It’s Time to Stop the Immigration Reform Charade

John Boehner says he’d really, really love to pass immigration reform, but darn it, President Obama’s arbitrary and lawless regulatory changes to Obamacare make that impossible. Republicans no longer trust Obama to enforce whatever law they pass, so they’re stuck.

This is a contrivance so obvious that I think most five-year-olds could see through it, but that’s Boehner’s story and he’s sticking to it. So Harry Reid has now made official what used to be merely idle chatter:

“Let’s pass immigration reform today. Make it take effect in 2017. Republicans don’t trust President Obama,” Reid said. “Let’s give them a chance to approve the bill under President Rand Paul or President Theodore Cruz. To be clear, delaying implementation of immigration reform is not my preference. But I feel so strongly that this bill needs to get done, I’m willing to show flexibility.”

….“If they don’t take our offer, then we’re going to have to go to the second step, which is not my preference,” Reid said. “Administrative rules cannot trump legislation but we’re going to have to do what we have to do as we proved with DACA,” he said, referring to Obama’s program to grant deportation relief and work permits to young illegal immigrants who came to the United States as children.

Look: immigration reform is dead. Republicans just aren’t willing to cross their base and pass something. The lawlessness story has never been anything more than a pretense, so Reid’s offer won’t change anything on that front. As for the executive action threat, Democrats have already tried that once before, when they were attempting to pass a cap-and-trade bill. If the bill didn’t pass, they said at the time, Obama would be forced to curb carbon emissions using executive actions. And he’s doing it! So it’s not as if Republicans figure he won’t call their bluff. They know he will. But that’s still not enough.

Nothing would be enough. The tea party has won. They don’t want immigration reform in any guise, and they control the Republican Party these days. That’s the reality, and I think by now everyone knows it. It’s time to stop the charade and move on.

The White House Correspondents’ Dinner was tonight. President Obama told some jokes. Joel McHale told some jokes. None of these jokes were terribly funny, I thought. They weren’t awful, but they weren’t great. McHale sort of “went after” the Beltway types in the room (a la Colbert), which was neat, but I don’t think the jokes themselves were very funny. But who knows, really. Maybe they were? I don’t know. Maybe I’m just not in the right mood.

President Obama Denounces Donald Sterling’s Racist Tirade

At a press conference with Malaysian Prime Minister Najib Razak, President Obama was asked about the audio recording of racist Donald Sterling’s racist comments.

Here are his remarks, courtesy of CNN:

I don’t think I have to…interperet Sterling’s statements for you. They kind of speak for themselves. When people…When ignorant folks want to advertise their ignorance, you don’t really have to do anything, you just let them talk. And that’s what happened here. I have confidence that the NBA commissioner Adam Silver, a good man, will address this. Obviously the NBA is a league that is beloved by fans all across the country. It’s got an awful lot of African-American players. It’s steeped in African-American culture. I suspect that the NBA is going to be deeply concerned in resolving this.

I will make just one larger comment about this. You know, we, the United States, continues to wrestle with a legacy of race and slavery and segregation that’s still there, the vestiges of discrimination. We’ve made enormous strides but you’re going to continue to see this percolate up every so often and I think we have to be clear and steady in denouncing it, teaching our children differently, but also remaining hopeful that part of why some statements like this stand out so much is because there has been this shift in how we view our selves.

The White House released its strategy to cut methane emissions this morning — President Obama’s latest sashay around Congress to pursue climate action (as part of the plan he announced in June).

Methane isn’t the most ubiquitous of greenhouse gases (that’d be good ‘ol CO2), but it is a potent one: The same amount of methane as CO2 has 20 times the impact in terms of future global warming over a 100-year period. While methane emissions have decreased by 11 percent since 1990, we’re still not in good shape: 50 percent more methane is leaking from oil and gas sites than previously thought and, without action, methane emissions are expected to increase through 2030 – mostly thanks to fracking. So far the oil and gas industry has balked at the idea of regulating its methane leaks, saying that it might slow production down (we’ve all heard it before, but, man, frack you!).

Obama’s plan looks at culling methane emissions from four big sources: landfills (methane gets released when all of our biodegradable trash breaks down), leaks from oil and natural gas production, coal mining, and cow farts. The report details how the White House will delegate government agencies to come up with and enforce better standards, i.e. the EPA will manage landfills while the Department of the Interior will handle methane leaks on public lands. It also focuses on ways to capture methane to reuse it for clean energy, such as biogas systems, which can convert cattle waste into fuel. So while we’re not going to replace our cows with less-farty kangaroos, it at least offers options for putting all those bovine leavings to good use.

All of these steps are pretty minor in the face of battling climate change, but the plan overall does have people excited. “Curbing methane is … a big step in the right direction,” David Doniger, director of the Climate and Clean Air Program at NRDC, said in a recent press release. And from Sen. Sheldon Whitehouse: “As climate change continues to harm American communities from the Heartland to the coasts, we must use every tool at our disposal to reduce the greenhouse gas emissions that are causing it … I applaud the President for his ongoing commitment to public health and the environment.”

5 Things You Need to Know About Obama’s NSA Proposal

On Thursday, the White House released its proposal to end the National Security Agency’s bulk collection program, which hoovers up the phone records of millions of Americans. Currently, the NSA stores Americans’ phone metadata (which doesn’t include the content of calls) for five years. Under the President’s new proposal, phone companies will instead be tasked with holding onto this data, which will they will store for 18 months. Additionally, the government would only be allowed to query these records if it gets approval from the Foreign Intelligence Surveillance Act (FISA) court, though the president’s plan includes an exemption for as-yet-unspecified “emergency” situations. Here are five more things you need to know about the President’s proposal:

1. It only addresses the bulk collection of phone records.

The collection of telephone records has gotten a lot of attention from Congress—but documents leaked by former NSA contractor Edward Snowden have revealed many other controversial surveillance programs. Last October, for instance, the Washington Post reported that the NSA had broken Google and Yahoo’s encryption and was siphoning millions of their users records into the agency’s data centers. In a press call on Thursday with civil liberties groups, privacy experts argued that President Obama should make additional reforms that address these other alleged surveillance programs. “Our phone records are sensitive, but so are our financial records, Internet information, email data,” said Michelle Richardson, the ACLU’s legislative counsel. “It reveals who we know, where we go, what we do, what we think and what we believe, and those sorts of records need just as much protection.”

2. Phone companies aren’t too psyched about Obama’s plan, so the administration might compensate them.

On Thursday, Verizon announced that it opposes aspects of the plan. “If Verizon receives a valid request for business records, we will respond in a timely way, but companies should not be required to create, analyze or retain records for reasons other than business purposes,” Randal Milch, Verizon’s general counsel and executive vice president for public policy, said in a statement. In a call with reporters on Thurday, White House officials emphasized that the administration has been meeting with phone companies to come up with a workable solution, which could potentially include compensating them for their efforts. “I certainly would envision, consistent with what the government does today with respect to compensating phone companies and others for their production of records in response to lawful court process, I think we would see a similar approach,” said a senior administration official.

3. The plan is still missing a lot of key details.

According to a press release issued by the Brennan Center for Justice at New York School of Law on Thursday, the Obama administration has yet to “identify the standard that the government must meet to obtain a court order, beyond a vague reference to ‘national security concerns.’ Nor does the fact sheet identify any limits on the government’s ability to keep and search the records it obtains, which will necessarily include large amounts of information about innocent Americans.” In the White House press, a reporter asked senior administration officials how long the NSA could keep querying data once it had obtained a court order. An official responded: “I’m not going to presuppose what that time period would be right now.”

4. Obama could end the program now if he wanted to, but he’s waiting for Congress to act.

President Obama could end the NSA’s bulk collection program without congressional approval, but he’s choosing not to. A senior White House official said on Thursday, “The President believes the government should no longer collect and hold the bulk telephone metadata. He’s also got a responsibility as commander-in-chief to ensure that we maintain the capabilities of this program, and he wants to see it done in a way that also responds to the concerns that have been identified and to create a program and have a discussion about it, and have legislation that would promote confidence in our intelligence-gathering activities.”

5. There are competing bills to end the program. Privacy advocates hate one of them.

On Thursday, privacy advocates took issue with the NSA reform bill introduced this week by members of the House intelligence committee. The bill, sponsored by Rep. Mike Rogers (R-Mich.) and Rep. Dutch Ruppersberger (D-Md.), ends the bulk collection program, but doesn’t require strict judicial review before the NSA queries phone companies for their customers’ records. President Obama’s proposal, in contrast, does require this review. The ACLU’s Richardson notes that the Rogers-Ruppersberger plan would allow the FBI and other agencies to directly demand information from companies. “It’s not a fix, it’s not even a half-measure,” she said. Privacy advocates support the USA Freedom Act, introduced by Rep. James Sensenbrenner (R-Wis.) and Sen. Patrick Leahy (D-Vt.), which includes more civil liberties protections.

President Obama on Thursday announced he would expand sanctions against Russia, targeting individuals who support the government and a bank with ties to these associates, delivering on his warning earlier this week that it would ratchet up costs on Russia if it moved to annex the breakaway province of Crimea.

….Mr. Obama also said he had signed a new executive order that would allow him to impose sanctions Russian industrial sectors, presumably including its energy exports — a step that would dramatically tighten the economic pressure on Russia.

I expect we’ll quickly get a pro forma response about how weak and vacillating this is from Bill Kristol, John McCain, and Charles Krauthammer. I can’t quite get straight precisely what they want, but whatever it is, it’s something higher on the belligerence scale than whatever the appeaser-in-chief is offering up.

Hundreds arrested at anti-Keystone protest in front of White House

Nearly 400 anti-Keystone protestors were arrested on Sunday after zip-tying themselves to a fence in front of the White House. Activist group 350.org characterized the action as the “largest youth civil disobedience at the White House in a generation.”

Those arrested were part of a larger student-led protest coordinated by XL Dissent. Organizers estimated that 1,200 people total participated in the march and rally that called on President Obama and Secretary of State John Kerry to reject plans to build the Keystone XL pipeline.
