second round of Russian roulette without our town,” said Mayor Alrene Burns in a statement. “It’s totally unacceptable.”

Mosier’s citizens agree. Dozens of locals — including city officials, tribal representatives, faith leaders, and members of environmental groups — gathered in nearby Hood River, Ore., over the weekend to protest the oil trains moving through their communities.

Mosier, of course, isn’t the only town at risk.

Crude oil from the Bakken shale is especially flammable, and it is transported all across the U.S. and Canada. In 2013, a train moving Bakken crude derailed in Lac-Mégantic, Quebec, killing 47 people and destroying much of the town center. It was the most deadly oil-train derailment in recent history, but it was far from the only one. In the past few years, more than a dozen derailments and explosions have occurred, leading to evacuations, oil spills, and, in some cases, fires that burned for days.

Though oil transport by rail is increasingly common, many residents have no idea that these trains are passing through their communities. (This map shows some rail lines that transport oil, as well as sites where accidents have occurred.) In 2014, national railroad operators agreed to eight voluntary measures to lower the risk of derailments, including reducing speed in some cities and increasing inspections, but communities still aren’t getting the information they would need to effectively respond to disasters, let alone prevent them.

Mosier has about 400 residents, but these oil trains aren’t only going through rural areas and small towns. They go through major American cities as well.

In Seattle, an oil train carrying nearly 100 cars derailed underneath a bridge in 2014. While all the cars were left intact and there was no public safety risk, according to officials, the incident underscored the potential for disaster. And that potential is huge: Last year, a KOMO News investigation captured video of more than a hundred train cars filled with oil rolling past the Seattle Seahawks football stadium as 32,000 fans watched a game inside. The Seattle City Council has called for railroads to curb oil train shipments through the city, but the companies have refused to comply, or even to release train schedules. And there’s no law that requires them to.

“The railroads are bringing weapons of mass destruction through our cities,” Fred Millar, oil safety and hazardous materials expert, tells Grist, and the only thing firefighters can do in the event of an explosion is to back off and let it burn.

As for Mosier, all evacuees have been allowed to return home, but their ordeal is far from over. The city’s wastewater treatment plant is offline, residents have a boil advisory for drinking water, and the full oil cars are still sitting there beside the tracks.

Another day, another exploding oil train.

On Friday, a flimsy metal can carrying crude oil derailed east of Portland in Mosier, Oreg., forcing schools to evacuate and an interstate highway to close. The accident involved 11 train cars, according to KIRO 7 News, and several burst into flames.

As of Saturday, there were no reports of oil leaking into the Columbia River.

Every accident reinvigorates fears about bomb trains that regularly route through the Pacific Northwest. In May, Oregon activists occupied railroad tracks to protest the extraction and transportation of crude oil through the region.

Three years ago, an oil-train explosion in Lac-Mégantic Quebec killed 47 people.

Flooding in Texas killed six over Memorial Day weekend, bringing the death toll from the state’s unprecedented floods this year to at least 14. The area surrounding Houston has been hit especially hard: On Sunday, about 2,600 inmates were evacuated from two southeastern Texas prisons endangered by high water, and evacuation orders were issued Monday for homes along the Brazos River.

Deluges like this aren’t exactly new to the area — downpours at this time last year brought a death toll of at least 30 — but as the climate warms, so does risk of flooding. In the past 30 years, reports the AP, the frequency of extreme downpours in the area has doubled.

“One likely cause,” Texas’ state climatologist John Nielsen-Gammon tells Grist, “is the increase in ocean temperatures from the Gulf of Mexico and tropical Atlantic. That determines how much moisture is in the atmosphere.” As temperatures increase, so does rainfall.

But it’s not just the rainfall that is endangering Houston’s citizens — it’s also ecologically irresponsible development.

Houston is the only major American city without formal zoning laws. As a result, developers have been free to pave over huge swaths of valuable wetlands that absorb runoff. Between 1996 and 2011, the amount of the Houston region covered in pavement increased by 25 percent, according to Samuel Brody, professor of urban planning at Texas A&M.

“Houston’s unique in that it’s a low-lying area barely above sea level,” Brody told Marketplace. “It’s originally made up of bayous and soils that don’t drain too well, and it’s a city that’s afflicted by flooding from both the sea, saltwater flooding, and rainfall-based flooding. The problem is not the environmental conditions, the problem is pavement.”

Beyond lives lost, there are financial costs to these disasters as well. Since 1998, FEMA has paid over $3 billion (adjusted for inflation) for flood losses in the area, according to the AP. And as floods worsen and paved areas expand, that’s a cost that promises to get worse.

Duke Energy is finally being ordered to clean up its coal-ash ponds in North Carolina — more than two years after one of them leaked 40,000 tons of toxic muck into the Dan River. But it has eight years to get the job done, and the state Department of Environmental Quality (DEQ) hopes to give the company even more flexibility.

Duke, the nation’s largest electric utility, has 33 sites around the state where it dumps toxic ash waste from its coal-fired power plants, and some of the sites are believed to be leaking hazardous chemicals into nearby water supplies. For a year, hundreds of households near coal ash ponds were told not to drink water from their wells, which was found to have high levels on a known carcinogen. This spring, they were told they could resume drinking the water, even though it hadn’t been cleaned up. (We wrote more about this earlier this week.)

In a proposal released on Wednesday, DEQ said Duke should excavate and close eight of the most dangerous coal ash sites by 2019, and the 25 others by 2025. But DEQ is asking the state legislature to be allowed to reconsider the timeline in 18 months. The agency has been accused of being lenient on Duke; last year, DEQ lowered the utility’s fine for the big 2014 spill from $25 million to $7 million.

Duke CEO Lynn Goode said the cost of the cleanup could be as high as $4 billion — and the company would seek to pass that cost on to the state’s residents. “It’s fair to say that if we have to excavate all of our basins, it would be significantly higher costs for our customers,” Goode said during a conference call with reporters.

Environmentalists say the DEQ’s recommendations don’t go far enough. “DEQ just ducked its responsibility and punted it into the future,” said Peter Harrison, attorney for the Waterkeeper Alliance. “As usual, North Carolina’s so-called leadership has shown it lacks the courage to stand up to powerful polluters, even when people’s health is at stake.”

North Carolina Gov. Pat McCrory (R) has been in the news lately thanks to HB2, a bill he signed into law in March that forces transgender folks to use the bathroom of the gender on their birth certificates. The backlash for McCrory — who is up for reelection this year — was swift. Along with a myriad of businesses who have threatened to pull out of the state, North Carolina residents themselves are protesting in creative ways: An “air horn orchestra” regularly performs outside the governor’s mansion in Raleigh, a Durham-based advertising firm is giving away toilet paper printed with the text of HB2, and activists delivered a porta-potty to McCrory’s lawn.

But HB2 isn’t the only issue that could have North Carolina voters reconsidering McCrory when they go to the polls this November: There’s also the governor’s cozy ties to Duke Energy and allegations that his administration let the company off easy after serious pollution violations.

A fine reduced

The story goes back to 2014, when Duke Energy — McCrory’s employer for nearly three decades — was responsible for a spill that dumped 40,000 tons of toxic coal ash and 27 million gallons of wastewater into the Dan River, one of the largest coal ash spills in the nation’s history.

Initially, Duke was fined $25 million by the state, but in a retreat that many residents found disappointing — and fishy — the North Carolina Department of Environmental Quality (DEQ) later privately negotiated the fine down to just $7 million. When the deal was announced in September 2015, an attorney for the Southern Environmental Law Center called it “a total surrender and collapse by DEQ.”

An investigation by TV station WRAL later found that McCrory and DEQ officials secretly met with Duke Energy leaders, including company CEO Lynn Good, at the governor’s mansion in Raleigh a few months before the fine was lowered.

Duke, as it happens, donated $3 million to the Republican Governors Association soon after the 2014 coal ash spill. The association, which contributed to McCrory’s campaign in 2012, is expected to be a big backer of his reelection effort this year.

Dirty drinking water

But the low fine wasn’t the only favor that the McCrory administration appears to have done for Duke Energy.

After the Dan River spill, investigations found that Duke had more than a dozen coal ash storage sites across the state, many of which were leaching a carcinogen called hexavalent chromium into the water table. After this was discovered, 240 households located near coal ash sites were told not to drink from their wells. Duke Energy started supplying bottled water to those households in April 2015, as WBTV reports.

But a year later, the DEQ and the North Carolina Department of Health and Human Services reversed the do-not-drink order. Residents were told their water was just as safe as water coming from public utilities.

That wasn’t true, WBTV reports. Some of the wells near Duke’s facilities were found to have levels of hexavalent chromium hundreds of times higher than the average level in the state’s public water systems.

So why the about-face by the state agencies? Duke Energy, it turns out, lobbied the state to reverse the do-not-drink order, according to the TV station. When state epidemiologist Megan Davies was deposed by a lawyer for the Southern Environmental Law Center, she said that she and her boss questioned the reversal. She also said that McCrory’s office intervened in the wording of initial do-not-drink letters sent out in April 2015.

Still, the Department of Health and Human Services insists that the water contamination is nothing to worry about. “The water in these wells meets the standards of the Safe Drinking Water Act,” Kendra Gerlach, communications director for the agency, said in a statement. “Allowing the affected residents to return to drinking their water is within federal and state guidelines and is consistent with safe drinking water practices across the country.”

For those who live near Duke’s coal ash sites, however, the state’s position doesn’t bring much comfort. In the year between the do-not-drink order and its reversal, nothing has changed. The coal ash sites weren’t cleaned up and the carcinogen didn’t go away. In fact, one thing has arguably gotten worse: In March, McCrory shut down the commission charged with overseeing the cleanup of Duke’s coal ash sites across the state.

“The water isn’t any different,” said Tad Helmstettler, an environmental health supervisor in Rowan County, one of the areas affected by the order. “If you were worried about the water before, you should be worried about it now.”

If polls are to be believed, McCrory has his own reasons to be worried: His approval rating is at an all-time low, and he’s in a tight race with Democratic challenger Roy Cooper. And as the spotlight shines brighter on HB2, as well as the governor’s ties to Duke Energy, McCrory’s prospects may only get darker.

A short train ride separates Manhattan from Donald Trump’s New York. Stretching between the Hudson River to the west and the Connecticut border to the east, Dutchess County encompasses a rural, white, and conservative swath of the state, punctuated with two small, liberal cities with large minority populations. On Sunday, these two populations met—and clashed—when Trump came to town.

The Hudson Valley isn’t generally seen as a hotbed of right-wing politics, but in some ways it resembles the places where Trump has performed best. Trump has posted his top numbers in states with a high percentage of minorities, especially African Americans. His supporters are largely white, but they seem to be galvanized by the presence of minorities in their environs.

Trump’s appeal in Dutchess County was evident at a rally on Sunday in Poughkeepsie that brought thousands of his supporters—and a sizeable contingent of protesters—to the county seat, a working-class, largely post-industrial city that is 48 percent nonwhite.

“I came out to see all the racists,” said 22-year-old Marvin Graves of Poughkeepsie, who stationed himself outside the Trump rally and goaded the Trump fans waiting in line to get in. “I go to community college, I don’t have a gun,” he said, before raising his voice even louder and announcing, “I’m not going to shoot you!”

Donald Trump has been spewing forth a stream of repugnant verbal pollution for months. Now he stands accused of producing a more literal kind of pollution — one that could contaminate the source of drinking water for the city where he so badly wants to live.

In 2009, the Trump National Golf Course 15 miles outside Washington, D.C., cut down an estimated 465 mature trees along the banks of the Potomac River, which provides drinking water to 5 million people. The head of the nonprofit Potomac Conservancy, Hedrick Belin, is now charging that the removal of trees along that 1.5-mile stretch could be worsening erosion and runoff into the river.

“It’s the single largest stretch of river upstream of D.C. without any trees on it whatsoever,” Belin told Grist. “If you’re flying into the National Airport in D.C., you can see it from the air. The contrast is so stark.” And those missing trees matter for water quality: “Trees are nature’s Brita filter,” he says, noting that they capture pollutants before they enter waterways. “When Trump makes an egregious move like this, we’re gonna call it out.”

Ed Russo, who has overseen environmental work on Trump’s golf courses, said that some of the trees were weak and susceptible to disease. Russo, who has been identified in the past as a special projects manager, spokesman, environmental consultant, planning consultant, and project director for the Trump Organization, also claimed that the trees were causing erosion, and that the grasses planted in their place are more environmentally beneficial. As The Washington Post sardonically put it in 2011, Russo’s ideas “often go against the grain of conventional scientific wisdom and soil conservation practice.”

Russo fired back against Belin’s allegations with bombast worthy of Trump himself: “This is a spectacular environmental net gain we did,” he told the Washingtonian this week. “Nobody required Donald Trump to do it. He did it because it was the right thing to do. Everyone agrees with me except Hedrick what’s-his-name.”

It’s not the first time the Republican presidential front-runner’s golf courses have been targeted for poor environmental practices. In 2011, New Jersey’s Department of Environmental Protection cited the Trump National Golf Club in Bedminster, N.J., for a series of violations, including cutting down trees and fouling wetlands. And Scottish scientists reportedly criticized efforts to stabilize sand dunes at Trump’s course in Scotland, which was also the site of a bitter battle between the business mogul and proponents of a large coastal wind farm.

Trump, who has both touted his own “great environmental record” and pledged to eliminate the Environmental Protection Agency, has not weighed in on the tree-clearing himself. The Trump Organization, the Trump campaign, and Ed Russo did not respond to requests for comment.

It’s Not Just Flint. There’s an Ugly History of Lead Poisoning and the Poor in the US.

“I know if I was a parent up there, I would be beside myself if my kids’ health could be at risk,” said President Obama on a recent trip to Michigan.

“Up there” was Flint, a rusting industrial city in the grip of a “water crisis” brought on by a government austerity scheme. To save a couple of million dollars, that city switched its source of water from Lake Huron to the Flint River, a long-time industrial dumping ground for the toxic industries that had once made their home along its banks. Now, the city is enveloped in a public health emergency, with elevated levels of lead in its water supply and in the blood of its children.

The price tag for replacing the lead pipes that contaminated its drinking water, thanks to the corrosive toxins found in the Flint River, is now estimated at up to $1.5 billion. No one knows where that money will come from or when it will arrive. In the meantime, the cost to the children of Flint has been and will be incalculable. As little as a few specks of lead in the water children drink or in flakes of paint that come off the walls of old houses and are ingested can change the course of a life. The amount of lead dust that covers a thumbnail is enough to send a child into a coma or into convulsions leading to death. It takes less than a tenth of that amount to cause IQ loss, hearing loss, or behavioral problems like attention deficit hyperactivity disorder and dyslexia. The Centers for Disease Control (CDC), the government agency responsible for tracking and protecting the nation’s health, says simply, “No safe blood lead level in children has been identified.”

President Obama would have good reason to worry if his kids lived in Flint. But the city’s children are hardly the only ones threatened by this public health crisis. There’s a lead crisis for children in Baltimore, Maryland, Herculaneum, Missouri, Sebring, Ohio, and even the nation’s capital, Washington, DC, and that’s just to begin a list. State reports suggest, for instance, that “18 cities in Pennsylvania and 11 in New Jersey may have an even higher share of children with dangerously elevated levels of lead than does Flint.” Today, scientists agree that there is no safe level of lead for children and at least half of American children have some of this neurotoxin in their blood. The CDC is especially concerned about the more than 500,000 American children who have substantial amounts of lead in their bodies. Over the past century, an untold number have had their IQs reduced, their school performances limited, their behaviors altered, and their neurological development undermined. From coast to coast, from the Sun Belt to the Rust Belt, children have been and continue to be imperiled by a century of industrial production, commercial gluttony, and abandonment by the local, state, and federal governments that should have protected them. Unlike in Flint, the “crisis” seldom comes to public attention.

Two, Three… Many Flints

In Flint, the origins of the current crisis lay in the history of auto giant General Motors (GM) and its rise in the middle decades of the twentieth century to the status of the world’s largest corporation. GM’s Buick plant alone once occupied “an area almost a mile and a half long and half a mile wide,” according to the Chicago Tribune, and several Chevrolet and other GM plants literally covered the waterfront of “this automotive city.” Into the Flint River went the toxic wastes of factories large and small, which once supplied batteries, paints, solders, glass, fabrics, oils, lubricating fluids, and a multitude of other materials that made up the modern car. In these plants strung out along the banks of the Flint and Saginaw rivers and their detritus lay the origins of the present public health emergency.

The crisis that attracted President Obama’s attention is certainly horrifying, but the children of Flint have been poisoned in one way or another for at least 80 years. Three generations of those children living around Chevrolet Avenue in the old industrial heart of the city experienced an environment filled with heavy metal toxins that cause neurological conditions in them and cardiovascular problems in adults.

As Michael Moore documented in his film Roger and Me, GM abandoned Flint in a vain attempt to stave off financial disaster. Having sucked its people dry, the company ditched the city, leaving it to deal with a polluted hell without the means to do so. Like other industrial cities that have suffered this kind of abandonment, Flint’s population is majority African American and Latino, and has a disproportionate number of families living below the poverty line. Of its 100,000 residents, 65 percent are African American and Latino and 42 percent are mired in poverty.

The president should be worried about Flint’s children and local, state, and federal authorities need to fix the pipes, sewers, and water supply of the city. Technically, this is a feasible, if expensive, proposition. It’s already clear, however, that the political will is just not there even for this one community. Gina McCarthy, the Environmental Protection Agency’s administrator, has refused to provide Flint’s residents with even a prospective timetable for replacing their pipes and making their water safe. There is, however, a far graver problem that is even less easy to fix: the mix of racism and corporate greed that have put lead and other pollutants into millions of homes in the United States. The scores of endangered kids in Flint are just the tip of a vast, toxic iceberg. Even Baltimore, which first identified its lead poisoning epidemic in the 1930s, still faces a crisis, especially in largely African American communities, when it comes to the lead paint in its older housing stock.

Just this month, Maryland’s secretary of housing, community, and development, Kenneth C. Holt, dismissed the never-ending lead crisis in Baltimore by callously suggesting that it might all be a shuck. A mother, he said, might fake such poisoning by putting “a lead fishing weight in her child’s mouth and then take the child in for testing.” Such a tactic, he indicated, without any kind of proof, was aimed at making landlords “liable for providing the child with better housing.” Unfortunately, the attitudes of Holt and Governor Rick Snyder of Michigan have proven all too typical of the ways in which America’s civic and state leaders have tended to ignore, dismiss, or simply deny the real suffering of children, especially those who are black and Latino, when it comes to lead and other toxic chemicals.

There is, in fact, a grim broader history of lead poisoning in America. It was probably the most widely dispersed environmental toxin that affected children in this country. In part, this was because, for decades during the middle of the twentieth century, it was marketed as an essential ingredient in industrial society, something without which none of us could get along comfortably. Those toxic pipes in Flint are hardly the only, or even the primary, source of danger to children left over from that era.

In the 1920s, tetraethyl lead was introduced as an additive for gasoline. It was lauded at the time as a “gift of God” by a representative of the Ethyl Corporation, a creation of GM, Standard Oil, and Dupont, the companies that invented, produced, and marketed the stuff. Despite warnings that this industrial toxin might pollute the planet, which it did, almost three-quarters of a century would pass before it was removed from gasoline in the United States. During that time, spewed out of the tailpipes of hundreds of millions of cars and trucks, it tainted the soil that children played in and was tracked onto floors that toddlers touched. Banned from use in the 1980s, it still lurks in the environment today.

Meanwhile, homes across the country were tainted by lead in quite a different way. Lead carbonate, a white powder, was mixed with linseed oil to create the paint that was used in the nation’s homes, hospitals, schools, and other buildings until 1978. Though its power to harm and even kill children who sucked on lead-painted windowsills, toys, cribs, and woodwork had long been known, it was only in that year that the federal government banned its use in household paints.

Hundreds of tons of the lead in paint that covered the walls of houses, apartment buildings, and workplaces across the United States remains in place almost four decades later, especially in poorer neighborhoods where millions of African American and Latino children currently live. Right now, most middle class white families feel relatively immune from the dangers of lead, although the gentrification of old neighborhoods and the renovation of old homes can still expose their children to dangerous levels of lead dust from the old paint on those walls. However, economically and politically vulnerable black and Hispanic children, many of whom inhabit dilapidated older housing, still suffer disproportionately from the devastating effects of the toxin. This is the meaning of institutional racism in action today. As with the water flowing into homes from the pipes of Flint’s water system, so the walls of its apartment complexes, not to mention those in poor neighborhoods of Detroit, Baltimore, Washington, and virtually every other older urban center in the country, continue to poison children exposed to lead-polluted dust, chips, soil, and air.

Over the course of the past century, tens of millions of children have been poisoned by lead and millions more remain in danger of it today. Add to this the risks these same children face from industrial toxins like mercury, asbestos, and polychlorinated biphenyls (better known as PCBs) and you have an ongoing recipe for a Flint-like disaster but on a national scale.

In truth, the United States has scores of “Flints” awaiting their moments. Think of them as ticking toxic time bombs — just an austerity scheme or some official’s poor decision away from a public health disaster. Given this, it’s remarkable, even in the wake of Flint, how little attention or publicity such threats receive. Not surprisingly, then, there seems to be virtually no political will to ensure that future generations of children will not suffer the same fate as those in Flint.

The Future of America’s Toxic Past

A series of decisions by state and local officials turned Flint’s chronic post-industrial crisis into a total public health disaster. If clueless, corrupt, or heartless government officials get all the blame for this (and blame they do deserve), the larger point will unfortunately be missed — that there are many post-industrial Flints, many other hidden tragedies affecting America’s children that await their moments in the news. Treat Flint as an anomaly and you condemn families nationwide to bear the damage to their children alone, abandoned by a society unwilling to invest in cleaning up a century of industrial pollution, or even to acknowledge the injustice involved.

Flint may be years away from a solution to its current crisis, but in a few cities elsewhere in the country there is at least a modicum of hope when it comes to developing ways to begin to address this country’s poisonous past. In California, for example, 10 cities and counties, including San Francisco, San Diego, Los Angeles, and Oakland, have successfully sued and won an initial judgment against three lead pigment manufacturers for $1.15 billion. That money will be invested in removing lead paint from the walls of homes in these cities. If this judgment is upheld on appeal, it would be an unprecedented and pathbreaking victory, since it would force a polluting industry to clean up the mess it created and from which it profited.
There have been other partial victories, too. In Herculaneum, Missouri, for instance, where half the children within a mile of the nation’s largest lead smelter suffered lead poisoning, jurors returned a $320 million verdict against Fluor Corporation, one of the world’s largest construction and engineering firms. That verdict is also on appeal, while the company has moved its smelter to Peru where whole new populations are undoubtedly being poisoned.

President Obama hit the nail on the head with his recent comments on Flint, but he also missed the larger point. There he was just a few dozen miles from that city’s damaged water system when he spoke in Detroit, another symbol of corporate abandonment with its own grim toxic legacy. Thousands of homes in the Motor City, the former capital of the auto industry, are still lead paint disaster areas. Perhaps it’s time to widen the canvas when it comes to the poisoning of America’s children and face the terrible human toll caused by “the American century.”

What Flint’s Dirty Water and Detroit’s Angry Teachers Have in Common

Michigan is having a rough year, to put it mildly. Flint is reeling from the news that its water supply was contaminated with lead for 17 months. In Detroit, teacher “sick-outs” have been shutting down schools; 88 of the city’s 104 schools were closed on January 21. These two seemingly unrelated episodes are joined by a common policy: Both Detroit’s school system and Flint’s water system have been under the control of emergency managers, unelected officials who are empowered to make sweeping decisions and override local policies in the name of balancing budgets.

What’s an emergency manager? Michigan Gov. Rick Snyder was elected in 2010 on a platform of fiscal austerity. Snyder, the former head of Gateway computers and a darling of the American Legislative Exchange Council and the Koch-funded Americans for Prosperity, promised to run the state like a company, complete with “outcomes” and “deliverables.” In 2011, he introduced a signature piece of legislation, Public Act 4, which expanded the state’s authority to take over financially troubled cities and school districts. Similar laws exist in about 20 states, but Michigan’s is the most expansive: Emergency managers picked by the governor have the power to renegotiate or cancel city contracts, unilaterally draft policy, privatize public services, sell off city property, and even fire elected officials.

Since 2011, 17 municipalities or school districts in Michigan have been assigned emergency managers. The majority of them are in poor, predominantly African-American communities that have been hit hard by depressed economies and shrinking populations. Some EMs have worked with communities to generate local buy-in, but their outsider status, lack of accountability, and propensity for cutting public services to save money have generated harsh criticism. As Michael Steinberg, the legal director for the Michigan chapter of the American Civil Liberties Union, said a recent statement, “Flint is Exhibit A for what happens when a state suspends democracy and installs unaccountable bean counters to run a city.”

So what does this have to do with Flint? Flint was one of the the first cities to be assigned an emergency manager, in 2011; it would have four EMs in as many years. In 2013, its city council voted to build a pipeline to Lake Huron that would free the city of its dependence on Detroit’s water system by 2017. Ed Kurtz, the then-emergency manager, signed off on the plan, and the question became where Flint would source its water in the intervening years. According to a recent Daily Beast investigation, Kurtz rejected the idea of using Flint River water based on conversations with Michigan’s Department of Environmental Quality. Longtime Flint residents were also skeptical of the idea: General Motors, which calls Flint home, had used the river as a dumping ground for years.

Yet in 2014, under emergency manager Darnell Earley, the city switched water sources to the Flint River. It remains unclear what led authorities to believe that Flint River water was safe to drink; Earley maintains the decision was supported in a vote by the city council, though there is no record of such a vote. Howard Croft, the former director of public works for Flint, told the ACLU that the decision was financial, had been reviewed by state authorities, and went “all the way to the governor’s office.”

In March of 2015, after months of residents reporting unusual health symptoms and foul-smelling, tainted water coming from their taps, the Flint City Council voted to “do all things necessary” to switch back to Detroit’s water system. Then-acting emergency manager Jerry Ambrose nixed the vote, calling it “incomprehensible.”

And what about Detroit? For the past few weeks, Detroit teachers have been protesting with coordinated sick days that have caused dozens of temporary school closures. The sick-outs, the teachers say, are in response to disgraceful school conditions, from black mold and dead rodents in classrooms to class sizes of more than 40 students.

The Detroit Public School system has been under the authority of an emergency manager since 2009, when the beleaguered system of roughly 100,000 students was mired in debt. Today, after six years under four emergency managers, the number of students has shrunk by about 50 percent while the system’s debt has ballooned to $515 million. It risks going bankrupt by April. Over the past five years, every public school employee has taken a 10 percent wage cut.

“Emergency management is not working,” Ivy Bailey, the president of Detroit Federation of Teachers, told CNN. “If the goal was to destroy DPS, emergency management has done an excellent job.”

Governor Snyder’s latest pick for DPS emergency manager was Darnell Earley, the same official who oversaw Flint’s transition to corrosive river water. On January 21, the day 88 schools were shut down, the school system filed a restraining order against the protesting teachers meant to stop them from calling in sick. The motion was denied. On January 23, Earley posted new rules requiring teachers to submit a written report to him if they learn about their fellow employees organizing a strike. “Failure to immediately comply with this order may be grounds for discipline up to and including termination,” the rules read. Earley’s office did not respond to requests for comment.

What’s next for Michigan’s emergency managers?

There are currently no Michigan cities with emergency managers, though three school districts still them. But they remain unpopular with many Michiganders. Democratic legislators say they will introduce a bill to repeal the EM law. Voters already overturned the EM law in a November 2012 referendum, but a month later, the Republican-led state legislature passed a nearly identical law attached to an appropriations bill that is immune to voter referendum.

“Appointing an emergency manager is the last thing I ever want to do,” wrote Snyder in a 2012 blog post entitled “Why Michigan Needs Its Emergency Manager Law,” written just before the voter referendum. “But if worse comes to worse, the state has a responsibility to protect the health, welfare and safety of its citizens. We can’t stand by and watch schools fail, water shut off, or police protection disappear.”
