The Feds Have a Secret Plan to Stop the Next Car Pollution Scandal

Days after Volkswagen admitted that half a million cars it sold in the US contained software enabling them to evade clean air laws, top Environmental Protection Agency officials said they are planning to toughen emissions testing for all automakers. The EPA now plans to examine vehicles for so-called defeat devices.

In a letter released this morning, the EPA said that federal regulations allow the agency to “test or require testing on any vehicle at a designated location, using driving cycles and conditions that may reasonably be expected to be encountered in normal operation and use, for the purposes of investigating a potential defeat device.” The EPA said it planned to begin conducting these additional procedures when vehicles undergo emissions and fuel economy testing, and it warned that the new procedures “may add time to the confirmatory test process and…additional mileage may be accumulated.”

“We are stepping up our testing,” Janet McCabe, the EPA’s acting assistant administrator, told reporters. “We take seriously our responsibility to oversee the enforcement of clean air regulations. The VW violations have made it clear that we need to adapt our oversight.”

Last Friday, the EPA issued a citation to Volkswagen for equipping nearly 500,000 diesel-powered cars sold since 2009 with software that can detect when the car is undergoing federal testing for smog-forming emissions. During the test, the cars meet the standard; under normal driving conditions, emissions are up to 40 times higher. Similar devices were installed on some 11 million VW cars worldwide, producing illegal air pollution that may contribute to thousands of deaths. The resulting scandal devastated VW’s share value and forced the ouster of its CEO.

The EPA is currently investigating the full extent of the illegal software program and could ultimately deliver up to $18 billion in fines. Today’s announcement doesn’t affect that investigation. Officials said that no recall has been announced and that if one is eventually called for, VW drivers will hear about it directly from the company.

EPA chief Gina McCarthy said the agency is concerned that other automakers could have similar devices that have gone undetected. Even if they don’t, VW is responsible for a new raft of regulatory headaches for all companies that want to sell cars in the US.

Chris Grundler, director of the EPA’s Office of Transportation, wouldn’t say how exactly his agency would sniff out defeat devices. But it would add additional time and rigor to the testing process, he said.

“We’re not going to tell them what the test is,” he said. “They don’t need to know.”

Volkswagen isn’t going to get away with this. You don’t (allegedly!) fake emissions data for a few million cars and just walk away. But what the German automaker’s punishment will be, and how much it’s going to hurt—those are still open questions.

The final decision will be up to lawyers at the US Environmental Protection Agency and Department of Justice. That latter agency has opened a criminal probe into the company’s (alleged!) emissions software tampering shenanigans. But based on precedent and the outlines of what Volkswagen actually seems to have done, we can make a few predictions.

If US officials absolutely throw the book at VW, EPA rules stipulate a maximum fine of $37,000 per affected car. At 482,000 cars on American roads, that comes to $18 billion. But according to attorneys who work on these kind of cases, that number is way too high for what’ll actually happen. The biggest fine of this kind to date was $1.2 billion, a criminal penalty that Toyota paid in 2014 for concealing information about faulty ignition switches that triggered sudden accelerations.

It’s unclear whether Elon Musk is a comic book character come to life, or whether we’re all just comic book characters living in his world on the floor of some middle schooler’s bedroom. Either way, Musk is probably watching from a secret lair right about now, doing some serious Mr. Burns-style finger-tenting and muttering “Eeexcellent” — until an assistant pops in to feed him his latest experiment in food replacement technology.

Earlier today, Hyperloop Transportation Technologies (HTT), the startup that’s trying to build Musk’s proposed Hyperloop — a super fast and super sci-fi-ish people launcher that could (in theory) get commuters from L.A. to San Francisco in 30 minutes — announced three new partnerships with an engineering design firm, a Swiss technology company, and an architecture firm. (Note: The Hyperloop is not to be confused with Musk’s other big ideas: saving the planet with solar power and colonizing Mars.)

HTT CEO Dirk Ahlborn also announced that it now has 400 “team members” from places like NASA, Boeing, Tesla, and SpaceX, who have made minimum weekly commitments to the project in exchange for stock options. The company is planning to break ground on a five-mile test track in California’s Central Valley in May of next year.

Wired spoke with Carl Brockmeyer, the head of business development at Oerlikon Leybold Vacuum, one of HTT’s new partners, about the collaboration:

Oerlikon has put a half dozen employees on the project. They’re simulating how much energy it would take to clear the Hyperloop tube to near zero pressure, and what it would cost. Brockmeyer declined to give exact figures, but says “you will be surprised” by how little energy is required. In fact, he says the energy could be generated by the solar panels and wind turbines Ahlborn plans to erect in Quay Valley. All that aside, there’s another reason Oerlikon signed on.

“I thought, ‘Traveling in a vacuum tube? This is something we should be involved in,’” Brockmeyer says.

Aecom, the engineering design firm that HTT is teaming up with, helped build the Barclays Center in Brooklyn and is currently working on London’s 62-mile Crossrail tunnel. Aecom’s vice president of new ventures told Wired that he thinks HTTs plans are “very realistic.”

Presumably, all 400 people working on the project think the hyperloop is at least somewhat realistic (although we’re still waiting for proof). That is, unless this is all just a coverup for what Musk really wants to build in California’s Central Valley. DUN DUN DUUUUN! Stay tuned for the next issue of … what? If we were all living in a comic book, what would it be called?

Uber Drivers in California Are Employees, Labor Commission Rules

California’s Labor Commission just delivered what could potentially be a significant blow to Uber’s business model. After a former driver sued to be reimbursed for driving expenses, the commission ruled that drivers working for the popular ride-hailing app are employees, not independent contractors.

“The defendants hold themselves out as nothing more than a neutral technological platform, designed simply to enable drivers and passengers to transact the business of transportation,” the commission wrote in its ruling. “The reality, however, is that defendants are involved in every aspect of the operation.”

The ruling, which for now only applies to California drivers, is the result of a claim filed back in September by Barbara Ann Berwick, a former Uber driver. Berwick argued she was owed payment for expenses, such as mileage, incurred while working for the company, but Uber insisted that she was only an independent contractor and therefore not eligible for reimbursement. On Tuesday, the commission ordered the company to pay Berwick $4,000 in expenses.

The difference in classification is significant, as an employee status may force Uber to provide drivers benefits such as social security, health insurance, and unemployment insurance. Uber is in the process of appealing the decision.

Pretty soon, bikers in San Francisco won’t just have the moral high ground over cars: They’ll literally ride on higher ground.

The city plans to install new elevated bike lanes that will not only keep cyclists safe from speeding cars, but also give them a better vantage point from which to flip off the drivers of said cars. Here’s CityLab with the details:

The city’s Municipal Transportation Agency will oversee the construction of an elevated pathway on Valencia Street in the southern Mission District. The curb-hugging lane will be raised about 2 inches above the road surface, and will measure 6-feet wide with an additional 5-foot “buffer zone.” The city will follow up with a handful of other raised lanes next year, all planned for areas with high rates of bicycle injuries.

Of course, this is already a thing in Europe, where cyclists rule and drivers drool:

Raised lanes are a relatively new concept in the United States, though they’ve been around for a while in Europe. The idea is that by jacking up the path a bit, motorists will be less likely to stray into cyclist space. Cyclists, meanwhile, won’t feel as compelled to ride on the sidewalk in heavy-traffic corridors. It’s a minimalist form of what’s known as a protected bike lane, and one that’s not as in-your-face as, say, defensive lines of bollards or planters.

You can imagine the city of San Francisco is a lot like a mom (let’s call her Fran) with three kids: the jerky eldest (Auto), the quiet middle child (Walker), and the quirky and rebellious younger one (…Bike? Wheeler?), and this is Fran’s way of saying “Auto, Bike — stop hitting each other! And leave your poor brother Walker alone; if he just wants to sit by himself and read, let him!”
