The FDA is confused about the definition of ‘milk,’ so we talked to a dictionary expert

As a young kiddo, you probably looked up from the book you were reading to ask some version of the following question:  “Mommy, what does ‘obnoxious’ mean?”

More likely than not, a lazy adult advised you to look it up in the dictionary. That advice, while annoying, was instructive.

Perhaps the U.S. Food and Drug Administration should take a page from the dictionary, too. The agency has expressed some confusion over the word “milk,” and whether plant-based beverages like almond milk should be labeled as such.

“You know, an almond doesn’t lactate, I will confess,” FDA’s commissioner Scott Gottlieb said at a policy summit earlier this month.

The dairy industry has been begging the agency to address this topic of concern for nearly 20 years in the hopes of getting “milk” banished from the labels of non-dairy, climate-friendlier alternatives like soy, almond, coconut, and oat milk.

Big Lactose’s dreams might finally come true. The FDA released an official statement Thursday saying it was reviewing the question of what’s milk, and what’s not.

“All the lexicographers I know groaned and said, ‘Oh boy, here we go,” says Kory Stamper, lexicographer and author of Word by Word: The Secret Life of Dictionaries.

“The FDA can decide whatever they want, but in terms of common usage, that use of [plant] milk is not going anywhere,” Stamper tells me. “It’s 600 years old.”

That’s right — almond milk actually dates back to the 1400s, according to Stamper.

Milk generally refers to the “fluid secreted by the mammary glands of females for the nourishment of their young,” as Merriam-Webster dictates, as well as milk from an animal “used as food by people.” The next definition, however, says that milk is also “a food product produced from seeds or fruit that resembles and is used similarly to cow’s milk,” as well as “a liquid resembling milk in appearance.”

Earlier this year, France decided to ban vegan foods from borrowing terminology from animal products (that means no more soy milk or vegan bacon). The justification? That consumers might confuse soy milk with dairy milk, for instance. There doesn’t seem to be much real confusion about whether plant-based milks are really milk milk, Stamper tells me.

The FDA seems to be taking a different tack than the French. Echoing the dairy industry, the agency’s statement suggests that when people hear “almond milk,” they might somehow think that it’s nutritionally equivalent to dairy milk. The nutritional comparison is another question in itself.

And the same discussion may soon turn to “meat.” As the debate heats up over what to call cell-cultured meat and meat alternatives, know this: While meat has referred to animal flesh since the 1300s, it was used for the flesh of a fruit or a nut (like the meat of a walnut) just a century later, Stamper tells me.

“It gets tricky when you start dealing with these general vocabulary terms that are really foundational,” Stamper says. “We think they have one clear meaning, but if you look at the history, their meanings are just not that clear. Their use goes back way further than we think.”

Gottlieb, the FDA commissioner, knows he’s up against a challenge. If the FDA decides to take the milk out of almond milk, it could end up embroiled in a legal battle over commercial free speech rights.

“If you open our Standards of Identity, it talks about a lactating animal,” Gottlieb said at the policy summit, “but you open up a dictionary, it talks about milk coming from a lactating animal or a nut.”

The dairy industry’s hope seems to be that if these increasingly popular plant-based milks can no longer be billed as milk, their sales might dip. Whatever ends up on the label, at least one person is likely to keep buying almond milk anyway.

“I’m lactose intolerant, so I can’t drink dairy,” Stamper says. “I mostly drink nut milks.”

And she’ll probably keep calling it almond milk, just like the rest of us: “Trying to change general usage once it’s well established is pretty impossible, so good luck with that.”

What’s the secret to being a highly-paid CEO of a Fortune 500 company? Sales growth? Earnings growth? Impressive return to shareholders? Visionary leadership?

According to a new study from Institutional Shareholder Services the real key is simpler: set your own pay. Or better yet, have a friend set it. According to ISS, in companies that have an insider as chairman of the board, CEOs earned a little over $15 million during the past three years. But in companies with an independent outsider as chairman, CEOs made only $11 million.

Did anything else matter? Revenue did: bigger companies pay their CEOs more. But that was it. Shareholder return was insignificant, as were several other variables. Bottom line: if you want a big payday, run a big company and make sure an insider is setting your pay.

Game 6 of baseball’s World Series is tonight in Kansas City, and the stakes are high: The San Francisco Giants could clinch their third championship in five years with a win, while the hometown Royals need a win to stay alive. Don’t have a rooting interest, or looking for another reason to tune in? Check out Mother Jones‘ report from last year on the political and business dealings of Major League Baseball’s owners. If you like Karl Rove, you may want to pull for the Giants—but if rationalizing child labor is more your taste, go Royals!

Here’s the dish on the Giants’ Charles B. Johnson:

Johnson, a mutual-funds baron and the 211th-richest person in the world according to Forbes, spent some $200,000 to try to defeat California’s Proposition 30, the sales and income tax increase that included elements of the state’s millionaire’s tax initiative. (Prop. 30 passed in November.) Other political expenditures: $50,000 for Prop. 32, which would have kept unions and corporations from using automatic payroll deductions to bankroll political activity, and $200,000 for Karl Rove’s American Crossroads.

And the Royals’ David Glass:

In 1992, when he was still president and CEO of Walmart, Glass was confronted by NBC’s Dateline with evidence of child labor at a T-shirt factory in Bangladesh. His response: “You and I might, perhaps, define children differently.” As Glass explained, looks can be deceiving—Asians are short. Then he ended the interview. Meanwhile, as the Royals’ owner he’s pocketed profits without making any discernible investment in the on-field product. He also once revoked press credentials of reporters who asked critical questions.

In Defense of Optics

Here’s a Twitter conversation this afternoon between Jamison Foser and me:

Foser: Dumbest words in politics: “Optics,” “Gaffe,” “Hypocrisy.” (That latter one is a real thing, but misused to the point of meaninglessness.)

Drum: But “optics” is just short for “how this will look to others.” Nothing really wrong with that.

Foser: “Optics” = “I cannot articulate a substantive problem with this, so I’ll just suggest others won’t like it.” It’s a house of cards.

Drum: But don’t politicians routinely consider the optics of their actions? I mean really, genuinely, think about it. It’s a real thing.

Foser: Not sure why that means anyone should care, or how that validates 99% of use of word by reporters/operatives/pundits….And I’ve really, genuinely thought about it for a couple decades.

Drum: What word would you suggest instead? The concept itself is pretty ordinary.

Foser: I don’t think we need a word for “people might not like the Congressman’s cheesesteak order.” I think we need to shut up about it.

Drum: Hmmm. It’s a slow day. Maybe I’ll blog about this since I think my disagreement is more than 140 characters long.

Foser: Then here’s another angle: To the extent “optics” claims are about “analyzing” rather than sneakily influencing reactions, I find that pointless as well. “Here’s what I think people will think” is generally dull & unimportant.

Here’s the thing: like most anything, there are good uses of the word optics and dumb uses of the word optics. To the extent that it becomes an excuse for fatuous preoccupations with Al Gore’s earth tones or Hillary Clinton’s speaking fees, then yes, it’s dumb. The world would be a better place if campaign beat reporters spent a lot less time on this kind of soul-crushing imbecility.

But that’s not the only use of the word. As I mentioned in my first tweet—though see the note below for more about this—it’s also used as a shortcut for a specifically political meaning of “how something will look to other people.” And if you object to that, then you’re just railing against human nature. Unless you’re clinically autistic, obsessing with how our actions will appear to others is fundamental to the human condition. Ditto for obsessing with other people’s appearances.

That’s especially true for anyone in the sales and marketing business, where appearances are literally what the job is all about. And who’s more in the sales and marketing business than a politician? Sure, they have actual products—universal pre-K, cutting tax rates, whatever—but most people don’t buy their products based on a Brookings white paper outlining the pros and cons. They buy it based on how it fits into their worldview, and that in turn owes more to how it’s sold than to what’s actually being sold.

So when you try to figure out why, say, Marco Rubio’s immigration reform plan crashed and burned, you’re missing half the story if you only look at the details of his plan. If you’re covering a campaign, you’re missing half the story if you don’t report about how the campaign is trying to mold public perceptions. If you’re writing a history of the Iraq War, you’re missing half the story if you don’t spend time explaining the marketing campaign behind the whole thing. For better or worse, politicians spend a lot of time thinking about how various audiences—supporters, opponents, undecideds, pundits, members of Congress, the media—will react to their proposals, and they shape their messages accordingly. If you’re reporting on politics, you have to include that as part of the story, and optics is as good a word as any to describe it.

That said, we’d be better off if there were fewer dumb appeals to optics. If you’re going to talk about optics, it should be based on either (a) ground-level reporting about what someone’s political operation is actually doing, or (b) empirical data like poll numbers about how people react to things. If all you’re doing is inventing stuff that no one on the planet would have noticed if you hadn’t been hard up for column material, then you’re responsible for making us collectively stupider and giving optics a bad name. Knock it off.

FULL DISCLOSURE: I’ve defended the word optics against critics before, which suggests that in my mind I really do think it’s OK to use it:

When someone says “optics,” for example, I know that they’re talking not just about general appearances, but about how something plays in the media and how it plays with public opinion. Using the word optics also suggests that you’re referring to a highly-planned operation managed by media pros, not just some random event on the street.

On the other hand, I don’t actually use the word very much myself, which suggests that in my heart I agree with Foser more than I’m letting on.

A year and a half after California started forcing some big polluters to pay for pumping greenhouse gases into the atmosphere, households in the Golden State are about to start cashing in on the program.

The state’s cap-and-trade program has raised nearly $1.7 billion so far. About 40 percent of proceeds are earmarked to be spent on clean energy initiatives, while the rest will be distributed to small utility customers through various programs, helping offset any increase in electricity prices. Residential customers of the state’s investor-owned utilities, which together serve more than two-thirds of the state’s electricity, will receive the first California Climate Credits on this month’s electricity bills, reducing the amount due by roughly $30 to $40. The next residential credits will be paid out in October. Small business customers will receive them monthly.

California Public Utilities Commission President Michael Peevey said the credits will give “millions of Californians a stake in the fight for clean air and a healthy environment.” He suggested electricity customers reinvest the money in efficient lightbulbs, smart thermostats, and other energy-saving measures to further reduce costs and to join the fight against climate change.

The state’s motorists could end up seeing the minor cash infusion whittled away next year, when transportation fuels start to be included in the carbon-trading program. That could drive up the price of gas by about 12 cents a gallon.

Oil giant Chevron, which operates a huge, dirty, explosion-prone refinery in the poor Californian city of Richmond, is crying foul. Despite the company’s long-running efforts to overcome neighborhood opposition and secure permits needed to upgrade its Richmond refinery, a company exec recently claimed that the cap-and-trade program could force its closure. We call bullshit on that. But if it does happen, good bloody riddance, and don’t forget to take your filthy propaganda rag with you.
