President Obama Takes on Overtime Rules

President Obama this week will seek to force American businesses to pay more overtime to millions of workers, the latest move by his administration to confront corporations that have had soaring profits even as wages have stagnated….Mr. Obama’s decision to use his executive authority to change the nation’s overtime rules is likely to be seen as a challenge to Republicans in Congress, who have already blocked most of the president’s economic agenda and have said they intend to fight his proposal to raise the federal minimum wage to $10.10 per hour from $7.25.

This is obviously just the latest in Obama’s long series of Constitution-crushing moves that flout the law and turn the president into a despot-in-chief, gleefully kneecapping Congress and — wait. What’s this?

In 2004, business groups persuaded President George W. Bush’s administration to allow them greater latitude on exempting salaried white-collar workers from overtime pay, even as organized labor objected….Mr. Obama’s authority to act comes from his ability as president to revise the rules that carry out the Fair Labor Standards Act, which Congress originally passed in 1938. Mr. Bush and previous presidents used similar tactics at times to work around opponents in Congress.

Oh. So he’s just doing the same stuff that every other president has done. Sorry about that. You may go about your business.

For what it’s worth, this gets to the heart of my impatience with all the right-wing hysteria about how Obama is shredding the Constitution and turning himself into a modern-day Napoleon. I’m not unpersuadable on the general point that Obama’s executive orders sometimes go too far. But so far no one has provided any evidence that Obama has done anything more than any other modern president. They all issue executive orders, and Obama has actually issued fewer than most. They all urge the federal bureaucracy to reinterpret regulations in liberal or conservative directions. They all appoint agency heads with mandates to push the rulemaking process in agreeable directions. And they all get taken to court over this stuff and sometimes get their hats handed to them.

Is Obama opening up whole new vistas in executive overreach? I don’t see it, and I don’t even see anyone making the case seriously. You can’t just run down a laundry list of executive actions you happen to dislike. You need to take a genuinely evenhanded look at the past 30 or 40 years of this stuff and make an argument that Obama is doing something unique. Until you do that, you’re just playing dumb partisan games.

9 Times Chris Christie Denied Using a Bridge for Political Revenge

UPDATE: On Thursday, Christie said, “I am outraged and deeply saddened to learn that not only was I misled by a member of my staff, but this completely inappropriate and unsanctioned conduct was made without my knowledge.”

On Wednesday morning, news outlets released emails that strongly imply that in September a top aide to New Jersey Republican Gov. Chris Christie planned a dangerous traffic jam near the George Washington Bridge to punish the Democratic mayor of Fort Lee. After over seven hours of silence, Christie—a possible presidential candidate in 2016—released a statement denying he had knowledge of the aide’s actions. Up until then, Christie and his aides made numerous statements claiming his office had no involvement in the scandal. Here’s the evolution of how Christie responsed to the scandal, dating back to September:

“Kevin Roberts, a spokesman for the Christie campaign, said that any notion that Mr. Sokolich faced retribution for not endorsing the governor was ‘crazy.'” –The Wall Street Journal, September 17, 2013
â&#128;&#139; “A spokesman for Christie, Michael Drewniak, said the governor had nothing to do with the lane closures: ‘The governor of the state of New Jersey does not involve himself in traffic studies,’ Drewniak said.” –The Star-Ledger (November 13, 2013)

Former Defense Secretary Robert Gates has published a memoir of his time in government. He served in Obama’s cabinet for two years:

Mr. Gates says that by 2011, Mr. Obama began expressing his own criticism of the way his strategy in Afghanistan was playing out.

At a pivotal meeting in the situation room in March 2011, Mr. Gates said, Mr. Obama opened with a blast of frustration over his Afghan policy — expressing doubts about Gen. David H. Petraeus, the commander he had chosen, and questioning whether he could do business with the Afghan president, Hamid Karzai.

“As I sat there, I thought: The president doesn’t trust his commander, can’t stand Karzai, doesn’t believe in his own strategy and doesn’t consider the war to be his,” Mr. Gates writes. “For him, it’s all about getting out.”

Gates was frustrated about this, and I don’t blame him. And needless to say, conservatives are going to have a field day with it.

But it’s pretty frustrating for those of us on the other side of the fence as well. Apparently, we’ve spent the past three years fighting a war that the White House no longer believes in. There’s been essentially no hope of victory, or even of doing much good, and yet we gutted it out anyway. What a waste.

The governors of eight Northeastern states are fed up with the air pollution that blows their way from states to their west.

In the latest high-profile move to crush the antiquated practice of burning coal in the U.S., the governors filed a petition with the EPA today that seeks more stringent air quality regulations on coal-burning states such as Ohio, Kentucky, and Michigan. That’s because pollution from those states’ coal-fired power plants reaches the Atlantic coastline, sickening residents there. From The New York Times:

[There is] growing anger of East Coast officials against the Appalachian states that mine coal and the Rust Belt states that burn it to fuel their power plants and factories. Coal emissions are the chief cause of global warming and are linked to many health risks, including asthma and lung disease.

Gov. Dannel P. Malloy of Connecticut, who is leading the effort by East Coast governors to crack down on out-of-state pollution, called it a “front-burner issue” for his administration. …

Mr. Malloy said that more than half the pollution in Connecticut was from outside the state and that it was lowering the life expectancy of Connecticut residents with heart disease or asthma. “They’re getting away with murder,” Mr. Malloy said of the Rust Belt and Appalachia. “Only it’s in our state, not theirs.”

And there’s more big air pollution news this week. From the Times:

The petition comes the day before the Supreme Court is to hear arguments to determine the fate of a related E.P.A. regulation known as the “good neighbor” rule. The regulation, officially called the Cross-State Air Pollution Rule, would force states with coal pollution that wafts across state lines to rein in soot and smog, either by installing costly pollution control technology or by shutting the power plants.

Bloomberg reports on that “good neighbor” court case:

The Supreme Court will hear arguments over reviving an EPA rule that would limit sulfur dioxide and nitrogen oxide emissions in 28 states whose pollution blows into neighboring jurisdictions. All are in the eastern two-thirds of the country.

The U.S. Court of Appeals for the D.C. Circuit struck down the rule. It said the regulation was too strict and that EPA didn’t give states a chance to put in place their own pollution-reduction plans before imposing a nationwide standard. The Obama administration and environmental groups are appealing.

Some energy companies have been powering down their coal-fired stations, citing financial losses, but plenty of coal-burning plants are still pumping out pollutants. In October, Wisconsin Energy Corp. sought permission to shutter its 407-megawatt Presque Isle coal-fired power plant in Michigan. The request was denied by the regional grid operator, which said the region couldn’t manage without the power plant’s electricity supply. The grid operator is now in talks over compensation, to help the energy company continue operating the plant at a loss.

The Supreme Court case could decide the fate of Presque Isle and many other coal plants, so it’s one to watch. Another air-pollution case is also being argued tomorrow, this one in the D.C. Circuit Court over the EPA’s mercury rules. “This is the biggest day for clean air in American courts — ever,” John Walke of the Natural Resources Defense Council told Bloomberg.

President Obama Is Getting Camera Shy

The New York Times reports that the press is unhappy with the Obama White House:

A mutiny has erupted among photographers who cover President Obama over what they say is the White House’s increasing practice of excluding them from events involving the president and then releasing its own photos or video.

On Thursday, the White House Correspondents’ Association and 37 news organizations submitted a letter to the press secretary….The letter cited seven recent examples of newsworthy events from which photographers were banned, including an outdoor lunch for Mr. Obama and former Secretary of State Hillary Rodham Clinton, a meeting with Israeli and Palestinian negotiators, and a session in the Oval Office at which Malala Yousafzai, a young Pakistani human rights campaigner, spoke with Mr. Obama, his wife, Michelle, and their daughter Malia.

….White House photographers have historically captured private moments of the president, with his family or conferring with advisers in the Oval Office or the Situation Room. During the debate over the civil war in Syria, Mr. Souza’s images of internal meetings provided a revealing account of the tensions felt by the president and his staff….“The way they exclude us is to say that this is a very private moment,” said Doug Mills, a photographer for The New York Times who has covered the White House since the Reagan administration. “But they’re making private moments very public.”

The story is a little frustrating because it doesn’t provide a good sense of whether photographic access has changed significantly over the years. But the AP’s director of photography, Santiago Lyon, added this on his blog:

While photographers are granted some access to Oval Office meetings and other activities, it has decreased markedly under the Obama administration when compared to previous presidents….In fact, since 2010 we have only been granted access to the President alone in the Oval Office on two occasions, once in 2009 and again in 2010. We have never been granted access to the President at work in the Oval Office accompanied by his staff. Previous administration regularly granted such access.

This is part of a troubling trend, as presidential administrations have all gotten successively more and more single-minded about managing their image. By itself, it’s hard to get too worked up about photographers not being allowed into a few meetings here and there, but this is yet another step in the direction of obssessive White House media management. It’s the wrong direction, and it’s also kind of pointless. Whether he likes hordes of photographers around or not, Obama should know that it’s all part of the job. He should let the photographers back in.

Is filibuster reform coming as soon as tomorrow? Maybe so:

“We’re not bluffing,” said one senior aide who has spoken with Mr. Reid directly and expects a vote on Thursday, barring any unforeseen breakthrough on blocked judges.

The threat that Democrats could significantly limit how the filibuster can be used against nominees has rattled Republicans. Senator John McCain, the Arizona Republican who has brokered last-minute deals that have averted a change to filibuster rules in the past, visited Mr. Reid in his office on Thursday but failed to strike a compromise.

Of course, as Rick Hasen says, “If Democrats were bluffing, they’d have every incentive to say ‘We’re not bluffing.'” Still, it sure doesn’t look like any serious negotiations are taking place, and Harry Reid wouldn’t bring something to the floor unless he knew he had the votes to pass it. Thursday could be a very interesting day in Washington DC.

You could be as happy as this guy.

It’s easy to see the electric car as a symbol of the kind of offbeat elitism often associated with eco-conscious living — the rich man’s veggie oil-powered VW bus, if you will. But that could change as the industry starts going Model T on EVs, making them more affordable for the masses. Automakers are now offering an array of discount leases and perks that, when combined with government tax incentives, make EV ownership accessible for a much broader segment of the population.

Owning an electric vehicle automatically slashes drivers’ fuel costs by as much as 80 percent. But it’s the up-front cash that presents a barrier to most prospective buyers, not to mention the lack of widespread charging infrastructure. Of course, growing ranks of EV drivers would spur the construction of more charging stations and attract still more electric converts. But with so few choices on the market, none of them wildly affordable, it’s hard to get that cycle started.

Until now. The Wall Street Journal reports:

Bronson Beisel, 46, says he was looking last fall for an alternative to driving his gas-guzzling Ford Expedition sport utility around suburban Atlanta, when he saw a discounted lease offer for an all-electric Nissan Leaf. With $1,000 down, Mr. Beisel says he got a two-year lease for total out-of-pocket payments of $7,009, a deal that reflects a $7,500 federal tax credit.

As a resident of Georgia, Mr. Beisel is also eligible for a $5,000 subsidy from the state government. Now, he says, his out-of-pocket costs for 24 months in the Leaf are just over $2,000. Factor in the $200 a month he reckons he isn’t paying for gasoline to fill up his hulking SUV, and Mr. Beisel says “suddenly the car puts $2,000 in my pocket.”

Beisel also got a charging station installed at his house for no up-front cost. He’s spending less than $15 a month so far for the electricity needed to power the Leaf. That means that, including charging costs, he’s paying no more than $1,180 a year to drive his EV around town. Compare that to the $9,000 per year it costs to own and operate a typical gas-powered car.

Beisel compared the deal to “a two-year test drive, free.” Another Leaf driver is taking that approach literally:

Matt Brooks, a software engineer in Rochester, N.Y., says he decided to replace a hybrid Prius with a Leaf because the lease was so cheap. He’s paying $239 a month for 24 months with no money down. Mr. Brooks says he likes the car, but doesn’t expect to buy it when the lease is done. Used Leafs are selling below the purchase price written into his lease, he says.

Manufacturers are under pressure to comply with state regulations like California’s, which requires that by 2018, 4.5 percent of cars sold in the state be zero-emission vehicles; by 2025, 15 percent. Only the Nissan Leaf and the Tesla Model S sold more than 1,000 cars during the first quarter this year. But discount leases like the ones Brooks and Beisel have could help those numbers rapidly accelerate.

In an effort to ramp up production and lower costs, Nissan is increasingly manufacturing the Leaf and its pricey battery packs at factories in Tennessee instead of in Japan (creating American jobs in the process). This helped drop the 2013 Leaf’s starting price ($28,800) by $6,400 compared to last year’s model.

Of course, the one major drawback of EVs is that they’re primarily city cars because most roads still lack charging stations. That’s why many EV owners still keep a gas guzzler around for out-of-town trips. But one automaker has a solution to that problem: As part of the $32,500-plus cost of its new 500e electric, Fiat USA offers 12 days a year of free access to a gas-powered rental car. So unless you’re planning a truly epic road trip, you don’t need to own a second car in order to hit the highway.

And hey, if a guy with a name as bro-y as Bronson Beisel, not to mention a veteran New York cabbie, can proudly pilot an electric car, they’re clearly not just for highfalutin hippies anymore.
