Supreme Court Upholds Arizona’s Right to Ensure Minority Representation

The Supreme Court upheld an Arizona redistricting commission’s right to draw legislative districts in a way that ensures minority representation, delivering a crushing rebuke on Wednesday to a group of Arizona tea party activists who’d sought to strike down the state’s redistricting maps in order to increase the voting power of rural white voters.

In Harris v. Arizona Independent Redistricting Commission, the plaintiffs were taking on Arizona’s Independent Election Commission, a body created through a 2000 ballot initiative intended to make redistricting less partisan. The commission produced its first legislative maps after the 2010 census. Its work came under fire almost immediately, primarily by Republicans. At one point, then-Gov. Jan Brewer (R) attempted to impeach the commission’s chair in what was seen as a power grab. When that failed, in 2012, the Republican-led state legislature filed a lawsuit arguing that the ballot measure that created the commission was unconstitutional because it deprived the legislature of its redistricting power. The lawsuit went all the way to the US Supreme Court, which last June ruled 5-4 in the commission’s favor.

In the current lawsuit, filed in 2014, the plaintiffs, all Republicans, argued that the commission diluted their voting power by packing more people into Republican districts while underpopulating Democratic ones. They wanted the court to mandate that all district have almost exactly equal populations; the current ones vary by 4 to 8 percent. The commission, in turn, responded that it drew the districts in such a way as to win approval from the Justice Department, in compliance with the Voting Rights Act. Due to Arizona’s long history of suppressing minority voting, it was one of the jurisdictions required under the Voting Rights Act to clear any changes to legislative districts with the Justice Department before implementing them. The Supreme Court gutted this requirement in Shelby County v. Holder in 2013, but it was in place when Arizona redrew its legislative maps.

If the Harris plaintiffs had been successful, the case could have opened the floodgates to lawsuits challenging how states around the country draw their legislative districts. But in an opinion written by Justice Stephen Breyer, the court ruled unanimously that Arizona’s maps were indeed designed to comply with federal law in ensuring minority representation, and that the minor population deviations were acceptable.

It’s the second time this term the court has rejected challenges to state redistricting plans from tea party conservatives upset about the growing clout of Latino voters. In Evenwel v. Abbott, decided earlier this month, a pair of Texas plaintiffs argued that states should create state legislative districts based on the number of eligible voters in them, as opposed to total population. The move would have granted more power to rural, white areas that lean Republican over more populated urban areas that are home to large minority (and Democratic-leaning) populations. Earlier this month, the Supreme Court unanimously ruled against the Evenwel plaintiffs.

Donald Trump told a Wisconsin town hall on Wednesday that his proposed ban on Muslims entering the United States would have an exception for the billionaire’s rich friends.

“I have actually—believe it or not, I have a lot of friends that are Muslim and they call me,” Trump said, when asked about his plan by MSNBC’s Chris Matthews, the event’s moderator. “In most cases, they’re very rich Muslims, OK?”

Matthews then asked Trump if his rich Muslim friends would be able enter the country under Trump’s Muslim ban. “They’ll come in,” Trump said. “You’ll have exceptions.”

But he didn’t stop there. A few moments later, when Matthews suggested that a blanket ban might rub Muslims the wrong way, Trump flipped the script, arguing that it would instead have a galvanizing effect on Middle Eastern countries in the fight against ISIS.

“Maybe they’ll be more disposed to fight ISIS,” Trump said. “Maybe they’ll say, ‘We want to come back into America, we’ve got to solve this problem!'”

Democratic front-runner Hillary Clinton wasted little time dismissing Trump’s comments:

Ted Cruz took a lot of flak yesterday for his proposal to “patrol and secure” Muslim neighborhoods, so he decided to explain it further last night:

“It is standard law enforcement — it is good law enforcement to focus on where threats are emanating from, and anywhere where there is a locus of radicalization, where there is an expanding presence of radical Islamic terrorism,” Cruz told reporters on Tuesday evening in Manhattan. “We need law enforcement resources directed there, national security resources directed there.”

….Ibrahim Hooper, spokesman for the Council on American-Islamic Relations (CAIR), compared Cruz’s proposition to “the dark days of the 1930s” in Europe and “the interment of Japanese-Americans” in the 1940s, calling it “a very frightening image.”

Cruz repudiated the comparison at the press conference, saying: “I understand that there are those who seek political advantage and try to raise a scary specter.” He instead compared it to ridding neighborhoods of gang activity and law enforcement’s efforts “to take them off the street.”

And what did Donald Trump think of all this? He supports Cruz’s plan “100 percent.” Naturally.

In the wake of the Brussels terror attacks Tuesday morning, GOP presidential candidate Ted Cruz suggested that the United States “empower law enforcement to patrol and secure Muslim neighborhoods before they become radicalized.”

“Today radical Islamic terrorists targeted the men and women of Brussels as they went to work on a spring morning. In a series of coordinated attacks they murdered and maimed dozens of innocent commuters at subway stations and travelers at the airport. For the terrorists, the identities of the victims were irrelevant. They –we—are all part of an intolerable culture that they have vowed to destroy.

“For years, the west has tried to deny this enemy exists out of a combination of political correctness and fear. We can no longer afford either. These Racist Collectibles Will Make Your Skin Crawl

DAVID PILGRIM bought his first piece of racist memorabilia in the early 1970s, when he was a youngster in Mobile, Alabama. It was a set of salt and pepper shakers meant to caricature African Americans. “I purchased it and broke it” on purpose, recalls Pilgrim, who is black. Yet over the next few decades, he amassed a sizable collection of what he calls “contemptible collectibles”—once-common household objects and products that mock and stereotype black people.

In 1996, Pilgrim transformed his 3,200-item collection into the Jim Crow Museum of Racist Memorabilia at Michigan’s Ferris State University, where he teaches sociology. He presents a selection of these appalling objects and images in his new book, Understanding Jim Crow: Using Racist Memorabilia to Teach Tolerance and Promote Social Justice. As the title implies, the book isn’t merely an exercise in shock value. It lays out the philosophy behind Pilgrim’s work as a scholar and an activist: that only by acknowledging these artifacts and their persistence in American culture can we honestly confront our not-so-distant past.

Mother Jones: What made you decide to turn your collection into a museum?

David Pilgrim: When I got to Michigan, someone mentioned that they knew this elderly black woman who was an antiques dealer. After many months, she agreed to let me see her personal collection. It was just objects floor to ceiling in a barnlike structure. I was overwhelmed by the sheer volume. It shook me! I thought I’d seen everything. What she had was a testimony to—this is going to sound weird—not just the creativity of racism, but the diversity in it. I remember that day thinking that I wanted to do what she’d done, but in a different way.

MJ: How popular were these collectibles?

DP: They were everyday objects in a lot of people’s homes, including African Americans’. The antiques collector had postcards, posters. She had records, 78s. She had ashtrays. She had a racist bell. I think she had the game called Chopped Up Niggers—it’s a puzzle. She told me that she hadn’t paid very much for many of those pieces because at the time people were throwing stuff away. Some people were ashamed.

MJ: Why own them in the first place?

DP: These toys, games, sheet music about “coons” and “darkies”—all these millions, and I mean literally millions, of objects—were integral to maintaining Jim Crow. Jim Crow could not work without violence, real violence, but also the threat of violence and the depiction of violence. There are a number of games in the museum where you throw things at black people: “hit the nigger” or “hit the Negro” games. If you had such a game, you were actually creating safe spaces to do that.

MJ: Do you also keep track of racist images and memorabilia online?

DP: Absolutely. With the power of the internet and social media, one person can do the damage that in the old days it took many to do. When you have a race-based incident—and I make it my business to look—within one week there are material objects that reflect that incident in a racist way: lunch boxes, posters, puzzles, T-shirts, pillows. President Obama has been an industry for racist objects. He has been portrayed as a witch doctor, a Rastus character from Cream of Wheat, as a Sambo, as an Uncle Tom—and also as gay, as transgender, as communist, as socialist, as a terrorist, as a Muslim. Many of the images that appear online are old. The images from the old “coon” songs from the late 1800s and early 1900s show up in memes, and people don’t realize they’re older images.

MJ: What sort of people collect this stuff?

DP: There are some who want to educate. I’ve met collectors who collect to destroy the pieces. But by far the biggest segment are speculators who know that a McCoy cookie jar was $3 and you can get several hundred dollars for it now.

MJ: Do you see a role for your collection in today’s movement for racial equality?

DP: One of the questions I get often is why we’re still having these conversations. And my answer is: The objects are still being made, they’re still being sold and distributed. There’s not an image in the museum that’s not being reproduced in some way. Secondly, the reason we still have these discussions is because race still matters. But Americans don’t often talk about it in places where their ideas are challenged. We want our museum to be safe but uncomfortable.

MJ: I found myself hiding your book from my kids. At what age do you think it’s okay to expose children to this stuff?

DP: I believe that young people—8, 9, 10—should have discussions appropriate to their age about race. But no one under 12 can come into the museum by themselves, and we discourage parents from bringing them. Right in the center of the room is a lynching tree. Even though it’s contextualized, it can be a house of horrors.

Donald Trump Trots Out Tale Of Muslims, Pig Blood, and Bullets

Donald Trump ended his final campaign rally of the South Carolina primary Friday night with a story about a four-star general, Muslim insurgents, and bullets dunked in pig blood. Forty minutes into his address at a not-quite-full convention center in North Charleston, after mocking Texas Sen. Ted Cruz’s lack of enthusiasm for waterboarding, the Republican presidential frontrunner told the crowd he wanted to share an anecdote he’d heard about General John Pershing.

“General Pershing was a rough guy,” Trump said. He explained that during the early 1900s, the general was battling Muslim insurgents in the US-controlled Philippines, he decided to make a point:

He caught 50 terrorists who did tremendous damage…and he took the 50 terrorists and he took 50 men and dipped 50 bullets in pig’s blood. You heard about that? He took 50 bullets and dipped them in pig’s blood which is considered haram. And he has his men load up their rifles and he lined up the 50 people and they shot 49 of those people. And the 50th person, he said, you go back to your people and you tell them what happened. And for 25 years there wasn’t a problem.

“We’ve got to start getting tough and we’ve got to start being vigilant and we’ve got to start using our heads or we’re not gonna have a country, folks,” he concluded.

Snopes, the online mythbuster, classifies the Pershing tale—which is popular on the right—as a “legend.” “We haven’t eliminated the possibility… but so far all we’ve turned up are several different accounts with nothing that documents Pershing’s involvement,” it explains.

But a lack of evidence has never stopped Trump, especially when it comes to the anti-Islam invective that has helped keep him atop the polls in South Carolina. His proposal to ban Muslims from entering the United States is hugely popular among Republicans; a recent survey of his supporters found that just 44 percent believed Islam should even be legal. So with his candidacy on the line, he’s sticking with what got him to this point.

The Trump Town Hall Was a Big Fat Waste

Tonight’s Trump Town Hall, hosted by MSNBC, may indicate that Trump has finally stunned the nation into silence. Or at least mild tolerance, like the way we don’t challenge our drunk uncle at Thanksgiving.

Trump—who has called for a ban on Muslim immigrants, has retweeted posts from white supremacists, and has remarked that Mexican immigrants are “rapists”—wasn’t asked about any of these assertions. He was asked about poll numbers, if Apple is wrong for refusing to unlock the iPhone of one of the San Bernadino shooters, and if he can play nice with Congress if elected to office. In an hour-long question-and-answer session in Charleston, S.C., moderators Mika Brzezinski and Joe Scarborough occasionally pushed Trump on specificity, but couldn’t garner substantial answers. As Isaac Chotiner points out at Slate, “He wasn’t pressed hard for any policy details, nor challenged about his well-catalouged dislike of the truth.” Instead, he was asked the kind of medium-range questions that, well, other candidates get.

Or maybe Trump has conquered the Overton Window theory—the range of ideas the public will accept—faster than anyone in history. Could it be that his talking points have become so commonplace, no one even questions them anymore? Rather, we ask him questions like the one from an audience member tonight: “Why do you want to be president?”

Marco Rubio Is Very Upset That President Obama Went to a Mosque

On Wednesday, President Barack Obama visited a mosque for the first time as president, and offered perhaps the least controversial comment imaginable: “You’re part of America too,” he told his hosts. “You’re not Muslim or American; you’re Muslim and American.”

Sen. Marco Rubio was not impressed, telling voters in New Hampshire:

I’m tired of being divided against each other for political reasons like this president’s done. Always pitting people against each other. Always. Look at today—he gave a speech at a mosque. Oh, you know, basically implying that America is discriminating against Muslims. Of course there’s going to be discrimination in America of every kind. But the bigger issue is radical Islam. And by the way, radical Islam poses a threat to Muslims themselves.

To be clear: America discriminates against Muslims.

In 2012, Wired reported that “the FBI is teaching its counterterrorism agents that ‘main stream” sic American Muslims are likely to be terrorist sympathizers; that the Prophet Mohammed was a ‘cult leader’; and that the Islamic practice of giving charity is no more than a ‘funding mechanism for combat.” That investigative series on federal law enforcement’s prejudices against Muslims won a National Magazine Award. In 2011, the Associated Press reported on how the NYPD, with the help of the CIA, spied on America mosques and even infiltrated Muslim student associations. That series won a Pulitzer. Last week, Buzzfeed reported on the intense pressure applied by the federal government on Muslim immigrants who apply for citizenship. My colleague Kristina Rizga has reported on the pervasiveness of anti-Muslim bullying in schools. One of the candidates who beat Rubio last week literally proposed banning Muslims from entering the country; the other limited his ban to people from predominantly Muslim countries.

This is all pretty easy to find online, but in Rubio’s defense, the Internet is pretty spotty in New Hampshire.

This South Carolina Republican Wants to Create a "Registry" for Responsible Journalists

Perhaps inspired by Donald Trump’s recent call for a Muslim database, one South Carolina representative just introduced a measure to create a different kind of strange registry—this time to track journalists deemed “responsible” by the state.

The bill, proposed by Republican state lawmaker Mike Pitts, would establish vague requirements for journalists to submit to a registration process by the state. Journalists found in violation of the registry, by either not registering or breaking his rules, would be subjected to monetary fines and even criminal penalties—a lighter version of how the Kremlin treats its own pesky champions of free speech. As the Post and Courier reports, quoting Pitts, the Secretary of State’s Office would maintain a “responsible journalism registry” and create the criteria, with the help of a panel, on what qualifies a person to be a journalist—similar to the licensing for doctors and lawyers.

When asked if the proposal was retribution for some unflattering press coverage directed towards Pitts—the lawmaker has been repeatedly cited for some of his more eyebrow-raising spending habits—he told the Post and Courier it was actually aimed to combat stories he believes have been unfairly targeting gun ownership.

“It strikes me as ironic that the first question is constitutionality from a press that has no problem demonizing firearms,” Pitts, a lifetime NRA member, said. “With this statement I’m talking primarily about printed press and TV. The TV stations, the six o’clock news and the printed press has no qualms demonizing gun owners and gun ownership.”

This “Peace Troubadour” Wanted to Perform in ISIS Territory

James Twyman wants you to know that he’s not going to just wander into ISIS-controlled territory with a guitar slung on his back for his upcoming “peace prayer concert” inside Syria. He isn’t crazy, he tells me over the phone from his houseboat in Oregon. “I have no intention of being a martyr.”

The 53-year-old “Peace Troubadour” first announced his plan to venture into Syria in a blog post last month:

Performing the peace prayers in ISIS Controlled Syria will be the most important and dangerous peace mission of my life…Every peace mission I’ve been on has been dangerous, but this journey is without question the most perilous, and in my opinion—the most important. People everywhere are concerned about the escalating violence in the Middle East, especially with the rise of ISIS, but they don’t feel empowered to be part of the solution. That is what we are about to change.

Twyman’s original idea was to enter Syria through Turkey, travel through Kurdish-controlled areas, and then into ISIS territory, where he would perform wherever he could get to. “But now things have really escalated,” he says. The State Department made it clear that it would have little ability to help him should anything go awry. “People have been writing me, begging me not to go. You know, just the most fearful things you could imagine.” Things like the kidnappings, beheadings, and the chaos that have become ISIS’ trademark. Twyman’s well aware of it all, but says, “I try not to put too much energy in it, but I do need to be responsible about it. I think the most important thing we all need today is courage.”

Now, his plan has changed—phew!—from a really horrible one to a less horrible one. Twyman leaves on the 20th for Italy, where he’ll spend a week preparing for the performance. Then he flies to Tel Aviv to meet with a collection of supporters and a group of Christian, Muslim, and Jewish leaders who will join him as he crosses the Israel-Syria border to Majdal Shams, an Israeli-occupied town in the Golan Heights that overlooks ISIS-held territory several miles away.

This isn’t Twyman’s first musical peace mission. He performed in the Balkans during the region’s wars in the ’90s and sang in Baghdad in 1998—at the behest of Saddam Hussein, he claims.

Twyman hopes that millions of people from around the world will join him in focused prayer as he leads a peace vigil near Majdal Shams and sings an Islamic prayer for peace on February 1. (Watch his rendition in English below.) “There is definitely a correlation between massive numbers of people focusing their energy on a situation, and then a shift in the energy—or a crisis being averted—because of it.” Each of the religious leaders will offer prayers of peace from their own tradition, what Twyman calls “The Great Abrahamic Pulse.”

Twyman says the decision to scale back his Syrian trip is due to the spiritual leaders who are now involved. “I feel that it’s more important that they be there” than to go closer to ISIS territory, he says. “So we’re going to be as close as possible while remaining as safe as possible.” Will he have a security detail? “No,” he tells me. “I’m someone who believes on the power of prayer and positive energy.”
