A slight setback at the Supreme Court doesn’t change the fact that we’re winning the war on carbon pollution. gvgoebel/Flickr The political war surrounding the government’s efforts to limit emissions is ending not with a bang but a whimper. “It bears mention that EPA is getting almost everything it wanted in this case,” Justice Antonin Scalia said on Monday while announcing the 5–4 verdict in Utility Air Regulatory Group v. EPA. Technically, though, the ruling was a slight loss for the EPA. The majority found that the agency’s efforts to force any fixed operation that emits pollutants to get permission before it expands was an overreach of the agency’s authority. But the ruling also upheld the ability of the EPA to force power plants and other operations that emit pollutants to adhere to its new standards. The way Scalia saw it, the decision lets the EPA regulate 83 percent of greenhouse gas emissions, instead of the 86 percent it could regulate under the authority it abrogated unto itself. “To permit the extra 3 percent, however, we would have to recognize a power in EPA and other government agencies to revise clear statutory terms,” Scalia said, adding that would contradict “the principle that Congress, not the president, makes the law.” To keep reading, click here. Dirty Money: From Rockefeller to Koch

Catholic University’s decision to accept $1 million from the Charles Koch Foundation to support the study of “principled entrepreneurship” is like a modern-day reenactment of 1905′s “tainted money affair.” Catholic University of America. NCinDC/flickr Last November, the Catholic University of America announced a pledge of $1 million from the Charles Koch Foundation to support the study of “principled entrepreneurship” at the university’s new business school. As the billionaire funder of various libertarian causes and much of the Tea Party movement, Koch (along with his brother David) is not exactly a stranger to controversy. But his foundation has made gifts to many educational institutions in the past—its website lists 270 colleges and universities it supports, including more than two dozen Catholic schools—with only the occasional stir of opposition. And so he might have assumed that his gift would be met with a press release and that mild mix of gratitude and entitlement with which the public now greets most seven-figure gifts to educational and cultural institutions. After all: Who doesn’t like principled entrepreneurship? Yet, this time, the gift to Catholic (CUA) caused more than a stir. In fact, from a significant swath of the broader Catholic community it provoked something close to outrage. As things stand today, the outcry hasn’t managed to scuttle the donation. But it has the chance to do something even more important: to renew a vital and century-long debate about the terms of philanthropy itself. There are two reasons why Koch’s gift did not slide tranquilly into Catholic’s coffers. One is that CUA holds a unique status among American institutions of Catholic higher education; both because of CUA’s national profile and because U.S. bishops founded it and sit on its board, American Catholics tend to be especially defensive about its reputation. The other is that Koch’s gift coincided with a moment of mounting confidence among Catholic progressives, who have found an ally in Pope Francis. In fact, just a little more than a week after CUA announced Koch’s donation, the Pope issued his first major public pronouncement, denouncing the “deified market,” the folly of supply-side economics, and the “new tyranny” of unfettered capitalism. Global warming means more heavy rainfall…and more drought. NOAA Squelch, squelch, squelch – that could be the sound of future America, if predictions about how climate change will ramp up “extreme rainfall” prove accurate. Say the world’s nations do little to reduce the amount of greenhouse gases pouring into the atmosphere. By the years 2041 to 2070, the warmer climate could bring torrential downpours to vast parts of the United States, as shown in this model from NOAA. Dark-blue splashes depict areas that might see as many as two or more days a year of extreme rain, defined as “rainfall totals in excess of the historic 98th percentile.” (This is against a 1971 to 2000 baseline.) Cities that should maybe consider wooing the umbrella-manufacturing industry include Seattle, Washington; Portland, Oregon; Boise, Idaho; Richmond, Virginia; and much of the Northeast. Louisiana’s Coastline Is Disappearing Too Quickly for Mappers to Keep Up

Climate change and development are accelerating coastal erosion. The area south of the town of Buras, Louisiana, in 1990 (left) and today (right). NOAA has retired the names English Bay, Bay Jacquin, and Scofield Bay, acknowledging the vast water that now separates Buras from the barrier along Pelican Island (NOAA Chart 11358) Twenty-five years ago, miles of marshy land and grasses separated the small fishing outpost of Buras, Louisiana, from the Gulf of Mexico. But years of erosion – along with the one-two punch of Hurricanes Katrina and Rita – have washed away much of that barrier. Today, the islands, inlets, and bays that once defined the coastline of Plaquemines Parish have begun to melt together. Like all coasts, the land around the Mississippi River is constantly evolving. In past centuries, that process was slowed by the annual flooding of the River’s vast delta, which brought new sediment to replace what was lost. But climate change, coupled with better engineering (which brought effective channeling and stronger levees), have turned this coastline into one of the most rapidly eroding areas of the U.S. In the area around Buras, gone are the formerly distinct waterways of English Bay, Bay Jacquin, and Scofield Bay, leaving a vast expanse of water between the mainland and the barrier islands. How To Make Natural Gas More Climate-Friendly

We have the technology to clean up fracking, but we can’t trust industry to use it voluntarily. LonnyG/Thinkstock This is a story about natural gas leakage, and we’re not talking about what happens after your grandfather says, “Pull my finger!” Recent reports in journals such as Science and the Proceedings of the National Academy of Sciences have carried some depressingnews: Natural gas, the “bridge fuel” touted by President Obama for its lower CO2 emissions and domestic abundance, may not actually be better for the climate than coal. Natural gas is mostly methane, which is half as carbon intensive as coal when it’s burned, but when it’s released directly into the atmosphere, it’s 86 times worse for the climate than CO2 over a 20-year time frame. Rampant methane leakage in the fracking process and from pipelines raises natural gas’s total greenhouse gas emissions; the studies estimate that more than 2 percent of gas in the U.S. may escape through leaks. It doesn’t have to be this way. The technology already exists to dramatically reduce methane leakage for a reasonable price. Environmental groups have put out reports outlining how. They could serve as a template for the oil and gas industry to follow voluntarily, or for the EPA to require under the Clean Air Act. Read the rest at Grist. Al_HikesAZ/Flickr WASHINGTON — This year marks the 50th anniversary of the Wilderness Act, the law that created a new designation for public lands that retain their “primeval character and influence.” Yet the only thing Congress has preserved in the last four years is its record dry spell, having designated no new areas of the country for protection under that law since 2009. The 112th Congress, in 2010 and 2011, was the first since the law’s passage to fail to designate any new wilderness. And now, halfway through the 113th Congress, it’s unclear whether any more will be designated this session, either. The lack of new designations “speaks to the broader dysfunction of Congress,” said Paul Spitler, director of wilderness campaigns at the Wilderness Society. “They seem to have lost the ability to compromise and move forward.” While there are other designations for public lands, such as parks, national forests and wildlife refuges, wilderness is the highest protection that can be given to wild lands. Such areas are off-limits to drilling, logging, roads and most motorized vehicles. The Wilderness Act of 1964 defined the areas it sought to protect simply: “A wilderness, in contrast with those areas where man and his own works dominate the landscape, is hereby recognized as an area where the earth and its community of life are untrammeled by man, where man himself is a visitor who does not remain.” To keep reading, click here.
