Trump is sneaking environmental rollbacks past a nation in quarantine

In the weeks since the novel coronavirus began its exponential spread across America, schools have closed; churches, synagogues, and mosques have canceled services; and non-essential businesses have shuttered. The U.S. economy has ground to a halt. But the Trump administration and some state governments are still going full steam ahead on rolling back environmental protections.

So what’s been happening while we’ve been sheltering in place? A whole lot. “Consistent” isn’t generally a word used to describe this president, but Trump has been nothing if not consistent in his commitment to ensuring unfettered freedom for big polluters.

On Tuesday, Trump’s Environmental Protection Agency put the nail in the coffin of President Obama’s 2012 rule aimed at curbing auto emissions. That rule would have required automakers to improve the fuel economy standards of their cars and light fleet trucks to by 5 percent on average a year. Trump’s new rule will only require them to raise those standards by 1.5 percent annually. For an idea of how easy Trump has made life for automakers, the industry has said it would boost standards 2.4 per year sans regulation.

Trump says the Safer Affordable Fuel-Efficient Vehicles rule will make new cars cheaper and bolster auto manufacturers in the midst of the coronavirus pandemic. But loosening restrictions on automakers will lead to a billion more tons of carbon dioxide emitted and 80 billion more gallons of gasoline consumed cars over the course of their lifetimes. California is currently in a courtroom tussle with the EPA over a waiver that would allow the state to sidestep Trump’s rule and continue imposing stricter tailpipe emissions rules on vehicles driven in its jurisdiction.

Speaking of the EPA, the agency, helmed by former coal lobbyist Andrew Wheeler, is steadily moving forward with other rollbacks. Among them, a rule that could hobble future federal health regulations by limiting the studies regulators can use in the rulemaking process. Wheeler says the agency’s new rule to require disclosure of the raw data behind scientific studies used by the government to make regulations will increase transparency. Health experts argue it’ll exclude key studies that rely on confidential medical data.

Not content to move ahead with rollbacks that were already in the works, the EPA is also using the coronavirus as an excuse to let polluters loose on the playground. Last week, the agency announced it was going to let facilities like power plants and factories regulate themselves during the pandemic. The EPA will not issue fines for some air, water, and hazardous waste violations, and that loosening of restrictions will take retroactive effect going back to March 13. Companies should “act responsibly,” according to the EPA. Fat chance.

At the Department of the Interior, a similar saga is playing out. Last week, the department refused to extend the public comment period on its proposed reinterpretation of the Migratory Bird Treaty Act, a 1918 rule protecting more than 800 avian species. The agency also kept moving along plans this month to consider drilling projects on previously protected lands in Alaska and New Mexico, and is continuing oil and gas drilling lease auctions apace.

States are getting in on the deregulatory action, too. Over the past two weeks, Kentucky, South Dakota, and West Virginia quietly passed laws that would penalize pipeline protesters. Under the new state laws, fossil fuel infrastructure like the Dakota Access Pipeline are designated “critical infrastructure” or “key infrastructure assets.” Causing damage above a certain dollar amount or tampering with those assets could now lead to felony charges.

Meanwhile, the governors of New Hampshire, Massachusetts, and Illinois have already temporarily banned or officially discouraged reusable bags in grocery stores, and Maine’s plastic bag ban is being postponed until January 2021. Republican officials arguing against efforts to limit plastic pollution are taking talking points from the plastics industry. The president of the Plastic Industries Association recently said, “As the coronavirus spreads across the country, single-use plastics will only become more vital.” But the science behind the assertion that plastic bags spread the virus is thin, and a recent study showed the virus is still viable on plastic surfaces after 72 hours.

It’s clear that the coronavirus crisis has handed Trump and conservative state lawmakers a once-in-a-lifetime opportunity to do away with environmental protections they find too burdensome. Too bad social distancing isn’t effective for pollution.

Sprint Update: 5,000 New Jobs, But They Still Don’t Know What They’re For

Last April, Sprint announced that it planned to hire 5,000 workers to deliver cell phones to customers at their homes. A few days ago it announced it would be hiring 5,000 new workers for…something. I surmised that these were actually the same 5,000 workers, and Sprint wasn’t doing anything new. But apparently I was wrong. Max Ehrenfreund reports:

Representatives of Sprint have said the company will create positions for about 5,000 more people in the United States, counting both new employees and workers at Sprint’s contractors.

….Spokesman David Tovar said that the new positions would be in addition to Sprint’s previously announced plans to expand its presence on the street with 2,500 new stores and a fleet of vehicles for delivering phones. However, he added, the company has not yet determined exactly what the new workers will do or how many of them will work for Sprint as opposed to contractors.

Well…OK. But this is damn peculiar. We’re going to hire 5,000 new people, but we don’t really know what they’re going to do. What kind of company does something like that? It’s nuts. But they do know that a bunch of them will work for contractors. How do they know that? It’s all very mysterious. But I guess Masayoshi Son wanted to suck up to Donald Trump, so he sent down word to hire 5,000 people and find something for them to do. Welcome to free enterprise, Trump style.

How One Plan to Bring Undocumented Immigrants out of the Shadows Could Get Them Deported

Since 2015, California has issued about 800,000 licenses to drivers who lack proof of legal residence. In Illinois, more than 212,000 people have received what are known as temporary visitor driver’s licenses. Connecticut has approved around 26,000 drive-only licenses for undocumented immigrants, and nine more states plus the District of Columbia have similar programs.

To date, these initiatives have been widely hailed as a reasonable way to try to improve public safety, by helping make sure that everyone behind the wheel was a competent driver. But now, with the incoming Trump administration seemingly committed to deporting undocumented individuals, there is worry among immigration advocates that the identifying data collected as part of these programs—names, addresses, copies of foreign passports—could be used by federal authorities looking to send people back to their home countries.

Last month, Trump said he would deport or incarcerate as many as 3 million undocumented immigrants who have criminal records. A 10-point immigration plan on Trump’s transition website lists “zero tolerance for criminal aliens,” along with a promise to “ensure that other countries take their people back when we order them deported.” The plan also calls for blocking funding for so-called “sanctuary cities” that historically have limited their cooperation with federal immigration agents.

“The discussion up to this point has been hypothetical or theoretical, and now it’s feeling very real,” said Jonathan Blazer, advocacy and policy counsel for the ACLU. “People start to think, ‘Are things going to look completely different than they’ve ever looked before, in terms of what the federal government might try to do?'”

Nothing in federal law specifically entitles immigration agents access to state data on drivers who may be in the country illegally, according to Blazer. To get states to produce a list of these drivers, US Immigration and Customs Enforcement—which includes the federal government’s deportation arm—might have to rely on its administrative subpoena power. Even then, states could refuse to provide the information, thereby forcing the federal government to sue for the driver data or narrow its request, Blazer and other legal experts said.

“If ICE just came and said, ‘Hey, give me all your driving privilege card holders, ‘I would say, ‘No,’ and they would have to take some sort of different legal action that is beyond my control,” said Scott Vien, the director of Delaware’s Division of Motor Vehicles, which has so far issued about 3,500 driving credentials to undocumented immigrants. Some of the records they maintain include copies of birth certificates, foreign passports and consular identification cards.

Uncertainty already surrounds the fate of more than 700,000 undocumented immigrants who first arrived in the United States as children, and who obtained temporary reprieves from deportation through a 2012 executive action of President Barack Obama. In applying to the program, these individuals submitted all sorts of personal information to the federal government, including home addresses and the names of family members. Immigrants and their advocates now fear that this information could be turned over to federal immigration officials after Obama leaves office, for use in tracking down undocumented individuals.

Driving records, it is now clear, constitute another vast store of data on US residents who may not be residing in the country legally. In all, more than 1 million licenses meant for people without proof of legal immigration status have been issued across the country.

There have already been some instances of ICE seeking to get and use driver’s license information in bulk from states that do not have the special programs for the undocumented—New Jersey among them. In 2012, ICE’s Newark field office obtained from the New Jersey Motor Vehicle Commission a list of people who had applied for restricted licenses using valid but temporary immigration documents. An initial review “resulted in the identification of numerous foreign-born individuals who fall under ICE priorities,” according to an April 2012 letter from the field office director, who also requested that New Jersey continue to supply updated lists.

That same year, the Atlanta field office proposed gaining access to the names of foreign-born residents with temporary driver’s licenses, as well as lists of rejected license applications, as part of its efforts to achieve that year’s “criminal-alien removal target.” That DMV project was not implemented, according to an ICE official’s email from 2014, which was obtained through a Freedom of Information Act request by the National Immigration Law Center.

The Illinois secretary of state’s office has said it cannot guarantee the safety of temporary license applicants’ information from federal immigration authorities. If the office receives a “legally valid request” for information on license applicants who lack proof of legal residence, it will comply, according to an FAQ published by the state earlier this year.

“If ICE did come to us with a subpoena, we’d probably have to go and get a legal opinion, from the attorney general,” said Dave Druker, a spokesman for the Illinois secretary of state’s office. “It hasn’t happened yet.”

The state has had a problem with protecting applicant information before. About three years ago, an employee of the secretary of state’s office alerted ICE about an undocumented immigrant who had applied for a temporary license. The applicant was then apprehended upon showing up at a state office for an appointment in February 2014. Due in part to outcry from immigrant rights advocates following the incident, the state has said it will no longer proactively volunteer information to ICE about temporary license seekers, as long as they do not have any records of felony criminal activity or appear on any terrorism watch list.

“In order to find out the legality, someone needs to be willing to sue, and because of data sharing and how it operates, a lot of times it’s going to require a political actor to do that—a state, a locality,” said Mark Fleming, the national litigation coordinator for the National Immigrant Justice Center. “That’s often a political decision for a lot of elected officials.”

ICE already enjoys limited access to basic state driver’s license information through a law enforcement data exchange network called Nlets. However, the information ICE can see wouldn’t necessarily give away someone’s immigration status.

In California, any driver’s license information that the state makes available to law enforcement agencies through data-sharing systems does not indicate whether the driver provided evidence of legal immigration status, according to Artemio Armenta, a spokesman for the California Department of Motor Vehicles.

In the Illinois system, however, there’s a potential giveaway: Driver data for a regular license includes a Social Security number, whereas temporary license records will list a consular card or foreign passport number instead.

Other states that offer driving privileges to undocumented individuals include Colorado, Connecticut, Delaware, Hawaii, Maryland, New Mexico, Nevada, Utah, and Vermont. In Washington state, no resident has to provide evidence of legal presence or citizenship to obtain a standard license. Even so, many immigrants who lack proof of legal residence face a dilemma in deciding whether or not to take advantage of these programs and apply for driving credentials.

“People can’t be afraid to get the license that would enable them to learn the rules of the road and hold them accountable for driving,” said Tanya Broder, a senior staff attorney with the National Immigration Law Center. At the same time, “we’ve told people that if they’re at high risk, if they don’t want to be seen or found, that the DMV database makes them easier to find.”

Today in break the internet news, the new Tesla P85D — an all-wheel drive version of the Model S — scored a 103 out of 100 in a Consumer Reports evaluation. For those of you keeping track, that’s an improper fraction. (And for those of you who really don’t have anything to do, it’s an improper fraction with a prime number in the numerator, so you can’t even reduce it to something more palatable.) Which is to say the new Model S is so good that Consumer Reports doesn’t even have the numbers to describe it.

What do you do when you’ve shown your metric to be incapable of capturing what you’re trying to measure? If you were Consumer Reports, perhaps you’d change the scale so the P85D scored a perfect 100. Which is what they did. Turns out these kinds of procedural tweaks can be pretty straightforward when we admit that everything is arbitrary and original intent can be outdated. (If only it was so easy to apply this logic to, say, the Second Amendment.) Bloomberg Business has the story:

“This is a glimpse into what we can expect down the line, where we have cars with the performance of supercars and the comfort, convenience and safety features of a luxury car while still being extremely energy efficient,” Jake Fisher, the magazine’s head of automotive testing, said in an interview. “We haven’t seen all those things before.”

Based on the P85D’s scores, Consumer Reports had to reassess how much to weigh things like acceleration, where the Tesla is as much as twice as quick as other vehicles, Fisher said.

“Once you start getting so ridiculously fast, so ridiculously energy efficient, it didn’t make sense to go linear on those terms anymore,” he said.

The P85D — which has a starting price of $105,000 — is capable of hitting 60 mph in 3.5 seconds from stop. Which is pretty impressive for something with zero emissions. Or, you know, emissions that aren’t immediately obvious. All that electricity has to come from somewhere.

Three cheers for Tesla and its electrifying CEO Mr. Musk, though. Record breaking is often cause for celebration. Just wait ’til that Jetsons car hits the market.

Air pollution is about as romantic as wilted flowers, chapped lips, and corked wine, so the record-setting smog that has settled over the City of Love in the past few days is definitely dampening the mood.

Unseasonably warm weather has triggered unprecedented air pollution levels in Paris. Over the weekend, the city responded by offering free public transportation and bike sharing. (Similar measures were taken throughout nearby Belguim, which also reduced speed limits.) But that wasn’t enough to fix the problem, so Paris and 22 surrounding areas are taking more extreme steps, banning nearly half of vehicles from their roads.

Private cars and motorcycles with even registration numbers will be barred from the streets on Monday. Unless the air quality improves quickly and dramatically, odd registration numbers will be banned from the roads on Tuesday. Electric vehicles and hybrids will be exempted, as will any cars carrying at least three people. About 700 police officers will be stationed at checkpoints, handing out $31 (€22) fines to violators.

Agence France-Presse reports that Paris has tried the approach before:

Ecology Minister Philippe Martin said he understood the “difficulties, the irritation and even anger” over the move, adding: “But we just had to take this decision.”

Martin said similar measures in 1997 “had yielded results”, adding that he hoped that the number of vehicles on the roads would be “significantly lower” on Monday, without giving a figure.

Trains and buses will remain free while the car restrictions are in place, giving Parisians yet more public places where they can nuzzle and talk excitedly about government policies until the ugly smog burns off.

According to the website’s rather garbled recounting of Islamic tradition, the clothing reflects “the rationale behind the traditional hijab and burqa,” acting as a veil to separate women from God—only in this case, “replacing God with drone.”

Better Place, an electric car startup backed by $850 million in private funding, has filed for bankruptcy. The company aimed to have 100,000 electric vehicles on the road in Israel and Denmark by 2010, but had deployed fewer than 1,000 of the Renault Fluence Z.E. cars in Israel and just 200 in Denmark to date. IEEE Spectrum reports:

Better Place’s bankruptcy filing this last weekend is a blow not merely to the company itself and its influential backers, but to the vision of an electrified automotive future. This is because Better Place had what seemed an extremely persuasive business model and a sensible plan for developing the plan in the marketplace.

Israel and Denmark were the first testing grounds, and Better Place had already built 21 battery swapping stations in Israel, which is about the size of New Jersey. With Israel’s small size, high gas prices and start-up friendly atmosphere, the country seemed like the perfect testing grounds for introducing Better Place, the New York Times writes. But while Better Place did contend with some delays, ultimately it seems that people simply were not interested in buying the cars.

The company filed for liquidation on Sunday, citing financial difficulties. Better Place’s chief executive, Dan Cohen, spoke with the Times

Mr. Cohen said on Sunday that the vision and the model had been right, but that the pace of market penetration had not lived up to expectations. Without a large injection of cash, he said, Better Place was unable to continue its operations.

Meanwhile, Fisker Automotive, another significant player in electric car ventures that received significant U.S. federal backing, appears to be on the edge of collapse. The Times reports, in a separate story:

On the surface, Fisker had all the trappings of a potential player in the emerging electric car industry.

Serious problems emerged almost as soon as the car hit the market.

Fisker, with its technical problems, management turmoil and mounting losses, offers a cautionary tale in the fiercely competitive arena of alternative-fuel vehicles and of government subsidies for start-up businesses.

Bankruptcy now appears unavoidable, and a political reckoning is coming.

Not every electric car is crashing, however. Tesla, whose Model S won MotorTrend’s 2013 Car of the Year award, continues to shine. The company recently paid off its Department of Energy loans nearly 10 years early, had its first profitable quarter and is enjoying skyrocketing stock prices.

America passed a milestone on Monday, according to electric-vehicle advocacy group Plug-In America. That’s when the 100,000th EV was sold in the U.S., the group estimates.

Based on the average US household size, this means that over a quarter million people are now being exposed regularly to the benefits of electric transportation.  The vehicles themselves are reaching an even greater number of people simply by being on the road — perhaps as many as 1 million or more people per day. While much work remains to be done, 100,000 vehicles means that we are ever closer to the tipping point for electric transportation.

And like an EV driver who passes a gas station — and just keeps on driving — the nation is expected to sail past this milestone and keep on snapping up ever more of these clean-running cars. From Treehugger:

In 2011, the first full year with the current crop of plug-ins on the market, fewer than 20,000 were sold. In 2012, that number tripled to over 50,000. And it’s currently expected that more than 100,000 plug-ins will be sold in 2013 alone. Not a bad growth rate for a technology that is still maturing (like personal computers in the 1980s or cellphones in the 1990s).

How good is business for the nation’s electric-auto makers and sellers? A press release from Plug-In America says that the all-electric Nissan Leaf has been outselling all other Nissan models in some markets this year, and that Tesla’s Model S sedan is outselling the Mercedes-Benz S-Class, the BMW 7 series, and the Audi A8. That’s about Tesla repaying a federal loan nine years before it comes due. From Bloomberg:

Loans for Tesla, Ford, Nissan and Fisker were all awarded from a program created under President George W. Bush in 2007 and implemented by President Barack Obama in 2009.

Tesla plans to use $452.4 million to pay off its Advanced Technology Vehicles Manufacturing loan, with interest, the company said in a statement. … Based on the $25.4 million already paid to the Energy Department, taxpayers may see as much as a $12.8 million profit, based on company filings.

Despite some major hiccups, the electric-vehicle industry is now really starting to rev its engines.
