Covered California, my state’s version of Obamacare, announced some discouraging results yesterday. Among the uninsured, lots of people know about the tax penalty for not buying insurance, but a full third have no idea that subsidies are available to reduce the cost of buying coverage. Here’s what they’re doing about it:

Based on the survey results, as well as a review of research from a wide range of other sources (including those who have enrolled), Covered California has refined its comprehensive outreach campaign aimed at reaching the uninsured in their communities, through Navigator grants to community organizations; support for more than 18,000 Certified Insurance Agents; and promotion of storefronts where consumers can get free, confidential help enrolling.

The outreach campaign will include a new television, radio, digital and outdoor advertising campaign to reach multi-segment, Hispanic, Asian and African-American audiences. Details about the campaign and television ads, the route of the “Spotlight on Coverage” bus tour and new dental coverage will be released next week.

Meh. I have taken the liberty of creating a punchier campaign. Just running this up the ol’ flagpole to see if anyone salutes, you understand. Of course, we’ll need to rework the website too if we want to create a disruptive culture that appeals to people who like free money. And TV too. I’m thinking of a micro-targeting campaign that uses big data analytics to reach our SES demo, and impacts eyeballs with maximum penetration at minimal cost. And let’s not forget social media either. Those guys love free stuff. Let me know what you think.

"Employees Are Bitter" as Whole Foods Chops Jobs and Wages

Whole Foods Market co-CEO and co-founder John Mackey has never hidden his disdain for labor unions. “Today most employees feel that unions are not necessary to represent them,” he told my colleague Josh Harkinson in 2013. That same year, Mackey echoed the sentiment in an interview with Yahoo Finance’s the Daily Ticker. “Why would they want to join a union? Whole Foods has been one of Fortune‘s 100 best companies to work for for the last 16 years. We’re not so much anti-union as beyond unions.”

On September 25, the natural-foods giant gave its workers reason to question their founder’s argument. Whole Foods announced it was eliminating 1,500 jobs—about 1.6 percent of its American workforce—”as part of its ongoing commitment to lower prices for its customers and invest in technology upgrades while improving its cost structure.” The focus on cost-cutting isn’t surprising—Whole Foods stock has lost 40 percent of its value since February, thanks to lower-than-expected earnings and an overcharging scandal in its New York City stores.

Sources inside the company told me that the layoffs targeted experienced full-time workers who had moved up the Whole Foods pay ladder. In one store in the chain’s South region, “all supervisors in all departments were demoted to getting paid $11 an hour from $13-16 per hour and were told they were no longer supervisors, but still had to fulfill all of the same duties, effective immediately,” according to an employee who works there.

I ran that claim past a spokesman at the company’s Austin headquarters. “We appreciate you taking the time to reach out and help us to set the record straight,” he responded, pointing to the press release quoted above. When I reminded him that my question was about wage cuts, not the announced job cuts, he declined to comment.

Another source, from one of Whole Foods’ regional offices, told me the corporate headquarters had ordered all 11 regional offices to reduce expenses. “They’ve all done it differently,” the source said. “In some regions, they’ve reduced the number of in-store buyers—people who order products for the shelves.”

I spoke with a buyer from the South region who learned on Saturday that, after more than 20 years with the company, his position had been eliminated. He and other laid-off colleagues received a letter listing their options: They could reapply for an open position or “leave Whole Foods immediately” with a severance package—which will be sweetened if they agree not to reapply for six months. If laid-off employees manage to snag a new position that pays less than the old one did, they are eligible for a temporary pay bump to match the old wage, but only for a limited time.

Those fortunate enough to get rehired at the same pay rate may be signing up for more work and responsibility. At his store, the laid-off buyer told me, ex-workers are now vying for buyer positions that used to be handled by two people—who “can barely get their work done as it is.”

My regional office source told me that the layoffs and downscaling of wages for experienced staffers is part of a deliberate shift toward part-time employees. Whole Foods has “always been an 80/20 company,” the source said, referring to it ratio of full- to part-time workers. Recently, a “mandate came down to go 70/30, and there are regions that are below that: 65/35 or 60/40.” Store managers are “incentivized to bring down that ratio,” the source added.

Employees working more than 20 hours per week are eligible for benefits once they’ve “successfully completed a probationary period of employment,” the Whole Foods website notes. But some key benefits are tied to hours worked. For example, employees get a “personal wellness account” to offset the “cost of deductibles and other qualified out-of-pocket health care expenses not covered by insurance,” but the amount is based on “service hours.”

And part-time employees tend not to stick around. My regional source said that annual turnover rates for part-timers at Whole Foods stores approach 80 percent in some regions. According to an internal document I obtained, the national annualized turnover rate for part-time Whole Foods team members was more than triple that of full-timers—66 percent versus about 18 percent—in the latest quarterly assessment. “Whole Foods has always been a high-touch, high-service model with dedicated, engaged, knowledgeable employeesâ&#128;&#139;,”â&#128;&#139; the source said. “How do you maintain that, having to constantly train a new batch of employees?”

Of course, Whole Foods operates in a hypercompetitive industry. Long a dominant player in natural foods, it now has to vie with Walmart, Trader Joe’s, and regional supermarket chains in the organic sector. Lower prices are key to staying competitive, and in order to maintain the same profit margins with lower prices, you have to cut your expenditures. Whole Foods’ labor costs, according to my regional source, are equal to about 20 percent of sales—twice the industry standard.

It’s not unusual for a publicly traded company to respond to a market swoon by pushing down wages and sending workers packing. But Whole Foods presents itself as a different kind of company. As part of its “core values,” Whole Foods claims to “support team member employee happiness and excellence.” Yet at a time when the company’s share price is floundering and its largest institutional shareholder is Wall Street behemoth Goldman Sachs—which owns nearly 6 percent of its stock—that value may be harder to uphold.

Workers join unions precisely to protect themselves from employers that see slashing labor costs as a way to please Wall Street. “There’s a fear of unions coming in, because employees are bitter,” the regional-office source said. “People talk about it in hushed tones.”

Obamacare Has Now Been MIA in Two Debates

In the first Republican debate, Obamacare was barely mentioned. Over at National Review, Ian Tuttle notes that last night it was also MIA:

Beyond a few brief in media res mentions from candidates, a repeal line in Cruz’s closing address, and an allusion or two (e.g., the question about John Roberts), the president’s signature piece of legislation was a non-issue.

Which makes one wonder: Is it a non-issue?….I suspect that the anti-Obamacare fervor is in a period of quiescence. We have now seen Obamacare implemented sans “death spiral.” The website works. The Supreme Court has handed the Obama administration two affirmative Supreme Court decisions. And the president has made sure to do much in the interim — immigration executive actions and Iran deals, for example — to draw fire away from his healthcare law. Conservative heads have a limited supply of steam.

Tuttle is right. Obamacare has become a brief, pro forma applause line these days, but not much more. Partly this is for the reason Tuttle rather surprisingly concedes: It’s up, it’s running, and it’s working reasonably well. The nation still stands, and it’s hard to keep whipping up hysteria for years and years over something that, it turns out, just isn’t affecting all that many people.

I don’t think this means that Obamacare is going away as a political issue. But I do think that the repeal movement has lost a lot of steam as a winning issue for Republicans. The tea party types are starting to realize that nothing in their lives has changed, and the more moderate types realize—maybe via personal experience, maybe via news reports—that it’s doing a lot of good for poor and working class folks. So it’s become something of a wedge issue: Pounding on it loses about as many votes as it gains.

This is becoming a real problem for the GOP. A lot of issues that used to be pretty reliable winners have now turned into dangerous wedge issues: gay marriage, taxes, terrorism, illegal immigration, military adventurism, abortion, crime, education, global warming, Ukraine, free trade, Social Security cuts—the list goes on and on. And this is coming at the same time that their bread and butter, the angry white guy demographic, is declining. I’m not sure what they’re going to end up doing about this. The GOP has a tough decade ahead.

Black Lives Matter Comes Through With a Plan

A few weeks ago, after the disruption at Netroots Nation, I wondered aloud what the Black Lives Matter movement actually wanted. What were their demands? What did they want from candidates for president? I found a list of items on their website, but they were vague enough and broad enough to keep me a little puzzled. What sort of concrete initiatives were they interested in?

I’m happy to see that they’ve now come up with exactly what everyone’s been asking for. It’s called Campaign Zero, and it even comes with its own nifty graphic:

Some of these are easy: police body cams, for example, have become widely supported on both right and left, and by both activists and police. Others are a little harder: independent investigations of police shootings and better representation of minorities on police forces aren’t universally supported, but they do have fairly wide backing already. And some are more difficult: it will be tough to wean police forces off their up-armored humvees and challenging to end the vogue for broken-windows policing.

That said, these are all specific and achievable goals. They even have a fact sheet here that tracks some of the presidential candidates and where they stand on each issue. Ironically, Bernie Sanders has positions that at least partly address eight of the ten items—more than anyone else. Martin O’Malley has seven and Hillary Clinton has two so far.

This is good stuff. BLM won’t get everything it wants—nobody ever does—but Campaign Zero should allow them to avoid the fate of Occupy Wall Street, which generated a ton of passion but never really offered any place to channel it. BLM has now done both, and has a good shot at making their issues important ones during the upcoming presidential campaign.

Hillary Clinton hauled in $47.5 million in the first three months of her campaign, besting both Republican Jeb Bush, who raised $11.4 million, and her surprising Democratic challenger, Bernie Sanders, who racked up $15.2 million. According to her campaign, she had more than 250,000 donors, of whom 61 percent were female, an unprecedented number of female donors. But what Clinton did not highlight was that she had relied on wealthy donors and lobbyists to pull together most of her money.

Clinton reported raising $8 million—or 16.8 percent of her total—from small donors who gave $200 or less. Many politicians raise far less from small donors. Jeb Bush, for example, raised just 3 percent of his campaign cash from small donors. But Sanders blew Clinton out of the water when it came to grassroots fundraising, taking in $10.4 million (or 68 percent) of his warchest from $200-or-less donors.

Science Is Ignoring its “Publication Pollution” Problem

In a damning op-ed published Friday, Arthur Caplan, a medical ethicist at NYU’s Langone Medical Center, called out scientists who are turning a blind eye to the scientific publishing industry’s “publication pollution problem.” At the root of the matter: pay-to-publish journals with weak or nonexistent pre-publication review standards that are “corroding the reliability of research.” As he wrote in the Mayo Clinic Proceedings, “neither the leadership nor those who rely on the truth of science and medicine are sounding the alarm loudly or moving to fix the problem with appropriate energy.”

Consider this recent experiment, as described in the (unfortunately paywalled) commentary:

Harvard researcher Mark Shrime recently wrote an article entitled Cuckoo for Cocoa Puffs?: The Surgical and Neoplastic Role of Cacao Extract in Breakfast Cereals.The fake authors he chose for the piece were Pinkerton A. LeBrain and Orson Welles. Shrime submitted this fake article to 37 journals. At last count, 17 had accepted the obviously phony, nonsensical paper. John Bohannon did the same thing with a completely phony paper, with even more depressing results in terms of peer reviewed acceptance to journals. The journals that took these gibberish-laden, concocted articles were scam, author-must-pay, profit driven entities that nevertheless have every appearance of being legitimate journals.

“Predatory publishers” create a seeming win-win situation: the publisher makes money and the author gets a journal article published—currency in the world of science and academia. The result?

Predatory, pay-to-publish, non-peer-reviewed journals flood disciplines with bad or fake science, making it hard, much as light pollution does, to see the real stars. Worse, publication pollution lessons the impact of legitimate science in the formation of public policy, undermining public health, weakening the overall value of legitimate publications in influencing policy, and creating opportunities for the continued power of crackpot views that corrode many areas of public life, such as vaccination, fluoridation, and the prevention and treatment of diseases, such as autism, AIDS, and cancer.

Jeffrey Beall, a University of Colorado librarian who wrote a similar op-ed in Nature in 2012, estimates these publishers make up a whopping 25 percent of all open-source journals. Beall maintains an ongoing list of “potential, possible, and probable” predatory publishers on his website, Scholarly Open Access. He’s identified over 1,300 such publishers and journals to date.

James O’Keefe Loses Libel Suit Over Landrieu Incident

Conservative filmmaker and provocateur James O’Keefe has lost another legal battle: on Monday, a federal court in New Jersey dismissed a libel suit O’Keefe filed against legal news website MainJustice. In August 2013, MainJustice published an article referring to a 2010 incident in which O’Keefe and his associates posed as telephone technicians to gain access to the offices of then–Sen. Mary Landrieu (D-La.). O’Keefe and three others ultimately pleaded guilty to the misdemeanor charge of entering federal property under false pretenses.

In its original article, MainJustice said that O’Keefe was “apparently trying to bug” Landrieu’s offices. After O’Keefe complained, the website changed the sentence to read that O’Keefe and his associates “were trying to tamper with Landrieu’s phones.” Still, O’Keefe sued, alleging that both characterizations were defamatory because they implied he had committed a felony. MainJustice countered that the language wasn’t defamatory because the substance of the article was true, and the site accurately described the legal proceedings triggered by the episode.

The court didn’t find O’Keefe’s case convincing. Judge Claire Cecchi wrote in her opinion:

Regardless of whether the article used the words “apparently trying to bug” or “trying to tamper,” the few words challenged by the Plaintiff, taken in context, do not alter the fundamental gist of the paragraph… Therefore, the words “trying to tamper with,” understood in the colloquial sense, convey the substantial truth of the Landrieu incident and do not alter the ultimate conclusion of the paragraph—that Plaintiff was guilty of a misdemeanor.

Mary Jacoby, editor-in-chief of MainJustice, writes in a statement:

This is an important First Amendment victory. It’s a total, resounding defeat of O’Keefe’s attempts to intimidate journalists into accepting his spin on the circumstances of his 2010 entry into Sen. Landrieu’s offices under false pretenses.

In 2013, O’Keefe paid $100,000 to settle a lawsuit filed against him by a former employee of ACORN, a nonprofit the filmmaker had targeted. In a statement to Mother Jones, an O’Keefe spokesman said, “While we are disappointed in the Court’s decision, it is one that we respect due to the complex and difficult nature of proving defamation. That being said, we think it is important to note that this decision in no way validates any of the false statements made against Project Veritas or James O’Keefe.”

Last year, as Obamacare finally went into full effect, the ranks of the uninsured began to drop sharply. Despite all the website problems and the repeated predictions of doom from conservatives, it turned out that Obamacare was working well. Then things stabilized as open enrollment ended. Today, Gallup released new results for the final quarter of 2014, which marked the start of Obamacare’s second year of enrollment, and guess what? The ranks of the uninsured are dropping yet again. The percentage of adults without health insurance dropped from 13.4 percent to 12.9 percent:

The Affordable Care Act has accomplished one of its goals: increasing the percentage of Americans who have health insurance coverage. The uninsured rate as measured by Gallup has dropped 4.2 points since the requirement to have health insurance or pay a fine went into effect. It will likely drop further as plans purchased during the current open enrollment period take effect. The Department of Health and Human Services reported that 6.5 million Americans either selected new plans or were automatically re-enrolled into a plan via HealthCare.gov as of Dec. 26, 2014.

….Other signs also point to the uninsured rate falling more after this open enrollment period ends. HHS continues to focus on the financial assistance available to enrollees and increasing the fine for not having health insurance….The uninsured rate could also fall further as more states expand Medicaid.

The uninsurance rate has dropped the most among blacks, Hispanics, the young, and the poor. It’s dropped by only a small amount among the middle classes, since they’re mostly insured already by their employers. But even right smack in the middle, uninsurance rates have dropped by three percentage points. Obamacare just keeps on working, and it’s working for everyone.

How You Can Fake Solving a Rubik’s Cube

Matt Parker isn’t your average stand-up comedian. He doesn’t draw his material from the banalities of everyday life, like many of his peers. His routine substitutes equations and mathematical concepts for toilet humor and political jabs. And the audience loves it.

So how did he become a mathematical comedian? “During the day, I was teaching math to teenagers, and then in the evening, I was telling jokes to drunk people in comedy clubs—which actually is a surprisingly similar skill set,” explains Parker on the latest episode of the Inquiring Minds podcast. He says he gradually began to work bits about “what it’s like to be a nerd” into his routines, and eventually “people started showing up expecting me to talk about math.”

“This is my ideal Venn diagram,” adds Parker. “If I can do math and stand-up at the same time, that’s brilliant.”

Parker has also just released a book—Things to Make and Do in the Fourth Dimension—packed full of clever jokes and a lot of really interesting math. What sets it apart from a number of other recent math books is the fact that the reader is encouraged to actually do some math, rather than just read about it. “I put in loads of puzzles, hands-on activities, things you can build,” says Parker. “And you can read the book without doing them, but if you want to, you can get your hands dirty.”

This is the appeal of Parker’s brand of math: He wants you to not just understand the concepts, but to be able to use them to impress your friends. Take a look at the video above, for example, in which he describes how to cheat your way into “solving” a Rubik’s Cube in fewer than three minutes. (It might even help you get into Princeton.)

If that isn’t impressive enough, try this hack: Tell your buddies that you have the magical ability to recognize fake credit card numbers. Have them write down a series 16-digit numbers, one that they copy from an actual credit card and several that they just make up. Now, starting with the first digit in each sequence, take every second digit and double it. If doubling a digit produces a two-digit answer, add those two digits together. You should now have eight new digits. Add up all these new digits along with the eight remaining digits that you didn’t double. If the result is a multiple of 10, it could be a real credit card number. If not, you have one of your friends’ randomly-generated foils. “The reason we put that strange pattern in there,” explains Parker, is that “when you type it into a website, the website can do that calculation. If the answer is not a multiple of 10, it knows it’s not a real card.”

Parker bemoans the fact that many people don’t realize how much math affects their daily lives. “They think that math isn’t helping when, in fact, it is!” he exclaims. “It’s making their lives possible.”

But even Parker took a detour in his education before committing to a life in mathematics—the “dark days” in college when he was studying mechanical engineering. “I got about halfway through a mech-eng degree before I realized that if I finished it, it would leave me dangerously employable,” he jokes. “And I also realized that what I really liked was just doing the equations—that it was the actual math behind the engineering that set my world on fire.”

So what is it about math that ignites Parker’s passion? “It’s basically like a murder mystery,” he says. What can make an otherwise decent thriller turn sour is if there’s a nonsensical ending—if the author just brings in a random character at the very end and calls him the murderer, the reader will lose interest in that author’s work. “But a good book, you get to the end and go, ‘Oh, that makes sense, there were hints all along,'” says Parker. “And that’s mathematics. You get to the end, you go, ‘That was hard work, but it’s great.'”
