The Coolest Thing on the Internet Is Moving to Canada

A year ago, Donald Trump said he would consider closing off parts of the internet.

“We’re losing a lot of people because of the internet, and we have to do something,” he told a crowd while campaigning at the U.S.S. Yorktown in South Carolina. “We have to go see Bill Gates and a lot of different people…about, maybe in certain areas, closing the internet up in some way. Somebody will say, ‘Oh, freedom of speech! Freedom of speech! These are foolish people…We’ve got to do something with the internet.”

A week later, during the CNN Republican presidential debate, Wolf Blitzer asked Trump if “closing the internet” might put the United States “in line with China and North Korea”—two countries known to censor the online world. Trump responded that groups like ISIS are using the web to take our “young impressionable youth” and that he “sure as hell doesn’t want to let people that want to kill us and kill our nation use our internet.”

So now, as Trump prepares to take office, a number of internet-freedom activists are worried he may make good on these campaign promises. They include Brewster Kahle, the founder of the San Francisco-based Internet Archive, one of the biggest online libraries in the world that curates 279 billion web pages, 2.9 million films and videos, 3.1 million recordings, and much more. Part of the Internet Archive is the Wayback Machine, a search engine for past incarnations of web pages, some of which are no longer accessible. In a FAQ posted to the Internet Archive blog last weekend, Kahle wrote that the Internet Archive had been planning a partial backup in Canada. But Trump’s statements on the campaign trail and his election as president “ramped us into higher gear, moving us further and faster than we would have. The election led us to think bigger.”

“On November 9th in America, we woke up to a new administration promising radical change,” Kahle wrote in a statement on November 29. “It was a firm reminder that institutions like ours, built for the long-term, need to design for change…It means preparing for a Web that may face greater restrictions.”

In an interview with Mother Jones, Kahle said that after the election, his staff went through the archives to see what Trump had said about the internet and freedom of speech. They found several instances of troubling talk from Trump in which he called for restricting parts of the internet and attacked the press for reporting on his behavior. When your business is to preserve a record of the internet as a historical record, a president who might restrict it is an existential threat.

“At this point it seemed prudent to at least take him at his word,” Kahle told Mother Jones. “If something goes down, and he said this was what he was going to do, shame on us.”

So instead of building out a partial backup of the entire Internet Archive in Canada, as they had originally planned, Kahle and his team are now moving forward with a full duplication of their work based in Canada. The group already has partial backups in Alexandria, Egypt, and Amsterdam, but Kahle says the $5 million Canadian project is designed to be not just a backup, but “another node in an international library system.”

In recent segment on The Rachel Maddow Show, Maddow described the Internet Archive as an invaluable tool for researchers, journalists, and everybody who wants to preserve history with reports and data that are only accessible through the Wayback Machine. Vice President-elect Mike Pence’s first congressional campaign platform document—that included a call for the government to shift AIDS research funding and put it toward curing people from being gay—can no longer be found through a Google search. Trump’s use of a government presidential transition web page to showcase his properties around the world was taken down shortly after it appeared but can still be accessed through the Wayback Machine.

Kahle said another example was a press release that came out during the George W. Bush administration after the famous speech he delivered under the “Mission Accomplished” banner, announcing that all combat operations in Iraq had ended. That release was soon amended before being pulled down altogether. But the Wayback Machine preserved the controversial moment for history.

“People remember that particular event,” Kahle said. “Having it switch from ‘Yeah, we’re done here,’ to ‘Well, we’re still there,’ and ‘Let’s not talk about that anymore,’ all happening with that one press release from WhiteHouse.gov I think is kind of a useful lesson in Orwellian editing.”

Giving the government the ability to access all communications is part of the general discussion of restricting what can and can’t be done online, and what is preserved for posterity. FBI Director James Comey has spoken aggressively in favor of limiting encryption technology and allowing the government “backdoors” into communications, and a bipartisan group of senators—including Dianne Feinstein (D-Calif.) and John McCain (R-Ariz.)—seem open to mandating government access to communications over phones or the internet. Trump himself has called for a boycott of Apple products after the company got into a very public fight with the FBI, when the FBI wanted Apple to write software to break its own iPhone encryption following the 2015 San Bernardino attack. To Kahle, this provides further impetus for complete backups of his archive in other countries.

“There’s a lot of laws that are put in place that have built the world that we have,” Kahle said. “And to the extent that those are going to be up for grabs, then we can end up with a very different world.”

The Trump transition team and his spokesperson, Hope Hicks, did not respond to questions about his policies toward free speech on the internet.

As The Ringer’s Alyssa Bereznak put it the day before the election, Trump’s mastery of social media aside, “he has shown little understanding of the infrastructure behind the online tools that have extended his reach.” He jokingly asked Russia to find Hillary Clinton’s 33,000 deleted emails and said he wished he “had the power” to hack the Democratic National Committee. And there’s also Trump’s alleged history of listening in on phone calls involving staff at Mar-A-Lago, an allegation Hicks denied when asked by BuzzFeed. As for weaponizing the internet via cyberwarfare, Trump has described the United States as “obsolete” and called for a ramping up of US government capabilities.

“The first thing to do is listen to what people say they want to do. And when they say things like they want to close up part of the internet…that sort of thing is a big change to how the internet structure could work,” Kahle said. “Who knows what will exactly happen, but we’re starting with his words.”

Obama Orders a Review of Russian Meddling in the US Election—But How Much of It Will Be Public?

President Barack Obama has added momentum to the call for an investigation of Russian meddling in the 2016 election. On Friday morning, Lisa Monaco, a top White House aide on homeland security, told a group of reporters that the president has directed the national intelligence community to conduct a “full review” of Russian interference in the campaign.

Obama’s decision comes as members of Congress have upped the volume on demands that the Russian hacking of Democratic targets be probed. Rep. Elijah Cummings (D-Md.), the top Democrat on the House government oversight committee, has urged Rep. Jason Chaffetz (R-Utah), the chairman of that committee, to mount a congressional investigation of Moscow’s intervention in the election. But Chaffetz, who prior to the election vowed to fiercely investigate Hillary Clinton should she win, has not responded to Cummings’ request, according to a Cummings spokeswoman. House Minority Leader Nancy Pelosi of California and incoming Senate Minority Leader Chuck Schumer of New York have seconded Cummings’ call for a congressional investigation.

This week, Sen. John McCain (R-Ariz.), who chairs the Senate Armed Services Committee, said he will mount a probe of Russian cyber penetrations of US weapons systems and noted that he expects this inquiry will also cover hacking related to the election. “The problem with hacking,” McCain said, “is that if they’re able to disrupt elections, then it’s a national security issue, obviously.” And the Washington Post reported that Sen. Bob Corker (R-Tenn.), the chair of the Senate Foreign Relations Committee, and Sen. Richard Burr (R-S.C.), chair of the Senate Intelligence Committee, have also expressed interest in examining the Russian hacking.

Meanwhile, a group of high-ranking House Democrats sent a letter to President Barack Obama requesting a classified briefing on Russian involvement in the election, and seven Democrats on the Senate Intelligence Committee publicly pressed the Obama administration to declassify more information about Russia’s intervention in the election. Republican Sens. Lindsey Graham and Marco Rubio have also urged a congressional investigation of Russian interference. “I’m going after Russia in every way you can go after Russia,” Graham told CNN. “I think they’re one of the most destabilizing influences on the world stage, I think they did interfere with our elections, and I want Putin personally to pay a price.”

Cummings has also joined with Rep. Eric Swalwell, (D-Calif.), a Democrat on the House Intelligence Committee, to introduce legislation to create a bipartisan commission to investigate attempts by the Russian government or persons in Russia to interfere with the election. The commission would consist of 12 members, equally divided between Democrats and Republicans, and would be granted subpoena power, the ability to hold public hearings, and the task of producing a public report.

And that’s the key thing: a public report.

With the Obama administration and its intelligence services having already declared that Russia hacked Democratic targets during the election and swiped material that was ultimately released through WikiLeaks, the public certainly deserves to know more about this operation. How did it happen? How has it been investigated by US agencies? How can future cyber interventions be prevented and future US elections secured from foreign influence?

The Obama-ordered probe is due before he leaves office on January 20, and it will likely be the first of all the possible investigations to be completed. (Presumably, the CIA, the FBI, and the National Security Agency were already looking into the topic.) But there’s no telling how much of this review, if any, will be released publicly. A White House spokesman tells Mother Jones, “Hard to say right now, but we’ll certainly intend to make public as much as we can consistent with the protection of classified sources and methods and any active law enforcement investigations.”

In response to the news of the Obama review, Rep. Adam Schiff (D-Calif.), the top member of the House Intelligence Committee, declared, “The Administration should work to declassify as much of it as possible, while protecting our sources and methods, and make it available to the public.”

Yet this review may or may not yield a public accounting. And a congressional investigation might or might not include public hearings and a public report. Only the independent bipartisan commission proposed by Cummings and Swalwell would mandate the release of a public report.

While all the recent developments on this front are heartening for citizens who want to know to what degree American democracy was affected by covert Russian actions, there is so far no assurance that Americans will be presented the full truth. For Obama’s review to be released publicly, it will likely have to be scrubbed for classified information—a process that can take time. And if time runs out, the new Trump administration might not be keen on putting out a declassified version of the report. President-elect Donald Trump has repeatedly refused to acknowledge Russian involvement with the hacking of the Democratic National Committee and other Democratic targets. Would he want to release a report that contradicted him or that could be seen as tainting his electoral victory?

Talking to reporters, Monaco declined to say what she expected the Obama-ordered review to unearth. “We’ll see what comes out of the report,” she said. “There will be a report to a range of stakeholders, including Congress.”

But the biggest stakeholder of all is the American voter.

UPDATE: On Friday night bombshell news reports noted that the CIA had assessed Russia intervened in the US election to help Trump win; that during the campaign senior congressional Republicans, including Senate majority leader Mitch McConnell, had resisted a private White House request to be part of a bipartisan effort to call out Russian hacking of Democratic and political targets; and that Moscow had penetrated the computer system of the Republican National Committee but had not publicly disseminated any of the stolen material.

How One Plan to Bring Undocumented Immigrants out of the Shadows Could Get Them Deported

Since 2015, California has issued about 800,000 licenses to drivers who lack proof of legal residence. In Illinois, more than 212,000 people have received what are known as temporary visitor driver’s licenses. Connecticut has approved around 26,000 drive-only licenses for undocumented immigrants, and nine more states plus the District of Columbia have similar programs.

To date, these initiatives have been widely hailed as a reasonable way to try to improve public safety, by helping make sure that everyone behind the wheel was a competent driver. But now, with the incoming Trump administration seemingly committed to deporting undocumented individuals, there is worry among immigration advocates that the identifying data collected as part of these programs—names, addresses, copies of foreign passports—could be used by federal authorities looking to send people back to their home countries.

Last month, Trump said he would deport or incarcerate as many as 3 million undocumented immigrants who have criminal records. A 10-point immigration plan on Trump’s transition website lists “zero tolerance for criminal aliens,” along with a promise to “ensure that other countries take their people back when we order them deported.” The plan also calls for blocking funding for so-called “sanctuary cities” that historically have limited their cooperation with federal immigration agents.

“The discussion up to this point has been hypothetical or theoretical, and now it’s feeling very real,” said Jonathan Blazer, advocacy and policy counsel for the ACLU. “People start to think, ‘Are things going to look completely different than they’ve ever looked before, in terms of what the federal government might try to do?'”

Nothing in federal law specifically entitles immigration agents access to state data on drivers who may be in the country illegally, according to Blazer. To get states to produce a list of these drivers, US Immigration and Customs Enforcement—which includes the federal government’s deportation arm—might have to rely on its administrative subpoena power. Even then, states could refuse to provide the information, thereby forcing the federal government to sue for the driver data or narrow its request, Blazer and other legal experts said.

“If ICE just came and said, ‘Hey, give me all your driving privilege card holders, ‘I would say, ‘No,’ and they would have to take some sort of different legal action that is beyond my control,” said Scott Vien, the director of Delaware’s Division of Motor Vehicles, which has so far issued about 3,500 driving credentials to undocumented immigrants. Some of the records they maintain include copies of birth certificates, foreign passports and consular identification cards.

Uncertainty already surrounds the fate of more than 700,000 undocumented immigrants who first arrived in the United States as children, and who obtained temporary reprieves from deportation through a 2012 executive action of President Barack Obama. In applying to the program, these individuals submitted all sorts of personal information to the federal government, including home addresses and the names of family members. Immigrants and their advocates now fear that this information could be turned over to federal immigration officials after Obama leaves office, for use in tracking down undocumented individuals.

Driving records, it is now clear, constitute another vast store of data on US residents who may not be residing in the country legally. In all, more than 1 million licenses meant for people without proof of legal immigration status have been issued across the country.

There have already been some instances of ICE seeking to get and use driver’s license information in bulk from states that do not have the special programs for the undocumented—New Jersey among them. In 2012, ICE’s Newark field office obtained from the New Jersey Motor Vehicle Commission a list of people who had applied for restricted licenses using valid but temporary immigration documents. An initial review “resulted in the identification of numerous foreign-born individuals who fall under ICE priorities,” according to an April 2012 letter from the field office director, who also requested that New Jersey continue to supply updated lists.

That same year, the Atlanta field office proposed gaining access to the names of foreign-born residents with temporary driver’s licenses, as well as lists of rejected license applications, as part of its efforts to achieve that year’s “criminal-alien removal target.” That DMV project was not implemented, according to an ICE official’s email from 2014, which was obtained through a Freedom of Information Act request by the National Immigration Law Center.

The Illinois secretary of state’s office has said it cannot guarantee the safety of temporary license applicants’ information from federal immigration authorities. If the office receives a “legally valid request” for information on license applicants who lack proof of legal residence, it will comply, according to an FAQ published by the state earlier this year.

“If ICE did come to us with a subpoena, we’d probably have to go and get a legal opinion, from the attorney general,” said Dave Druker, a spokesman for the Illinois secretary of state’s office. “It hasn’t happened yet.”

The state has had a problem with protecting applicant information before. About three years ago, an employee of the secretary of state’s office alerted ICE about an undocumented immigrant who had applied for a temporary license. The applicant was then apprehended upon showing up at a state office for an appointment in February 2014. Due in part to outcry from immigrant rights advocates following the incident, the state has said it will no longer proactively volunteer information to ICE about temporary license seekers, as long as they do not have any records of felony criminal activity or appear on any terrorism watch list.

“In order to find out the legality, someone needs to be willing to sue, and because of data sharing and how it operates, a lot of times it’s going to require a political actor to do that—a state, a locality,” said Mark Fleming, the national litigation coordinator for the National Immigrant Justice Center. “That’s often a political decision for a lot of elected officials.”

ICE already enjoys limited access to basic state driver’s license information through a law enforcement data exchange network called Nlets. However, the information ICE can see wouldn’t necessarily give away someone’s immigration status.

In California, any driver’s license information that the state makes available to law enforcement agencies through data-sharing systems does not indicate whether the driver provided evidence of legal immigration status, according to Artemio Armenta, a spokesman for the California Department of Motor Vehicles.

In the Illinois system, however, there’s a potential giveaway: Driver data for a regular license includes a Social Security number, whereas temporary license records will list a consular card or foreign passport number instead.

Other states that offer driving privileges to undocumented individuals include Colorado, Connecticut, Delaware, Hawaii, Maryland, New Mexico, Nevada, Utah, and Vermont. In Washington state, no resident has to provide evidence of legal presence or citizenship to obtain a standard license. Even so, many immigrants who lack proof of legal residence face a dilemma in deciding whether or not to take advantage of these programs and apply for driving credentials.

“People can’t be afraid to get the license that would enable them to learn the rules of the road and hold them accountable for driving,” said Tanya Broder, a senior staff attorney with the National Immigration Law Center. At the same time, “we’ve told people that if they’re at high risk, if they don’t want to be seen or found, that the DMV database makes them easier to find.”

Democrats Intensify Push for Probe of Russian Meddling in 2016 Campaign

Congressional Democrats are increasing the pressure for an official and public inquiry into Russian meddling in the 2016 campaign. On Wednesday afternoon, Rep. Eric Swalwell, (D-Calif.), a Democrat on the House intelligence committee, and Rep. Elijah Cummings (D-Md.), the senior Democrat on the House government oversight committee, announced they were introducing legislation to create a bipartisan commission to investigate any attempt by the Russian government or persons in Russia to interfere with the recent US election. The commission they propose is modeled on the widely praised 9/11 Commission. It would consist of 12 members, equally divided between Democrats and Republicans. The members would be appointed by the House speaker, the Senate majority leader, and the two Democratic leaders of the House and Senate. This commission would be granted subpoena power, the ability to hold public hearings, and the task of producing a public report.

Cummings previously called on Rep. Jason Chaffetz (R-Utah), the chair of the House government oversight committee, to launch such an investigation via his committee. But Chaffetz, who before the election vowed to probe Hillary Clinton fiercely, has not replied to Cummings’ request, according to a Cummings spokesperson. Nor has Chaffetz responded to another Cummings request for a committee examination of Donald Trump’s potential conflicts of interest. House Democratic leader Nancy Pelosi (Calif.) and incoming Senate Democratic leader Chuck Schumer (N.Y.) have both endorsed Cummings’ proposal for a congressional investigation of Russian attempts to influence the 2016 campaign. Republican Sens. Lindsey Graham (S.C.) and Marco Rubio (Fla.) also have suggested that Congress examine Russian interference in the election.

The Democrats have not yet catapulted the issue of foreign interference fully into the media spotlight. But Swalwell and Cummings’ bill comes as more Democrats are demanding action. Last week, seven Democrats on the Senate intelligence committee publicly pressed the Obama administration to declassify more information about Russia’s intervention in the election. Sen. Ron Wyden (D-Ore.), who led that effort, wrote in a brief letter to the White House, “We believe there is additional information concerning the Russian Government and the US election that should be declassified and released to the public. We are conveying specifics through classified channels.”

On Tuesday, seven high-ranking House Democrats sent a letter to President Barack Obama requesting a classified briefing on Russian involvement in the election, including “Russian entities’ hacking of American political organizations; hacking and strategic release of emails from campaign officials; the WikiLeaks disclosures; fake news stories produced and distributed with the intent to mislead American voters; and any other Russian or Russian-related interference or involvement in our recent election.” The signatories were Cummings, Rep. Steny Hoyer, the Democratic whip, Rep. John Conyers, the top Democrat on the judiciary committee, Rep. Eliot Engel, the top Democrat on the foreign affairs committee, Rep. Bennie Thompson, the top Democrat on the homeland security committee, Rep. Adam Smith, the top Democrat on the armed services committee, and Rep. Adam Schiff, the top Democrat on the intelligence committee. They wrote:

We are deeply concerned by Russian efforts to undermine, interfere with, and even influence the outcome of our recent election. This Russian malfeasance is not confined to us, but extends to our allies, our alliances and to democratic institutions around the world.

The integrity of democracy must never be in question, and we are gravely concerned that Russia may have succeeded in weakening Americans’ trust in our electoral institutions through their cyber activity, which may also include sponsoring disclosures through WikiLeaks and other venues, and the production and distribution of fake news stories.

In September, Schiff joined Sen. Dianne Feinstein (Calif.), the top Democrat on the Senate intelligence committee, to release a statement blaming Russia for the hacks of Democratic targets during the campaign:

Based on briefings we have received, we have concluded that the Russian intelligence agencies are making a serious and concerted effort to influence the US election. At the least, this effort is intended to sow doubt about the security of our election and may well be intended to influence the outcomes of the election—we can see no other rationale for the behavior of the Russians. We believe that orders for the Russian intelligence agencies to conduct such actions could come only from very senior levels of the Russian government.

The Obama administration has reached the same conclusion. In October, the Office of the Director of National Intelligence and the Department of Homeland Security released a joint statement declaring, “The US Intelligence Community (USIC) is confident that the Russian Government directed the recent compromises of e-mails from US persons and institutions, including from US political organizations.” A week after the election, the director of the National Security Agency, Admiral Michael Rogers, was asked about the WikiLeaks release of hacked information during the campaign, and he said, “This was a conscious effort by a nation-state to attempt to achieve a specific effect.” He added, “This was not something that was done casually. This was not something that was done by chance. This was not a target that was selected purely arbitrarily.”

For some reason, Moscow’s effort to influence the presidential election has not been as big a story as, say, Trump’s tweets about the musical Hamilton or Alec Baldwin. That may be because Democrats, busy licking their wounds, have not aggressively sought to keep the issue front and center. (Obama and Vice President Joe Biden have not said much on this subject.) And most Republicans have shown little interest in investigating an assault on American democracy that helped their party win the White House and retain majorities in both houses of Congress. But Cummings has been trying mightily to kick-start a public investigation. (Presumably, the FBI, CIA, and NSA have been looking into Russian hacking related to the election, but their investigations are not designed to yield public information—unless they result in a criminal prosecution.)

With the legislation to establish an independent commission, Cummings and Swalwell are opening another front. In the coming days, they will be signing up co-sponsors and looking for Republican support. Their bill provides a proposal that concerned voters—including upset Democrats and activists—can rally behind. (Were this measure to pass next year, Trump, who has steadfastly refused to blame Moscow for the hacks of the Democratic Party and the Clinton campaign, would have to decide whether to sign it.)

In his recent letter to Chaffetz, Cummings noted, “Elections are the bedrock of our nation’s democracy. Any attempt by a foreign power to undermine them is a direct attack on our core democratic values, and it should chill every Member of Congress and American—red or blue—to the core.” So far, few Republicans, including Trump, have acknowledged feeling that chill, and there’s certainly more opportunity for the Democrats to turn up the heat.

Trump Is Right: Our Generals Haven’t "Done the Job"

President-elect Donald Trump’s message for the nation’s senior military leadership is ambiguously unambiguous. Here is he on 60 Minutes just days after the election.

Trump: “We have some great generals. We have great generals.”

Lesley Stahl: “You said you knew more than the generals about ISIS.”

Trump: “Well, I’ll be honest with you, I probably do because look at the job they’ve done. Okay, look at the job they’ve done. They haven’t done the job.”

In reality, Trump, the former reality show host, knows next to nothing about ISIS—one of many gaps in his education that his impending encounter with actual reality is likely to fill. Yet when it comes to America’s generals, our president-to-be is onto something. No doubt our three- and four-star officers qualify as “great” in the sense that they mean well, work hard, and are altogether fine men and women. That they have not “done the job,” however, is indisputable—at least if their job is to bring America’s wars to a timely and successful conclusion.

Trump’s unhappy verdict—that the senior US military leadership doesn’t know how to win—applies in spades to the two principal conflicts of the post-9/11 era: the Afghanistan War (now in its 16th year) and the Iraq War, which was launched in 2003 and (after a brief hiatus) is once more grinding on. Yet the verdict applies equally to lesser theaters of conflict, largely overlooked by the American public, that in recent years have engaged the attention of US forces—a list that would include conflicts in Libya, Somalia, Syria, and Yemen.

Granted, our generals have demonstrated an impressive aptitude for moving pieces around on a dauntingly complex military chessboard. Brigades, battle groups, and squadrons shuttle in and out of various war zones, responding to the needs of the moment. The sheer immensity of the enterprise across the Greater Middle East and northern Africa—the sorties flown, munitions expended, the seamless deployment and redeployment of thousands of troops over thousands of miles, the vast stockpiles of material positioned, expended, and continuously resupplied—represents a staggering achievement. Measured by these or similar quantifiable outputs, America’s military has excelled. No other military establishment in history could have come close to duplicating the logistical feats being performed year in, year out by the armed forces of the United States.

Nor should we overlook the resulting body count. Since the autumn of 2001, something like 370,000 combatants and noncombatants have been killed in the various theaters of operations where US forces have been active. Although modest by 20th-century standards, this post-9/11 harvest of death is hardly trivial.

Yet in evaluating military operations, it’s a mistake to confuse how much with how well. Only rarely do the outcomes of armed conflicts turn on comparative statistics. Ultimately, the one measure of success that really matters involves achieving war’s political purposes. By that standard, victory requires not simply the defeat of the enemy, but accomplishing the nation’s stated war aims, and not just in part or temporarily but definitively. Anything less constitutes failure, not to mention utter waste for taxpayers, and for those called upon to fight, it constitutes cause for mourning.

By that standard, having been “at war” for virtually the entire 21st century, the United States military is still looking for its first win. And however strong the disinclination to concede that Donald Trump could be right about anything, his verdict on American generalship qualifies as apt.

That verdict brings to mind three questions. First, with Trump a rare exception, why have the recurring shortcomings of America’s military leadership largely escaped notice? Second, to what degree does faulty generalship suffice to explain why actual victory has proved so elusive? Third, to the extent that deficiencies at the top of the military hierarchy bear directly on the outcome of our wars, how might the generals improve their game?

As to the first question, the explanation is quite simple: During protracted wars, traditional standards for measuring generalship lose their salience. Without pertinent standards, there can be no accountability. Absent accountability, failings and weaknesses escape notice. Eventually, what you’ve become accustomed to seems tolerable. Twenty-first-century Americans inured to wars that never end have long since forgotten that bringing such conflicts to a prompt and successful conclusion once defined the very essence of what generals were expected to do.

Senior military officers were presumed to possess unique expertise in designing campaigns and directing engagements. Not found among mere civilians or even among soldiers of lesser rank, this expertise provided the rationale for conferring status and authority on generals.

In earlier eras, the very structure of wars provided a relatively straightforward mechanism for testing such claims to expertise. Events on the battlefield rendered harsh judgments, creating or destroying reputations with brutal efficiency. Back then, standards employed in evaluating generalship were clear-cut and uncompromising. Those who won battles earned fame, glory, and the gratitude of their countrymen. Those who lost battles got fired or were put out to pasture.

During the Civil War, for example, Abraham Lincoln did not need an advanced degree in strategic studies to conclude that Union generals like John Pope, Ambrose Burnside, and Joseph Hooker didn’t have what it took to defeat the Army of Northern Virginia. Humiliating defeats sustained by the Army of the Potomac at the Second Bull Run, Fredericksburg, and Chancellorsville made that obvious enough. Similarly, the victories Ulysses S. Grant and William T. Sherman gained at Shiloh, at Vicksburg, and in the Chattanooga campaign strongly suggested that here was the team to which the president could entrust the task of bringing the Confederacy to its knees.

Today, public drunkenness, petty corruption, or sexual shenanigans with a subordinate might land generals in hot water. But as long as they avoid egregious misbehavior, senior officers charged with prosecuting America’s wars are largely spared judgments of any sort. Trying hard is enough to get a passing grade.

With the country’s political leaders and public conditioned to conflicts seemingly destined to drag on for years, if not decades, no one expects the current general in chief in Iraq or Afghanistan to bring things to a successful conclusion. His job is merely to manage the situation until he passes it along to a successor, while duly adding to his collection of personal decorations and perhaps advancing his career.

Today, for example, Army General John Nicholson commands US and allied forces in Afghanistan. He’s only the latest in a long line of senior officers to preside over that war, beginning with General Tommy Franks in 2001 and continuing with Generals Mikolashek, Barno, Eikenberry, McNeill, McKiernan, McChrystal, Petraeus, Allen, Dunford, and Campbell. The title carried by these officers changed over time. So, too, did the specifics of their “mission” as Operation Enduring Freedom evolved into Operation Freedom’s Sentinel. Yet even as expectations slipped lower and lower, none of the commanders rotating through Kabul delivered. Not a single one has, in our president-elect’s concise formulation, “done the job.” Indeed, it’s increasingly difficult to know what that job is, apart from preventing the Taliban from quite literally toppling the government.

In Iraq, meanwhile, Army Lt. General Stephen Townsend currently serves as the—count ’em—ninth American to command US and coalition forces in that country since the George W. Bush administration ordered the invasion of 2003. The first in that line, (once again) General Tommy Franks, overthrew the Saddam Hussein regime and thereby broke Iraq. The next five, Generals Sanchez, Casey, Petraeus, Odierno, and Austin, labored for eight years to put it back together again.

At the end of 2011, President Obama declared that they had done just that and terminated the US military occupation. The Islamic State soon exposed Obama’s claim as specious when its militants put a US-trained Iraqi army to flight and annexed large swaths of Iraqi territory. Following in the footsteps of his immediate predecessors Generals James Terry and Sean MacFarland, General Townsend now shoulders the task of trying to restore Iraq’s status as a more or less genuinely sovereign state. He directs what the Pentagon calls Operation Inherent Resolve, dating from June 2014, the follow-on to Operation New Dawn (September 2010 to December 2011), which was itself the successor to Operation Iraqi Freedom (March 2003 to August 2010).

When and how Inherent Resolve will conclude is difficult to forecast. This much we can, however, say with some confidence: With the end nowhere in sight, General Townsend won’t be its last commander. Other generals are waiting in the wings with their own careers to polish. As in Kabul, the parade of US military commanders through Baghdad will continue.

For some readers, this listing of mostly forgotten names and dates may have a soporific effect. Yet it should also drive home Trump’s point. The United States may today have the world’s most powerful and capable military—so, at least, we are constantly told. Yet the record shows that it does not have a corps of senior officers who know how to translate capability into successful outcomes.

That brings us to the second question: Even if Commander in Chief Trump were somehow able to identify modern-day equivalents of Grant and Sherman to implement his war plans, secret or otherwise, would they deliver victory?

On that score, we would do well to entertain doubts. Although senior officers charged with running recent American wars have not exactly covered themselves in glory, it doesn’t follow that their shortcomings offer the sole or even a principal explanation for why those wars have yielded such disappointing results. The truth is that some wars aren’t winnable and shouldn’t be fought.

So, yes, Trump’s critique of American generalship possesses merit, but whether he knows it or not, the question truly demanding his attention as the incoming commander in chief isn’t “Who should I hire (or fire) to fight my wars?” Instead, far more urgent is, “Does further war promise to solve any of my problems?”

One mark of a successful business executive is knowing when to cut your losses. It’s also the mark of a successful statesman. Trump claims to be the former. Whether his putative business savvy will translate into the world of statecraft remains to be seen. Early signs are not promising.

As a candidate, Trump vowed to “defeat radical Islamic terrorism,” destroy ISIS, “decimate Al Qaeda,” and “starve funding for Iran-backed Hamas and Hezbollah.” Those promises imply a significant escalation of what Americans used to call the “global war on terrorism.”

Toward that end, the incoming administration may well revive some aspects of the George W. Bush playbook, including repopulating the military prison at Guantanamo Bay, Cuba, and “if it’s so important to the American people,” reinstituting torture. The Trump administration will at least consider re-imposing sanctions on countries like Iran. It may aggressively exploit the offensive potential of cyberweapons, betting that America’s cyberdefenses will hold.

Yet President Trump is also likely to double down on the use of conventional military force. In that regard, his promise to “quickly and decisively bomb the hell out of ISIS” offers a hint of what is to come. His appointment of the uber-hawkish Lt. General Michael Flynn as his national security adviser and his selection of retired Marine Corps General James (“Mad Dog”) Mattis as defense secretary suggest that he means what he says.

In sum, a Trump administration seems unlikely to reexamine the conviction that the problems roiling the Greater Middle East will someday, somehow yield to a US-imposed military solution. Indeed, in the face of massive evidence to the contrary, that conviction will deepen, with genuinely ironic implications for the Trump presidency.

In the immediate wake of 9/11, George W. Bush concocted a fantasy of American soldiers liberating oppressed Afghans and Iraqis and thereby “draining the swamp” that served to incubate anti-Western terrorism. The results were beyond disappointing, while the costs exacted in terms of lives and dollars squandered were painful indeed. Incrementally, with the passage of time, many Americans concluded that perhaps the swamp most in need of attention was not on the far side of the planet but much closer at hand—right in the imperial city nestled alongside the Potomac River.

To a very considerable extent, Trump defeated Hillary Clinton, the preferred candidate of the establishment, because he advertised himself as just the guy disgruntled Americans could count on to drain that swamp. Yet here’s what too few of those Americans appreciate, even today: War created the swamp in the first place. War empowers Washington. It centralizes. It provides a rationale for federal authorities to accumulate and exercise new powers. It makes government bigger and more intrusive. It lubricates the machinery of waste, fraud, and abuse that causes tens of billions of taxpayer dollars to vanish every year. When it comes to sustaining the swamp, nothing works better than war.

Were Trump really intent on draining that swamp—if he genuinely seeks to “Make America Great Again”— then he would extricate the United States from war. His liquidation of Trump University, which was to higher education what Freedom’s Sentinel and Inherent Resolve are to modern warfare, provides a potentially instructive precedent for how to proceed.

But don’t hold your breath. All signs indicate that, in one fashion or another, our combative next president will perpetuate the wars he’s inheriting. Trump may fancy that, as a veteran of Celebrity Apprentice (but not of military service), he possesses a special knack for spotting the next Grant or Sherman. But acting on that impulse will merely replenish the swamp in the Greater Middle East, along with the one in Washington. And soon enough, those who elected him with expectations of seeing the much-despised establishment dismantled will realize that they’ve been had.

Which brings us, finally, to that third question: To the extent that deficiencies at the top of the military hierarchy do affect the outcome of wars, what can be done to fix the problem?

The most expeditious approach: Purge all currently serving three- and four-star officers. Then, make a precondition for promotion to those ranks confinement in a reeducation camp run by Iraq and Afghanistan war amputees, with a curriculum designed by Veterans for Peace. Graduation should require each student to submit an essay reflecting on these words of wisdom from Grant himself: “There never was a time when, in my opinion, some way could not be found to prevent the drawing of the sword.”

True, such an approach may seem a bit draconian. But this is no time for half measures—as even Donald Trump may eventually recognize.

Clinton Campaign Says It Will Participate in Recount

Marc Elias, the lawyer for Hillary Clinton’s presidential campaign, announced Saturday that the Clinton campaign will participate in the election recount initiated by Green Party candidate Jill Stein in Wisconsin, Michigan, and Pennsylvania.

Elias, in a statement posted on Medium, wrote that the campaign has been quietly taken “steps in the last two weeks to rule in or out any possibility of outside interference in the vote tally in these critical battleground states,” including combing through election results looking for anomalies “that would suggest a hacked result” and consulting with analysts within and outside of the campaign “with backgrounds in politics, technology, and academia.”

“We believe we have an obligation to the more than 64 million Americans who cast ballots for Hillary Clinton to participate in ongoing proceedings to ensure that an accurate vote count will be reported,” Elias wrote.

On Tuesday, New York Magazine reported that computer scientist J. Alex Halderman and a colleague had found “persuasive evidence” that vote totals in Wisconsin, Michigan, and Pennsylvania could have been “manipulated or hacked.” In a subsequent post on Medium, Halderman wrote that his findings had been misrepresented, and that what he was calling for was a examination of paper ballots and voting machines in those states to see if a cyberattack could have changed any results. Stein subsequently launched a fundraising push that has netted more than $5 million in order to push for recounts, according to the Wall Street Journal. She has formally requested a recount in Wisconsin, and is preparing challenges in Pennsylvania and Michigan, according to the Journal.

In Saturday’s Medium post, Elias wrote:

Because we had not uncovered any actionable evidence of hacking or outside attempts to alter the voting technology, we had not planned to exercise this option ourselves, but now that a recount has been initiated in Wisconsin, we intend to participate in order to ensure the process proceeds in a manner that is fair to all sides. If Jill Stein follows through as she has promised and pursues recounts in Pennsylvania and Michigan, we will take the same approach in those states as well. We do so fully aware that the number of votes separating Donald Trump and Hillary Clinton in the closest of these states — Michigan — well exceeds the largest margin ever overcome in a recount. But regardless of the potential to change the outcome in any of the states, we feel it is important, on principle, to ensure our campaign is legally represented in any court proceedings and represented on the ground in order to monitor the recount process itself.

The campaign is grateful to all those who have expended time and effort to investigate various claims of abnormalities and irregularities. While that effort has not, in our view, resulted in evidence of manipulation of results, now that a recount is underway, we believe we have an obligation to the more than 64 million Americans who cast ballots for Hillary Clinton to participate in ongoing proceedings to ensure that an accurate vote count will be reported.

The NSA Chief Says Russia Hacked the 2016 Election. Congress Must Investigate.

Despite all the news being generated by the change of power underway in Washington, there is one story this week that deserves top priority: Russian interference in the 2016 presidential election. On Tuesday, the director of the National Security Agency, Admiral Michael Rogers, was asked about the WikiLeaks release of hacked information during the campaign, and he said, “This was a conscious effort by a nation-state to attempt to achieve a specific effect.” He added, “This was not something that was done casually. This was not something that was done by chance. This was not a target that was selected purely arbitrarily.”

This was a stunning statement that has echoed other remarks from senior US officials. He was saying that Russia directly intervened in the US election to obtain a desired end: presumably to undermine confidence in US elections or to elect Donald Trump—or both. Rogers was clearly accusing Vladimir Putin of meddling with American democracy. This is news worthy of bold and large front-page headlines—and investigation. Presumably intelligence and law enforcement agencies are robustly probing the hacking of political targets attributed to Russia. But there is another inquiry that is necessary: a full-fledged congressional investigation that holds public hearings and releases its findings to the citizenry.

If the FBI, CIA, and other intelligence agencies are digging into the Russian effort to affect US politics, there is no guarantee that what they uncover will be shared with the public. Intelligence investigations often remain secret for the obvious reasons: they involve classified information. And law enforcement investigations—which focus on whether crimes have been committed—are supposed to remain secret until they produce indictments. (And then only information pertinent to the prosecution of a case is released, though the feds might have collected much more.) The investigative activities of these agencies are not designed for public enlightenment or assurance. That’s the job of Congress.

When traumatic events and scandals that threaten the nation or its government have occurred—Pearl Harbor, Watergate, the Iran-contra affair, 9/11—Congress has conducted investigations and held hearings. The goal has been to unearth what went wrong and to allow the government and the public to evaluate their leaders and consider safeguards to prevent future calamities and misconduct. That is what is required now. If a foreign government has mucked about and undercut a presidential election, how can Americans be secure about the foundation of the nation and trust their own government? They need to know specifically what intervention occurred, what was investigated (and whether those investigations were conducted well), and what steps are being taken to prevent further intrusions.

There already is much smoke in the public realm: the hacking of the Democratic National Committee, the Democratic Congressional Campaign Committee, and John Podesta, the chairman of Hillary Clinton’s campaign. Also, Russian hackers reportedly targeted state election systems in Arizona and Illinois. Coincidentally or not, the Russian deputy foreign minister said after the election that Russian government officials had conferred with members of Trump’s campaign squad. (A former senior counterintelligence officer for a Western service sent memos to the FBI claiming that he had found evidence of a Russian intelligence operation to coopt and cultivate Trump.) And the DNC found evidence suggesting its Washington headquarters had been bugged—but there was no indication of who was the culprit. In his recent book, The Plot to Hack America, national security expert Malcolm Nance wrote, “Russia has perfected political warfare by using cyber assets to personally attack and neutralize political opponents…At some point Russia apparently decided to apply these tactics against the United States and so American democracy itself was hacked.”

Several House Democrats, led by Rep. Elijah Cummings, the ranking Democrat on the House Oversight Committee, have urged the FBI to investigate links between Trump’s team and Russia, and Senate Minority Leader Harry Reid has done the same. According to various news reports, Russia-related probes have been started by the FBI targeting Americans associated with the Trump campaign. One reportedly was focused on Carter Page, a businessman whom the Trump campaign identified as a Trump adviser, and another was focused on Paul Manafort, who served for a time as Trump’s campaign manager. (Page and Manafort have denied any wrongdoing; Manafort said no investigation was happening.)

Yet there is a huge difference between an FBI inquiry that proceeds behind the scenes (and that may or may not yield public information) and a full-blown congressional inquiry that includes open hearings and ends with a public report. So far, the only Capitol Hill legislator who has publicly called for such an endeavor is Sen. Lindsey Graham (R-S.C.). On Tuesday, Graham, who was harshly critical of Trump during the campaign, proposed that Congress hold hearings on “Russia’s misadventures throughout the world,” including the DNC hack. “Were they involved in cyberattacks that had a political component to it in our elections?” Graham said. He pushed Congress to find out.

The possibility that a foreign government covertly interfered with US elections to achieve a particular outcome is staggering and raises the most profound concerns about governance within the United States. An investigation into this matter should not be relegated to the secret corners of the FBI or the CIA. The public has the right to know if Putin or anyone else corrupted the political mechanisms of the nation. There already is reason to be suspicious. Without a thorough examination, there will be more cause to question American democracy.

NSA Chief: WikiLeaks Hacks of Democrats’ Emails Were a “Conscious Effort by a Nation-State”

The WikiLeaks release of internal emails from the Democratic National Committee and the Hillary Clinton campaign constituted a “conscious effort by a nation-state to attempt to achieve a specific effect,” the head of the National Security Agency said Tuesday.

“There shouldn’t be any doubt in anybody’s mind,” NSA Director Michael S. Rogers said in an interview with the Wall Street Journal on Tuesday. “This was not something that was done casually, this was not something that was done by chance. This was not a target that was selected purely arbitrarily.” Rogers acknowledged in October that Russians were behind the hacks.

News that the DNC had been compromised broke earlier this June, when hacker Guccifer 2.0 released a trove of documents containing campaign emails and memos—most notably emails implying that the committee favored Clinton over Sen. WikiLeaks also published thousands of emails from John Podesta, Clinton’s campaign chair. Though Russia was long suspected of being behind the hacks, US officials did not formally accuse the Russian government of orchestrating the cyber attacks until October. In November, just four days before the election, DNC officials told Mother Jones they had found evidence that the DNC headquarters may have been bugged and had submitted a report to the FBI.

In the near term, the Donald Trump shitshow is going to unfold on a daily basis as we learn who will be running things in the new administration. The bad news starts at the top: Mike Pence is replacing Chris Christie as head of Trump’s transition team. Christie may be an intolerable prick, but he’s not a conservative ideologue and might have played a slightly calming role. Pence is nothing of the sort. He’s a stone right winger who will be perfectly happy to put the Heritage Foundation in control of the country.

As for the lower-level folks, it turns out that Trump doesn’t hate lobbyists all that much after all. That whole “Drain the Swamp” thing was just red meat for the rubes. The Associated Press reports that far from hating lobbyists, Trump absolutely adores them. Here’s the Trump transition team:
