Scott Pruitt testified before Congress and it got messy

On Tuesday, Environmental Protection Agency Administrator Scott Pruitt testified for more than two hours before the Senate Environment and Public Works committee about his first year on the job. While Senate Republicans such as Chair John Barrasso, from Wyoming, and Senator Joni Ernst, from Iowa, gave him credit for helping create jobs by loosening regulations, Senate Democrats were far more concerned with the actions he’s taken that have damaged the functioning of the agency and harmed America’s land, water, and air.

The EPA has touted the massive repeal of regulations as a major achievement of the last year, but Senator Tom Carper, a Delaware Democrat and the ranking member of the committee, saw it differently. “Those are not achievements,” he said. “Those are the complete opposite.”

The night before the hearing, Democrats on the Environment and Public Works committee released a memo entitled “Basically Backward: How the Trump Administration is Erasing Decades of Air, Water and Land Protections and Jeopardizing Public Health.” In it, they outlined some of the steps Pruitt’s EPA has taken to roll back environmental protections. “From nominating extremists to some of the highest posts in our government, to willfully ignoring sound science and stripping the protections that keep millions of Americans safe, this administration has spent its first year reversing the progress our country,” Senator Carper said in a press release about the memo.

During his testimony, Pruitt said that the EPA is going to focus on cleaning up Superfund sites at a faster pace. New Jersey Democratic Senator Cory Booker asked Pruitt if he believed that the 327 Superfund sites that are threatened by climate-fueled flooding deserved immediate attention. “Absolutely,” Pruitt replied, but he did not acknowledge the dangers from climate change. As Carper pointed out, the White House budget has proposed cutting the Superfund budget by 30 percent. Earlier this month, a list circulated by the EPA showed Superfund cleanup successes, seven of which had occurred during the Obama administration.

At his Senate confirmation hearing — which was the last time he had appeared before the committee — Pruitt famously said that he hadn’t looked into the scientific research on lead poisoning, but on Tuesday he announced the launch of a bipartisan war on lead. Senator Tammy Duckworth, a Illinois Democrat, noticed the discrepancy. “Unfortunately, your rhetoric doesn’t match your actions,” she said. “Over the last several months the administration has taken several steps that will make it harder, not easier, to limit lead exposure.” She noted that the White House has proposed slashing programs that reduce lead exposure.

Senator Duckworth went on to cite the EPA’s decision to delay the update to the Lead and Copper Rule, which limits the amount of those substances allowed in drinking water. When the Senator asked Pruitt to answer yes or no to committing to updating the rule before 2020, Pruitt attempted to provide a long explanation. Duckworth insisted on a simple “yes” or “no,” until Pruitt turned to committee chair Barrasso and asked, “Mr. Chairman, may I answer the question?” Duckworth moved on after Barrasso told him he could give a more complete answer later.

She also asked Pruitt about his unexpected trip to Morocco last December, to promote natural gas. “I don’t understand what the sale of natural gas has to do with the EPA’s mission,” Duckworth said. Without giving him time to respond, she then asked for documents containing details of his trips, which Pruitt agreed to provide. Duckworth also asked if he believed the country was a “shithole,” as Trump reportedly said about African countries earlier this month. Senator Barrasso announced her time was up before Pruitt could answer.

But perhaps the most dramatic moment of the hearing came when Senator Sheldon Whitehouse, a Rhode Island Democrat, grilled Pruitt on comments he had made in 2016, when as Oklahoma attorney general he appeared on the Pat Campbell Show. In a story first reported by Documented, a corporate interest watchdog group, Pruitt told Campbell in February 2016, “I believe that Donald Trump in the White House will be more abusive to the constitution than Barack Obama and that’s saying a lot.” Pruitt did not respond while Senator Whitehouse held up posters of his quotes on the show. “Do you recall saying that?” Whitehouse asked him. Finally, Pruitt replied that he didn’t remember making those comments.

After the hearing ended, the EPA put out a formal statement calling Trump the “most consequential leader of our time.”

Sierra Club’s new video slams Ford for greenwashing its public image

In a video made public Wednesday, the Sierra Club denounced Ford Motor Company for lobbying the Trump administration and “#PollutingPruitt” to roll back vehicle efficiency and emission standards.

The environmental organization timed the airing of their new video with the D.C. Auto Show, at which Ford isn’t showing any electric vehicles despite claiming a commitment to sustainability, according to the Sierra Club.

Titled, “Tell Ford to put clean cars in the fast lane,” the 53-second video features a man getting into a car, paired with a caption reading, “By 2025, fuel-efficiency of U.S. cars will nearly double thanks to current clean-car standards.” Once inside the car, the man notices all of the car’s gears shift to reverse. Without another choice, he puts the car in reverse and blasts back in time, as the car transforms into a Model-T. A caption then reads, “But Ford is trying to roll back these standards so they can make cars with worse gas mileage than the Model T.”

The Sierra Club posted the video on Twitter, along with the hashtag, #ForwardNotBack (which couldn’t help but remind us of this Simpsons episode).

Not long ago, Ford pledged to invest in greener technologies, including $11 billion to put new electric vehicles on the road by 2022, a company spokesperson recently told The Hill, and the company has even criticized its own role in climate change. In a video put out by the company in conjunction with the release of their 2016-2017 Sustainability Report in August, executive chair Bill Ford says, “The implications of climate change are pretty profound … If we continue to be part of the problem rather than part of the solution, what kind of example are we setting for our children — our grandchildren?”

Ford though isn’t alone in pushing for looser emission standards. In Nov. 2016, the Alliance of Automobile Manufacturers, representing companies including Ford, General Motors, and Toyota, sent a letter to then President-elect Trump, asking him to “harmonize and adjust” the Obama-era emission goals and regulations. In March, Trump directed the Environmental Protection Agency to review current fuel efficiency standards after meeting with executives from different motor companies, including Ford.

“Ford may be trying to put on a good show, but behind closed doors, it has been working with Donald Trump and Scott Pruitt to roll back our single biggest defense against dangerous climate pollution,” said Andrew Linhardt, the deputy legislative director at the Sierra Club, in a statement. “Ford’s claims of sustainability in its advertising and here at the auto show are nothing more than greenwashing.”

You have public lands in the ocean, which means Ryan Zinke wants to shrink them.

After long days of reading about the dismantling of the EPA, I wanted to think about anything but politics. Samin Nosrat’s wonderful cookbook provided plenty of fodder.

Nosrat breaks cooking into its key elements; food science becomes clear and usable. For example: Roast chicken should get a hearty dose of kosher or sea salt the day before going in the oven. In a wild and woolly year, apolitical facts such as these were a godsend, and they actually got me to cook more.

Take dinner with a friend (and former Grist fellow) who was guest-writing the excellent newsletter WTF Just Happened Today. He got up early every day to sort through Trump administration noise and summarize the real news. He was, as you might expect, questioning everything. A distillation of our conversation:

Him: “All of this has me thinking about printing press capitalism’s link to the rise of nationalism. And with that, how international news has expanded our idea of community despite our inherent lack of agency. How about that?”

*Throws ingredients into soup*

Me: “What kind of salt you using over there, big guy?”

One night, I used the cookbook to make buttermilk chicken for this friend and others. They filtered in, various degrees of flustered and wide-eyed. I placed the skillet on the table and our manners and worries melted away. We ripped meat off the bones and gestured that yes, you should really just grab a handful of potatoes to scoop up the sauce. 

The world was still going batshit outside my door, but we could ignore it for a little while. We laughed and chatted as the salt and fat dripped down our chins.

Rick Perry’s Department of Energy really, really wants to prove that regulations kill coal.

The only problem: That’s not what the data shows.

In “the early days of all of the Obama administration regulations, everyone said the sky is falling, we’re going to have to fix all of these plants simultaneously,” energy consultant Alison Silverstein said during a panel last Friday. “Um, not so much. It turns out that when people have to actually do a job they find cheaper ways to do it.”

Silverstein, a veteran of the Bush administration, was tasked by fellow Texan Rick Perry to write a Department of Energy report analyzing the data on coal plant closures. But she found that regulations and renewable energy did not play a significant role in shutting down coal-burning power plants. The aging plants were instead condemned by cheap natural gas and falling electricity demand.

According to Silverstein, the Energy Department pushed back on her results, which did not support the hoped-for conclusion. Her draft report was leaked to the press in June, and the DOE released the final report in August, largely unchanged.

Nevertheless, in September, Perry submitted a rule requesting subsidies for nuclear and coal plants, citing Silverstein’s report for support. It was “as though they had never read it,” Silverstein said. Not a bad guess.

St. Louis just became the biggest Midwestern city to commit to clean energy.

You’d think that, in an era of increasingly extreme weather and disasters that render whole regions of the country nearly uninhabitable for months, maintaining a weather service in tip-top shape would be a priority.

Turns out, under President Donald Trump, that hasn’t been the case. Shifting priorities and uncertainty over funding at the National Weather Service have led to as many as 700 current staff vacancies, according to a report in the Washington Post. That’s about 15 percent of its mandated positions.

“Given our staffing, our ability to fill our mission of protecting life and property would be nearly impossible if we had a big storm,” Brooke Taber, a weather service forecaster in Vermont, told her local paper.

Some offices, like the one in Washington, D.C., are missing a third of their workforce as hurricane season winds down ahead of winter, traditionally one of the busiest times of the year for storms. Although a weather service spokesperson denied the problem was hurting the quality of its forecasts, the service’s employees union said in a statement that the organization is “for the first time in its history teetering on the brink of failure.”

The report follows a Grist cover story this week that looked at how Trump’s proposed cuts to the National Weather Service are already making the country less safe.

Trump administration to replace Clean Power Plan with ‘dirty power plan’

President Donald Trump claimed in September that he did away with the Clean Power Plan, one of the Obama administration’s most ambitious efforts for tackling climate change. The plan was the first to set a limit on carbon pollution from existing power plants. Dispensing with the regulation, Trump told a rally in Alabama, was simple as, “boom, gone.”

Of course the reality is more complicated. Because the Clean Power Plan is a finalized regulation from the EPA, the agency also has to put forward its justification for repealing it. During an appearance on Monday at the coal-mining town of Hazard, Kentucky, administrator Scott Pruitt announced his plans to sign the draft proposal to repeal the 2015 climate rule.

“The war on coal is over,” Pruitt said. “Tomorrow in Washington, D.C., I will be signing a proposed rule to roll back the Clean Power Plan. No better place to make that announcement than Hazard, Kentucky.”

The Clean Power Plan was crafted to cut carbon pollution from existing power plants 32 percent by 2030, by having states devise their own proposals for creating a pollution-cutting mix of renewables, gas, nuclear, and energy efficiency. But the Supreme Court stayed the rule in 2015, so its implementation stalled while the U.S. Court of Appeals for the District of Columbia Circuit heard the case brought by 26 states and coal companies like Murray Energy, which is owned by Trump donor Bob Murray. So far, the court hasn’t ruled, waiting to see what the Trump administration does next.

Another wrinkle is that the Trump administration eventually has to do something because it technically can’t ignore the EPA’s determination that greenhouse gases endanger public health, a finding compelled by a landmark Supreme Court decision in 2007. If they do nothing, they still risk lawsuits for not enforcing the Clean Air Act.

Whatever the administration decides, it will need to publish a written justification, which will be scrutinized by environmental groups in a likely lawsuit on the decision. The administration faces a similar quandary that plagued the GOP during the health care fight: Repeal the Clean Power Plan outright, or replace it with a shell of a rule?

According to a leaked draft of the EPA’s proposal, the Trump administration is choosing the first option — but with a twist. The 43-page document lays out the reasoning for repealing the rule by stressing the costs of implementation without factoring in the benefits from air pollution reduction and its contribution to combating climate change. The public is also invited to comment on alternatives for replacing it, without the EPA proposing any replacement of its own.

Janet McCabe, former head of the EPA office of air and radiation, explained that seeking input before even proposing a replacement “is not a legally necessary step.” Agencies use this step “sometimes to seek broad input before they put their own thoughts down into a proposal, which necessarily signals a particular policy and legal direction.”

A former EPA attorney that helped craft the Clean Power Plan told Mother Jones that the agency’s invitation to the public to comment is actually its own stalling tactic. The extra step pushes back the EPA’s regulatory timeline for nine months, at least. The reason the status quo appeals to the administration’s coal allies is that the implementation of the Clean Power Plan was delayed by the Supreme Court while current legal challenges played out. The coal industry only gains by the EPA delaying a replacement climate regulation, because the longer it’s put off, the longer it can pollute without limit. By stalling, Pruitt kicks the can down the road, by betting that the status quo of no rule in place is better than a replacement.

“Pruitt doesn’t believe in this stuff, so he’s actually in a paradoxical position,” says Joe Goffman, the former EPA attorney who is now at Harvard Law School’s environmental program. “If they do propose a replacement for the Clean Power Plan, what he’ll be doing is putting his signature on the proposal which will require to some extent power plants to address their carbon emissions.”

Nothing Pruitt is proposing now changes the underlying legal and scientific reasoning for why the EPA needs to do something on carbon emissions from the coal sector. Natural Resource Defense Council’s Climate and Clean Air Director David Doniger says the administration’s strategy is basically “replacing the Clean Power Plan with a dirty power plan.”

Devastated Dominica aims to climate-proof the country.

President Trump visited the U.S. territory on Tuesday, two weeks after Hurricane Maria devastated the island. Half of Puerto Ricans lack clean water and 95 percent are without power.

So, how did the president approach the unfolding humanitarian crisis? Let’s hear it:

Trump said that Hurricane Maria wasn’t a “real catastrophe” like Hurricane Katrina at a briefing with local officials. He compared the certified death count of the disasters as evidence: “You can be very proud, only 16 instead of thousands in Katrina.” To point out a few problems: The official death toll in Puerto Rico is underreported, it will likely continue to climb, and maybe we shouldn’t frame death tolls as something to be proud of.

“I hate to tell you, Puerto Rico, but you’ve thrown our budget out of whack,” Trump said at the briefing — apparently joking about the disaster aid pending in Congress.

“Have a good time,” Trump told a family after they showed him their storm-damaged home.

The president went mostly off-script from the White House’s Puerto Rico media coverage plan, but he did take the opportunity to tout the success of the relief effort. “Everybody watching can really be very proud of what’s been taking place in Puerto Rico,” he said.

We can only hope he’s not talking about his own performance.

Despite Trump, states keep getting more energy-efficient.

On Thursday, President Trump announced — after much feeble deliberation — that he would waive the Jones Act, a century-old law that requires all shipping to U.S. territories to be made through American ships and companies. This massively expensive policy, Puerto Rico Governor Ricardo Rossello noted, created an unnecessary obstacle to getting crucial supplies to a devastated island.

Good! One obstacle down, a billion and three to go — including the fact that trucks, drivers, and gasoline to distribute supplies around the island are currently few and far between.

CNN reports that only 4 percent of 3,000 containers of supplies that recently arrived at the Port of San Juan have made it to communities in need. There are currently upwards of 10,000 containers of supplies waiting to be circulated. Only 20 percent of truck drivers have returned to work, and many are hard to contact due to downed cell towers.

Remember that Puerto Rico’s current financial insecurity and infrastructure failings are largely a product of predatory hedge fund lending and lack of access to states’ resources — like, for example, a congressional representative.

EPA employees eagerly leak documents from their mandatory anti-leaking class.

“If you just look at the energy sector, we need about a trillion a year,” Barbara Buchner says about the gap between between our climate goals and the amount of investment in developing solutions.

To spur those needed investments, Buchner’s group, The Lab, just launched a new crop of projects aimed at making it easier for investors to put money into green investments. Projects include partnerships between hydropower operators and land conservation and restoration efforts and “climate smart” cattle ranching initiatives in Brazil, as well as more esoteric exploits in private equity and cleantech development.

There are three main barriers that keep investors away from innovative projects, Buchner says: lack of knowledge of new projects, perception of higher risk, and an unwillingness to go in alone on unproven projects.

Breaking down these barriers is important because that climate investment gap can’t be closed by government spending alone.

“It’s the backbone, it’s the engine behind overall climate finance,” Buchner says of these early, targeted projects by governments and non-governmental organizations. “But the private sector [investors] really are the ones that make the difference.”
