Bernie Sanders inspired the Sunrise Movement, now has its endorsement

Sunrise Movement, the group of young climate activists who helped catapult the Green New Deal onto the national stage last year, is feeling the Bern. The organization used its oodles of Gen Z social capital to endorse Senator Bernie Sanders for president on Thursday.

In a statement, Varshini Prakash, the group’s executive director, said she believes a Sanders presidency “would provide the best political terrain” for Sunrise to accomplish its mission of enacting a Green New Deal. It’s no surprise that an organization founded by young adults inspired by Sanders’ presidential run in 2016 would throw its support behind the candidate. But the results of a survey of thousands of the group’s members, published Thursday, made it clear that the group is united behind the Vermont Senator.

Sunrise, which is comprised of a national leadership team and a series of autonomous “hubs” located across the country, started the process of endorsing a candidate last November. The six-week-long undertaking allowed the group’s 10,000 members to cast votes on two questions: should Sunrise endorse a candidate, and who should that candidate be? Eighty-five percent of its members voted in favor of endorsing, and 76 percent voted in favor of Sanders — a decisive victory by any measure. Senator Elizabeth Warren got 17.4 percent of the vote, and the remainder was split primarily among Pete Buttigieg, Andrew Yang, and “no preference.”

Sanders, who was the first candidate to unveil a climate change proposal actually called the Green New Deal, said on Thursday he was “honored” to receive Sunrise’s support. But he’s not the only candidate with a vision for a progressive climate action plan. Warren also has a plan called the Green New Deal and has been endorsed by one of the architects of Congress’s Green New Deal resolution, and all of the Democrats running for president have said they support the general idea of a Green New Deal. “I’m grateful for @SunriseMvmt’s leadership in this fight,” Warren, who clearly is not a sore loser, wrote on Twitter shortly after the group announced its endorsement of Sanders.

Regardless of how committed other candidates say they are to progressive proposals like the Green New Deal, Sanders’ seniority on these issues has made him a magnet for endorsements from progressive groups like Dream Defenders and People’s Action. Most importantly perhaps for the young members of Sunrise Movement, Representative Alexandria Ocasio-Cortez, cosponsor of the Green New Deal resolution that was introduced in the House and rejected by the Senate last year, endorsed him in October.

Why did Lindsey Graham join a climate group?

Congress has long been a place where climate policy goes to die. That could soon change, and not only because there’s an election coming up in less than a year.

A new bipartisan climate caucus has formed in the Senate. It’s similar to a climate caucus in the House that’s been around since 2016: There must be one Republican for every Democrat who joins, and the group aims to educate members on policy and, ideally, propose pathways to action. But the House version has run into some serious roadblocks: it lost a chunk of its right flank in the 2018 midterm election, and it’s having trouble recruiting enough Republican members for the many Democrats who wish to join.

In the few weeks since it’s been up and running, the caucus in the upper chamber has had no difficulty attracting high-profile GOP members. Senators Mitt Romney, Lisa Murkowski, and Marco Rubio are among the Republicans who have joined the group. Surprisingly, so has South Carolina’s Lindsey Graham, one of President Trump’s staunchest supporters.

“I believe climate change is real,” Graham said in a statement. “I also believe that we as Americans have the ability to come up with climate change solutions that can benefit our economy and our way of life.”

That sounds like the Lindsey Graham of yore, who was more centrist than firebrand. In 2009, Graham teamed up with Democratic Senator John Kerry to push for climate legislation in the Senate. In 2015, he garnered praise for being one of only two Republican presidential contenders who had a history of engaging with climate and environment issues. In 2017, he urged President Trump to stay in the Paris climate accord, arguing that the leader of the Republican Party should not break with the rest of the world on an issue supported by sound science.

In the two years since he disagreed with Trump on the Paris Agreement, an unearthly transformation has transpired: Graham devolved from independent lone wolf to White House lapdog so rapidly that researchers were forced to reevaluate Charles Darwin’s seminal theory. Graham’s sudden zeal for defending the actions of the Commander in Chief — a man he once called “unfit for office” — inspired him to do things like go on Trump’s favorite Fox News show to compliment the president’s golf game. “To every Republican, if you don’t stand behind this President, we’re not going to stand behind you,” he said in South Carolina in February.

Given Trump’s aversion to climate science and working with Democrats, Graham’s decision to join a bipartisan climate solutions caucus is odd. Is Graham reverting to his old centrist ways? Or is there a more cynical explanation for his presence on the caucus?

It’s possible — in the sense that almost anything is possible — that Graham genuinely wants to reach across the aisle to take action on climate change. His recent voting record on the environment is surprisingly strong, by Republican standards. So far in 2019, he has cast five pro-environment votes, according to the League of Conservation Voters, a political group that keeps track of how members of Congress vote on environmental policy. That’s a far better record than other Republican members of the caucus, like Romney and Rubio, who only cast one pro-environment vote this year each.

But there’s another potential explanation, one that’s more in line with the partisan choices Graham has made in the past couple of years of the Trump administration. Perhaps Graham joined the caucus not to work with Democrats, but to stymie them. His motivation might be to ensure that other lawmakers decide to adopt a conservative vision of climate action, instead of something like the Green New Deal.

“If the only thing out there is the Green New Deal, well, the American people will take it,” Bob Inglis, former U.S. representative from Graham’s home state of South Carolina, told Grist. “You’ve got to get out there with an alternative. That’s what Republicans are doing, they’ve figured out how to enter the competition of ideas and present an alternative.”

Whether Graham and his fellow GOP-ers use the caucus as an opportunity to push for meaningful alternatives to progressive climate change solutions remains to be seen. The American Petroleum Institute, a group that has a long history of successfully lobbying against environmental regulations, called the caucus a “promising addition to the national conversation,” something that has climate activists on edge.

But activists would do well to remember that the new Lindsey Graham is in the habit of doing whatever is politically expedient. The South Carolinian may have sensed that denial may not serve the GOP much longer.

Killing California car pollution rules could kill speed limits

If you want to upend a half-century of legal tradition, you better have a damn-solid argument to justify your move. Especially if it’s a legal move so broad that it could nullify local speed limits.

President Donald Trump is attempting a tectonic upheaval of precedent by telling California it can’t set its own rules for the greenhouse gases coming out of cars. The administration’s rationale is so broad, according to one law professor, that it would wipe out a lot more than the state’s ability to set its own standards. It could also outlaw state gas taxes, city speed limits, and various other local rules. If courts agree, the Trump administration’s case would lead to a tremendous shift of power from state and local governments to Washington.

“Their interpretation is just so broad, and so lacking in any limiting principles, that I couldn’t determine why even the most silly example wouldn’t apply,” said Greg Dotson, an assistant professor at the University of Oregon School of Law, who wrote a paper examining the administration’s argument.

Since the late 1960s, California has been setting car-pollution rules that go beyond the federal standards, and, until recently, the federal government has endorsed that as a reasonable way for state governments to deal with their own unique situations. It all started because California had more cars and more smog than other states.

But now the Trump Administration is trying to change all that, basing its argument on a line from the Energy Policy and Conservation Act of 1975, which covers federal fuel economy standards. The relevant part:

“no State or political subdivision of a State shall have authority to adopt or enforce any law or regulation relating to fuel economy standards or average fuel economy standards applicable to automobiles covered by such Federal standard.”

On its face, that seems pretty cut and dry. If there’s a federal gas mileage standard, states and cities can’t mess with it. But if that’s the right interpretation, Dotson notes, there’s a ton of laws “relating to fuel economy standards” that would be in deep trouble. Gas taxes and speed limits affect vehicles’ fuel economy more than California’s greenhouse gas rules, as do local laws like bans on idling cars (which exist in nine states and many cities), and rules on the speed you can go when towing a trailer.

“Would anyone expect or want some 50-year-old law to pre-empt every state gas tax?” Dotson asked. “It’s goofy.”

There’s a lot more legalese to the administration’s argument, but that line from the Energy Policy and Conservation Act is the foundation, said Caitlin McCoy a fellow at Harvard Law School’s Environmental and Energy Law Program.

“It’s everything,” McCoy said. “And it’s indicative of the strategy that the Trump administration has employed on environmental issues, looking for limiting principles in the underlying statutes so they can achieve the biggest cuts to authority.”

And it’s not like the Trump White House is strictly interested in slashing state authority. It argued on the side of state’s rights when fighting the Clean Power Plan, McCoy said.

California and 22 other states have already sued the Trump administration in federal court to stop the move. That means the courts will decide whether there’s any good reason to let states keep the power to set their own rules. If you want a preview of how this might play out in court, it’s worth looking at the last attempt to take away the rights of states to regulate car emissions. In 2007, President George W. Bush’s administration tried to strip California’s authority to regulate greenhouse gas pollution from cars. But the Bush administration wasn’t exactly enthusiastic about pursuing the case. As Dotson wrote, a lawyer from the EPA explained that “After review of the docket and precedent, we don’t believe there are any good arguments against granting the waiver [allowing California to regulate greenhouse gases]. All of the arguments . . . are likely to lose in court if we are sued.”

But we never saw that put to the test. When President Barack Obama came into office in 2009, he granted California’s authority to make its own rules, putting off the fight until now.
